Should we conceive of corporations as entities to which moral responsibility can be attributed? This contribution presents what we will call a political account of corporate moral responsibility. We argue that in modern, liberal democratic societies, there is an underlying political need to attribute greater levels of moral responsibility to corporations. Corporate moral responsibility is essential to the maintenance of social coordination that both advances social welfare and protects citizens' moral entitlements. This political account posits a special capacity of self-governance (...) that corporations can intelligibly be said to possess. Corporations can be said to be "administrators of duty" in that they can voluntarily incorporate moral principles into their decision-making processes about how to conduct business. This account supplements and partly transforms earlier pragmatic accounts of corporate moral responsibility by disentangling responsibility from its conventional linkages with accountability, blame and punishment. It thereby represents a distinctive way to defend corporate moral responsibility and shows how Kantian thinking can be helpful in disentangling the problems surrounding the concept. (shrink)

We establish a completeness theorem for first-order basic predicate logic BQC, a proper subsystem of intuitionistic predicate logic IQC, using Kripke models with transitive underlying frames. We develop the notion of functional well-formed theory as the right notion of theory over BQC for which strong completeness theorems are possible. We also derive the undecidability of basic arithmetic, the basic logic equivalent of intuitionistic Heyting Arithmetic and classical Peano Arithmetic.

Transparency is a crucial condition to implement a CSR policy based on the reputation mechanism. The central question of this contribution is how a transparency policy ought to be organised in order to enhance the CSR behaviour of companies. Governments endorsing CSR as a new means of governance have different strategies to foster CSR transparency. In this paper we discuss the advantages and disadvantages of two conventional policy strategies: the facilitation policy and the command and control strategy. Using three criteria (...) (efficiency, freedom and virtue) we conclude that both strategies are defective. Most attention is paid to the facilitation strategy since governments nowadays mainly use this. In evaluating this strategy we analyse the Dutch case. As an alternative we introduce a third government policy: the development of a self-regulating sub-system. By construing an analogy with the historical development of corporate financial disclosure, we point out that the vital step in the creation of a self-regulating subsys- tem is the creation of strong informational intermediate organisations. Abstract‘Corporate Social Responsibility (CSR) is conceptualized in many ways. We argue that one cannot be indifferent about the issue of its conceptualization. In terms of methodology, our position is that any conceptual discussion must embed CSR in political theory. With regard to substance, we link up with the discussion on whether CSR must be defined on the basis of a tripartite or a quadripartite division of business responsibilities. We share A.B. Carroll’s intuition that a quadripartite division is called for as (...) a basis to define CSR. However, defending the quadripartite division of business responsibilities requires that the distinctions between economic, legal, ethical and discretionary business responsibilities be made intelligible. Carroll’s account is defective in this respect. We argue that contemporary Neo-Kantian political ethics is able to make sense of these distinctions, because of its specific interpretation of liberalism. Interestingly, from a conventional liberal perspective this interpretation of liberalism is atypical, as it extends public morality beyond the domain of the law. (shrink)

The condition of explicit theoretically discursive cognitive performance, as it culminates in scientific activity, is, I claim, the life world. I contrast life world and scientific world and argue that the latter arises from the first and that contrary to the prevailing views the scientific world (actually, worlds, since the classical world is substantially different from the quantum world) finds its completion in the life world and not the other way around. In other words: the closure we used to search (...) in a complete and comprehensive scientific description of all aspects of experience by referring it back to underlying atoms, genes and other scientific objects and the covering laws ruling them, should be sought in a reintegrating and occasionally dissolving of the abstract scientific model in the self-organizational fluidity and superposition-like indeterminateness and non-locality of the life world: “We have to acknowledge the indeterminate as a positive phenomenon” (Merleau-Ponty in his The Phenomenology of Perception). Coping with stress has been primarily investigated as an individual-level phenomenon. In work settings, however, an individual’s exposure to demands is often shared with co-workers, and the process of dealing with these demands takes place in the interaction with them. Coping, therefore, may be conceptualized as a multilevel construct. This paper introduces the team coping concept and shows that including coping as a higher-level team property may help explain individual-level outcomes. Specifically, we investigated the effects of exposure to danger during (...) deployment on burnout symptoms in military service members and examined to what extent this relationship was moderated by individual-level and team-level functional coping. We hypothesized that the relationship between individuals’ exposure to danger and burnout is contingent on both. In line with our predictions, we found that service members who were highly exposed to danger, and did not engage in much functional coping, suffered most from burnout symptoms, but only when their teammates did not engage in much functional coping either. When their teammates did engage in much functional coping, the effect of exposure to danger on burnout was buffered. Hence, team members’ coping efforts functioned as a resilience resource for these service members. (shrink)

This paper provides an early evaluation of Artificial Intelligence against COVID-19. The main areas where AI can contribute to the fight against COVID-19 are discussed. It is concluded that AI has not yet been impactful against COVID-19. Its use is hampered by a lack of data, and by too much data. Overcoming these constraints will require a careful balance between data privacy and public health, and rigorous human-AI interaction. It is unlikely that these will be addressed in time to be (...) of much help during the present pandemic. In the meantime, extensive gathering of diagnostic data on who is infectious will be essential to save lives, train AI, and limit economic damages. (shrink)

Legal information retrieval is in need of the provision of legal knowledge for the improvement of search strategies. For this purpose, the LOIS project is concerned with the construction of a multilingual WordNet for cross-lingual information retrieval in the legal domain. In this article, we set out how a hybrid approach, featuring lexically and legally grounded conceptual representations, can fit the cross-lingual information retrieval needs of both legal professionals and laymen.

This paper argues that economic agents, including corporations, have the duty to further justice, not just a duty merely to comply with laws and do their share. The duty to further justice is the requirement to assist in the establishment of just arrangements when they do not exist in society. The paper is grounded in liberal theory and draws heavily on one liberal theorist, Kant. We show that the duty to further justice must be interpreted as a duty of virtue (...) that is owed. This means that the duty is not enforceable but that violating this duty is still wrong and not merely non-virtuous. Our analysis has consequences for the morality of commercial life. It is often suggested that the morality of the market is a special, restricted morality that is leaner than the morality that agents must acknowledge outside the market. If our analysis is correct, the duty to further justice cannot be exempted from market morality, even if it is agreed that this must be leaner than the morality outside commercial life. Our analysis also has direct consequences for John Ruggie’s view on the responsibilities of businesses. Ruggie has never explicitly acknowledged a duty on the part of business enterprises to further justice. If our analysis is correct, his view is contradictory in that it presupposes the normative validity of free market enterprise yet shrinks from taking into account the conditions of its possibility. This article deals with the question of how self-organization in living organisms is realized. Self-organization may be observed in open systems that are out of equilibrium. Many disequilibria-conversion phenomena exist where free energy conversion occurs by spontaneously formed engines. However, how is self-organization realized in living entities? Living cells turn out to be self-organizing disequilibria-converting systems of a special kind. Disequilibrium conversion is realized in a typical way, through employing information specifying protein complexes acting as nano engines. The genetic code (...) enables processing of information—derived from coding DNA—to produce these molecular machines. Hence, information is at the core of living systems. Two promising approaches to explaining living cells containing sequences carrying information are mentioned. Also discussed is the question of whether a second concept of self-organization—namely, the Kantian concept—applies. (shrink)

In this article some of the presuppositions that underly the current ideas about decision making capacity, autonomy and independence are critically examined. The focus is on chronic disorders, especially on chronic physical disorders. First, it is argued that the concepts of decision making competence and autonomy, as they are usually applied to the problem of legal (in)competence in the mentally ill, need to be modified and adapted to the situation of the chronically (physically) ill. Second, it is argued that autonomy (...) and dependence must not be considered as two mutually exclusive categories. It is suggested that decision making may take on the form of a more or less conscious decision not to be involved in making all kinds of explicit and deliberate decisions. Elaborating on Agich's distinction between ideal and actual autonomy, the concept of Socratic autonomy is introduced. (shrink)

This contribution is located in the field of Historical Theology. It gives an overview (post-World War II) of the philosophical-theological discourse on technology and humanity, articulated by academics who were members and ordained ministers of the Nederduitsch Hervormde Kerk van Afrika (NHKA). It serves to illustrate the close relationship between theology and philosophy within the theological tradition of the NHKA. The author concludes that there is a growing realisation that it is not primarily about technology anymore, but about humanity. Theologians would forsake their responsibility if they would stay quiet on something, which is not only transforming our world view and morality, but humanity itself.Contribution: The current discourse on technology tends to be dominated by economists, engineers, information technology specialists, jurists and medical specialists. As a result, technology takes the centre stage, emphasising the benefits of technological progress. In this contribution the creeds are examined in terms of their development, the inclusion of the articles on the church, their reception during the 16th century Reformation as well as difficulties in the official Afrikaans translations. The impact of philosophy of science on biology is slight. Evolutionary biology, however, is nowadays an exception. The status of the neo-Darwinian (synthetic) theory of evolution is seriously challenged from a methodological perspective. However, the methodology used in the relevant discussions is plainly defective. A correct application of methodology to evolutionary theory leads to the following conclusions. (a) The theory of natural selection (the core of neo-Darwinism) is unfalsifiable in a strict sense of the term. This, however, does not militate (...) against the theory, because no scientific theory whatever is testable in this way. Under a more liberal testability criterion, the theory is surely testable. None the less, certain (not all) research programs may tend to make the theory untestable in practice. (b) It has often been argued that the tautologous character of the principle of natural selection, allegedly the focus of evolutionary theory, makes the theory untestable through circular reasoning. Actually, the principle is only a tautology if fitness is wrongly defined in terms of actual survival. But even then circular reasoning need not ensue. (c) Evolutionary principles do not permit, without additional information, the derivation of statements about evolutionary events concerning particular species or populations. If this were a reason to criticize the theory (as has been argued in the literature), any other scientific theory would be inadequate by the same token. (shrink)

Periodic attacks of uncertain origin, where the clinical presentationresembles epilepsy but there is no evidence of a somatic disease, arecalled Pseudo-Epilepsy or Pseudo-Epileptic Attack Disorder (PEAD). PEADmay be called a `non-disease', i.e. a disorder on the fringes ofestablished disease patterns, because it lacks a rationalpathophysiological explanation. The first aim of this article is tocriticize the idea, common in medical science, that diseases are realentities which exist separately from the patient, waiting to bediscovered by the doctor. We argue that doctor and (...) patient construct adisease, and that the construction of the disease PEAD includes manynormative evaluations. The second aim is to provide insight into thesuffering of patients with PEAD. We focus on three aspects of thepatient, identity, autonomy and responsibility. We present somecharacteristic descriptions of (pseudo-)epileptic attacks by FjodorDostoevsky, Gustave Flaubert and Thomas Mann. We argue that diagnosingPEAD reduces a meaningful life event into an insignificant, thoughintriguing, medical phenomenon, and that the patient will not benefitfrom being diagnosed as having PEAD. In his 1939 Cambridge Lectures on the Foundations of Mathematics, Wittgenstein proclaims that he is not out to persuade anyone to change their opinions. I seek to further our understanding of this point by investigating an exchange between Wittgenstein and Turing on contradictions. In defending the claim that contradictory calculi are mathematically defective, Turing suggests that applying such a calculus would lead to disasters such as bridges falling down. In the ensuing discussion, it can seem as if Wittgenstein challenges Turing's (...) claim that such disasters would occur. I argue that this is not what Wittgenstein is doing. Rather, he is scrutinizing the meaning and philosophical import of Turing's claim—showing how Turing is wavering between making an empirical prediction and a logical observation, and that it is only through this wavering that Turing can believe that he has provided a proper explanation of why contradictory calculi are mathematically defective. Creatively operationalizing Claude Lévi-Strauss’ predicament that food is good to think with, I initiate a methodological conceptualization of food by exploring the ways in which it is apt to study Sri Lankan domestic and collective village life. Food is approached as an assemblage that is an emergent resultant of heterogeneous aspects with which it is deeply entangled and by way of which it turns into a potent agent shaping life. More specifically, I explore the vibrancy of these different components that (...) co-create the overall soundscape of food that as such becomes the conductor of Sri Lankan life. Food shapes domestic life by way of its preparation and consumption, and through its cultivation also conducts the collective rhythms at the village level. The conceptualization of food as an assemblage seeks to develop it as a methodology that opens up for a holistic integration and interdisciplinary collaboration. (shrink)

On occasion of Dr. Leavitt's criticism I would like to stress the following points: 1. In spite ofWolfson'sendeavourtoreduceSpinozatoAristotelian, scholastic and Jewish sources ofthe Middle Ages, many texts—in fact all texts in which Aristotle ismentioned—constitute (...) aconvincingproof that Spinoza not only rejected,just like Hume, all sorts ofAristotelian and scholastic speculation, buteven showedmuch contemptfor them.1 In the same way there cannot be any doubt that he rejected Maimonides' Jewish Aristotelianism.2 In the TTP he defines his position in sharp contrast to Maimonides. 2.Nominalism means that names may be used for the indication of many items whereas ideas are essentially ideas of particulars. According to Spinoza everything is reflected in its own specific idea,3 whereas names like 'ens', 'aliquid', 'man', etc. may be the sign, sometimes ambiguously but often also without confusion, of more things, which are vaguely conceived. An arms race for an artificial general intelligence would be detrimental for and even pose an existential threat to humanity if it results in an unfriendly AGI. In this paper, an all-pay contest model is developed to derive implications for public policy to avoid such an outcome. It is established that, in a winner-takes-all race, where players must invest in R&D, only the most competitive teams will participate. Thus, given the difficulty of AGI, the number of competing teams is unlikely (...) ever to be very large. It is also established that the intention of teams competing in an AGI race, as well as the possibility of an intermediate outcome, is important. The possibility of an intermediate prize will raise the probability of finding the dominant AGI application and, hence, will make public control more urgent. It is recommended that the danger of an unfriendly AGI can be reduced by taxing AI and using public procurement. This would reduce the pay-off of contestants, raise the amount of R&D needed to compete, and coordinate and incentivize co-operation. This will help to alleviate the control and political problems in AI. Future research is needed to elaborate the design of systems of public procurement of AI innovation and for appropriately adjusting the legal frameworks underpinning high-tech innovation, in particular dealing with patenting by AI. This paper explores semi‐formal interactions between SRI‐investors that take the governance route rather than deploy a best‐in‐class logic or exclusionary screening. On the basis of a stakeholder typology of the investor and of the chosen topic of interaction, namely compliance with the core ILO labour conventions, the paper formulates 10 expectations about management reactions to the concerns raised by investors. These expectations cover responsiveness, acknowledgment of positions and general attitude. The expectations are then related to the factual discourse by management (...) responding to such concerns raised by investors. Based on data obtained from the Portfolio21‐correspondence, which is a joint initiative of European investors, it is found that management is very willing to discuss cases but at the same time denies the truth‐value of the allegations. The purpose of this paper is to elaborate on the notion of clinical medicine as a hermeneutical enterprise and to bridge the gap between the general perspectives of hermeneutics and the particularities of medical practice. The case of a patient with low back pain is analyzed. The discussion centers around the metaphor of the patient as a text and a model of five social discourses about low back pain. The problems addressed are: (1) the nature of a moral experience, (2) (...) the variety of available texts, (3) the difference between the doctor's and patient's narratives, and (4) the patient's and doctor's responsibility regarding the existential, biographical meaning of an illness. Although many problems are left unsolved, it is argued that from a philosophical point of view the notion of medicine as a hermeneutical enterprise opens up the possibility of gaining insight in the foundations of the clinical encounter. Grime (1979) in a recently developed theory distinguished three basic plant strategies: stress tolerance,ruderality and competition. He relates them to environments characterized in terms of stress and disturbance. Classifications of strategies and environments both are ultimately defined in terms of production. This tends to make the theory tautological. If the theory is to make sense, environments had better be defined in independent terms.

Over the last few decades there has been a revival of interest in virtue ethics, with the emphasis on the virtuous caregiver. This paper deals with the ‘virtuous patient’, specifically the patient with End Stage Renal Disease (ESRD). We believe that a virtue approach provides insights not available to current methods of studying coping styles and coping strategies. Data are derived from seven semi-structured in-depth interviews. The transcripts of the interviews were subjected to an Interpretative Phenomenological Analysis (IPA). The focus (...) of the analysis was on ‘living well with chronic illness’. It appears that the moral challenges faced by patients with an ESRD are manifold. When they are invited to tell the story of their illness, they do not explicitly speak of virtues, but they often refer to moral qualities, and to attitudes that can be regarded as virtuous. We identify several such concepts in the narratives of patients with ESRD. We conclude that the Aristotelian model of virtue ethics is particularly descriptively (and possibly also normatively) relevant to the explanation of the life narratives and the moral challenges of patients with an ESRD. Wim Klever In Book 1 ofthe TreatiseofHumanNature1 Spinoza enjoys thehonour ofbeing the only figure from the history of philosophy and science to be explicitly and extensively discussed by Hume. This honour is, however, a dubious one as the treatment he gets is not so friendly. The passage (T 232-51) is full of insults and denunciations: Spinoza is referred to as "that famous atheist" (T 241), and (...) characterized as "universally infamous" (T 240). His doctrine contains "a true atheism" (T 240). His theory about the thinking substance is an "hideous hypothesis" (T 241); Hume does not want to enter "farther into these gloomy and obscure regions" (T 241), although he spends ten pages on the subject. Richard Popkin2 suggests on account ofthis not too well studied section: "In introducing Spinoza into the discussion of the immateriality ofthe soul, Hume follows what was common practice in his day." This statement, if true, raises the question whether Hume was sincere in writing these 'satanicverses'. Does he, after all, hide the backside of his tongue? This would bring him pretty well in line with two of his English forerunners; with Hobbes about whom Aubrey recorded: "He toldme he [Spinoza]had outthrown him [Hobbes] a bar's length, for he [Hobbes] durst not write so boldly," and with Locke, who possessedinhis privatelibraryall Spinoza's worksbutnonetheless, for one reason or another, refused to assess the theories of "those decried names," saying "I am not so well read in Hobbes or Spinoza as to be able to say what were their opinions in this matter" (namely the pre-existence ofthe soul).4 One commentator, named Gilbert Boss, wrote a two volume dissertation in order to argue for the fundamental opposition between the philosophical systems of both thinkers. In this paper I wish to propose another view and to defend their overall agreement. I will not do so with regard to their thought on religion (as this is already done byPopkin), but I shall more specificallyfocuson the theoretical (mainly epistemological) part oftheir work. Coming to Hume's text the reader of Spinoza's work who is, moreover, convinced by his geometrical demonstration of the propositions, does feel himself quite well at home chez Hume. Hume's is not another world for him. Apart from the question who is the real first modern thinker, Descartes, Hobbes, Spinoza or Hume, there is much common in their treatises on man and world, not only methodologically. Hume's rejection of "the antient philosophy," in Volume XVI Number 2 89 WIM KLEVER which he criticizes the "fictions... concerning substances, and substantial forms, and accidents, and occult qualities" (T 219), "sympathies, antipathies, and horrors ofa vacuum" (T 224) could have been written by the three other candidates as well. In fact every one of thoseitems maybe tracedoutin Spinoza's work; compare, for instance, JSp 136 ("doctrinam illam puerilem et nugatoriam de formis substantialibus, qualitatibus etc.") or 2 PPC 8s ("Quare omnia ilia figmenta de sympathie et antipathie ut falsa sunt reicienda... Nunquam dicendum erit, quod corpus aliquod movetur, ne detur vacuum; sed tantum ex alterius impulsu"). But let us go to the main theme in Book 1 ofthe Treatise, already present in Part 1, Section 1, "Ofthe Origin ofour Ideas." All our ideas result from impressions, themselves also being ideas or perceptions, though withmoreforce andliveliness. The original perceptions aresaid to be "the causes of our ideas" (T 5). We find the impressions in our mind and their effects, our ideas. Hume does not explain the cognitive status ofthe impressions by reducing them to non-cognitive processes. The "universe of the imagination" (T 68) is a world apart, irreducible to matter; we can't step out ofit, "since nothing is ever present to the mind but perceptions, and since all ideas are deriv'd from something antecedently present to the mind" (T 67). Ideas, whatever their character (about external existences or not), can only be explained by other ideas. Hume carefully avoids the category mistake of transcending the border from mental to material things and keeps consequently, at least methodologically, to the absolute caesura between mind and body. The author proved in his Ph.D. Thesis [W. Veldman, Investigations in intuitionistic hierarchy theory, Ph.D. Thesis, Katholieke Universiteit Nijmegen, 1981] that, in intuitionistic analysis, the positively Borel subsets of Baire space form a genuinely growing hierarchy: every level of the hierarchy contains sets that do not occur at any lower level. It follows from this result that there are natural examples of analytic and also of co-analytic sets that are not positively Borel. It turns out, however, that, in intuitionistic analysis, (...) one may give surprisingly different and, in some sense, much more simple examples of analytic and co-analytic sets that fail to be positively Borel. In the paper, two such examples are given. In proving them correct, one obtains new proofs of the Borel Hierarchy Theorem. Brouwer’s Continuity Principle plays a crucial role in arguments. (shrink)

The participation of minors in clinical trials is essential to provide safe and effective medical care to children. Because few drugs have been tested in children, pediatricians are forced to prescribe medications off-label with uncertain efficacy and safety. In this article, we analyze how the enrollment of minors in clinical trials is negotiated within relationships of mutual trust between clinicians, minors, and their parents. After a brief description of the problems associated with involving minors in clinical research, we consider how (...) existing “relationships of trust” can be used as a place where the concerns of research subjects can be more fully discussed and addressed. Building on the tacit recognition of trust found in The European Clinical Trials Directive we make policy recommendations that allow for clearer, more ethically informed guidelines for enrolling minors in clinical research. As part of the creation-discovery interpretation of quantum mechanics Diederik Aerts presented a setting with macroscopical coincidence experiments designed to exhibit significant conceptual analogies between portions of stuff and quantum compound entities in a singlet state in Einstein—Podolsky—Rosen/Bell-experiments (EPR-experiments). One important claim of the creation-discovery view is that the singlet state describes an entity that does not have a definite position in space and thus does not exist in space. Free Process Theory is a recent proposal by Johanna Seibt of (...) an integrated ontology, i.e., of an ontology suitable for the interpretation of theories of the macrophysical and microphysical domain (quantum field theory). The framework of free process theory allows us to show systematically the relevant analogies and disanalogies between Aerts' experiment and EPR-experiments. From free process ontology it also follows quite naturally that the quantum compound entity described by the singlet state does not exist in space. (shrink)
