The paper identifies and assesses the implications of two approaches to the field of artificial intelligence and legal reasoning. The first — pragmatism — concentrates on the development of working systems to the exclusion of theoretical problems. The second — purism — focuses on the nature of the law and of intelligence with no regard for the delivery of commercially viable systems. Past work in AI and law is classified in terms of this division. By reference to The Latent (...) Damage System, an operational system, the paper articulates and responds to conceivable purist (jurisprudential and AI) objections to such a program. The methods of the pragmatist are also called into question and refined. The author concludes that pragmatism within a purist framework is the only sound approach to developing reliable AI systems in law. (shrink)

The pragmatist epistemologist is supposed to defend the idea that there is no pure epistemic activity and, thereby, that the way we form our beliefs does not have to be assessed according to aims, or norms that rest on the illusory denial of the pragmatic encroachment of any inquiry. According to the pragmatist, the kind of epistemic purism that is widely endorsed in contemporary epistemology has in fact no other raison d’être than the doxastic puritanism that appears in W. (...) K. Clifford’s ethical principle. But a belief being defective has in fact nothing to do neither with the kind of practical factors that pragmatism so conceived, considers as relevant nor with the rules or values that epistemic puritanism reveres. Between believing that P and believing that E establishes that P, there is no such thing as the distance there is between practical reasons to φ and φ-ing. The position I defend is closer to Peirce’s pragmatism than to any other pragmatist approach. Among other things, it explains why C. S. Peirce’s thesis that: 1) The “real man of science” does not give any weight to practical stakes in his inquiries not only goes hand in hand with the thesis that 2) He never believes of any hypothesis that it is true, but also with the thesis that 3) The inquiry to which such a man devotes is infinite. Peirce is right from an epistemic point of view to praise men, whose life is devoted to the disinterested search for truth. (shrink)

Intellectualists disagree with anti-intellectualists about the relationship between knowledge and truth. According to intellectualists, this relationship is intimate. Knowledge entails true belief, and in fact everything required for knowledge is somehow relevant to the probability that the belief in question is true. According to anti-intellectualists, this relationship isn’t intimate. Or, at least, it’s not as intimate as intellectualists think. Factors that aren’t in any way relevant to the probability that a belief is true can make a difference to whether it (...) counts as knowledge. In this paper, I give a new argument for anti-intellectualism and draw out consequences of this argument for the pragmatic encroachment debate. The standard purist objection to pragmatism is that pragmatism entails anti-intellectualism. As I show, anti-intellectualism follows from premises that are plausible even if purism is true, so the standard purist objection to pragmatism fails. (shrink)

Purists think that changes in our practical interests can’t affect what we know unless those changes are truth-relevant with respect to the propositions in question. Impurists disagree. They think changes in our practical interests can affect what we know even if those changes aren’t truth-relevant with respect to the propositions in question. I argue that impurists are right, but for the wrong reasons, since they haven’t appreciated the best argument for their own view. Together with “Minimalism and the Limits of (...) Warranted Assertability Maneuvers,” “The Pragmatic Encroachment Debate,” and “Anti-Intellectualism” (below), this paper constitutes my attempt to refute the entire pragmatic encroachment debate. As I show in this paper, there is an argument for impurism sitting in plain sight that is considerably more plausible than any extant argument for pragmatism. (shrink)

Does knowledge depend in any interesting way on our practical interests? This is the central question in the pragmatic encroachment debate. Pragmatists defend the affirmative answer to this question while purists defend the negative answer. The literature contains two kinds of arguments for pragmatism: principle-based arguments and case-based arguments. Principle-based arguments derive pragmatism from principles that connect knowledge to practical interests. Case-based arguments rely on intuitions about cases that differ with respect to practical interests. I argue that there are insurmountable (...) problems for both kinds of arguments, and that it is therefore unclear what motivates pragmatism. (shrink)

At the centenary of Frank H. Knight’s Risk, Uncertainty, and Profit, we explore the continuing relevance of Knightian uncertainty to the theory and practice of entrepreneurship. There are three challenges facing such assessment. First, RUP is complex and difficult to interpret. The key but neglected element of RUP is that Knight’s account is not solely about risk and uncertainty as states of nature, but about how an agent’s beliefs about uncertain outcomes and confidence in those beliefs guide their choices. Second, (...) RUP is Knight’s only effort in this area. His subsequent career led elsewhere, so he did not engage with subsequent interpretations of this work. Third, much of the current literature emphasizes that decisions must be different under the two states of nature with a consequent misunderstanding of entrepreneurial agency. This paper addresses each challenge in sequence. First, we explicate Knight’s approach and explain why that approach is murky. Second, as a complement to Knight’s interpretation, we examine Frank P. Ramsey’s approach to subjective probabilities to help clarify Knight’s murky approach. What links Knight and Ramsey is a shared pragmatism about entrepreneurial agency under uncertainty that depends upon the beliefs about, and confidence in, their judgments of possible outcomes. This Knight-Ramsey approach does not require actor’s behaviors to be determined by the class of uncertain environment they face. We focus on the response by the entrepreneur to the existence of uncertainty in all its forms. We argue that this reductive account provides a foundation to examine common problems in management, including managerial hubris, the interaction between entrepreneurs and venture capitalists, and the need for experimentation in advance of new product and venture launches. Third, we critique current literature that favors epistemic purism about the ontology of risk and uncertainty and ignores Knight-Ramsey pragmatism in meeting uncertainty, such as using formal and informal institutions for uncertainty mitigation. Our account locates Frank Knight’s subtleties in entrepreneurial behavior firmly in the literature on entrepreneurial agency a century later. (shrink)

Ayalon Eidelstein’s Openness and Faith focuses on the centrality of the idea of openness, or open-mindedness, to the educational sphere. The first half presents the challenges in modern ‘divided-consciousness’ and its consequences of egoism, materialism, and hedonism on the one hand, and religious fanatism on the other. Eidelstein’s main audience is the Israeli secular public, to which he proposes an educational and philosophical middle-way rooted in sincere human and inter-human openness. This openness is inspired by the idea of disinterestedness that (...) Kant articulates in his Critique of Judgment. Eidelstein refers to additional authors, including Franz Rosenzweig and Emmanuel Levinas, to conceptualize the idea of open-mindedness. In the second half of the book, he engages classical American Pragmatism, specifically that of William James, in order to establish the possibility for, and the validity of, a humane open-mindedness. Pragmatism thus paves the way for accepting beliefs that may otherwise be excluded as superstitions and accords them a legitimate and productive role in the life of a modern individual. The difficulty, however, lies in Eidelstein’s employment of Kantian disinterestedness, for it is in fact seriously dissonant with the worthy pragmatic educational purposes that Eidelstein elaborates in the second half of his book. Pragmatism is opposed to disinterestedness in that it stresses the entanglement of fact and value, viewing interests as playing a necessary and productive part in moral motivation and action, while Kantian deontology eliminates consequentialism from the moral scope. While for pragmatists (for example John Dewey’s Democracy and Education) the human creature is holistically conceived, as made of flesh and blood and not only as ‘spirit’, Kant maintained the dualistic Cartesian tradition. This tension calls for a rigorous address. Since Eidelstein’s book is making an important claim about the place open-mindedness has within the Judaism, it must be noted that the disinterestedness of a presumed human ‘self’ is also not easily compatible with the dominant voices in normative Jewish tradition. The Bible does not deal to a large extent with the ‘self’ or with mental intentions, and its conception of the human is not categorically different in the Talmudic corpus. On the contrary, the rabbis frequently endorse pragmatic and ‘external’ reasons, as the motivational basis for action. The kind of purism associated with disinterestedness (as in Mishnah Avot 5:18-19) is barely represented in rabbinic thought. Openness and Faith: In Search of Cultural Education Here and Now is nevertheless an important contribution to the intellectual discourse over the individual and public virtues. In our ever-more segregated and fenced-off world, there is an urgency to delineating the virtue of openness, hoping that Ecclesiastes is right in contending that “No person has power over the spirit [רוח] to retain it” (8:8). But to make Eidelstein’s point about openness in the second half of his book educationally viable, there a need for a pragmatic refinement of the philosophical anthropology in its first half. One way or the other, Openness and Faith is praiseworthy for its articulateness and depth, which invites its readers to an open-minded conversation about the concept of openness. (shrink)

Food sovereignty can be conceptualized as a political proposal for social change in the field of agri-food relations. However, specific strategies of how to achieve this transformative potential are diverse, and context-dependent. The paper explores this diversity by examining discourses on the food sovereignty construction process in Catalonia. Using Q methodology we have explored visions held by individuals participating in the social movement for food sovereignty, identifying five discourses: activism, anti-purism, self-management, pedagogy, and pragmatism. Key strategies of transformation include (...) social mobilization, institutional negotiation, self-management, education to foster value change, and politics of the possible. The relevance assigned to ideological affinity explains different views on the subject of transformation, particularly regarding the involvement of the administration and the productive sector. As regards transformative strategies, discourses assign differing importance to the role of agency for effecting social transformation, which influences their assessment of individual actions as an effective means for social change. Forms of individualized and classic collective action currently coexist within the Catalan agri-food movement, but such diversity is not acknowledged as an effective alliance towards food sovereignty. Moreover, all discourses agree to a dual definition of food sovereignty, both as a process, that is, as democratization of the decision-making process in the agri-food sector, and as a result, that is, establishing an agri-food model alternative to the neo-liberal one. However, the discourses share an unclear view of democracy as decentralized collective decision-making that does not make explicit how this model should be implemented to achieve social control of the agri-food system. In this article I argue that doing the lesser evil in politics is always permitted and even required. I call this view “pragmatism”. I defend it against “purism”, which claims that it is never permissible to do (the lesser) evil. I reject three arguments for purism, which are based on Alan Gewirth’s principle of intervening action, on an alleged epistemic difference between doing and allowing evil, and on rule-consequentialism. I also address Terrance McConnell’s and Thomas Hill Jr.’s attempts (...) to constrain pragmatism by claiming that doing the lesser evil is not always permitted or required. A growing number of contributors to environmental philosophy are beginning to rethink the field’s mission and practice. Noting that the emphasis of protracted conceptual battles over axiology may not get us very far in solving environmental problems, many environmental ethicists have begun to advocate a more pragmatic, pluralistic, and policy-based approach in philosophical discussions abouthuman-nature relationships. In this paper, we argue for the legitimacy of this approach, stressing that public deliberation and debate over alternative environmental ethics is necessary for a (...) culture of democracy to be upheld in decision making and policy formulation. Then we argue for a democratically tempered environmental ethics that is grounded in a practical understanding of the character of moral claims regarding the natural world. We offer the results of an empirical study of environmental ethics held by the public to illustrate the diversity in their moral commitments to nature. Finally, we conclude with a discussion of the implications of this ethical pluralism for policy discussions about the management of American public lands. (shrink)

The renaissance of pragmatism in recent decades has stimulated renewed study of the classical pragmatists. Until this volume, F. C. S. Schiller was the only major pragmatist from the classical era whose significant writings remained uncollected for renewed scholarly study. The forty-two pieces in this collection represent Schiller's finest writings. The debate around ethical consumption is often characterised by discussion of its numerous failures arising from complexity in perceived trade-offs. In response, this paper advances a pragmatist understanding of the role and nature of trade-offs in ethical consumption. In doing so, it draws on the central roles of values and value in consumption and pragmatist philosophical thought, and proposes a critique of the ethical consumer as rational maximiser and the cognitive and utilitarian discourse of individual trade-offs to understand how sustainable (...) consumption practices are established and maintained. An in-depth qualitative study is conducted employing phenomenological interviews and hermeneutic analysis to explore the consumption stories of a group of ethically minded consumers. The research uncovers the location of value within a fluid, yet habitual, plurality of patterns, preferences, morals, identities and relationships. Its contribution is to propose that consumer perception of value in moral judgements is represented by an overall form of aggregate personal advantage, which lacks conscious reflection and delivers a phenomenological form of value rooted in habits, reflecting a pragmatist representation of value unified as a ‘consummatory experience’. Transgender individuals and families throw existing taxonomic classification systems of identity into perplexing disarray, illuminating sociolegal dilemmas long overdue for critical sociological inquiry. Using interview data collected from 50 cisgender women from across the United States and Canada, who detail 61 unique partnerships with transgender and transsexual men, this work considers the pragmatic choices and choice-making capacities of this social group as embedded within social systems, structures, and institutions. Proposing the analytic constructs of “normative resistance” and “inventive pragmatism” to situate (...) the interactional processes between agency and structure in the everyday lives of this understudied group of cisgender women, this work theorizes the liminal sociolegal status of an understudied family form. In so doing, it exposes the increasingly paradoxical consolidation and destabilization of sociolegal notions of identity, marriage, normativity, and parenthood—challenging, contributing to, and extending current theoretical and empirical understandings of agency and structure in twenty-first-century families. In this article, Bianca Thoilliez draws on pragmatist notions of fallibilism and pluralism to develop proposals for possible educational interventions to address the problem of “post-truth” conditions. Post-truth, she contends, is not only a political danger for liberal democracies, but it also poses a serious threat of extinction for our educational practices. With the help of some of Bruno Latour's and Danna Haraway's categories, and with the narrative intervention of Gerald Durrell's My Family and Other Animals, Thoilliez attempts to adapt (...) both Charles Peirce's and William James's classic pragmatist ideas in order to experiment with new horizons of thought capable of overcoming the exhausted pedagogical divides of docility/indocility, conserve/discard, and optimism/pessimism that often seem woven into the definition of educational relationships, the establishment of curriculum content, and the orientation of pedagogical actions. As an alternative, she recommends building communitarian alliances of fallibilistic inquiry and promoting practices of pluralistic cultural provision as more useful educational ends-in-view that embody a down-to-earth pedagogy capable of reinstating trust, taking care of truths, looking for ways of keeping our lives together, and making education possible again. Thus, here Thoilliez proposes a pedagogy that neither fixes nor evades our troubles, but one that stays with them. (shrink)

At the core of pragmatism is the idea of an active projection of experience into the future. William James’s contribution to pragmatism included an emphasis on emotions in the apprehension of possible futures and related processes. After presenting a summary of Jamesian pragmatism, and especially the significance of emotions in it, the article notes the reception of James’s writings in Europe and their influence on European intellectual developments. Max Weber, for instance, studied James closely. He treated James’s approach to religion (...) as a negative example. While Emile Durkheim rejected the individualist approach of James, he nevertheless found much of value in James’s conceptualization of religious experience, including its emotional underpinnings. Discussion below explores the neglected Jamesian quality of Durkheim’s account of religion. It is noted in conclusion that the more recent sociological neglect of James and the failure to appreciate his particular approach in pragmatism, coincided with the rise of Freudian psychology in the early decades of the twentieth century. I want to begin by thanking Judith Green for organizing this symposium, and all the contributors for their thoughtful attention to my work.Pragmatism is currently undergoing an apparent revival, with a number of philosophers not normally associated with the movement claiming to have joined the club: following the lead of Dick Rorty, Isaac Levi, and Hilary Putnam, Robert Brandom and Huw Price have also declared their pragmatist allegiance. I, too, have signed on. But, as Seth Joshua Thomas astutely notes in (...) his essay, should those who have labored long and hard during times when the writings of Peirce, James, and Dewey were neglected (and often brusquely dismissed) take these self-ascriptions seriously? In this essay, Stefano Oliverio engages with the question of how to think about education in times of climate change and the “intrusion of Gaia” by establishing a dialogue between Bruno Latour's political ecology and John Dewey's appeal to the need to bring a genuine Copernican revolution to fruition. Oliverio argues that the panoply of conceptual tools Dewey fashioned by recognizing the influence of Darwin on philosophy not only maintains its topicality but can be fruitfully deployed to make sense of (...) our contemporary condition and to frame an earthbound education. On the other hand, the encounter with the views of contemporary thinkers reflecting on the New Climate Regime and the endeavors it invokes may help us to recontextualize the Deweyan heritage in order to “face Gaia.” In this horizon, the idea of the school as a site of collective inquiry is acclimatized to the new existential situation, and its significance in promoting an art of the learning of attention to contrast the contemporary negligence and risk of barbarism is vindicated. In this paper we claim that pragmatist philosophical practice is incompatible with scientistic philosophy. The kind of pragmatism used for making this case follows the spirit and method of philosophical pragmatists such as William James, John Dewey, Richard Rorty, and a related pragmatic tradition, Confucian Philosophy. Pragmatism starts from immediate experience, and refuses to cleave off the reality and salience of what is found in such experience in the process of thinking. Pragmatism also concerns itself with social problems, broadly conceived. (...) In contrast to this focus on immediate experience, the influence of science in much philosophizing involves a kind of scientism through which the relevance, value, and even reality of experience is brought into question. It also concerns itself with a narrowly defined set of so-called philosophical problems. In this regard, pragmatist philosophical practice is fundamentally opposed to scientistic philosophical practice. We will start by modelling the kind of philosophical practice that stems from pragmatism, and the role of immediate experience in it. Subsequently, we will introduce two modes of philosophizing that diminish if not negate the role of experience. One is bald naturalist philosophizing, and the other is a priori scientific philosophizing. In the last section, we will show how main commitments of both of these traditions are incompatible with a pragmatist philosophy that remains committed to the original impulse of pragmatism. My aim in this paper is to explore an affinity between early critical theory and analytical philosophy. The affinity is in a fairly unexpected area: philosophy of science. I argue that early critical theory embraces a view of science which is a natural if somewhat unfamiliar extension of the pragmatist one defended by Quine. In particular, I argue that Horkheimer has a version of the Quine-Duhem thesis (“underdetermination of theory choice by the evidence”). How do the Frankfurt and analytical versions (...) of the underdetermination thesis differ? Quine and others have taken the thesis to motivate a form of pragmatism. What this means is that it is certain interests that ultimately determine the choice of theory: chief among them, an interest in simplicity of our theories. However, the Critical Theorists offer us a distinctly historical materialist version of the underdetermination thesis, in which it is the imperatives of the prevailing mode of production, for example, capitalism, which are decisive. The result is an unfamiliar Marxist version of an otherwise familiar thesis from the analytic tradition. (shrink)

Theorizing about perception is often motivated by a belief that without a way of ensuring that our perceptual experience correctly reflects the external world we cannot be sure that we perceive the world at all. Historically, coming up with a way of securing such epistemic contact has been a foundational issue in psychology. Recent ecological and enactive approaches challenge the requirement for perception to attain epistemic contact. This article aims to explicate this pragmatic starting point and the new direction of (...) inquiry that this opens up for psychology. It does so by detailing the development of James J. Gibson’s ecological psychology. Securing epistemic contact has been a leitmotiv in Gibson’s early work, but subsequent developments in Gibson’s works can teach us what it takes to adopt a pragmatic approach to psychology. We propose a reading of the developments in Gibson’s original works that shows that, since perception is a mode of acting, perception aims for pragmatic contact before allowing for epistemic contact. Amplifying these pragmatist lines of thought in Gibson’s works we end by considering situations where an individual is adapted to the intricacies of specific social practices. These situations show how pragmatic contact can also afford attaining epistemic contact. (shrink)

When Richard Rorty passed away in June of 2007, we lost a philosopher who contributed to a major number of philosophical currents, a thinker who, with his writing, managed to be at a height of an epoch. This interview was conducted during the year 2005–2006, and it has not been published in English. I publish it now as a way of honoring one of the most interesting philosophers of recent years.

In _Couplets_, Brian Massumi presents twenty-four essays that represent the full spectrum of his work during the past thirty years. Conceived as a companion volume to _Parables for the Virtual_, _Couplets_ addresses the key concepts of _Parables_ from different angles and contextualizes them, allowing their stakes to be more fully felt. Rather than organizing the essays chronologically or by topic, Massumi pairs them into couplets to encourage readers to make connections across conventional subject matter categories, to encounter disjunctions, and to (...) link different phases in the evolution of his work. In his analyses of topics ranging from art, affect, and architecture to media theory, political theory, and the philosophy of experience, Massumi charts a field on which a family of conceptual problems plays out in ways that bear on the potentials for acting and perceiving the world. As an essential guide to Massumi's oeuvre, _Couplets_ is both a primer for his new readers and a supplemental resource for those already engaged with his thought. (shrink)

Ernst Mach’s positivism, it is argued in this paper, may be regarded as a version of pragmatist philosophy of science. Already James’s biographer Perry detected such tendencies in Mach and this is confirmed here by close attention to Mach’s early works, esp. History and Root of the Principle of the Conservation of Energy and The Science of Mechanics. Both Mach’s principle of the economy of thought and his principle of scientific significance are shown to bear out his pragmatism. A similar (...) conclusion is shown to hold for the philosophy of Wilhelm Jerusalem already long before he became the translator of James’s Pragmatism into German. But while Jerusalem early on relied perhaps even more than Mach on evolutionary theory for promptings of pragmatist insights, he soon too linked them, as Mach had all along, to broadly sociological observations concerning the condition of human cognition. Sayyid Qutb and Fethullah Gülen are two of the most important Muslim leaders and intellectuals of the twentieth century: the two are similar not only for their focus on the relationship between Islam and politics, but also for their lifelong commitments to education. For both Qutb and Gülen, schools were a means through which society itself could be made more just and, ultimately, more Islamic, and for both, their philosophy of education and broader political projects were at once pragmatic and (...) implicitly and explicitly for Qutb contrasted with American pragmatism. Their differing pedagogies are illustrative of their larger visions: for Qutb, Muslim education must be a “total world” in which Islam is protected from secular contagion, while for Gülen, Muslim education can move more slowly through largely secular means. For Gülen, Islam can work outside of and within a secular system; for Qutb, the system must be changed. (shrink)
