This book provides a thorough critical overview of the current debate on the ethics of war, as well as a modern just war theory that can give practical action-guidance by recognizing and explaining the moral force of widely accepted law. Traditionalist, Walzerian, and "revisionist" approaches have dominated contemporary debates about the classical jus ad bellum and jus in bello requirements in just war theory. In this book, Uwe Steinhoff corrects widely spread misinterpretations of these competing views and spells out the (...) implications for the ethics of war. His approach is unique in that it complements the usual analysis in terms of self-defense with an emphasis on the importance of other justifications that are often lumped together under the heading of "lesser evil." It also draws on criminal law and legal scholarship, which has been largely ignored by just war theorists. Ultimately, Steinhoff rejects arguments in favor of "moral fundamentalism"-- the view that the laws and customs of war must simply follow an immutable morality. In contrast, he argues that widely accepted laws and conventions of war are partly constitutive of the moral rules that apply in a conflict. ‘No-platforming’—the practice of denying someone the opportunity to express their opinion at certain venues because of the perceived abhorrent or misguided nature of their view—is a hot topic. Several philosophers have advanced epistemic reasons for using the policy in certain cases. Here we introduce epistemic considerations against no-platforming that are relevant for the reflection on the cases at issue. We then contend that three recent epistemic arguments in favor of no-platforming fail to factor these considerations in and, as a result, (...) offer neither a conclusive justification nor strong epistemic support for no-platforming in any of the relevant cases. Moreover, we argue that, taken together, our epistemic considerations against no-platforming and the three arguments for the policy suggest that no-platforming poses an epistemic dilemma. While advocates and opponents of no-platforming alike have so far overlooked this dilemma, it should be addressed not only to prevent that actual no-platforming decisions create more epistemic harm than good, but also to put us into a better position to justify the policy when it is indeed warranted. Der protestantische Theologe Karl Girgensohn (1875–1925) ist 1903 mit seinem frühen Werk über das Wesen der Religion an die Öffentlichkeit getreten, welches einen starken religionsphilosophischen Standpunkt zum Ausdruck bringt. Kernüberlegung ist hierbei eine kognitive Theorie des Religiösen, in der die Gottesidee zentral ist. Unter Berücksichtigung der Biographie Girgensohns geht der vorliegende Beitrag auf diese frühe Studie zum Wesen der Religion ein und skizziert den Übergang des Autors von einem philosophischen zu einem experimentell-introspektiven Ansatz der Religiositätsforschung, welcher dann zum Fundament für (...) die Dorpater religionspsychologische Schule wurde. Basierend auf Girgensohns frühem Werk werden abschließend Implikationen für die heutige empirische Theologie vorgeschlagen.The Protestant theologian Karl Girgensohn (1875–1925) came to the public in 1903 with his early work on the nature of religion, which expresses a strong religious-philosophical standpoint. The core consideration here is a cognitive theory of the religious, in which the idea of God is central. Taking into account Girgensohn’s biography, the present contribution addresses this early study on the nature of religion and outlines the author’s transition from a philosophical to an experimental-introspective approach to religious research, which then became the foundation for the Dorpat School of the psychology of religion. In this book Uwe Steinhoff describes and explains the basic tenets of just war theory and gives a precise, succinct and highly critical account of its present status and of the most important and controversial current debates surrounding it. Rejecting certain in effect medieval assumptions of traditional just war theory and advancing a liberal outlook, Steinhoff argues that every single individual is a legitimate authority and has under certain circumstances the right to declare war on others or the state. He (...) also argues that the just cause cannot be established independently of the other criteria of jus ad bellum (the justification of entering a war), except for right intention, which he interprets more leniently than the tradition does. Turning to jus in bello (which governs the conduct of a war) he criticizes the Doctrine of Double Effect and concludes that insofar as wars kill innocents, and be it as "collateral damage", they cannot be just but at best justified as the lesser evil. Steinhoff gives particular attention to the question why soldiers, allegedly, are legitimate targets and civilians not. Discussing four approaches to the explanation of the difference he argues that the four principles underlying them all need to be taken into account and outlines how their weighing can proceed if applied to concrete cases. The resulting approach does not square the distinction between legitimate and illegitimate targets with the distinction between soldiers and civilians, which has extremely important consequences for the conduct of war. Finally, Steinhoff analyses the concept of terrorism and argues that some forms of "terrorism" are actually not terrorism at all and that even terrorism proper can under certain circumstances be justified. Answer-set programming (ASP) has emerged as a declarative programming paradigm where problems are encoded as logic programs, such that the so-called answer sets of theses programs represent the solutions of the encoded problem. The efficiency of the latest ASP solvers reached a state that makes them applicable for problems of practical importance. Consequently, problems from many different areas, including diagnosis, data integration, and graph theory, have been successfully tackled via ASP. In this work, we present such ASP-encodings for problems associated (...) to abstract argumentation frameworks (AFs) and generalisations thereof. Our encodings are formulated as fixed queries, such that the input is the only part depending on the actual AF to process. We illustrate the functioning of this approach, which is underlying a new argumentation system called ASPARTIX in detail and show its adequacy in terms of computational complexity. (shrink)

In the first part, the paper describes in detail the classical conception of intentionality which was expounded in its most sophisticated form by Edmund Husserl. This conception is today largely eclipsed in the philosophy of mind by the functionalist and by the representationalist account of intentionality, the former adopted by Daniel Dennett and David Chalmers, the latter by John Searle and Fred Dretske. The very considerable differences between the classical and the modern conceptions are pointed out, and it is argued (...) that the classical conception is more satisfactory than the two modern ones, not only regarding phenomenal adequacy, but also on the grounds of epistemological considerations. In the second part, the paper argues that classical intentionality is not naturalizable, that is, physicalizable. Since classical intentionality exists (in the experiences that display it), the non-naturalizability of classical intentionality implies psychophysical dualism. (shrink)

In Petersen :665–694, 2003) it was established that adding \ to \ \ is sufficient to prove the totality of primitive recursive functions but it was also indicated that this would (...) not extend to 2-recursive functions such as the Ackermann–Péter function, for instance. The purpose of the present paper is to expand the underlying idea in the construction of \ to gain a stronger notion, conveniently labeled \, which is sufficient to prove a form of nested double induction and thereby the totality of 2-recursive functions. New Publications on Nietzsche’s Musical Aesthetics and Philosophy of Music. The significance of music in Nietzsche’s aesthetic writings is undisputed. However, the question of the role that music played in Nietzsche’s thought and writing process still yields divergent answers which are not free of speculative interpretations. New publications on Nietzsche’s aesthetics of music cover a wide range of themes: from the significance that the syllabic rhythms of Greek antiquity held for Nietzsche to the relationship between sounds and language in poetic (...) texts, for example, and the processes to which Nietzsche applied himself as a composer of music. This makes it very clear that music is not simply a complementary element to express what cannot be said in language, nor is it a form of relief from the tragic perception of life. (shrink)

A conceptualization of capitalism as a consequence of functional differentiation is proposed. The general theoretical model of a functionally differentiated capitalist society is outlined in four steps based on these keywords: functional differentiation; capitalist economy; capitalist society; welfare state. This model grasps the essential characteristics of the analytical prototype of a capitalist society. What are its basic components that, working together, generate this kind of society’s structural dynamics?

This book offers a philosophical analysis of the moral and legal justifications for the use of force. While the book focuses on the ethics self-defense, it also explores its relation to lesser evil justifications, public authority, the justification of punishment, and the ethics of war. Steinhoff’s account of the moral use of force covers a wide range of topics, including the nature of justification in general, the precise elements of different justifications, the logic of claim- and liberty-rights and of rights (...) forfeiture, the value of human life and its limits, and the principles of reciprocity and precaution. While the author’s analysis is primarily philosophical, it is informed by a metaethical stance that also places heavy emphasis on existing law and legal scholarship. In doing so, the book appeals to widely shared moral intuitions, precepts, and concepts grounded in criminal law. Self-Defense, Necessity, and Punishment offers the most comprehensive and systematic account of the ethics of self-defense. This chapter offers a version of Cartesian dualism that draws on the resources of a Husserlian account of intentionality. For example, it argues that 'I can locate myself at the point in space from which I am looking at the world (my 'center of perspective')'. It relies on empirical phenomenology to show that this location that does not correspond to my body or any part of it. Phantom sensations provide confirming evidence. Next, the chapter uses the example of blurred (versus (...) sharp) vision to provide evidence of qualitative properties that cannot be instantiated within the physical world. Finally, it argues that the self's endurance through calls for explanation in terms of patterns of psychophysical causation or interaction. (shrink)

Arguing against the doctrine of double effect, Bennett claims that the terror bomber only intends to make his victims appear dead. An obvious reply is that he intends to make them appear dead by killing them. I argue that the alleged refutations of this reply rest on a mistaken test question to determine what an agent intends, as Bennett's own test question confirms, and that Bennett is misled by confusing metaphorical death and literal death. Moreover, Bennett's argument is half-hearted anyway, (...) and going the whole way would not only undermine the DDE but also Quinn's revision of it. (shrink)

Studies have shown that in the mammalian neuromuscular system stretch reflexes are localized within individual muscles. Neuromuscular compartmentalization, the partitioning of sensory output from muscles, and the partitioning of segmental pathways to motor nuclei have also been demonstrated. This evidence indicates that individual motor nuclei and the muscles they innervate are not homogeneous functional units. An analysis of the functional significance of reflex localization and partitioning suggests that segmental control mechanisms are based on subdivisions of motor nuclei–muscle complexes. A partitioned (...) organization of segmental control mechanisms could utilize (1) the potential functional diversity of muscle fiber types, (2) the variety of mechanical actions of individual muscles arising from their distributed origins and insertions, and (3) diverse architectural features such as intramuscular variations in pinnation and complex in-series and in-parallel arrangements of muscle fibers. The differentiated activity observed in some muscles during natural movements also calls for localized segmental control mechanisms. Partitioning may also play a role in mechanical interactions between contracting motor units and in increasing the stability of neuromuscular systems. The functional advantages of reflex localization and partitioning suggest they are probably common features of segmental systems, whose organization reflects the structure and function of their associated neuromuscular systems. Confirmation bias is one of the most widely discussed epistemically problematic cognitions, challenging reliable belief formation and the correction of inaccurate views. Given its problematic nature, it remains unclear why the bias evolved and is still with us today. To offer an explanation, several philosophers and scientists have argued that the bias is in fact adaptive. I critically discuss three recent proposals of this kind before developing a novel alternative, what I call the ‘reality-matching account’. According to the account, confirmation (...) bias evolved because it helps us influence people and social structures so that they come to match our beliefs about them. This can result in significant developmental and epistemic benefits for us and other people, ensuring that over time we don’t become epistemically disconnected from social reality but can navigate it more easily. While that might not be the only evolved function of confirmation bias, it is an important one that has so far been neglected in the theorizing on the bias. (shrink)

Uwe Heyll zeigt auf, dass hinter den Placeboeffekten Funktionen des Erkennens stehen, die Geist und Körper zu einer untrennbaren Einheit verschmelzen lassen: Sie erzeugen ein Erleben, in dem sich das menschliche Selbst als Ausdruck der eigenen Persönlichkeit ausbildet. Auf dem Weg zur wissenschaftlichen Medizin wurden diese Funktionen jedoch schrittweise ausgesondert, so dass Placeboeffekte die Erscheinung (...) einer wissenschaftlichen Anomalie angenommen haben.
