This article considers why the influential neo-republicans Philip Pettit and Richard Bellamy tend to minimise or deny the role that natural or moral rights play in republican thought. It argues that their specific views about the theoretical role of such rights are motivated by methodological commitments. In Pettit’s case the commitments are to consequentialism and formalism, while in Bellamy’s it is to proceduralism. But these commitments get in the way of providing a fully adequate account of the value of freedom (...) as non-domination: one that allows us to determine when citizens actually enjoy this kind of freedom. Finally, the article argues that a full explanation of what it means to enjoy freedom as non-domination must unavoidably appeal to normative notions. (shrink)

Under the same hypothesis, there is an inner model with level by level equivalence between strong compactness and supercompactness, and indeed, another in which there is level by level inequivalence between strong compactness and supercompactness. If a cardinal is strongly compact up to a weakly iterable cardinal, then there is an inner model in which the least measurable cardinal is strongly compact. If there is a weakly iterable limit δ of <δ-supercompact cardinals, then there is an inner model with a proper class of Laver-indestructible supercompact cardinals. The widely touted discovery of mirror neurons has generated intense scientific interest in the neurobiology of intersubjectivity. Social neuroscientists have claimed that mirror neurons, located in brain regions associated with motor action, facial recognition, and somatosensory processing, allow us to automatically grasp other people's intentions and emotions. Despite controversies, mirror neuron research is animating materialist, affective, and embodied accounts of intersubjectivity. My view is that mirror neurons raise issues that are directly relevant to feminism and cultural studies, but interventions are (...) needed for the work to be compatible with nonreductionist critical thought. In this article I critique the dominant neuroscientific account of mirror neurons, called embodied simulation theory. I draw from feminist epistemologies as well as alternative interpretations of mirror neurons in cognitive science and philosophy of mind to consider mirroring as situated, embodied perception. The purpose of this study was to identify and describe published research articles that were named in official findings of scientific misconduct and to investigate compliance with the administrative actions contained in these reports for corrections and retractions, as represented in PubMed. Between 1993 and 2001, 102 articles were named in either the NIH Guide for Grants and Contracts (“Findings of Scientific Misconduct”) or the U.S. Office of Research Integrity annual reports as needing retraction or correction. In 2002, 98 of (...) the 102 articles were indexed in PubMed. Eighty-five of these 98 articles had indexed corrections: 47 were retracted; 26 had an erratum; 12 had a correction described in the “comment” field. Thirteen had no correction, but 10 were linked to the NIH Guide “Findings of Scientific Misconduct”, leaving only 3 articles with no indication of any sort of problem. As of May 2005, there were 5,393 citations to the 102 articles, with a median of 26 citations per article (range 0–592). Researchers should be alert to “Comments” linked to the NIH Guide as these are open access, and the “Findings of Scientific Misconduct’ reports are often more informative than the statements about the retraction or correction found in the journals. One of the perplexing features of an infectious disease is the damage it causes, not only to physical health, but to mental health and to social relationships. This tension between the separation that is required for safety and the human need for contact is especially felt by institutions of higher education. Many such institutions not only educate students but seek to foster the kinds of communities which have thrived on personal interaction and shared physical space. Different institutions have responded to (...) COVID-19 and its impacts on their members differently. Given that the spring semester will begin months before COVID-19 vaccines are widely available, we offer seven recommendations and argue that for a university, college, or other similarly situated educational institution to ethically respond to the pandemic, it must follow these recommendations. These recommendations are grounded in both scientific research and ethical analysis. Proper ethical analysis, which is necessary for the implementation of good policies, cannot be accomplished without an evidence-based grounding. After describing features of the virus and the situation that faces higher education institutions, in general, we turn to a detailed discussion of transmission. We discuss interventions available to institutions, including masking, hygiene, barriers, and testing and surveillance. Our recommendations are supported by an ethical analysis reliant on four themes: expertise, planning, stewardship, and dignity. (shrink)

In this article we take off from critiques of psychological and school bullying typologies as creating problematic binary categories of bully and victim and neglecting sociocultural aspects of gender and sexuality. We review bullying research informed by Judith Butler’s theories of discursive performativity, which help us to understand how subjectification works through performative repetitions of heterosexual gender norms. We then build on these insights drawing on the feminist new materialist approach of Karen Barad’s posthuman performativity, which we argue enlarges our (...) scope of inquiry in profound ways. Barad’s theories suggest we move from psychological models of the inter-personal, and from Butlerian notions of discursive subjectification, to ideas of discursive-material intra-action to consider the more-thanhuman relationalities of bullying. Throughout the article, we demonstrate the approach using examples from qualitative research with teens in the UK and Australia, exploring nonhuman agentic matter such as space, objects and time as shaping the constitution of gender and sexual bullying events. Specifically we examine the discursive-material agential intraactions of skirts and hair through which ‘girl’ and ‘boy’ and ‘slut’ and ‘gay’ materialise in school spacetimematterings. In our conclusion we briefly suggest how the new materialism helps to shift the frame of attention and responses informing gendered intraactions in schools. (shrink)

Building on an intertwined spatiotemporal weaving of reckoning-repairing-reworlding, this article analyses the constitutional process experienced in Chile between 2019-2023. Inspired by the sociology of image as a methodological tool and following a narrative that takes the shape of a spiral, we examine a series of photographs representing different layers in this ongoing process. In October 2019, the largest demonstrations in Chile’s history sparked long-brewing demands for social and ecological transformation. The unsustainable pressure pushed political parties to call for a constitutional (...) referendum where the population overwhelmingly voted to overturn the charter inherited from Augusto Pinochet’s regime, and so the process of drafting a new text began. Following the rejection of two drafts, the constitutional process is, for now, closed. Yet, we claim that embracing a failure narrative is not only futile, but misleading, and we propose to see these events in terms of their potential for conceptualising and enacting transformative futures. Drawing on decolonial, anti-colonial, and Indigenous scholarship, this essay focuses mainly on 2019’s uprising and the first constitutional process (2021-2022) examining demands for Indigenous transformation – and the possibilities this case offers resistance movements elsewhere and “elsewhen.”. Este trabajo busca indagar sobre una posible interpretación del totalitarismo en el pensamiento de Hannah Arendt. Si bien es cierto que para Arendt el totalitarismo es un régimen político específico y delimitado en un contexto histórico particular, también es posible encontrar en su pensamiento una idea más amplia del totalitarismo en la estela de la crítica a la tradición de la filosofía política que la autora desarrolla. Según Arendt, esta tradición no habría hecho otra cosa que idear modos de gobierno (...) que permitan controlar la acción y con ello también la contingencia de los asuntos humanos. Así, esta tradición de la filosofía política habría terminado por comprender los asuntos humanos como una obra por realizar, sin dejar espacio, de este modo, al despliegue de la pluralidad humana. Se trata entonces de pensar en esas “corrientes subterráneas del pensamiento occidental” que cristalizaron en la Alemania nazi y la URSS. Esta lectura del totalitarismo estará iluminada en ciertos puntos por la idea de inmanentismo desarrollada por Jean-Luc Nancy en La Comunidad Inoperante. This paper attempts to provide an interpretation of Hannah Arendt's understanding of totalitarianism. Although Arendt conceives totalitarianism as a specific political regime, my claim is that it is also possible to find a broder conception of totalitarianism in Arendt's work if we consider her critical approach to the tradition of political philosophy. According to Arendt, the western tradition of political philosophy has brought forth nothing but different types of government that are only concerned with subjecting human action and thus the contingency of human affairs. Thereby, the philosophical tradition understands human affairs qua work and in doing so hinders and obstructs the deployment of human plurality. Hence, my aim in this paper is to reflect upon the underground stream that according to Arendt crystallized both in the Nazi Germany and in the USSR. To accomplish this task, I take into account the notion of “immanentism” developed by Jean-Luc Nancy in The inoperative Community. (shrink)

Робоча гіпотеза розвідки ґрунтується на трьох позиціях: генезис звукоемоційних комплексів убачається в емоційному тлумаченні; модусом антропології музики є феномени, що закладені як глибинна структура в розвитку європейської культури в історичній перспективі та в сьогоденні; музичне мистецтво моделює за допомогою інтонаційної мови ціннісне багатство, логіку й динаміку людського світовідношення, організує духовне спілкування між людьми й поколіннями.

Rigorously studying the inexpressible expression provoked by the silenced testimony of the Holocaust survivor, in Jean-François Lyotard's The Differend, and the religious faithful, in Pseudo-Dionysius' The Divine Names, proves to dissolve the apparent heterogeneity of postmodernism and Neoplatonist Christian mysticism and open radical new lines of dialogue. Expressing the Inexpressible critically evaluates each thinker and tradition, rethinks witnessing, testimony, sublimity, and apophaticism, and then engages them together to forge a new reading of silence and eros.

This paper examines the advent of the Web as a critical media tool in the promotion and sale of goods to consumers and the ethical questions it raises that are issues of public policy. We examine four traditional ethical rationales that guide organizational decision-making – utilitarianism, distributive justice, moral rights of man and relativism, further characterized as "ends-based", "equity-based", "rules-based" and "comparison-based" rationales – and we apply them to four moral dilemmas attributed to the proliferation of dot.com companies as they (...) relate to consumer welfare. We find that ethical rationale in the New Media is largely non-existent, and where it exists, it is primarily reactive and driven by utilitarian or relativistic reasoning. We attribute this condition to the newness of the industry and to its economic context, representing, as it does, many characteristics embodied in the concept of the "perfect market." We offer some remedies to improve ethical conduct by e-business. (shrink)

Collective action processes in complex, multiple-use common-pool resources (CPRs) have only recently become a focus of study. When CPRs evolve into more complex systems, resource use by separate user groups becomes increasingly interdependent. This implies, amongst others, that the institutional framework governing resource use has to be re-negotiated to avoid adverse impacts associated with the increased access of any new stakeholders, such as overexploitation, alienation of traditional users, and inter-user conflicts. The establishment of “platforms for resource use negotiation” is a (...) way of dealing with complex natural resource management problems. Platforms arise when stakeholders perceive the same resource management problem, realize their interdependence in solving it, and come together to agree on action strategies for solving the problem (Röling, 1994). This article sets the scene for a discussion in this Special Issue about the potential of nested platforms for resource use negotiation in facilitating collective action in the management of complex, multiple-use CPRs. The article has five objectives. First, we define “collective action” in the context of this paper. Second, we discuss the importance of collective action in multiple-use CPRs. Third, we introduce the concept of platforms to coordinate collective action by multiple users. Fourth, we address some issues that emerge from evidence in the field regarding the role and potential of nested platforms for managing complex CPRs. Finally, we raise five discussion statements. These will form the basis for the collection of articles in this special issue. (shrink)

The U.S. proposal to establish missile defense sites in Poland and the Czech Republic has exacerbated relations with Russia to a degree not seen since the Cold War, despite the fact that the system has no demonstrated capability to defend the U.S., let alone Europe.

This paper is divided into two parts. In Section 1, I explore and defend a “regulative view” of folk-psychology as against the “standard view”. On the regulative view, folk-psychology is conceptualized in fundamentally interpersonal terms as a “mind-making” practice through which we come to form and regulate our minds in accordance with a rich array of socially shared and socially maintained sense-making norms. It is not, as the standard view maintains, simply an epistemic capacity for coming to know about the (...) mental states and dispositions already there. Importantly, the regulative view can meet and beat the standard at its own epistemic game. But it also does more. In Section 2, I show how the regulative view makes progress on two other problems that remain puzzling on the standard view: the problem of “first-person authority” – accounting for the special features of self-knowledge; and the problem of “reactive.. This paper examines the methodological claim made famous by P.F. Strawson: that we understand what features are required for responsible agency by exploring our attitudes and practices of holding responsible. What is the presumed metaphysical connection between holding responsible and being fit to be held responsible that makes this claim credible? I propose a non-standard answer to this question, arguing for a view of responsible agency that is neither anti-realist (i.e. purely 'conventionalist') nor straightforwardly realist. It is instead ‘constructivist’. On (...) the ‘Scaffolding View’ I defend, reactive attitudes play an essential role in developing, supporting, and thereby maintaining the capacities that make for responsible agency. While this view has relatively novel implications for a metaphysical understanding of capacities, its chief virtue, in contrast with more standard views, is providing a plausibly defensible account of how so-called responsible agents genuinely deserve to be treated as such. Philosophers and social scientists have focussed a great deal of attention on our human capacity to trust, but relatively little on the capacity to hope. This is a significant oversight, as hope and trust are importantly interconnected. This paper argues that, even though trust can and does feed our hopes, it is our empowering capacity to hope that significantly underwrites—and makes rational—our capacity to trust.

In Building Better Beings, Vargas develops and defends a naturalistic account of responsibility, whereby responsible agents must possess a feasibly situated capacity to detect and respond to moral considerations. As a preliminary step, he also offers a substantive account of how we might justify our practices of holding responsible—viz., by appeal to their efficacy in fostering a ‘valuable form of agency’ across the community at large, a form of agency that precisely encompasses sensitivity to moral considerations. But how do these (...) accounts relate to one another? Though I find much that is appealing in Vargas’s general approach, I challenge his insistence that these accounts should be treated as ‘conceptually independent’, arguing that this generates an objectionable “justification gap”: on his analysis, someone could remain an appropriate target of our responsibility practices and yet fail to be a morally responsible agent. In closing, I offer a potential solution to this problem, though it means re-visioning how the account of moral responsibility is conceptually tied to the justification of our responsibility practices. We call systematic disputes that are particularly hard to resolve deep disagreements. We can divide most theories of deep disagreements in analytic epistemology into two camps: the Wittgensteinian view and the fundamental epistemic principles view. This essay analyzes how both views deal with two of the most pressing issues a theory of deep disagreement must address: their source and their resolution. After concluding that the paradigmatic theory of each camp struggles on both fronts, the essay proceeds to show that, despite (...) their differences, these theories share some core assumptions and think of deep disagreements similarly: as grounded in fundamental epistemic differences between the parties. This underlying conception of deep disagreements the author calls “the fundamental model.” The essay provides reasons to be wary of this conception, and hence, mainstream epistemologists’ treatment of the issue. This paper argues that our folk-psychological expertise is a special case of extended and enculturated cognition where we learn to regulate both our own and others’ thought and action in accord with a wide array of culturally shaped folk-psychological norms. The view has three noteworthy features: it challenges a common assumption that the foundational capacity at work in folk-psychological expertise is one of interpreting behaviour in mentalistic terms, arguing instead that successful mindreading is largely a consequence of successful mindshaping; it (...) argues that our folk-psychological expertise is not only socially scaffolded in development, it continues to be socially supported and maintained in maturity, thereby presenting a radically different picture of what mature folk-psychological competency amounts to; it provides grounds for resisting a recent trend in theoretical explanations of quotidian social interaction that downplays the deployment of sophisticated mentalizing resources in understanding what others are doing. What is hope? Though variously characterized as a cognitive attitude, an emotion, a disposition, and even a process or activity, hope, more deeply, a unifying and grounding force of human agency. We cannot live a human life without hope, therefore questions about the rationality of hope are properly recast as questions about what it means to hope well. This thesis is defended and elaborated as follows. First, it is argued that hope is an essential and distinctive feature of human agency, (...) both conceptually and developmentally. The author then explores a number of dimensions of agency that are critically implicated in the art of hoping well, drawing on several examples from George Eliot’s Middlemarch. The article concludes with a short section that suggests how hoping well in an individual context may be extended to hope at the collective level. (shrink)

Gathering evidence across disciplines is a strength of interdisciplinary fields like neuroethics. However, conclusions can only be made if the evidence applies to the issue at hand. Libet and colleagues' Citation1983 experiment is an interesting case study in this problem. Despite ongoing critiques about the methods used and the replicability of its findings, many people consider Libet and colleagues' methodology a valid strategy to investigate free will and related topics. We reviewed studies using methods similar to those of Libet and (...) colleagues (N = 48) to identify its use and the evidence produced. Overall, we found substantial variation between studies. While the Libet paradigm may be useful for examining how stimuli affect temporal judgments, the link between this and free will or moral responsibility is not clear. Being aware and critical of the methods used to gather results is important when applying scientific experiments to complex, abstract phenomena. (shrink)

This paper describes a live ethics case project that can be used to teach ethics in a broad variety of business classes. The live case differs from regular cases in that it involves a current situation. Students select an on-going or current event that involves ethical violations and write a case about it. They then present their case and run a debate about the challenges and issues outlined in the case and the actions that could have or should have been (...) taken. The dynamic project fulfills the key criteria for effective ethics education since it increases awareness of the complexity of ethical challenges, allows application of concepts, creates a personal emotional engagement in the case, is relevant, holds students accountable for their position, and creates a setting that encourages students to think critically about ethics. We show that the theory, consisting of the usual axioms of but with the power set axiom removed—specifically axiomatized by extensionality, foundation, pairing, union, infinity, separation, replacement and the assertion that every set can be well‐ordered—is weaker than commonly supposed and is inadequate to establish several basic facts often desired in its context. For example, there are models of in which ω1 is singular, in which every set of reals is countable, yet ω1 exists, in which there are sets of (...) reals of every size, but none of size, and therefore, in which the collection axiom fails; there are models of for which the Łoś theorem fails, even when the ultrapower is well‐founded and the measure exists inside the model; there are models of for which the Gaifman theorem fails, in that there is an embedding of models that is Σ1‐elementary and cofinal, but not elementary; there are elementary embeddings of models whose cofinal restriction is not elementary. Moreover, the collection of formulas that are provably equivalent in to a Σ1‐formula or a Π1‐formula is not closed under bounded quantification. Nevertheless, these deficits of are completely repaired by strengthening it to the theory, obtained by using collection rather than replacement in the axiomatization above. The medicalisation of pregnancy and childbirth has been encouraged by the continuing growth of technology that can be applied to the reproductive journey. Technology now has the potential to fully separate reproduction from the human body with the prospect of ectogenesis—the gestation of a fetus outside of the human body. This paper considers the issues that have been caused by the general medicalisation of pregnancy and childbirth and the impact that ectogenesis may have on these existing issues. The medicalisation of (...) pregnancy and childbirth is criticised for its impact on the relationship between doctors and pregnant women and the way in which doctors treat fetuses. It is argued that ectogenesis may cause more imbalance in the doctor and intended parent relationship and may result in an increased lack of clarity regarding a doctor’s duty to the fetus. This paper finds that extensive guidance and revised legislation will be necessary to minimise the impact of ectogenesis on the existing issues caused by the medicalisation of reproduction. (shrink)
