This brief tour of American law has demonstrated a little of the breadth and currency of legal liability actions which affect nursing. As health care changes and nursing roles change with it, so too will the nature of liability in this area. The American penchant for litigation is such that the chances of disentangling nurses from the continued onslaught of negligence litigation seem remote.

Critics of SRI have said little about the integrity of corporate representations resulting in screening inclusion or exclusion. This is surprising given social and environmental accounting research that finds corporate posturing and deception in the absence of external verification, and a parallel body of literature describing corporate "greenwashing" and other forms of corporate disinformation. In this paper I argue that the problems and challenges of ensuring fair and accurate corporate social reporting mirror those accompanying corporate compliance with law. We report an experiment investigating the “special-process” theory of insight problem solving, which claims that insight arises from non-conscious, non-reportable processes that enable problem re-structuring. We predicted that reducing opportunities for speech-based processing during insight problem solving should permit special processes to function more effectively and gain conscious awareness, thereby facilitating insight. We distracted speech-based processing by using either articulatory suppression or irrelevant speech, with findings for these conditions supporting the predicted insight facilitation effect relative to silent working or thinking (...) aloud. The latter condition was included to investigate the currently contested effect of “verbal overshadowing” on insight, whereby thinking aloud is claimed to hinder the operation of special, non-reportable processes. Whilst verbal overshadowing was not evident in final solution rates, there was nevertheless support for verbal overshadowing up to and beyond.. (shrink)

This article critically considers Castoriadis’ central concept of creation ex nihilo. It does so in two ways. It first draws on recent research to suggest that the historical inauguration of the project of autonomy in ancient Greece - in both its political and philosophical aspects - was more complex and contextually anchored than Castoriadis acknowledges: it did not surge forth out of nothing. Second, it considers the idea of creation from a theoretical perspective. Here the idea of creation as contextual (...) rather than absolute is offered. Within this suggested qualification, two lines of discussion - drawn from the hermeneutical and phenomenological traditions - are broached. (shrink)

In her 2003 article in the British Medical Journal, Ruth Macklin provocatively declared dignity to be a useless concept: either a vague restatement of other more precise values, such as autonomy or respect for persons, or an empty slogan. A recent response to Macklin has challenged this claim. Doris Schroeder attempts to rescue dignity by positing four distinct concepts that fall under the one umbrella term. She argues that much of the confusion surrounding dignity is due to the lack of (...) disambiguation among these four concepts, but that once we understand the different values in question dignity becomes a powerful tool in the fields of human rights and bioethics. It is the goal of this paper to build upon Schroeder's insights by reconnecting the multiple strands of dignity she identifies. It will be argued that the usefulness of dignity as a guiding principle in medical ethics can be much improved by identifying the single conceptual link that ties together the various values flying under its banner. That conceptual link is provided by understanding dignity as the capacity to live by one's standards and principles.

'International' and 'internationalisation' are two terms frequently used today in association with the university. In this paper I consider the way in which the notion of internationalisation connects to the contemporary university, which I have termed 'Neo-liberal'. I begin by outlining the main characteristics of the contemporary university and then discuss some of the problems that arise in relation to the notion of internationalisation; it is strongly associated with an economic rather than a cultural imperative. Alternatives to the Neo-liberal model (...) of the university are then considered and rejected. In the final section of the paper I suggest a different interpretation of internationalisation, one that is cultural rather than economic because such an internationalisation degenerates into instrumentalism and robs higher education of what should be essential to it. An experiment is reported examining dual-process models of belief bias in syllogistic reasoning using a problem complexity manipulation and an inspection-time method to monitor processing latencies for premises and conclusions. Endorsement rates indicated increased belief bias on complex problems, a finding that runs counter to the “belief-first” selective scrutiny model, but which is consistent with other theories, including “reasoning-first” and “parallel-process” models. Inspection-time data revealed a number of effects that, again, arbitrated against the selective scrutiny model. The most striking inspection-time (...) result was an interaction between logic and belief on premise-processing times, whereby belief - logic conflict problems promoted increased latencies relative to non-conflict problems. This finding challenges belief-first and reasoning-first models, but is directly predicted by parallel-process models, which assume that the outputs of simultaneous heuristic and analytic processing streams lead to an awareness of belief - logic conflicts than then require time-consuming resolution. This article offers an unprecedented close reading of the poetic texts created by the Martinican author René Ménil, whose poetry has been almost entirely neglected by scholars to date and who is better known for his philosophical and political writings than for his verse. I pay particular attention to Ménil’s treatment of geographical and cultural spaces in his published poetry from 1932 to 1950, and place that verse in dialogue with a text by another Martinican author at work around this (...) period: Edouard Glissant, and his first poetry collection, Un champ d’îles. Despite their otherwise dissimilar literary approaches, I show how both Ménil and Glissant created verse in these years where landscapes shift unpredictably, where human subjects are often overwhelmed, and where bewildering, vertiginous contact between Europe and the Caribbean is emphasized. This stands in contrast to more descriptive or directly political depictions of local nature created by other Afro-Caribbean poets during the period, and, I argue, underscores the complexities of the unsettling encounters between places and peoples occurring with increasing frequency in these years of rapid change around the Second World War. Given the nature of integrated healthcare settings, social workers may encounter unprecedented ethical challenges. Efforts to institutionalize ethics in corporations have been discussed without first addressing the desirability of norm conformity or the possibility that the means used to elicit conformity will be coercive. This article presents a theoretical context, grounded in models of social control, within which ethics initiatives may be evaluated. Ethics initiatives are discussed in relation to variables that already exert control in the workplace, such as environmental controls, organizational controls, and personal controls.

In the UK, as elsewhere in the world, the global financial crisis has focused attention on the cost of public services and the need to reduce expenditure, not least in respect of higher education. This, however, raises a set of prior questions: What kind of society do we want? What is important to democratic society? What kind of higher education is desirable? The article takes Alasdair MacIntyre's critique of what he calls liberal capitalist society as a starting point for considering (...) questions concerning the kind of higher education that would be valuable and relevant to a healthy democratic society. His thesis is outlined and the implications of this for the university set out. The article examines MacIntyre's notion of community, which he elaborates in relation to medieval religious worldviews, and argues that whilst his conceptualisation is more intellectually and educationally coherent than some others, it is ultimately too restrictive. The article argues instead for a recognition, within education, of what is uncommon. This may open greater possibilities for keeping alive the serious questions that we must constantly attend to, beyond and within our communities, secular or religious. (shrink)

This essay considers Paul Ricœur’s early notion of cultural memory from 1956-1960. He discusses it in two texts: “What does Humanism Mean?” and the slightly later The Symbolism of Evil. In the former, cultural memory appears as an ongoing and dynamic process of retroaction focussed on questioning and rethinking the meaning of classical antiquity for contemporary worlds, on the one hand, that is linked to an important critical aspect as a counterweight to the flattening effects of modernity, on the other. (...) In the latter, cultural memory expands the reach of the classical heritage, and, in addition to retroaction, further modes of orientation, such as relations of depth and breadth, are delineated. At first glance, cultural memory, in Ricœur’s sense, appears to be embodied in the singular, albeit generalized self. Yet, in reconstructing its meaning, the essay argues that Ricœur’s articulation of cultural memory relies on an implicit collective dimension. The present essay’s hermeneutic reconstruction of Ricœur’s notion of cultural memory comprises a preliminary step of a broader project that aims to rearticulate Jan and Aleida Assmann’s cultural memory framework along social imaginary lines. In this vein, the essay concludes with an overview of the Assmannian approach to cultural memory and considers possible bridges between Ricœur and the Assmanns. (shrink)

A study is reported which focused on the problem-solving strategies employed by expert electronics engineers pursuing a real-world task: integrated-circuit design. Verbal protocol data were analysed so as to reveal aspects of the organisation and sequencing of ongoing design activity. These analyses indicated that the designers were implementing a highly systematic solution-development strategy which deviated only a small degree from a normatively optimal top-down and breadth-first method. Although some of the observed deviation could be described as opportunistic in nature, much (...) of it reflected the rapid depth-first exploration of tentative solution ideas. We argue that switches from a predominantly breadth-first mode of problem solving to depth-first or opportunistic modes may be an important aspect of the expert's strategic knowledge about how to conduct the design process effectively when faced with difficulties, uncertainties, and design impasses. This article critically engages with Castoriadis’s elucidation of autonomy. It does so by taking into account the implications of Castoriadis’s enduring interest in the ecological devastation of the natural world, on the one hand, and the changing configuration of his philosophical anthropology, on the other—especially in regard to his reconsideration of the creativity of nature in the 1980s and the reconfiguration of the nomos and physis problematic. It contextualizes these movements in his thought within a broader hermeneutic of modernity that, (...) following Johann Arnason, emphasizes the cultural currents of both Romanticism and the Enlightenment as constitutive of modernity as a field of tensions. In an extension of Arnason’s elaboration, however, the present article argues that a latent opening towards an ecological worldhood is implicit to Castoriadis’s hermeneutic of modernity that, conversely, also finds Castoriadis at the limits of autonomy. The essay’s argument is twofold: First, it contends that Ricœur’s articulation of the social imaginary in the Lectures on Ideology and Utopia, reveals a turn to a general theory of culture, which is best understood as a shift from a hermeneutics of culture to a cultural hermeneutics. This move forms part of his philosophical anthropology of “real social life.” The essay proposes it is epitomized in Ricœur’s changing reception of Cassirer. Second, the essay hermeneutically reconstructs the emergence of this turn (...) in Ricœur’s intellectual trajectory, and, in so doing, contends that it is connected to a rearticulation of both the phenomenological reduction and the symbolic function that took place in the mid- to late 1960s. Ricœur’s developing response to the phenomenological problematic of the world horizon underlies these further phenomenological-hermeneutic considerations. The essay concludes with a brief sketch of Ricœur’s understanding of the symbolic mediation of action as a reconfiguration of the hermeneutical actualization of phenomenological preconditions of the symbolic. Cornelius Castoriadis understood history as a self-creating order. In turn, he elaborated history in two directions: as the political project of autonomy, and as the ontological modality of the social-historical. On his account, history as self-creation was only possible through the interplay of social (or political) imaginaries and social doing. Although social imaginaries are readily situated within the non-subjective field, non-subjective modes of doing have been less explored. Yet non-subjective contexts are integral to both the “doing” and “imaginary” dimensions of (...) the human condition, and form the preconditions for concrete varieties of social and political action and politics (as la politique), more generally. The present paper begins to clear a path to reflect on social doing in its non-subjective aspects; as such, it is preparatory rather than programmatic. After briefly reviewing the field of “social imaginaries”, it reflects on Castoriadis’s elaboration of “praxis” and “teukhein”. It then considers Johann Arnason’s culturological reconfiguration of Castoriadis’s approach, and Jan Patočka’s asubjective phenomenology of the movement of human existence as different ways of engaging with the problematic of doing, instituting society and political imaginaries. Despite a gradual subordination of “doing” to “signification” in Castoriadis’s philosophical elaborations, “social doing” as a non-subjective modality does not disappear altogether from his thought – especially and explicitly in respect to the phenomenon of instituting society as a political project – and remains a point of recurring intrusion into his more explicit theoretical concerns. John Henry Newman is probably known best for The Idea of a University. In his most philosophical work, An Essay in Aid of a Grammar of Assent, however, he undertakes a detailed investigation of different ways of knowing and understanding in a manner that is of clear pertinence for philosophical enquiry into education. He offers many examples and descriptions of particular experiences, from religious and secular life, and on the strength of these he argues that before enquiry can take place (...) there must be a prior attentiveness: in Newman's preferred terms, this involves an ‘assent’, a saying ‘yes’. There is an interesting resonance here with some of the work that occupied Ludwig Wittgenstein, found in his Remarks on Frazer's Golden Bough and On Certainty. My purpose in this paper is to look at the place, within the university, of a grammar of assent. What is at stake here is not a question of the relations between the university and religion but rather the question of the ethics that constitutes enquiry in.. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:New Rhetoric's Empire:Pragmatism, Dogmatism, and SophismRomain LauferPragmatism vs. RationalismThere are at least two reasons to devote some attention to sophism when dealing with the relationship between philosophy and rhetoric in the context of Franco-American intellectual exchanges. The first reason is that it lies at the very origin of classical philosophy which could be described as resulting directly from the way in which Plato and Aristotle succeeded in separating the (...) realm of rhetoric from the realm of philosophy. The second reason arises out of the way in which Durkheim, the founder of French academic sociology, thought it necessary to establish a clear distinction between sociology and pragmatism. This was done in a course given at the Sorbonne during the academic year 1913–14. The course could be considered a direct answer to the lectures on pragmatism given by William James at the Lowell Institute in Boston in 1906–7 (Durkheim 1955).From the very beginning of his talk, Durkheim expresses an extremely ambivalent point of view. On the one hand, pragmatism, better than any other doctrine, allows one to feel the necessity of reforming or renovating the type of "traditional rationalism" that dominated the French intellectual atmosphere of the time. On the other hand, it represents a real threat for this same rationalist tradition. Is it not a declaration of war that pragmatism launches on rationalism when William James writes that "against [End Page 326] rationalism as a pretension and a method pragmatism is fully armed and militant" (1975, 32)? In the face of this attack Durkheim declares that what is at stake are the very foundations of French culture: "Our whole French culture is essentially based on rationalism. Here the eighteenth century lives on. Thus, a radical negation of rationalism would constitute a danger: it would imply a complete disruption of our national culture. The whole French spirit would have to be transformed if the form of irrationalism that pragmatism represents were to be admitted" (1955, 28). Durkheim adds that this threat is not limited to the French tradition: "Not only our culture but the whole of the philosophical tradition has been, since the very beginnings of philosophical speculation—apart from a single exception that will be dealt with later—of a rationalist tendency. Therefore it is toward the disruption of all this tradition that one would have to proceed if pragmatism were valid" (1955, 28).Durkheim insists that what pragmatism tends to destroy is the "cult of truth," the fact that there are judgments that are necessary, which he will allude to throughout his analysis as corresponding to a dogmatic conception of truth that is repeatedly criticized by William James. James writes in his lectures on pragmatism that "rationalism is comfortable only in the presence of abstractions[;]... objective truth must be something non-utilitarian, haughty, refined, remote, august, exalted. It must be the absolute correspondence of our thoughts with an equally absolute reality.... Down with psychology, up with logic, in all this question!" (1975, 38).This allows Durkheim to declare that by stating that the human mind is free in front of the truth, pragmatism approaches the single exception he mentioned, namely, sophism, which in a similar manner negated truth. This connection is not arbitrary: it is avowed by the pragmatists themselves (1955, 28–29). Thus F. C. S. Schiller proclaims himself a "Protagorean" and recalls the axiom that "man is the measure of all things."Thus the debate between rationalism and pragmatism—between, according to Durkheim, a French philosophical tradition characterized by its link with a Cartesian dogmatic form of rationalism and an American philosophy characterized by its link with pragmatism—can be seen as the continuation of the debate between Plato and Aristotle, on the one hand, and the Sophists, on the other, at the origin of Western philosophy. Moreover, Durkheim tells us that the resurgence of the debate between pragmatism and philosophy corresponds to a historical transformation that affects the whole Western world. The complex and dynamic nature of systems pose a particular challenge to researchers and require the use of a research methodology designed to deal with such systems. The properties of fit, relevance, understandability, generality, control, workability, generalizability, and modifiability make Glaserian grounded theory and grounded action particularly well suited for studying systems. These methods are innovative, systemic, and sophisticated enough to reveal the underlying complexities of systems and plan actions that address their complex, dynamic nature while remaining grounded in what (...) is occurring within the systems as they change over time.
