W.M. Gorman has been a major figure in the development of economies during the past forty years. His publications on separability, aggregation, duality and the modelling of consumer demand are recognized as fundamental contributions to economic theory. Many of his unpublished papers have achieved similar status as privately-circulated classics.This volume brings together for the first time all Gorman's important work, much of which has never been published before, on aggregation across commodities and agents, including separability, budgeting, representative agents, (...) and the construction of capital and labour aggregates. Each chapter is preceded by an editorial introduction which describes its origin and place within the literature as well as the main results themselves. Bernard Williams argues that human mortality is a good thing because living forever would necessarily be intolerably boring. His argument is often attacked for unfoundedly proposing asymmetrical requirements on the desirability of living for mortal and immortal lives. My first aim in this paper is to advance a new interpretation of Williams' argument that avoids these objections, drawing in part on some of his other writings to contextualize it. My second aim is to show how even the best version of (...) his argument only supports a somewhat weaker thesis: it may be possible for some people with certain special psychological features to enjoy an immortal life, but no one has good reason to bet on being such a person. In considering the historical treatment of Aboriginal Australians this paper will discuss the different spaces operating in Western Australia’s South West in the late 1920s and the government policies that fed into them. These are the Moore River Native Settlement that is located some 100 km north of Perth and White City, a carnival sideshow located at the bottom of William Street on the banks of the Swan River in Perth. The 1905 Aborigines Act and a provision within that (...) act known as the Proclamation of the Prohibited Area of Perth will be discussed. This will be done by comparing the ways that White City was seen by the government in the 1920s and how in recent years Northbridge has been regulated and discursively constructed. The intent is to look at how Aboriginal people have been treated over time and consider the social, historical and political forces that have shaped that construction. (shrink)

This article mobilizes the troublesome and unrigorous concept of love to open an oblique entry into the equally troublesome concepts of object-oriented ontology and speculative realism. Issues of object fetishism, species companionship, bestiality, and assemblages of desire are traced in the theories of Graham Harman, Donna Haraway, Jane Bennett, Mario Perniola, and other posthumanist thinkers. Both romantic and Christian love are identified in the discursive practices of speculative realists as a way of outlining recurrent tropes in posthumanist thinking. From here, (...) a vector is traced back to the romantic literary tradition, thus linking the posthumanist tendencies of William Blake, for example, to the romanticism of Jane Bennett and Ian Bogost. Pulling against the chains of language, these thinkers challenge the finitude of human being by developing discursive strategies that focus attention sideways, away from human subjectivity and toward the world of organic and inorganic things. The essay concludes with a description of “applied media theory,” a method developed by the Critical Media Lab to generate objects-to-think-with for the sake of posthumanist speculation. (shrink)

In the case of the Essay this syndrome has resulted in historical mythmaking which, while rightfully monumentalizing Locke’s book, has (...) done so at the expense of its actual or potential significance. Walker’s study is aimed at destroying the myths about the Essay while rethinking its significance, through a carefully rhetorical reading of its text.Rhetoric is, of course, one of the things which Locke—along with Bacon and Descartes—is held to have rejected from philosophical discourse. This image of Locke as a proponent of commonsensical empiricism and an opponent of rhetorically-oriented speculation is one of the mainstays of intellectual history—of several distinct histories, in fact: philosophical, literary, and linguistic. But, Walker argues, it is also a mythic image. He further holds that an attentive, unprejudiced reading of the Essay will illustrate this claim by showing the work to be imagistic through and through. The Locke who emerges from this [End Page 250] rereading is not the sworn enemy of those literary effects to which language lends itself, one who has proven convenient to the formulation of neat defenses of poetry (including rhetoric) against simple-minded epistemologues. Walker’s suggestion is that this Locke, not having existed, had to be invented. The Locke of the Essay as Walker rereads it is, instead, a thinker about mind, language, and their intertwined effects who stands much closer to Nietzsche than anyone might have thought previously. And this Locke is anything but the naive philosophical butt simply awaiting a sophisticated (meaning, linguistically-oriented) deconstruction of the kind associated with Nietzsche.As might be expected from this summary, the spirit of Paul de Man hovers over Walker’s project. But this is deconstruction with a difference (and what other kind is worthwhile?). On the one hand, Walker’s whole analysis follows the mandate laid down in de Man’s celebrated essay on “The Epistemology of Metaphor” (1978), which is to ignore the commonplaces of intellectual history about Locke and to look at the text of the Essay with an eye to what happens there (the relevant passage in de Man is quoted on p. 133). On the other hand, however, the result of following out de Man’s suggestion has been Walker’s discovery and demonstration of severe problems in de Man’s own treatment of Locke and his Essay, a treatment that depends for its effect very strongly on the kind of mythmaking that casts Locke and Nietzsche as antagonists, and more specifically Locke as the problem for which Nietzsche proves the diagnosis.Walker is in fact quite harsh on de Man in places. Thankfully, however, the relevant chapters of his book do more than provide a litany of “de Man’s flagrant violations of fact and reason” (p. 154)—though this is no bad place to start in reconsidering de Man’s analyses, which have all too easily acquired the status of received wisdom. There is an ongoing debate within the law of unjust enrichment whether the victim of a pickpocket has, in addition to a claim in tort against the thief, one in unjust enrichment. Those who argue that he does say that it follows a fortiori from the availability of claims in unjust enrichment for mistake. If the law gives a claim where the transferor's consent to the transfer was merely vitiated, as it does in cases of mistake, so too should it (...) do so where he was ignorant, giving no consent whatever to the ‘transfer’. This idea is used by the protagonists of ignorance as the basis of an explanation of a number of controversial cases, especially Lipkin Gorman v Karpnale and Foskett v McKeown, as belonging within unjust enrichment. This article questions whether the argument is correct. Differently to the case of a mistaken transfer, where the claimant's title passes to the defendant, the pickpocket victim's title stays put. That would seem to be fatal to any unjust enrichment analysis, for an essential element of such a claim, an enrichment at the claimant's expense, now appears to be missing. The question then is whether that objection can be overcome. Various strategies have been proposed, that the law looks to ‘factual’ rather than ‘technical’ enrichments, that title can be electively transferred by the victim to the thief and that title can simply be renounced. None of these strategies work, however, with the consequence that any claim by a victim against his thief can only be in tort, not unjust enrichment. (shrink)

This article proposes a new interpretation of mutual information. We examine three extant interpretations of MI by reduction in doubt, by reduction in uncertainty, and by divergence. We argue that the first two are inconsistent with the epistemic value of information assumed in many applications of MI: the greater is the amount of information we acquire, the better is our epistemic position, other things being equal. The third interpretation is consistent with EVI, but it is faced with the problem of (...) measure sensitivity and fails to justify the use of MI in giving definitive answers to questions of information. We propose a fourth interpretation of MI by reduction in expected inaccuracy, where inaccuracy is measured by a strictly proper monotonic scoring rule. A critical survey of some attempts to define ‘computer’, beginning with some informal ones, then critically evaluating those of three philosophers, and concluding with an examination of whether the brain and the universe are computers.

In this essay I argue the extent to which meaning and judgment in aesthetics figures in Wittgenstein’s later conception of language, particularly in his conception of how philosophy might go about explaining the ordinary functioning of language. Following a review of some biographical and textual matters concerning Wittgenstein’s life with music, I outline the connection among (1) Wittgenstein’s discussions of philosophical clarity or perspicuity, (2) our attempts to give clarity to our aesthetic experiences by wording them, and (3) the clarifying (...) experience of the dawning of an aspect, which Wittgenstein pictures as the perception of an internal relation. By examining Wittgenstein’s use of “internal relation” from the Tractatus to his later writings, I come to challenge the still prevalent understanding of Wittgenstein’s appeals to grammar as an appeal to something given (e.g., to a set of grammatical rules). Instead, as I argue, Wittgensteinian appeals to grammatical criteria should be understood as modeled by the form of justification found in our conversations about art. (shrink)

In order to avoid patient abuse, under normal situations before performing a medical intervention on a patient, a physician must obtain informed consent from that patient, where to give genuine informed consent a patient must be competent, understand her condition, her options and their expected risks and benefits, and must expressly consent to one of those options. However, many patients refrain from the option that their physician believes to be best, and many physicians worry that their patients make irrational healthcare (...) decisions, hindering their ability to provide efficient healthcare for their patients. Some philosophers have proposed a solution to this problem: they advocate that physicians nudge their patients to steer them towards their physician's preferred option. A nudge is any influence designed to predictably alter a person's behavior without limiting their options or giving them reasons to act. Proponents of nudging contend that nudges are consistent with obtaining informed consent. Here I argue that nudging is incompatible with genuine informed consent, as it violates a physician's obligation to tell their patients the truth, the whole truth, and nothing but the truth during adequate disclosure. In _The Fragility of Things_, eminent theorist William E. Connolly focuses on several self-organizing ecologies that help to constitute our world. These interacting geological, biological, and climate systems, some of which harbor creative capacities, are depreciated by that brand of neoliberalism that confines self-organization to economic markets and equates the latter with impersonal rationality. Neoliberal practice thus fails to address the fragilities it exacerbates. Engaging a diverse range of thinkers, from Friedrich Hayek, Michel Foucault, Hesiod, and Immanuel Kant to (...) Voltaire, Terrence Deacon, Friedrich Nietzsche, and Alfred North Whitehead, Connolly brings the sense of fragility alive as he rethinks the idea of freedom. Urging the Left not to abandon the state but to reclaim it, he also explores scales of politics below and beyond the state. The contemporary response to fragility requires a militant pluralist assemblage composed of those sharing affinities of spirituality across differences of creed, class, gender, sexual orientation, and ethnicity. This new work is a major contribution to recent debates on the rule of law and the possibilities of democracy in postindustrial societies, but it is much more.The introduction by William Rehg succinctly captures the special nature of the work, noting (...) that it offers a sweeping, sociologically informed conceptualization of law and basic rights, a normative account of the rule of law and the constitutional state, an attempt to bridge normative and empirical approaches to democracy, and an account of the social context required for democracy. In 2008 the Australian Government introduced a national reform agenda to increase organ and tissue donation. Australia continues to perform poorly by international standards on measures of organ procurement, however. This paper outlines three proposals to improve donation rates and considers the empirical evidence available for each. A number of ethical objections frequently given to resist such proposals are also addressed. Firstly, it is recommended that Australia implement an ‘opt-out’ system of organ donation. Secondly, the existing veto rules should be (...) changed to better protect the wishes of those who wish to donate. Finally, a numer of incentives should be offered to increase donation rates; these could include incentives of financial value, but also non-financial incentives such as prioritisation for the receipt of organs for previous donors. The thrust of this paper addresses how the notion of an author relates to the authority of a law. Drawing from the legal thought of Hobbes, Bentham, and John Austin, the Paper offers a sense of the author as a distinct institutional source of the state. The Paper then addresses the more difficult legal theories in this context: those of HLA Hart, Ronald Dworkin and Hans Kelsen. The clue to the latter as well as the earlier theorists is a presupposed (...) inaccessible author or ghost. The presupposed ghost of the law is crucial to the binding character of a law. (shrink)

The final work of the esteemed philosopher William Demopoulos supplants logical empiricism's accounts of physical theories, which fail to satisfactorily engage modern physics. Arguing for a new appreciation of the tightly woven character of theory and evidence, Demopoulos offers novel insights into the distinctive nature of quantum reality.

A reading of the film Moonstruck (1987) is presented in two movements. The first aligns Moonstruck with certain Hollywood film comedies of the 1930s and 40s, those Stanley Cavell calls comedies of remarriage. The second turns to some aspects of Emerson's writing – in particular his interest in our relation to human greatness, and his coinciding interest in our relation to the words of a text – and shows how Moonstruck inherits these Emersonian, essentially philosophical interests.

The alleged emergence of a ‘post-truth’ regime links the rise of new forms of social media and the reemergence of political populism. Post-truth has theoretical roots in the interdisciplinary field of Science and Technology Studies, with sociologists of science arguing that both true and false claims should be explained by the same kinds of social causes. Most STS theorists have sought to deflect blame for post-truth, while at the same time enacting a normative turn, looking to deconstruct truth claims and (...) subject expertise to criticism. Steve Fuller has developed a positive case for post-truth in science, arguing that post-truth democratizes science. I criticize this argument and suggest an alternative approach that draws on the prehistory of the field in the 1930s and 1940s, when philosophers and sociologists sought to define the social conditions necessary for reliable knowledge production that might stem mass media irrationalism. What is one doing when one improvises music, as one does in jazz? There are two sorts of account prominent in jazz literature. The traditional answer is that one is organizing sound materials in the only way they can be organized if they are to be musical. This implies that jazz solos are to be interpreted with the procedures of written music in mind. A second, more controversial answer is offered in David Sudnow's pioneering account of the phenomenology of improvisation, (...) Ways of the Hand. Sudnow claims that learning to improvise at the piano is concerned centrally with copying the bodily ways of one's mentors and finding how one's instructable hands and the keyboard come to answer to one another, so that "to define jazz ... is to describe the body's ways." But despite its greater sensitivity over the traditional account, Sudnow's account is flawed both as a description of how improvisatory skill is acquired and as a model for describing the interest of jazz. My critique of Sudnow compares his account to Augustine's account of learning language, and finds that Wittgenstein's criticisms of Augustine extend to Sudnow. I offer a third approach to understanding improvised music, one which treats the procedures of improvisation as derived from, and importantly at play in, our everyday actions. (shrink)

This essay claims that the violence characterizing the 20th century has been coloured by the clash of two very different senses of legal authority. These two senses of legal authority correspond with two very different contexts of civil violence: state secession and the violence characterizing a challenge to a state-centric legal authority. Conklin argues that the modern legal authority represents a quest for a source or foundation. Such a sense of legal authority, according to Conklin, clashes such a view with (...) the unwritten laws of early Amerindian traditional societies. As science and religion researchers begin to engage questions of mental health, mindfulness may prove to be a fruitful area of investigation. However, quantifying the physical effects of mindfulness on the brain is difficult because mindfulness deals with the problem of mental and physical interaction or, the mind/body problem. One system of understanding which may aid science and religion scholars in the pursuit of mindfulness is traditional Chinese medicine (TCM). Within TCM, heart Qi manages the body's present connection to time (...) and space. If the “being in the moment” is disrupted, then the heart Qi is blocked and mental illness or various neurological disorders occur. Succinctly, within TCM, mindfulness is understood as a nonphysical phenomenon (Qi) which directly affects physical systems, resulting in empirical data. This is tracked and treated through the TCM understanding of Qi. The TCM view of Qi in mental health may therefore provide a helpful new paradigm to investigations concerning mindfulness and the human brain. (shrink)

A professor is brought before a secret tribunalin his law faculty for the purpose of decidingthe appropriateness of a student's grade. Thegrounds of the grade appeal are that theprofessor had taught critically instead ofpractically and that he had done so with anacademic bias and prejudice. He is also allegedto have taught philosophy rather than law. After many hours of examination andcross-examination as a defendant and as anexpert witness, the professor, Flink, begins adialogue with a spirit in an effort tounderstand the (...) nature and identity of law. Flink comes to appreciate that law is adisplacing discourse rather than a structure ofcategories signified in an official writing. The analytic method familiar to officials incommon law jurisdictions, Flink comes tounderstand, excludes the experiential meaningsthat are manifested through unwritten gesturesand rituals. Officials embody signs withexperiential expectations and past assumptions.The embodiment of meaning brings life intolegal language. But such an embodiment isforgotten as officials decompose textualfragments and reported social events intoanalytic units. Legal analysis is so successfulthat officials even forget that they hadforgotten something so important as theembodiment of meaning. The professor and the spirit also ask whetherjustice is an `ought' and where one can locatesuch an `ought'. They conclude that there is astructure within which legal officials reason.The exteriority of the structure is anunwritten `ought' realm. But the structurepossesses a gap, which enters into such anunanalysable object-less realm. Analyticreasoning has assumed that reason can take anofficial only so far until she or he mustjourney outside the structure to anunanalysable realm of personal values. However, the embodiment of meanings alsoincorporates unwritten collective values ofwhich officials, precisely because of thesuccess of the analysis project in forgettingthat something was forgotten, have never beenconscious. It is such an unanalysable realmthat grounds or authorises the analyticproject. The exterior authorising origin of theanalytic units of the structure rests upon apossibility that requires faith on the part ofthe officials, a faith that there exists afoundation, radically different from theanalytic units, on the other side of thestructure. The officials can, at best, imagineor picture the authorising origin, located asit is in the unanalysable object-less realmexterior to the written language of thestructure. The imagined origin takes the `form'of a bodiless spirit. The officials are haunted by thepossibility that the structure of humanlyposited rules are ultimately authorised by aspirit. (shrink)

Since the time of the Enlightenment in Western Europe, discussions of faith and reason have often pitted the believer against the skeptic, the theist against the atheist, and the person of one faith against the person of no professed faith. But the relation of reason to faith has been a matter of debate among believers as well. There are those who hold that religious faith can be proven or supported by rational argument. Others say that to try to give reasons (...) and arguments does violence to religious faith, or opens it to misunderstanding and doubt, or trivializes it. Responses to the Enlightenment: An Exchange on Foundations, Faith, and Community is a dialogue between Hendrik Hart and William Sweet, two philosophers who identify themselves as Christians, and who seek to respond to the challenges of the Enlightenment and its legacy. The authors approach the relation of faith to reason, however, in very different ways: Hart from the perspective of the Calvinian tradition and postmodern philosophy, Sweet from the Catholic tradition and analytic philosophy. Among the topics discussed are the nature of religious faith and of reason, liberalism and orthodoxy in religion, the relation of religious experience and rationality, and building community in a religiously and culturally pluralistic world. This book is a clear and concise introduction to the Roman Emperor Marcus Aurelius Antoninus. His one major surviving work, often titled 'meditations' but literally translated simply as 'to himself', is a series of short, sometimes enigmatic reflections divided seemingly arbitrarily into twelve books and apparently written only to be read by him. For these reasons Marcus is a particularly difficult thinker to understand.
