Insurance Brokers’ behaviour: the effect of policy collection on management decisions.Miguel Ángel Latorre Guillem - 2022 - Human Review. International Humanities Review / Revista Internacional de Humanidades 11 (3):1-10.
Spanish legislation on insurance and reinsurance mediation stipulates that intermediary can only receive commissions and fees for the management of their policies and prohibits any other form of remuneration. However, it is possible that financial intermediaries who manage larger risks wait until the end of the legal deadline to settle with insurance companies. This common practice in the insurance market hides additional remuneration in defiance of the law. It also means that the risk is not covered within the prescribed (...)

Mondialisation et Traduction Juridique: Nouveaux Parcours de Recherche.Fabrizio Megale - 2015 - International Journal for the Semiotics of Law - Revue Internationale de Sémiotique Juridique 28 (1):31-52.
So far, legal translation studies have generally been concerned with multilingual legislation, which they have dissected using comparative law methods. The time seems to have come for a differentiated research that recognises various types of legal translation, including the category of translation by professionals for public authorities and business concerns. This latter category’s context is rapidly changing. Globalization is aggravating the crisis of national legislation. First and foremost, networks of authorities have sprung up alongside international organisations. The texts (...)

Washington, D.C.’s City Council has recently taken the first step towards legalizing the use of “medical marijuana” in accordance with the provisions of the Legalization of Marijuana for Medical Treatment Initiative of 1998. This action was not overruled by the United States Congress within the 30-day deadline imposed by the District of Columbia’s Home Rule Statute. The Council is now crafting regulations that will govern the therapeutic and palliative use of this drug with the goal of avoiding some of the (...)

    A Philosophy of Freedom.Kerri Pierce (ed.) - 2014 - Reaktion Books.
Freedom of speech, religion, choice, will—humans have fought, and continue to fight, for all of these. But what is human freedom really? Taking a broad approach across metaphysics, politics, and ethics, Lars Svendsen explores this question in his engaging book, while also looking at the threats freedom faces today. Though our behaviors, thoughts, and actions are restricted by social and legal rules, deadlines, and burdens, Svendsen argues that the fundamental requirement for living a human life is the ability (...)

INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...)

The improvement of ultrasound scan techniques is enabling ever earlier prenatal diagnosis of developmental anomalies. In France, apart from cases where the mother’s life is endangered, the detection of “particularly serious” conditions, and conditions that are “incurable at the time of diagnosis” are the only instances in which a therapeutic abortion can be performed, this applying up to the 9th month of pregnancy. Thus numerous conditions, despite the fact that they cause distress or pain or are socially disabling, do not (...)

I criticize the interpretive assumptions on which these disputes generally depend and defend a theory of interpretation which tends to vindicate the determinacy of law even in hard cases and the style of recent (...)

The Four Feet of Legal Procedure and the Origins of Jurisprudence in Ancient India.Patrick Olivelle & Mark McClish - 2021 - Journal of the American Oriental Society 135 (1):33.
The well-known classification of legal procedure into “four feet” presents certain conceptual problems for the Indian legal tradition that various Smṛtikāras and commentators have attempted to resolve in different and sometimes contradictory ways. These difficulties arise because the four feet originally referred in Indian legal theory to four distinct, hierarchical legal domains rather than procedural means for reaching a verdict. The earliest attested discussion of the four feet, found in Kauṭilya’s Arthaśāstra, indicates that early legal (...)

How Does Legal Status Inform Immigrant Agency During Encounters of Workplace Incivility?Amal Abdellatif & Ajnesh Prasad - 2024 - Journal of Business Ethics 194 (4):775-787.
Workplace incivility is experienced ubiquitously by immigrants. While a growing body of literature has sought to identify the causes and the outcomes of this phenomenon, what remains largely underexplored is the role of legal status in configuring how workplace incivility manifests in the immigrant experience. To advance the extant literature, in this article we investigate the question: How does legal status inform the ways in which immigrants exercise agency in response to workplace incivility? In addressing this question, we (...)

Ronald Dworkin famously argued that legal positivism is a defective account of law because it has no account of Theoretical Disagreement. In this article I argue that legal positivism—as advanced by H.L.A. Hart—does not need an account of Theoretical Disagreement. Legal positivism does, however, need a plausible account of interpretation in law. I provide such an account in this article.

    A Bayesian model of legal syllogistic reasoning.Axel Constant - 2024 - Artificial Intelligence and Law 32 (2):441-462.
Bayesian approaches to legal reasoning propose causal models of the relation between evidence, the credibility of evidence, and ultimate hypotheses, or verdicts. They assume that legal reasoning is the process whereby one infers the posterior probability of a verdict based on observed evidence, or facts. In practice, legal reasoning does not operate quite that way. Legal reasoning is also an attempt at inferring applicable rules derived from legal precedents or statutes based on the facts at (...)

We present an argument in support of the legal prohibition of infant male circumcision (IMC) in developed Western countries. We submit that all IMC, irrespective of whether the motivation behind it be secular or religious, violates children’s rights to self-determination (autonomy) and bodily integrity and is therefore morally illegitimate. And while IMC’s being morally wrong does not entail that it ought to be criminalised, we contend that it should be legally proscribed so as to protect children against harm and (...)

As the expansion of the Internet and the digital formatting of all kinds of creative works move us further into the information age, intellectual property issues have become paramount. Computer programs costing thousands of research dollars are now copied in an instant. The Metastases of Myth: Legal Images as Transitional Phenomena.Desmond Manderson - 2015 - Law and Critique 26 (3):207-223.
In times of transition and transformation, legal images metastasize. This idea can be usefully related both to Winnicott’s theory of transitional objects and Barthes’ theory of myth. But each tell only part of the full story. Barthes fails to fully account for the stabilizing effect of the reassuring signifier; Winnicott fails to fully account for the ideological adaptability—and implications—of the shifting signified. The legal image unites the iterability of the signifier and the polysemy of the signified, harnessing the (...)

It does not include the recent statutory amendments in jurisdictions such as New South Wales and the United Kingdom. Legal Provisions on Medical Aid in Dying Encode Moral Intuition.Ivar Hannikainen, Jorge Suárez, Luis Espericueta, Maite Menéndez-Ferreras & David Rodríguez-Arias - forthcoming - Preprint.
In recent decades, many jurisdictions have moved toward legalizing euthanasia and assisted suicide—together with a growing recognition of the moral right to a medically assisted death. Herewe draw on a comprehensive quantitative review of existing laws on assisted dying, experimental survey evidence, and four decades of time-series data to explore the relationship between these legislative transitions and changing moral attitudes. Our analysis reveals that existing laws on medical aid in dying impose a common set of eligibility restrictions, based on the (...)

This paper investigates the basis arguments of so-called legal logic and their relation to logic in its standard meaning. There is no doubt that legal arguments belong to logic in the wide sense (sensu largo), but their reduction to schemes of formal logic (logica sensu stricto) is a controversial issue. It can be demonstrated that only some legal arguments fall under explicit rules of formal logic, that is, having a deductive character. Most such reasoning is fallible, and (...)

Previous research has demonstrated that judicial instructions are not well understood by jurors tasked with returning informative verdicts, and explanatory strategies can facilitate juror’s comprehension of law-related contents. Unlike a great deal of research on legal-lay interactions in a jury trial, most of which is based on English-language materials, the present article uncovers how Russian judges communicate law-related information to the jury. The study was motivated by the lack of guidance on interactions with the jury and the challenges faced (...)

This article argues that legal positivism is best understood as a political tradition which rejects the Separation Thesis—the thesis that there is no necessary connection between law and morality. That tradition was committed for some time to eliminating the conceptual space in which the common law tradition and its style of reasoning operate. A genealogical reconstruction of the tradition shows that when positivist judges are forced to operate in that space, they have to adapt their own style of reasoning (...)
