Developing countries face numerous barriers to conducting effective and efficient ethics reviews of international collaborative research. In addition to potentially overlooking important scientific and ethical considerations, inadequate or insufficiently trained ethics committees may insist on unwarranted changes to protocols that can impair a study's scientific or ethical validity. Moreover, poorly functioning review systems can impose substantial delays on the commencement of research, which needlessly undermine the development of new interventions for urgent medical needs. In response to these concerns, the Drugs (...) for Neglected Diseases Initiative, an independent nonprofit organization founded by a coalition of public sector and international organizations, developed a mechanism to facilitate more effective and efficient host country ethics review for a study of the use of fexinidazole for the treatment of late stage African Trypanosomiasis. The project involved the implementation of a novel ‘pre-review’ process of ethical oversight, conducted by an ad hoc committee of ethics committee representatives from African and European countries, in collaboration with internationally recognized scientific experts. This paper contributes to the debate about how the overdemandingness objection applies to Kant's ethics. I first look at the versions of the overdemandingness objections Kant himself levels against other ethicists and ethical principles and I discuss in what sense he acknowledges overdemandingness as a problem. Then I argue that, according to Kant's own standards, introspection about the moral worthiness of one's actions can constitute forms of moral overdemandingness. Self-scrutiny and Kant's well-known claim that we can never be certain that (...) we acted for the right reason jeopardize agents’ deserved happiness. Furthermore, self-scrutiny can constitute an activity Kant himself criticizes under the labels of “micrology” and “fantastic virtue”. The demandingness of critical self-scrutiny has not yet received due attention in the overdemandingness debate since this debate is focused on duties we have towards others. (shrink)

The first case of COVID-19 infection in Africa was recorded in Egypt on 14 February 2020. Following this, several projections of the possible devastating effect that the virus can have on the population of African countries were made in the Western media. This paper presents evidence for Africa’s successful responses to the COVID-19 pandemic and under-reporting or misrepresentation of these successes in Western media. It proceeds to argue for accounting for these successes in terms of Africa’s communitarian way of life (...) and conceptions of self, duty, and rights; and that a particular orientation in theorizing on global justice can highlight the injustices inherent in the misrepresentation of these successes and contribute shared perspectives to formulating a framework of values and concepts that would facilitate the implementation of global policy goals for justice. The paper is thus grounded in a rejection of the insular tenets of theorizing prevalent in the global justice debate and to persistent inclinations in Western scholarship to the thinking that theorizing in the African context that draws inspiration from the cultural past has little to contribute to the quest for justice globally. On the contrary, it argues that reflexive critique of cultural history is a necessary source of normative ideals that can foster tolerant coexistence and a cooperative endeavour toward shared conceptions of justice in the contemporary world. Daniel Taylor and Dawn Goodwin present a case study of the Morecambe Bay Inquiry (MBI), which examined the high rate of maternal and neonatal deaths over a period of 9 years (2004–2013), within the small maternity unit of Furness General Hospital (FGH), one of the three hospitals comprising Morecambe Bay Hospitals Trust.1 They examine this through a conceptual lens, and provide a solution involving changes in medical education. This commentary explores both these elements. First, they use the lens of ‘Normalisation (...) of Deviance’ (NoD) to explain organisational failure. However, other available lenses such as ‘Sociology of Disasters’, ‘Organisational Silence’ and ‘Comfort-seeking Behaviour’ may point to different problems and solutions. More justification for their choice of the lens of NoD would have been useful. Similarly, more justification for their focus on a cluster of five ‘serious untoward incidents’ (SUIs) occurring in 2008 would also have been useful. They suggest that before 2008, the perinatal mortality rate was low, patient satisfaction was high and recent level 2 accreditation of maternity services by the Clinical Negligence Scheme for Trusts all suggested standards of care within the obstetric department were adequate. This stream of positive signals is likely to have contributed towards a genuine belief of safe operation within the maternity unit by staff and board members. I discuss two puzzling and neglected passages in the Critique of Practical Reason, namely, V:92 and V:163. In these passages Kant claims that practical philosophers should follow the paradigm of the chemist and conduct experiments on common human reason. I explain Kant’s conception of the chemical experiment, provide a detailed interpretation of the two passages in question, and conclude by applying the structure of the chemical experiment to the Analytic of the Critique of Practical Reason. Chemical experiments as a model (...) of ethics should be understood as a method of confirming that a philosophical theory systematizes and defends ideas that ordinary rational agents are already committed to. A close reading of the three Bhavanakramah texts, written by Kamalasila, reveals that their author was aware of two competing concepts of meditation prevalent in Tibet at the time of their composition. The two concepts of meditation,associated with the Sanskrit words bhavana and dhyana, can be related respectively to the Indian and Chinese sides of the well-known debates at bSam yas. The account of the Mahayana path outlined in these texts implies an acceptance of the precedence of bhavana over dhyana. (...) In this paper I argue that Kamalasila advocated bhavana – a conception of meditation which encompasses non-conceptual dhyana, but which also includes a discernment of reality that is conceptual in nature. Such conceptual discernment should not be understood simply as a process of ordinary rational understanding but rather as constituting a special kind of meditative wisdom. A failure to recognize the subtle differences between Kamalasila’s employment of the terms dhyana and bhavana, along with his advocacy of the latter, could easily lead to mistranslation and, with this, a basic misunderstanding of his position. In particular, it could lead to a conception of insight that is overly intellectual in nature. Given the historically important role that these texts played in the formation of Tibetan Buddhism, the implications of such a misconception could be far-reaching. This paper attempts to clarify the key meditation terminology found in the Bhavanakramas as well as demonstrate the rationale for using ‘meditation’ as the default translation for bhavana. (shrink)

En este trabajo trato de demostrar que Nino no logra articular un liberalismo completamente antiperfeccionista en su respuesta al comunitarismo. Para ello, parto de reconstruir el diagnóstico que Nino ofrece de la crítica comunitarista al liberalismo y señalo que para darle respuesta se compromete con una concepción particular del bien basada en la idea de autorrealización autónoma. En la siguiente sección desarrollo la manera en la que esa concepción del bien da forma al liberalismo de Nino y, en el apartado (...) siguiente, la confronto con un experimento mental destinado a evaluar si es capaz de bloquear distintas políticas estatales de corte perfeccionista. En la última sección ofrezco unas breves conclusiones respecto al modo en el que la adopción de una concepción del bien particular limita las pretensiones antiperfeccionistas de su teoría liberal. In this paper I attempt to prove that Nino does not succeed in developing a fully antiperfectionist account of liberalism as an answer to the communitarian challenge. I begin with a reconstruction of Nino’s diagnosis of the communitarian challenge to liberalism and point out that, in order to answer it he commits himself to a particular conception of the good based on the idea of autonomous self-realization. In the next section I develop the way by which that conception of the good shapes Nino’s liberalism. I further challenge his liberalism with a mental experiment designed to asses if it is capable of blocking several perfectionist State policies. In the last section I offer some brief remarks on the way the adoption of a particular conception of the good limits the antiperfectionist scope of Nino’s liberalism. (shrink)

As I will argue in this article, the concepts of the political refer to the self-institution of societies, while political concepts are those that emerge in the realm of politics, a field some societies institute as precisely the site in which the reversibility of the political takes place. This article will argue that the concepts of the political and the political concepts coming (...) out of South America in its contemporary history spring from the main events and processes—the political and social history—that dominated the period. The events and concepts first discussed will be those related to the conquest and its legacy, only to later move fully to the past fifty years of dictatorships, transitions to democracy, and the emergence of the neopopulist political form. It later (...) matured under Pythagoras among the Greeks and Italians and culminated in Plato. As is well known, this genealogy was not merely a historical thesis for Ficino and his followers but also a program for revival, a utopia achieved through restoration. For the assertion of a concordance between these early philosophies and their accordance with Christianity—in the sense of a Christian Platonism—implied the synthesis of fragementary philosophemes into a fully developed doctrine in the service of a uniform and timely philosophia pia.This program was formulated in a variety of ways during the sixteenth and seventeenth centuries with differing protagonists and with diverse aims. Thus one could supplement the genealogy in a cabalist vein, introduce biblical characters such as Solomon or Moses, or (as was done by Bruno) use it to contest Christian doctrine. The genealogy could be read as culminating in various notable modern figures such as for example, Paracelsus. Aristotle could be included or excluded from it, depending on whether one wanted to assimilate the Aristotelian tradition or to distance oneself from it; and one could leave the end [End Page 1] of this genealogical lineage open in order to exhort the necessity of a scientific and moral reform.Here, however, we shall be occupied with the question of what became of this program during the late Renaissance, when two developments took place simultaneously: on the one hand, the utopia of the prisca sapientia set about to conquer the field formerly reserved to the Aristotelians, namely, natural philosophy; on the other hand, the first doubts arose about the overall validity of the historical-philological foundation of the program, especially the dating of the works of Hermes Trismegistus. The latter began with the publication of the first part of Patrizi's Discussiones peripateticae in 1571,which aimed to rehabilitate, contrary to Aristotle's critique, old presocratic natural philosophies, and in so doing it cleared the way for interpreting the latest advancements in non-Aristotelian natural sciences as resumptions of these very philosophies.2 This initiated a period of complex interaction between late humanist philology, innovative natural science, and speculative metaphysics.This phase, however, not only entailed the grand synthesizing endeavors that one finds in Patrizi's Nova de universis philosophia;it also introduced historical critique—no doubt provoked by Patrizi—of the Hermetic prisca sapientia, understood in Frances Yates's sense, which was performed in careful detail long before Casaubon at the end of the Renaissance.3 Further, it was a phase characterized by an attempt to reevaluate Aristotelian philosophy against its opponents, which paradoxically was also motivated by Patrizi yet which managed to keep the venture open to "esoteric" depths. Ramus’s sixteenth century revision of the intellectual map reclassified it as at best an adjunct of dialectic, to be conceived in terms of elocutio and pronunciatio, an approach that in the English-speaking world led to its reduction (...) to mere ornamentation—the application of figures and tropes—opening the way to Stoppard’s (anachronistic) debasement: 1Guildenstern: What in God’s name is going on?Rosencrantz: Foul! No rhetoric. Two-one.Both approaches are current, which makes for confusion. Two characteristic examples will suffice. Of course these cannot always easily be separated, for it may be that certain qualities of style figure prominently among the available means of persuasion, but a useful test of the conception an individual has of the topic may be judged by how he or she reacts to the (deliberately provocative) opening sentence of my introduction to The Bible as Rhetoric: “Rational argument is one of the most effective rhetorical modes we know.” Mason’s conception of the “plain style” of the philosophical logicians as rhetorical style fits this Aristotelian approach well, but for the more Ramist Crisp such examples are “unlikely candidates” for rhetorical status and Mason’s conception “forced.” So it may be as well to consider contemporary work on the philosophy/rhetoric borderline under two heads: the Ramist and the Aristotelian. But that borderline itself invites a further distinguo; philosophical analysis of rhetoric and rhetorical analysis of philosophy, though this distinction, too, is not absolute. This gives us a convenient set of quadrants, so for expository purposes I shall consider the contemporary relations between rhetoric and philosophy under four main heads.First, philosophical analysis of “rhetoric” understood in a stylistic or Ramist sense. This paper poses a new challenge to control-based theories of moral responsibility. Control-based theories – as defended, for instance, by Aristotle and John Martin Fischer – hold that an agent is responsible for an action only if she acted voluntarily and knew what she was doing. However, this paper argues that there is a large class of cases of unreflective behavior of which the following is true: the persons involved did not have the kind of control required by control-based (...) theories, yet we intuitively take the persons involved to be morally responsible. Vor allem aber argumentiert der Autor fair und gründlich gegen nahezu sämtliche Positionen in der Debatte, um an ihre Stelle dann seine eigene spannende und originelle Neu-Konzeptualisierung von Wissen-Wie zu setzen. All diese Faktoren zusammen – kristallklare Thesen, Argumente gegen alle (...) anderen, eine grundlegende Neu-Konzeptionalisierung – können nur zu einem führen: Man fühlt sich provoziert und will umgehend kritisch mit dem Autor diskutieren. Und das ist natürlich genau die Reaktion, die ein gelungener Debattenbeitrag in der Analytischen Philosophie auslösen sollte. Ich bin froh, an dieser Stelle die Gelegenheit zu haben, exemplarisch einige mögliche Stränge einer solchen kritischen Diskussion vorführen zu können. Dabei werde ich mich nicht scheuen, in den beiden Teilen dieses Textes das herauszufordern, was man als die beiden Hauptthesen Worthmanns ansehen könnte. (shrink)

In recent years, increasing pressures have been brought to bear upon nurses and others more closely to inform, involve and support the rights of parents or guardians when crucial ‘life and death’ ethical decisions are made on behalf of their seriously ill child. Such decisions can be very painful for all involved, and may easily become deadlocked when there is an apparent clash of moral ideals or values between the medical team and the parents or guardians. This article examines a (...) growing number of such cases in New Zealand and analyses the moral parameters, processes, outcomes and ethical responses that must be considered when life and death ethical decisions involving children are made. The article concludes with a recommendation that nurses should be recognized as perhaps the most suitable of all health care personnel when careful mediation is needed to produce an acceptable moral outcome in difficult ethical situations. Der umfassende Prozess der weltweiten Digitalisierung prägt alle gesellschaftlichen Systeme in unterschiedlicher Weise. Wie sehr verändert die Digitalisierung die uns bekannte Welt und die Vulnerabilität des Lebens? Sind die damit verbundenen Transformationen gar wünschenswert und/oder notwendig? In Hinblick auf eine Vergewisserung dessen, was als (unsere) Welt anzusehen ist, bietet sich der Begriff der Lebenswelt im Ausgang von Edmund Husserl an. Demnach ist es eine wirklich anschauliche, wirklich erfahrene und erfahrbare Welt, in der sich unser ganzes Leben praktisch abspielt. Technisierung bedeutet (...) eine Veränderung dieses menschlichen Weltverhältnisses. Husserl attestierte seinerzeit eine Lebensweltvergessenheit, die zu einer Krise Europas und des europäischen Menschentums beitragen würde. Daher setzte er sich für eine Rehabilitierung der Lebenswelt als Sinnesfundament ein. Diese berühmte Diagnose und jene Massnahme sind seit Husserls Tagen immer wieder aufgegriffen worden. Wird die Digitalisierung die Welt in eine komplett künstliche Welt transformieren, die den Zusammenhang von persönlicher Erfahrung, Leiblichkeit, gesellschaftlichen Institutionen und Erscheinungen der Natur aufgekündigt hat? Bevor eine solche Befürchtung geglaubt werden kann, gilt es, grundlegende Muster der Digitalisierung im Hinblick auf ihre lebensweltliche Konkretion zu befragen.
