本书主要通过比较分析和历史分析的方法,通过对当今世界代表大陆法系的德国和代表英美法系的美国的证据收集制度的全面研究,以及对站在美国和德国中间点的日本的证据收集制度的研究等,为中国的证据收集制度寻找有益 的借鉴.同时,本书在研究中国特有的国情和文化的基础上,试图找到一个适合中国特色的证据收集制度,以保障案件事实的发现,促进司法正义的实现.

Especially in periods of crises, economists try to explain why some economies suffer negative consequences more strongly than others. In order to explain these differential effects, two economic categories known as economic vulnerability and economic resilience can be used. Hence, the aim of the paper is to undertake a critical reflection on the interrelated categories of economic vulnerability and resilience to shocks. The paper analyses these categories from a theoretical perspective and identifies the factors that shape each of them. It (...) then attempts to measure the economic vulnerability and resilience of selected European countries using two synthetic variables. Based on these, a classification of countries in terms of economic vulnerability and resilience was made. The results achieved provide a good starting point for a more detailed study of the paths of crises and their consequences in individual countries. (shrink)

The purpose is to improve the teaching quality of Russian spatial prepositions in colleges. This work takes teaching Russian spatial prepositions as an example to study the key technologies in 3D Virtual Simulation teaching. 3D VS situational teaching is a high-end visual teaching technology. VS situation construction focuses on Human-Computer Interaction to explore and present a realistic language teaching scene. Here, the Steady State Visual Evoked Potential is used to control Brain-Computer Interface. An SSVEP-BCI system is constructed through the Hybrid (...) Frequency-Phase Modulation. The acquisition system can obtain the current SSVEP from the user's brain to know which module the user is watching to complete instructions encoded by the module. Experiments show that the recognition accuracy of the proposed SSVEP-BCI system based on HFPM increases with data length. When the data length is 0.6-s, the Information Transfer Rate reaches the highest: 242.21 ± 46.88 bits/min. Therefore, a high-speed BCI character input system based on SSVEP is designed using HFPM. The main contribution of this work is to build a SSVEP-BCI system based on joint frequency phase modulation. It is better than the currently-known brain computer interface character input system, and is of great value to optimize the performance of the virtual simulation situation system for Russian spatial preposition teaching. We examine managers’ earnings forecasts for evidence of incentive alignment or subversion characteristics. We find that forecasts by managers compensated via relative performance (RP) goals are more likely to be pessimistic and less accurate than those by managers compensated via absolute performance (AP) goals. For firms not issuing earnings forecasts, disclosures in Form 10-Ks are more pessimistic for RP firms than for AP firms. Furthermore, we find that RP firms perform worse than AP firms in terms of future stock returns. (...) Overall, our evidence is consistent with a proposition that, contrary to sound ethical business practices, RP managers make self-serving earnings disclosures to subvert the efforts of their peers to meet performance targets more easily. Entrepreneurs sometimes make unethical decisions that have devastating effects on their companies, stakeholders, and themselves. We suggest that insights into the origins of such actions can be acquired through attention to personal motives and their impact on moral disengagement—a cognitive process that deactivates moral self-regulation, thus enabling individuals to behave in ways inconsistent with their own values. We hypothesize that entrepreneurs’ motivation for financial gains is positively related to moral disengagement, while their motivation for self-realization is negatively related to this (...) process. Results obtained with a sample of founding entrepreneurs offered support for the first prediction, as well as support for the prediction that moral disengagement is positively related to the tendency to make unethical decisions. Jeffrey (1983) proposed a generalization of conditioning as a means of updating probability distributions when new evidence drives no event to certainty. His rule requires the stability of certain conditional probabilities through time. We tested this assumption (“invariance”) from the psychological point of view. In Experiment 1 participants offered probability estimates for events in Jeffrey’s candlelight example. Two further scenarios were investigated in Experiment 2, one in which invariance seems justified, the other in which it does not. Results were in (...) rough conformity to Jeffrey (1983)’s principle. In this study we present a self-organizing connectionist model of early lexical development. We call this model DevLex-II, based on the earlier DevLex model. DevLex-II can simulate a variety of empirical patterns in children's acquisition of words. These include a clear vocabulary spurt, effects of word frequency and length on age of acquisition, and individual differences as a function of phonological short-term memory and associative capacity. Further results from lesioned models indicate developmental plasticity in the network's recovery from damage, in (...) a non-monotonic fashion. We attribute the network's abilities in accounting for lexical development to interactive dynamics in the learning process. In particular, variations displayed by the model in the rate and size of early vocabulary development are modulated by (a) input characteristics, such as word frequency and word length, (b) consolidation of lexical-semantic representation, meaning-form association, and phonological short-term memory, and (c) delayed processes due to interactions among timing, severity, and recoverability of lesion. Together, DevLex and DevLex-II provide an accurate computational account of early lexical development. (shrink)

A stochastic prey-predator system in a polluted environment with Beddington-DeAngelis functional response is proposed and analyzed. Firstly, for the system with white noise perturbation, by analyzing the limit system, the existence of boundary periodic solutions and positive periodic solutions is proved and the sufficient conditions for the existence of boundary periodic solutions and positive periodic solutions are derived. And then for the stochastic system, by introducing Markov regime switching, the sufficient conditions for extinction or persistence of such system are obtained. (...) Furthermore, we proved that the system is ergodic and has a stationary distribution when the concentration of toxicant is a positive constant. Simpson’s paradox (SP) is a statistical phenomenon where the association between two variables reverses, disappears, or emerges, after conditioning on a third variable. It has been proposed (by, e.g., Judea Pearl) that SP should be analyzed using the framework of graphical causal models (i.e., causal DAGs) in which SP is diagnosed as a symptom of confounding bias. This paper contends that this confounding-based analysis cannot fully capture SP: there are cases of SP that cannot be explained away in terms of (...) confounding. Previous works have argued that some cases of SP do not require causal analysis at all. Despite being a logically valid counterexample, we argue that this type of cases poses only a limited challenge to Pearl’s analysis of SP. In our view, a more powerful challenge to Pearl comes from cases of SP that do require causal analysis but can arise without confounding. We demonstrate with examples that accidental associations due to genetic drift, the use of inappropriate aggregate variables as causes, and interactions between units (i.e., inter-unit causation) can all give rise to SP of this type. The discussion is also extended to the amalgamation paradox (of which SP is a special form) which can occur due to the use of non-collapsible association measures, in the absence of confounding. The present study constructed a moderated mediation model to examine whether borderline pathological celebrity worship may be associated with higher levels of impulsive buying intent. The mediating role of empathy and the moderating role of gender were also examined. A total of 1,319 participants recruited from a college through the campus network. The results indicated that borderline pathological celebrity worship could positively predict individuals’ impulsive buying intent; the predictive effect of borderline pathological celebrity worship on impulsive buying intent could be (...) mediated by empathy; and gender moderated the predictive effect of borderline pathological celebrity worship on impulsive buying intent. Specifically, relatively higher levels of borderline pathological celebrity worship were found to be associated with higher impulsive buying intent among men. However, this was relatively less significant among women.ConclusionThe results contribute to previous findings by demonstrating that borderline pathological celebrity worship could affect impulsive buying intent. Moreover, the mediating role of empathy and the moderating role of gender were also revealed. (shrink)

ObjectivesTo simulate hemodynamic changes after extraluminal compression in pulsatile tinnitus patients with a prominent transverse-sigmoid sinus junction.MethodsOne patient-specific case was reconstructed based on computed tomography venography images of a PT patient. The compression degree served as a new index in this study. Cases with 10, 20, 30, 40, 50, 60, 70, 80, and 90% of the compression degree of the control subject were constructed. Steady-state computational fluid dynamics were assessed. The wall pressure distribution, wall maximum pressure and flow pattern of (...) the PTSJ were calculated to evaluate hemodynamic differences among all cases.ResultsWith increasing compression, the wall pressure at the compression point and downstream of the PTSJ decreased but increased upstream. When the compression degree exceeded 70%, the upstream pressure increased significantly. Above 50% compression, the blood flow pattern downstream of the sigmoid sinus tended to spiral, especially after 80% compression. Beyond 60% compression, the blood flow pattern under the compression axis became more medial.ConclusionMechanical compression of PTSJ changes wall pressure and blood flow patterns. The degree of compression should be carefully observed to avoid possible complications or reoccurrence. (shrink)

This study aimed to explore the influence the value modularity and a firm’s innovation performance, directly and indirectly, using knowledge management as mediating variable. Moreover, in this study, we used the resource integration ability as a moderator between the relationship value modularity and firm innovation performance. We collected data from the Chinese state-owned and state-controlled high-tech firms from 2011 to 2018. In this study, we used the gray comprehensive evaluation method to test the degree of value modularity, and hierarchical regression (...) analysis is used to analyze the relationship among variables. The outcomes of this study indicate that value modularity and firm innovation performance has inverted U-shaped and significant association. Similarly, results also confirm that knowledge acquisition and knowledge internalization mediate the relationship between value modularity and firm innovation performance. The finding of this research also confirms that resource integration ability negatively affects the relationship between value modularity and firm innovation performance. This paper enriches the research of the value modularity and gives certain inspiration to knowledge management. At the end of this study, we also suggest some significant practical implications. In public health emergencies, people are more willing to save money rather than spending it, which is not conductive to economic development and recovery. Due to the absence of relevant research, the internal logic of this phenomenon is not clear. In the context of the COVID-19 pandemic, this study systematically explored whether and why public health emergencies stimulate consumers' preference for saving. We conducted two online surveys and used methods including stepwise regression analysis and bootstrapping to test the hypotheses. The (...) first survey, with 1,511 participants from China in February 2020, indicates that the severity of emergencies has a significant positive impact on the populations' willingness to save. Risk perception plays a mediating role between the severity of emergencies and consumers' saving willingness. Materialism plays a moderating role between risk perception and an individual's saving willingness, individuals who are more materialistic have a lower saving willingness when they perceive the risks of the pandemic. To verify the duration of the above effects, we conducted a follow-up survey consisted of 466 instances in August 2020. It is noteworthy that the above effects are not significant during the post-pandemic period. Thus, spending behavior in public health emergencies can be motived by reducing risk perception and increasing materialism. These findings can provide a valuable inspiration for public health, crisis management, and economic recovery during public health emergencies. (shrink)

Biases and misunderstanding stemming from pre-training in Generative Pre-Trained Transformers are more likely for users of underrepresented English varieties, since the training dataset favors dominant Englishes (e.g., American English). We investigate (potential) bias in GPT-4 when it interacts with Trinidadian English Creole (TEC), a non-hegemonic English variety that partially overlaps with standardized English (SE) but still contains distinctive characteristics. (1) Comparable responses: we asked GPT-4 18 questions in TEC and SE and compared the content and detail of the responses. (2) (...) Accurate translation: we assessed how accurate and authentic 29 TEC and 34 SE translations were. (3) Language knowledge and attitudes: we asked what language the prompts were written in and categorized the responses and examined any language attitudes that were exhibited. Content and detail in prompts were comparable. The model was proficient at translating TEC pronouns and many grammatical categories. It was weaker at processing spelling and vocabulary items. In addition, it produced several inauthentic features. Only 39% of TEC-generated sentences were fully grammatical. While GPT-4 was perfect at identifying SE, it was 21% accurate at identifying TEC, which it sometimes classified as English with “errors” and “corrected”. GPT-4’s scope of use is limited for non-hegemonic English users. It is problematic that some of its analyses perpetuate bias against underrepresented Englishes. Increased research on lesser-documented Englishes is necessary and we anticipate that this problem affects dialects of other languages. We intend to partner with Trinidadian stakeholders to train GPT-4 in the future. (shrink)

Evidence suggests that perceived school culture is the most powerful predictor of teachers’ work performance. However, studies to date have paid little attention to the potential mechanisms behind this association. On the basis of the job demands–resources model, the present study explored the mediating role of affective empathy and the moderating role of job tenure in the association between perceived school culture and teachers’ work engagement. 647 primary and secondary school teachers completed questionnaires measuring perceived school culture, affective empathy, and (...) work engagement. After gender and educational level were included as covariates, the results showed that perceived school culture positively correlated with teachers’ work engagement, and more importantly, this association was partially mediated by affective empathy. In addition, job tenure significantly moderated the direct association between perceived school culture and work engagement. Specifically, there was a stronger association between perceived school culture and work engagement for teachers with shorter job tenure than those with longer job tenure. The findings suggested the direct effect of perceived school culture on work engagement, and the indirect effect of perceived school culture on work engagement through the mediating role of affective empathy. These findings enrich our understanding of how perceived school culture associates with work engagement, and highlight the moderating role of job tenure in the direct association between perceived school culture and work engagement. Previous studies show that adults and children evaluate the act of leaving a choice for others as prosocial, and have termed such actions as socially mindful actions. The current study investigates how the desirability of the available options (i.e., whether the available options are desirable or not) may influence adults’ and children's evaluation of socially mindful actions. Children (N = 120, 4- to 6-year-olds) and adults (N = 124) were asked to evaluate characters selecting items for themselves from a set (...) of three items—two identical items and one unique item—in a way that either leaves a choice (two diverse items) or leaves no choice (two identical items) for the next person (i.e., the beneficiary). We manipulated whether the available options were either desirable or undesirable (i.e., damaged). We found that adults’ and 6-year-olds’ evaluation of socially mindful actions is moderated by the desirability of the options. Although they evaluate the act of leaving a choice for others as nicer than the act of leaving no choice both when the choosing options are desirable and when they are undesirable, the discrepancy in the evaluation becomes significantly smaller when the choosing options are undesirable. We also found that inference of the beneficiary's feeling underlies social evaluation of the actor leaving a choice (or not). These findings suggest that children consider both the diversity of options left and the desirability of the available options in understanding and evaluating socially mindful acts. (shrink)

Based on event history analysis, this study examined the survival distribution of the duration of online public opinions related to major health emergencies and its influencing factors. We analyzed the data of such emergencies that took place in China during a period of 10 years. The results of the Kaplan-Meier method and Cox proportional hazards regression analysis showed that the average duration of online public opinions regarding health emergencies is 43 days, and the median is 19 days, which dispels the (...) myth of the “Seven-day Law of Propagation.” Furthermore, the duration of online public opinions can be divided into three stages: the rapid decline stage, the slowdown stage, and the disappearing stage. In addition, the type of event, and the volume of both social media discussion and traditional media coverage all had significant impacts on the duration. Our findings provide practical implications for the carrying out of targeted and stage-based governance of public opinions. (shrink)

To identify the boundary conditions for proactive employees making whistle-blowing decisions, we developed a cross-level model comprising employee proactive personality and two types of whistle-blowing intentions that incorporates the influences of organizational- and individual-level attributes. Analyses of data collected from 432 Chinese employees in 32 companies indicated that proactive personality was positively related to internal whistle-blowing intention and even more positively related to external whistle-blowing intention when individuals were working in organizations characterized by an instrumental ethical climate and employees with (...) a high level of moral identity. In China, neither reproduction and parenthood by lesbian couples nor their marital status are regulated or protected by law. In 2020, the first legal dispute in China involving a lesbian couple over custody of their joint baby was heard in court. This study examines the legal and ethical issues that lesbian couples confront when they decide to give birth to a child of their own. These challenges begin with regulatory restrictions on their lawful access to assisted reproductive technology and extend (...) to gaps in the legal establishment of parenthood. We found that the lack of access to legitimate reproductive assistance for lesbian couples in China has caused them to make efforts to circumvent laws and regulations to have a child. However, the legislative gaps later led to ethical dilemmas when resolving disputes over parenthood. This study discusses different accounts of establishing and determining natural parenthood in China and concludes by pointing out the urgent need for change in legislative and sociocultural attitudes toward both assisted reproductive technology and same‐sex relationships, mapping the way forward for lesbian couples to obtain better protection of procreation and parenthood before their marriage is culturally accepted and finally legalized. Examining the effect of hedge fund activism on gender diversity, we find that the number of female directors decreases after a firm is targeted by hedge fund activism. Using the employment history data from BoardEx, we find that activist hedge funds are more likely to appoint people with finance backgrounds to the boards of target firms. And the newly appointed finance background directors are almost all male because of the lack of diversity in the finance industry. The lack of gender (...) diversity of the hedge funds’ networks and the lack of qualified female directors in the local area also help explain the impact of hedge fund activism on gender diversity on the board. Previous research has shown that the proactive deprioritization of emotional distractors through the provision of information about the distractors or passive habituation of emotional distractors may attenuate emotion-induced blindness (EIB) in the rapid serial visual presentation stream. However, whether prior memory encoding of emotional distractors could bias the EIB effect remains unknown. To address this question, this study employed a three-phase paradigm integrating an item-method direct forgetting (DF) procedure with a classic EIB procedure. Participants completed a memory coding phase to (...) either remember or forget negative pictures, then performed an intermediate phase of the EIB test, and finally finished a recognition test. Critically, the same to-be-forgotten (TBF) and to-be-remembered (TBR) negative pictures in the memory learning phase were used as emotional distractors in the intermediate EIB test. The results replicated the typical DF effect by showing higher recognition accuracies for TBR pictures compared to those for TBF pictures. More importantly, the TBF negative distractors attenuated the EIB effect compared to the TBR negative distractors, but showed a comparable EIB effect as the novel negative distractors. These findings indicate that prior memory encoding manipulations of negative distractors could bias subsequent EIB effects, providing an important approach to modulate the EIB effect. (shrink)

Although emerging evidence has implicated structural/functional abnormalities of patients with Autism Spectrum Disorder, definitive neuroimaging markers remain obscured due to inconsistent or incompatible findings, especially for structural imaging. Furthermore, brain differences defined by statistical analysis are difficult to implement individual prediction. The present study has employed the machine learning techniques under the unified framework in neuroimaging to identify the neuroimaging markers of patients with ASD and distinguish them from typically developing controls. To enhance the interpretability of the machine learning model, (...) the study has processed three levels of assessments including model-level assessment, feature-level assessment, and biology-level assessment. According to these three levels assessment, the study has identified neuroimaging markers of ASD including the opercular part of bilateral inferior frontal gyrus, the orbital part of right inferior frontal gyrus, right rolandic operculum, right olfactory cortex, right gyrus rectus, right insula, left inferior parietal gyrus, bilateral supramarginal gyrus, bilateral angular gyrus, bilateral superior temporal gyrus, bilateral middle temporal gyrus, and left inferior temporal gyrus. In addition, negative correlations between the communication skill score in the Autism Diagnostic Observation Schedule and regional gray matter volume in the gyrus rectus, left middle temporal gyrus, and inferior temporal gyrus have been detected. A significant negative correlation has been found between the communication skill score in ADOS_G and the orbital part of the left inferior frontal gyrus. A negative correlation between verbal skill score and right angular gyrus and a significant negative correlation between non-verbal communication skill and right angular gyrus have been found. These findings in the study have suggested the GM alteration of ASD and correlated with the clinical severity of ASD disease symptoms. The interpretable machine learning framework gives sight to the pathophysiological mechanism of ASD but can also be extended to other diseases. (shrink)

ABSTRACT People tend to be unable to evaluate themselves accurately in many areas. One such area is their own and others’ morality. The current research explores the self–other moral valuation difference in the context of moral foundation theory. We propose that people generally have a moral positive illusion. Specifically, people overestimate their own morality and underestimate the morality of others. Two studies provide converging evidence that individuals underestimate the average moral valuations of others on the five dimensions of moral foundation (...) theory. In particular, we demonstrate three moderators for moral positive illusion: moral foundation type, gender, and political identity. Specifically, compared with the binding foundations, people have greater moral positive illusions based on the individualizing foundations; compared to men, women have greater moral positive illusions; and compared with liberals, conservatives have greater moral positive illusions based on the binding foundations. Multi-person pose estimation is a challenging problem. Bottom-up methods have been greatly studied because the prediction speed of top-down methods is related to the number of people in the input image, making these methods difficult to apply in real-time environments. To solve the problems of scale sensitivity and quantization error in bottom-up methods, it is necessary to have a model that can predict multi-scale keypoints and refine quantization error. To achieve this, we propose context feature and refined network for multi-person (...) pose estimation (CRNet), which can effectively solve the problems of scale sensitivity and quantization error in bottom-up methods. We use a multi-scale feature pyramid and context feature to achieve scale invariance of the network. We extract global and local features and then fuse them by attentional feature fusion (AFF) to obtain context feature that adapt to multi-scale keypoints. In addition, we propose an efficient refined network to solve the problem of quantization error and use multi-resolution supervised learning to further improve the prediction accuracy of CRNet. Comprehensive experiments are conducted on two benchmarks: COCO and MPII datasets. The average precision of CRNet reached 72.1 and 80.2%, respectively, surpassing most state-of-the-art methods. Traditional research on emotion-face processing has primarily focused on the expression of basic emotions using adult emotional face stimuli. Stimulus sets featuring child faces or emotions other than basic emotions are rare. The current study describes the acquisition and evaluation of the Qingdao Preschooler Facial Expression set, a facial stimulus set with images featuring 54 Chinese preschoolers’ emotion expressions. The set includes 712 standardized color photographs of six basic emotions, five discrete positive emotions, and a neutral expression. The validity of (...) the pictures was examined based on 43 adult raters’ online evaluation, including agreement between designated emotions and raters’ labels, as well as intensity and representativeness scores. Overall, these data should contribute to the developmental and cross-cultural research on children’s emotion expressions and provide insights for future research on positive emotions. (shrink)

The research object of this subject, through cooperation with Shanghai International Fashion Education Center, a fashion travel education institution, is a convenient sample for the members of its “Japan Fashion Travel Project,” using quantitative research methods and research tools for questionnaires. From the perspective of tourist shopping experience marketing, this paper studies the relationship among tourist marketing, value perception, shopping satisfaction, and customer loyalty to outlets, and discusses the recommendations for sustainable development of outlets.

Aquinas’ doctrine of materia signata or “designated matter” is an important deviation from the traditional doctrines on matter. Through in-depth typological and genetic analyses of the related concepts, this essay explores materia signata’s ontological qualities, generative mechanism and function, as well as its academic significance in the history of both Christian theology and Western philosophy.

Tolerant discourse in the United States has responded to heightened stereotyping of Muslims as violent by countering that “not all Muslims are terrorists.” This subtyping of Muslims—as some radical terrorists among mostly peaceful “moderates”—is meant to protect a positive image of the group but leaves the original negative stereotype unchanged. We predicted that such discourse may paradoxically increase people’s support of anti-Muslim policies because the subtyping and its associated negative stereotypes justify hostile actions toward Muslims. In Study 1, subtyping predicted (...) support for three anti-Muslim policies, but only among political moderates and conservatives. In Study 2, participants who were exposed to subtyping narratives expressed greater support for surveillance of Muslims in the United States. The effect of subtyping narrative exposure was stronger on support for hawkish anti-terror policy when participants’ preexisting endorsement of subtyping was low. Irrespective of the well-meaning intentions of peaceful vs. radical subtyping, its expression can justify ongoing “War on Terror” policies. As the population of Muslims increases in North America, the intuition that most Muslims do not meet the negative stereotype may ironically reduce inclusion. (shrink)

Heidegger through Hegel's "Phenomenology of Mind" from the absolute beginning and returns the absolute prerequisite for the analysis, while abandoning Hegel skillfully expounded his own view of hermeneutics, in particular related to the limited and infinite nature of the relationship, the meaning of existence and there are other issues, for we understand the "Phenomenology of Mind", to understand Heidegger's own thinking and in philosophical method, as well as between the two thinkers and critical internal succession relations are very instructive.
