There are many moral qualities which are valued in men. But the question of virtue, of the moral worth of the person as an agent, is quite a different question from that of whether or not he possesses these moral qualities. The problem with which Kant wrestled for many years was that of the nature of the relation between the ‘feeling’ and the ground or motivation of moral action. His Critical doctrine was that the moral feelings lie at the basis (...) of morality, as subjective conditions of our receptiveness to the concept of duty. The Critical doctrine was to allocate the moral feeling to the causality of reason in its practical use, and in that way deliver it from the subjectivism which Kant attributes to all feelings. In the Prize Essay Kant explicitly limits the task of philosophy, however provisionally, to the analytic one of exhibiting, in Newtonian fashion, the basic elements of experience. (shrink)

The Doctrine of Double Effect and the Principle of Do No Harm raise important theoretical and practical issues, some of which are discussed by Boyle, Donagan, and Quinn. I argue that neither principle is correct, and some revisionist, and probably nonabsolutist, analysis of constraints on action and omission is necessary. In making these points, I examine several approaches to deflection of threat cases, discuss an argument for the permissibility of voluntary euthanasia, and present arguments relevant to medical contexts which justify (...) intentionally hanning some to aid others, with and without the consent of those harmed. The doctrine of hell, stated with a little care, entails that some persons never achieve their greatest good, fail to really flourish and never reach the end for which they were created. If that doctrine is true, and it is tragic that persons never achieve their greatest good, then there are tragic states of affairs whose tragedy is never overcome.

Judgment aggregation theory, or rather, as we conceive of it here, logical aggregation theory generalizes social choice theory by having the aggregation rule bear on judgments of all kinds instead of merely preference judgments. It derives from Kornhauser and Sager’s doctrinal paradox and List and Pettit’s discursive dilemma, two problems that we distinguish emphatically here. The current theory has developed from the discursive dilemma, rather than the doctrinal paradox, and the final objective of the paper is to give (...) the latter its own theoretical development along the line of recent work by Dietrich and Mongin. However, the paper also aims at reviewing logical aggregation theory as such, and it covers impossibility theorems by Dietrich, Dietrich and List, Dokow and Holzman, List and Pettit, Mongin, Nehring and Puppe, Pauly and van Hees, providing a uniform logical framework in which they can be compared with each other. The review goes through three historical stages: the initial paradox and dilemma, the scattered early results on the independence axiom, and the so-called canonical theorem, a collective achievement that provided the theory with its specific method of analysis. The paper goes some way towards philosophical logic, first by briefly connecting the aggregative framework of judgment with the modern philosophy of judgment, and second by thoroughly discussing and axiomatizing the ‘general logic’ built in this framework. When the U.S. conducts warfare, elements of a force are drawn from different services and work together as a single team to accomplish an assigned mission. To achieve such unified action, it is necessary that the doctrines governing the actions of members of specific services be both consistent with and subservient to joint Doctrine. Because warfighting today increasingly involves not only live forces but also automated systems, unified action requires that information technology that is used in joint warfare must be (...) aligned with joint doctrine. It requires also that the separate information systems used by the different elements of a joint force must be interoperable, in the sense that data and information that is generated by each element must be usable (understandable, processable) by all the other elements that need them. Currently, such interoperability is impeded by multiple inconsistencies among the different data and software standards used by warfighters. We describe here the on-going project of creating a Joint Doctrine Ontology (JDO), which uses joint doctrine to provide shared computer-accessible content valid for any field of military endeavor, organization, and information system. JDO addresses the two previously mentioned requirements of unified action by providing a widely applicable benchmark for use by developers of information systems that will both guarantee alignment with joint doctrine and support interoperability. In the Canon of the Critique of Pure Reason, Kant endorses both a Moral Belief in God as well as what he there calls Doctrinal Belief. The former mode of belief is well known and can be found throughout the Kantian Corpus. The latter, however, is far more obscure and thus far has not been carefully studied. Doctrinal Belief only appears explicitly in the Canon, but is related to a number of issues in the Transcendental Dialectic as well (...) as the Critique of Judgment. This paper will provide an account of the Doctrinal Belief in God and consider its compatibility with Kant’s other discussions of the projected ground of the principle of purposiveness. (shrink)

The article examines the meaning of the concepts of "doctrine" and "tradition" in Walter Benjamin's 1917 reflections, concepts that are closely linked to his reception of Kant. Given the scarce analysis of this appropriation, the paper seeks to show that these concepts express an interest in Kant's idea of the systematic unity of knowledge and that Benjamin reinterprets such unity in Messianic terms, that is, not as a necessary assumption, but as a demand for redemption. Finally, it shows how these (...) notions are implicit in Benjamin's On the Program of the Coming Philosophy. (shrink)

Global ignorance about Africa continues to sustain inappropriate global interventions to resolve public health crises, often with disastrous consequences. To explain why this continues to happen, I marshal two theorems that predict basic statistical properties, called ‘the doctrinal paradox’ and ‘the discursive dilemma’, which underlie scientific consensus formation and evidence-based decision making on a global scale. These mathematical results illuminate the epistemic and material injustices committed by the protocols of medical research conducted at the highest level of global knowledge (...) production in the service of international humanitarian aid for Africans. These social choice theorems reveal that a global scientific consensus projecting claims and proposing policies about Africa’s disease burden is likely to yield a low degree of reliability, in that the probability of its accuracy is less than chance. The solution to this anomaly is to remove from the global scientific agenda the statistically unrealisable demand of satisfying too many multinational corporate and foreign governments’ priorities as equally entitled to benefit from the knowledge produced to improve Africa’s public health sector. Instead, foreign funding targeted to support medical science and policy in Africa should be directed by those specialists in situ who are most familiar with their own national health challenges and potential solutions, rather than relying upon foreign decision makers to interpret Africa’s emergency public health care needs. Peter Geach describes the 'doctrine of distribution' as the view that a term is distributed if it refers to everything that it denotes, and undistributed if it refers to only some of the things that it denotes. He argues that the notion, so explained, is incoherent. He claims that the doctrine of distribution originates from a degenerate use of the notion of ?distributive supposition? in medieval supposition theory sometime in the 16th century. This paper proposes instead that the doctrine of (...) distribution occurs at least as early as the 12th century, and that it originates from a study of Aristotle's notion of a term's being ?taken universally?, and not from the much later theory of distributive supposition. A detailed version of the doctrine found in the Port Royal Logic is articulated, and compared with a slightly different modern version. Finally, Geach's arguments for the incoherence of the doctrine are discussed and rejected. (shrink)

Our time is characterized by what seems like an unprecedented process of intense global homogenization. This reality provides the context for exploring the nature and value of toleration. Hence, this essay is meant primarily as a contribution to international ethics rather than political philosophy. It is argued that because of the non-eliminability of differences in the world we should not even hope that there can be only one global religion or ideology. Further exploration exposes conceptual affinity between the concepts of (...) intolerance, ideology, and doctrinal evil. The last concept is developed in contrast to pure evil and average evil, and under the assumption of the metaphysical necessity of free will. Doctrinal evil is found to represent the main source of intolerance as a result of a mechanism that tends to confuse doctrinal evil (or the competing conceptions of the good) with pure evil. This connection between doctrinal evil and pure evil provides ideologies with their forcefulness. Tolerance cannot be properly understood in terms of a simple opposition to intolerance, however. Tolerance emerges as a sort of vigilance, conscientiousness, and non-negligence based not on a supposedly correct interpretation of the good, but rather on the acceptance of the fallibility of any such attempted definition. Conversely, the principal evil in doctrinal evil is found in arrogance that accompanies the intolerance-inducing irresponsible thoughtlessness. With this conceptual topology in mind the paper also addresses questions regarding religious tolerance, the ideology of human rights and democracy, the right to self-defense, ways to face evil, the dialectics of using old names for novel evils, and related issues. La doctrine de l’État rassemble les Leçons sur des contenus variés de philosophie appliquée données par Fichte à l’université de Berlin pendant le semestre d’éré 1813. Elle est le dernier grand cours donné par Fichte avant sa mort en janvier 1814, et témoigne de l’état ultime de la pensée du philosophe, qui la présente lui-même à ses auditeurs comme livrant les résultats des recherches de toute une vie. Par « philosophie appliquée » Fichte n’entendait pas un quelconque effort d’adaptation de (...) la philosophie théorique à une réalité étrangère au monde de la pensée, mais la mise en œuvre de la pensée philosophique elle-même en son essence pratique, c’est-à-dire en tant qu’elle est elle-même une force vitale de formation et de création sociale et politique. La Doctrine de l’État mobilise ainsi la totalité de l’œuvre philosophique de Fichte à seule fin de déterminer les conditions de la libération réeelle et collective des hommes. Elle constitue, à ce titre, un témoignage précieux de cette philosophie fichtéenne de l’action qui, dans les années 1842-1844, inspira fortement la philosophie sociale allemande alors en rupture avec l’idéalisme spéculatif hégélien. The Doctrine of Double Effect (DDE) is an influential non-consequentialist principle positing a role for intention in affecting the moral permissibility of some actions. In particular, the DDE focuses on the intend/foresee distinction, the core claim being that it is sometimes permissible to bring about as a foreseen but unintended side-effect of one’s action some harm it would have been impermissible to aim at as a means or as an end, all else being equal. This article explores the meaning and (...) application of the DDE along with current debates over the nature of the intend/foresee distinction and its moral significance. How is the line between intended effects and merely foreseen but unintended side-effects to be drawn, and how are problem cases best handled? What is an appropriate methodology for debating the tenability of the DDE? How might the DDE interact with other non-consequentialist principles, and how might it be modified to capture other related factors (resulting perhaps in a Doctrine of Triple Effect) or to avoid certain problem cases? Does the DDE make permissibility turn on the actual intentions of particular agents, as critics such as Thomson and Scanlon assume, or is the role of intention more abstract? (shrink)

The article attempts to characterize three key doctrinal controversies in the Carolingian Renaissance, namely: the disputes over the Eucharist, the so-called trina deitas, and predestination. The core of the article is an exposition of the controversy concerning predestination, whose main protagonist is Gottschalk of Orbais. The article discusses four crucial issues related to the problem: (i) the concept of God, (ii) the understanding of grace, nature and free will, (iii) the relation of foreknowledge to predestination, and (iv) the doctrine (...) of redemption, i.e., specifically the relationship betweenjustice and mercy. The article is largely an attempt at an interpretation of the texts of the epoch, mainly those of Gottschalk of Orbais and his adversary, Hincmar of Reims. The conclusions point to difficulties in the issues discussed and outline what attempts at solving this problem have taken place in the coming centuries. (shrink)

This book provides an accessible and thorough analysis of "The Doctrine of Being," the first part of Hegel's Science of Logic. Though it received much scholarly attention in the past, interpreters of this text have generally refrained from examining it in a sufficiently detailed manner. Through a rigorous and critical reading of Hegel's speculative arguments, Mehmet Tabak illustrates that Hegel meant his logic to be both a presuppositionless analysis and development of the basic categories of thought, on the one hand, (...) and a post-Kantian ontology on the other. However, the analysis of the text demonstrates that Hegel fails to deliver such logic. In this précis I introduce the topic of the symposium, namely, Oliver D. Crisp’s book, Analyzing Doctrine: Toward a Systematic Theology. I discuss the impetus behind the symposium, provide a précis of Analyzing Doctrine, and preview the various responses to the book given by his interlocutors. I conclude by highlighting some possible new directions for analytic theology.

IN DEBATES CONCERNING the relationship between basic principles of Whiteheadian process philosophy and the classical doctrine of substance, one can distinguish at least three types of essentially different approaches to the discussed issue: Process metaphysics implies definitive rejection of substantialist categories of traditional philosophy, and introduces a radically new perspective in which notions of flux and change replace the former categories of enduring substances and relative immutability of individual subjects. Whitehead's approach to the traditional doctrine of substance results in a (...) strong critique of it but not in total rejection. Certain elements of the Aristotelian and Cartesian legacy must be critically revised, but they cannot be eliminated from a rational interpretation of nature. Their implicit presence in Whiteheadian interpretative schemes substantiates the opinion that process metaphysics introduces a reformed version of the doctrine of substance. In spite of explicit critique of the concept of substance found in Whitehead's texts, the same texts implicitly presuppose the necessity of reference to certain substantialist categories. Whitehead himself did not always formally recognize such a necessity; his metaphysical assertions, however, provide an objective basis for developing a modified theory of substance. (shrink)

. How does the doctrine of double effect apply to business decisions to sell products which may be harmful to consumers? Lawrence Masek believes that some authors have misapplied the doctrine to this type of decision and, as a consequence, have committed themselves to placing unwarranted constraints on businesses. Seeking to correct this mistake, Masek presents his account of how the doctrine applies here, an account which is rather permissive but which, he claims, nevertheless preserves the virtues of the doctrine. It will be seen, though, that his attempt to loosen these putatively unnecessary constraints by appealing to consumer autonomy and an intuition about the morality of producing harmful products leaves the doctrine of double effect irrelevant to this type of decision. His argument that the doctrine is less restrictive in this context than others suppose leads ultimately to the conclusion that the doctrine does not constrain this kind of business decision at all. The author (...) displays an exceptional knowledge of the Leibnizian corpus, the ancient and medieval sources for the various doctrines he analyzes, and the contemporary issues underpinning Leibniz's investigations. He aims at rectifying misconceptions that stemmed originally in Couturat's La Logique de Leibniz (1901) and have since affected several studies. Three methodological statements set the ground for Rauzy's analysis: (1) Leibniz's notion of truth concerns in unified fashion all the elements of discourse: terms, concepts, and propositions. (2) Leibniz did not restrict his doctrine of truth to consistency relations, but yielded a complex, well-articulated conception of truth as correspondence, as evidenced in New Essays on Human Understanding, IV, v, sect. 11; yet, at the same time, his doctrine focused on conceptual relations which specify an order of reasons deserving to be analyzed for their own sake: "Dans la doctrine leibnizienne de la vérité, l'adaequatio rei constitue encore le cadre général en dehors duquel le prédicat de vérité n'a pas de sens. This article summarizes the content and the methodological proceedings of the unwritten doctrines ascribed to Plato, and documents their presence, which is to be found particularly in the Sophist. The article tries then to reconcile the first principles' theory with Platonic metaphysics, which admits the theological transcendency. It attempts to show that, because of the difference between the Dyad of great and small in the cosmological sphere and the Dyad of the ideal sphere, the role of the demiurgic Intellect becomes essential. Kant makes it clear in the Inaugural Dissertation that all the sense‐representations which form the material content of human knowledge are simply ‘modifications of inner sense’. Immortality would be, Kant suggests, the continuation of the unity of one's experience in a differently intuited world; ‘those transcendental objects, which in our present state appear as bodies, could be intuited in an entirely different manner’. Just as the early rationalist doctrine of the self is denied speculative validity, but admitted as a practical (...) postulate of morality; so the early rationalist doctrine of God is retained, but solely for practical use, without any cognitive function. Kant's contention that the ideal of God is a postulate for the employment of understanding in the investigation of nature is not usually granted much force in contemporary thought. Positively, the absolute demands of categorical morality require the postulates of freedom, immortality and God as a condition of their intelligibility. (shrink)

The doctrine (or principle) of double effect is often invoked to explain the permissibility of an action that causes a serious harm, such as the death of a human being, as a side effect of promoting some good end. According to the principle of double effect, sometimes it is permissible to cause a harm as a side effect (or “double effect”) of bringing about a good result even though it would not be permissible to cause such a harm as a (...) means to bringing about the same good end. Does the principle of double effect play the important explanatory role that has been claimed for it? To consider this question, one must be careful to clarify just what the principle is supposed to explain. Three misinterpretations of the principle’s force or range of application are common. 1. To ensure that Double Effect is not misunderstood as principle issuing a blanket permission on causing any unintended harm that yields a benefit, applications must require that the agent seek to minimize the harm involved. 2. Since it is widely accepted that it is wrong to aim to produce harm to someone as an end, to rule this out is not part of double effect’s distinctive content. 3. Harms that were produced regretfully and only for the sake of producing a good end may be prohibited by double effect because they were brought about as part of the agent’s means to realizing the good end. Doctrinal legal scholarship faces persistent challenges from empirical approaches, but such criticism rarely seeks to encounter doctrine on its own terms. In this article, we seek to excavate the theoretical and methodological basis of doctrinal legal scholarship by situating the discipline in a hermeneutic continuum between theory and practice, or law’s engagement with the social world. We first unfold this dynamic as an exercise in methodological interpretivism and ontological hermeneutics and then turn to explicate our analysis with examples (...) drawn from tort law and international criminal law. We ultimately argue that law can never be strictly circumscribed as an empirical object because law cannot be disassociated from an agent’s reasons, which are continuously bound up in a hermeneutic circle, and which the scholar must enter into to achieve legal understanding. Unavoidably, therefore, doctrinal legal scholarship becomes part of the very object it is investigating. (shrink)

According to the Doctrine of Doing and Allowing, the distinction between doing and allowing harm is morally significant. Doing harm is harder to justify than merely allowing harm. This paper is the first of a two paper critical overview of the literature on the Doctrine of Doing and Allowing. In this paper, I consider the analysis of the distinction between doing and allowing harm. I explore some of the most prominent attempts to analyse this distinction:. Philippa Foot’s sequence account, Warren (...) Quinn’s action/ inaction account, and counterfactual test accounts put forward by Shelly Kagan and Jonathan Bennett. I also discuss Jeff McMahan’s account of the removal of barriers to harm. I argue that analysis of the distinction has often been made more difficult by two mistaken assumption: (1) the assumption that when an agent does or allows harm his behaviour makes the difference to whether or not the harm occurs (2) the assumption that the distinction between doing and allowing and the distinction between action and inaction are interchangeable. I suggest that Foot’s account is the most promising account of the doing/allowing distinction, but that it requires further development. (shrink)

ABSTRACT William Cooney has recently argued (The Journal of Applied Philosophy, Vol. 6, pp. 201–204) that the social programme of affirmative action, though controversial, can be supported by the doctrine of double effect in that, according to the doctrine, responsibility falls on the side of intended consequences and not on that of unintended consequences. The point of affirmative action is to include certain disadvantaged groups; it is not to exclude other groups, though this is an inevitable and foreseeable by‐product. In (...) this article I contend that Cooney's argument ignores two important conditions of the doctrine of double effect; namely, that the good which results from the intended effect must be at least commensurate with the harm that results from the unintended effect; and, that the intended good effect is causally separate from the unintended harmful effect. Any use of the doctrine which neglects these conditions leads to morally problematic cases. Further, once we take the conditions into account, we have good reason to think that the doctrine of double effect has no relevance to the affirmative action debate. (shrink)

Physician-assisted suicide offers a moral and theological Rorschach test. Foundational commitments regarding morality and theology are disclosed by how the issue is perceived and by what moral problems it is seen to present. One of the cardinal differences disclosed is that between Western and Orthodox Christian approaches to theology in general, and the theology of dying and suicide in particular. Confrontation with the issue of suicide is likely to bring further doctrinal development in many of the Western Christian religions, (...) so as to be able to accept physician-assisted suicide and euthanasia. The initial impact of John Henry Newman’s 1845 Essay on the Development of Christian Doctrine has previously been downplayed because scholars have neglected Roman sources on the question. These sources show that one of the most influential theologians in Rome at the time, Giovanni Perrone, S.J., learned from Newman’s theory and even advocated it publically in the city. After an 1847 exchange with Newman on the question of doctrinal development, Perrone employed Newman’s theory in publications that contributed to the (...) discussions preceding the decree of the Immaculate Conception in 1854. The article goes on to illustrate how Perrone’s influence upon these discussions helped to shape the Church’s official language regarding doctrinal progression in history. (shrink)

This dissertation examines the strategy of justifying doctrinal beliefs by appealing to special revelation. Even if one thinks that belief in God is rationally warranted, it does not follow that one's distinctive religious doctrines are justified. Though theism may be justified, it remains an open question whether or not believers are entitled to believe, for example, that Jesus Christ is God Incarnate or that God is triune. Traditionally, religious believers have claimed that their doctrinal beliefs are justified because (...) they have been revealed by God. ;My assessment of this claim consists of three parts. First I examine the concept of special revelation and defend it against charges of incoherence. But if even it makes sense to say that God can reveal himself, the more philosophically interesting question concerns how we could know that he has in fact done so. Hence the second part of the dissertation assesses criteria for adjudicating revelation claims. Locke's claim that the veracity of revelation is vouchsafed through miracles is examined. I argue that it is preferable to understand our doctrinal beliefs as properly basic rather than attempt to authenticate revelation claims through appeals to miracles. Finally, in part three, I consider and respond to several objections against the claim that our doctrinal beliefs can be justified. The first objection says that the strategy of justifying doctrinal beliefs through appeals to special revelation is undermined by competing claims to revelation. The second criticism claims that appeals to special revelation fail to provide the degree of justification required to underwrite decisive assent to doctrinal beliefs. This article examines certain aspects of current English doctrine in the light of applied property theory. Two of the problems of home-sharing which the law must address are: When should a claim be sustainable against the party who has legal title? Should such claims be exigible against successors of the title-holder? When statue is silent, three doctrinal streams of case-law are invoked. They concern money-down resulting trust interests, proprietary estoppel claims, and common intention constructive trust interests. The 'just outcome' (...) is prayed in aid, intermittently and interstitially, when the doctrinal solution is unclear or when doctrine itself is developed. This article reverses the usual approach. It asks what sound 'property-specific justice reasons' are relevant to the home-sharing problems. They are canvassed before an imaginary Justice Tribunal: (i) no going back on a gift; (ii) perfecting a contract; (iii) fruits of money; (iv) induced expectations; (v) labour desert; (vi) home need; (vii) windfall wealth. This article discusses two doctrines of jus ex bello concerning whether and how to end wars. In Section I, I defend the claim that there is a distinct morality of ending wars. Section II rebuts a challenge that the account is too permissive of war. Section III rejects a forward-looking conception of proportionality for jus ex bello. If Kierkegaard was an unrelenting judge of the revolutionary movements that agitated Denmark at that time, it was not only as a more or less sour witness of his epoch, but was in the name of a lucidity of which Adorno saw the pertinence of a positive modernity. According to the Doctrine of Doing and Allowing, the distinction between doing and allowing harm is morally significant. Doing harm is harder to justify than merely allowing harm. This paper is the second of a two paper critical overview of the literature on the Doctrine of Doing and Allowing. In this paper, I consider the moral status of the distinction between doing and allowing harm. I look at objections to the doctrine such as James’ Rachels’ Wicked Uncle Case and Jonathan (...) Bennett’s argument that any acceptable analysis of the distinction leaves it implausible that the distinction is morally relevant. I consider putative defences of the Doctrine from Philippa Foot and Warren Quinn. I argue that neither Foot not Quinn provides a satisfactory justification of the Doctrine of Doing and Allowing, but that the idea of self-ownership discussed by Quinn can be developed to provide a justification of the doctrine. The present article discusses a well-known religious philosophical and partially legal doctrine of the “Just war”, developed in the Christian tradition by St. Augustine, St. Tomas Aquinas, Francisco de Vittoria, Francisco Suarez, Hugo Grotius and many other thinkers. The main thesis of the doctrine is that war will be just only if it corresponds to certain criteria, such as autoritas principi (waged by the sovereign), justa causa (on just aim) and with recta intentio (animus) or the aim and will to (...) wage war in order to restore justice and not because of personal hate, revenge, lust for glory, etc. However, the impact of the doctrine was not limited by the Middle Ages and the Christian philosophic discourse. This doctrine shaped both emerging international law and international humanitarian law in one or another way. Even though it did not survive intact through the changing reality of the world, it is not so hard to trace the reflections of this doctrine even in contemporary international law. For example, while evaluating the armed conflict we still use the autoritas principi principle (armed conflicts may be fought only by defined subjects such as states or militarily - politically organised dissidents), moreover, when we are dealing with the concept of combatancy, the same principle applies in establishing whether a person is a legal fighter in the conflict or not, because his status directly stems from his belonging to the party of the conflict. With its strictly limited possibilities to use force, the contemporary jus contra bellum also somewhat resembles the doctrine, not only in the sense of justa causa (such as a possibility of unilateral use of force by the state only in self-defence) but also in recta intentio (e.g. the United Nations Security Council may order the use of force only with the intention to re-establish peace). Therefore, even though the doctrine is the product of the Middle Ages thought, it is not forgotten in our days. The possible military strike against Iran in order to stop it from developing nuclear weapon is already discussed in the light of this doctrine. Moreover, authors (though mainly not lawyers) discussing inadequacies of current international legal framework for the use of force (e.g. the need for humanitarian intervention) find their inspiration in the doctrine. The main doctrines of justice are liberal egalitarianism, libertarianism, luck egalitarianism, socialism, utilitarianism, capability approach, communitarianism, and care ethics. These can be further elaborated in the light of traditional moral and social theories, values, ideals, and interests, and there are distinct dimensions of justice that are captured better by some tactics than by others. There are two seemingly unrelated paradoxes of democracy. The older one is the doctrinal paradox or the discursive dilemma. or a comprehensive bibliography, see List 1995. The younger one is the mixed motivation problem introduced by Jonathan Wolff (1994) in this journal. In the mixed motivation problem, we have voters with mixed Benthamite and Rousseauian motivations who reach a majority on an issue that is neither in the self-interest of a majority of the voters, nor considered to be conducive (...) to the common good by a majority of the voters. What has gone unnoticed so far is that both of these paradoxes share a common structure. (shrink)

This article proposes an analysis of the doctrine of sufficiency. According to my reading, the doctrine's basic positive claim is ‘prioritarian’: benefiting x is of special moral importance where (and only where) x is badly off. Its negative claim is anti-egalitarian: most comparative facts expressed by statements of the type ‘x is worse off than y’ have no moral significance at all. This contradicts the ‘classical’ priority view according to which, although equality per se does not matter, whenever x is (...) worse off than y, at least some priority should be assigned to helping x. Section I elaborates and defends this reconstruction of the doctrine of sufficiency, and section II shows that the privileged utility level presumed within the sufficiency framework exists. (shrink)

Why informal logic? Informal logic is a group of proposals meant to contrast with, replace, and reject formal logic, at least for the analysis and evaluation of everyday arguments. Why reject formal logic? Formal logic is criticized and claimed to be inadequate because of its commitment to the soundness doctrine. In this paper I will examine and try to respond to some of these criticisms. It is not my aim to examine every argument ever given against formal logic; I am (...) limiting myself to those that, as a matter of historical fact, were instrumental in the replacement of formal logic by informal logic and initially established informal logic as a separate discipline. If the criticism of the soundness doctrine is defective, then the move from formal logic to informal logic was not theoretically well-motivated. It is this motivation that I wish to bring into question, rather than the adequacy or inadequacy of formal or informal logic as such. While I will tend to the view that formal logic is as adequate as it is reasonable to expect, the real issue is whether it is inadequate for the reasons that, as a matter of historical fact, were used to motivate its rejection.
