Randomized controlled trials test new drugs using various debiasing devices to prevent participants from manipulating the trials. But participants often dislike controls, arguing that they impose a paternalist constraint on their legitimate preferences. The 21st Century Cures Act, passed by US Congress in 2016, encourages the Food and Drug Administration to use alternative testing methods, incorporating participants’ preferences, for regulatory purposes. We discuss, from a historical perspective, the trade-off between trial impartiality and participants’ freedom. We argue that the (...) only way out is considering which methods improve upon the performance of conventional trials in keeping dangerous or inefficacious compounds out of pharmaceutical markets. This paper analyzes the possibilities and challenges of Fair Trade certification as a movement seeking to improve the well-being of small-scale coffee growers and coffee laborers in the global South. Six months of fieldwork was conducted in 2005–2006 to study the roles of a wide range of farmers, laborers, cooperative administrators, and export companies in Fair Trade coffee production and trade in Nicaragua. The results of our evaluation of the ability of Fair Trade to meet its (...) objectives indicate that Fair Trade’s opportunities to provide a significant price premium for participating farmers largely depend on world coffee prices in mainstream markets. While Fair Trade has promoted premiums for social development for participating producers and strengthened the institutional capacities of the cooperatives involved, its ability to enhance significantly the working conditions of hired coffee laborers remains limited. The selection process for firm participation on foreign trade missions during the Clinton administration has received much attention. Although critics said seats were exchanged for political contributions, government officials argued they selected internationally competitive firms capable of leveraging the contacts the mission provided. This article provides empirical evidence consistent with both claims. Firms with high levels off oreign trade competency were almost six times more likely to be chosen for participation than firms with little international experience, whereas (...) firms making large soft money donations were five times more likely to be chosen for participation than firms making no soft money donations. Drawing on a collection of Islamicate and Russian-language documentary materials presently held in Tashkent, I explore how the administration of Tashkent’s Kūkeldāš Madrasa oversaw and regulated the leasing-out of the madrasa’s waqf-endowed trade and artisanal establishments. By tracing shifts in the administration of leasing arrangements we may begin to illustrate a number of other, larger shifts in socio-economic practice over the course of the madrasa’s long existence, reflecting the consequences first of the rise of the Khoqand Khanate (...) and secondly of the Russian conquest and the establishment of the Turkestan Governorship-General. By attending to patterns of lease arrangements over the history of a single waqf establishment, we may begin to discern shifting patterns of practice which are all too often obscured when viewed against a wider canvas. This paper investigates under what conditions a good corporate social responsibility (CSR) can compensate for a relatively poor corporate ability (CA) (quality), and vice versa. The authors conducted an experiment among business administration students, in which information about a financial services company’s CA and CSR was provided. Participants indicated their preferences for the company’s products, stocks, and jobs. The results show that for stock and job preferences, a poor CA can be compensated by a good CSR. For product preferences, (...) a poor CA could not be compensated by a good CSR, at least when people thought that CA is personally relevant to them. This paper examines the relationship between the university and fair trade coffee campaigns in North America. In recent years, fair trade coffee sales internationally have increased substantially but have still not grown large enough to meet the needs of fair trade producers in the South. In consequence, fair trade activists have sought to expand the market by pressuring public institutions to adopt fair trade purchasing policies. In North America, the university has emerged as a central (...) focus of fair trade coffee campaigns. Thus far, university administrators have been reluctant to support fair trade. This paper explores this reluctance and asserts that the university has a moral responsibility to support fair trade. However, it also argues that the potential exists for administrators to employ fair trade as an ethical fig leaf to mask the growing corporatization of the university under the weight of neoliberal reforms. This has become a common strategy of many neoliberal institutions in the North. Contrary to the assumptions of much of the emerging literature, it cannot be assumed that the impact of fair trade will necessarily be beneficial in the North unless activists work to ensure fair trade does not become employed as an ethical fig leaf. In thispaper, the potential effects of variousarticles of the Protocol on international tradein GMOs are analyzed. Based on the presentstatus of imports of GMOs and domestic researchand development of biotechnology in China,likely trends in imports of foreign GM food andrelated products after China accedes to WTO isexplored. Also, (...) China's potentialcountermeasures to control and regulate importsof GMOs in line with implementation of theProtocol are discussed. China, in recent times,has increased its food and agricultural importssubstantially from USA and Canada. Chinaimported soybean 10.42 mill. tons in 2000 andabout 15 mill tons in 2001, of which majorityare from USA where GM soybean accounts for60%. The plantation of US Monsanto'stransgenic Bt cotton was increased to more than1 million ha in China in 2001. Though China haspaid great attention to develop biotechnology,it appears to have little scope to export GMOsand GM products. So China may consider a rangeof administrative measures to implement theCartagena Protocol and to regulate its importof GMOs and GM agricultural products.Consequently, the Regulation on Safety ofAgri-GMOs was issued on June, 2001 and followedthree detailed rules issued in Jan. of 2002,with a priority to limit foreign GMOs importingby safety certification and labeling system.These were outlined taking into accountpolicies adopted in Western countries such asgreen barriers to international trade. After World War II, the United States participated in helping to produce an international set of institutions, treaties, and multilateral relationships to cope with political conflict and global problems. Internationalist multilateralism was complicated by the Cold War that split the world into competing camps and blocs. Facing a Soviet nuclear threat and challenges on the military, political and economic front, the US developed multilateral institutions and alliances with European and other allies to provide national security. Doctrines of containment and deterrence (...) combined with a global system of alliances protected the US from military assault and provided outlines of a global system from within which conflicts could be resolved and global problems dealt with. With the collapse of the Soviet Union, there were brief hopes that a more peaceful and secure world could be produced through strengthened multilateral global alliances and with major countries working together within international law. The first Bush administration and the two Clinton administrations developed globalist and multilateral politics and the 1990s exhibited remarkable economic prosperity, at least for those in the overdeveloped countries, and, with some marked failures, began to deal with human rights and violations of international law collectively and multilaterally within a global framework. The second Bush administration renounced internationalist and multilateralist policies and alliances. From the beginning, they rejected international accords such as the Kyoto Treaty on the environment and a series of arms limitations treaties ranging from attempts to cutback on nuclear weapon to controlling the small arms trade. After the September 11 terror attacks on the US, the Bush administration responded with unilateralist militarism, developed new doctrines of preemptive strikes, and waged violent but unresolved wars in Afghanistan and Iraq.. Records of certain Government Departments known to have purchased scientific instruments from designated suppliers over long periods are potentially important sources of information on both instruments and their makers. The Office of Ordnance was one such Department. Investigation of its financial and administrative records has shown that the appointment ‘Mathematical Instrument Maker to his Majesty's Office of Ordnance’ brought the holder a substantial trade in instruments for drawing, surveying, and military purposes. Detailed entries in the Bill Books enable not (...) only types, quantities, and prices of instruments supplied to be determined, but also the purposes for which they were required. In many cases the actual users of the instruments are named, with their locations in Great Britain and overseas.The records of the Office of Ordnance are extensive, covering the mid-seventeenth to the mid-nineteenth century in over ten thousand volumes or bundles. This paper provides an introduction to what is available, and examines in particular the period 1748–1772 when George Adams senior was Mathematical Instrument Maker to this Office. It is shown that during this period Adams supplied over 1500 instruments, ranging from drawing pens to theodolites, detailed in 148 bills amounting to a total value of £2425. Some other well-known instrument makers, such as Thomas Wright, Benjamin Cole & Son, and Jesse Ramsden, were also occasional suppliers of instruments in the same period, while from 1765 onwards the records include bills for instruments purchased by the Office of Ordnance for the Royal Observatory from makers such as Dollond and Bird. The total number of instrument makers' bills located and examined in the period searched, including the 148 by Adams, was 166. In addition, though not within the scope of this paper it was observed that the records contain numerous bills by William Deane before, and by Jeremiah Sisson after, the period of Adams' appointment respectively. Consumer concerns pop up. They are relatedto the safety of agrifood products for people, foranimals, and for the environment as well as the socialand ethical implications of certain agrifoodproduction methods. At first sight, the WTO agreementand the SPS and TBT agreements appear to offersufficient legal scope to deal with these concerns andresolve trade conflicts. The events of recent years,however, have shown the limitations of theseagreements in dealing with cultural differencesbetween nations and in dealing with the social andpolitical pressure on (...) national governments to lay downrestrictive, trade distorting measures. It is vitalthat we consider the dynamic relationship betweennational governments, civil society, and the market.In the United States, Canada, and Europe, thisrealization is growing. We propose that these issuesshould be studied by experts in several disciplines:technical experts, hygiene experts and veterinarians,public administration experts, lawyers, philosophers,ethicists, sociologists, and, of course, economists.To unite these disciplines and provide a platform fordiscussion in the light of international tradeliberalisation, the cultural identity of distinctcommunities, and the functioning of the democraticnation state an international network is needed. Wetherefore propose establishing a network to explorethe issues and dynamics described above. The networkshould be international and interdisciplinary withparticipants, initially, from science and government.The purpose of the network would be to present newperspectives to the negotiating parties in the nextWTO round. In addition, the healthy living conditions of the detainees, It also includes issues such as meeting the needs of the detainees such as churches and baths. Tazkire decisions aiming to ensure the flow of daily life in Egypt during wartime without causing a possible instability are always valid state policies aiming at state order and social welfare. This study revisits the debate on trade reform in Latin America, focusing specifically on what combinations of conditions were necessary and sufficient for very rapid trade liberalization. It departs significantly from two types of studies that have been previously used to examine Latin American trade reform: those using large samples and linear statistics to test the mean effects of variables on levels of trade protection and those isolating necessary conditions for rapid reform but using a small (...) number of case studies. Using fuzzy-set qualitative comparative analysis and short case studies, the study considers trade policy in sixty-one administrations. It finds that a key motivating factor for rapid trade opening is potential resistance from protected industry; it further identifies several other important enabling conditions, such as hyperinflation, devaluation, and an unconstrained executive. In combination, these enabling conditions are sufficient to account for a high percentage of rapid reform episodes. (shrink)

The aim of this essay is to survey the logic behind the Tory ministerial decision to bring a quick end to the hostilities with France in the early 1710s by looking at a tri-weekly journal called The Mercator (1713–14). Founded by Henry St. John, Viscount Bolingbroke, then Secretary of State, and his economic advisor Charles Davenant, with a view to justifying their grandiose plan to liberalise the Anglo-French trade relationship as part of a new European order initiated by the (...) Mineral waters were a delicate and unstable product whose value as a remedy increased in early modern France. If it was once the prised luxury of the nobility travelling to the spa, the eighteenth century slowly watched it turned into a commodity. The waters became widely available in bottles and were sold in bureaus of distribution. Despite the logistical challenges of selecting and carrying the waters to their new urban public, many different springs made their way into most of France’s (...) cities. This took place under the watch and regulation of a uniquely dedicated institution, the Société de Médecine. This Société eventually settled its authority over the management of mineral waters, thanks to the backing of state power, the influence of the Academy and the newly recognized authority of chemists as analysts of waters. The purpose of this paper is to bring to light this overlooked institution and its essential role in the administration of mineral waters. Though it never eradicated fraud or succeeded in creating a full scientific and economic monopoly, it greatly broadened the budding trade of bottled water in France and gave a powerful incentive for chemists to better their mastering of the particularly challenging analysis of water. In the wake of two recent developments in stem cell research, it is a fitting time to reassess the claim that stem cells will radically transform the concept and function of medicine. The first is the U.S. Food and Drug Administration’s decision in January 2009 to approve Geron Corporation’s Phase I clinical trial using human embryonic stem cells for patients with spinal cord injuries. The second is the National Institutes of Health’s decision to permit federal funding of research using (...) donated IVF human embryos in their July 2009 Guidelines on Human Stem Cell Research. We are now poised to see whether stem cell research can deliver on what it promises. However, what exactly does it promise and how? Moreover, who is doing the promising? Turning to the use of metaphor can help us to answer these questions and enable us to develop a better appreciation of the unique features of promised stem cell therapies. Indeed, metaphors have exerted profound influence in medicine, and it is fitting that we seek new metaphors for new therapies where appropriate. In this case, other metaphors such as magic bullets or the Holy Grail cannot capture what is unique about stem cells. Accordingly, I propose a new metaphor: the stem cell superhero. Stem cell superheroes are characterized by the following traits: they are seemingly capable of fighting the evil of virtually all disease and they seem to be our only hope of doing so, although to summon them we must make difficult moral choices. In the course of assessing the merits of three recent yet covert references to the superhero metaphor, I conclude that this powerful new paradigm employs a problematic logic, but that the aspiration as such is a good one. The book focuses on two pillars of China's economic success: industrial enterprises and the national system of innovation. The first part investigates the nature and evolution of productive enterprises, concentrating on the rounds of transformation of their ownership structure. The second part analyses the structure of China's national innovation systems. The analysis is based on a thorough study of statistical data provided by the China Statistical Yearbook, the World Bank and other sources. Alberto Gabriele emphasizes two key points, which constitute (...) a partly novel interpretation of two aspects of China's unique development. The first point is the crucial role of public ownership of the country's core means of production, in the framework of a harmonious market where different types of property coexist. China, the author argues, gradually abandoned old-fashioned administrative command tools and is relying more and more on indirect and value-based forms of strategic control of productive assets. The second point is China's strategic emphasis on technological progress and innovation, accompanied by an effort to develop national capacity and reduce its dependence on other countries. China's drive to become a first-class technological power revolves around the enhancement of its national innovation system, the author says. Most new drugs are protected by pharmaceutical patents, which give the patent holder exclusive control over that drug’s supply for 20 years. When the patent term expires, the drug becomes available for generic production by any company. The resulting competition typically leads to dramatic reductions in price. In Brazil, generic drugs are on average 40% cheaper than reference or brand-name drugs. In the United States, the Federal Drug Administration reports up to 85% price differences. Consumers in India have witnessed (...) more than 100-fold price reduction for antiretroviral drugs due to generic production. Generics thus play a key role in broadening access to health care, mostly by driving costs down, both in the developing and developed world. (shrink)

Among American adults 20 years and older, 59 percent take at least one prescription drug on a regular basis. Unlike most branded drugs, which are generally drugs that have a trade name and are protected by a patent, off‐patent generic drugs make up approximately 90 percent of prescriptions annually filled in the United States; yet in 2017, generic drugs made up only 23 percent of total drug costs in the U.S. The U.S. Food and Drug Administration has taken (...) the lead in encouraging increased competition in the nation's prescription drug marketplace, most recently with its release of the agency's Drug Competition Action Plan, but also with its regulatory guidance and enforcement efforts to eliminate “gaming” of the regulatory process by both branded and generic pharmaceutical manufacturers. Such “gaming” activities include “pay‐for‐delay” agreements involving financial compensation between branded and generic pharmaceutical manufacturers to forestall the emergence into the market of generic pharmaceuticals to compete against a formerly patent‐protected branded drug. A combination of new enabling legislation, federal judicial guidance, and agency regulatory activities show promise in encouraging increased competition in the prescription drug marketplace, with the American consumer the ultimate beneficiary of lower health care costs and improved overall personal health. This paper considers the trend towards megaregionalism that became prominent in the trade domain in the last years of the Obama administration. While megaregionalism has fallen by the wayside since Trump’s inauguration, the underlying rationale for such treaties will most likely reassert itself rather soon. So there are structural issues that need to be discussed from a standpoint of global justice. In all likelihood, megaregionalism is detrimental to global justice. TTIP in particular, or anything like it, might derail (...) any possibility for a trade organization to aid the pursuit of justice at the global level, and any possibility that trade will be used to that end. From the standpoint of global justice one must hope that megaregionalism does not replace WTO multilateralism. De plus, le Groupe spécial a procédé à un tournant procédural en présentant ses conclusions sous forme d’un jugement purement juridico-administratif tout en gardant implicites ses propres jugements sur les questions de fond liées aux risques.The high-profile WTO trade dispute on GMOs brought in scientific expertise in somewhat novel ways. From the outset, the Panel placed the dispute under the WTO Sanitary and Phytosanitary Agreement by drawing on a new legal ontology. The Panel brought scientific expertise into play in specific ways that defined how experts were questioned, the answers they would give, their specific role in the legal arena, and the way their statements would complement the Panel’s findings. Furthermore, the Panel created a procedural turning point in WTO jurisprudence by representing its findings as a purely legal and administrative assessment of whether the EC’s regulatory procedures violated the SPS Agreement, with its own assessments on substantive risk issues remaining implicit. Gene editing techniques, such as CRISPR, are being heralded as powerful new tools for delivering agricultural products and foods with a variety of beneficial traits quickly, easily, and cheaply. Proponents are concerned, however, about whether the public will accept the new technology and that excessive regulatory oversight could limit the technology’s potential. In this paper, we draw on the sociotechnical imaginaries literature to examine how proponents are imagining the potential benefits and risks of gene editing technologies within agriculture. We derive (...) our data from a content analysis of public comments submitted to the Food and Drug Administration’s 2017 docket titled “Genome Editing in New Plant Varieties Used for Food.” Our sample frame consists of 26 comments representing 30 agriculture and biotech companies, organizations, and trade associations. Our findings reveal three key sociotechnical imaginaries, including that gene editing technologies in agriculture: are not GMO but instead equivalent to traditional plant breeding; have the potential to usher in a new Green Revolution; and could facilitate the democratization of agricultural biotechnologies. We argue that forming and projecting these collective interpretations of the potential of gene editing technologies for crops and foods plays an important role in efforts by proponents to influence regulatory oversight, modes of governance, and build public acceptance. This research contributes to calls by science and technology studies scholars to investigate emergent concerns and imaginaries for novel technoscientific advances to help inform upstream models of public engagement and governance decisions. In a wide-ranging, provocative anatomy of modern society and its origins, novelist and historian John Ralston Saul explores the reason for our deepening sense of crisis and confusion. Throughout the Western world we talk endlessly of individual freedom, yet Saul shows that there has never before been such pressure for conformity. Aims. Currently, methylphenidate (MPH, trade name Ritalin) is the most widely prescribed medication for attention deficit/hyperactivity disorder (ADHD). We examined the ability of repeated MPH administration to produce a sensitized appetitive eagerness type response in laboratory rats, as indexed by 50-kHz ultrasonic vocalizations (50-kHz USVs). We also examined the ability of MPH to reduce play behavior in rats which may be partially implicated in the clinical efficacy of MPH in ADHD. Design. 56 adolescent rats received injections of either (...) 5.0 mg/kg MPH, or vehicle each day for 8 consecutive days, and a week later received a challenge injection of either MPH or vehicle. Measurements. Both play behavior (pins) and 50-kHz USVs were recorded after each drug or vehicle administration. Results. MPH challenge produced a substantial 73% reduction in play behavior during the initial treatment phase, and during the last test (1 week post drug), 50-kHz USVs were elevated approximately threefold only in animals with previous MPH experience. Conclusions. These data suggest that MPH treatment may lead to psychostimulant sensitization in young animals, perhaps by increasing future drug-seeking tendencies due to an elevated eagerness for positive incentives. Further, we hypothesize that MPH may be reducing ADHD symptoms, in part, by blocking playful tendencies, whose neuro-maturational and psychological functions remain to be adequately characterized. The purpose of this paper is to describe the nature of dental practice and to identify some recent innovations which have effect on cost containment in dentistry. The first of these innovations is dental insurance or prepaid dental services. Dental insurance has only recently emerged as a significant economic factor. The chronic and prevalent nature of dental disease mandates that the management of these programs incorporate insurance devices which limit demand and utilization. These devices amount to cost containment measures. The (...) second factor to be discussed is advertising. Advertising has been foisted on the dental profession by recent rulings of the Federal Trade Commission in an effort to promote competition. The Reagan administration, despite a market oriented approach to health care, had attempted to blunt some of the FTC actions. Advertising, nevertheless, has the potential to stimulate competition and restrain price escalation. The third factor includes a discussion of alternative delivery systems. These commercially oriented dental enterprises have the potential to compete with established practices as well as increase the demand for services. (shrink)

The hitherto neglected Pandechion epistemonicon, Ulisse Aldrovandi’s extant manuscript encyclopaedia, indicates that Renaissance naturalists did not necessarily apply the humanist jack-of-all-trades, the commonplace book, in their own field without considerably altering its form. Over many years the Italian natural historian tested and recombined different techniques to arrive at the form of paper technology that he considered to be the most fit for his purposes. Not all of these techniques were taught at school or university. Rather, Aldrovandi drew on administrative practices (...) as well as on the bookkeeping practices of early modern merchants that he knew first-hand. Reconstructing the formation and use of the Pandechion this article contributes to the historiography of learned reading and information management in Renaissance Europe. (shrink)

In 1798, the National Institute and the French minister of foreign relations invited European countries to send delegations of science practitioners to Paris to finalise the values of the metre and the kilogram. This article reads the event as part of a wider attempt to establish the political relevance of international scientific consensus and include scientific exchanges in the diplomatic culture of post-revolutionary Europe. At the end of the 18th century, the scope and methods of both the sciences and diplomacy (...) were being renegotiated. French academicians hoped that the new system of weights and measures would at once facilitate international scientific exchanges and advertise that new authority should be politically invested in savants. During the Directory, part of the political elite hoped to stabilise the Revolution and forge an international order where the Republic could coexist with old regime monarchies. This entailed focusing diplomatic negotiations on commercial development, something a shared metrological system could foster. The conference was the product of the alliance between the two groups. Foreign responses to the project reveal the novelty of the association between scientific discussions and diplomatic negotiations. Furthermore, European savants and governments did not agree that metrological reforms fell primarily under the expertise of science practitioners, rather than under that of trading actors or administrators. The conference did not produce consensus on the suitability of the metric system or on the feasibility of programmes for the unification of weights and measures. It was more successful at promoting precision and rationality as key parameters to assess metrological systems and science practitioners as main experts in the matter. (shrink)

This volume presents critical writings on the work of the later mercantilists. Sir Josiah Child was elected a governor of the East India Company in 1681. His reputation as an economist rests on his book 'A New Discourse of Trade' published in 1693. His work stimulated a wide range of discussion of such topics as interest rates, population, wage policy, poor relief and colonization. Despite many liberal elements in his thinking, he was a typical Mercantilist in his preference for (...) administrative solutions to economic problems. John Locke, best known for his work on political philosophy, made a major contribution to the debate on the rate of interest in his essay 'Some Considerations of the Consequences of the Lowering of Interest and Raising the Value of Money' (1692). The central theme of that pamphlet was that the rate of interest, being the price for the hire of money, is determined by the demand for and supply of money, which Parliament is powerless to affect. Locke's other major contribution to economic thought was the so called labour theory of private property contained in the 'Two Treaties on Government' (1690), a classic in the history of political philosophy. This article argues that the key crisis that has overtaken today’s global economy is the classical capitalist crisis of over-accumulation. Reaganism and structural adjustment were efforts to overcome this crisis in the 1980s, with little success, followed by globalization in the 1990s. The Clinton administration embraced globalization as the “Grand Strategy” of the United States, its two key prongs being the accelerated integration of markets and production by transnational corporations and the creation of a multilateral system of global governance, (...) the pillars of which were the World Trade Organization, the International Monetary Fund and the World Bank. The goal of creating a functionally integrated global economy, however, stalled, and the multilateral system began to unravel,thanks among other things to the multiple crises created by the globalization of finance, which was the main trend of the period. In response partly to these crises, partly to increasing competition with traditionally subservient centre economies, and partly to political resistance in the South, Washington under the Bush administration has retreated from the globalist project, adopting a nationalist strategy consisting of disciplining the South through unilateralist military adventures, reverting to methods of primitive accumulation in exploiting the developing world, and making other centre economies bear the brunt of global adjustments necessitated by the crisis of over-accumulation. From a largely Western phenomenon, the “animal turn” has, in recent years, gone global. Animals and Human Society in Asia: Historical, Cultural and Ethical Perspectives is just such a timely product that testifies to this trend.But why Asia? The editors, in their very helpful overview essay, have from the outset justified the volume's focus on Asia and ensured that this is not simply a matter of lacuna filling. The reasons they set out include: the fact that Asia is the cradle (...) of early human settlement and animal domestication; Asia encompasses an extreme diversity of closely connected ecosystems and human cultures; Asia is the place where the world's major religions originated; and, as in other parts of the world, Asia's use of animals for food and other utilitarian purposes constitutes a prominent feature of its culture. All of these factors, they argue, made Asia a unique lab for the exploration of major developments in human civilization and the complexities of human-animal interactions.Based on these premises, the book is divided into four parts, each concentrating on areas that the editors consider to have paramount significance in world history: Part I, “Hunting and Domestication”; Part II “Animals as Food”; Part III “Animals at War”; and Part IV “Animals in Culture and Religion.” As many good works on animal studies do, the volume adopts a truly cross-disciplinary approach, uniting scholars from disciplines as diverse as archaeology, history, anthropology, art, religion, literature, and cultural studies. Together, they demonstrate, with reference to telling archaeological evidence how the early societies in this region have been highly dependent upon the increasingly sophisticated interactions with and uses of mega-herbivores in the protracted and by no means clear-cut transition from hunting and herding towards the agricultural way of life, affirming the co-existing and co-constituting relations between humans and other animals in the deep past of Asia.The chapters in the section on “Animals at War” equally reveal the crucial roles that animals have played in the military sphere, as either a practical war technology or a show of military power. “Elephants in Mongol History” revisits the thesis of elephant-mounted troops in South and Southeast Asia as a barrier to Mongol expansion. Through its lively account of the pivotal battles in Mongolian history, especially that against India and China, it illustrates with great success the complex interactions between animals (especially elephants, horses, and humans), technology, and the geographical environment, which jointly exercised their influence on the outcome of warfare and degree of success of political rule. Turning away from the dynamic of warfare, the following two chapters explore the biopolitical question of the management of the horse as a bio-resource in the Mamluk Sultanate of Egypt and Syria (1250–1517) and early Ming Dynasty China, respectively. The first one places its focus on the breeding, procurement, and feeding of the horse subjects in question, while the latter concentrates on the human organization of various resources for the upkeep of government horses—a conventional area of study called “horse administration” in the institutional history of the government in China.The last section, “Animals in Culture and Religion,” examines the changing images of apex predators, such as lions and tigers, in Buddhist perceptions from South Asia to East Asia; the cult of the Horse King in late Imperial China; and the significance of animal signs in Mongolian historiography. They represent an established approach in animal studies that seeks to understand different aspects of human culture through symbolic or metaphorical animals. Instead of treating the animals discussed as mere abstractions, which has been a frequent criticism of works that adopt this approach, the relations between the symbolic animals and their prototype in the natural world were attentively explored. The essay on the cult of the Horse King, for example, closely links the wax and wane of the cult since late imperial China with the changing use and subsequent disuse of the actual horses in agriculture, transportation, commerce, and quotidian life. Yet, classic as these essays on symbolic animals are, one does feel slightly unsatiated when coming to the end of this section, which also marks the end of this volume. Having been reminded early in the introductory essay that Asia was “a major site for the emergence of moral teachings and ethical guidance on the treatment of animals” and how this legacy “still affects the lives of billions of humans to this very day,” one feels naturally rather let down that no article in this volume directly addresses this vital ethical dimension, especially since it belongs to a series on “animal ethics.”Indeed, regarding the task of placing either the nonhuman animals or the ethical relations between humans and other animals center stage, the essays in this volume achieve only varying levels of success. Some authors exhibit a more acute awareness of what “animal studies” or “animal ethics” might entail epistemically and methodically and experiment by paying closer attention to the species-specific characteristics, experience, and agency of nonhuman animals in order to cast off the deified anthropocentrism previously ruled in humanist scholarship. However, others have made no such attempt. For example, in Part II of “Animals as Food,” an essay on the production and consumption of milk in contemporary China, albeit alert to the issue of health hazards to consumers, omits any consideration of the subject from the dairy cows’ perspective under the modern intensive farming system. Moreover, otherwise superb research on the tuna-fishing industry in Japan, with its insightful discussion of the nexus between knowledge economies and imperial politics, too passes over any discussion of the fate of the tuna, whether collectively as a group of living organisms containing 15 species or individually as animals with an embodied experience. One does ponder whether these essays would fit better in a volume on the cultural history of food or on the entwining history of knowledge production, economics, and politics, which conventionally position human interests at the center of research.Taken as a whole, this is an impressive volume that directs our attention to the hitherto understudied world of Asia in animal studies. The long durée, with its interdisciplinary and interregional approach, also most powerfully presents a past in Asia that could not have been the same without the participation of animals at every level, from everyday life to the shaping of cultural values, the construction of belief systems, the building of a national identity, and even the rise and fall of regimes. Scholars and students interested in expanding the frontier of our understanding of the world with a more inclusive “we” should find a wealth of interesting subjects on which to build further research. Finally, the volume also presents a fitting occasion for all scholars committed to animal studies to consider the grave challenge confronting the field that arose alongside its growing respectability and rapid expansion: Should it be oriented toward the destabilization of our previously anthropocentric conception of the world? Or should no such perimeter be imposed, as in this volume? The overall breadth and limitations of this volume leave one pondering this issue. (shrink)

Smith also intensified his fight against the absurdity of the government's mercantile system of encouragements and prohibitions, which thwarted competition in the market place and favoured clamorous producers over consumers. The article examines the politicization of fear following the 11 September 2001 attacks on the World Trade Towers. It analyzes the role of mass media imagery in the wide-spread production of fear, focusing on the color-code « Terror Alert System » put in place by the Bush administration. It is argued that the recentering of governmental action on the preemptive response to threat has introduced a new time structure into politics which effectively renders futurity present. Through signs of (...) fear conveyed in mass media imagery this present futurity strikes the body at the level of affect, triggering the unfolding of a process bifurcating onto a number of self-differentiating but interconnected levels of experience. That process is construed in the essay as a « collective individuation » in Gilbert Simondon’s sense. A new vocabulary for the understanding of affective unfolding is proposed involving a four-fold distinction between « vitality affect », « pure affect », « emotion », and « affective tone ». Were they furthering ‘an exploration of the erotics of the relation between teacher and student’ as the professor says—or was it part of a pattern of sexual harassment as the student later charged?” So ran (...) the copy on an envelope advertising in 1994 an “extraordinary one-time offer $9.95 trial subscription” to Lingua Franca in 1994. 1 The enclosed letter relates an anecdote about two complaints against Jane Gallop filed by two female graduate students alleging she had sexually harassed them. Gallop defended having French-kissed a graduate student in a bar in front of other students in the same class by saying it was a pedagogical performance. The letter quotes from a Lingua Franca cover story that came to Gallop’s defense [Talbot].As sex between students and professors has become a topic of new interest in the wake of sexual harassment legislation, as colleges have adopted campus sexual conduct codes or debate doing so, and as debates and incidents involving sex and teaching have attracted widespread media attention, the anecdote has become central. Some critics might want to dismiss the Lingua Franca story as nothing more than titillating tabloid gossip or take it seriously only by regarding it as an effort to combat a right-wing agenda to smear innocent professors who, as feminist or queer, are politically and intellectually well to the left of the mainstream. But the anecdotal interests us precisely because it involves more than just a tabloid scandal in any simple sense. Sex is not merely a way one can slur kinds of criticism one doesn’t like by tarnishing its proponents (for teaching sexual, transgressive material to shock, pervert, or in the extreme case—as in this instance—literally seduce students) though it can sometimes function in this way. For sex comes up in anecdotes told by cultural critics to one another, and when it comes up, it comes up in the same way it does in “tabloid” coverage. The anecdote about sex is never really just about sex, about who did or didn’t (French) kiss, suck, and/or fuck whom: it is rather a story about something in the pedagogical relation that has gone wrong, about a connection that has gone off track. Anecdotes about sex and teaching are really stories about criticism, about pedagogy itself as a form of criticism, and about failed pedagogy as the occasion for self-criticism.Yet if the anecdote is not really about sex, sex is hardly irrelevant to the production of what the anecdote is really about, namely, criticism. Indeed, we want to focus on the question of sex between students and professors because it is precisely sexuality that puts pressure on different, key aspects of the project of cultural criticism and on the present contestation over it within and outside of academia. Campus codes are being introduced [End Page 72] as new pedagogical practices, and new courses are being introduced into the classroom: disruption though impersonation, performative strategies, bringing the personal and the erotic into the classroom, and classes making use of pornography, even hardcore visual pornography, often taught by feminist women. 2 According to leading cultural critics, destabilizing gender roles shows us how gender is constructed, and tells us about power in ways that are politically and performatively effective. 3But there is often a moment when the game breaks down in the classroom. Someone gets offended, and given the way that for some sexual harassment extends from unwanted sexual advances or trading grades for sexual favors to classroom materials (both written and visual), offense can easily move into complaint, legal action, media attention, and of course administrative and professorial panic. The usual rationale for transgressive pedagogy is that this disruption will be successful, not just anarchic: it will be successful in that it gets in the way of the replication and reproduction of power (this is the new mission for teaching: to disrupt the transmission and reproduction of patriarchal power structures... This case details the new product development and approval of Posilac®, an animal drug product pioneered by the Monsanto Company. The product is a genetically engineered hormone known as bovine somatotropin and was targeted for sale to dairy farmers to enhance the milk production of their herds. At the time of its development and subsequent introduction to the market, Posilac® represented one the first applications of genetic engineering in food production and as such, it became a lightning rod for controversy. The division of competences is even problematic for the administration.Since 1980, the communities also have international competences, for instance to ratify treaties. These competences are legal and constitutional, although the Central Government (...) tries to cut them down. Women’s health activists laid the groundwork for passage of the law that created the U.S. Food and Drug Administration in 1906. The pharmaceutical and food industries fought regulatory reforms then and continue to do so now. We examine public health activism in the Progressive Era, the postwar era and the present day. The women’s health movement began in the 1960s, and criticized both the pharmaceutical industry and the medical establishment. In the 1990s, patient advocacy groups began accepting industry funds; (...) thousands of commercially-funded groups now dominate the advocacy landscape. As pharma funding became normalized, concerns arose regarding a) the lack of transparency and public accountability regarding funding, b) the distortion of groups’ agendas, and c) the ability of pharma-funded groups to dominate the discourse and override less well-resourced patient and health advocacy groups. Although industry-funded groups argue that funding allows them to provide useful services, the trade-off in health risks, exorbitant prices and distorted information is far too high. Sincerity is beside the point; patients and the industry have differing interests when it comes to drug safety and efficacy, drug information and drug prices. A growing resistance movement is asserting the values of its activist predecessors and opposing the prevailing culture of pharma-funded advocacy. (shrink)

This study summarizes and discusses the trends and main features of South Korean studies on Japan's economy and business since the 1960s. I consulted 271 publications (articles and books) for this study. Academic and individual publications comprise 69.7% (189 publications) of the total; public and corporate research institutes 30.3% (82 publications). Therefore, academic and individual researches constitute a majority of the publications. The most pressing issues for South Korea are those of business administration, such as Japanese corporate governance, Zaibatsu, (...) and Japanese firms, which have been mainly studied by academic and individual researchers. The second most important issues are those of international economics such as FTA, FDI, and the trade deficit between South Korea and Japan, mainly researched by government research institutes and individual researchers. Although more interest seems to have shown in the Japanese economy and business since the 1990s, the number of Ph.D. holders who studied economics and business in Japan has been keeping very small portions compared with other majors. In order to attract more students from Korea, the Japanese graduate system for economics and business studies needs to be more globalized and competitive. (shrink)

The expansiveness of Harl’s welcome new treatment allows the reader access to virtually all of the significant stages and changes in the development of Roman coinage and their effects on the economy of the ancient Roman world and supplies knowledge crucial to a comprehensive understanding of how the Roman economy functioned, and, ultimately, why the empire was successful.Surprisingly enough, it was necessary for Harl to address many long-standing objections to the significance of coinage in the Roman economy before engaging in his survey. According to Finley, since the Romans struck coinage only intermittently, coins could not have played a major role in determining Roman fiscal policy. Others who now acknowledge that a great number of Roman coins were put into circulation, object that coinage could not have played an important role in the “underdeveloped” agrarian-based society of Rome. Still others, admitting the significance of coins in commerce in the Roman world, have argued that their use in trade was only incidental. In other words, the Roman government did not mint coins to stimulate trade, but simply to pay for expenses such as military and administrative payrolls or building contracts.In chapter 1, “Coins, the Money of the Roman Economy,” Harl counters Finley’s objections by arguing that since Finley’s work, many statistical studies have estimated the enormous outputs of coins that the Romans could mint on short notice if necessary. So in periods when there was a shortage of coins, the Romans could in fact very quickly pump more money into the economy. Harl argues that the supposed absence of coins in rural areas of the Roman world is simply due to the limitations of archaeology in that not all of the town centers and marketplaces in rural areas of the Roman world have been excavated. Furthermore, although he acknowledges the centrality of land in the Roman economy, he also points out the importance of seaborne trade to it. He next admits that coins were primarily issued by the state for government payrolls or payments [End Page 139] to contractors, but nonetheless he stresses that the degree of importance which Roman coinage had in commerce was equal to that which it possessed in government fiscal policies. Thus, although the use of coinage was fiscal in origin, its contribution to commercial growth was increasingly important as the empire expanded.Harl then provides a summary of the methods by which the Roman government manipulated the coinage in periods of inflation or emergency, or when the currency simply needed to be replenished due to deterioration of the metal content. In such instances, the Romans generally didn’t melt down and restrike worn coins but instead either lowered the tariff of the old coins against new coins which were issued or simply minted debased new coins with a precious metal content equal to that of the old coins in circulation. Summary As soon as he was appointed Minister of Public Instruction in 1863, Victor Duruy embarked on a major reform of French education. One of his most important initiatives was the creation of a new secondary curriculum designed to prepare for careers in industry, trade, and agriculture. Edme Fremy, professor at the Muséum d'histoire naturelle, took the opportunity of proposing a course of instruction in practical chemistry that would be offered at the Muséum for young men intending to work (...) in industry. Duruy approved the proposal, and funds were immediately made available. In contrast, Charles-Adolphe Wurtz, who led an internationally recognized research laboratory in organic chemistry in the Paris Faculty of Medicine, had difficulty in securing either administrative recognition or financial support. This article draws on the correspondence that Fremy and Wurtz exchanged with Duruy and senior officials in the Ministry between 1863 and 1869 to bring out the significance of the divergent ministerial responses to the two laboratories. The article examines the Scandinavian model of public administration, which is characterized by a corporate decision-making system (state – trade unions – employers), in which the role of coordinator in this structure is assigned to the authorities. It was determined that the state assumes responsibility for providing the population with social benefits and exercises control over the economy, promoting fair competition, safe working conditions and employment of the population. Characteristic features are a high level of trust of citizens (...) in public authorities and their participation in decision-making (through a referendum, consultations with the public, trade unions), openness and accountability of public authorities to the population. It is highlighted that the studied Scandinavian countries, Sweden and Norway, are leaders in the world in terms of the standard of living of the population, economic development, ensuring social standards and political stability, which is a guarantee of the high competitiveness of the Scandinavian countries. It is noted that different levels of government (state, regional, local) work together on favorable conditions for the country’s development and on ensuring quality living conditions for its citizens. A reliable basis for ensuring the high competitiveness of the countries under study is the balanced and effective functioning of all subsystems within the nation. Scandinavian countries are able to maximally combine progressive political and economic development and a high level of social security in modern conditions, which is a necessary condition for achieving high competitiveness in the world.Thus, the comparative study conducted in the mentioned Scandinavian countries using the method of binary longitudinal temporal comparison made it possible to single out a model of public policy of liberal democratic states, in which effective interaction between the government and society regarding the development and implementation of political decisions is established.Constructive factors that affect the relationship between the government and society and contribute to the functioning of this model of public policy are: clear legislative regulation of the legal status of all participants in the socio-political process; high level of political and legal culture and consciousness; stable economy; the activity of expert groups, the presence of independent institutes of control over the activities of the authorities, and others. The number of constructive factors of influence in these states significantly exceeds the level of destructive ones. An important condition for the functioning of public policy in liberal democracies is the presence of feedback between the government and society. (shrink)

Defining a minister's power is not an easy exercise. It bas to be put in a broader framework: a pluralistic democracy, that has respect for human rights and basic freedoms and a market economy that is developping towards a national border crossing competition and cooperation. But there are also some basic rules coming from national but also regional and supranational institutions. There nowadays exists a so called 'Gulliver-effect': the state represented by the governement is like a giant that is threatened (...) by a lot of surrenders whoforce him towards a powerless existence. Although citizens often have the impression politics is capable of doing anything it wants to, policy makers more often have to cope with restrictions that obstruct them in their policy aims.At the beginning of the twenty-first century ministers are heavily counterbalanced by other institions. Trade unions, big lobby groups, administration, the cabinets, the party executive and party president, parliament and the media: they all threaten a minster's power. Also the rising power of regional and supranational decision levels makes the power of a politician decline. In the future, rising information and communication skills will not only change the character of politics but also that of modern society. The internet, the globalisation ofeconomy and other changes will transform politics in a fundamental way. Leadership, power and authority will change strongly and the relationship between the citizens and their authority will never be the same again. (shrink)

Advertising by health care institutions has increased steadily in recent years. While direct-to-consumer prescription drug advertising is subject to unique oversight by the Federal Drug Administration, advertisements for health care services are regulated by the Federal Trade Commission and treated no differently from advertisements for consumer goods. In this article, we argue that decisions about pursuing health care services are distinguished by informational asymmetries, high stakes, and patient vulnerabilities, grounding fiduciary responsibilities on the part of health care providers (...) and health care institutions. Using examples, we illustrate how common advertising techniques may mislead patients and compromise fiduciary relationships, thereby posing ethical risks to patients, providers, health care institutions, and society. We conclude by proposing that these risks justify new standards for advertising when considered as part of the moral obligation of health care institutions and suggest that mechanisms currently in place to regulate advertising for prescription pharmaceuticals should be applied to advertising for health care services more broadly. Taming the power of Wall Street was a principal campaign theme for Franklin Delano Roosevelt in the 1932 election. Roosevelt's election bore fruit in the Securities Act of 1933, which regulated the public offering of securities, the Securities Exchange Act of 1934, which regulated stock markets and the securities traded in those markets, and the Public Utility Holding Company Act of 1935 (PUHCA), which legislated a wholesale reorganization of the utility industry. The reform effort was spearheaded by the newly created (...) Securities and Exchange Commission, part of the new wave of experts brought to Washington to rein in business. PUHCA also marked the federal government's first significant incursion into corporate governance, with a corresponding reduction in the traditional role of investment bankers. The SEC's ascendance over the investment bankers was reinforced during FDR's second term by the Chandler Act of 1938, which provided the agency with a broad role in the bankruptcy reorganization of troubled companies.Enacting those statutes was only the beginning, as the scope and effectiveness of the SEC's regulatory efforts depended critically on navigating these new statutes past an initially hostile Supreme Court. After substantial delay in the lower courts, the securities statutes eventually got a friendly hearing in the Supreme Court, where a number of Justices came to the Court after serving as the "Founding Fathers" of the federal securities laws. Roosevelt's Supreme Court nominees were involved in drafting the new legislation, securing its passage in Congress and implementing a litigation strategy that successfully stalled final determination of the constitutionality of the securities laws until New Deal appointed justices were in place. Felix Frankfurter played an important role in shaping the Securities Act and PUHCA, and was a key advisor on litigation strategy to the Roosevelt administration. Hugo Black led the legislative battle to enact PUHCA against the utility companies. Stanley Reed and Robert Jackson were key courtroom advocates arguing PUHCA's constitutionality. William O. Douglas headed the study of Protective Committees that led to the Chandler Act and was Chairman of the SEC. In this article, we explore the role of the New Deal justices in enacting the securities laws, litigating the challenges brought against them and then interpreting these laws in securities cases before the Supreme Court. We show the important role that these New Deal justices played in ensuring a broad scope for the federal securities laws through generous interpretation. Once constitutional questions had faded, securities cases proved to be a critical testing ground for newly emerging theories of administrative law. We demonstrate the split over the importance of judicial review versus deference to the rule of experts that emerged among these Roosevelt appointees. Finally, we explore the relative lack of influence of Douglas and Frankfurter in these cases, despite their familiarity and experience with the securities laws. (shrink)
