What does it take to be subjectively free in an objectively rational social order? In this book Andreja Novakovic offers a fresh interpretation of Hegel's account of ethical life by focusing on his concept of habit or 'second nature'. Novakovic addresses two central and difficult issues facing any interpretation of his Philosophy of Right: why Hegel thinks that it is is better to relate unreflectively to the laws of ethical life, and which forms of reflection, especially critical reflection, (...) remain available within ethical life. Her interpretation draws on numerous parts of Hegel's system, particularly on his 'Anthropology' and his Phenomenology of Spirit, and also explores connections between his account and those of other philosophers. Her aim is to argue that Hegel has a compelling conception of the ordinary ethical standpoint which takes seriously both the virtues and the perils of reflection. (shrink)

Hegel frequently identifies ethical life with a “second nature.” This strategy has puzzled those who assume that second nature represents a deficient appearance of ethical life, one that needs to be overcome, supplemented, or constantly challenged. I argue that Hegel identifies ethical life with a second nature because he thinks that a social order only becomes a candidate for ethical life, if it provides a context conducive to the development of what I call “real habits.” First, I show that a (...) criterion for a real habit can be found in Hegel's Anthropology, namely, that of liberation. Next, I explain how the state, as Hegel analyzes it in the Philosophy of Right, provides such an environment by enabling trust toward and within it. I then consider two literary examples of contexts that fail to be similarly supportive—Coates' Between the World and Me and Atwood's Handmaid's Tale—concluding with reasons for thinking that real habits are an integral part of ethical life. Hegel's Science of Logic tracks the self-contained and self-generated development of what Hegel calls the concept. My question is: can the concept in the Logic surprise itself? I argue that the answer to that question is yes—the concept can surprise itself when it rediscovers itself in a place it did not expect to be. I first clarify the kind of perspective that the Logic asks us as readers to occupy and its difference from the perspective inside the ‘opposition’ of consciousness. (...) I then provide an example of the concept's self-surprise, namely, the transition from subjective to realized purpose in the Subjective Logic. I conclude by drawing out some implications of self-surprise for Hegel's method in the Logic and in the subsequent Realphilosophie. (shrink)

In 2009, with the enactment of the Lisbon Treaty, the Charter of Fundamental Rights of the European Union entered into force. Under Article 8 of the Charter, for the first time, a stand-alone fundamental right to data protection was declared. The creation of this right, standing as a distinct right to the right to privacy, is undoubtedly significant, and it is unique to the European legal order, being absent from other international human rights instruments. This commentary examines the parameters of (...) this new right to data protection, asking what are the principles underpinning the right. It argues that the right reflects some key values inherent in the European legal order, namely: privacy, transparency, autonomy and nondiscrimination. It also analyses some of the challenges in implementing this right in an era of ubiquitous veillance practices and Big Data. (shrink)

Continental Philosophy of Social Science demonstrates the unique and autonomous nature of the continental approach to social science and contrasts it with the Anglo-American tradition. Yvonne Sherratt argues for the importance of an historical understanding of the Continental tradition in order to appreciate its individual, humanist character. Examining the key traditions of hermeneutic, genealogy, and critical theory, and the texts of major thinkers such as Gadamer, Ricoeur, Derrida, Nietzsche, Foucault, the Early Frankfurt School and Habermas, she also contextualizes contemporary (...) developments within strands of thought stemming back to Ancient Greece and Rome. The goal of this dissertation is two-fold. It is, first, to reconstruct Kant's argument against self-murder, and, second, to analyze the function of the principle of self-preservation of reason with regard to the prohibition of self-murder. I argue that self-murder is contrary to the principle of self-preservation of reason and violates the trustee-relationship between the homo phaenomenon and the homo noumenon. The analysis shows that moral self-preservation in Kant is a rational principle which serves to secure the possibility of moral (...) faith and self-perfection. ;In the first part of the dissertation, I provide a comprehensive analysis of Kant's argument against self-murder by examining all of the relevant statements in his works, the Nachlass, as well as the lectures recorded by Herder, Powalski, Collins, and Vigilantius. Since self-murder violates a perfect duty to oneself, key-topics of the analysis are: the dual status of the duty of self-preservation as both inner duty of right and duty of virtue, the right and end of humanity, as well as Kant's model of self-possession in terms of proprietas. The analysis makes clear that self-murder destroys the moral self and must be distinguished from sacrificing one's life in order to preserve one's moral integrity. ;In the second part of the dissertation, I interpret the duty of self-preservation and the prohibition of self-murder in the context of Kant's doctrine of the faith of reason and the principle of self-preservation of reason. I first provide an overview of the debate on self-preservation and its implications for an understanding of modern rationality and summarize the different meanings of -preservation in Kant. I then argue that the "principle of self-preservation of reason" consists in what Kant calls "the maxim of healthy reason" and that it grounds the faith and the unity of reason. Against the background of this analysis, I interpret the trustee-relationship between the homo phaenomenon and the homo noumenon as a model of moral self-obligation. Entrusting the homo phaenomenon to the homo noumenon, I contend, means to entrust life to practical reason and to subject oneself to the moral law. (shrink)

Nominalism is the view that certain objects ( i.e ., abstract objects) do not exist, and not the view that it is philosophically indeterminate whether or not they do. I resolve the dilemma that Azzouni's claims pose: Azzouni is a non-factualist about what exists, but he is a factualist about which criterion for what exists our community of speakers has adopted. In this article I argue that Adorno makes an internal critique of instrumental reason. I depict Adorno's notion of instrumental reason by showing how he combines Freud's materialistic epistemology with his own German Idealist inheritance. In 1780 Frederick II pushed the Prussian Academy to put forward a controversial question for a public essay contest: “Is it useful for the people to be deceived, be it by leading it into new errors or by confirming it in those which it upholds?” Although Hegel would have been too young to participate in the contest, he took two later opportunities to provide what would have been his answer. Whereas the Phenomenology of Spirit evaluates Enlightenment’s charge that religious faith (...) is based on deception, the Philosophy of Right suggests that public opinion formation tends to lead to collective self-deception. In both versions of his answer, however, Hegel argues that it is impossible to deceive a people about its essence. Background: Within nursing, the concepts of home and homelike have been used indiscriminately to describe characteristics of healthcare settings that resemble a home more than an institution. Objectives: The aim of this study was to investigate the concept of home ( hem in Swedish). The main questions were as follows: What does the concept of home entail etymologically and semantically? Of what significance is the meaning of the concept to caring science and nursing? Design and methods: This study had a (...) qualitative design with a hermeneutical approach guided by Gadamer. Eriksson’s model of concept determination was partly used to determine the etymology and semantics, the essence and epistemic category of the concept of home. In this study, etymological dictionaries and 17 Swedish language dictionaries published between 1850 and 2001 were investigated. Ethical consideration: In all parts of this study, ethical guidelines have been followed concerning both gathering data from dictionaries and other sources and during the interpretation of these sources. Findings: The home, framed as the ethos of caring, can be drawn as a three-dimensional picture where the three dimensions have a common core, enclosed and inviolable. Symbolically, the picture of home can be seen as the ethos of the human being’s innermost room, the human being’s manner of being and the tone expressed in the external or abstract room where the human being lives and interacts with others. Conclusion: Based on the findings in this study, we conclude that home as ethos is an inner ethical dimension within the human being. Human beings who are in contact with their ethos, the self, feel at home and dare to follow the voice of their heart. Nurses who experience at-homeness have an ability to invite the patient into a caring relationship. The home and the feeling of being at home have significant meaning in terms of human beings’ health and well-being. (shrink)

John Rawls’s writings on just war, though limited, shed important light on the ethics of political violence. This chapter explores Rawls’s contribution to just war theory, paying particular attention to how he differs from his contemporary, Michael Walzer, as well as from future methodological sympathizers, the “revisionists,” who also turn to analytical philosophy to draw insights about just war. In contrast to the “revisionists,” however, Rawls does not take the reductive individualist turn. Rather, he extends the original position that defines (...) the domestic setting to peoples inhabiting the international level. This assumption sets the stage for his theorizing about just war, which tracks closely with Kant (on democratic peace theory) and Walzer (on supreme emergency), while offering insights into just war against “outlaw” states, individual conscientious objection in response to unjust wars, and the role that just war tenets might play in setting the stage for peace. Ultimately, Rawls’s thinking about the place of political collectives in the international domain offers insights for better navigating the methodological disagreements between traditional and revisionist views of just war from a largely untapped but analytically rigorous, perspective. Hojjat Soofi successfully developed a novel dementia-specific model of human flourishing.1 Based on a modified version of Nussbaum’s account of dignity (ie, the theoretical framework of the capabilities approach), and integrated with Kitwood and Bredin’s empirically informed list of indicators of well-being for people with dementia (ie, the field of empirically informed ethics), this model provides guidance on how to actually care for people with dementia in real-life practices, according to the moral requirements of respect for dignity. More specifically, we (...) deem the contributive value of the model to be threefold. (1) It is a successful specification and contextualisation of Nussbaum’s original list of capabilities in the context of dementia care. (2) The table clearly distinguishes between dementia-specific capabilities and their possibly dementia-related progressive deprivation (ie, the internal conditions), and the possible external setbacks or facilitators for human flourishing. (3) The model is proposed as being open to include new and additional insights from further empirical research on what forms of caregiving do (or do not) align with respect for the dignity of people with dementia. In our commentary, we want to focus on the source of dignity, that is, the locus and starting point of our moral requirements on which the author takes an explicit stance. First of all, by being founded on the list of dementia-specific capabilities, Soofi’s model places the source of our moral requirements of respect for the dignity of people with dementia within the persons themselves, ‘having some of the basis capabilities listed’ (p.6). As a counterpoint to demonstrative proofs in metaphysics, Robert Nozick presented the case for God’s existence based on the value of personal experiences. Personal experiences shape one’s life, but this is even more evident with extraordinary experiences, such can be religious ones. In the next step, says the argument, if those experiences can be explained only by invoking the concept of the Supreme Being, then God exists. The second step mirrors scientific explanation constituting what Nozick calls the “argument to the (...) best explanation.” The argument is set against the background of Nozick’s methodology which rejects demonstrative proofs in metaphysics. Its purpose is threefold. It aims to establish a certain sort of experience (religious/spiritual) as a legitimate basis for the argumentation; it aims to show that it is not philosophically blasphemous to explain such experiences by introducing a concept of divinity. Finally, it seeks to showcase the non-dogmatic, investigative nature of the argument. By exploring the merits of Nozick’s proposal, I will try to elucidate all three components, which should pave the way for a broader discussion on the role of non-demonstrative arguments in metaphysics. Women generally initiate, lead, and constitute the rank and file of environmental justice activism. However, there is little research on why there are comparatively so few men involved in these movements. Using the environmental justice movement in the Central Appalachian coalfields as a case study, we examine the ways that environmental justice activism is gendered, with a focus on how women’s and men’s identities both shape and constrain their involvement in gendered ways. The analysis relies on 20 interviews with women (...) and men grassroots activists working for environmental justice in the coalfields of Appalachia. We find that women draw on their identities as “mothers” and “Appalachians” to justify their activism, while the hegemonic masculinity of the region, which is tied to the coal industry, has the opposite effect on men, deterring their movement involvement. We explore the implications of these findings for understanding the relationship of gender to environmental justice activism. (shrink)

Contemporary international law separates the international justice of war from the domestic justice of society, but empirically, there is a correlation between democratic governance and military effectiveness, which could have a number of causes. A contemporary reconstruction from _The Seven Military Classics_ of Chinese military philosophy offers potential lessons for how domestic virtues may yield military and geopolitical victory. This chapter reconstructs arguments from the seven treatises into a collective an amalgamated conception of “good governance” that weaves together military strategy (...) and virtue ethics and maintains that good governance at home actually wins wars abroad. A reconstructed classical Chinese conception of “good governance” presents theoretical and ethical challenges, but also offers viable justicial content for contemporary jus ad bellum considerations beyond sovereign self-defense or human rights. It presents a way of instantiating the sprawling conception of human rights that falls short in contemporary discourse. (shrink)

An Irish Government directive to close colleges amid the Covid-19 pandemic resulted in a switch to emergency remote teaching. Many lecturers unused to practicing online began teaching students who were unfamiliar with online learning. Completion of the semester does not necessarily indicate that it is practicable for a more extended period. This paper queries four aspects of the sustainability of emergency remote teaching: its acceptance by stakeholders; its impact upon student motivation and faculty workload; and its effect upon learning outputs. (...) Questionnaires administered to undergraduate design students and faculty captured their respective experiences of emergency remote teaching. Acceptance of an extended pivot to online learning is not guaranteed, but will surely form a central facet of academic continuity. Increased working hours associated with online teaching endangers the work-life balance of lecturers, yet the same staff must find ways to support student motivation. Faculty’s reduced expectations of student output places strain upon the sustainability of online education founded upon an unplanned pivot. The experience of emergency remote teaching has created an opportunity for all parties to leverage the affordances of online learning – the challenge will be to ensure that all aspects of any extended switch to online are sustainable. Lo digital descansa en la computación. La programación utiliza algoritmos. Los algoritmos son el conjunto de reglas que resuelven problemas en un número finito de pasos. En este sentido, el mundo digital está regido por cantidades, números, reglas fijas. El grado de libertad parece muy limitado. Por el contrario, la actividad artística y la creatividad descansan en la apertura, la libertad y en experiencias cualitativas. Estas experiencias no solo son vitales para la expresión artística, sino para la vida cotidiana. Los (...) mundos-vitales tecnológicos tal como se representan en tecnologías actuales (por ejemplo, en las casas inteligentes o en la conducción automática) o en la ciencia ficción no parecen dar cabida a estas estructuras abiertas. La filosofía de la tecnología está dividida: muchos sostienen que la tecnología determina en gran medida la cognición humana (como Mark B. N. Hansen, Bernard Stiegle) y, consiguientemente, subordina la cognición humana a las organizaciones maquinales. Otros adoptan una aproximación diferente y reflexionan sobre el potencial creativo de las nuevas tecnologías (Erin Mannig, Jaime del Val). This dissertation focuses on the question of whether or not we can adjudicate between competing criteria for what exists. A criterion for what exists provides the necessary and sufficient conditions for what sorts of entities are real. It tells us which property, or which set of properties, an entity must possess to count as existing. Example: an entity exists if and only if it has causal powers. ;My thesis, in this project, is that we are not in a position to (...) adjudicate between competing criteria for what exists. A criterion for what exists is philosophical bedrock, and it isn't possible for us to slide any justification underneath it. ;The first chapters of the dissertation focus on four candidate criteria for what exists: the causal criterion , the criterion of causal explanation , the criterion of best explanation , and the criterion of indispensability . My purpose is not to defend any of these criteria, nor to work out what exactly falls under them, but to get a good statement of each criterion, so that we have a set of possible candidates to adjudicate between. ;I then move to defend my main thesis. To this end, I examine four groups of arguments that might be used to defend a criterion for what exists: arguments from Quine's criterion, epistemic arguments, inductive arguments, and metaphysical arguments.
