Much modern liberal political theory takes the concept of autonomy as central and argues that political arrangements are to be assessed, in some part, by their ability to foster the development of individual autonomy understood as being the author of one's own life. This paper argues that so understood, autonomy is less important than is usually thought The liberal requirement that we 'author' our own lives disguises the importance of also being accurate readers of our own lives. I explore the (...) metaphor of reading through a discussion of the character of Nora in Ibsen's Doll's Houseand argue that Nora's case demonstrates the limitations of the liberal understanding of autonomy as involving authorship of one's own life. The study of cultural evolution has taken on an increasingly interdisciplinary and diverse approach in explicating phenomena of cultural transmission and adoptions. Inspired by this computational movement, this study uses Bayesian networks analysis, combining both the frequentist and the Hamiltonian Markov chain Monte Carlo (MCMC) approach, to investigate the highly representative elements in the cultural evolution of a Vietnamese city’s architecture in the early 20th century. With a focus on the façade design of 68 old houses in Hanoi’s Old (...) Quarter (based on 78 data lines extracted from 248 photos), the study argues that it is plausible to look at the aesthetics, architecture, and designs of the house façade to find traces of cultural evolution in Vietnam, which went through more than six decades of French colonization and centuries of sociocultural influence from China. The in-depth technical analysis, though refuting the presumed model on the probabilistic dependency among the variables, yields several results, the most notable of which is the strong influence of Buddhism over the decorations of the house façade. Particularly, in the top 5 networks with the best Bayesian Information Criterion (BIC) scores and p<0.05, the variable for decorations (DC) always has a direct probabilistic dependency on the variable B for Buddhism. The paper then checks the robustness of these models using Hamiltonian MCMC method and find the posterior distributions of the models’ coefficients all satisfy the technical requirement. Finally, this study suggests integrating Bayesian statistics in the social sciences in general and for the study of cultural evolution and architectural transformation in particular. (shrink)

This paper analyses Hello Barbie as a commercial artefact to explore how big data practices are reshaping the enterprise of marketing. The doll uses voice recognition software to ‘listen’ to the child and ‘talk back’ by algorithmically selecting a response from 8000 predetermined lines of dialogue. As such, it is a useful example of how marketers use customer relationship management systems that rely on sophisticated data collection and analysis techniques to create a relationship between companies and customers in which (...) both parties are positioned as active participants who are able to obtain what they wish from the interaction. I use dialogic analysis to see how Mattel ‘makes sense’ of the dialogue as a dialogic partner. I argue that, in spite of the rhetoric of instantaneity and personalization, in which the technology is positioned as an immediate response to a child’s imagination, Mattel’s dialogic communication is both asynchronous and carefully crafted to fit the child’s responses within predetermined consumer subjectivities that are crafted to encourage particular kinds of consumption. Although the dialogue spoken by Hello Barbie is able to situate Barbie as an active subject, the control exercised by the company in order to elicit data for customer relationship management purposes and steer the dialogue to brand-friendly messages relegates the child to a passive role. Accordingly, the doll fails to deliver the promises of customer relationship management. (shrink)

Using an analysis of child care books and parenting Web sites, this article asks if second-wave feminism’s vision of gender-neutral child rearing has been incorporated into contemporary advice on child rearing. The data suggest that while feminist understandings of gender have made significant inroads into popular advice, especially with regard to the social construction of gender, something akin to “a stalled revolution” has taken place. This article critically examines the 25 June 1998 decision by the House of Lords regarding the psychiatric admission of a man with autism.1 Mr L was able neither to consent to, nor refuse, that admission and the disposition of his case illuminates the current debate regarding best interests of vulnerable adults by the judiciary and the psychiatric profession. This article begins with the assumption that hospitalisation was not the optimum response to Mr L's condition, provides alternative approaches to the (...) interpretation of best interest and examines principles of liberty, anti-discrimination, and equal protection. Abstract:Thoreau’s story of climbing Saddleback (Mt. Greylock) in A Week on the Concord and Merrimack Rivers (1849) preserves his memories associated with the place and establishes the cultural significance of the mountain. The interpolation is about Thoreau’s quest to find a place of meaning and permanence amid the rapid changes in his life and the development of rural New England from industrialization. Places are integrations of space and time created by stories with personal and cultural significance. Such places must be (...) preserved. The hike is a pilgrimage to a paradise where he has a transcendental vision of a new world. Thoreau is born again on the mountain. The Greylock story is one of the most studied places in A Week. Literary critics have discussed how Thoreau’s ascent and the sunrise at the summit are the climax of the Romantic hero’s journey through nature, space, and time. None have noticed the symbolism of Thomas Carlyle’s “untamable fly” appearing instead of God, and none have explored Greylock as a Thoreauvian place. Thoreau’s trip to Greylock and the Catskills was a search for inspiration, and he was inspired to write Walden (1854). He stayed in cabins that prefigured his house at Walden Pond, and he saw things that reminded him of Harvard, Boston, Staten Island, and other mountains he had climbed. At the summit he found water, nibbled supper with the mice, conceived of a book about nature, and watched the sunrise of his new life. The history of Greylock is the story of the environmental impact of unregulated lumbering and development and the resulting conservation efforts. The old growth forest is now protected state land, with rare birds and a ghost. The mountain is a literary place also associated with Hawthorne, Melville, and Rowling. Since 1994, Thoreau’s climb up Greylock has been commemorated by an annual hike retracing his footsteps. (shrink)

Older single women in Australia are increasingly experiencing homelessness. Age and gender seem inherently related to single older women’s housing crises, but no attempt has been made to account for the causes of their homelessness through an intersectional lens. This article develops a complex and contingent causal explanation of the structures and mechanisms implicated in growing homelessness for this group. We demonstrate an original use of critical realist-informed intersectional analysis which is characterized by stratified social ontology and emergence. We (...) theoretically reframe existing literature to demonstrate how the intersectional causal powers of gender and age (‘gender*age’) discrimination and conventional life course experiences intersect to generate financial precarity for older women. Our causal model explains how economic insecurity, structural and individual contexts, and crisis events interact, challenging older women’s housing security and precipitating first-time homelessness later in life. This article makes a case for the capacity of "social practice" accounts of agency and freedom to criticize, resist, and transform systemic forms of power and domination from within the context of religious and political practices and institutions. I first examine criticisms that Michel Foucault's analysis of systemic power results in normative aimlessness, and then I contrast that account with the description of agency and innovative practice that pragmatist philosopher Robert Brandom identifies as "expressive freedom." I argue that Brandom (...) can provide a normative trajectory for Foucault's diagnoses of power and domination, helping to resolve its apparent lack of ethical direction. I demonstrate that Foucault, in turn, presents Brandom with insights that might overcome the charges of abstraction and conservatism that his pragmatic inferentialism frequently encounters. The result is a vindication of social practice as an analytical lens for social criticism that is at once both immanent and radical. (shrink)

House eschews the generic conventions of the “television doctor” by being neither the idealized television doctor of the past, nor the more recent competent but often fallible physicians in entertainment texts. Instead, his character is a fragmented text which privileges the biomedical over the personal or emotional with the ultimate goal of (...) scientifically uncovering and resolving instances of disease. This article examines the implicit and explicit messages in House M.D. and critically analyzes both the show and its lead character in relation to the traditional medical drama genre that highlights the “doctor-hero” as the central character. While at first House seems to completely violate narrative and generic norms, ultimately the program provides a new form that reinforces the presence of the doctor-hero, but highlights House’s character as the central figure who is personally and interpersonally problematic but biomedically effective. The review of activity of local governments of Leningrad on the solution of social problems is presented in article in the period of the Great Patriotic War and restoration of municipal economy during the post-war period. The considerable attention is paid to questions of ensuring activity of the population and the main directions of social policy. Consequences of the public regress caused by war, which detained for many decades development of the social sphere in the country, are not studied yet. (...) In this regard, the judgment of process of overcoming of these consequences, research of the principles of work, methods and forms of administrative activities for the organization of full-fledged life of citizens during the recovery post-war period and in the next decades is of special interest. Completion of World War II entailed changes in a control system of the country - as it is known, extraordinary bodies of authority and management of a wartime in the capital and on places were abolished. Management of restoration and maintenance of full functioning life support system of the cities and areas transferred to local governments of the Soviet power - to city and regional councils of deputies and their constantly operating executive committees. The role of the social sphere in modern conditions more and more increases in improvement of economy, development of democratic processes. The scientific analysis of activity of the central and local authorities for protection and providing the population in years of war and the post-war period gives more deep understanding of role and importance of social questions in life of society. It reveals historical experience of creation, development and implementation of effective mechanism of such activity, that experience is useful for modern management practice of state and local authorities. Healthcare environments continue to prove discriminatory and marginalizing towards patients and healthcare workers themselves, which contributes to inequitable health outcomes across lines of socially constructed difference. This content and discourse analysis of nursing identity scholarship asks whether there is a connection between nursing identity and oppressive behaviour by examining the construction of nursing identity and the foundational discourses, sometimes in absentia, that support such a construction. Bourdieu's concepts of social fields and Audre Lorde's concept of the master's house (...) are applied as a framework towards understanding the constructs of power and status in healthcare. The analysis identifies a gap in nursing identity literature where social constructs of difference are not considered. In the reviewed literature, nursing identity has been co‐opted by the professionalization project in effort to stabilize a conceptualization of nursing's contribution to healthcare towards gaining professional and societal status. This leads to a monolithic, apolitical representation of nursing identity that erases difference, denies historical influence, universalizes nursing work and further marginalizes marginalized identities. The oppressive and hegemonic nature of a universal nursing identity may contribute to a lack of disciplinary reflexivity about the ongoing influences of foundational discursive constructs of gender, epistemology, power and professional status. This study examines the role of both religion and culture [as measured by the cultural clusters of countries in the GLOBE study of House et al. (Culture, Leadership, and Organizations: The GLOBE Study of 62 Societies, 2004)] on the levels of perceived corruption. Covering the period from 2000 to 2010, the study uses three different measures of perceived corruption: (1) the World Bank’s Control of Corruption measure, (2) Transparency International’s Corruption Perceptions Index, and (3) Heritage Foundation’s Freedom from Corruption (...) Index. A system of three simultaneous equations is used, with the jointly endogenous variables being (a) perceived corruption, (b) perceived government legitimacy, and (c) perceived government effectiveness. The results show that both cultural and religious differences are incrementally related to perceived corruption, even after controlling for other economic and political factors. Specifically, relative to the Protestant Christian religion, the non-Protestant Christian religion, the Islamic religion, and Other Religion/no Religion are positively associated with higher corruption (or negatively with anti-corruption), but the Buddhist and Hindu religions appear to be not significantly different from the Protestant Christian religion. On the cultural side, compared to the Anglo-Saxon cultural tradition, the other European clusters are incrementally positively associated with higher corruption, but this tendency is offset by more effective political governance, thus leading in the case of the German and Nordic cultures to levels of corruption not statistically different from the Anglo cluster. All the non-European cultural clusters are associated with significantly higher corruption tendencies, but the overall effect is mitigated partially by either greater perceived political legitimacy (Latin-American, Middle-Eastern, Caribbean, and Pacific Islander), or greater political effectiveness (Confucian and South-East Asian). This study examines the Korean translations of a Japanese work Joshi no rongo [女子の論語/Women’s Analects] (Yuki, Ako [祐木亜子]. 2011. 女子の論語. Tokyo: Sunmark Publishing House), a modern interpretation of the Chinese classic The Analects, with a view to identifying how the paratexts of a translated text contributed, or hindered the reception of the work in the target culture. By drawing on Gérard Genette’s (1997 [1987]. Paratexts: Threshold of interpretation, Jane E. Lewin (trans.). Cambridge: Cambridge University Press) concept of “paratexts,” this (...) study both analyses translation shifts in the peritexts (e.g., cover, foreword, table of contents) and the epitexts (reviews) of the Korean translations. The analysis shows that the additions and rearrangements of some paratextual elements in the Korean translation further reinforced the traditional view presented in the source text, which ironically brought about heavy criticisms of the original Japanese text and resulted in the Korean retranslation of the work. The scrutiny of peritexts and epitexts in this article will enhance our understanding of the interactions between the translator, the publisher, and the public readers, which jointly contextualize the production and reception of a translated work in a given culture. Resumen En este artículo me propongo revisitar de manera sucinta y sistemática los li-neamientos centrales de la teoría de la subjetividad de Sigmund Freud, persiguiendo el objetivo de mostrar la vigencia filosófica y teórico-social de la misma. Para ello, procedo en tres pasos: en primer lugar expongo el modo en que el autor construye su concepción del "sujeto del Inconsciente" a través de un enfrentamiento con la noción de "sujeto cartesiano". Luego, examino la tensión entre natura y nurtura que puede (...) rastrearse en su tratamiento del problema de la "pulsión" [ Trieb]. Y, finalmente, reseño su descripción de la estructura tripartita del aparato psíquico, poniendo especial énfasis en su noción de la subjetividad escindida y en el análisis del origen intersubjetivo del "Superyó" [Über-Ich].In this paper, I intend to systematically revisit the main lines of Sigmund Freud's theory of subjectivity, with the aim of showing its current relevance within the fields of philosophy and social theory. In order to do so, I will proceed in three steps. First, I will scrutinize the way Freud elaborates his account of the "subject of unconsciousness" arguing against the conception of the "Cartesian subject". Then, I will examine the tension between nature and nurture, which can be found in his treatment of the problem of "drives" [Triebe]. Finally, I will sketch out his description of the three-fold structure of the psychical apparatus, putting special emphasis on his conception of the "split subjectivity" and on his analysis of the intersubjective origin of the Superego [Über-Ich]. The harmful consequences of fossil fuels use has resulted in the promotion of clean and renewable energies. During the past decades, green technologies have experienced a strong development, paying especial attention to wind energy, that covers a significant share of the electric energy demand. In this context, the main efforts are focused on the optimization of wind generator facilities, not only in the mechanic design but also in the energy management. Then, the present work deals with the prediction of the (...) energy generated in a small wind turbine placed in a bioclimatic house located on the north west region of Spain. This includes an analysis of the characteristics of the atmospheric variables registered during the turbine operation for a period of one year and an exploratory examination of a range of regression techniques in order to assess the suitability of using the registered information to predict the installation’s power generation levels on the short term. The study detailed in this work proves that this objective is an attainable one with a good degree of accuracy. (shrink)

The subject of the article, which is based on the concept and practical methodology of using the space of the museum exposition as an educational one, is the activities of the Moscow Memorial Museum "Losev's House". Particular attention is paid to the analysis of such educational resources of a new type offered by the Losev House as the Scientific Library, Online Lecture and Study Day at the Museum; within the framework of each of these forms, its general (...) educational potential and advantages are analyzed in comparison with the traditional forms of teaching philosophy within the walls of an educational institution of a conventional type. Based on the results of the study, fundamentally new opportunities for increasing the effectiveness of philosophical education through the active formation of the educational motivation of a museum visitor or a learning individual through immersion and interactive interaction are identified and analyzed. In conclusion, an assessment is made of the educational activities of the "Losev's House" within the framework of the general socio-cultural genesis of the domestic society, its actual opposition to the multiple tendencies of cultural primitivization. The article concludes that, having a pronounced discursive character, philosophy, being presented in the educational space of the Losev House Museum, receives additional original opportunities for deploying this discourse. Represented in the educational space of the museum, philosophy, as an established system, from its content side, acts as a harmony and balance of its own objective and subjective aspects. A full-fledged philosophical education cannot be limited only to educational practices, it is necessary to include the upbringing of the culture inherent in philosophy and independence of thought. In the era of modern information culture, which implies the possibility of providing quick access to any necessary information, the emphasis in the learning process is shifting from the previous forms of its direct transmission to the formation of appropriate learning motivation, immersiveness and interactivity of new forms of learning provided by the educational space of the Losev House Museum. Julie Dash's experimental short film, Praise House, situates conjuring as both a narrative and formal device to invent new memories around Black womanhood that exceed our representation within the epistemes of Man. I view Praise House as an example of conjure-cinema with which we can evaluate how Black feminist filmmakers, primarily working in experimental film, manipulate the poetic structure and aesthetics of film to affect audiences rather than rely on representational narrative alone. Following the scholarship of Sylvia Wynter, (...) I use Man to refer to the representational body of the Western episteme that defines value through mass accumulation. It is through Wynter's scholarship that we find the ontological emancipation from Man that is Caliban's woman, who represents discourse beyond our normative, colonial mode of feeling/knowing/being. Through an analysis of Praise House that foregrounds film's ability to generate affect via its aesthetics, this article argues that aesthetics can similarly enact the same power of conjure as found in Praise House's narrative, and as such conjures an epistemological rupture to our normative order that is Caliban's woman. Scientists and historians have often presumed that the divide between biochemistry and molecular biology is fundamentally epistemological.100 The historiography of molecular biology as promulgated by Max Delbrück's phage disciples similarly emphasizes inherent differences between the archaic tradition of biochemistry and the approach of phage geneticists, the ur molecular biologists. A historical analysis of the development of both disciplines at Berkeley mitigates against accepting predestined differences, and underscores the similarities between the postwar development of biochemistry and the emergence of molecular (...) biology as a university discipline. Stanley's image of postwar biochemistry, with its focus on viruses as key experimental systems, and its preference for following macromolecular structure over metabolism pathways, traced the outline of molecular biology in 1950.Changes in the postwar political economy of research universities enabled the proliferation of disciplines such as microbiology, biochemistry, biophysics, immunology, and molecular biology in universities rather than in medical schools and agricultural colleges. These disciplines were predominantly concerned with investigating life at the subcellular level-research that during the 1930s had often entailed collaboration with physicists and chemists. The interdisciplinary efforts of the 1930s (many fostered by the Rockefeller Foundation) yielded a host of new tools and reagents that were standardized and mass-produced for laboratories after World War II. This commercial infrastructure enabled “basic” researchers in biochemistry and molecular biology in the 1950s and 1960s to become more independent from physics and chemistry (although they were practicing a physicochemical biology), as well as from the agricultural and medical schools that had previously housed or sponsored such research. In turn, the disciplines increasingly required their practitioners to have specialized graduate training, rather than admitting interlopers from the physical sciences.These general transitions toward greater autonomy for biochemistry and allied disciplines should not mask the important particularities of these developments on each campus. At the University of Caliornia at Berkeley, agriculture had provided, with medicine, significant sponsorship for biochemistry. The proximity of Lawrence and his cyclotrons supported the early development of Berkeley as a center for the biological uses of radioisotopes, particularly in studies of metabolism and photosynthesis. Stanley arrived to establish his department and virus institute before large-scale federal funding of biomedical research was in place, and he courted the state of California for substantial backing by promising both national prominence in the life sciences and virus research pertinent to agriculture and public health. Stanley's venture benefited significantly from the expansion of California's economy after World War II, and his mobilization against viral diseases resonated with the concerns of the Cold War, which fueled the state's rapid growth. The scientific prominence of contemporary developments at Caltech and Stanford invites the historical examination of the significance of postwar biochemistry and molecular biology within the political and cultural economy of the Golden State.In 1950, Stanley presented a persuasive picture of the power of biochemistry to refurbish life science at Berkeley while answering fundamental questions about life and infection. In the words of one Rockefeller Foundation officer,There seems little doubt in [my] mind that as a personality Stanley will be well able to dominate the other personalities on the Berkeley campus and will be able to drive his dream through to completion, which, incidentally, leaves Dr. Hubert [sic] Evans and the whole ineffective Life Sciences building in the somewhat peculiar position of being by-passed by much of the truly modern biochemistry and biophysics research that will be carried out at Berkeley. Furthermore, it seems likely that Dr. S's show will throw Dr. John Lawrence's Biophysics Department strongly in the shade both figuratively and literally, but should make the University of California pre-eminent not only in physics but in biochemistry as well.101Stanley, Sproul, Weaver, and this officer (William Loomis) all testified to a perceptible postwar opportunity to capitalize on public support for biological research that relied on the technologies from physics and chemistry without being captive to them, and that addressed issues of medicine and agriculture without being institutionally subservient. What is striking, given the expectation by many that Stanley would ‘be able to drive his dream through to completion,” was that in fact he did not. Biochemists who had succeeded in making their expertise valued in specialized niches were resistant to giving up their affiliations to joint Stanley's “liberated” organization. Stanley's failure was not simply due to institutional factors: researchers as well as Rockefeller Foundation officers faulted him for his lack of scientific imagination, which made it difficult for him to gain credibility in leading the field. Moreover, many biochemists did not share Stanley's commitment to viruses as the key material for the “new biochemistry.”In the end, Stanley's free-standing department did become a first-rate department of biochemistry, but only after freeing itself from Stanley's leadership and his single-minded devotion to viruses. Nonetheless, the falling-out with the Berkeley biochemists was rapidly followed by the establishment of a Department of Molecular Biology, attesting to the unabating economic and institutional possibilities for an authoritative “general biology” (or two, for that matter) to take hold. In each case, following Stanley's dream sheds light on how the possible and the real shaped the (re)formation of biochemistry and molecular biology as postwar life sciences. (shrink)

The problem of combinatorial optimization is considered in relation to the choice of the location of the location of power supplies when solving the problem of the development of urban distribution networks of power supply. Two methods have been developed for placing power supplies and assigning consumers to them to solve this problem. The first developed method consists in placing power supplies of the same standard sizes, and the second - of different standard sizes. The fundamental difference between the created (...) methods and the existing ones is that the proposed methods take into account all the material of the problem and have specialized methods for coding possible solutions, modified operators of crossing and selection. The proposed methods effectively solve the problem of low inheritance, topological unfeasibility of the found solutions, as a result of which the execution time is significantly reduced and the accuracy of calculations is increased. In the developed methods, the lack of taking into account the restrictions on the placement of new power supplies is realized, which made it possible to solve the problem of applying the methods for a narrow range of problems. A comparative analysis of the results obtained by placing power supplies of the same standard sizes and known methods was carried out, and it was found that the developed method works faster than the known methods. It is shown that the proposed approach ensures stable convergence of the search process by an acceptable number of steps without artificial limitation of the search space and the use of additional expert information on the feasibility of possible solutions. The results obtained allow us to propose effective methods to improve the quality of decisions made on the choice of the location of power supply facilities in the design of urban electrical. This paper studies the dynamic characteristics of triopoly models that are constructed based on a 3-dimensional Cobb–Douglas utility function. The paper presents two parts. The first part introduces a competition among three rational firms on which their prices are isoelastic functions. The competition is described by a 3-dimensional discrete dynamical system. We examine the impact of rationality on the system’s steady state point. Studying the stability/instability of this point, which is Nash equilibrium and is unique in those models, is illustrated. (...) Numerically, we give some global analysis of Nash point and its stability. The second part deals with heterogeneous scenarios. It consists of two different models. In the first model, we assume that one competitor adopts the local monopolistic approximation mechanism while the other opponents are rational. The second model assumes two heterogeneous players with LMA mechanism against one rational firm. Studies show that the stability of NE point of those models is not guaranteed. Furthermore, simulation shows that when firms behave rational with symmetric costs, the stability of NE point is achievable. (shrink)

Air transport is playing an increasing role in the world economy every year. This is facilitated by technological development and the latest developments in the aviation industry, globalization. This paper provides an overview of artificial neural network training methods for airfare predicting. The articles for 2017-2019 were analyzed in order to determine the model with the most accurate prediction. The researchers conducted research on open data collected by themselves and set themselves the goal of creating a model that would advise (...) a user the best time to buy a ticket when the price would be the lowest. The review of the papers by similar themes revealed that the Bagging Regression Tree model has the highest results with an accuracy of 88% and the random forest method has an accuracy of 87%. Civil aviation plays an important role in the economy of each country. Aviation is the best way to cover long distances in comfort in the shortest time. Airlines offer customers a variety of opportunities to travel both within the country and abroad. The main problem of interaction between airlines and customers is the airfare: the former want to sell more at the higher price, and the latter want to buy cheaper. Therefore, companies use their own private algorithms for dynamic pricing and constantly monitor the market situation, responsive to changes in demand and the actions of competitors. This behavior allows them to achieve a balance between the desires of airlines and customers. Scientists are trying to invent a way to predict airfare so that air travelers can buy them at the lowest price. The results of the work in this area provide general rules for the best purchase. For example, according to the article thebest day to buy a ticket by expedia.com for a domestic flight on the United States is Sunday, and the best period is 57 days before departure. This article provides an overview of the works, the authors of which compared the models of machine learning. Achievements in this area are limited to direct flights of a certain domestic market and 88% accuracy of the forecast. The Bagging Regression Tree model described in the article can be considered the best result. This trained model can make predictions based only on two parameters: the number of free cargo and the number of days left before departure and has an accuracy of 88%. (shrink)

The General Data Protection Regulation (GDPR) was introduced in 2018 to harmonize data privacy and security laws across the European Union (EU). It applies to any organization collecting personal data in the EU. To date, service-level consent has been used as a proportionate approach for clinical trials, which implement low-risk, routine, service-wide interventions for which individual consent is considered inappropriate. In the context of public health research, GDPR now requires that individuals have the option to choose whether their data may (...) be used for research, which presents a challenge when consent has been given by the clinical service and not by individual service users. We report here on development of a pragmatic opt-out solution to this consent paradox in the context of a partner notification intervention trial in sexual health clinics in the UK. Our approach supports the individual’s right to withhold their data from trial analysis while routinely offering the same care to all patients. (shrink)

The subject of the study is the peculiarities of the formation of the canonical two-evening edition of S. S. Prokofiev's opera "War and Peace" and the influence on this process of the authors of the first production of the composition at the Maly Opera House in 1946 - the musical and stage version of conductor S. A. Samosud, director B. A. Pokrovsky and artist V. V. Dmitriev. The main purpose of the work is to identify the key aspects of (...) the impact of the theater and the production process on the appearance of the legendary opera epic S. S. Prokofiev. The methodology of work is based on the principle of historicism in the study of musical drama and the stage fabric of the performance, developed by the domestic theater school. A study of the first edition of the 1943 opera, a detailed analysis of the rehearsal and staging process for preparing the premiere performance at the Maly Opera House, preserved letters and memoirs, periodicals, as well as a number of archival materials reveal a significant role for the authors of the production - conductor S. A. Samosud and director B. A. Pokrovsky - in a revision of the composer's originally created composition, explain the work of S. S. Prokofiev in order to create additional musical and dramatic episodes, which later became the climax of the canonical version of the opera. The author examines the little-known facts of the history of the creation of the opera "War and Peace" by S. S. Prokofiev - the influence of the theater on the appearance of the work formed as a result of work on the production of 1946-1947. (shrink)

How do we measure happiness? Focusing on subjective measures as a proxy for welfare and well-being, this book finds ways to do that. Subjective measures have been used by psychologists, sociologists, political scientists, and, more recently, economists to answer a variety of scientifically and politically relevant questions. Van Praag, a pioneer in this field since 1971, and Ferrer-i-Carbonell present in this book a generally applicable methodology for the analysis of subjective satisfaction. Drawing on a range of surveys on people's (...) satisfaction with their jobs, income, housing, marriages, and government policy, among other areas of life, this book shows how satisfaction with life "as a whole" is an aggregate of these domain satisfactions. Using German, British, Dutch, and Russian data, the authors cover a wide range of topics, even some not usually considered part of economic study.The book makes a distinction between actual satisfaction levels and individual norms, and in this way complements Van Praag's earlier work within the Leyden School with his later work in "happiness research". This article focuses on referential practices at a Japanese midwife house, where at prenatal examinations, a midwife palpates a pregnant woman’s abdomen with her hands, without any assistance from an ultrasound scanner. The midwife often refers to spots on the abdomen in palpation with locative demonstrative expressions. I demonstrate that ways in which references to spots on the pregnant woman’s abdomen are accomplished are subtly different, depending on the action sequence in which they are embedded. The description of referential (...) practices in which the touching plays an important role has consequences for the re-conceptualization of human interaction in general, and interaction between medical professionals and their clients in modern medical settings in particular. This paper presents a detailed analysis of a previous work that described the dynamic behavior of an antique stamp mill. The stamp mill application was for breaking ore stones as part of silver production. The dynamic analysis was established from a modern description of the kinematic chain. Since there is no technical data or archeological reports, the model was reconstructed using the dimensions described in original documents and assuming the operation conditions from different technical references. The model was (...) validated using the typical production rates from the pre-industrial revolution period (XVI to XVIII centuries). The results show a proper method for reconstructing the engineering data of antique mechanisms and provide the basis for reproducing these types of mechanisms with modern engineering concepts. Criticisms of the liberal-individualist idea of the “unencumbered self” are not just a staple of communitarian thought. Some modern Confucian thinkers are now seeking to develop an ethically particular understanding of social roles in the family that is sensitive to gender-justice issues, and that provides an alternative to liberal-individualist conceptions of the “unencumbered self” in relation to family roles. The character of Nora in Henrik Ibsen's A Doll's House seemingly exemplifies such conceptions of the unencumbered self in her rejection (...) of her housewife role for a more authentic selfhood. Drawing upon the capabilities approach to justice, and positive early Japanese bluestockings’ responses to Ibsen's play, I argue that Nora's character is better understood as exemplifying an ethically compelling disencumbered self in potentially cross-cultural circumstances: a self criticizing and rejecting social roles that are found to be unjust according to universal, as opposed to particularist, “Confucian” ethical standards. The policy adopted by housing authorities of denying prospective tenants with a criminal record access to housing is an important barrier to ex-offenders seeking somewhere to live. The policy is legal, but are there any good reasons in favor of it when we know that having no, or limited, access to secure and affordable housing increases the probability of recidivism? The primary aim of this article is to critically discuss two central reasons that have been given for denying people with (...) criminal records access to housing: that doing so will prevent crime, and that the policy reduces fear of crime. We also try to evaluate an argument for the conclusion that current law, and the policies that follows wrongfully discriminate against people with criminal records. The general thrust of the article is that arguments for this practice turning on its crime preventive effect, and its role in reducing or preventing fear of crime, are unpersuasive. We then explained why, in our view, excluding ex-offenders from housing amounts to wrongful discrimination against them. Our analysis suggests that ex-offenders, apart from a few excemptions, ought to be allowed access to housing to the same extent as other people. (shrink)

Simone de Beauvoir’s early enthusiasm for the philosophy of Henri Bergson (1859-1941)—denied in her 1958 autobiography, Memoirs of a Dutiful Daughter—is a surprising discovery in her 1927 handwritten student diary, as I reported in 1999 and explored at more length in 2003 (Simons 1999; Simons 2003). Discovered by Sylvie Le Bon de Beauvoir after Beauvoir’s death in 1986 and now housed in the Bibliothèque nationale, Beauvoir’s student diary first appeared in print in the 2006 volume, Diary of a Philosophy Student: (...) 1926-27, followed in 2008 by the French publication, Cahiers de jeunesse: 1926-1930. Since my 1999 analysis of the 1927 diary, the publication of the 1926 diary and other posthumously discovered texts has deepened and complicated the evidence of Bergson’s influence.1 In this chapter, I propose to take up and expand upon my earlier analyses in the light of this new evidence, arguing that Beauvoir’s methodological turn to the description of immediate experience, especially her method of writing philosophy in literature and her lifelong interest in describing the subjective experience of time, drew upon Bergson’s philosophy before her first encounter with Husserl’s phenomenology which may have come as early as 1927; that her concept of bad faith and interest in exposing distortions in perception and thinking, as in the chapters in The Second Sex on myths about women, drew upon Bergson’s philosophy long before she had read Marx; and that her earliest formulation of the problem of the Other drew upon Bergson’s distinction between the “social self and the deep self,” two years before she met Jean-Paul Sartre and two decades before she first read Hegel’s Phenomenology. The terms “politics” and “political” have become so overdetermined that it is difficult to use them in any effective manner. We argue that this has dangerous political consequences, and that this could be addressed by providing a new, sounder, notion of politics. This paper argues that defining politics in relation to the notion of play can provide a notion both intuitively appealing and able to withstand the problematic overdeterminations. We argue that politics is the set of practices through which the (...) indeterminate of Spielraum is made more determinate. This suggests that politics is always partly a matter of play: it is about instituting values without making any claims about the legitimacy of this instituting act. With reference to Huizinga and Nietzsche’s analyses of play, we define play as the living unity of seriousness and frivolity, and non-play as either seriousness without frivolity or frivolity without seriousness. In order to illustrate this, we comparatively analyse the attitudes of Barack Obama and Donald Trump in the single context of the well-known yearly White House Correspondent’s Dinner. There, we see two opposed attitudes to playfulness. Our analysis allows us to apply our _Spielraum_ model of politics to show that the thrust of Obama’s attitude involves an embrace of the non-foundational nature of politics as play, whereas Trump’s attitude is politicidal: it is animated by a refusal to acknowledge its own lack of foundation, leading to an oscillation between over-seriousness and over-frivolity. Being sure of each other is the blossoming of Kimberley Brownlee’s earlier work on the intrinsic value and qualities of human connection (2013, 2016c, 2016b), opening with a scene from A. A. Milne’s House at Pooh Corner: lost in the woods together, Piglet takes Pooh’s paw ‘just to be sure’ of his friend. The importance of social connection is often overlooked because it is central to our lives, like breathable air. Brownlee’s work highlights the need for social connection, as (...) deserving of more philosophical attention and practical protection through rights. But her key insight is that receiving relational goods isn’t all that matters: being able and permitted to provide relational goods to others, as Piglet and Pooh receive and offer each other reassurance, is just as essential for our wellbeing. Objective: To determine the usefulness of Q methodology to locate and describe shared subjective influences on clinical decision making among participant physicians using hypothetical cases containing common ethical issues. Design: Qualitative study using by-person factor analysis of subjective Q sort data matrix. Setting: University medical center. Participants: Convenience sample of internal medicine attending physicians and house staff (n = 35) at one midwestern academic health sciences center. Interventions: Presented with four hypothetical cases involving urgent decision making near the (...) end of life, participants selected one of three specific clinical actions offered for each case. Immediately afterward and while considering their decision, each respondent sorted twenty-five subjective self-referent items in terms of the influence of each statement on their decision-making process. By-person factor analysis, where participants are defined as variates, yielded information about the attitudinal background the physicians brought to their consideration of each hypothetical case. We performed a second-order factor analysis on all of the subjective viewpoints to determine if a smaller core of shared attitudes existed across some or all of the four case vignettes. Factor scores for each item and post-sort comments from interviews conducted individually with each respondent guided the interpretation of ethical perspective used by these respondents in making clinical decisions about the cases. Measurements and Main Results: Second-order factor analysis on seventeen viewpoints used by physicians in the four hypothetical urgent decision cases revealed three moderately correlated (r 2 < 40%) subjective core attitudinal guides used broadly among all the cases and among sixteen of the seventeen original factors. Across all the cases, our participants were guided in general by: (1) patient-focused beneficence, (2) a patient- and surrogate-focused perspective that includes risk avoidance, and (3) best interest of the patient guided by ethical values. Economic impact on the physician, expediency in resolution of the situation, and the expense of medical treatment were not found to be influential determinants in this study. Conclusions: Q sorting and by-person factor analysis are useful qualitative methodological tools to study the complex structure of subjective attitudes that influence physicians in making medical decisions. This study revealed the subjective viewpoints used by our physician participants as they made ethically challenging treatment decisions. The three second-order factors identified here are grounded in current bioethical values as well as the personal traits of physicians. The participants' decision methods appear to resemble casuistry more than principle-based decision making. Generalizability of results will require further studies. (shrink)

The thesis of this paper is that games and sports that harm nonhuman animals are unethical because they exceed the permissible limits of optional harm and the more harm the game imposes on the nonhuman animal(s) it objectifies the worse the ethical transgression. Factors in the analysis include the nature of games and sports, the ontology of beings (i.e., human and nonhuman animals) in games, the mitigating power of informed consent among human game-players and its absence among nonhuman game (...) players, harm, and intent. Purpose. The paper is aimed at analyzing in a comparative way the philosophical conceptions of the human, proposed by Ludwig Wittgenstein and Martin Heidegger as the main representatives of the analytic and continental tradition of philosophizing in the XXth century. The theoretical basis of the study is determined by Wittgenstein’s legacy in the field of logical and linguistic analysis, as well as Heidegger’s existential, hermeneutical, and phenomenological ideas. Originality. Based on the analysis of the philosophical works of Wittgenstein (...) and Heidegger, the initial principles of their anthropological concepts in the unity of transcendental preconditions, essential foundations, and correlations to the world in the technosphere are reconstructed. It is demonstrated that, despite the difference in the explanation of the peculiarities in the interpretation of the realm of the transcendental and basic characteristic of the inner world of human, both philosophers emphasized the understanding of the human being through the prism of language and the need for anthropologization of science and technology. Conclusions. Wittgenstein and Heidegger developed their own original considerations on the nature of human being, which fully conform to the basic theoretico-methodological principles of their philosophical conceptions. The former focused on how language reflects a human’s world and serves as a means of expressing their knowledge and aspirations. The latter, on the contrary, interpreted the world as a reflection of language that expresses itself through human. As a supporter of analytic methodology and, accordingly, of accuracy in formulations, Wittgenstein came to the concept of the unspeakable in the process of reflection on the being of human over the language. But in Heidegger’s existential discourse, which is full of metaphors and neologisms, being of human is limited by the concept of Nothing. As a consequence, it is noted that the ontological status of values is transcendental to the world according to Wittgenstein, but it is immanent to the world, according to Heidegger. It is argued that the Austrian thinker developed a linguo-psychological approach to the study of human through the prism of the mental, but the German philosopher comprehended the human on the basis of the concept of self in the ontological sphere. It has been demonstrated that both thinkers have pointed to the challenges faced by humans in the development of science and technology while emphasizing the importance of substantiating their anthropological foundations. In this paper several recent factor- and dimension-based models of precedential constraint are formally investigated and an alternative dimension-based model is proposed. Simple factor- and dimension-based syntactic criteria are identified for checking whether a decision in a new case is forced, in terms of the relevant differences between a precedent and a new case, and the difference between absence of factors and negated factors in factor-based models is investigated. Then Horty’s and Rigoni’s recent dimension-based models of precedential constraint are critically (...) examined. An alternative to their reason models is proposed which is less expressive but arguably easier to apply in practice. (shrink)

The principle-based approach is a methodology to classify and analyse argumentation semantics. In this paper we classify seven of the main alternatives for argumentation semantics using a set of new robustness principles. These principles complement Baroni and Giacomin’s original classification and deal with the behaviour of a semantics when the argumentation framework changes due to the addition or removal of an attack between two arguments. We distinguish so-called persistence principles and monotonicity principles, where the former deal with the question of (...) whether a labelling or extension of an argumentation framework under a given semantics persists after a change, and the latter with the question of whether new labellings or extensions are created after a change. We furthermore show in which sense labelling-based and extension-based semantics lead to subtly different principles and results. Our results can be used for choosing a semantics for a particular application, or to guide the search for new argumentation semantics, but they have been used also in the design of algorithms. The revelation that menstruation tracking apps share sensitive data with third parties, like Facebook, provoked a sense of violation among users. This case highlights the need to address ethics and governance of health data created outside of traditional healthcare contexts. Commodifying health data breaches trust and entails health and moral risks. Through the metaphor of The Wizard of Oz, we argue that these apps approximate healthcare without the professional competency, fiduciary duties, legal protections and liabilities such care requires and thus (...) represent an innovation in the annals of snake-oil salesmanship and the systematic devaluing of women’s bodies, lives, and work. An extensive introduction presents Bate's life and work and sheds new light on the reception and use of Greek, Latin, Arabic, and Hebrew texts among scholars in Paris at the end of the 13th century. ABSTRACTUsing qualitative content analysis, informed by a Critical Discourse Analysis approach, this article examines the production, content and reception of print and online media discourses concerning the 2017 ‘Welfare Cheats, Cheat Us All’ campaign in the Republic of Ireland. Our article is situated in the context of recent debates concerning the media’s role in articulating ‘disgust’ discourses focused on ‘welfare fraud’, poverty and unemployment. Central to these processes is the social construction of those who are deemed to be (...) the ‘deserving poor’ or the ‘undeserving poor’. Our corpus includes records of in-house debate within the Department of Social Protection; the campaign’s documentation; print media and on-line media coverage of the campaign. The article’s findings demonstrate the ways in which welfare ‘fraud’ is mis-represented by the state and media. It also evidences ways in which such hegemonic discourses can be challenged in traditional and ‘new’ media settings. (shrink)
