Both radical rebellion and humanitarian intervention aim to defend citizens against tyranny and human rights abuses at the hands of their government. The only difference is that rebellion is waged by the oppressed subjects themselves, while humanitarian intervention is carried out by foreigners on their behalf. In this paper, it is argued that the prudential constraints on war (last resort, probability of success, and proportionality) impose tighter restrictions on, or demand more of, humanitarian interveners than they do (...) of rebels. Specifically, I argue that rebels enjoy exemptions from the success principle that do not apply to humanitarians, and that rebels are not constrained by the foreseen mediated consequences of their actions ? consequences that are interceded by the agency of other parties. The same cannot be said for intervening states. If this is right, then it is possible for a humanitarian intervention to fall short of the prudential conditions of legitimate war despite being expected to accomplish no less, and to cost no more, than a rebellion which is rightly judged to satisfy these conditions. The article investigates the implications of mediatization for the legitimation strategies of humanitarian organizations. Based on a corpus of ~400 pages of brochure material from 1970 to 2007, the micro-textual processes involved in humanitarian organizations’ efforts to legitimate themselves and their moral claim were examined. A time trend analysis of the prioritization of actors in the material indicates that marked shifts in legitimation loci have taken place during the past 40 years. A discourse analysis unfolds the three dominant (...) discourses behind these shifts, namely legitimation by accountancy, legitimation by institutionalization, and legitimation by compensation. The analysis relates these changes to a problem of trust associated with mediatization through processes of mediation. (shrink)

One of the most commonplace worries about humanitarian intervention relates to the perverse incentives that it might create, or the adverse reactions that it might provoke. For instance, it is sometimes said that by weakening the norm of sovereignty humanitarian intervention can encourage unscrupulous states to wage aggressive wars of self-interest using human rights as a pretense. It is feared, in other words, that humanitarian intervention—even when it has the purest motives—might ultimately do more harm than good (...) by inciting unwanted reactions from other states or substate groups. I will refer to these kinds of knock-on effects as the mediated consequences of intervention. They are brought about via the interceding agency of parties other than the intervener. It is generally assumed that when judging the proportionality of a humanitarian intervention, these consequences must be factored into the equation. If an intervention is expected to provoke adverse reactions the accumulated costs of which will outweigh the benefits that the intervention will deliver, then the intervention is thought to be disproportional and, therefore, unjustified. I want to challenge this assumption. I begin by considering what the principle of proportionality can reasonably demand of rebels who are defending their own basic rights against an oppressive government. I argue that a rebellion in such circumstances cannot plausibly be rendered impermissible solely by the expectation of negative mediated consequences, even when those consequences outweigh the anticipated benefits of the rebellion. This would seem to imply that rebels may discount mediated consequence from the proportionality calculus. But if this is so, do we have sound reasons for withholding the same prerogative from humanitarian interveners pursuing similar ends and using similar means? Can we justify asymmetric standards of proportionality? (shrink)

Considering that negative intergroup emotions can hinder conflict resolution, we proposed integrative emotion regulation as possibly predicting conciliatory policies towards outgroups in violent conflict. Two studies examined Jewish Israelis’ self-reported IER, empathy, liberal attitudes, and support for humanitarian aid to Palestinians in Gaza. Study 1 found that unlike reappraisal Jewish Israelis’ ability to explore emotions promoted concern for others’ emotions, which in turn predicted support for humanitarian aid. Study 2 replicated this mediation model, additionally confirming that liberal (...) attitudes moderated the relation between IER and support for humanitarian aid. Thus, IER linked more strongly with humanitarian support when the commitment for liberal egalitarian beliefs was high. Preliminary results hold important theoretical and practical implications regarding the potential to empathise with outgroup members in intractable conflicts. (shrink)

Nahdhatul Ulama (NU) and Muhammadiyah are two moderate Islamic organizations in Indonesia which operate in the area of preaching amar ma’ruf nahi munkar, and enlightenment tajdid, sourced from the Al-Quran and Sunnah. Besides being known as a religious organization, NU and Muhammadiyah are also known as organizations that play an active role in the humanitarian field. The study is based on the premise that religious discourse as a resolution can come in various forms and strategies, even by involving actors (...) from across disciplines and countries. Hence, the purpose of this study was to determine the role of NU and Muhammadiyah organizations in reducing conflict and realizing peace in the Middle East. This research used a qualitative descriptive case study method with NU and Muhammadiyah as research subjects. Miles and Huberman model was used for data analysis which required data collection, data presentation, data condensation, and drawing conclusions. In this study, it was found that in helping to create world peace, NU and Muhammadiyah had done a number of things. In the international arena, NU played a major role in global peace efforts. This role can be seen when NU actively initiated, organized, and led various meetings and conferences and interfaith dialogues. NU also formed the International Conference of Islamic Scholars or the Ulama Conference. and World Muslim Scholars. The role of Muhammadiyah, too, included resolving conflicts in Central Africa, Palestine, and the Rohingya Muslim Conflict. In resolving the Middle East conflict, Muhammadiyah was actively involved in sending aid, for example in the Palestinian conflict, Muhammadiyah formed Muhammadiyah AID. (shrink)

The phenomenal success of the Internet has strengthened this strategic position by broadening the range of translating skills and their fields of application. This article demonstrates a priori cosmopolitan values of restraint and harm limitation exist to establish a cosmopolitan “no-harm” duty in warfare, predating utilitarianism and permeating modern international humanitarian law. In doing so, the author exposes the atemporal and ahistorical nature of utilitarianism which introduces chaos and brutality into the international legal system. Part 2 conceptualises the duty as derived from the “no-harm” principle under international environmental law. Part 3 frames the discussion within legal pluralism and cosmopolitan ethics, arguing that (...) divergent legal jurisdictions without an international authority necessitates a “public international sphere” to mediate differences leading to strong value-commitment norm-creation. One such norm is the “no-harm” duty in warfare. Part 4 traces the duty to the Stoics, Christianity, Islam, Judaism, African traditional culture, Hinduism, and Confucianism. The World Bank estimates that over one billion people currently lack official identity documents. To tackle this crucial issue, the United Nations included the aim to provide legal identity for all by 2030 among the Sustainable Development Goals. Technology can be a powerful tool to reach this target. In the digital age, new technologies increasingly mediate identity verification and identification of individuals. Currently, State-led and public–private initiatives use technology to provide official identification, to control and secure external borders, and to (...) distribute humanitarian aid to populations in need. All of these initiatives have profound implications for the protection of human rights of those affected by them. Digital identity technologies may render individuals without legal documentation more visible and therefore less vulnerable to abuse and exploitation. However, they also present risks for the protection of individuals' human rights. As they build on personal data for identification and identity verification, data protection and privacy rights are most clearly affected. The prohibition of discrimination in the digital space is also of concern as these technological advances' societal impact is not yet fully understood. Accordingly, the article argues that emerging digital identity platforms will only contribute to the protection of human rights if the providers adequately mitigate any risks of potential discrimination and promote high standards of privacy and data protection. The article attempts to re-think active citizenship both from the point of view of social practice and scientific perspective and from the standpoint of modern social philosophy. It is shown that globalization is one of the most used terms of modern socio-humanitarian discourse but simultaneously one of the most difficult to define. Any research related to the global is also related to the national because the reception of global influences is different in different cultures. From the perspective of 2022, (...) the research shows a globalization crisis in the classical sense of the word. It is about the crisis of real and nominal political power, which are often incompatible with each other. In many countries, the desire for “strong statehood” is even stronger. It has been proven that the impact of globalization on society is actively mediated by civil society. In a philosophical sense, a developed civil society as a completed form of morally determined life is almost an ideal product of the history of civilization. The first trend of active citizenship transformation is economic liberalization. The second feature that determines changes in active citizenship is political pluralism. Active citizens control the basis of the activity of the modern state. In these conditions, the control function of the institution of citizenship becomes extremely important for the stable existence of political regimes and for achieving political stability. Another trend in the transformation of active citizenship is the growing role of the state in global processes. It was possible to distinguish two levels of transformation of active citizenship in the era of globalization. The first is interiorization, and the second is exteriorization. It has been proven that active citizenship is not only a social connection of people but also a way of existence characteristic of any civilized human community. (shrink)

While living a life based on universal principles is well accepted by many, the reality of living acts as a great detriment to those who want to centre their lives on these timeless truths. Further, institutional mechanisms and work environments do not conform in general to such principle-centred living. The agents of the state, especially those in the police, have to work under tremendous obstacles and pressures from within and without, and often get a bad reputation, sometimes undeservingly. Moreover their (...) value systems may also degrade in these environments, a direction that requires to be altered by the ‘guardians of the law’. It is important to bring about alignment of values and ethical perceptions of state administrators with some universal laws. The Buddhist practice of vipassana mediation can play a significant role in such transformations, as is evident from the responses from Delhi Police personnel who underwent vipassana in one of their training programmes. Vipassana has made significant differences in the lives and perceptions of these trainees—both at the professional and personal level. This paper introduces these concepts and cites evidences from the feedback sheets of trainees to recommend worldwide adoption of such practices for those who occupy seats of power and responsibility. The feedback shows positive and very encouraging trends in all dimensions—work related, humanitarian, family and self—in other words, in professional, personal and deep inner lives. (shrink)

An increase in global violence has forced the displacement of more than 70 million people, including 26 million refugees and 3.5 asylum seekers. Refugees and asylum seekers face serious socioeconomic and healthcare barriers and are therefore particularly vulnerable to physical and mental health risks, which are sometimes exacerbated by immigration policies and local social discriminations. Calls for a strong evidence base for humanitarian action have encouraged conducting research to address the barriers and needs of refugees and asylum seekers. Given (...) the role of epigenetics factors to mediate the effect of psychological and environmental exposures, epigenetic modifications have been used as biomarkers for life adversity and disease states. Therefore, epigenetic research can be potentially beneficial to address some of the issues associated with refugees and asylum seekers. Here, we review the value of previous and ongoing epigenetic studies with traumatized populations, explore some of the ethical challenges associated with epigenetic research with refugees and asylees and offer suggestions to address or mitigate some of these challenges. Researchers have an ethical responsibility to implement strategies to minimize the harms and maximize the short and long-term benefits to refugee and asylee participants. (shrink)

The paper is a partly provocative essay edited as a humanitarian study in philosophy of science and social philosophy, reflecting on the practical, “anti-metaphysical” turn taken place since the 20th century and continuing until now. The article advocates that it is about time it to be overcome because it is the main obstacle for the further development of exact and natural sciences including mathematics therefore restoring the unity of philosophy and sciences in the dawn of modern science when the (...) great scientists were philosophers as a necessary condition for their revolutionary achievements, and the physicists were simultaneously mathematicians not less than philosophers and even theologians as Descartes, Newton, Leibnitz were just as their predecessors, Copernicus or Galileo Galilei. The revolution in science accomplished by them needed philosophy since any scientific revolution, then necessarily growing into social, needs philosophy; and if ones wish to prevent social revolutions originating from fundamental scientific discoveries, in turn relying on the close link of sciences and philosophy, they are to cut the link at issue, and just that happened in the 20th centuries therefore implicitly heralding a “brave new world” of eternal normal science without revolutions whether scientific or social. Fukuyama’s “end of history” requires an “end of scientific history” as it is an obligatory premise, and separating sciences from philosophy is sufficient for that, though proclaimed quite otherwise: as overcoming metaphysics preventing sciences and substituting them by quasi-sciences. Particularly, that “anti-metaphysical turn” has established for science to obey society absolutely and thoroughly, obviously a condition contradicting the scientific and social revolutions in Modernity featured by the domination of science over society by the mediation of philosophy able to translate all epochal scientific discoveries as social corollaries. A special attention is paid to quantum mechanics, being the frontier of physics in the 20th century, where that anti-metaphysical turn is discernibly concentrated and may be notated by the famous slogan “Shut up and calculate!” regardless of its authorship. Just the revolutionary discoveries in physics, for example those of “dark mass” and “dark energy” or entanglement force now its rejection therefore restoring the unity of philosophy, mathematics and physics, made ever possible the establishment of modern science by its emancipation from religion, and thus and ind final analysis, from society. This study investigates how students’ national identity affects their historical understanding by mediating their use of affective historical empathy. The research focuses on the case of “comfort women” (women forced into sexual slavery for Japanese soldiers during WWII) in South Korea—a topic in which a strong nationalist narrative dominates social and educational discourses. I conducted semi-structured, task-based group interviews with 16 high school students in South Korea. In interviews, students’ national identity mediated how they utilized four types of affective historical (...) empathy: Students as ethnic Koreans cared more about “our” Korean comfort women over others; cared that Korean comfort women and others suffered from what “we” and “they” did as nations; cared for those women's voices from a humanitarian perspective beyond their ethnic and national boundaries; and cared to make social changes for those women and themselves as future citizens of their democratic nation. These findings help us understand how students’ emotional attachment to “our” nation and its members can mediate their historical understanding through affective historical empathy as well as how affective historical empathy can motivate students to move beyond purely nationalistic concerns. This case study also stimulates reflection on historical empathy's implications for students’ democratic civic participation. (shrink)

A legal system of mankind seems now more possible than ever before. The universalistic claim of the ICC, I contend in this article, is nevertheless potentially biased by a West-centric prejudice. And the aesthetic-political rationality in Foucault’s ethics is compared with Wellner’s suggestions of holding on to the notion of code but with a new meaning. (...) Bioethics mediation is increasingly used as a method in clinical ethics cases. My goal in this paper is to examine the implicit theoretical assumptions of the bioethics mediation method developed by Dubler and Liebman. According to them, the distinguishing feature of bioethics mediation is that the method is useful in most cases of clinical ethics in which conflict is the main issue, which implies that there is either no real ethical issue or if there were, they are (...) not the key to finding a resolution. I question the tacit assumption of non-normativity of the mediation method in bioethics by examining the various senses in which bioethics mediation might be non-normative or neutral. The major normative assumption of the mediation method is the existence of common morality. In addition, the four-principle formulation of the theory articulated by Beauchamp and Childress implicitly provides the normative content for the method. Full acknowledgement of the theoretical and normative assumptions of bioethics mediation helps clinical ethicists better understand the nature of their job. In addition, the need for a robust philosophical background even in what appears to be a purely practical method of mediation cannot be overemphasized. Acknowledgement of the normative nature of bioethics mediation method necessitates a more critical attitude of the bioethics mediators towards the norms they usually take for granted uncritically as valid. Education as a deliberate activity and purposive process necessarily involves mediation, in the sense that the educator mediates between the child and the world. This can take different forms: the educator may function as a guide who initiates children into particular practices and domains and their modes of thinking and perceiving; or act as a filter, selecting what of the world the child encounters and how; or meet the child as representative of the adult world. I look at these (...) types of mediation at the hand of the work of John Dewey, Martin Buber, Hannah Arendt, and Richard Peters. The purpose of this paper is to explore the bearing that the mediating role of the educator—as interpreted by these authors—has on the role wonder may play in the educational process. I suggest that initiation highlights the familiarizing function of wonder, and is most readily associated with inquisitive wonder; representation draws attention to the defamiliarizing role of wonder, as well as to its world-affirming role; and selection foregrounds the distinction between momentary and dispositional wonder. Mediation is an alternative dispute resolution process that is becoming more and more popular particularly in English-speaking countries. In contrast to traditional litigation it has not benefited from technological advances and little research has been carried out to make this increasingly widespread practice more efficient. The study of argumentation in dispute mediation hitherto has largely been concerned with theoretical insights. The development of argumentation theories linked to computational applications opens promising new horizons since computational tools could support mediators, (...) making sessions quicker and more efficient. For this, we need tools for close analysis of mediation discourse in order to explore the argumentative activity in depth, and ultimately get an accurate image of how dialogues unfold in this particular context. This paper therefore aims at laying the foundations of a theory of close analysis for discourse in dispute mediation. Theories provided by the literature serve as a basis for argumentative analyses of transcripts of mediation sessions in order to deliver a clear image of the argumentative structure. Analyses of the argumentative strategies in mediation discourse will allow for the development of a dialogue protocol that can be used to develop operational models which can be embodied in software to help make the mediation process easier and more effective. Clinical ethics mediation is invaluable for resolving intractable disputes in the hospital. But it is also a critical day-to-day skill for clinicians, especially those who serve a disproportionate number of vulnerable patients. While mediation is typically reserved for intractable cases, there are two important opportunities to expand its use. First is preventative mediation, in which clinicians incorporate clinical ethics mediation into their daily routine in order to address value-laden conflicts before they reach the point at which (...) outside consultation becomes necessary. Second is guided mediation, in which clinical teams resolve conflicts with patients or surrogates with guidance from an ethics consultant, who operates at some distance from the conflict and, rather than recommending a single action, counsels clinicians on the process they can use to resolve the conflict on their own. These approaches build the capacity of all clinicians to use clinical ethics mediation to improve the care of vulnerable patients. (shrink)

Given its centrality to the intellectual thought processes through which the great structures of logic, nature, and spirit are unfolded it is clear that mediation is vital to the very possibility of Hegel’s encyclopaedic philosophy. Yet Hegel gives little specific explanation of the concept of mediation. Surprisingly, it has been the subject of even less attention by scholars of Hegel. Nevertheless it is casually used in discussions of Hegel and post- Hegelian philosophy as though its meaning were simple (...) and straightforward. In these discussions mediation is the thesis that meanings are not atomic in that the independence of something is inseparable from its relation to something else. Hence being is mediated by nothing, the particular by the universal, the individual by society. But does Hegel ever explain mediation in a way which justifies such use of the concept? The same easy employment of mediation is found in Theodor Adorno whose works are replete with the use of this concept and, indeed, acknowledgements of its Hegelian origin. But the concept of mediation in Adorno’s negative dialectic is operative in an entirely different context from that of Hegel. How, it might be asked, can a concept be so adaptable? I want to argue that mediation is, in fact, an equivocal term which in both Hegel and Adorno covers a variety of entirely different conceptual relations. Furthermore, as propounded by both Hegel and Adorno it lacks the rigour which could allow the particular conclusions which the concept allegedly facilitates. (shrink)

This article explores the accounts of Canadian-trained health professionals working in humanitarian and development organizations who considered not treating a patient or group of patients because of resource limitations. In the narratives, not treating the patient(s) was sometimes understood as the right thing to do, and sometimes as wrong. In analyzing participants’ narratives we draw attention to how medications and equipment are represented. In one type of narrative, medications and equipment are represented primarily as scarce resources; in another, they (...) are represented as patient care. In the contexts respondents were working, medications and equipment were often both patient care interventions and scarce resources. The analytic point is that health professionals tend to emphasize one conceptualization over the other in coming to assert that not treating is right, or wrong. Rendering tacit ethical frameworks more explicit makes them available for reflection and debate. (shrink)

Exploring the factors influencing entrepreneurial intention is crucial to entrepreneurial practice and education. For a comprehensive understanding of the influence of narcissistic personality on entrepreneurial intention, this study analyzed the relationship between narcissistic personality, entrepreneurial self-efficacy, and entrepreneurial intention in college students sampled from three higher vocational colleges in Beijing, China. A total of 252 valid questionnaires were collected. The results show that the narcissistic personality of the college students has a significant positive effect on entrepreneurial intention and entrepreneurial self-efficacy. (...) Entrepreneurial self-efficacy of the college students has a significant positive effect on entrepreneurial intention and plays a partial mediation role in the relationship between narcissistic personality and entrepreneurial intention. Research productivity is an important criterion for the university to assess teachers. Studies about factors that affect teachers’ research productivity are increasing nowadays. It is generally agreed that academics’ research productivity depends on how much mentorship is provided to them and how the current working environment is mediated by their research motivation and self-efficacy. Despite the increasing amount of the literature along this line, we know little about what kinds of situations that Chinese university English as a foreign language (EFL) (...) teachers are in and how they regard the importance of mentorship and what roles their working environments would play in affecting their research productivity. To fill the research gap, we utilized the snowball method to collect the survey data from 546 Chinese EFL tertiary teachers. The results show that mentorship is not correlated with research productivity while the working environment has a positive direct correlation with it. Both motivation and self-efficacy mediate the working environment and research productivity significantly. Specifically, only extrinsic motivation has a negative mediation influence on teachers’ research productivity; teachers’ intrinsic motivation and self-efficacy play a positive mediation role in affecting their research productivity. The article examines the efficacy of social dialogue as a mechanism for addressing societal issues. While social dialogue was once viewed with great optimism, its effectiveness has waned in recent years, despite participants employing various persuasive strategies. The study distinguishes between two forms of dialogue: formal and substantive (productive), emphasizing that only the latter genuinely catalyzes shifts in participants’ perspectives. By analyzing historical examples and contemporary cases, the study identifies key factors that influence the success of social communication. Employing J.L. (...) Austin’s speech act theory, the article frames dialogue not merely as an exchange of information but as a form of social action, where the utterances of participants are performative, possessing the power to directly transform social reality. A historical case study is presented, examining the dialogue between Western-oriented Russian liberals who viewed their nation as socially and economically backward, and thinkers who challenged this assessment, perceiving Russia’s unique spiritual potential to address pan-European challenges. The statements of P.Ya. Chaadaev and F.M. Dostoevsky are analyzed as performative acts that shaped a new vision of Russia’s role in world history. Additionally, the author explores the role of identity in social dialogue, showing through examples from the lives of A.S. Pushkin and M.I. Tsvetaeva how identity structures can influence one’s openness or resistance to personal transformation in the face of internal conflict. The study hypothesizes that dialogue effectiveness correlates with participants’ ability to integrate new values into their identity without compromising its core. Furthermore, the author argues that rhetorical commitment to mediation alone is insufficient for bridging deep social divides and examines the historical social conditions required for effective mediation, such as a shared cultural foundations, formal dialogue platforms, robust legal frameworks, and flexible power structures. In conclusion, the author considers the question of whether it is inherently possible to create effective mechanisms for social dialogue under the current conditions of globalization and information society.
