With regard to the handling of dual use research, the dominant approach in Germany aimed at mitigating dual use risks emphasizes the freedom of research and the strengthening of academic self-regulation. This article presents this approach as one example for a framework for handling security-relevant research, underlines the need for awareness-raising about risks of security-relevant research, and, more generally, highlights some of the dilemmas researchers and legislators face when dealing with security-relevant research. The article furthermore presents the key questions developed (...) by the German Joint Committee on the Handling of Security-Relevant Research to provide guidance for researchers and institutions when they address possible research of concern. It applies these key questions in a case study of a well-publicized experiment in which artificial intelligence and drug discovery technologies were used to determine their dual use potential in identifying highly toxic chemical substances. Moreover, it discusses the utility of the framework applied in Germany and concludes that this approach is practicable. Given the strong emphasis on the researchers’ own responsibility, however, awareness of dual use risks and risk mitigation strategies should be further enhanced and an academic culture of responsible handling of security-relevant research should be promoted. El propósito de “Venganza imaginaria y espera escatológica” es demostrar como la temporalidad heredada de la religión cristiana se divide en dos regímenes distintos. Uno nos permite profundizar y ralentizar, según un largo proceso de incorporación. El otro, vinculado a una teleología fantasmática, es un tiempo acelerado por el ansioso esfuerzo de acabar con todo. En el conflicto que opone estas dos temporalidades, Nietzsche procura definir tres tipos de relaciones entre la espera y la expectativa.

El artículo analiza el problema de los mundos humanos a partir del concepto de mundo circundante que J. von Uexküll plantea para pensar la existencia animal. En este sentido, introduce dicho concepto biológico y sus implicancias, reconstruye las interpretaciones y críticas que se le formulan en la antropología filosófica alemana de principios del siglo XX, y defiende la idea según la cual, desde un horizonte arqueológico, habría una oposición correlativa entre el Umwelt biológico y las ideas filosóficas de mundo humano (...) previamente tematizadas. RESUMEN Largamente desatendida o malinterpretada, la noción de caos en la filosofía de Nietzsche es una pieza constitutiva de la particular concepción del ser que este autor habría dejado apenas esbozada. El artículo se propone elaborar este concepto en la obra nietzscheana, siguiendo algunas de las metáforas que lo iluminan. Desde allí se busca plantear los rasgos centrales de una ontologia del caos, de sesgo no metafísico, que, al afirmar el carácter acontecimental de la realidad, puede verse como precursora de (...) la ontología hermenéutica contemporánea. ABSTRACT The notion of chaos, which has long been neglected or misinterpreted, is a constitutive element of a peculiar conception of being that the philosopher only had time to outline. The objective of this article is to elaborate on this concept in Nietzschean philosophy, guided by some of the metaphors that shed light on it. This serves as the basis to set forth the main characteristics of a non-metaphysical ontology of chaos that asserts the eventful nature of reality and can thus be seen as a precursor of contemporary hermeneutic ontology. Ya Jakob Grimm sabía que “el derecho y la literatura surgen del mismo lecho”. Se encuentran estrechamente relacionados y se influyen en los ajustes: el derecho puede entenderse como una forma de literatura, cuando analizamos su textura, lo tomamos como una narración o consideramos el estilo de los abogados. Encontramos muchos aspectos jurídicos en la literatura, sobre todo en Kafka, pero también en Thomas Bernhard, que pensaron que “el mundo entero es una enorme jurisprudencia”. Además, no podemos hablar de (...) derecho en la literatura, sino de forma más práctica de literatura en el derecho, por ejemplo, cuando los tribunales deciden sobre el carácter ficticio de las novelas. Por último, la literatura puede alcanzar un tipo de justicia que el derecho no puede. Este contexto normativo más amplio de derecho y literatura está cubierto por la “justicia poética”. Derecho y literatura es, pues, un proyecto interdisciplinario que analiza la inserción cultural del derecho. (shrink)

Resumen: El artículo propone una lectura de la meseta “10000 AC. La geología de la moral ” desde el punto de vista de una ontología del espacio. Nos concentraremos específicamente en el concepto de estrato. En los primeros dos apartados se mostrará que todo estrato supone aspectos materiales y semióticos. Para ello se explicitarán algunos conceptos de la geología y de la lingüística utilizados por Deleuze y Guattari. Los apartados 3, 4 y 5 se ocuparán, sucesivamente, de los conceptos de (...) substrato, epistrato y paraestrato. En la articulación de estos conceptos se juegan tres aspectos fundamentales para pensar la configuración de todo espacio actual: la territorialización, la desterritorialización relativa y la codificación/descodificación. Esta tipología de estratos da cuenta de lo diverso espacial y será estudiada a partir de algunas de las fuentes utilizadas por los autores. Se hará un énfasis especial en la obra de Pia Laviosa Zambotti, fuente crucial para comprender la tipología de estratos, como así también en ciertos aspectos del pensamiento de Jacques Monod y Jakob Von Uexküll, claves para pensar el concepto de mundo circundante en la determinación de la noción de paraestrato. The Geology of Morals ” from the perspective of an ontology of space. We will deal specifically with the concept of stratum. In the first and second paragraphs we will show that every strate is composed of both material and semiotic aspects. In order to do so we will develop some notions of geology and lingüistics used by the authors. Then, paragraphs 3, 4 and 5 will deal, succesivelly, with the concepts of substratum, epistratum and paraestratum. Three fundamental aspects of actual space are configured in the articulation of these three concepts: territorialization, relative deterritorialization and codification/decodification. This tipology of strates gives an account of spatial diversity and it will be studied through some of the sources utilized by Deleuze and Guattari. The thought of Pia Laviosa Zambotti will receive special attention since her work is an essential source of the tipology of strates. Some aspects of the thoughts of Jacques Monod and Jakob Von Uexküll will also be taken into account, especially those concerning the concept of umwelt and paraestratum. La tesi che si intende discutere è che il progetto sia l’intima essenza dell’uomo. I primi argomenti a suo favore non vanno tuttavia ricercati nella riflessione antropologica, in quanto il “discorso dell’uomo sull’uomo” presume il suo stesso oggetto di ricerca, rischiando di “avvitarsi” in un circolo vizioso senza uscita. Non è casuale che, in tal senso, le intuizioni più illuminanti siano state espresse attraverso il linguaggio mito-poietico. Già nel Protagora Platone, con le figure di Prometeo e di Epimeteo, mette in (...) scena il dramma di una condizione umana che si presenta quale strutturale privazione di qualità specifiche, che la sola “capacità anticipante” del Titano può risarcire, facendosi portatrice della tecnica come istanza di sopravvivenza in ambiente ostile. Da questo momento in avanti, l’avventura del progetto diventa metonimica protensione verso le cose a venire (ad-ventura); condizione necessaria, ancorché non sufficiente, per orientarsi in un mondo inteso come stato di indeterminazione dal quale emanciparsi. Tali premesse paiono oggi indicare una possibile via di uscita alla crisi di valori generata dal capitalismo finanziariario, che ci costringe a vivere in un rinnovato stato di incertezza, all’interno di un desolante paesaggio di rovine. La rigenerazione della città, in tale scenario, costituisce pertanto la ripresa di un cammino, destinato a incontrare difficoltà e resistenze, anche politiche. Un viatico necessario alla riproposizione tentativa di futuri possibili: nella consapevolezza che essi si fondino sulla capacità di formulare ipotesi sul passato – divenuto “criticamente” il nuovo ambiente in cui operare – sempre sospesi tra il “non più” del mondo alle nostre spalle e il “non ancora” di quello che auspichiamo a venire. A partire dalla fondamentale distinzione tra Umwelt e Welt, introdotta dall’etologo Jakob von Uexküll, i percorsi della filosofia fenomenologico-esistenziale si intrecciano con quelli dell’Antropologia filosofica, confermando il senso dell’avventura del progetto e il suo problematico intrecciarsi con i destini dell’uomo. Max Scheler, Helmuth Plessner, Arnold Gehlen, Martin Heidegger, Gunter Anders, e Hannah Arendt, nutrono la consapevolezza che il carattere aporeticamente sfuggente dell’essenza umana derivi dalla costante riformulazione del rapporto “uomo”/“mondo”, di cui il progetto risulta il paradossale fondamento “effimero”. Ciò impone che la cultura del progetto sia la prima a doversi mettere in gioco, ponendosi come continua interrogazione sui propri principi, metodi, regole ed esiti, da sottoporre a un incessante processo di verifica e confutazione. L’avventura del progetto diventa pertanto espressione architettonica dell’esistenza – intesa come fuoriuscita dal ciclico riproporsi di uno stato di incertezza – che nel suo divenire costruisce la realtà sociale quale unico mondo abitabile dall’uomo, sempre uguale per quanto mai identico. La vaga mención de ciertas fuentes “orientales” como origen de los “sistemas emanativos” por parte de Jakob Brucker se transforma en un motivo de sugestión para la historiografía posterior. El concepto plotiniano de “procesión” queda fundido con el concepto historiográfico de “emanación”, lo que supone una equiparación de doctrinas (...) distintas bajo un solo gran rótulo. Este rótulo resulta aplicado tanto a la filosofía plotiniana como a las doctrinas de Filón de Alejandría, a la cábala hebrea y cristiana, al gnosticismo, al hermetismo y, ya entrado el siglo XIX, a la filosofía india. Como consecuencia de esta filiación entre “sistema de emanación” y “Oriente”, la filosofía de Plotino será primero excluida del canon de la filosofía europea, pero se irá volviendo además una de las matrices interpretativas principales para la recepción de nuevas filosofías de África y Asia. The phenomenology of agency and perception is probably underpinned by a common cognitive system based on generative models and predictive coding. I defend the hypothesis that this cognitive system explains core aspects of the sense of having a self in agency and perception. In particular, this cognitive model explains the phenomenological notion of a minimal self as well as a notion of the narrative self. The proposal is related to some influential studies of overall brain function, and to psychopathology. Organisations increasingly use automated decision-making systems (ADMS) to inform decisions that affect humans and their environment. While the use of ADMS can improve the accuracy and efficiency of decision-making processes, it is also coupled with ethical challenges. Unfortunately, the governance mechanisms currently used to oversee human decision-making often fail when applied to ADMS. In previous work, we proposed that ethics-based auditing (EBA)—that is, a structured process by which ADMS are assessed for consistency with relevant principles or norms—can (a) help organisations (...) verify claims about their ADMS and (b) provide decision-subjects with justifications for the outputs produced by ADMS. In this article, we outline the conditions under which EBA procedures can be feasible and effective in practice. First, we argue that EBA is best understood as a ‘soft’ yet ‘formal’ governance mechanism. This implies that the main responsibility of auditors should be to spark ethical deliberation at key intervention points throughout the software development process and ensure that there is sufficient documentation to respond to potential inquiries. Second, we frame AMDS as parts of larger sociotechnical systems to demonstrate that to be feasible and effective, EBA procedures must link to intervention points that span all levels of organisational governance and all phases of the software lifecycle. The main function of EBA should, therefore, be to inform, formalise, assess, and interlink existing governance structures. Finally, we discuss the policy implications of our findings. To support the emergence of feasible and effective EBA procedures, policymakers and regulators could provide standardised reporting formats, facilitate knowledge exchange, provide guidance on how to resolve normative tensions, and create an independent body to oversee EBA of ADMS. A new theory is taking hold in neuroscience. It is the theory that the brain is essentially a hypothesis-testing mechanism, one that attempts to minimise the error of its predictions about the sensory input it receives from the world. It is an attractive theory because powerful theoretical arguments support it, and yet it is at heart stunningly simple. Jakob Hohwy explains and explores this theory from the perspective of cognitive science and philosophy. The key argument throughout The Predictive Mind (...) is that the mechanism explains the rich, deep, and multifaceted character of our conscious perception. It also gives a unified account of how perception is sculpted by attention, and how it depends on action. The mind is revealed as having a fragile and indirect relation to the world. Some monothematic types of delusions may arise because subjects have unusual experiences. The role of this experiential component in the pathogenesis of delusion is still not understood. Focussing on delusions of alien control, we outline a model for reality testing competence on unusual experiences. We propose that nascent delusions arise when there are local failures of reality testing performance, and that monothematic delusions arise as normal responses to these. In the course of this we address questions concerning the tenacity with (...) which delusions are maintained, their often bizarre content, the patients' inability to dismiss them, and their often circumscribed character. This article examines the financial technology of derivatives. Derivatives are financial products whose values are based on possible fluctuations in the values of underlying assets. Hence derivatives markets are markets that trade in the risks of other markets. In order for derivatives markets to function, forms of prognostication that can assess the possible future fluctuations of the underlying markets are necessary. What such prognostications do, the article argues, is to create information out of future possibilities. Building upon a notion of (...) virtuality derived from Gilles Deleuze, Ulrich Beck and Niklas Luhmann, the article shows how market risks and uncertainties, by means of prognostications, cease to be mere possibilities and instead come to have virtual existence. Through the technology of derivatives, uncertainty and risk can be rendered virtual and be traded. The article suggests that this technology is an example of a new way in which capitalism is now expanding self-referentially as it creates markets out of markets; and of how it is colonizing the future by developing new technologies for ‘hyper-speculation’, that is, speculation not in the possible developments of a given asset but simply in the risk of such speculation. This chapter seeks to recover an approach to consciousness from a general theory of brain function, namely the prediction error minimization theory. The way this theory applies to mental and developmental disorder demonstrates its relevance to consciousness. The resulting view is discussed in relation to a contemporary theory of consciousness, namely the idea that conscious perception depends on Bayesian metacognition; this theory is also supported by considerations of psychopathology. This Bayesian theory is first disconnected from the higher-order thought theory, and (...) then, via a prediction error conception of action, connected instead to the global neuronal workspace theory. Considerations of mental and developmental disorder therefore show that a very general theory of brain function is relevant to explaining the structure of conscious perception; furthermore, this theory can subsume and unify two contemporary approaches to consciousness, in a move that seeks to elucidate the fundamental mechanism for selection of representational content into consciousness. Predictive processing (PP) is now a prominent theoretical framework in the philosophy of mind and cognitive science. This review focuses on PP research with a relatively philosophical focus, taking stock of the framework and discussing new directions. The review contains an introduction that describes the full PP toolbox; an exploration of areas where PP has advanced understanding of perceptual and cognitive phenomena; a discussion of PP's impact on foundational issues in cognitive science; and a consideration of the philosophy of science (...) of PP. The proposed European Artificial Intelligence Act (AIA) is the first attempt to elaborate a general legal framework for AI carried out by any major global economy. As such, the AIA is likely to become a point of reference in the larger discourse on how AI systems can (and should) be regulated. In this article, we describe and discuss the two primary enforcement mechanisms proposed in the AIA: the _conformity assessments_ that providers of high-risk AI systems are expected to conduct, and (...) the _post-market monitoring plans_ that providers must establish to document the performance of high-risk AI systems throughout their lifetimes. We argue that the AIA can be interpreted as a proposal to establish a Europe-wide ecosystem for conducting AI auditing, albeit in other words. Our analysis offers two main contributions. First, by describing the enforcement mechanisms included in the AIA in terminology borrowed from existing literature on AI auditing, we help providers of AI systems understand how they can prove adherence to the requirements set out in the AIA in practice. Second, by examining the AIA from an auditing perspective, we seek to provide transferable lessons from previous research about how to refine further the regulatory approach outlined in the AIA. We conclude by highlighting seven aspects of the AIA where amendments (or simply clarifications) would be helpful. These include, above all, the need to translate vague concepts into verifiable criteria and to strengthen the institutional safeguards concerning conformity assessments based on internal checks. Shaun Gallagher calls for a radical rethinking of the concept of nature and he resists reduction of phenomenology to computational-neural science. However, classic, reductionist science, at least in contemporary computational guise, has the resources to accommodate insights from transcendental phenomenology. Reductionism should be embraced, not feared.

The free energy principle says that any self-organising system that is at nonequilibrium steady-state with its environment must minimize its free energy. It is proposed as a grand unifying principle for cognitive science and biology. The principle can appear cryptic, esoteric, too ambitious, and unfalsifiable—suggesting it would be best to suspend any belief in the principle, and instead focus on individual, more concrete and falsifiable ‘process theories’ for particular biological processes and phenomena like perception, decision and action. Here, I explain (...) the free energy principle, and I argue that it is best understood as offering a conceptual and mathematical analysis of the concept of existence of self-organising systems. This analysis offers a new type of solution to long-standing problems in neurobiology, cognitive science, machine learning and philosophy concerning the possibility of normatively constrained, self-supervised learning and inference. The principle can therefore uniquely serve as a regulatory principle for process theories, to ensure that process theories conforming to it enable self-supervision. This is, at least for those who believe self-supervision is a foundational explanatory task, good reason to believe the free energy principle. (shrink)

An exciting theory in neuroscience is that the brain is an organ for prediction error minimization. This theory is rapidly gaining influence and is set to dominate the science of mind and brain in the years to come. PEM has extreme explanatory ambition, and profound philosophical implications. Here, I assume the theory, briefly explain it, and then I argue that PEM implies that the brain is essentially self-evidencing. This means it is imperative to identify an evidentiary boundary between the brain (...) and its environment. This boundary defines the mind-world relation, opens the door to skepticism, and makes the mind transpire as more inferentially secluded and neurocentrically skull-bound than many would nowadays think. Therefore, PEM somewhat deflates contemporary hypotheses that cognition is extended, embodied and enactive; however, it can nevertheless accommodate the kinds of cases that fuel these hypotheses. The involvement of ethicists, philosophers or others who might qualify as ‘moral experts’ in policy-development, where they are sometimes, typically as members of a committee, given an advisory role, is often seen as problematic, for several reasons. First, there may be doubts as to the very existence of moral experts, and it may be hard to know who the moral experts are. Next, even if these problems are solved, giving experts a special role in policy-making might be problematic from a (...) democratic point of view, if it involves politicians deferring to the moral judgements of experts. The paper considers possible replies to this problem of moral deference. One reply is that moral deference is unnecessary, because even moral non-experts are well equipped to assess the arguments offered by moral experts; I argue that this reply underestimates the complexity of moral arguments. Another reply is that if moral experts are simply given the ‘technical’ role of clarifying which concrete positions that follow from the values which decision-makers already accept, deference is not problematic. I will argue that this reply underestimates how a given set of moral values underdetermines which concrete positions follow from it. Finally, I will consider and defend the reply that since policy decisions are subject to a requirement that they be justified within the limits of public reason, and since these limits include a requirement that the justification be accessible, moral experts are barred from providing policy advice which rests on too complex moral arguments. The search for the neural correlates of consciousness is in need of a systematic, principled foundation that can endow putative neural correlates with greater predictive and explanatory value. Here, we propose the predictive processing framework for brain function as a promising candidate for providing this systematic foundation. The proposal is motivated by that framework’s ability to address three general challenges to identifying the neural correlates of consciousness, and to satisfy two constraints common to many theories of consciousness. Implementing the search (...) for neural correlates of consciousness through the lens of predictive processing delivers strong potential for predictive and explanatory value through detailed, systematic mappings between neural substrates and phenomenological structure. We conclude that the predictive processing framework, precisely because it at the outset is not itself a theory of consciousness, has significant potential for advancing the neuroscience of consciousness. Dieses zeigt sich als ein zunehmend gebrochen-fragiles; in dieser Schwächung kann sich jedoch eine neue Aufmerksamkeit für das Göttliche, das Menschliche und die Sprache entwickeln – in theologischer Diktion: Offenbarung Gottes nicht in einem „Mehr“, sondern in der Zurücknahme einer für den Menschen nicht fassbaren Fülle und im Abschied von fixierten Bildern.

The relationship between Legal Realism and Legal Positivism has been a recurrent source of debate. The question has been further complicated by the related difficulty of assessing the internal relationship between the two main original strands of Legal Realism: American and Scandinavian. This paper suggests considering American and Scandinavian Realism as instantiations of forward-looking and backward-looking rule skepticism respectively. This distinction brings into sharp relief not only the fundamentally different relationship between each of these two Realist schools and Legal Positivism (...) but also their equally different potentials as starting points for naturalizing jurisprudence. In this paper I want to give the metaphysical background to the problem, before turning to a more detailed consideration of how Spinoza in fact accounts for error, or the having of false ideas. I will show the importance of the notions of adequacy and inadequacy in Spinoza's account. Delusion formation may also involve some kind of top-down (...) mechanism. This could be in the shape of a patient's flawed background beliefs, or biases, which somehow modulate perception or ensure delusional interpretations of experience. There is little agreement about what kind of mechanism is primary in delusion formation, or, indeed, what the particular mechanisms and their neural substrates might be.In the evaluation of top-down and bottom-up mechanisms in delusion formation, a number of conceptual questions should be addressed (Davies and Coltheart 2000). For example, if there is an experiential component, why is a hypothesis with a delusional explanation of the unusual experience seen as relevant? Why do the subjects come to believe it tenaciously? How come some unusual experiences do not develop into delusions?A number of empirical findings also need to be taken into account: for example, the damage to the autonomic system in Capgras delusion (Ellis et al. 1997), the decreased ability for fast error correction in schizophrenia (Frith and Done 1989), modulation of activity in parietal cortex in delusions of alien control and other passivity experiences (Blakemore, Oakley, and Frith 2003), and also in schizophrenia, the increased sensitivity to self-produced stimuli, such as tickling oneself (Blakemore et al. 2000) and the sound of one's own voice (Ford et al. 2001).Theory choice can also be guided by philosophical doctrines about, for example, the nature of belief, the constitutive role of rationality, and intersubjectivity and the nature of judgements about the external world. It is natural, however, to let beliefs about philosophical doctrine be secondary to empirical findings and conceptual issues.The distinction between bottom-up and top-down mechanisms is particularly sharp in John Campbell's (2001) account of delusions and in Tim Bayne and Elisabeth Pacherie's (2004) discussion of Campbell. In this discussion, top-down approaches are associated with the general philosophical doctrine of rationalism, and bottom-up approaches with the philosophical doctrine of empiricism. Campbell's account is top-down because he posits delusional framework beliefs that arise directly as a result of brain damage or malfunction, and that work in some top-down fashion on the interpretation of experience. Bayne [End Page 65] and Pacherie convincingly defend empiricism against Campbell's rationalist account. Among their many other objections, they briefly puzzle about how a delusional framework belief (e.g., that one's spouse is an impostor) in a top-down fashion could cause the damage to the autonomic system seen in the Capgras and Cotard delusions (2004, 1). I think this is a very important objection because skin conductance data are part of the evidence for the bottom-up hypothesis concerning the Capgras delusion. We could add to this, for example, that it is mysterious how belief in a top-down fashion could cause people with schizophrenia to be worse at fast error correction than normal controls, to be better at tickling themselves than normal controls, and to have an increased response to the sound of their own voice.On the other hand, although the skin conductance response (SCR) evidence suggests a bottom-up approach to the Capgras delusion, it does not explain the character of the subjective experience that is hypothesized to give rise to the delusional belief: reduced SCR is not part of the experience itself (thanks to Ian Gold for discussion of this). Something more is required to give a full account of the type of experience that gives rise to the delusion. Further, as they stand, most bottom-up accounts are unable to account for why reality testing fails for beliefs based on these experiences.Neither rationalism nor empiricism on their own seem able to address the conceptual questions while paying... A series of recent developments points towards auditing as a promising mechanism to bridge the gap between principles and practice in AI ethics. Building on ongoing discussions concerning ethics-based auditing, we offer three contributions. First, we argue that ethics-based auditing can improve the quality of decision making, increase user satisfaction, unlock growth potential, enable law-making, and relieve human suffering. Second, we highlight current best practices to support the design and implementation of ethics-based auditing: To be feasible and effective, ethics-based auditing (...) should take the form of a continuous and constructive process, approach ethical alignment from a system perspective, and be aligned with public policies and incentives for ethically desirable behaviour. Third, we identify and discuss the constraints associated with ethics-based auditing. Only by understanding and accounting for these constraints can ethics-based auditing facilitate ethical alignment of AI, while enabling society to reap the full economic and social benefits of automation.
