The Dialectical Forge identifies dialectical disputation as a primary formative dynamic in the evolution of pre-modern Islamic legal systems, promoting dialectic from relative obscurity to a more appropriate position at the forefront of Islamic legal studies. The author introduces and develops a dialectics-based analytical method for the study of pre-modern Islamic legal argumentation, examines parallels and divergences between Aristotelian dialectic and early juridical jadal-theory, and proposes a multi-component paradigm—the Dialectical Forge Model—to account for the power of jadal in (...) shaping Islamic law and legal theory.In addition to overviews of current evolutionary narratives for Islamic legal theory and dialectic, and expositions on key texts, this work shines an analytical light upon the considerably sophisticated “proto-system” of juridical dialectical teaching and practice evident in Islam’s second century, several generations before the first “full-system” treatises of legal and dialectical theory were composed. This proto-system is revealed from analyses of dialectical sequences in the 2nd/8th century Kitāb Ikhtilāf al-ʿIrāqiyyīn / ʿIrāqiyyayn through a lens molded from 5th/11th century jadal-theory treatises. This article argues that Habermas’s division of the process of Western modernization into cultural modernity (a pure normative sphere) and social-economic modernization (a pure technical-logical or instrumental sphere) and his use of this theoretical-political standpoint in order to ground a model of radical political democracy as an impartial, neutral, impersonal and formal procedural juridical-political paradigm based on the dialectics between institutionalization and spontaneity lead to strong institutionalism in politics. The notion of modern social systems or institutions as structures (...) of impartial, neutral, formal and impersonal proceduralism with a technical-logical or instrumental sense, constitution and evolution implies their non-political and non-normative understanding, depoliticizing them. As a consequence, institutions (especially political and economic ones) become self-referential and self-subsisting structures-subjects which are centralized and managed by institutional elites and technicians from a technical-logical standpoint-dynamics. We argue that a model of radical political democracy must overcome such separation between cultural modernity and social-economic modernization, politicizing the social systems and making them normative-political institutions-subjects streamlined and defined by social struggles between conflicting social classes, their hegemony and counterpoints. Currently there is a widely held view that international law and its historiography did not emerge until the nineteenth century, with earlier forms of jus gentium or Völkerrecht being consigned to the status of a superseded ‘pre-history’. It is not widely understood that this view itself belongs to a particular kind of historiography–the dialectical historiography of international law–that was born in 1840s Germany, and wielded this viewpoint as a cultural-political weapon to exclude its rivals from ‘modernity’. In outlining a history (...) of this dialectical historiography, the present article focuses on the reception of Kantian and Hegelian philosophies, understood as species of Protestant rationalist metaphysics, in the juridical-political arena of the German Vormärz. Dialectical histories and theories of international law were the effects and instruments of this reception, which gave rise to the new academic subculture of philosophical international law. This subculture in turn permitted the fashioning of a new intellectual persona, the philosopher-jurist, who could claim to transcend positive treaty-based international law through personal insight into a ‘common international legal consciousness’, and to treat this insight as the threshold of ‘modern’ international law. This paper looks at key points of convergence and divergence in Hegel and Adorno on the question of the dialectics of humanity and nature as these unfold in institutions. Bearing in mind the distinct historical periods in which they worked, particular attention is paid to the ways in which their respective epistemologies deliver very different assessments of social and political life in modern societies. This is illustrated by contrasting Hegel's notion of recognition with the utopian dimension of Adorno's ideas (...) on non-identity and mimetic reconciliation. It is shown that in opposition to those who regard Adorno exclusively as a philosopher and aesthetic theorist, his ideas have social and juridical relevance, as well as continuing resonance in the history of political thought. Rationality and reasonableness can be illustrated as Janus-faced concepts, not only in a descriptive diagnosis but also in a normative construction of adjudication, and in the analysis of its practical and rhetorical effects. Considering such an illustration, the present reflection returns to the discussion on the relevance of rationality and reasonableness in legal interpretation, aiming at distinguishing and/or connecting principles and criteria, beyond formally logical and/or procedurally argumentative decision-making, and, thus, within a normatively practical adjudication. Such an approach will be (...) presented in two main steps. In a first step, the rationality/reasonableness dichotomy will be discussed within a constitutive connection between principles and criteria in adjudication, and understanding legal principles as normatively substantial foundations to legal criteria—the former as axiological references filtered into the juridical system and the latter as their concretizations, and whose practical adequacy is rhetorically assigned by the interpretive communities involved in/by adjudication, and normatively referred both to their practical accordance to the axiological normativity of the principles they shall presuppose and to their suitability as practical operators to the problematic relevance of the sub judice cases. In a second step, and consequently, encompassing the projection of legal interpretation, in semiotic and in practical-normative perspectives, in order to discuss their constituting practical relevance in adjudication, the rationality/reasonableness dichotomy will be experimented within formal-logical procedures and within practical-dialectical connections between juridical problem and juridical system—therefore stating a discussion on the foundations, the intentionality and the consequences of adjudication, amongst deduction and analogy. The study of argumentation is prospering. After its brilliant start in Antiquity, highlighted in the classical works of Aristotle, after an alternation of ups and downs during the following millennia, in the post-Renaissance period its gradual decline set in. Revitalization took place only after Toulmin and Perelman published in the same year their landmark works The Uses of Argument and La nouvelle rhétorique. The model of argumentation presented by Toulmin and Perelman’s inventory of argumentation techniques inspired a great many scholars (...) in various ways to take up the study of argumentation in a serious manner. Nowadays there are well-established logical approaches to argumentation, but also social and socio-psychological, linguistic, juridical and other approaches. In most of these approaches traces can be found of the influence of the classical and neo-classical argumentation theories just mentioned. (shrink)

The paper aims to clarify the sense of contemporary fascism, particularly from the example of the Brazilian Bonsolarism, defining it as an anti-systemic, anti-institucional, anti-juridical and infralegal perspective with a personalist, devoted, voluntarist, spontaneous and militant character which starts from inside judiciary and in terms of subversion of the relation among law, politics and moral, and that, by means of politicization and partisanship of law, branches to the political system, serving as instrument to the fratricide political war among parties, (...) from there linking to civil society in the form of constitution of a digital-social mass-militia of acclamation oriented to an anti-systemic posture. In this dynamic, the fascism has two constitutive and streamlining cores: on one side, it subverts the correlation of human rights and law, delegitimizing and truly destroying the ontogenetic primacy, the separation, the differentiation, the self-referentiality and the overposition of law in relation to politics and moral, as the subsidiarity of them regarding law; on other, it leads to the deconstruction from inside to judiciary and political system of the highly institutionalist, legalist, technical, formal and depersonalized perspective which is proper to them, eliminating the centrality of the judiciary and, them, delegitimizing its regulator role regarding to political system and to the social dialectics, normalizing the totalizing regression caused by political-moral colonization of the democratic law. By reconstructing the pluralist and universalist democracy’s meta-normative and generative basis as a public system of law, that is, the co-originality of universality of human rights, pluralism and law, the condition of ontogenetic primacy, independence, self-subsistence and overposition of law in relation to politics and moral, as the subsidiarity of these regarding to law, we will point to the renewal of this systemic, systematic, procedural, mediated, instancial, progressive and publicized perspective of the public system of law, in the interrelation, separation and overposition of judiciary and political system, demarcated by a strong ideal of methodological-procedural-axiological institutionality, legality, technicality, formality and depersonalization, which eradicates the politicization and partisanship of law and, by devolving the complete integrality to law-judiciary, confines the democracy’s political system and civil society to their true limits which are its structural basis: the human rights, the legal process and the public system of law, with the necessity of full translation of politics and moral to law, delimitating the pluralist and universalist democracy as a public system of law oriented to the production of universality in/as/by legality. Around the 1960's, C. Perelman / L. Olbrechts–Tyteca and S. Toulmin endorsed the separation between argumentation and logic. In fact, both assumed a gap between everyday reasoning, closer to legal reasoning, and scientific reasoning based on mathematics. The main claim was that both paradigms are incommensurable, since the legal paradigm makes use of the notion of formality, that has a procedural nature with roots on a conversational and dialectical practice, and logic is based on the notion of form, that involves (...) static (and syntactic) features. I will contest the incommensurability of both paradigms, as J. van Benthem (2009) did already, and plea that what we need is more rather than less logic. There are no juridical solutions to logical problems, if the problem is related to reasoning, then the solution relates to inferences drawn on the basis of juridical knowledge. (shrink)

A nation is not a creation of the brain but a collective experience. It does not equal the sum of the individuals that compose it but transcends that sum like a global personality that is not only juridical (although there once was a “League of Nations”) but also moral in the highest sense of the word.We may ask ourselves if liberty is indetermination, nonalienation and autonomy in its accomplishment; if it is congenial in the genetic code of the nation (...) for its entire existence or, on the contrary, if there is not a sort of dialectic, that is, historic, aleatory and problematic relationship between these two realities. In fact, there is danger in the desire to find a similarity, even by analogy, between the life of nations and a biological process. The nation is a historical phenomenon appearing through a chain of circumstances in 19th-century Europe, theorized by Europe and often born elsewhere as a reaction to European imperialism. In response to distant suffering, global civil society is being consumed by a generalized witnessing fever that converts public spaces into veritable machines for the production of testimonial discourses and evidence. However, bearing witness itself has tended to be treated as an exercise in truth-telling, a juridical outcome, a psychic phenomenon or a moral prescription. By contrast, this article conceives of bearing witness as a transnational mode of ethico-political labour, an arduous working-through produced out of the struggles of groups (...) and persons who engage in testimonial tasks in order to confront corresponding perils produced by instances of situational or structural violence; it is the work of witnessing, the normative and political substance generated through the performance of patterns of social action, which matters. Using Celan's allegory of the poem as a message in a bottle, I consider bearing witness as a web of cosmopolitan testimonial practices structured around five dialectically related tasks and perils: giving voice to mass suffering against silence (what if the message is never sent or does not reach land?); interpretation against incomprehension (what if it is written in a language that is undecipherable?); the cultivation of empathy against indifference (what if, after being read, it is discarded?); remembrance against forgetting (what if it is distorted or erased over time?); and prevention against repetition (what if it does not help to avert other forms of suffering?). The second part of this publication deals with 1. 17-36 in the unpublished fragment (B), which without doubt form the most original part of the law. For it was not only a question of creating an obstacle to a coup d'État that that would overturn a genuine democracy (represented by a boule and prytaneia of Athenian type, whose members were chosen by lot among the Eretrians), but also of henceforth reestablishing this constitution if a tyranny or oligarchy — interesting association (...) — was imposed by violence. Each citizen was invited to take up arms spontaneously (this clause offered a remarkable dialectical form, a semi-passive participation of Northwestern origin). An eventuality is envisaged of the People being no longer in control of the civic centre, in particular the zone of the boukuterion designated there probably by the term Agoraion (= Metroon at Athens?), or even of them being kept outside the town : in this case the democratie elements should regroup in some part of the territory, a tactic well attested in Greece and even Eretria (the role of the maritime fortress of Porthmos) in order to retake the power. Lastly, sanctions are envisaged against citizens who had not served the cause of the People, while its defenders would be rewarded by the grant of lands and goods belonging to those who had been guilty. A considerable conduding section reviews the principal problems posed by this document : the date, circumstances of its promulgation, place(s) it was exhibited, identity of the legislator, and possible juridical and/or philosophical models. Today it seems certain that the law (necessarily before 336) has to be related to the liberation of Eretria in the autumn of 341, a relatively well documented event. As is a priore probable, an influence by Athenian legislation can be detected in the first part of the text. But a comparison with the celebrated law proposed by Eucrates of Piraeus in 337/6 shows that the Attic model would not account for ail its particularities. The Eretrian law — which is, moreover, the oldest of its kind to have survived on stone — appears radier to be the fruit of an unhappy political experience undergone in the recent past. (shrink)

Among the salient aspects of laughter; I retain its aptitude to administer a kind of punishment – albeit of a relatively mild character. Henri Bergson did not hesitate to adopt for himself the traditional formula that "laughter chastises the ways of life" (Laughter, I.2). I maintain that laughter, seen under this angle, simultaneously conveys an evaluation (commonly a depreciative one) and an immediately implemented punishment. This twofold nature makes of laughter a very specific kind of behavior. The starting point of (...) our approach is the following: as human behavior generally, laughter is itself susceptible of an evaluation. It is of the kind that can be applied to acts of evaluation, and also of the kind that may be applied to punishments. Under the light of this second-order evaluation, laughter may be considered as appropriate or not, as acceptable or not, as deserved or not. This depends principally on the object of laughter. I try to describe some of the norms that are relevant at this second-order level. I also expect such norms to extend their relevance to humor, insofar as it sets out to bring about laughter. The norms that appear at this second-order level (mostly restrictive norms) have a strong social and contextual character. We may describe them without recognizing them as binding. Nevertheless, they do not lack an authority of their own. This is not to say that they are above criticism. There is much to say about humor in ethical and juridical terms. I describe summarily some conflicts of norms that may appear at this second-order level, and claim that there is a dialectical arrangement that best permits to understand how these norms work together. This essay argues that modern sovereignty is not simply a legal or political concept that is coterminous with the modern nation-state. Rather, at the theoretical level modern sovereign power is inscribed into a wider theological dialectic between “the one” and “the many”. Modernity fuses juridical-constitutional models of supreme state authority with a new, “biopolitical” account of power whereby natural life and the living body of the individual are the object of politics and are subject to state control (section 1). (...) The origins of this dialectic go back to changes within Christian theology in the late Middle Ages and the early modern period. In particular, these changes can be traced to Ockham's denial of the universal Good in things, Suárez's priority of the political community over the ecclesial body and Hobbes's “biopolitical” definition of power as state dominion over life (section 2). At the practical level, modern sovereignty has involved both the national state and the transnational market. The “revolutions in sovereignty” that gave rise to the modern state and the modern market were to some considerable extent shaped by theological concepts and changes in religious institutions and practices: first, the supremacy of the modern national state over the transnational papacy and national churches; second, the increasing priority of individuality over collectivity; third, a growing focus on contractual proprietary relations at the expense of covenantal ties and communal bonds (section 3). By subjecting both people and property to uniform standards of formal natural rights and abstract monetary value, financial capitalism and liberal secular democracy are part of the “biopolitical” logic that subordinates the sanctity of life and land to the secular sacrality of the state and the market. In Pope Benedict's theology, we can find the contours of a post-secular political economy that challenges the monopoly of modern sovereignty (sections 4–5). (shrink)

An original form of poetical debate is elaborated in the 12th and 13th century in relation to court lyricism. Under the appellation of “jeux-partis” in “oil” tongue, they meet some success in the urban frame of the “puy d'Arras”. As they formulate a sophistry of love, they intersect a number of different formalisations such as the poetical, juridical and scholastic ones.What is at stake in the debate is expressed on the dilemmatic mode. The argumentation is worked out at large (...) through three basic enunciations: maxims, proverbs and images.The maxim, inscribed as it is in the lyrical discourse that it lays down as being axiomatical for love, has an ambivalent function: on one hand it is the enunciation one intends to dispute, on the other hand it is the form taken by the demonstration. As it combines with a syntax of demonstration it only brings out the illusion of dialectics incidentally revealing the reduddant tautology of “le jeu-parti”. Out of a number of 120 poems, there are no less than 80 proverbial expressions which articulate themselves on the context differently — although they do so in majority through assertive formulations — yet disrupting with its isotopy in so much as they illustrate and enunciate the rule at the same time. The process of examplarisation, in the form of imaged enunciations operate other alterations. If the proverb, descending from the empirical universe, universalizes the situation it refers to, the image alone proceeds inversely: from a general theme it gives an example of one or several anecdotical situations out of which the universalness of the rule emerges.Now, none of those enunciations proceeds from a demonstrative or even properly argumentative logic. They are enclosed in themselves. The interlocutors do not resume what has just been said, unless it be in a blunt form of refutation. The true formalisation is polemical. It consists in a discourse which handles irony, lightly touches insult and seeks after effect rather than reasoning. It builds up its own truth — contradictorily though — as a game played on an audience whose complicity is to be grasped and then requested — for truthfulness does lie right in the midst of the debate and asserts itself unendlessly, such as it is in “les disputes”, those contests between scholars. “Disputes” and “jeux-partis” promote a logic of controversy. They are “argumentations-spectacles”. The elaboration of truth lies elsewhere, in the “Summae” for example. Le “jeu-parti” is aporhetical. If ever there exists an answer to its questioning, it can be found in love poetry the form of which includes the “sic et non” of “la joy”, mirth and play on love. (shrink)

This article seeks to examine the ethico-anthropological dimension at the root of the ricœurian idea of justice, which is developed quite explicitly in Oneself as Another and then picked up in his last work The Course of Recognition. Our hypothesis is that the ricœurian analysis of justice implies an essential relationship between knowledge of oneself and recognition, which is marked by an inherent tension that both links and opposes these two moments in an irreducible dialectic. However, this dialectic runs the (...) risk of disguising a founding sense of justice in the social life of man, both on an interpersonal level and on the political level, which reinforces the institution of justice at the juridical level. So, to begin with, we will try to show how that ethical sense of the just shows itself on the basis of the anthropological analysis of the capacities of the capable man, which reinforces the original correlation between knowledge of oneself and recognition; then we will attempt to relate the fundamental contributions of the hermeneutics of the self to Ricœur’s notion of justice. For Hegel, personhood is developed primarily through the possession, ownership, and exchange of property. Property is crucial for individuals to experience freedom as persons and for the existence of Sittlichkeit, or ethical life within a community. The free exchange of property serves to develop individual personalities by mediating our intersubjectivity between one another, whereby we share another’s subjective experience of the object by recognizing their will in it and respecting their ownership of it. This free exchange is grounded the abstract (...) right to property which is defined by the liberal institution of private property. Like all legal/juridical rights, the abstract property right and its related institution are productions of the state, which can also claim priority over them. This prioritization reveals the dialectic inherent in the both the conception and exercise of the right, in which the private right to property at the level of civil society confronts the public right of the state, resulting in both the preservation and uplifting of the right, and, at the same time, its cancellation or annihilation. Minneapolis: Univocal Publishing. 2012. 200 pp. | ISBN 9781937561086 | $22.95 Conveying to potential readers the significance of a book puts me at risk of glad handing. It’s not in my interest to laud the undeserving, especially on the pages of this journal. This is not a sales pitch, but rather an affirmation of a necessary work on very troubled terms: human, earth, nature, and the problematic world we made. (...) It is this world that aspirates the silence (so to speak), and therefore the subject which, along with the development of the “made world” exports the excess augmentation of the cosmically missing, this silence of the natural, et cetera. Had we learned from Locke that lesson of “labor,” to consume what we need… but perhaps we need more than what matters? Serres’ Biogea has several functions on this manner, if it is indeed a book to be consumed. First, readers searching for novelistic entertainment have a place to dwell. Biogea deserves a place in your back pocket; biographical generosity and poetic fluidity should satisfy most textual fetishes. For lay philosophers who want to refresh their acumen, Biogea deserves a place on the book shelf, one already reads a sorely needed postmodern tune-up here. Serres’ style is clearly French; he leaves few cheese crumbs on his words, rather preciseness and breathing in the work give way to a sweeping manner that breaks the narrative line of sight. A circular narrative and anachronistic fragmentation of terms allows an abyssal atmosphere to swell, if only to pump into the book the externality of its broader text. Biogea aspires to a higher standard and the book, at times, is thinking this negentropic problem too. Univocal, the publisher, has crafted a book appropriate for the hands to hold and the translations are an achievement of an otherwise difficult writer to translate. Terms are the conditions of a broader text. It is important to note that Serres’ content is as much a thinking of terminal ports. There is a regard for the transportation technology of the written word. For me, this is the mark of genius, a craftiness that tells of a book device that I may trust. Serres is an accomplished thinker and a necessary voice to check the putative trendiness of anti-postmodernist and market-driven theory of endless cultural liquidation. Offering interventions on subjectivity as an open system we are given a chance to affirm the human, not merely to discard it, but to engage its poetic image emotion, the calibratory silent sense of the analogic world; the terms on which we base our efforts. 1 The human is the center of its own negation, constantly mediating it. Something deeper at stake appears in the work then, and it is quite obvious from the onset. Certainly, a book is an intensification of possible text and those who brought this actual book into existence have captured a rarity in regards to the subject matter and artistic accomplishment. I mentioned terms as conditions, so let us understand Biogea as bio-yea, a yes to bios . An affirmation of living and accepting presence for all of its defiance of images, words, and things temporal. Therefore Serres’ existence and its existants plays parts; out of linearity and still like a porous bone pumping blood it manufactures into the fleshy life it becomes. Starting from a man named silence chaos emerges, or the man “Old Taciturn” takes up a journey anticipating a great flood. In other words, a development akin to the one in Genesis. In dealing with this ancestral occupation, fusing Genesis with contemporary philosophical terms, Serres initiates this anachronistic fragmentation under the forming subjectivity of his own autobiography. This mutation in the open system is precisely one of Serres’ terms. There an abyss is at work, stated, but also measured by heels on the ground—the abyss dispatching earthen tensions, that which plays our tunes, that which we abide by and recognize in volcanoes, rivers, oceans, earthquakes and weaponry in the battles of the world. Set in later stages of the book, such tensions are harnessed through scientific principles in an attempt to unify the terms of natural force if only to terminate the world. Thus the elevation of the earth into the world is clearly set forth. Here already, and few pages in, a resonance is set forth under appellations such as the river Garonne, a subjectivity as much as it is inhuman, the river is the inhuman that makes us human. I get the sense that Serres is taking up a challenge issued by Wallace Stevens; namely, that the great poems of heaven and hell have been written, but that only the poem of the earth has resisted composition. 2 On this level we cannot avoid the killing factor of silence, given that our cognition blocks its pure, radical obliteration. Thus a silence of attunement to the earth is in a novel dialectic of the rithmic and rhythm. A technological world, a triumph of termination is set forth. If a text imposes its will given the reader who authorizes it, it is made to convey or convect a presupposition to a reader or its inhabitant(s). Text is therefore both, in-content, contenting, contentedness, and in reading it, a way to navigate self-destruction (dis-content). Here then would one note that the “inhuman” reveals itself, “an aperiodic rhythm of lovers and beloved…the sea as our friend…but as our enemy…maternal vivifying sea.” The sea is an open book, or vaginal birth canal, where the engagement of text comes forth: “…woman sea, open vulva.” One sees like the sea, but only after it, when the uninhabitable truth of inhabiting it switches the polarity of the sailors soul: “I was seeing like the sea” (9-11). In other words, we are invited to embrace the nonsense of the visible. At this point I am taken to Jean-François Lyotard’s work The Inhuman , specifically the first entry on negentropy that would be congruent with Serres’ thematic. 3 The human being exports, deports, or transplants its relation through text, through the system— and this is its sense or relation to silence, to music. Unaware of Serres’ proximity to this work, the concept of gender interrelation as regards a solar catastrophe runs clear. It would be, on this basis, that Serres references his peers, the other texts that, as mentioned above, are discarded in philosophy today. For students of philosophy what we have here is perhaps a gift, a needed project. If silence and death are at work, there is a political valence to deal with, and here, much like the domain of the text and the dominion of the reader, we confront the world of natural, fluid violence. The anti-postmodernist critique is in part based on a weak idea that the loss of ideology, of a world vision, motivates the “correlationist” project. 4 Serres seems to offer another way to view this when he notes that whereas persons “sometimes kill,” it is clearly “the collective” that “always kills” (17). What is the collective today, if not an organizing function we never see yet acts in its favor in the name of truth? One feels a sense of enigma here, if only to link to what Stevens remarked of communism as a “grubby faith,” providing this applies for capitalism as well, namely any ideology of progress overly interested in absolutes. Here we get the sense that the inhuman, silence, this type of killing, always killing, could not be matched by human-made, political dynamos. Or that if it comes to an equilibrium, a catastrophe is never too far from us to read with our heels. We are left to note that the forces of nature presuppose and permeate political systems, the more these systems obtain force, the more the system takes upon itself the proper name of nature that motivates its dissemination, albeit falsely. This note, that in an age of ecocide and technological captivity (sustainability and transparency) political regimes won’t grow our soul-learning ears any larger than our tongues, stands clear to us. The promise of technological desubjectification is here pushed aside. Regarding politics, Serres illustrates this fact: Where did this corpse come from? Who was it? Who killed it? I don’t know. I won’t try to find out. I refuse to get vengeance for it. And I only see Garonne. For our victims, today, are the rivers, too. Their waters have irrigated my life, enchanted my thought, invigorated my body; I’ve known them to be threatening, untamable, as dangerous as the sea when it rages. Yes, murderous. They decided to control their courses; dams, sometimes senseless, destroying sites and valleys, reduced entire populations to servile displacements; programs for the irrigation of thirsty farmland, often beneficial of course, completed their drying up.(22) Serres enters into his idea concerning the captivity of language from the natural into a world system: For thousands of years, we have been licking things with our tongues, covering and daubing them so as to appropriate things for ourselves. If language boils down to a convention, this convention took place between the speakers without consulting the thing named, become as a result the property of those who covered it in this way with their drawn or voiced productions. Malfeasance analyzes these acts of appropriation. Thus every inert object, every living thing as well, sleeps under the covers of signs, a little in the way that, today, a thousand posters shouting messages and ugly riots of color drown, with their filthy flood, the landscapes, or better, exclude them from perception because the meaning, almost nil, of this false language and these base images forms an irresistible source of attraction to our neurons and eyes. This appropriation covers the world’s beauty with ugliness. (38-39) Technological concealment coming to bear, we begin to get a sense of another commentary on the condition of sensing, driving home the necessity of a text dealing with such subject matter to be what its terms insist. Thus toward new openings: The new opening. As low beneath our feet as you like, the Biogea opens us to another space, high enough for us to be able to acquire a wisdom there, that of redeveloping this same place differently from our fathers, this place that’s still politically cut up by old hatreds, beneath the flood of tears and blood that we call history. Without this soft place, spiritually very old, but newly conceived in this way, without the juridical construction of a common good, opposed to our filthy ownership, I don’t see how our planet, hard, will survive. Hardness that depends on a softness, material belonging that depends on this temporary rented location (51). Serres enters into a summit on the content and the structure of his work. Archimedes is brought in with the concept of three volcanoes. Meaning fire, but as well earth, water, air. For it was Archimedes’ war machines that sought to lift the earth, thus bringing in the question of principles of science: “can a principle be invented while controlling its consequences?” (66-7). May the earth be put in a sentence, terminated by terminology, appellations, gone wild? By means of these element-dominating laws, this old physicist began to tear nature away from the ancient myths; by a strange return, today we’re plunging our successes back into the anxieties and terrors from which that ancient physics was born. Yes, our new history of science and technology is plunging, today, as though in a loop, into the fundamental human myths from which Empedocles’ first laws came. A major progression and a regression on the nether side of the origins. Consequently, the contemporary time requires that we try to return to that unity in which the principles of hate and love are at the same time human, living, inert and global. We will never attain a deontology of our knowledge and actions without thinking the subjective, the objective, the collective, and the cognitive all together simultaneously. Here, hate and love are the result of these four components.(71) Working then on the concept of fire-starting mirrors to the atomic annihilation of the Second War, Serres works into the subjectivity in question on the matter of rhythm—say rithmic— precisely at that point: Knowledge is changing today. The all-political is dying; the monarchy of the sciences said to be hard is coming to a close. The science of the things of the world will have to communicate just as much as the things of the world do, which do it much better than humans do, who don’t always want to do it. Let’s celebrate two changes this morning. The first one strikes a new blow to our narcissism. No, knowledge and the world don’t resemble our analytical enjoyments of refined cutting up, of endless debates and of exclusions full of hate. They, on the contrary, form a bloc and a sum, alliance and alloys. Uniting the fields of knowledge among themselves the way the things are connected among themselves, the second newness puts into place sets united by interlacing, webs and simplexes that combine with the things of the world, themselves combined, the combined knowledge that understands them.(130-1) Biogea closes on its opening flood thematic, approaching the initial telos of Genesis. Here the trees are brought into a position with atmosphere, the opaque abyssal reservoir, the tomb of the sun, sea in the polarity of the earthen heaven and hell. The poem of the earth then is silent but deadly, indeed, as funny as that phrase is, mainly a tomb gas. The meaning of the living and the non-meaning of things converge in the muteness of the world; this meaning and non-meaning plunge there and come out, the ultimate eddy. Mundus patet: through a fissure, through an opening, a fault, a cleft come noises, calls as small as these apertures. I’m listening, attentive, I’m translating, I’m advancing in the scaled-down meaning and science. Mundus patet: should the world open greatly, it will launch me into its silence. The totality remains silent. Knowledge expanded in elation. White origin of meaning, fountain of joy. (198) Final Remarks One test of a review is the long term trajectory the referee thinks the book will have. I see Serres’ text lending greatly into the vision of Biogea . In fact, in the vision of the novel inquiries of Stephen Jay Gould’s work there is something to be thought on the level of the individual and the species; namely, that humanity and its uniqueness is in its deferral, its thinking and naming, a thinking surrounded by silence that filters into everything, that pulls us through the world, the kinetic pulse we recognize, and all of that we cleave away in the base philosophical maxim of difference itself. Unique individuals are spatial creatures: we dwell, and we ought to get good at it. Yet this is an imaginative space that, if you are crazy enough to believe it, de-term-ine the conditions of its own terms. That is why we are not merely creating spaces on the acceleration of time, or so this ignoramus thinks, to accidentally transcend. Imagination already has this insatiable silence that we drink up and fail to manifest. Space is timeless. The imagination itself, shared by humans for themselves, their objects, and the species as a whole, is a non-defined space of relation; a whole human trajectory as part of nature, and part of worlds that are the other side of thinking nature, the consequence of it, at least our attempt to do so. Our survival is based on our deliberation, our caution, our natural deconstructive sense toward this silence that is already part of the song, sung, singing of this century without end. Good books will let us inhabit this space and recognize a form of life. Serres’ text moves toward dwelling, as noted, in masterful and accessible ways. The pitched battles are the falling replays of anemic and dead politics. n his account of the state of exception, Agamben repeatedly relies upon what Hegel would have called emWesenslogik/em or #39;transcendental thinking#39;. Because of this reliance, the state of exception appears in Agamben#39;s account as the hidden ground of modern liberal democracies. When conceived as such a ground, it appears to be a condition of possibility that inexorably persists in the modern state. Moreover, within the state of exception all juridical order is suspended, leaving no normative or juridical criteria (...) on the basis of which to decide what the structure of any emergent political order should look like. This means that from the state of exception we can just as easily land in a totalitarian as we can in a liberal democratic or democratic socialist state. Without such criteria - lacking due to the total suspension characterizing the state of exception - Agamben#39;s own alignment with Benjaminian revolutionary messianism over Schmittian authoritarianism is arbitrary, and he leaves us with no basis for making any such decision ourselves. Drawing upon Hegel#39;s dialectic of freedom and his critique of transcendental thought, this paper argues that within the state of exception there is an implicit logic that points the way out of it. Furthermore, it does so in such a way that the state of exception is neither annexed by the structure of a predetermined juridical order along the lines proposed by Schmitt on the one hand nor posited it as a transcendental structure underlying or always preceding modern liberal democracies on the other. This alternative is overlooked by Agamben precisely because of his own insistence upon conceiving of the state of exception in a transcendent way. (shrink)

In response to distant suffering, global civil society is being consumed by a generalized witnessing fever that converts public spaces into veritable machines for the production of testimonial discourses and evidence. However, bearing witness itself has tended to be treated as an exercise in truth-telling, a juridical outcome, a psychic phenomenon or a moral prescription. By contrast, this article conceives of bearing witness as a transnational mode of ethico-political labour, an arduous working-through produced out of the struggles of groups (...) and persons who engage in testimonial tasks in order to confront corresponding perils produced by instances of situational or structural violence; it is the work of witnessing, the normative and political substance generated through the performance of patterns of social action, which matters. Using Celan's allegory of the poem as a message in a bottle, I consider bearing witness as a web of cosmopolitan testimonial practices structured around five dialectically related tasks and perils: giving voice to mass suffering against silence (what if the message is never sent or does not reach land?); interpretation against incomprehension (what if it is written in a language that is undecipherable?); the cultivation of empathy against indifference (what if, after being read, it is discarded?); remembrance against forgetting (what if it is distorted or erased over time?); and prevention against repetition (what if it does not help to avert other forms of suffering?). It is considered a first stage mostly because recognition is rooted in the partners' mutual dependency as needy creatures, which demand care and the emotional approval that follows it. In this sense, a constitutional lacking emerges as the fundamental character (...) of the most primitive kinds of interaction embedded in social norms. And that is important inasmuch the other stages of recognitive practices depend on this first one, in which subjects acquire capacities for rational and moral reasoning and action in the public sphere. However, one could question to what extent the same normative structure can be taking as underlying every loving relationship, as oriented by an affirmation of the subject's independence, while presupposing involuntary feelings of liking and attraction. After all, if the aspirations of reciprocal recognition in this realm are intrinsically related to very concrete features, why taking child caring, friendship and sexual encounter as referred to the same set of recognition patterns? If Honneth's recourse to psychoanalytic theory makes it clear why in all these kinds of interaction is to be found erotic contents of libidinal character, on the other hand one gets no clue on why the very different forms of satisfaction of the drives do not come into consideration. At this point it seems important to recall Georges Bataille's account of sexuality to think not only about the limits of recognition, but also its dialectical structure. The central notion of transgression helps understand why the normative grounds of intersubjective acknowledgment regarding at least some love relationships require a sort of suspension which is not the mere suppression of their validity: the violence that resides at the core of such erotic, transgressive experiences points to a disruptive effect over the features of subjective arrangement, intersubjectively formed. That is why excitement and fear, pleasure and anguish intertwine in eroticism, and desire becomes the name of a fascinating and frightening ontological excess. It is this very paradoxical character that is decisive for Bataille, for if norms need their transgression in order to exert a subjective inscription, one should not take the passage from desire to recognition as just a progressive process towards a determined form of sociality. Bataille associates a certain Durkheimian heritage with a philosophy of life to account for a libidinal economy of recognition in which desire lies at its very core. This paper proposes a reflection on what is at stake in this conceptual operation, and on the significance of the peculiar enjoyment of norms to a rethinking of the particular aspirations of recognition in love relationships. I argue that same-sex divorce presents a different kind of potential constraint to the agency of persons pursuing the dissolution of their marriage; a constraint upon one’s counterstory and the reconstitution of one’s personal identity. The dialectic within the paper mirrors the movements that I have had to make as I have sought to constitute and reconstitute myself throughout my divorce process. Beginning from a juridical perspective, I examine how the constraints on same-sex divorce present constraints on one’s agency (...) that are antithetical to the spirit of a liberal democratic conception of freedom of movement. I then explore the role of narrative in my self-(re)constitution, as well as the limits of the narrative and counterstories, when the institutional framework of the State fails to acknowledge the change in my State-sanctioned personal relationship. I end by arguing that this view from the law ignores the ways in which we relationally constitute ourselves, and in so doing covers over the harms done to persons that find themselves in a married-yet-not state of limbo. In fact the conflict works at two levels, the one of the self-consciousness and the one of the history : the tragic conflict between the gods and the mankind, and then between the man and the fate in the Greek tragedy ; the conflict for the recognition as a fight to the life, to (...) the death ; the juridical conflict, and the disappearance of all conflicts in the State which is really political. But the conflict reappears at the historical level inso far as the State remains a State and the war between the States follows from the interplay of passions and violence. In the Hegel’s philosophy the proper site of the conflict is not the political organization, but rather what is infra-political and historical. In Hegel all is conflict except the Idea of the State. A study in philosophical methodology aimed at providing a clear view of the scope and limits of philosophical inquiry.

Chris Arthur's approach aims at a systematic re-ordering of Marx's categories. This article argues that his approach is actually a different ordering of different categories that are positioned within a specific theoretical whole, a Hegelian re-interpretation of Marx and especially of abstract labour, which distances itself from Marx. While the debate has focused mainly on the philosophical aspects of Arthur's work, its economic features have not been the object of a systematic analysis. Yet, a full assessment of the 'New (...) class='Hi'>Dialectics' should include explicitly a systematic internal critique of its economic dimensions. The aim of this article is to assess the internal consistency of the economic ramifications of the 'New Dialectics'. The focus is on the notions of abstract labour, concrete labour, and exploitation. Arthur's faithfulness to Marx, or correspondence to Marx's quotations, is not the criterion used to assess the 'New Dialectics'. Rather, the criterion is whether it discovers logical inconsistencies in Capital and is itself free from inconsistencies. The answer is negative in both cases. (shrink)

This chapter examines the notion of philosophical truth that Adorno, in Negative Dialectics, believes to be possible by means of his changed conception of philosophy. What that examination finds is that philosophical truth, as Adorno recommends it, is realized through “singular” philosophical experiences. The critical question is that of how the truths that are conveyed through “singularity” can be understood to have persuasive force over us, Adorno's readers. Also examined is the relationship between the philosophically authentic “singularity” approach and (...) the critical endeavors evident, in the same book, through Adorno's engagements with a range of figures from the modern philosophical tradition. The idea at the basis of this special issue is that reopening the old debate about the logical status of Hegel’s dialectics is extremely interesting, for various reasons.1 The first reason is that...

It is a widespread view that Marx did not apply dialectics to nature, and that Engels’s writings on this subject are a distortion of his outlook. This paper examines Marx’s discussion of elliptical motion and some other physical phenomena, and shows that he did indeed find contradictions and oppositions in nature, and thus recognised a dialectics of nature. In addition to analysing relevant passages in Marx’s texts, his study of the physics and mathematics of elliptical motion is reviewed (...) and compared with Hegel’s position. Marx’s conception of how dialectical contradictions are resolved is reviewed in order to interpret his claim that the contradiction in elliptical motion is ‘solved’ but not ‘overcome’ by that motion. Textual evidence is presented that Marx regarded ‘real contradictions’ as resolved only by ‘development’, a process in which the conflict between the opposing sides of the contradiction becomes more intense. The consequences of this interpretation for Marx’s analysis of elliptical motion are explored, and some alternative interpretations are discussed. (shrink)

He is known largely for his original conception of the ideal, which he deployed against both idealist and crude materialist forms of reductionism, including official Soviet Diamat. It especially focuses on two prominent features of Underhill's text: the description of the mystical life as one permeated by an intense love between the mystic and infinite reality, and the detailed delineation of stages of mystical development. Given immunity’s general role in the organism’s economy—both in terms of its internal environment as well as mediating its external relations—immune theory has expanded its traditional formulation of preserving individual autonomy to one that includes accounting for nutritional processes and symbiotic relationships that require immune tolerance. When such a full ecological alignment is adopted, the immune system becomes the mediator of both defensive and assimilative environmental intercourse, where a balance of immune rejection and tolerance governs the complex interactions of the (...) organism’s ecological relationships. Accordingly, immunology, which historically had affiliated with the biology of individuals, now becomes a science concerned with the biology of communities. With this translocation, the ontological basis of the organism is undergoing a profound change. Indeed, the recent recognition of the ubiquity of symbiosis has challenged the traditional notions of biological individuality and requires a shift in the metaphysics undergirding biology, in which a philosophy of the organism must be characterized by ecological dialectics “all-the-way-down.”. One of the most important philosophical principles in contemporary natural science is the principle of the universality of evolutionary development , which was argued with much force and depth in F. Engels's The Dialectics of Nature. For the more than a century that has passed since Engels's sweeping synthesis of knowledge in the natural sciences, his revelation of the unity of the processes of evolution in inanimate and animate nature, including the inevitably and law-governed appearance of its "highest flower, (...) the thinking mind," where appropriate conditions for that appearance arise, this principle of development has assisted in the achievement of many impressive advances. The general outlines of the evolutionary process of nature, in its infinite diversity, are now emerging in ever sharper relief, although our knowledge of that process still contains many rather serious lacunae. It is significant to note that the progress of natural science leads not only to modifications but often even to radical revisions of many notions about the evolution of nature, including those that seemed unchallengeable.
