In contract law, common mistake or frustration are grounds for relieving the promisor from the obligation to perform. Conventional economic theory justifies relief by appealing to its effect on the promisee’s incentives, namely, her incentives to act efficiently to prevent the unfavorable occurrence or its associated losses. The Article challenges this justification. While relief may indeed generate efficient incentives under certain conditions, these are not the conditions in which it is in fact granted. Consequently, the cases in which the (...) conventional theory recommends that relief be provided and those in which it is actually awarded, are incompatible. Based upon this premise, the Article develops a new theory of the law of common mistake and frustration, bearing descriptive and prescriptive implications. Under the new theory, the purpose of relief is not to incentivize promisees, but rather to determine the legal consequences of non-contemplated events. Viewed in this light, the Article identifies a new set of efficiency rationales for the rule. Under specified conditions, relief allows contracting parties to (1) refrain from welfare-reducing trade in unquantifiable risk; (2) maintain control over the distribution of contractual gains; and (3) overcome disincentives to form efficient contracts. The Article analyzes the conditions under which these virtues are applicable, and finds that they generally correspond to those in which relief is actually awarded. (shrink)

This paper examines an important but neglected topic in Suárez’s metaphysics–—namely, his theory of efficient causation. According to Suárez, efficient causation is to be identified with action, one of Aristotle’s ten highest genera or categories. The paper shows how Suárez’s identification of efficient causation with action helps to shed light on his views about the precise nature of efficient causation, and its role in his ontology. More specifically, it shows that Suárez understands efficient causation to be a distinctive or (...) sui generis type of entity, and that he thinks we must adopt this view in order to account for the facts of efficient causation. This 1987 book looks at competition, attacking the notion that competition always leads to good results and that more competition is better. It also attacks the notion that cooperation is always harmful. An efficient economic equilibrium requires an optimal combination of both cooperation and rivalry. Telser first examines the genesis of certain late nineteenth-century laws that affected competition in the United States. Going on to give theoretical insights into cooperation and rivalry, he shows when unrestricted competition can lead to an (...) efficient equilibrium, as well as when restrictions on competition can provide for the same. The tensions between these two forces are especially pertinent to the study of innovation - the more costly it is to protect the property rights of ideas, the greater is the reliance on secrecy, and hence, the more likely is the wasteful duplication of results. We contend that if efficiency and reliability are important factors in neural information processing then distributed, not localist, representations are “evolution's best bet.” We note that distributed codes are the most efficient method for representing information, and that this efficiency minimizes metabolic costs, providing adaptive advantage to an organism.

Recent studies of scientific interaction based on agent-based models suggest that a crucial factor conducive to efficient inquiry is what Zollman has dubbed ‘transient diversity’. It signifies a process in which a community engages in parallel exploration of rivaling theories lasting sufficiently long for the community to identify the best theory and to converge on it. But what exactly generates transient diversity? And is transient diversity a decisive factor when it comes to the efficiency of inquiry? In this (...) paper we examine the impact of different conditions on the efficiency of inquiry, as well as the relation between diversity and efficiency. This includes certain diversity-generating mechanisms previously proposed in the literature, as well as some factors that have so far been neglected. This study is obtained via an argumentation-based ABM. Our results suggest that cautious decision-making does not always have a significant impact on the efficiency of inquiry while different evaluations underlying theory-choice and different social networks do. Moreover, we find a correlation between diversity and a successful performance of agents only under specific conditions, which indicates that transient diversity is sometimes not the primary factor responsible for efficiency. Altogether, when comparing our results to those obtained by structurally different ABMs based on Zollman’s work, the impact of specific factors on efficiency of inquiry, as well as the role of transient diversity in achieving efficiency, appear to be highly dependent on the underlying model. Ibn Sina’s theory of efficient causality includes the definitions of metaphysical and natural efficient causes. In the first section, these definitions and two theses about their relation will be introduced. َAccording to the first thesis, natural efficient causes do not bestow existence and therefore they are not metaphysical. The alternative thesis defends bestowing existence by natural efficient causes, although this ontological status is restricted only to conferring existence of motion. In the second section, I will argue that, according to (...) Ibn Sina, natural causes bestow existence and therefore they are metaphysical. To do that, textual evidence and second definition of efficient causality will be appealed. Bestowing existence by natural efficient causes threatens, prima facia, Ibn Sina's theory of divine causality as a deistic theory. However, I will finally try to show that bestowing existence by natural causes leads to a theory which respects special divine action, and so it is not deistic. (shrink)

This paper describes a theory that explains both the creativity and the efficiency of people's conceptual combination. In the constraint theory, conceptual combination is controlled by three constraints of diagnosticity, plausibility, and informativeness. The constraints derive from the pragmatics of communication as applied to compound phrases. The creativity of combination arises because the constraints can be satisfied in many different ways. The constraint theory yields an algorithmic model of the efficiency of combination. The C3 model (...) admits the full creativity of combination and yet efficiently settles on the best interpretation for a given phrase. The constraint theory explains many empirical regularities in conceptual combination, and makes various empirically verified predictions. In computer simulations of compound phrase interpretation, the C3 model has produced results in general agreement with people's responses to the same phrases. (shrink)

An extended analysis compared to observations shows that modern “globalised” world civilisation has passed through the invisible “complexity threshold”, after which usual “spontaneous”, empirically driven kind of development (“invisible hand” etc.) cannot continue any more without major destructive tendencies. A much deeper, non-simplified understanding of real interaction complexity is necessary in order to cope with such globalised world development problems. Here we introduce the universal definition, fundamental origin, and dynamic equations for a major related quantity of (systemic) risk characterising real (...) complex system development tendencies at any level of dynamics. Various methods have been employed to investigate different aspects of the brain activity modulation related to the performance of a cycling task. In our study we examined how functional connectivity and brain network efficiency varied during an endurance cycling task. To this purpose, we reconstructed EEG signals at source level: we computed current densities in 28 anatomical regions of interest (ROIs) through the eLORETA algorithm, then we calculated the Lagged Coherence of the 28 current density signals to define the (...) adjacency matrix. To quantify changes of functional network efficiency during an exhaustive cycling task, we computed three graph theoretical indices: local efficiency (LE), global efficiency (GE) and Density (D) in two different frequency bands, Alpha and Beta bands, that indicate alertness processes and motor binding/fatigue respectively. This analysis was conducted for six different task intervals: pre-cycling, initial, intermediate and final stages of cycling, active recovery and passive recovery. Fourteen participants performed an incremental cycling task with simultaneous EEG recording and RPE monitoring to detect participants’ exhaustion. LE remained constant during the endurance cycling task in both bands. Therefore, we speculate that fatigue processes did not affect segregated neural processing. We observed an increase of GE in the Alpha band only during cycling, that could be due to greater alertness processes and preparedness to stimuli during exercise. Conversely, although D did not change significantly over time in the Alpha band, its general reduction in the Beta bands during cycling could be interpreted within the framework of the neural efficiency hypothesis, which posits a reduced neural activity for expert/automated performances. We argue that the use of graph theoretical indices represents a clear methodological advancement in studying endurance performance. (shrink)

Ockham’s razor is the principle that, all other things being equal, scientists ought to prefer simpler theories. In recent years, philosophers have argued that simpler theories make better predictions, possess theoretical virtues like explanatory power, and have other pragmatic virtues like computational tractability. However, such arguments fail to explain how and why a preference for simplicity can help one find true theories in scientific inquiry, unless one already assumes that the truth is simple. One new solution to that problem is (...) the Ockham efficiency theorem, which states that scientists who heed Ockham’s razor retract their opinions less often and sooner than do their non-Ockham competitors. The theorem neglects, however, to consider competitors following random strategies and in many applications random strategies are known to achieve better worst-case loss than deterministic strategies. In this paper, we describe two ways to extend the result to a very general class of random, empirical strategies. The first extension concerns expected retractions, retraction times, and errors and the second extension concerns retractions in chance, times of retractions in chance, and chances of errors. We consider the Stag Hunt in terms of Maynard Smith’s famous Haystack model. In the Stag Hunt, contrary to the Prisoner’s Dilemma, there is a cooperative equilibrium besides the equilibrium where every player defects. This implies that in the Haystack model, where a population is partitioned into groups, groups playing the cooperative equilibrium tend to grow faster than those at the non-cooperative equilibrium. We determine under what conditions this leads to the takeover of the population by cooperators. Moreover, we compare (...) our results to the case of an unstructured population and to the case of the Prisoner’s Dilemma. Finally, we point to some implications our findings have for three distinct ideas: Ken Binmore’s group selection argument in favor of the evolution of efficient social contracts, Sewall Wright’s Shifting Balance theory, and the equilibrium selection problem of game theory. Recent years have seen a surge in accounts motivated by information theory that consider language production to be partially driven by a preference for communicative efficiency. Evidence from discourse production (i.e., production beyond the sentence level) has been argued to suggest that speakers distribute information across discourse so as to hold the conditional per-word entropy associated with each word constant, which would facilitate efficient information transfer (Genzel & Charniak, 2002). This hypothesis implies that the conditional (contextualized) probabilities of (...) linguistic units affect speakers’ preferences during production. Here, we extend this work in two ways. First, we explore how preceding cues are integrated into contextualized probabilities, a question which so far has received little to no attention. Specifically, we investigate how a cue's maximal informativity about upcoming words (the cue's effectiveness) decays as a function of the cue's recency. Based on properties of linguistic discourses as well as properties of human memory, we analytically derive a model of cue effectiveness decay and evaluate it against cross-linguistic data from 12 languages. Second, we relate the information theoretic accounts of discourse production to well-established mechanistic (activation-based) accounts: We relate contextualized probability distributions over words to their relative activation in a lexical network given preceding discourse. I argue that, in light of his critique of rival theories of efficient causation, there is a puzzle latent in Aristotle’s own account. To show this, I consider one of his preferred examples of such causation, the activity of experts. Solving the puzzle yields a novel reading of Aristotle, one according to which experts, but not their characteristic arts or skills, are efficient causes.

Fifty years after the famous essay “The Problem of Social Cost” (1960) by the Nobel laureate Ronald Coase, Law and Economics seems to have become the lingua franca of American jurisprudence, and although its influence on European jurisprudence is only moderate by comparison, it has also gained popularity in Europe. A highly influential publication of a different nature was the Brundtland Report (1987), which extended the concept of sustainability from forestry to the whole of the economy and society. According to (...) this report, development is sustainable when it “meets the needs of the present without compromising the ability of future generations to meet their own needs”. A key requirement of sustainable development is justice to future generations. It is still a matter of fact that the law as well as the theories of justice are generally restricted to the resolution of conflicts between contemporaries and between people living in the same country. This in turn raises a number of questions: what is the philosophical justification for intergenerational justice? What bearing does sustainability have on the efficiency principle? How do we put a policy of sustainability into practice, and what is the role of the law in doing so? The present volume is devoted to these questions. In Part One, “Law and Economics”, the role of economic analysis and efficiency in law is examined more closely. Part Two, “Law and Sustainability”, engages with the themes of sustainable development and justice to future generations. Finally, Part Three, “Law, Economics and Sustainability”, addresses the interrelationships between the different aspects. (shrink)

This essay develops an account of health, the functional efficiency theory, which derives from Christopher Boorse's biostatistical theory. Like the BST, the functional efficiency theory is a nonevaluative view of health, but unlike the BST, it argues that the fundamental theoretical task is to distinguish levels of efficiency with which the parts and processes within organisms and within systems within organisms function. Which of these to label as healthy or pathological is of secondary importance. (...) Because the statistical distributions that Boorse's account relies on are distributions of functional efficiency, the functional efficiency theory arguably complements rather than challenges the BST. Since its inception, Shannon's information theory has attracted interest for the study of language and music. Recently, a wide range of converging studies have shown how efficient communication pervades language, from phonetics to syntax. Efficient principles imply that more resources should be assigned to highly informative items. For instance, average information content was shown to be a better predictor of word length than frequency, revisiting the famous Zipf's law. However, in spite of the success of the efficient communication framework (...) in the study of language and speech, very little work has investigated its relevance in the analysis of music. Here, we examine the organization of harmonic information in two large corpora of Western music, one made of MIDI files directly sequenced from scores, and the other made of MIDI recordings of live performances of highly skilled piano players. We show that there is a clear positive relationship between (contextual) information content of harmonic sequences and two essential musical properties, namely duration and loudness: the more unexpected a harmonic event is, the longer and the louder it is. Two aerodynamic concepts theorized in the early twentieth century – laminar-flow control and flying wings – offer the potential for more efficient aircraft. However, despite compelling advantages on paper and optimistic predictions, the fuel-saving benefits of these technologies have not yet been fully realized. This paper documents British work on these concepts, with a particular focus on laminar-flow control. Faced with an increasingly difficult funding context and a lack of a clear military rationale, these potentially significant advances in aircraft (...) class='Hi'>efficiency were stymied by a catch-22: the government was only prepared to provide financial support for the development of an operational prototype if operational performance had already been demonstrated. This case also highlights the challenges faced in the commercial uptake of radical aviation technologies, even when they appear to offer greater efficiency and environmental benefits. (shrink)

Willusionists claim that recent developments in psychology and neuroscience demonstrate that consciousness is causally inefficient [Carruthers, 2007; Eagleman, 2012; Wegner, 2002]. In section 1, I show that willusionists provide two types of evidence: first, evidence that we do not always know the causes of our actions; second, evidence that we lack introspective awareness of the causal efficiency of our intentional acts.In section 2, I analyze the first type of evidence. Recent research in the field of social psychology has shown (...) that irrelevant factors affect human behavior. For example, it has been shown that pleasant smells make a person more helpful toward strangers [Baron, 1997], whereas images of eyes that a person sees on a poster reduce the likelihood of cheating [Bateson, Nettle, & Roberts, 2006]. I argue that minor influences do not necessarily lead to something more sinister, and the contrary has not been empirically proven so far.In section 3, I analyze the second type of evidence that Daniel Wegner [2002] provides in favor of willusionism. Wegner claims that conscious will is usually understood in one of two ways: «as something that is experienced when we perform an action» [Wegner, 2002, p. 3] or «as a force of mind, a name for the causal link between our minds and our actions» [ibid.]. According to Wegner, it is a conceptual truth that for something to count as an instance of conscious will it must both be felt as voluntary, and causally efficient in bringing about a certain effect. Wegner claims that what satisfies can fail to satisfy, and vice versa. The major part of Wegner’s book is the review and analysis of diverse psychological phenomena: automatisms, hypnosis, illusions of control, influence of unconscious factors on human behavior, as well as some neuroscientific data. I briefly review the data provided by Wegner, and come to the conclusion that, although they show that there is a double dissociation between consciously willed processes and the acts that are supposedly caused by these processes, they do not justify further conclusions made by Wegner.According to Wegner, the feeling of conscious will is just an indicator of unconscious processes which, in fact, cause our behavior. I argue that the data considered by Wegner do not provide direct information about the neuronal processes that underlie conscious intentional processes. Moreover, double dissociation can only show that one process neither a necessary nor sufficient cause of another process. It cannot show that one process is not among the causes leading to another process.In section 4, I argue that the experimental data discussed in the article are important for philosophical theories of intentionality. In this paper I will discuss the problem of evaluating dynamic properties of the procedural rules that govern science. I will propose a novel framework for evaluating dynamic properties of such rules. This framework is based upon an analogy from New Institutional Economics. I will argue that the concept of ‘adaptive efficiency’, as it has been developed by Douglass North, solves a problem in economics that is analogous to the problem of evaluating dynamic properties of the procedural rules that (...) govern science. I will propose to apply the main ideas underlying this concept to Chrysostomos Mantzavinos’s theory of Explanatory Games. Based on these ideas, I will develop the concept of ‘explanatory efficiency’. This concept is meant to provide the means to evaluate the dynamic properties of Explanatory Games. I will argue that the proposed analogy also motivates more general applications of New Institutional Economics to traditional problems of philosophy of science. (shrink)

In this innovative book, Gloria Frost reconstructs and analyses Aquinas's theories on efficient causation and causal powers, focusing specifically on natural causal powers and efficient causation in nature. Frost presents each element of Aquinas's theories one by one, comparing them with other theories, as well as examining the philosophical and interpretive ambiguities in Aquinas's thought and proposing fresh solutions to conceptual difficulties. Her discussion includes explanations of Aquinas's technical scholastic terminology in jargon-free prose, as well as background on medieval scientific (...) views - including ordinary language explanations of the medieval physical theories which Aquinas assumed in formulating his views on causation and causal powers. The resulting volume is a rich exploration of a central philosophical topic in medieval philosophy and beyond, and will be valuable especially for scholars and advanced students working on Aquinas and on medieval natural philosophy. This essay argues that what is central to Christopher Boorse’s biostatistical theory of disease as statistically subnormal part function (BST) are comparisons of the “functional efficiency” of parts and processes and that statistical considerations serve only to pick out a healthy level of functional efficiency. On this interpretation, the distinction between health and pathology is less important than comparisons of functional efficiency, which are entirely independent of statistical considerations. The clarifications or revisions of the BST that (...) this essay offers are friendly amendments that render moot some of the most prominent criticisms of Boorse’s account. (shrink)

Egalitarian theories of justice hold that equality should be promoted. Typically, perfect equality will not be achievable, and it will be necessary to determine which of various unequal distributions is the most equal. All plausible conceptions of equality hold that, where perfect equality does not obtain, (1) any benefit (no matter how small) to a worst-off person that leaves him/her still a worst-off person has priority (with respect to equality promotion) over any benefit (no matter how large) to a best-off (...) person, and (2) any benefit to a worse-off person (even if not a worst-off person) has priority over a benefit of the same size to a better off person (even if not a best-off person). This paper points to some limitations of law and economics as both an explanative and a normative theory. In explaining law as the result of efficiency promoting decisions, law and economics theorists often dismiss the reasons actors in the legal system give for their behavior. Recognizing that sometimes actors may be unaware of why institutions evolve as they do, I argue that the case for dismissing reasons for action is weaker when those reasons make reference to rules of (...) practices that constitute the meaning of actions within those practices, or when they have otherwise been given well-considered defenses. In criticizing law and economics as a normative theory, I acknowledge that economic considerations are often important in deciding how to act in the personal sphere and how government should allocate its scarce resources. I argue that while the use of institutions to promote our ideals forces us to take their costs into account, it is a mistake to infer from this that the question of determining social policy is a purely economic problem, and that we should acknowledge the non-utilitarian moral ideals our law and practices promote. This is the basis of both an internal criticism--law and economics theorists have not sufficiently evaluated and weighed the value of fairness and other ideals in their utility calculations--and an external criticism-- these ideals are important in ways that can not be measured in utiles. Özkal-Sanver (Theory Decis 59:193–205, 2005) studies stability and efficiency of partitions of agents in two-sided matching markets in which agents can form partitions by individual moves only, and a matching rule determines the matching in each coalition in a partition. In this study, we present the relationship between stability and efficiency of partitions that is analyzed for several matching rules and under various membership property rights codes, now allowing coalitional moves.

The thesis of theory-ladenness of observations, in its various guises, is widely considered as either ill-conceived or harmless to the rationality of science. The latter view rests partly on the work of the proponents of New Experimentalism who have argued, among other things, that experimental practices are efficient in guarding against any epistemological threat posed by theory-ladenness. In this paper I show that one can generate a thesis of theory-ladenness for experimental practices from an influential New Experimentalist (...) account. The notion I introduce for this purpose is the concept of ‘theory-driven data reliability judgments’, according to which theories which are sought to be tested with a particular set of data guide reliability judgments about those very same data. I provide various prominent historical examples to show that TDRs are used by scientists to resolve data conflicts. I argue that the rationality of the practices which employ TDRs can be saved if the independent support of the theories driving TDRs is construed in a particular way. (shrink)

I propose that empirical procedures, like computational procedures, are justified in terms of truth-finding efficiency. I contrast the idea with more standard philosophies of science and illustrate it by deriving Ockham's razor from the aim of minimizing dramatic changes of opinion en route to the truth.

This paper is motivated by the increasing popularity of efficient designs for stated choice experiments. The objective in efficient designs is to create a stated choice experiment that minimizes the standard errors of the estimated parameters. In order to do so, such designs require specifying prior values for the parameters to be estimated. While there is significant literature demonstrating the efficiency improvements of employing efficient designs, the bulk of the literature tests conditions where the priors used to generate the (...) efficient design are assumed to be accurate. However, there is substantially less literature that compares how different design types perform under varying degree of error of the prior. The literature that does exist assumes small fractions are used, which is in contrast to computer-aided surveys that readily allow for large fractions. Further, the results in the literature are abstract in that there is no reference point to provide clear insight on the magnitude of any issue. Our objective is to analyze the robustness of different designs within a typical stated choice experiment context of a trade-off between price and quality. We use as an example transportation mode choice, where the key parameter to estimate is the value of time. Within this context, we test many designs to examine how robust efficient designs are against a misspecification of the prior parameters. The simple mode choice setting allows for insightful visualizations of the designs themselves and also an interpretable reference point for the range in which each design is robust. Not surprisingly, the D-efficient design is most efficient in the region where the true population VOT is near the prior used to generate the design: the prior is $20/h and the efficient range is $10–$30/h. However, the D-efficient design quickly becomes the most inefficient outside of this range, and the estimation significantly degrades above $50/h. The orthogonal and random designs are robust for a much larger range of VOT. The robustness of Bayesian efficient designs varies depending on the variance that the prior assumes. Implementing two-stage designs that first use a small sample to estimate priors are also not robust relative to uninformative designs. Arguably, the random design performs as well as any design, and it will perform even better if data cleaning is done to remove choice tasks where one alternative dominates the other. (shrink)

In the vernacular, ‘efficiency’ typically concerns means. I can choose efficient rather than inefficient means to accomplish my ends. Or more generally, I can be efficient or inefficient in allocating my limited resources. If we could measure the aggregate utility or welfare of a society, as in Benthamite utilitarianism, we could say that a society is efficient in an analogous sense: it uses effective institutions to achieve the greatest possible welfare. But the normative notion of efficiency commonly in (...) use in social and political theory today is about social choices without aggregative welfare measures. Outbreaks of foodborne illness have received increasing attention in recent years, resulting in a growing awareness of the negative impacts associated with industrial food production. These trends indicate a need to examine systemic causes of outbreaks and how they are being addressed. In this paper, we analyze outbreaks linked to ground beef and salad greens. These (...) case studies are informed by personal interviews, site visits, and an extensive review of government documents and peer-reviewed literature. To explore these cases, we draw from actor-network theory and political economy to analyze the relationships between technological tools, the design of industrial production systems, and the emergence and spread of pathogenic bacteria. We also examine if current responses to outbreaks represent reflexive change. Lastly, we use the myth of Prometheus to discuss ethical issues regarding the use of technology in food production. Our findings indicate that current tools and systems were designed with a narrow focus on economic efficiency, while overlooking relationships with pathogenic bacteria and negative social impacts. In addition, we find that current responses to outbreaks do not represent reflexive change and a continued reliance on technological fixes to systemic problems may result in greater problems in the future. We argue that much can be learned from the myth of Prometheus. In particular, justice and reverence need to play a more significant role in guiding production decisions. (shrink)

Many theories about the teaching of logic and critical thinking take for granted that theoretical learning, the learning of formal rules for example, and its practical application are sufficient to master the tools taught and to take the habit of using them. However, this way of teaching is not efficient, a conclusion supported by much work in cognitive science. Approaching cognition evolutionarily with dual-process theories allows for an explanation of these insufficiencies and offers clues on how we could teach critical (...) thinking and logic more efficiently. In this article, we want to present this approach and explore these leads in order to make some pedagogical recommendations and lay the foundations of a framework. We will put forward an example of the application of this research program with philosophy for children. (shrink)

Does the seller of a house have to tell the buyer that the water is turned off twelve hours a day? Does the buyer of a great quantity of tobacco have to inform the seller that the military blockade of the local port, which had depressed tobacco sales and lowered prices, is about to end? Courts say yes in the first case, no in the second. How can we understand the difference in judgments? And what does it say about whether (...) the psychiatrist should disclose to his patient's girlfriend that the patient wants to kill her? Kim Lane Scheppele answers the question, Which secrets are legal secrets and what makes them so? She challenges the economic theory of law, which argues that judges decide cases in ways that maximize efficiency, and she shows that judges use equality as an important principle in their decisions. In the course of thinking about secrets, Scheppele also explores broader questions about judicial reasoning--how judges find meaning in legal texts and how they infuse every fact summary with the values of their legal culture. Finally, the specific insights about secrecy are shown to be consistent with a general moral theory of law that indicates what the content of law should be if the law is to be legitimate, a theory that sees legal justification as the opportunity to attract consent. This is more than a book about secrets. It is also a book about the limits of an economic view of law. Ultimately, it is a work in constructive legal theory, one that draws on moral philosophy, sociology, economics, and political theory to develop a new view of legal interpretation and legal morality. Workplace inspections are undertaken because they are believed to lead to better conditions In the workplace. It is therefore essential to know if inspections have the desired effects on working conditions. We introduce a theoretical framework for the evaluation of workplace inspections with respect to their effects on working conditions. Criteria of efficiency and priority-setting are discussed. Some empirical results concerning priority-setting in Swedish inspection agencies are presented. Further, we argue that in order to obtain reliable information about the (...) effects of different inspection methods, it is necessary to perform controlled comparative studies in which different methods are used in different workplaces. Given the facility with which such studies can be performed, it is surprising how few such studies have been made. We conclude by surveying some empirical studies that concern the issue of efficient inspections. (shrink)

We consider situations of multiple referendum: finitely many yes-or-no issues have to be socially assessed from a set of approval ballots, where voters approve as many issues as they want. Each approval ballot is extended to a complete preorder over the set of outcomes by means of a preference extension. We characterize, under a mild richness condition, the largest domain of top-consistent and separable preference extensions for which issue-wise majority voting is Pareto efficient, i.e., always yields out a Pareto-optimal outcome. (...) Top-consistency means that voters’ ballots are their unique most preferred outcome. It appears that the size of this domain becomes negligible relative to the size of the full domain as the number of issues increases. (shrink)

The concentration of high-frequency controls in a limited period of time constitutes an important feature of many law-enforcement policies around the world. In this paper, we offer a comprehensive investigation on the relative efficiency and effectiveness of various crackdown policies using a lab-in-the-field experiment with real passengers of a public transport service. We introduce a novel game, the daily public transportation game, where subjects have to decide, over many periods, whether to buy or not a ticket knowing that there (...) might be a control. Our results show that concentrated crackdowns are less effective and efficient than random controls; prolonged crackdowns reduce fare-dodging during the period of intense monitoring but induce a burst of fraud as soon as they are withdrawn; pre-announced controls induce more fraud in the periods without control. Overall, we also observe that real fare-dodgers fraud more in the experiment than non-fare-dodgers. (shrink)

Finding out why we have beliefs and desires is important for a thorough understanding of the nature of our minds (and those of other animals). It is therefore unsurprising that several accounts have been presented that are meant to answer this question. At least in the philosophical literature, the most widely accepted of these are due to Kim Sterelny and Peter Godfrey-Smith, who argue that beliefs and desires evolved due to their enabling us to be behaviourally flexible in a way (...) that reflexes do not—which, they claim, is beneficial in epistemically complex environments. However, as I try to make clear in this paper, upon closer consideration, this kind of account turns out to be theoretically implausible. In the main, this is because it fails to give due credit to the powers of reflex-driven organisms, which can in fact be just as flexible in their behaviour as ones that are belief/desire-driven. In order to improve on this account, I therefore propose that beliefs and desires evolved, not due to their enabling us to do something completely different from what reflexive organisms can do, but rather due to their enabling us to do the same things better. Specifically, I argue that beliefs and desires evolved for making the generation of behaviour more efficient, since they can simplify the necessary cognitive labour considerably. This paper offers the concept of “justice failure,” as a counterpart to the familiar idea of market failure, in order to better understand managers’ ethical obligations. This paper takes the “market failures approach” to business ethics as its point of departure. The success of the MFA, I argue, lies in its close proximity with economic theory, particularly in the idea that, within a larger scheme of social cooperation, markets ought to pursue efficiency and leave the pursuit of equality (...) to the welfare state. As a result, the core ethical responsibility of business actors is to avoid profiting off of market failure. After reviewing this approach I challenge its emphasis on efficiency. I argue that just as we note the suboptimal efficiency of actual markets, we should also take seriously the suboptimal equality of actual welfare states. Taking this idea seriously results in a whole other set of ethical responsibilities for businesses to take into account; in addition to market imperfections and regulatory lacunae, managers should also avoid profiting from, and exacerbating, structural inequalities and injustices. I offer an outline of the kinds of injustices and inequalities that would have bearing on business ethics, and the kinds of ethical responsibilities that this approach suggests that business actors should take into account. In this paper I shall attempt to locate and articulate Aristotle's answer to a foundational question in the theory of action - viz., 'what is the proximate (efficient) cause of action?' This task is certainly of historical importance, since one cannot hope to understand Aristotle's interesting and influential theory of action without understanding his views on the proximate efficient cause of action. But the present project is not, I should think, of historical interest alone; for it has recently (...) been argued by a leading figure in the study of action, Myles Brand, that What [proximately] initiates action?' is the fundamental question in action theory, 1 and we shall see that Aristotle has the makings of a very plausible answer.
