To look into the darkness of the human soul is a frightening venture. Here Mary Midgley does so, with her customary brilliance and clarity. Midgley's analysis proves that the capacity for real wickedness is an inevitable part of human nature. This is not however a blanket acceptance of evil. Out of this dark journey she returns with an offering to us: an understanding of human nature that enhances our very humanity.

In diesem Beitrag werde ich die Wege untersuchen, auf denen Moraltheoretiker philosophischen Sinn in der These entdecken könnten, daß das Gesetz die moralische Schlechtigkeit von Personen dadurch tolerieren sollte, daß es den Bürgern Rechte zuerkennt, moralisch Falsches zu tun. Dabei vernachlässige ich Fälle, in denen diese Toleranz deshalb angemessen erscheint, weil die Moralität des in Rede stehenden Verhaltens ungewiss oder jedenfalls unter gleichermaßen vernünftigen Personen hinreichend umstritten ist, so daß die Gewährung von Freiheit auch für den Staat als das angemessene (...) Mittel erscheint, die Problematik zu lösen. Stattdessen werde ich mich auf Fälle konzentrieren, in denen der Gesetzgeber davon überzeugt ist, daß das betreffende Verhalten tadelnswert ist, so daß weder Zweifel noch Uneinigkeit über die Bewertung des Verhaltens als ausreichende Gründe dafür genannt werden können, daß der Staat sich der Sache nicht annimmt.Wie ich im 1. Kann ein Konsequentialist sich damit einverstanden erklären, daß der Staat Personen die Freiheit zugesteht, etwas zu tun, was konsequentialistisch verboten ist? Kann ein Deontologe nicht nur die Freiheit, Erlaubnisse zu missbrauchen, verteidigen, sondern auch die Freiheit, kategorische Verbote zu verletzen? Im 2. Teil des vorliegenden Beitrages vertrete ich die These, daß es durchaus einleuchtende Gründe dafür geben mag, daß Freiheit entweder intrinsisch oder instrumentell gut ist, um andere intrinsisch gute Dinge zu bewirken, in welchem Fall Konsequentialisten gute Gründe dafür haben, daß der Staat grundsätzlich moralische Schlechtigkeit tolerieren sollte, oder sie zumindest dann tolerieren sollte, wenn dies der Preis dafür ist, größeres Gutes zu befördern. Im 3. Teil behaupte ich, daß selbst unsere beste deontologische Theorie Maximen in sich aufnehmen kann, die es dem Gesetzgeber kategorisch verbieten, den Bürgern die Verletzung kategorischer Maximen zu verbieten. So kann es dem Gesetzgeber z.B. verboten sein, in die Privatsphäre der Bürger einzugreifen, um das Fehlverhalten von Bürgern zu ermitteln. Oder es kann dem Gesetzgeber auferlegt sein, nicht etwas zu verbieten, wenn er dieses Verbot nicht gegenüber allen Bürgern durchsetzen kann.Das Ergebnis meiner Analyse ist, daß die Theorie liberaler Toleranz nicht von der Behauptung vernünftigen Zweifels und der Uneinigkeit zwischen Gesetzgeber und Bürgern abhängt, wie es unter liberalen Politikwissenschaftlern oftmals voraus-gesetzt wird. Selbst dann, wenn vernünftige Personen sich darüber einig sind, daß eine bestimmte Art von Verhalten unmoralisch ist, und selbst dann, wenn bei dem Gesetzgeber kaum Zweifel an der Unmoralität des Verhaltens vorhanden sind, gibt es doch schwerwiegende moralische Gründe dafür, weshalb der Gesetzgeber moralisch verpflichtet sein kann, die Begehung unmoralischer Handlungen zu tolerieren. In this article I explore the ways in which moral theorists might make philosophical sense of the claim that the law ought to tolerate moral wickedness by according citizens legal rights to do moral wrongs. I set aside cases in which tolerance is proper because the morality of the conduct in question is uncertain or sufficiently contested by equally reasonable persons so as to make liberty the appropriate default solution for the state. Instead, I confine my inquiry to cases in which lawmakers are confident that the conduct in question is blameworthy, so that doubt and disagreement cannot be said to be sufficient reasons for staying the hand of the state. As I argue in Part I, both consequentialist and deontological moral theories can be thought to permit immoralities that are not violations of consequentialist or deontological obligations. Rule-consequentialists require tolerance of act-consequential wrongs that are done in the name of their rules; and deontologists require tolerance of consequentially sub-optimal deeds that are categorically permitted. While we may have aretaic obligations to become the kinds of persons who do not abuse deontological permissions, I explore a series of reasons to think that those who subscribe to an aretaic moral theory that substitutes concerns for character for concerns for actions will nevertheless have good grounds to place the cultivation of good character beyond the scope of the state. The question is harder when we move from immoralities that do not violate obligations to immoralities that do violate such obligations. Can consequentialists make sense of the state according persons liberty to do what is consequentially prohibited? Can deontologists defend not just the liberty to misuse permissions but the liberty to violate categorical prohibitions? I argue in Part II that there may be sound arguments for why liberty is either intrinsically good or instrumentally good for the achievement of other intrinsically good things, in which case, consequentialists have sounds reasons for supposing that the state ought to tolerate wickedness, tu cour , or tolerate it when it is a price that purchases greater goods. And I argue in Part III that our best deontological theory may contain within it maxims that categorically prohibit legislators from prohibiting violations of categorical maxims on the part of citizens. For example, they may be enjoined from invading citizens' privacy in the ways required to detect citizens' wrongdoing; or they may be enjoined not to prohibit what they cannot equally enforce against all. The upshot of my analysis is that a theory of liberal tolerance does not depend upon claims of reasonable doubt and disagreement amongst lawmakers and citizens, as is so often supposed amongst liberal political theorists. Even if reasonable persons agree that a kind of conduct is immoral, and even if lawmakers are in little doubt about its immorality, there are powerful moral reasons why lawmakers might be morally obligated to tolerate its persistence. Some philosophers have argued that the concepts of evil and wickedness cannot be well grasped by those inclined to a naturalist bent, perhaps because evil is so intimately tied to religious discourse or because it is ultimately not possible to understand evil, period. By contrast, I argue that evil—or, at least, what it is to be an evil person—can be understood by naturalist philosophers, and I articulate an independently plausible account of evil character.

“Wicked” problems are characterized by intractable complexity, uncertainty, and conflict between individuals or institutions, and they inhabit almost every corner of medical ethics. Despite wide acceptance of the same ethical principles, we nevertheless disagree about how to formulate such problems, how to solve them, what would _count_ as solving them, or even what the possible solutions _are_. That is, we don’t always know how best to implement ethical ideals in messy real-world contexts. I sketch an implementation framework for medical ethics (...) that can help clarify wicked problems and organize further ethics research toward their resolutions. This framework describes the procedural variables that work alongside substantive ethical ideals to deliver ethical decisions in complex real-world situations. Using controversial GM mosquito research as an example, I illustrate how the generalizable relationships between the variables clarify emerging ethical guidelines of research governance and provide a pathway to extend these guidelines in a way consistent with our ethical intuitions across a wide range of research and public health ethics. In an article from 1973, Rittel and Webber distinguished between “tame” or “benign” problems on the one hand and “wicked” problems on the other. The authors argued that wicked problems occur in nearly all public policy issues. Since different groups adhere to different value-sets, solutions can only be expressed as better or worse. By no means can they be viewed as definitive or objective. In this paper we shall consider, from this very angle, the theory of social choice which is (...) about the aggregation of individual preferences with the aim to derive a consistent social preference. We shall show that collective choice offers wicked problems of various types which differ in their degree of severity. We shall hereby concentrate on welfare functions and voting schemes of different kinds and shall discuss these in the light of various criteria such as Arrow’s independence condition, Condorcet consistency, monotonicity, manipulability, and other properties. Broad goals on climate change are largely set at international and national levels, whereas the tangible action required to tackle the challenge of climate change is essentially implemented at a local and individual level. The paper investigates how international policy discourses on climate change are adapted in local government, analysing a data set from a council debate in Germany about the EU programme ‘100 Climate-Neutral and Smart Cities by 2030’ and the textual and discursive networks created by that debate. The (...) analysis is based on recordings from the council and committee debates, the different versions of motions, as well as the broader textual networks produced by the debate. Although the debate did not result in this city taking part in the programme, it initiated a wider debate within the urban society and increased the influence of local policy expertise. The article contributes to the agenda of critical policy discourse analysis by outlining the role of epistemological and ontological scales in the connection of global and local policy discourses, which contribute to the complexity and wickedness of climate change as a policy problem. A rebuttal is provided to each of the arguments adduced by John Harris, an Editor-in-Chief of the Journal of Medical Ethics, in two editorials in the journal in support of the view that National Institute for Health and Clinical Excellence’s procedures and methods for making recommendations about healthcare procedures for use in the National Health Service in England and Wales are the product of “wickedness or folly or more likely both”, “ethically illiterate as well as socially divisive”, responsible for (...) the “perversion of science as well as of morality” and are “contrary to basic morality and contrary to human rights”. If it’s correct to think that the West does wrong by doing nothing despite having the room to reduce emissions and the capacity to do so, then it’s correct to think that we’re doing wrong too, in our everyday lives. Your emissions might be as much as 20 times more than others in the world; you might be doing as much as 20 times the damage to the planet compared to other people. The bulbs are not enough.

Is it possible for a person to understand that what he proposes to do is morally wrong and yet prefer to do it nonetheless? I shall argue that wickedness consists in a defect of character that results in one's often having just such preferences. Yet many philosophers think that wickedness so conceived is impossible, because, for them, having such a preference is incompatible with believing, or at least knowing, that the act would be wrong.

This paper critically analyses the position that basic income schemes foster idleness and thereby create harm. The view is based on an alleged empirical link between idleness and violent crime and an equation of non-activity with the creation of burden for others. It will be argued that the empirical claim is weak because it relies on conjectures derived from studies on unemployment. In addition, opponents arguing that basic income leads to an unfair distribution of burden between `lazy idlers'' and `honest (...) taxpayers'' have to face three questions. Is the distribution of onerous or unpleasant work fair? Is the distribution of work burdens between paid and unpaid workers equitable? Is the distribution of work between the unemployed and the employed fair? None of these questions can be answered in the affirmative. Hence, it can be confirmed that the `idleness'' argument against basic income relies on unfounded premises. (shrink)

Neo-Kantian constructivism aspires to respond to moral skepticism by compelling agents to act morally on pain of irrationality. According to Christine Korsgaard, a leading proponent of constructivism, we construct all reasons for action by following correct deliberative procedures. But if we follow these procedures we will find that we only have reasons to act in morally permissible ways. Thus, we can show the skeptic that he is rationally constrained to act morally. Unfortunately, as I argue in my first chapter, this (...) strong response to moral skepticism renders deliberate immoral action unintelligible. This result is problematic since we often do interpret ourselves and others as deliberately choosing to do wrong. I further suggest that this problem follows from central commitments of Korsgaard’s constructivism, so that any adequate account of immoral action must abandon constructivist metaethics in favor of moral realism, a suggestion reinforced by the argument of my second chapter. There, I call attention to Kant’s solution to a similar problem in his own account of morality. I argue that Korsgaard’s constructivist commitments prevent her from embracing Kant’s solution. I proceed in my third chapter to argue that there is a further tension between Korsgaard’s response to moral skepticism and her work in non-ideal theory. In particular, Korsgaard maintains that, when confronted with injustice, the virtuous person may have reason to do what is wrong in the name of morality. She thus relies on the assumption that one can deliberately do wrong. I argue that this assumption undermines the response to skepticism that motivated Korsgaard’s constructivism in the first place. But despite the problems with constructivism, we may worry that moral realism fails to offer an adequate response to moral skepticism. Indeed, Korsgaard rejects realism in part because she believes that realists simply refuse to respond to moral skepticism. I thus conclude by arguing that moral realists can offer adequate responses to moral skepticism. In fact, I believe Korsgaard’s response is no more effective than those suggested by some moral realists. (shrink)

The revelatory paper, “Dilemmas in the General Theory of Planning,” by Rittel and Webber (Policy Sci 4:155–169, 1973 ) has had great impact because it provides one example of an emergent consensus across many disciplines. Many “problems,” as addressed in real-world situations, involve elements that exceed the complexity of any known or hoped-for model, or are “wicked.” Many who encounter this work for the first time find that their concept of wicked problems aptly describes many environmental disputes. For those frustrated (...) with the lack of progress in many areas of environmental protection, Rittel and Webber’s work suggested a powerful explanatory hypothesis: Complex environmental problems cannot be comprehended within any of the accepted disciplinary models available in the academy or in discourses on public interest and policy. What should we conclude about the future of social improvements, and about the possibilities for rational discourse leading to cooperative action, with respect to this huge number of pressing public, environmental problems? Can we find ways to address environmental problems that improves the ability of communities to respond creatively and rationally to them? I will argue that, while the Rittel-Webber critique requires us to abandon many of the assumptions associated with a positivistic view of science and its applications to policy analysis, it also points to a more productive direction for the future of policy analysis. I will introduce “boundary critique,” developed within Critical Systems Theory (CST), an approach that offers some reason for optimism in dealing with some aspects of wickedness. (shrink)

In light of scholarly debates on the wicked problems framework, this contribution offers an appraisal of the role of theology in an African context characterized by myriad wicked problems. I argue that within the African context, the decolonization of theology is indispensable for doing theology that is self-consciously contextual and therefore responsive to societal issues. This is crucial not least because of the widely recognized public role of religion in Africa. Drawing on the analytical framework of decoloniality and the theoretical (...) concept of wicked problems, I will argue that although the category of wicked problems emerged within the framework of the intellectual world of the Northern Hemisphere, its analytical capacity is no less significant for contemporary African theological discourse on decoloniality. This essay presents a systematic reconstruction of the problem of divine providence in Quobna Ottobah Cugoano’s Thoughts and Sentiments on the Evil of Slavery. I argue that reading Thoughts and Sentiments in this frame allows interpreters to take Cugoano at his word without compromising on the religious and political sophistication of his argument. Cugoano, I show, develops an innovative account of providence’s relationship to slavery by engaging both contemporary apologies for slavery and abolitionist arguments for divine retribution. Written across the disciplines of art history, literature, philosophy, sociology, and theology, the ten essays comprising the collection all insist on multidimensional definitions of evil. Taking its title from a moment in Shakespeare's Tempest when Prospero acknowledges his responsibility for Caliban, this collection explores the necessarily ambivalent relationship between humanity and evil. To what extent are a given society's definitions of evil self-serving? Which figures are marginalized in the process of identifying evil? How is humanity itself implicated in the production (...) of evil? Is evil itself something fundamentally human? These questions, indicative of the kinds of issues raised in this collection, seem all the more pressing in light of recent world events. This is a fascinating study of the a-temporal nature of evil in the West. The international authors who have contributed to this text not only concentrate on political, social and legally sanctioned cruelty from the past and present, but also explore the nature of moral transgression in contemporary art, media and literature. Although many forms and practices of what might be called evil' are analysed, all are bound by violence and/or the sexually perverse.

Evil should be characterised as a specific constellation, which results from destructive connections between individual activities and systemic influences. The article shows some important aspects of the structure of evil and prefers the terms of wickedness and obscene coincidences to describe its own character. Therefore, also the division between rationality and affectivity appears as inadequate, because evil has on the one side an intrinsic attractiveness for individuals and is on the other side in modern societies more and more a (...) product of a rationality, which is free from passion. Especially the emotional impoverishment is responsible for the increase of evil, which is demonstrated by two examples. Wisdom and wickedness as a 'Woman' have always attracted much discussion, especially in the ways images of the female are employed in wisdom literature. This article focuses on two Qumran texts that fall into the category of wisdom literature, namely 4Q184 and 4Q185, and the metaphorical appropriation of the woman as a figure of wisdom or a figure of wickedness. By combining a number of traditions in certain forms, sages tried to establish an education for their learners on (...) how to obtain wisdom with the ultimate purpose of creating harmony. The ultimate purpose of the wisdom teachings of the sages was to confirm the harmony in the universe, and these teachings were also conveyed to their learners. In their instructions, they often employed binary opposites such as 'wise' and 'fool' according to which someone was characterised, or rather stereotyped. The result of such binary stereotyping was that the 'whore' and the 'holy one' represented opposite poles, and became fixed images in Judaism. According to feminist exegetes, these images typify the concept of cultural stereotyping. This article aims to illustrate that two Qumran texts, 4Q184 and 4Q185, regarded as wisdom texts, employ the female stereotypes that were known in the wisdom literature of Judaism. (shrink)

The evidence of human wickedness in the world is so transparent that no rational person can dispute its reality. This paper approaches the question of the human person from an African philosophical perspective and explores the relation between the apparently free-acting human being and God conceived as the creator of the world and the ultimate cause of the human being. The paper will proffer answers to the following question: to what extent can the human being be absolved of blame (...) for the evil they perpetrate in a world conceived in African traditional religion and thought as the creation of a high deity who could have foreseen the negative bent of human nature and should have made human nature inclined to goodness all of the time? The paper will make novel contributions to the debate about human nature in African philosophical discourse by recasting the human being as a homo melancholicus, or melancholy being, whose evil inclination in the world can best be understood in the context of a tragic vision of reality. Aristotle took practical wisdom to include cleverness, and something more. The hard question, that he does not explicitly answer, is what this something more is. On my interpretation, the practically wise are not merely more knowledgeable about what is good for people. They are also better able to discern all the values at stake, in whatever circumstances they find themselves. This is an ability that good people develop, typically rather late in life, provided they are masters of their own affairs. (...) According to Aristotle, this development is stunted by wickedness and also by wretchedness. It follows from his account that attempts to teach this virtue are not likely to succeed unless teachers have opportunities for developing practical wisdom through their work. Aristotle’s arguments give us reasons to doubt that teachers can help their students to become virtuous and wise, if their own way to earn a living is not conductive to human flourishing. If we take his message to heart, we should, first and foremost, think about how to steer clear of wretched work conditions, where teachers’ moral agency is narrowly circumscribed. (shrink)

NICE must not say people are not worth treatingThe National Institute for Health and Clinical Excellence has proposed that drugs for the treatment of dementia be banned to National Health Service patients on the grounds that their cost is too high and “outside the range of cost effectiveness that might be considered appropriate for the NHS”i.1This is despite NICE’s admission that these drugs are effective in the treatment of Alzheimer’s disease and despite NICE having approved even more expensive treatments. The (...) effect is that thousands of Alzheimer’s patients will be denied the only treatment available. It is difficult to think of this as anything but wickedness or folly or more likely both. At the same time, and with no apparent sense of irony, NICE has launched a public consultation document3 on its guidelines on social value judgments. As we shall see these guidelines are ethically illiterate as well as socially divisive.Assuming permanently scarce resources it is clearly crucial that such healthcare resources as are available are not wasted. This point is often made in terms of cost effectiveness and it is argued, not implausibly, that to talk of cost effectiveness implies that we are able to measure just how cost effective each treatment is. To do so of course we need a standard of measurement. NICE has adopted the ubiquitous, but justly infamous QALY, the Quality Adjusted Life Year.The QALY combines life expectancy after treatment with measures of the expected quality of that life. There are two ways in which QALYS can be used. They might be used to determine which of rival therapies to give to a particular patient or which procedure to use to treat a particular condition, in short which of two different treatments is the more …. By examining issues held in common by both thinkers, Ivanhoe illustrates how the Confucian tradition was both continued and transformed by Wang Yangming, and shows the extent to which he was influenced by Buddhism. Over the past few years, individual competencies for sustainability have received a lot of attention in the educational, sustainability and business administration literature. In this article, we explore the meaning of two rather new and unfamiliar moral competencies in the field of corporate sustainability: normative competence and action competence. Because sustainability can be seen as a highly complex or ‘wicked’ problem, it is unclear what ‘normativity’ in the normative competence and ‘responsible action’ in the action competence actually mean. In this (...) article, we raise the question how both these moral competencies have to be understood and how they are related to each other. We argue for a virtue ethics perspective on both moral competencies, because this perspective is able to take the wickedness of sustainability into account. It turns out that virtue ethics enables us to conceptualize normative competence and action competence as two aspects of one virtuous competence for sustainability. (shrink)
