Mithilfe der Verfahren des Embryo-Splittings werden unter Laborbedingungen aus einem Embryo mehrere, genetisch identische Embryonen gewonnen. Gegenwärtig wird in Fachbeiträgen debattiert, die in der Nutztierzucht etablierten Verfahren auf die humane Reproduktionsmedizin auszuweiten. Eine solche Anwendung wird derzeit flächendeckend als reproduktives Klonen verstanden und ist in allen Staaten per Gesetz oder Richtlinie untersagt. Bei der Prüfung ausgewählter Einwände gegen die prinzipielle Zulässigkeit einer Anwendung des Embryo-Splittings als assistierter Reproduktionstechnologie zeigt sich, dass sich die Einwände gegen das reproduktive Klonen nicht auf den (...) Fall des Splittings übertragen lassen. Insbesondere liegt dem Splitting nicht die ‚narzisstische‘ Replikation des Genoms einer bereits lebenden Person zugrunde. Die Gleichsetzung mit anderen Formen des reproduktiven Klonens verdeckt darüber hinaus eigene regulative Fragen zum Umgang mit gesplitteten Embryonen, die hinsichtlich einer potenziellen klinischen Anwendung adressiert werden müssen. Schließlich wird deutlich, dass die Maßgabe, Embryonen zu schützen, bisher einseitig als ausreichender Grund für eine restriktive Regulierung des Splittings herangezogen wurde. Diese Argumentation erweist sich in einer pluralistischen Gesellschaft jedoch als unzureichend. (shrink)

In dem Aufsatz wird die Leistungsfähigkeit des Potentialitätsarguments am Beispiel des therapeutische Klonen untersucht. Die Diskussion bewegt sich auf drei Ebenen. Zunächst geht es auf fundamentaler Ebene darum, eine Begründung des Lebensrechts von Vernunftwesen zu skizzieren. Dann wird auf einer zweiten Ebene argumentiert, daß der Anwendungsbereich dieser Grundnorm auch nicht aktual ihre Vernunft gebrauchende Wesen einschließt. Diese hier "Erweiterungspostulat" genannte Forderung wird weitgehend intuitiv begründet. Daran anschließend wird das Potentialitätsargument als Versuch interpretiert, dieses Postulat bestmöglich zu rationalisieren. Das so gewonnene (...) Konzept einer "aktiven Potentialität" als Grundlage für das Recht auf Leben wird gegen die gängigen Einwände verteidigt. Auf einer dritten Ebene wird das Potentialitätsargument schließlich auf die beim therapeutischen Klonen anfallenden künstlichen Zygoten bzw. Embryonen angewandt und dafür argumentiert, diese beim gegenwärtigen Stand des Wissens nicht für die Forschung freizugeben. (shrink)

ZusammenfassungIm Spielfilm Never Let Me Go werden Klone als vulnerable und heteronome Individuen dargestellt, die zur anonymen Organspende gezwungen werden. In diesem Beitrag wird die Darstellung dieser Figuren in ihrer individuellen Entwicklung und gesellschaftlichen Sozialisation unter der Frage untersucht, welche Bezüge sich zu bioethischen Aspekten ergeben. Die Klone befinden sich in einer Situation der „privilegierten Deprivation“: Aus Sicht der Zuschauer sind sie sozial benachteiligt und können sich nicht zu komplett autonomen Wesen entwickeln, aber aus ihrer eigenen Perspektive sind sie im (...) dystopischen System immer noch „privilegiert“. Wir argumentieren, dass dieser Film auf symbolische Weise diejenigen Individuen fokussiert, die vom medizinischen Fortschritt nicht profitieren oder die nicht genügend Handlungsspielraum haben, um sich gegen geltende Praxen zu positionieren. Filme wie Never Let Me Go können deshalb ein Beitrag sein, um die Perspektive marginalisierter Personen im medizinischen System einzunehmen. (shrink)

Die Berufung auf das Prinzip der Menschenwürde ist im gegenwärtigen Diskurs über die Ethik der Genetik weit verbreitet, insbesondere wenn es darum geht, ein schlagkräftiges Argument gegen bestimmte Formen der genetischen Forschung und Praxis wie der Genmanipulation und des Klonens zur Verfügung zu haben. Das Prinzip der Menschenwürde ist indes sehr vage und unbestimmt. Der Beitrag verfolgt die Entwicklung des Prinzips der Menschenwürde von einem gesellschaftlichen Konzept - der Art und Weise, wie Individuen einander betrachten - zu den modernen (...) Konzepten eines inneren Wertes des Menschen als Mensch. Das moderne Verständnis des Konzepts der Menschenwürde stammt von Pico della Mirandola und - selbstverständlich von Kant. Die zentrale These des Beitrags läuft darauf hinaus, daß die genetische Forschung und Praxis in der Regel das Prinzip der Menschenwürde nicht verletzt, und zwar weder auf der Ebene der Individuen noch auf der Ebene der menschlichen Gattung. Genetische Forschung und Praxis benutzt Menschen nicht bloß als Mittel, ohne sie als Zweck zu achten, gentechnologische Kontrolle unterminiert nicht den inneren Wert des Menschen und gentechnische Analyse als solche beeinträchtigt nicht die Integrität von Individuen. Viele der Einwände gegen die Gentechnologie, die sich auf das Prinzip der Menschenwürde berufen, beruhen auf der sogenannten Theorie absoluter, nicht personenbezogener Werte, die behauptet, daß Werte in abstracto auf die Welt angewendet werden können. Diese Sicht ist typischerweise in der religiösen Tradition verwurzelt. Wenn wir demgegenüber von einer "personenbezogenen" Konzeption der Werte ausgehen, was bedeutet, daß Werte nur auf aktuell existierende Personen bezogen werden können, verliert die Argumentation gegen genetische Interventionen das meiste von ihrer Überzeugungskraft. Involving patients in decisions on primary prevention can be questioned from an ethical perspective, due to a tension between health promotion activities and patient autonomy. A nurse-led intervention for prevention of cardiovascular diseases, including counselling (risk communication, and elements of shared decision-making and motivational interviewing) and supportive tools such as a decision aid, was implemented in primary care. The aim of this study was to evaluate the nurse-led intervention from an ethical perspective by exploring in detail the experiences of patients (...) with the intervention, and their views on the role of both the nurse and patient. The study had a qualitative design. 18 patients who had received the intervention participated. Data were gathered by in-depth interviews. The interviews were analysed using directed content analysis. The findings revealed that patients perceived the consultations not as an infringement on their autonomy, but as supportive to risk reduction efforts they tried but found hard to realise. They specifically emphasised the role of the nurse, and appreciated the nurse's realistic advice, encouragement, and help in understanding. Patients' views on and experiences with risk management are in line with notions of relational autonomy, caring cooperation and communicative action found in the literature. We conclude that patients define the relationship with the nurse as shared work in the process of developing a healthier lifestyle. (shrink)

We performed an EEG graph analysis on data from 31 typical readers (22.27 ± 2.53 y/o) and 24 dyslexics (22.99 ± 2.29 y/o), recorded while they were engaged in an audiovisual task and during resting-state. The task simulates reading acquisition as participants learned new letter-sound mappings via feedback. EEG data was filtered for the delta (0.5–4 Hz), theta (4–8 Hz), alpha (8–13 Hz), and beta (13–30 Hz) bands. We computed the Phase Lag Index (PLI) to provide an estimate of the (...) functional connectivity between all pairs of electrodes per band. Then, networks were constructed using a Minimum Spanning Tree (MST), a unique sub-graph connecting all nodes (electrodes) without loops, aimed at minimizing bias in between groups and conditions comparisons. Both groups showed a comparable accuracy increase during task blocks, indicating that they correctly learned the new associations. The EEG results revealed lower task-specific theta connectivity, and lower theta degree correlation over both rest and task recordings, indicating less network integration in dyslexics compared to typical readers. This pattern suggests a role of theta oscillations in dyslexia and may reflect differences in task engagement between the groups, although robust correlations between MST metrics and performance indices were lacking. In diesem Beitrag wird versucht, eine formale Kritik der Begründungen zu leisten, die die beiden Neuropathologen Otmar Wiestler und Oliver Brüstle für die Notwendigkeit und ethische Zulässigkeit der Forschung an humanen embryonalen Stammzellen im Rahmen verschiedener Beiträge geliefert haben. Es zeigt sich, dass 1. die ethische Güterabwägung mit außergewöhnlichen Behandlungsaussichten arbeitet, deren Evidenz nicht allgemein einsichtig bzw. akzeptiert ist; 2. die ethischen Entscheidungen im Rahmen der Güterabwägung erkennbar den Forderungen folgen, die sich aus der eigenen naturwissenschaftlichen Fragestellung ergeben; und 3. (...) dass sich aus dem Fehlen einer handlungsanweisenden ethischen Orientierung das Fehlen einer Reflexion auf die Implikationen des eigenen Handelns auf zukünftige Entwicklungen ergibt, die sowohl in der Konsequenz des eigenen Handelns wie der biotechnologischen Forschungslogik insgesamt liegen. In dieser Argumentation reproduziert sich exemplarisch das Grundproblem der modernen Naturwissenschaften, Fortschritt an immanente Forschungsperspektiven der Wissenschaft zu binden, anstatt die Wissenschaft wertorientiert zu führen. Ein solcher Szientismus impliziert einen permanenten Dammbruch. Daher ist ein Moratorium bezüglich neuer biotechnologischer Entwicklungen wie humaner embyronaler Stammzellforschung und therapeutischem Klonen dringend geboten. In dieser Zeit müssen Wertorientierungen und Ziele der Wissenschaft einer gründlichen fachübergreifenden Diskussion unterworfen werden, und diese Diskussion muss schließlich in die Gesellschaft getragen werden. In diesem Band werden bioethische Debatten behandelt, die sich unter den islamischen Rechtsgelehrten seit den 1980er Jahren entwickelt haben. Der Schwerpunkt liegt dabei auf Fragen des Lebensanfangs, die sich anhand der Diskussion um den rechten Umgang mit Embryonen vor dem Hintergrund neuer Moglichkeiten der modernen Reproduktionsmedizin entwickelten. Dabei wird der Frage nachgegangen, wie sich moderne islamische Rechtsdiskussionen konkret entwickeln und welche Konzepte oder Faktoren diese Entwicklung beeinflussen.So wird nachgezeichnet, wie Mitte der 1980er Jahre Definitionen uber den Beginn menschlichen Lebens und (...) der damit verbundenen Schutzrechte des Ungeborenen vorgenommen wurden, bis dato in dieser Form von islamischen Rechtsgelehrten kaum oder gar nicht vertreten worden waren. Darauf aufbauend wird gezeigt, wie sich die Diskussion des Status von extra-korporalen Embryonen - einer Kernfrage bei der Bewertung gentechnologischen Fortschritts - zu Beginn der 1990er Jahre unter den fuqaha entwickelte. Dabei zeigt sich, dass sich wegen methodischen Problemen bislang unter Rechtsgelehrten keinerlei Konsens uber grundlegende Fragen zum Beginn menschlichen Lebens etabliert hat, der einer kritischen Analyse standhalten wurde. Im Anschluss daran werden islamische Rechtsmeinungen zu den vier Themenbereichen "Praimplantationsdiagnostik", "Abtreibung nach Pranataldiagnostik", "Klonen beim Menschen" und "Vaterschaftstests" vorgestellt.In diesem Band wird der Bezug zwischen theoretischen Diskussionen und ihren praktischen Auswirkungen in den Landern mit mehrheitlich muslimischer Bevolkerung aufgezeigt. Uber das engere Fachgebiet hinaus besteht die Bedeutung des Buches darin, dass es die modernen islamischen Rechtsmeinungen auf die ihr zu Grunde liegenden Konzepte hin durchleuchtet und somit hilft, diese Meinungen in bioethischen Debatten etwa in Deutschland besser einordnen und gegebenenfalls einbeziehen oder zuruckweisen zu konnen. Unconsented episiotomies and other procedures during labour are commonly reported by women in several countries, and often highlighted in birth activism. Yet, forced caesarean sections aside, the ethics of consent during labour has received little attention. Focusing on episiotomies, this paper addresses whether and how consent in labour should be obtained. We briefly review the rationale for informed consent, distinguishing its intrinsic and instrumental relevance for respecting autonomy. We also emphasise two non-explicit ways of giving consent: implied and opt-out consent. (...) We then discuss challenges and opportunities for obtaining consent in labour and birth, given its unique position in medicine.We argue that consent for procedures in labour is always necessary, but this consent does not always have to be fully informed or explicit. We recommend an individualised approach where the antenatal period is used to exchange information and explore values and preferences with respect to the relevant procedures. Explicit consent should always be sought at the point of intervening, unless women antenatally insist otherwise. We caution against implied consent. However, if a woman does not give a conclusive response during labour and the stakes are high, care providers can move to clearly communicated opt-out consent. Our discussion is focused on episiotomies, but also provides a useful starting point for addressing the ethics of consent for other procedures during labour, as well as general time-critical medical procedures. In der philosophischen Ethik ist "die gute Welt" außer Mode gekommen. Der vorliegende Diskussionsband setzt sich mit Ludwig Sieps "Konkreter Ethik" auseinander. Die "Konkrete Ethik" von Ludwig Siep öffnet sich bewusst hin auf eine Hermeneutik der religiösen und kulturellen Traditionen der Menschheit, sie sucht aber auch in der Auseinandersetzung mit Problemen der Kultur- und Naturethik den Dialog mit dem Forschungsstand der Naturwissenschaften. Methodisch geht die "Konkrete Ethik" von einem Verständnis von Ethik aus, das ihr Ziel nicht in der Ausarbeitung von (...) abstrakten Prinzipien sieht, die es dann nachträglich auf konkrete Probleme zu applizieren gälte. Aus dem hermeneutischen Selbstverständnis seines Ansatzes heraus ergibt sich eine beeindruckende Vielfalt von Fragestellungen. Sie reichen von der Frage nach der Bedeutung von Objektivität und Realität in der Ethik bis hin zu Problemen des reproduktiven Klonens und des Bevölkerungswachstums. Entsprechend vielfältige Ansatzpunkte ergeben sich für eine systematische philosophische Auseinandersetzung mit der "Konkreten Ethik". Im vorliegenden Band diskutieren namhafte Forscher Sieps Thesen, Konzepte, sein Begründungsmodell und seine Auseinandersetzung mit zentralen Themen der Medizin-, Bio- und angewandten Ethik. (shrink)

Courses on ethics and technology have become compulsory for many students at the three Dutch technical universities during the past few years. During this time, teachers have faced a number of didactic problems, which are partly due to a growing number of students. In order to deal with these challenges, teachers in ethics at the three technical universities in the Netherlands — in Delft, Eindhoven and Twente — have developed a web-based computer program called Agora (see www.ethicsandtechnology.com). This program enables (...) students to exercise their ethical understanding and skills extensively. The program makes it possible for students to participate actively in moral reflection and reasoning, and to develop the moral competencies that are needed in their later professional practice. The developers of the program have tried to avoid two traps. Firstly, they rejected, from the outset, a cookbook style of dealing with ethical problems that applied ethics is often taken to be and, secondly, they wanted to design a flexible program that respects the student’s as well as the teacher’s creativity, and that tries to engage students in moral reflection. Agora meets these requirements. The program offers possibilities that extend beyond the requirements that are usually accepted for case-exercises in applied ethics, and that have been realised in several other computer models for teaching ethics. In this article, we describe the main considerations in the development of Agora and the features of the resulting program. (shrink)

We invite systematic consideration of the metaphors of cycles and circulation as a long-term theme in the history of the life and environmental sciences and medicine. Ubiquitous in ancient religious and philosophical traditions, especially in representing the seasons and the motions of celestial bodies, circles once symbolized perfection. Over the centuries cyclic images in western medicine, natural philosophy, natural history and eventually biology gained independence from cosmology and theology and came to depend less on strictly circular forms. As potent ‘canonical (...) icons’, cycles also interacted with representations of linear and irreversible change, including arrows, arcs, scales, series and trees, as in theories of the Earth and of evolution. In modern times life cycles and reproductive cycles have often been held to characterize life, in some cases especially female life, while human efforts selectively to foster and disrupt these cycles have harnessed their productivity in medicine and agriculture. But strong cyclic metaphors have continued to link physiology and climatology, medicine and economics, and biology and manufacturing, notably through the relations between land, food and population. From the grand nineteenth-century transformations of matter to systems ecology, the circulation of molecules through organic and inorganic compartments has posed the problem of maintaining identity in the face of flux and highlights the seductive ability of cyclic schemes to imply closure where no original state was in fact restored. More concerted attention to cycles and circulation will enrich analyses of the power of metaphors to naturalize understandings of life and their shaping by practical interests and political imaginations. Barry Baldwin, noting that C.A. Trypanis, unlike the great B. Bury and others, was inclined to disbelieve the story, could not help expressing the hope that it was true (An Anthology of Byzantine Poetry, Amsterdam 1985, pp. 142–3). It is (...) of course only one of the many stories concocted by iconodule propaganda. The central question has to be formulated in more general terms: how is history made? History here primarily in the sense of the construction of the past by the Byzantines themselves, was embodied in historical narratives moving between hagiography and historiography. Trying to lay bare the basis and elements of such constructs will always remain a major task of critical historical scholarship. (shrink)

The next World Congress of Bioethics will be held in Doha, Qatar. Although this location provides opportunities to interact with a more culturally diverse audience, to advance dialogue between cultures and religions, offer opportunities for mutual learning, there are also huge moral concerns. Qatar is known for violations of human rights ‐ including the treatment of migrant workers and the rights of women ‐ corruption, criminalization of LGBTQI+ persons, and climate impact. Since these concerns are also key (bio)ethical concern we (...) call for a broad debate within the bioethics community whether organizing and attending the World Congress in Qatar is ethically problematic and how ethical concerns should be dealt with. Expanded universal carrier screening (EUCS) entails a population‐wide screening offer for multiple disease‐causing mutations simultaneously. Although there is much debate about the conditions under which EUCS can responsibly be introduced, there seems to be little discussion about its aim: providing carrier couples with options for autonomous reproductive choice. While this links in with current accounts of the aim of foetal anomaly screening, it is different from how the aim of ancestry‐based carrier screening has traditionally been understood: reducing the disease burden (...) in the population. The reasons why the aim of EUCS is presented in terms of ‘autonomy’ rather than ‘prevention’ have not been spelled out in the literature. This paper seeks to fill this gap by considering the morally relevant similarities and dissimilarities between foetal anomaly screening, ancestry‐based carrier screening and EUCS. When carrier screening is performed in the prenatal period, enhancing autonomy appears the most appropriate aim of EUCS, as the alternative of ‘prevention through selective abortion’ would urge women to terminate wanted pregnancies. However, when screening is conducted in the preconception period, carrier couples can avoid the birth of affected children by other means than selective abortion, for instance preimplantation genetic diagnosis. To the extent that this increased control over passing on a genetic disorder raises questions of parental responsibility, it seems necessary that the account of the aims of EUCS is wider than only in terms of enhancing reproductive autonomy. Cognitive agents are dynamical systems but not quantitative dynamical systems. Quantitative systems are forms of analogue computation, which is physically too unreliable as a basis for cognition. Instead, cognitive agents are dynamical systems that implement discrete forms of computation. Only such a synthesis of discrete computation and dynamical systems can provide the mathematical basis for modeling cognitive behavior.

We study several modal languages in which some (sets of) generalized quantifiers can be represented; the main language we consider is suitable for defining any first order definable quantifier, but we also consider a sublanguage thereof, as well as a language for dealing with the modal counterparts of some higher order quantifiers. These languages are studied both from a modal logic perspective and from a quantifier perspective. Thus the issues addressed include normal forms, expressive power, completeness both of modal systems (...) and of systems in the quantifier tradition, complexity as well as syntactic characterizations of special semantic constraints. Throughout the paper several techniques current in the theory of generalized quantifiers are used to obtain results in modal logic, and conversely. (shrink)

ABSTRACT Match-fixing is a major ethical issue in sports. Although research interest in match-fixing has increased in recent years, we remain largely in the dark regarding how both betting- and non-betting-related match-fixing relate to the moral decision-making of those involved. Drawing on Rest’s theory of morality and on the perceptions of a large sample of participants in Flemish sports, this study indicates that most match-fixing incidents are non-betting-related, while moral motivation and associated challenges clearly differ according to the type of (...) match-fixing. In the Netherlands fertility doctors increasingly formulate protocols, which oblige patients to quit their unhealthy lifestyle before they are admitted to IVF procedures. We argue that moral arguments could justify parenting protocols that concern all future parents. In the first part we argue that want‐to‐be parents have moral responsibilities towards their future children to prevent them from harm by diminishing or eliminating risk factors before as well as during the pregnancy. This is because of the future children's potential to become (...) of a certain type, more specifically: a person that will be the want‐to‐be parents' child. Want‐to‐be parents intend to become pregnant and therefore have an additional moral reason to diminish the risks. Also, people who become pregnant unintentionally have the responsibility to prevent their children from harm, unless they become pregnant due to contraception failure. All people not wanting to become pregnant should use contraception methods carefully.In the second part of this paper we translate the want‐to‐be parents' responsibilities into practice. We distinguish four determinants of risk factors: modifiability, chance, severity and effort. We examine some evidence‐based risk factors based on these variables and deduce levels of responsibility.In conclusion, formulating informal requirements for want‐to‐be parents is morally required and therefore also for want‐to‐be parents in need of medical assistance. The protocols developed by fertility doctors in the Netherlands could be seen as the precursor for a general, informal Parenting Protocol that could be developed on the basis of an extended and thoroughly debated risk‐responsibility analysis. What role do nurses play in euthanasia? How do they experience this role and what should be their ideal role? These are the questions of a study undertaken to gain insight into the role of nurses in euthanasia. Answers to these questions were derived from 20 semistructured in-depth interviews with nurses employed in a Dutch hospital. To make clear the role of nurses in euthanasia, the issue was split up into four phases: observation of a request for euthanasia; decision making; (...) carrying out of the request; and after-care. This article is a brief report on the most important results regarding these four phases. Special attention will be paid to nurses who have conscientious objections. To evaluate the study results, an unambiguous interpretation of the concept of ‘euthanasia’ is of most importance. For that reason, Dutch laws and other regulations concerning euthanasia will be explained. (shrink)

The paper provides a reconstruction of the notion of genetic phenomenology while trying to demonstrate that its elaboration leads Husserl to dismiss de facto the main motivation of his idealism—namely the idea that at the basis of constitution is an immanent and formless stuff shaped or animated by subjective acts. Indeed genetic analysis shows that the original stuff of constitution consists of sensuous contents structured according to a material lawfulness grounded on their peculiarity. By affecting the subject, such contents motivate (...) the performing of intentional acts and are the genuine motor of constitution. The genetic ground of apperceptions is thus material content. This article describes the findings of a mixed method literature review that examined the perceptions of elderly patients and residents of a good nurse in nursing homes, hospitals and home care. According to elderly patients and residents, good nurses are individuals who have the necessary technical and psychosocial skills to care for patients. They are at their disposal, promptly recognising the patients' needs. Good nurses like their job and are sincere and affectionate. They are understanding and caring. They do not (...) hesitate to enter into a trust-based relationship with their patients. Knowing and understanding how elderly patients and nursing home residents perceive ‘the good nurse’ is crucial for providing quality care and for promoting better patient outcomes in geriatric care.
