Criminal offenders are sometimes required, by the institutions of criminal justice, to undergo medical interventions intended to promote rehabilitation. Ethical debate regarding this practice has largely proceeded on the assumption that medical interventions may only permissibly be administered to criminal offenders with their consent. In this article I challenge this assumption by suggesting that committing a crime might render one morally liable to certain forms of medical intervention. I then consider whether it is possible to respond persuasively to this challenge (...) by invoking the right to bodily integrity. I argue that it is not. (shrink)

The concept of organizational stigma has received significant attention in recent years. The theoretical literature suggests that for a stigma to emerge over a category of organizations, a “critical mass” of actors sharing the same beliefs should be reached. Scholars have yet to empirically examine the techniques used to diffuse this negative judgment. This study is aimed at bridging this gap by investigating Goffman’s notion of “stigma-theory”: how do stigmatizing actors rationalize and emotionalize their beliefs to convince their audience? We (...) answer this question by studying the stigma over the finance industry since 2007. After the subprime crisis, a succession of events put the industry under greater scrutiny, and the behaviors and values observed within this field began to be publicly questioned. As an empirical strategy, we collected opinion articles and editorials that specifically targeted the finance industry. Building on rhetorical analysis and other mixed methods of media content analysis, we explain how the stigmatizing rhetoric targets the origins of deviant organizational behaviors in the finance industry, that is, the shareholder value maximization logic. We bridge the gap between rhetorical strategies applied to discredit organizations and ones used to delegitimize institutional logics by drawing a parallel between these two literatures. Taking an abductive approach, we argue that institutional contradiction between field and societal-level logics is sufficient, but not necessary to generate organizational stigma. (shrink)

In Writing the Book of the World, Ted Sider argues that David Lewis’s distinction between those predicates which are ‘perfectly natural’ and those which are not can be extended so that it applies to words of all semantic types. Just as there are perfectly natural predicates, there may be perfectly natural connectives, operators, singular terms and so on. According to Sider, one of our goals as metaphysicians should be to identify the perfectly natural words. Sider claims that there is a (...) perfectly natural first-order quantifier. I argue that this claim is not justified. Quine has shown that we can dispense with first-order quantifiers, by using a family of ‘predicate functors’ instead. I argue that we have no reason to think that it is the first-order quantifiers, rather than Quine’s predicate functors, which are perfectly natural. The discussion of quantification is used to provide some motivation for a general scepticism about Sider’s project. Shamik Dasgupta’s ‘generalism’ and Jason Turner’s critique of ‘ontological nihilism’ are also discussed. (shrink)

While evolutionary thinking is increasingly becoming popular in fields of investigation outside the biological sciences, it remains unclear how helpful it is there and whether it actually yields good explanations of the phenomena under study. Here we examine the ontology of a recent approach to applying evolutionary thinking outside biology, the generalized Darwinism approach proposed by Geoffrey Hodgson and Thorbjørn Knudsen. We examine the ontology of populations in biology and in GD, and argue that biological evolutionary theory sets ontological criteria (...) that GD fails to meet. Conciliatory theories of disagreement require that one lower one’s confidence in a belief in the face of disagreement from an epistemic peer. One question about which people might disagree is who should qualify as an epistemic peer and who should not. But when putative epistemic peers disagree about epistemic peerhood itself, then Conciliationism makes contradictory demands and paradoxes arise.

Given any proposition, is it possible to have rationally acceptable attitudes towards it? Absent reasons to the contrary, one would probably think that this should be possible. In this paper I provide a reason to the contrary. There is a proposition such that, if one has any opinions about it at all, one will have a rationally unacceptable set of propositional attitudes—or if one doesn’t, one will end up being cognitively imperfect in some other manner. The proposition I am concerned (...) with is a self-referential propositional attitude ascription involving the propositional attitude of rejection. Given a basic assumption about what constitutes irrationality, and a few assumptions about the nature of cognitively ideal agents, a paradox results. This paradox is superficially like the Liar, but it is importantly different in that no alethic notions are involved at all. As such, it stands independent of the Liar and is not a ‘revenge’ version of it. After setting out the paradox I discuss possible responses. After considering several I argue that one is best off simply accepting that the paradox shows us something surprising and interesting about rationality: that some cognitive shortfall is unavoidable even for ideal agents. I argue that nothing disastrous follows from accepting this conclusion. (shrink)

Traditional approaches to measurement of violations of academic integrity may overestimate the magnitude and severity of cheating and confound panic with planned cheating. Differences in the severity and level of premeditation of academic integrity violations have largely been unexamined. Results of a study based on a combined sample of business students showed that students are more likely to commit minor cheating offenses and engage in panic-based cheating as compared to serious and planned cheating offenses. Results also indicated there is a (...) significant interaction between severity and type of cheating. We hypothesized serious and planned cheating offenses would be related to justifications and found the largest differences were between panic and planned. Finally, panic and minor cheating were associated with two self-control-related personality traits. Implications for cheating research are discussed. (shrink)

Following the neurophenomenological approach, we propose a model of emotional emergence that identifies the experimental structures of time involved in emotional experience and their plausible components in terms of cognition, physiology, and neuroscience. We argue that surprise, as a lived experience, and its physiological correlates of the startle reflex and cardiac defense are the core of the dynamic, and that the heart system sets temporally in motion the dynamic of emotional emergence. Finally, in reference to Craig’s model of emotion, we (...) propose an integrative model of the temporal dynamic of emotional emergence that allows emotions to be distinguished depending on each temporal phase and that involves the following three systems: the brain , the consciousness , and the doubled-sided continuum of the body-heart context, with the heart as the focus within the body during emotion. This model provides the framework for future developments in 1st- and 3rd-person approaches for an integrative understanding of the science of emotion, including the fields of psychophysiology and psychopathology. Political philosophy has seen vibrant debate over the connection, if any, between liberalism and pluralism. Some philosophers, following Isaiah Berlin, reckon a close connection between the two concepts. Others--most notably John Gray--believe that liberalism and pluralism are incompatible. In this essay, I argue that the puzzle can be solved by distinguishing the responsibilities of liberal states to their peoples from the responsibilities of liberal states to other states. There is an entailment from pluralism to liberalism, and it in turn implies (...) that while liberal states must tolerate "illiberal" lifestyles within their borders, liberal states must not tolerate illiberal states. The fact of liberal intolerance, however, does not justify unreasonably aggressive intervention by liberal states, nor does it mean that illiberal states deserve to be punished. (shrink)

Most research in philosophy of perception has focussed on the perceptual experience of three-dimensional, solid, bounded and coherent material objects – items like ink-stands and tomatoes. But as well as having perceptual experience of such objects, we also experience such ‘perceptual ephemera’ as, for instance, rainbows, surfaces, and stuff; things that are ephemeral in the sense that they can be contrasted, in selected respects, with material objects. This book collects together fourteen new essays on the perceptual experience of ‘ephemera’. A (...) substantive introduction by the editors provides a detailed introduction to the topic as a whole, setting out the thematic background to this emerging area of research in contemporary philosophy of perception. The volume winds a path through the ephemeral that touches on sensibilia, shadows and absences, as well as on ephemeral topics that are less familiar: media, transparency, camouflage, solidity and ambient vision. This paper applies a hybrid Heideggerian-ethnomethodological approach to physiotherapy practice. Unlike previous studies written by and for practitioners, this paper uses my personal experience receiving physical therapy as its point of departure. By combining Heidegger’s [Being and time (trans: Stambaugh J). State University of New York Press, New York 1996] notion of the ‘ontological difference’ with Garfinkel’s (Studies in ethnomethodology, Prentice-Hall, Englewood Cliffs 1967) concept of ‘accountability,’ I argue that in physical therapy practice, both client and practitioner actively shape the (...) body into a coherent object for medical intervention. I begin by introducing three key phenomenological concepts, the life-world, the ontological difference, and Heidegger’s critique of subjectivity. I then empirically substantiate these concepts by reviewing classic and recent studies in ethnomethodology. I conclude with my own experience of physical therapy, and demonstrate how both client and practitioner actively constitute the body as a medical and therapeutic object. This is cause for both disability studies and physiotherapy to reconsider some of their core concepts, ‘medicalization’ and ‘client-specific measurement,’ respectively. (shrink)

InThe Methods of EthicsHenry Sidgwick argued against deontology and for consequentialism. More specifically, he stated four conditions for self-evident moral truth and argued that, whereas no deontological principles satisfy all four conditions, the principles that generate consequentialism do. This article argues that both his critique of deontology and his defence of consequentialism fail, largely for the same reason: that he did not clearly grasp the concept W. D. Ross later introduced of a prima facie duty or duty other things equal. (...) The moderate deontology Ross's concept allows avoids many of Sidgwick's objections. And Sidgwick's statements of his own axioms equivocate in exactly the same way for which he criticized deontological ones. Only if they are read as other things equal can they seem intuitive and earn widespread agreement; but that form is too weak to ground consequentialism. And in the form that does yield consequentialism they are neither intuitive nor widely accepted. Sidgwick's arguments against a rival view and for his own were, in multiple ways, unfair. (shrink)

It has been claimed that the prototype theory of concepts supports two controversial claims in the philosophy of art: that art cannot be defined, and that the possession of a certain sort of historical narrative is a sufficient but not necessary means of determining the art status of contested works. It is argued here that two sorts of considerations undermine the thesis that prototype theory offers significant support to anti-definitionism and historical narrativism. First, there is reason to think that prototype (...) theory is as a psychological theory not the sort of view that can support philosophical theories like anti-definitionism and historical narrativism. Second, well-known objections and theoretical alternatives to prototype theory theory raise serious questions about that theory’s own credentials. (shrink)

Not only our conscious expectations, wishes and intentions are directed towards the future, but also pre- or unconscious tendencies, hunches and anticipations. Using a term coined by Ernst Bloch, they can be summarized as the not-yet-conscious. This not-yet-consciousness usually unfolds spontaneously and without a plan; it is not expected or striven for, but rather emerges in consciousness in such a way that the subject is surprised by itself, so to speak. This gives rise to phenomena such as the conspicuous, the (...) accidental, the new and the improvised, which are particularly important for understanding creative and therapeutic processes. The aim of this article is to develop a general phenomenological framework for understanding not-yet-conscious dynamics and their unfolding in different contexts. To this end, the structure of the not-yet-conscious is examined in the light of protention, in which the phenomenon is fundamentally located. (shrink)

If a conception like the commissural-integrative conception of the normal stream of consciousness is correct, then we should expect to find that the consciousness of the deconnected left hemisphere is not a normal consciousness, because the right hemisphere cannot contribute to the left hemisphere's stream except by means of inadequate subcortical connections. Therefore, the present article considers, from the literature, three hypothesized dimensions of deconnected left-hemispheric consciousness: Is the deconnected left hemisphere alienated as agent from behavior produced by the respective (...) right hemisphere? Or does the deconnected left hemisphere appropriate the latter behavior to the person, as it does behavior that the left hemisphere itself produces? Is the stream of consciousness of the deconnected left hemisphere more narrow and more disunified than the normal stream? Or is the left hemisphere's total state of consciousness of the moment just as rich as the normal stream, both in the part-experiences that comprise it and in awareness of relations among these part-experiences? Is the deconnected left hemisphere unaware of the commissurotomy-produced deficiencies characterizing its stream of consciousness? Or does the deconnected left hemisphere have awareness of what it, taking itself to be the whole person, can no longer accomplish? Discussion of these questions should go forward; they represent natural directions in which to investigate what is distinctive about left-hemispheric consciousness-which, the commissural-integrative view holds, has been produced by surgery. Batman is allied with modern natural law in the way he relies upon reason to bring about his vision of ‘true justice’, operating as a force external to law. This vision of justice is a protective one, with Batman existing as a guardian—a force for resistance against the corruption of the state and the failures of the legal system. But alongside his rational means, Batman also employs violence as he moves beyond the boundaries of the civilised state into the dark (...) and violent world outside law’s protection. He thus sacrifices his own safety to ensure the safety of others—he is a Dark Knight, a sentinel, fighting the nasty and brutish underworld of criminality in his effort to bring rational order to the world and protect the people of Gotham from criminal harm. This fight for justice is fuelled by a deeply private trauma: the murder of Bruce Wayne’s parents: a private desire for vengeance that Batman transcends. In navigating Batman’s jurisprudential dimensions, we are ultimately reminded that private desires and motivations are enfolded within the public structures of justice. (shrink)

This new English translation of St. Thomas Aquinas's Treatise on Law, found in Questions 90-108 of the First Part of the Second Part of the Summa Theologiae, is the only free-standing English translation of the entire Treatise, which includes both a general account of law (Questions 90-92) and also specific treatments of what St. Thomas identifies as the five kinds of law: the eternal law (Question 93), the natural law (Question 94), human law (Questions 95-97), the Old Law (...) (Questions 98-105), and the New Law (Questions 106-108). According to St. Thomas, law, far from supplanting virtue as a basic principle of action, serves as an independent principle of action that complements virtue and is itself capable of being factored into practical deliberation. The reason is that all of God's precepts, prohibitions, and punishments are aimed at promoting the good of the whole universe and, more particularly, the good for human beings, both individually and within the various forms of social life. Because of this, law serves as both a restraint on bad actions and a spur to good action, i.e., a restraint on actions that take us away from virtue and genuine human flourishing and a spur to actions that promote virtue and flourishing. There are many benefits of having the whole treatise rather than just the first few questions, as has been the standard practice in previous editions of the Treatise on Law. To mention just a few of these benefits, the question on the moral precepts of the Old Law (question 100) helps to illuminate in many different ways the earlier questions on natural law and human law (questions 94-97). Again, the questions on the ceremonial and judicial precepts of the Old Law (questions 101-105) demon-strate in depth the symbiotic relationship that St. Thomas takes to obtain between the Old Testament and the New Testament. The questions on the New Law provide an introduction to the Christian way of life that will be described in incomparable detail in the Second Part of the Second Part, the bulk of which is structured around the treatment of the three theological virtues and the four cardinal virtues. Although normative systems, or social laws, have proved to be a highly influential approach to coordination in multi-agent systems, the issue of compliance to such normative systems remains problematic. In all real systems, it is possible that some members of an agent population will not comply with the rules of a normative system, even if it is in their interests to do so. It is therefore important to consider the extent to which a normative system is robust, i.e., the extent (...) to which it remains effective even if some agents do not comply with it. We formalise and investigate three different notions of robustness and related decision problems. We begin by considering sets of agents whose compliance is necessary and/or sufficient to guarantee the effectiveness of a normative system; we then consider quantitative approaches to robustness, where we try to identify the proportion of an agent population that must comply in order to ensure success; and finally, we consider a more general approach, where we characterise the compliance conditions required for success as a logical formula. We furthermore introduce a logic for specifying properties of norm compliance in general and norm robustness in particular. (shrink)

ABSTRACT“A legal system exists,” Joseph Raz claims, “if and only if it is in force.” By this he means to suggest that the efficacy of law—that is, its capacity to control the population to which it applies—is necessary for its identity as such. Despite widespread recognition that efficacy is a condition of the existence of law, however, little time has been spent analyzing the notion. This article begins an attempt to make up the deficit. I make the case for efficacy (...) as necessary for law and go on to develop and defend an account of the concept that is broadly Kelsenian in spirit. In doing so I address questions concerning the relationship between obedience and enforcement in an account of the existence of a legal system as well as relating the discussion to that concerning the ontological status of international law. The pirate is a figure that is both marginal to war – since he is excluded from it – and central – since he is regularly called upon to define it. From a few evocations of this figure by Bodin, Grotius and Hobbes, all of which are based on Thucydides, we want to bring to light a normativity that is specific and immanent to the space of warlike violence.
