Caring for unrepresented patients encompasses legal, ethical, and moral challenges regarding decision-making, consent, the patient’s values, wishes, best interest, and the healthcare team’s professional integrity and autonomy. In this article, I consider the impact of the aging population and the effects of the social determinants of health and suggest that without preventive intervention, the number of unrepresented patients will continue to increase. The health, social, and legal risk factors for becoming unrepresented require a multidisciplinary response. Medical-Legal Partnerships (MLPs) bring healthcare (...) and legal professionals together to address risk factors and health-harming legal needs. The article discusses the role of MLPs in identifying at-risk individuals, providing preventive interventions, and providing support. I make recommendations and conclude that proactive MLPs offer a sustainable approach to the ethical challenges in caring for unrepresented patients by providing interventions to prevent individuals from becoming unrepresented. In recounting some of the key sociological insights offered by over 30 years of research on emotion management, or emotion regulation, we orient our discussion around sociological answers to the following questions: What is emotion management? How does emotion management occur? Why does it occur? And what are its consequences or benefits? In this review, we argue that emotion and its management are profoundly social. Through daily interactions with others, individuals learn to differentiate which emotions are appropriate when, as well (...) as the most effective ways to bring their feelings in line with culturally agreed-upon emotion norms. Emotion management is also functional, not only for the individuals who perform it, but also for the dyads, groups, institutions, and societies in which they are embedded. The social processes through which individuals learn to display culturally appropriate emotions have important implications on many levels, from interpersonal interactions to the development of social movements. Florida is currently collecting data on the “costs of uncompensated care for aliens who are not lawfully present in the U.S.” (Statutes of Florida, 2023). The Florida data collection law, enacted in 2023, is part of aggressive anti-immigrant legislation. Hospitals accepting Medicaid must inquire about patients’ immigration status and submit de-identified reports. In August 2024, the Governor of Texas signed an Executive Order comparable to the Florida statute. Although presented as a data-collection measure, the legal requirements have far-reaching consequences. The (...) potential adverse impacts on immigrants’ health pose bioethical concerns. Immigration-related inquiries create barriers to healthcare access and advance care planning, exacerbating healthcare disparities and presenting ethical concerns. This article examines the effects on immigrants and the resulting ethical challenges, including respect for persons, beneficence, non-maleficence, and justice. The article proposes recommendations for mitigating these challenges, including community outreach, patient education, policy development, in-service education, and advocacy. While the legal requirements apply specifically to Florida and Texas, the ethical issues have nationwide relevance. (shrink)

Theorising about politics and society has never had firm and settled boundaries. In the past, political theorists have sometimes been moralists, sometimes moral philosophers; now apologists for the existing order, now social engineers; they have tried both to explain society and to discuss social values; and their explanations have been variously based on empirical generalisations, a priori assumptions about human nature or general metaphysical theories. This study aimed to identify the antibiotic-relevant lessons from the controlled drug regimen for narcotics. Whereas several elements of the United Nations Single Convention on Narcotic Drugs could be advantageous for antibiotics, we doubt that an international legally binding agreement for controlling antibiotic consumption would be any more effective than implementing stewardship measures through national AMR plans.

Historically, the sociology of emotion has been relatively long on theory and short on methods. This collection of articles seeks to remedy this by introducing new ways to capture the four factors of emotion, as articulated by Thoits (1989): meaning, expression, label, and physiology. As a group, these studies reify existing dichotomies in the literature—that is, emotional experience versus emotional expression—and seek to reconcile them. Additionally, they all champion the use of mixed methods—either simultaneously or sequentially—adopting some combination of direct (...) or indirect observation, subjective understanding/experience, and physiological change. Using examples drawn for their own research, the authors provide new ways to capture emotion that will carry emotion scholars into the next four decades of research. (shrink)

Most developed nations have a statutory minimum wage set at levels insufficient to alleviate poverty. Increased calls for a living wage have generated considerable public controversy. This article draws on 25 interviews and four focus groups with employers, low-pay industry representatives, representatives of chambers of commerce, pay consultants, and unions. The core focus is on how participants use prominent narrative tropes for the living wage and against the living wage to argue their respective perspectives. City Living is about urban spaces, urban dwellers, and how these spaces and people make, shape, and change one another. More people live in cities than ever before: more than 50% of the earth's people are urban dwellers. As downtown cores gentrify and globalize, they are becoming more diverse than ever, along lines of race, ethnicity, socioeconomic class, sexuality, and age. Meanwhile, we are in the early stages of what seems sure to be a period of intense civil unrest. (...) During such periods, cities generally become the primary sites where tensions and resistance are concentrated, negotiated, and performed. For all of these reasons, understanding cities and contemporary city living is pressing and exciting from almost any disciplinary and political perspective. Quill R Kukla offers the first systematic philosophical investigation of the nature of city life and city dwellers. The book draws on empirical and ethnographic work in geography, anthropology, urban planning, and several other disciplines in order to explore the impact that cities have on their dwellers and that dwellers have on their cities. It begins with a philosophical exploration of spatially embodied agency and of the specific forms of agency and spatiality that are distinctive of urban life. It explores how gentrification is enacted and experienced at the level of embodied agency, arguing that gentrifying spaces are contested territories that shape and are shaped by their dwellers. The book then moves to an exploration of repurposed cities, which are cities materially designed to support one sociopolitical order, but in which that order collapsed, leaving new dwellers to use the space in new ways. Through detailed original ethnography of the repurposed cities of Berlin and Johannesburg, Kukla makes the case that in repurposed cities, we can see vividly how material spaces shape and constrain the agency and experience of dwellers, while dwellers creatively shape the spaces they inhabit in accordance with their needs. The book concludes with a reconsideration of the right to the city, asking what would be involved in creating a city that enabled the agency and flourishing of all its diverse inhabitants. (shrink)

Situated approaches to affectivity overcome an outdated individualistic perspective on emotions by emphasizing the role embodiment and environment play in affective dynamics. Yet, accounts which provide the conceptual toolbox for analyses in the philosophy of emotions do not go far enough. Their focus falls (a) on the present situation, abstracting from the broader historico-cultural context, and (b) on adopting a largely functionalist approach by conceiving of emotions and the environment as resources to be regulated or scaffolds to be used. In (...) this paper, I argue that we need totake situatedness seriously: We need (a) to acknowledge that emotions are not situated in undetermined “contexts” but in concrete socio-culturally specific practices referring to forms of living; and (b) to agree that not only are context and emotionsusedfor the sake of something else but also that the meaning-disclosive dimension of affective intentionality is structured by situatedness as well. To do so, I offer a multidimensional approach to situatedness that integrates the biographical and cultural dimensions of contextualization within the analysis of situated affective dynamics. This approach suggests that humans affectively disclose meaning (together) which is at once product and producer of specific forms of living – and these are always already subjects of (politically relevant) critique. Meaning has traditionally been regarded as a problem for philosophers and psychologists. Advances in cognitive science since the early 1960s, however, broadened discussions of meaning, or more technically, the semantics of perceptions, representations, and/or actions, into biology and computer science. Here, we review the notion of “meaning” as it applies to living systems, and argue that the question of how living systems create meaning unifies the biological and cognitive sciences across both organizational and temporal scales.

New and complex technologies are exceedingly present and in widespread use in contemporary cities globally. The urban lifeworld is saturated with various applications of information and computing technologies, but also more rudimentary forms of technology construct and create the urban everyday life as we know it. Many forms of urban technologies are perceived first through their everyday aesthetic qualities: how they look, feel, sound, or are otherwise encountered within the streetscape. Philosophical aesthetics, however, has tended to overlook everyday technologies as (...) a topic, often due to unquestioned ideas of how a city should ideally look and feel. Thus, a more realistic approach to contemporary cities is needed, in which the deep-seated role of technologies is recognized and the experiences related to their entangled uses become acknowledged. In this article an epistemological framework is proposed in order to integrate the emergentist thought with systemic studies on biological autonomy, which are focused on the role of organization. Particular attention will be paid to the role of the observer’s activity, especially: (a) the different operations he performs in order to identify the pertinent elements at each descriptive level, and (b) the relationships between the different models he builds from them. According to the approach sustained here, organization will be considered (...) as the result of a specific operation of identification of the relational properties of the functional components of a system, which do not necessarily coincide with the intrinsic properties of its structural constituents. Also, an epistemological notion of emergence—that of “complex emergence”—will be introduced, which can be defined as the insufficiency, even in principle, of a single descriptive modality to provide a complete description of certain classes of systems. This integrative framework will allow us to deal with two issues in biological and emergentist studies: (1) distinguishing the autonomy proper of living systems from some physical processes like those of structural stability and pattern generation, and (2) reconsidering the notion of downward causation not as a direct or indirect influence of the whole on its parts, but instead as an epistemological problem of interaction between descriptive domains in which the concept of organization proposed and the observational operations related to it play a crucial role. If the problem of the origin of life is conceptualized as a process of emergence of biochemistry from proto-biochemistry, which in turn emerged from the organic chemistry and geochemistry of primitive earth, then the resources of the new sciences of complex systems dynamics can provide a more robust conceptual framework within which to explore the possible pathways of chemical complexification leading to living systems and biosemiosis. In such a view the emergence of life, and concomitantly of natural selection and (...) biosemiosis, is the result of deep natural laws (the outlines of which we are only beginning to perceive) and reflects a degree of holism in those systems that led to life. This study investigates the role of perceived power relation between target and perpetrator regarding victimization and turnover intent following exposure to bullying behavior at the workplace. We hypothesized that targets of bullying behavior who self-label as victims experiences a larger power imbalance with the perpetrator compared to targets who do not self-label as victims, and that the association between exposure to bullying behavior and intent to leave the job is stronger when there is power balance between target and perpetrator than (...) when there is a power imbalance. The hypotheses were tested in a probability sample of employees working in the child welfare service in Oslo municipality, Norway, and that had been exposed to at least one instance of mistreatment from a colleague at their workplace. Targets of bullying behavior whom self-labeled as victims reported a larger power imbalance with the perpetrator. Supporting the study hypothesis, and representing a reverse buffering effect, exposure to bullying behavior was most strongly associated with intent to leave among targets in power balance with the perpetrator. For targets in a perceived power imbalance, both low and high exposure to bullying behavior were associated with higher levels of intent to leave. These findings highlight the importance of implementing measures directed at preventing bullying and other forms of mistreatment, irrespective of the power relation between the two parties. (shrink)

The dead donor rule (DDR) regulates current practice for vital organ donation, which means that organs may only be retrieved from people who are already dead (or brain dead). However, several authors criticize the DDR and argue that we should instead adopt a rule that allows us to retrieve vital organs before people are dead. They call this proposal organ donation euthanasia (ODE). While I am sympathetic to this proposal I do not think it goes far enough. In this paper, (...) I show that the key reasons put forward in favor of permitting ODE actually justify a more far‐reaching suggestion for regulation, permitting people to become living vital organ donors even when they are not about to die for other reasons. Further, I argue that only accepting imminently dying people as eligible donors for living vital organ donation would be objectionably paternalistic. (shrink)

For the majority of scholars concerned with the ethics of living organ donation, inflicting moderate harms on competent volunteers in order to save the lives or increase the life chances of others is held to be justifiable provided certain conditions are met. These conditions tend to include one, or more commonly, some combination of the following: The living donor provides valid consent to donation. Living donation produces an overall positive balance of harm–benefit for donors and recipients which (...) cannot be obtained in a less harmful manner. Donation is not liable to cause significant and long-term morbidity to, or the death of, the donor. This paper critically examines the suggestion that these criteria are not sufficient to offer a general account of justified living organ donation in the context of competent volunteers and that key to justified living organ donation is that donors receive sufficient benefits from their donation that these outweigh the harms they suffer. However, although this view—termed here ‘The Donor Benefit Standard’—directs welcome attention to the many and complex motives which may underlie living organ donation, this paper ultimately concludes that given the threats this position poses to individual autonomy and the lives of those in need of organ transplants ‘The Donor Benefit Standard’ should ultimately be rejected. This Article examines the different meanings of Ehrlich’s idea of living law in relation to current debates about legal pluralism. It distinguishes three aspects of Ehrlich’s concept as these have been elaborated in the later literature: "law beyond the law," "law without the state," and "order without law." This retrospective shows that Ehrlich was not principally concerned with defending the rights of ethnic or autonomous communities as such. In taking his work further, it is important to recognize to what (...) extent official and unofficial law are even more interdependent today than in his day. The account of the best life for humans - i.e. a happy or flourishing life - and what it might consist of was the central theme of ancient ethics. But what does it take to have a life that, if not happy, is at least worth living, compared with being dead or never having come into life? This question was also much discussed in antiquity, and David Machek's book reconstructs, for the first time, philosophical engagements with the question from (...) Socrates to Plotinus. Machek's comprehensive book explores ancient views on a life worth living against a background of the pessimistic outlook on the human condition which was adopted by the Greek poets, and also shows the continuities and contrasts between the ancient perspective and modern philosophical debates about biomedical ethics and the ethics of procreation. This essay explores the life and teachings of Herbert Sutcliffe, a religious leader born in England and educated in Australia, where he earned a doctorate in psychology, and the United States, where he earned a doctorate of divinity from a New Thought seminary. Combining the two, he founded schools of Radiant Living in the United States, Canada, the United Kingdom, Australia, New Zealand, and Hong Kong, in that order. While he did not write a utopia or found an intentional (...) community, he was deeply involved in utopian movements in New Zealand, where some of his followers still live, and taught a form of self-help that he believed, if spread widely enough, would transform the world. Living labs are interdisciplinary and participatory initiatives aimed at bringing research closer to practice by involving stakeholders in all stages of research. Living labs align with the principles of participatory research methods as well as recent insights about how participatory ways of generating knowledge help to change practices in concrete settings with respect to specific problems. The participatory, open, and discussion‐oriented nature of living labs could be ideally suited to accompany ethical reflection and changes ensuing from reflection. (...) To our knowledge, living labs have not been explicitly trialed and reported in ethics literature. In this discussion paper, we report and discuss four initial issues that marked the process of setting up a living lab in ethics: (1) determining the goals and expected outcomes of an ethics living lab; (2) establishing operational procedures; (3) selecting communities and defining pilot projects; and (4) adopting a lens to tackle emerging questions and challenges. We explain these four issues and present the paths taken based on the novel and specific orientation, that is, living ethics, at the basis of this project. In alignment with living ethics and É‐LABO, we approach challenges as learning opportunities to ask not only “how” questions but also “why” questions. We hope that this discussion paper informed by our experience helps to clarify the theoretical, methodological, and practical approaches necessary to successfully adopt and employ living labs in ethics.
