El presente trabajo aborda la noción de seres sintientes, integrada al sistema jurídico por la Corte Constitucional sin un sustento filosófico o epistémico claro. El objetivo general fue analizar el panorama ontológico del ser sintiente como categorización especial para los animales dentro del régimen jurídico de las cosas en Colombia, el cual fue desarrollado mediante una metodología cualitativa con énfasis hermenéutico. Se comprende que la noción de ser, desde sus distintas acepciones, no es un debate netamente teórico, ya que la (...) precisa consolidación de este concepto determina un rumbo para el pensar jurídico, decisivo en el camino a reconocer la calidad de sujetos de derechos a los animales no humanos, dada su capacidad de sintiencia, pues su protección actualmente está condicionada a la moral humana, además, deriva de considerar a los animales parte del ambiente y no individuos cuasi racionales independientes, impidiendo profundizar en posibilidades normativas de protección a éstos. Del análisis, se concluye que el reconocimiento como seres sintientes es un primer paso en las garantías a favor de los animales; el siguiente sería transitar del Estado social de derecho a un Estado socioambiental de derecho, donde se reconozca al ambiente como eje central para definir los parámetros del bienestar humano y animal, teniendo en cuenta una igualdad entre especies, aunada a la responsabilidad de cuidado que conlleva la racionalidad humana. This article addresses the feeling of strangeness about the perception of time that many people with ordinary lifestyles experienced during the quarantine imposed to fight the presence of COVID-19. It describes different aspects of psychological time affected by the interruption of a normal routine and suggests some cognitive mechanisms, attention, and memory that might have been at play, leading to perceive time as being more or less long. The article also describes the critical role of anxiety and temporal uncertainty and (...) how they may affect the functioning of an internal clock and reminds the reader that there are individual differences in time-related aspects of the personality that contribute to the variety of impressions about duration experienced during the quarantine. This work documents the ethical dilemmas faced by anthropologists and researchers in general when investigating Amerindian communities.

Signaling games provide basic insights into some fundamental questions concerning the explanation of meaning. They can be analyzed in terms of rational choice theory and in terms of evolutionary game theory. It is argued that an evolutionary approach provides better explanations for the emergence of simple communication systems. To substantiate these arguments, I will look at models similar to those of Skyrms (2000) and Komarova and Niyogi (2004) and study their dynamical properties. My results will lend partial support to the (...) thesis that evolution leads to communication. In general, states of partial communication may evolve with positive probability under standard evolutionary dynamics. However, unlike states of perfect communication, they are unstable relative to neutral drift. (shrink)

But this picture of a ‘block universe’, composed of a timeless web of ‘world-lines’ in a four-dimensional space, however strongly suggested by the theory of relativity, is a piece of gratuitous metaphysics. Since the concept of change, of something happening, is an inseparable component of the common-sense concept of time and a necessary component of the scientist's view of reality, it is quite out of the question that theoretical physics should require us to hold the Eleatic view that nothing happens (...) in ‘the objective world’. Here, as so often in the philosophy of science, a useful limitation in the form of representation is mistaken for a deficiency of the universe. (shrink)

Although it is argued that social justice is a core concern for the discipline, nursing has not generally played a leadership role in the responses to many of the greatest social problems of our time. These include the accelerated rate of climate change, pandemic threats, systemic racism, growing health and social inequities, and the regulation of new technologies to ensure an equitable future ‘for all.’ In nursing codes of ethics, administration, education, policies, and practice, social justice is often claimed to (...) be a core value, yet it is rarely contextualized by philosophical or theoretical underpinnings. It appears that nurses’ commitment to social justice may stem more from a penchant for ‘doing good’ than an attempt to explore, understand, and enact what is meant by social justice from an ontological, epistemological, and methodological perspective. We contend that the dominance of a human science perspective in nursing contributes to a narrow definition of health and relegates many issues central to social justice to the margins of nurses’ care. In this article, we explore how the focus on ‘the human’ in the human science perspective may not only be limiting the capacity of nurses to develop strategies to adequately address social injustice, but in some instances, direct nurses to contribute to their very reproduction. We suggest that a critical interrogation of this human‐centric hegemony can identify avenues of rupture and introduce posthumanism as an additional philosophical perspective for consideration to help bridge the human‐social divide. The ArgumentIt is often assumed that all sciences travel the path of increasing precision and quantification. It is also assumed that such processes transcend the boundaries of rival scientific disciplines. The history of the personal equation has been cited as an example: the “personal equation” was the name given by astronomers after Bessel to the differences in measured transit times recorded by observers in the same situation. Later in the nineteenth century Wilhelm Wundt used this phenomenon as a type for (...) his experiments on reaction times. For historians of psychology, this has been taken to be an exemplary case where quantified laboratory science rescued astronomy by showing that this was really a psychological phenomenon measurable only in complication experiments. This paper challenges this story. Astronomers neither ignored, nor despaired of, the personality problem. Instead, the managers of the great observatories developed a new chronometric regime of vigilant surveillance of subordinate observers. The astronomers' solution was thus intimately connected with social and material changes in their way of life: a division of labor in the observatories, a network of observing sites, a mechanization of observation. The paper documents these changes and then presents a study of one case where managers, amateurs, and psychologists clashed for authority over the personality problem. Measurement is given its meaning when situated in specific contexts of styles of work and institutions. Disciplines give meanings to values, and often resist attempts by others to redefine these meanings or to gain authority over measurement. Quantification is not a self-evident nor inevitable process in science's history, but possesses a remarkable cultural history of its own. (shrink)

Passivity experiences in schizophrenia are thought to be due to a failure in a neurocognitive action self-monitoring system . Drawing on the assumption that inner speech is a form of action, a recent model of auditory verbal hallucinations has proposed that AVHs can be explained by a failure in the NASS. In this article, we offer an alternative application of the NASS to AVHs, with separate mechanisms creating the emotion of self-as-agent and other-as-agent. We defend the assumption that inner speech (...) can be considered as a form of action, and show how a number of previous criticisms of applying the NASS to AVHs can be refuted. This is achieved in part through taking a Vygotskian developmental perspective on inner speech. It is suggested that more research into the nature and development of inner speech is needed to further our understanding of AVHs. (shrink)

This paper defends a global principle of equality of opportunity, which states that it is unfair if some have worse opportunities because of their national or civic identity. It begins by outlining the reasoning underpinning this principle. It then considers three objections to global equality of opportunity. The first argues that global equality of opportunity is an inappropriate ideal given the great cultural diversity that exists in the world. The second maintains that equality of opportunity applies only to people who (...) are interconnected in some way and infers from this that it should not be implemented at the global level. The third, inspired by Rawls's The Law of Peoples, maintains that it is inappropriate to thrust liberal ideals (like global equality of opportunity) on nonliberal peoples. Transfer of information between senders and receivers, of one kind or another, is essential to all life. David Lewis introduced a game theoretic model of the simplest case, where one sender and one receiver have pure common interest. How hard or easy is it for evolution to achieve information transfer in Lewis signaling?. The answers involve surprising subtleties. We discuss some if these in terms of evolutionary dynamics in both finite and infinite populations, with and without mutation.

Interventions that are designed to stem plagiarism do not always override the motivation of individuals to cheat and, therefore, may not diminish misconduct. To inform more effective approaches, we conducted a systematic review to clarify the psychological causes of plagiarism. This review of 83 empirical papers showed that a specific blend of circumstances may foster plagiarism: an emphasis on competition and success rather than development and cooperation coupled with impaired resilience, limited confidence, impulsive tendencies, and biased cognitions. Fortunately, whenever students (...) feel their life and studies align to their future aspirations, many of these circumstances tend to dissipate. (shrink)

Within collective epistemology, there is a class of theories that understand the epistemic status of collective attitude ascriptions, such as ‘the college union knows that the industrial action is going to plan’, or ‘the jury justifiedly believes that the suspect is guilty’, as saying that a sufficient subset of group member attitudes have the relevant epistemic status. In this paper, I will demonstrate that these summativist approaches to collective epistemology are incompatible with epistemic permissivism, the doctrine that a single body (...) of evidence may rationalize multiple doxastic attitudes. In particular, I will make use of epistemic permissivism to provide a general recipe for generating so-called divergence cases, which demonstrate situations in which rationality requires group-level and member-level attitudes to diverge. I will call this class of cases permissive divergence cases. While other divergence cases have been discussed in the literature, permissive divergence cases prove themselves to be less susceptible to many of the worries raised against their competitors, while being directly built on an often-defended epistemological thesis. Loss aversion can occur in riskless and risky choices. We present novel evidence on both in a non-student sample (660 randomly selected customers of a car manufacturer). We measure loss aversion in riskless choice in endowment effect experiments within and between subjects and find similar levels of average loss aversion in both. The subjects of the within study also participate in a simple lottery choice task which arguably measures loss aversion in risky choices. We find substantial heterogeneity in both measures (...) of loss aversion. Loss aversion in riskless choice and loss aversion in risky choice are strongly positively correlated, but on average riskless loss aversion is higher than risky loss aversion. We find that in both choice tasks, loss aversion increases in age, income, and wealth, and decreases in education. Our results provide novel supportive input to the debate about the reality of loss aversion. (shrink)

In this paper I am not so much concerned with movements of the mind, as movements of the will. But my question bears a similarity to that of the tortoise. I want to ask whether the will is under the control of fact and reason, combined. I shall try to show that there is always something else, something that is not under the control of fact and reason, which has to be given as a brute extra, if deliberation is ever (...) to end by determining the will. This is, of course, a Humean conclusion, and the only novelty comes in the way I wish to argue for it. I believe that many philosophers think, erroneously, that Hume relies on a naive and outdated conception of facts, or on an even more naive and outdated conception of reason, in order to put passion on their throne. My tortoise defends Hume: what we do with our premises is not itself construed as acceptance of a premise. As it stands the project is only described metaphorically. Presumably everything, including movement of the will, is under the control of facts in some sense, for even if they are only facts about our physiology or chemistry, still, they make us move. I am interested only in cognitive control, or control by the apprehension of fact and reason. (shrink)

Recently there has been some interest in studying the explanation of meaning by using signaling games. I shall argue that the meaning of signals in signaling games remains sufficiently unclear to motivate further investigation. In particular, the possibility of distinguishing imperatives and indicatives at a fundamental level will be explored. Thereby I am trying to preserve the generality of the signaling games framework while bringing it closer to human languages. A number of convergence results for the evolutionary dynamics of our (...) models will be proved. (shrink)

Sin embargo, la experiencia de lo inmediato tiene la condición de presentarse bajo la forma de un extrañamiento, un «no saber». Se verá que la corporeidad y su extrañamiento abren a la posibilidad de una hermenéutica de nuestra propia condición porque la experiencia de lo Unheimlich es una vía de epojé que «detona» (revienta) la cadena de significaciones habitual y (...) reconfigura la experiencia. Se tomará como punto de referencia cuatro casos icónicos: 1) la convalecencia de Oliver Sacks, 2) el famoso caso Paul Schreber, 3) la referencia al joven esquizofrénico en los Seminarios de Zollikon, e incluso 4) el desfallecimiento de Heidegger entre los años 1945 y 1946, todo esto a la luz del extrañamiento de lo íntimo y la posibilidad que este abre a un «reordenamiento interno». En definitiva, las patologías y lo terrorífico que las acompaña son capaces de generar las condiciones de un vitalismo inusitado, pues solo quien se ha enfrentado a la más radical convulsión de todas sus verdades, podrá «abrirse camino» en medio del exceso de donación que desborda su «realidad». The tourism industry is one of the largest industries in the world, and despite recent events that have made its operating environment more complex, the industry continues to grow [Theobald, 2005, Global Tourism, 3rd edn., Butterworth-Heinemann/Elsevier]. Commensurate to the size of the industry is a growth in the number of students pursuing degree courses in tourism around the world. Despite an increasingly sophisticated literature, the relative recency of the industry and its study has meant little attention has been paid in (...) the ethics literature to the dilemmas facing tourism managers and its students. Based on interviews with senior members of the tourism industry six scenarios are developed with pertinence to the challenges faced by industry practitioners today. This paper then applies the Multidimensional Ethics Scale [Reidenbach and Robin, 1990, Journal of Business Ethics, 9, 639–653] to tourism students at three prominent universities in the U.K., Canada and Australia. In total, 438 responses are achieved. The results have importance for the instruction of tourism students for the future, but also in informing decisions about the tools tourism destinations can effectively employ to control the future direction of the industry. We study the handicap principle in terms of the Sir Philip Sidney game. The handicap principle asserts that cost is required to allow for honest signalling in the face of conflicts of interest. We show that the significance of the handicap principle can be challenged from two new directions. Firstly, both the costly signalling equilibrium and certain states of no communication are stable under the replicator dynamics ; however, the latter states are more likely in cases where honest signalling should (...) apply. Secondly, we prove the existence and stability of polymorphisms where players mix between being honest and being deceptive and where signalling costs can be very low. Neither the polymorphisms nor the states of no communication are evolutionarily stable, but they turn out to be more important for standard evolutionary dynamics than the costly signalling equilibrium. This paper provides the first comprehensive analysis of ethical issues raised by artificial intelligence (AI) in veterinary medicine for companion animals. Veterinary medicine is a socially valued service, which, like human medicine, will likely be significantly affected by AI. Veterinary AI raises some unique ethical issues because of the nature of the client–patient–practitioner relationship, society’s relatively minimal valuation and protection of nonhuman animals and differences in opinion about responsibilities to animal patients and human clients. The paper examines how these distinctive (...) features influence the ethics of AI systems that might benefit clients, veterinarians and animal patients—but also harm them. It offers practical ethical guidance that should interest ethicists, veterinarians, clinic owners, veterinary bodies and regulators, clients, technology developers and AI researchers. (shrink)

Environmentalist philosophers often paint a holistic picture, stressing such things as the continuity of humanity with wider nature and our membership of the 'natural community' . The implication seems to be that a non-anthropocentric philosophy requires that we strongly identify ourselves with nature and therefore that we downplay any human/non-human distinction. An alternative view, I think more interesting and plausible, stresses the distinction between humanity and a nature valued precisely for its otherness. In this article I discuss some of its (...) main elements, and some of the difficulties involved with keeping nature's otherness in focus. Firstly (in sections 1-5), I try to clarify what I take to be the otherness-based position by distinguishing it from the apparently similar views of John Passmore, Robert Elliott and Keekok Lee, and some opposed holistic views, especially of J. Baird Callicott. Then, in the second half of the article (sections 6-7), I argue that if nature is valued in virtue of its otherness, this value is best thought of as an extrinsic, final and objective good, where 'objectivity' is a 'method of understanding', in Thomas Nagel's sense. Although I give some reasons for preferring an otherness account to certain alternative positions, I make no overall attempt to 'prove' that nature is valuable for its otherness. My aim is to show that, if it is, then this seems the best way to understand that value. (shrink)

This article defends novel approaches to what we are and how we persist. First it is claimed that we have disjunctive persistence conditions: we can persist by way of either biological continuity or psychological continuity. Then it is claimed that we are neither human beings nor persons essentially. Rather, we are essentially bio-psycho-continuers, a concept to be explained along the way. A variety of objections are considered and found wanting.

The task of axiomatizing physical theories has attracted, in recent years, some interest among both empirical scientists and logicians. However, the axiomatizations produced by either one of these two groups seldom appear satisfactory to the members of the other. It is the purpose of this paper to develop an approach that will satisfy the criteria of both, hence permit us to construct axiomatizations that will meet simultaneously the standards and needs of logicians and of empirical scientists.

In this paper I contemplate two phenomena that have impressed theorists concerned with the domain of reasons and of what is now called ‘normativity’. One is the much-discussed ‘externality’ of reasons. According to this, reasons are just there, anyway. They exist whether or not agents take any notice of them. They do not only exist in the light of contingent desires or mere inclinations. They are ‘external’ not ‘internal’. They bear on us, even when through ignorance or wickedness we take (...) no notice of them. They thus very conspicuously shine the lights of objectivity, and independence, and even necessity. By basking in this light, ethics is rescued from the slough of sentiment and preference, and regains the dignity denied to it by theorists such as Hobbes or Hume, Williams, Gibbard or myself. Hence, many contemporary philosophers compete to stress and to extol the external nature of reasons, their shining objectivity. The other phenomenon is that of the inescapable ‘normativity’ of means-ends reasoning. Here the irrationality of intending an end but failing to intend the means is a different shining beacon. It is that of pure practical reason in operation: an indisputable norm, again showing a sublime indifference to whatever weaknesses people actually have, and ideally fitted to provide a Trojan horse for inserting rationality into practical life. If the means-end principle is both unmistakably practical and yet the darling child of rationality itself, then other principles of consistency or of humanity, or of universalizing the maxims of our action, can perhaps follow through the breach in the Humean citadel that it has spearheaded. And so we get the dazzling prospect that if people who choose badly are choosing against reason, then this can be seen to be a special and grave defect. It would locate the kind of fault they are indulging. It would give us, the people of reason, a special lever with which to dislodge their vices. Being able to herd knaves and villains in a compound reserved for those who trespass against reason and rationality therefore represents definite progress. (shrink)

We should be suspicious of the idea that experiencing pain could enable animals to trade off different motivations in a common currency. It is not even clear that humans have a common motivational currency reflected in evaluative experience. Instead, pain may capture attention, inhibiting attention to competing motivations and needs, thereby making genuine trade-offs harder. Our criteria for pain in invertebrates should be part of a more subtle theory of the relationship between pain and decision-making.

Summary This paper provides an interpretation of the movement of Arendt's thought in her Denktagebuch, from 1950 to 1973. This movement results in an incipient political philosophy based on new concepts of freedom, equality, and solidarity. As a contribution to debates on the normative foundations of Arendt's political thought, the paper seeks to show that her incipient political philosophy is based on an ethical understanding of the human condition as constituted by its openness to the divine, the worldly, and the (...) (human) Other. Despite its fragmentary nature and its politically problematic indebtedness to theological traditions, Arendt's private thought nevertheless allows us to rethink her place in the history of European ideas. Beyond that, it also provides a powerful alternative to the view that ethical and political thought must remain ?political not metaphysical? (shrink)

This special issue of Human Nature presents selected works from the 2015 and 2017 “Warfare, Environment, Social Inequality, and Pro-Sociability” conferences held at the Center for Cross-Cultural Study in Seville, Spain. These investigations explore the manifestations of indigenous warfare and violence from a host of theoretical perspectives. Topics range from the origins of warfare to the psychological repercussions of combat, the relationship between warfare and status, as well as the documentation of peace processes among warring groups. Empirical research on human–robot interaction has demonstrated how humans tend to react to social robots with empathic responses and moral behavior. How should we ethically evaluate such responses to robots? Are people wrong to treat non-sentient artefacts as moral patients since this rests on anthropomorphism and ‘over-identification’ —or correct since spontaneous moral intuition and behavior toward nonhumans is indicative for moral patienthood, such that social robots become our ‘Others’?. In this research paper, I weave extant HRI studies that demonstrate empathic (...) responses toward robots with the recent debate on moral status for robots, on which the ethical evaluation of moral behavior toward them is dependent. Patienthood for robots has standardly been thought to obtain on some intrinsic ground, such as being sentient, conscious, or having interest. But since these attempts neglect moral experience and are curbed by epistemic difficulties, I take inspiration from Coeckelbergh and Gunkel’s ‘relational approach’ to explore an alternative way of accounting for robot patienthood based on extrinsic premises. Based on the ethics of Danish theologian K. E. Løgstrup I argue that empathic responses can be interpreted as sovereign expressions of life and that these expressions benefit human subjects—even if they emerge from social interaction afforded by robots we have anthropomorphized. I ultimately develop an argument in defense of treating robots as moral patients. (shrink)

A common view of the relation between oughts and reasons is that you ought to do something if and only if that is what you have most reason to do. One challenge to this comes from what Jonathan Dancy calls ‘enticing reasons.’ Dancy argues that enticing reasons never contribute to oughts and that it is false that if the only reasons in play are enticing reasons then you ought to do what you have most reason to do. After explaining how (...) enticing reasons supposedly work and why accepting them may appear attractive, I firstly show why we are not committed to accepting them into our conceptual framework and then argue that no reasons work in the way enticing reasons are claimed to. Thus we should reject the category of enticing reasons entirely. (shrink)

Language’s intentional nature has been highlighted as a crucial feature distinguishing it from other communication systems. Specifically, language is often thought to depend on highly structured intentional action and mutual mindreading by a communicator and recipient. Whilst similar abilities in animals can shed light on the evolution of intentionality, they remain challenging to detect unambiguously. We revisit animal intentional communication and suggest that progress in identifying analogous capacities has been complicated by (i) the assumption that intentional (that is, voluntary) production (...) of communicative acts requires mental-state attribution, and (ii) variation in approaches investigating communication across sensory modalities. To move forward, we argue that a framework fusing research across modalities and species is required. We structure intentional communication into a series of requirements, each of which can be operationalised, investigated empirically, and must be met for purposive, intentionally communicative acts to be demonstrated. Our unified approach helps elucidate the distribution of animal intentional communication and subsequently serves to clarify what is meant by attributions of intentional communication in animals and humans. Suppose it is a law that all Fs are G. Does the law hold in all possible worlds? According to Necessitarianism, it holds in at least all those worlds containing F-ness. I argue that the Necessitarian must also take the law to hold in all those possible worlds which do not contain F-ness. Accepting the principle that a law can only hold in a world if it has some ontological grounding in that world, I argue that Necessitarianism is committed to (...) the claim that any law holding in the actual world is grounded in every possible world, and that any law holding in any possible world is grounded in the actual world. In other words, Necessitarianism takes all possible laws to be actual. (shrink)

Graham Harman describes the allure of art as the tension and fusion of a real object to sensual qualities so that it makes it seem that the inwardness of reality is opened to us. Yet real objects are withdrawn; how are we aware of their fusion? Since Harman’s ontology mandates that contact between real objects occurs only through sensual objects, this essay explores the idea that art’s allure must be a tension between sensual objects that draw the experiencer to believe, (...) or alieve, they are in contact with the withdrawn real. By looking at the examples in representational painting and sleight of hand magic, we see that ontographic art objects use at least four, carefully separated sensual objects to produce their aesthetic effect. The conclusion summarises allure as a sensual object process, speculates on art’s dialetheic confusion of sensual and real objects giving an enduring allure to idealism, and notes potential motifs of an infra-realist resistance. This article presents a reading of Nietzsche’s use of rhetoric as inseparable from his philosophical project. I provide an exegesis of Nietzsche’s own reflections on rhetoric and consider its actual deployment, arguing that Nietzsche’s rhetoric is often deliberately dissonant and oriented toward facilitating receptive effects. The aim, I suggest, is to shift politics of possibility—to alter what can and cannot be done and said politically. Dissonant rhetoric, rhetoric that marries aesthetic attunement with affective turbulence, helps to accomplish this end by (...) shaping the way that rhetoric is received by audiences. I conclude by suggesting that Nietzsche’s rhetoric has implications for contemporary theory, shifting how we might view critical political engagement in the public sphere. Understood in this way, Nietzsche’s rhetoric provides a perhaps surprising model for a critically robust form of rhetoric. (shrink)
