Comparative research in the area of property law is gaining importance. Against the background of the current discussion of developing model rules, aimed at facilitating European private law harmonisation, and of ongoing law reform projects in a number of EU Member States, this volume addresses key issues in the field of the transfer of corporeal movable property.

This is the first volume of a series of national reports on basic issues concerning the acquisition and loss of ownership of movable assets. The series plans to cover 27 European legal systems, distributed over six volumes, as a product of the research activities of the working group "Transfer of Movables" within the "Study Group on a European Civil Code." Volume 1 examines Austria, Estonia, Italy and Slovenia. Starting with general property law issues â?? like the concepts of ownership (...) and possession employed in the respective legal systems, and the related means of protection â?? the reports primarily deal with the "derivative" transfer of ownership, but extend to good faith acquisition from a non-owner, acquisitive prescription, processing and commingling, and further related issues. The reports provide the reader with detailed information about the respective rules, case law, and legal literature prepared by national property law experts. These reports are a starting point for further comparative research in property law and also a tool for practitioners searching for information on foreign legal systems. Where available and as far as reasonable, the reports include translations of the most important statutory provisions either in the text or in an annex. All reports include a table of literature and a table of abbreviations, which shall facilitate carrying out further research. (shrink)

This book is an expanded catalogue of an exhibit of mid‐fifteenth‐ through seventeenth‐century drawings, woodcuts, engravings, and etchings emphasizing hands as objects of study, as teaching tools, and as reflections of the human being. In addition, it contains an extended introduction by the curator of the exhibit, Claire Richter Sherman, and four essays by other contributors on pertinent topics: the hand as an instrument of the intellect, manual reckoning, music, and chiromancy . These essays, which precede the catalogue itself, (...) are only loosely connected to the exhibit, but each deals with its subject clearly and crisply.In his composition on the hand as a means of expression, Martin Kemp traces the legacy of ancient thought as reflected in the various anatomical drawings from Leonardo through the detailed Bidloo prints. Kemp concludes that the hand remains “a prime mechanism for personal expression—for the manifestation of individual character and identity.” In the following essay Sachiko Kusukawa provides a succinct sketch of finger numeration, noting that a system alluded to by ancient authors was fully described by the Venerable Bede in the eighth century. Bede also wrote of a method of using the hand as a mnemonic aid in determining the proper date for Easter and other movable feasts. Finger counting remained popular throughout the Middle Ages but gradually fell into disuse in the West by the sixteenth century and was merely quaint by the eighteenth. Kusukawa does not, unfortunately, suggest a reason for the decline, but the spread of computation with Arabic numerals was surely a major factor.Next, Susan Forscher Weiss discusses the use of the hand in teaching music theory and scales. Although there are some indications of this practice in antiquity, variations on a system developed in the eleventh century by Guido of Arezzo were used to teach music through the sixteenth century. Finally, Brain P. Copenhaver discusses the history of the pseudoscience chiromancy . Already in existence in antiquity, palmistry, and other forms of divination, flourished despite the prohibitions of the church. Copenhaver concludes with a witty discussion of the hard times on which palmistry has fallen recently in California.As for the catalogue, it consists of eighty‐three monochrome illustrations, each with an extensive commentary about the artist, the subject, and the reason the item was included in the exhibit. These descriptions are frequently fascinating short essays in themselves, enticing the reader to investigate further. The organization is thematic rather than chronological, with six divisions : “Reading the Writing on Hands,” “Handiwork of the Creator,” “Messengers of the World,” “Knowledge on Hand,” “Whole World in the Hand,” and “Guiding Hands.” The faults are minor. Although the themes of the divisions themselves are clearly described in Sherman's introduction, several of the illustrations seem to have only a general association with the stated theme. A few are filled with details too small to be legible in the necessary reduction of plates to fit the book. Most of the illustrations, however, are excellent examples of the main subject of the exhibit and are fascinating studies in their own right.Generally, this volume is a valuable work for anyone interested in the history of the hand in science and the arts. The four prefatory essays are particularly instructive, and the prints are reproduced clearly, with elaborate descriptions of their historical context and their meaning. Accordingly, this book is much more than merely a catalogue; it is an important work in its own right. Throughout, the substantial references to other works indicate directions for further study. One only regrets that the exhibit itself was shown in only two venues. (shrink)

Traditionally, a wayzgoose was a celebration at the end of a printer’s year, a night off in the late fall before the work began of printing by candlelight. According to the OED, the Master Printer would make for the journeymen “a good Feast, and not only entertains them at his own House, but besides, gives them Money to spend at the Ale-house or Tavern at Night.” Following in this line, continent. proposes in its publication(s) a night out and a good Feast, away from the noxious fumes of the Academy and into a night of revelry which begins, but does not end, at the alehouse or Tavern. continent. proposes that the thinking of the Academy be freed to be thought elsewhere, in the alleys and doorways of the village and cities, encountered not in the strictly defined spaces of the classroom and blackboard (now white) but anticipated and found where thinking occurs. Historically, academic journals have served a different purpose than the Academy itself. Journals (from the Anglo-Fr. jurnal , "a day," from O.Fr. jornel , "day, time; day's work," hence the journalist as writer of the news of the day ) have served as privileged sites for the articulation and concretization of specific modes of knowledge and control (insemination of those ideas has been formalized in the classroom, in seminar). In contrast, the academic journal is post-partum and has been an old-boys club, an insider trading network in which truths are (re)circulated against themselves, forming a Maginot Line against whatever is new, or the distinctly challenging. All in a Jurnal’s Work will discuss (in part) the ramifications of cheap start-up publications that are challenging the traditional ensconced-in-ivory academic journals and their supporting infrastructures. The panel will be seeking a questioning (as a challenging) towards the discipline of knowledge production/fabrication (of truth[s]) and the event of the Academy (and its publications) as it has evolved and continues to (d)evolve. Issues to be discussed will revolve around the power of academic publishing and its origins, hierarchical versus horizontal academic modules (is there a place for the General Assembly in academia?) and the evolving idea of the Multiversity as a site(s) of a (BABELing) multivocality in the wake of the University of Disaster. Facebook and Flickr are our era’s administered and generic version of sixties happenings!” — Tan Lin 1 ELECTING A MASCOT: THE BARNACLE GOOSE After pitching the idea for this panel with the editorial help of my continental cohorts I became fascinated with the image of the goose—dead and roasted as it may be—and its relationship to the space of the printing press. For a long while after proposing this gathering I was seriously under the sway of delusions of grandeur, imagining that we might roast a goose (or goosefu) and, preparing a meal as one prepares a text for publication, feast in something approaching a warm and well-nourished revelry. I should note, by way of introduction, that a substantial part of my undergraduate experience involved learning to typeset and work as a devil, as typesetters mischievously call it, in a letterpress studio. This accounts in part for my fascination and helps to explain the fact that, when I began to leaf around in medieval beastiaries in lieu of being able to procure a goose, I was almost immediately struck by a fantastic monster that I hereby elect to be the mascot for our so-called para-academic practice(s) the relatively famed, but no less fabulous for it, barnacle goose. The barnacle goose is a creature that first makes its way into 12th century manuscripts with Giraldus Cambrensis in 1186. Phenomenologically speaking the monster is a tree, a tree which, when approached closer is seen to be birthing geese budding from the buds that hang like ripe fruit from its branches. As the story goes these trees were found over water; the fledgling geese, once wrested from their pods would take off in flight or fall to their watery death, where they would be transformed into driftwood. In retrospect we presume the barnacle goose was posited as a consequence of the fact that geese born in more northern regions, migrating to Ireland and western Europe at large, were never seen to give birth. And I should note that this is far from the only other animal posited to be born from trees at around this time, my other favorite being medieval accounts of Moroccan tree-climbing goats. 2 In particular I’ve thrown up the mascot of the barnacle goose and singled it out from the quires of its beatiaries because its thoroughly hybrid origins lead us to name two very real creatures we can find point to in abundance; discrete materialities of the world cobbled together in textual fancy: on the one hand, the modern day barnacle goose , a common species of goose and, on the other, goose barnacles , a particular type of crustacean with incredible feathery tendrils and—I can't help but mention—one of the largest body mass to penis size ratios of all of the animals in the kingdom. Why is this bit of genital trivia relevant? Because they’re all hermaphroditic and in rare cases have been found to reproduce just with themselves—to inseminate themselves and give birth to their kin. So I think it must be stressed, as a symbol for what we’re really here to talk about, it's not a boy’s club thing so much as a very queer thing and, I contend, para - in every perfect sense of the word... Alongside the natural world, a monstrous imaginary concatenation; Alongside the hulls of so many institutional structures, funding sources and resources, Serresian parasites in all manner of mutualist, symbiotic, or properly parasitic positions; migratory and adrift; The tree, center stage in the 21st century adaptation of Waiting for Godot that is unraveling in ateliers across the world, is a barnacle goose birthing a flurry of miscegenous texts beyond medium and genre. PROVOCATION 1: CHAOSMOSIS “Genre is obsolete.” — Ray Brassier 3 And so, here I was getting carried away in daydreams about this generative and genealogical symbol under which to think all of the diverse projects we are all involved in as architects of the dressed word, (well dressed, bespoke, mansy, butch, careless, or roguishly punk attired as those words may be), when it also dawned on me, mid-flight here from Denver, that we are, even in lieu of being able to roast geese together, very much so literalizing what was never just the metaphor of the wayzgoose—a tradition, as you know, celebrated to mark the crepuscular turn into fall—as we are poised here, tomorrow being the first official day of fall on our calendars in the US marking the seasonal change from at which point it will no longer be possible to print without the aid of candlelight. A beautiful thought, that tipped into magical thinking on account of a little quick math I was able to do to come to the conclusion that we can all be delighted to know that as we proceed into the autumn with our printing projects always ahead of us and still to be set, we will tonight be bathed not only by the artificial candlelight of our screens, but also in part by photons raining down on us at 186,282 miles per second—photons from an aspect of 9 cyg, a stereoscopic binary deep within Cygnus, the swan but not-so-distant-relative of the goose, with a distance of 572 Light years away; photons that are raining down on us, will rain down on us all winter, have been raining down on us all year, and which had their origin in the combustion cores at a center of 9 cyg 572 years ago, in 1440, the year which we point to today as the common year in which, as we all know, Gutenberg is said to have brought the movable type to the western world, inaugurating an era that stretches farther into the past and future than McLuhan could justify; the proliferation of so much ambient text; insurrectionary coups on (and re-crystallizations of) genre—perceived amidst so much ambient light—enveloping this campus, just now. Oggi il libro elettronico imita il libro a stampa come i primi incunaboli imitavano i manoscritti, l’esplosione delle modalità di comunicazione elettroniche è altrettanto rivoluzionaria di quello che fu l’invenzione della stampa a caratteri mobili centinaia di anni fa, e il lettore contemporaneo ha altrettante difficoltà ad assimilare gli e-book di quante ne ebbero i lettori del Quattrocento a familiarizzare con gli incunaboli. Siamo in un periodo nel quale testo a stampa e testo digitale coesistono e sicuramente continueranno a (...) farlo per qualche altro tempo ancora. Non pretendiamo dunque a tutti i costi di analizzare in termini dualistici ( o carta o digitale ) un fenomeno che è ancora in corso e basandoci invece su quello che ci insegna la storia del libro proviamo piuttosto a riconoscere che oggi stiamo assistendo a un cambiamento che almeno per un verso è effettivamente inedito perché, per la prima volta nella storia, avviene simultaneamente su più piani, con la trasformazione contemporanea del supporto della scrittura, della tecnica della sua riproduzione, delle modalità della sua diffusione e infine dei modi di leggere. Today, the e-book imitate the printed book exactly as the first incunabula once imitated the manuscripts; the explosion of the electronic communication is just as revolutionary as it was the invention of the movable type printing hundreds of years ago; and the contemporary reader is facing, with the e-book, the same difficulty than the readers of the fifteenth century have had with the incunabula. We are in a period in which paper and digital definitely coexist and they surely will continue to do it for a few more years to come. So, rather than insisting on analyze in dualistic terms (or paper or digital) a phenomenon that is still in progress, and relying instead on what we learn from the history of the book, we should try to recognize that today we are witnessing a change that at least in one way is actually different because, for the first time in history, it takes place at the same time on several levels, with the simultaneously transformation of the writing's media , the technique of its reproduction, the way of its spread , and finally the practice of reading . The classic communication circuit is being revisited, and the editorial market is meant to grow in the digital era, but throughout a big change in its behavior. (shrink)

Paper, $21.00.Over the scholastics and earliest moderns, Hume had an advantage of hindsight in declaring that "There is no question, which on account of its importance, as well as difficulty, has caus'd more disputes both among ancients and modern (...) philosophers, than this concerning the efficacy of causes, or that quality which made them be followed by their effects" (Treatise I.iii.14). Between the scholastics and Hume fell (i) Descartes, (ii) classical mechanists such as Hobbes and Gassendi, (iii) the Cartesians Le Grand and Malebranche, (iv) the explanatory rationalists Spinoza and Leibniz, (v) later experimental mechanists such as Boyle, Rohault and Newton, and (vi) the so-called empiricists Locke and Berkeley. This book presents an accessible and admirably broad overview of the modern debate about causation, without sacrificing serious attention to textual details. With two chapters on (i) and one apiece on (ii) - (vi), Clatterbaugh earns for himself and his reader a helpfully synoptic picture of philosophical shifts in the causation debate in the hundred years separating Descartes' Discourse and Hume's Treatise. By the end of the (modern) day, (1) the four-fold causes of Aristotelian-Scholasticism have given way to efficient causation alone; (2) no pre-existing forms in efficient causes are to be found, nor indeed any substantial active powers whatever; (3) there is no deep sense in which causes communicate reality to effects; (4) necessary connection has gone by the board; (5) divine causation has no place in a natural philosophy of causation. No surprises there, but Clatterbaugh's effort reminds us afresh of the varied and torturous routes to such shifts, helping advanced students better (or newly) appreciate them in the comfortable space of 200 pages.Of those pages, a third are devoted to Descartes and the Cartesians. That's not inappropriate, given the importance and difficulty of Descartes's response to Aristotelian-Scholastic accounts of causation, and its influence on occasionalist sentiments on the Continent. The tenor and value of this book may be illustrated by reflecting on the first of these—a rich and frustrating business, both in Descartes's texts and in Clatterbaugh's book. Suppose we grant Descartes the back of his hand to substantial forms and active formal causes as at best "unexplanatory" (counseling Regius): his "at-least-as-much-reality-in-the-cause-as-in-the-effect" principle might be treated as the basis of "an alternative" metaphysical account of causation (19-32). Well, it might be so-treated: but three versions of the principle later, the reader will be excused for judging it little more than a necessary condition for some event-pair x,y counting as a cause-effect pair. If the scholastic appeal to active forms is unexplanatory, then Descartes's [End Page 600] principle—which isn't Descartes's principle at all but a scholastic commonplace—can scarcely fill the explanatory gap. Glossed as a predictable consequence of some strong form of influxus physicus, it is embarrassed by Foucher's objection (that mind bears no likeness to body) and by the weight of texts urging that accidents are individual to their bearers. Having offered us no deep metaphysical story about what in the world answers to 'vis,' Descartes is at best a bungling "interactionist" (here appropriating Clatterbaugh's word for someone whose apparent talk of secondary causes we are asked to respect as expressing a strict and considered philosophical commitment). One can only side with Voetius in reckoning Descartes's replacement of forms by purely quantitative, mechanical principles of motion as expressing a mere "disposition of the movable to move... not an activity of an efficient cause, but merely a necessary condition and a causa sine qua non" (my emphasis: Selectarum Disputationum I [1648-59], 873). Descartes has no deep theory about the nature of causation.Is that too harsh? This paper describes a cubic water tank equipped with a movable partition receiving various amounts of liquid used to represent joint probability distributions. This device is applied to the investigation of deductive inferences under uncertainty. The analogy is exploited to determine by qualitative reasoning the limits in probability of the conclusion of twenty basic deductive arguments (such as Modus Ponens, And-introduction, Contraposition, etc.) often used as benchmark problems by the various theoretical approaches to reasoning under uncertainty. The probability bounds (...) imposed by the premises on the conclusion are derived on the basis of a few trivial principles such as "a part of the tank cannot contain more liquid than its capacity allows", or "if a part is empty, the other part contains all the liquid". This stems from the equivalence between the physical constraints imposed by the capacity of the tank and its subdivisions on the volumes of liquid, and the axioms and rules of probability. The device materializes de Finetti's coherence approach to probability. It also suggests a physical counterpart of Dutch book arguments to assess individuals' rationality in probability judgments in the sense that individuals whose degrees of belief in a conclusion are out of the bounds of coherence intervals would commit themselves to executing physically impossible tasks. Rhymed text and movable pictures present a variety of amusing situations.

The Qurʾān was taught in the letter method for many years. After the names of the letters in the Arabic alphabet are memorized in this method, the teaching of origins and signs begins. The syllabic method was developed over time as an alternative to this method, and the letters were taught directly with their superior vowel signs without memorizing their names. Unlike these two methods, the sound-based alif ba method has begun to be used in recent years. This method coincides (...) with the primary literacy teaching method based on the sounds thatwere adopted in Turkish teaching since 2005. Basic principles such as teaching the letters one-by-one, following the sound learning stages in teaching each sound, conducting the lessons in class, reading the syllables and words formed with the learned letters from the first day are adopted in both teaching methods. The purpose of the present study was to find out how the Qurʾān can be taught by applying the sound-based alif ba method and to draw attention to the original aspects of this method for learning the Qurʾān with the right sounds. Since the correct teaching of the Qurʾān is closely related to the teacher’s content knowledge and teaching skills, the alif ba that will be used and the method to be applied are important in reaching the target more systematically and faster. The case study design was used in the study in which the qualitative method was employed. The primary data of the study were Sound-Based Alif ba, for which I was the project assistant of, and the book with the title A New Approach in Teaching the Qurʾān: Sound based Alif baand Tajwīd Method, which was an editorial book of which I was one of the authors, and the thirty-episode series We Are Children and We Are Reading the Qurʾān, published on Diyanet TV, for which I was the production coordinator. Also, to see the applicability of the method, interviews were conducted with eight instructors who used Sound-Based Alif ba in their lessons. The study received ethical approval from Ankara Social Sciences University Rectorate Social and Human Sciences Research and Scientific Publication Ethics Committee on 8 July 2021 with the decision no 12450. The main thing in the sound-based alif ba method is the correct vocalization of the Qurʾān. The letters in alif ba are arranged differently from the classical alphabet order and are divided into six groups considering the frequency of occurrence in the Qurʾān and the degree of difficulty of origins. Each letter is taught in a separate lesson with the support of the ḥarakas and the sukūn (such as اَلْ, اِلْ, اُلْ). During the teaching, attention is paid to the sound learning steps, and the student is expected to feel the sound of the letter to be learned, distinguish it from other letter sounds, and then pronounce it from the correct origin as much as possible. In the sound-based alif ba method, the teaching of the shape of the letter is done after the sound of the letter is pronounced. During the teaching of the shapes of the letters, the part of the letter that does not change when written within a word is emphasized, and the writing is used so that the shape of the letter can be placed in the mind of the student. In the sound-based alif ba teaching, reading from the Qurʾān is done in every lesson, starting from the teaching of the first letter. During the teaching of alif ba, educational games, question-answer, and narration methods are used, primarily with the taʿlīm method. In this way, the teaching of Sound-Based Alif ba is spread over a period of 40 lessons. The study findings showed that the sound-based alif ba method has similar characteristics with the sound-based primary literacy teaching method; however, Arabic has its own unique aspects with its language structure. Among these originalities, which is adopted in the teaching of letters, firstly teaching the letter with the sukūn and with the support of movable ا and then showing the shape of the letter is carried out. As a matter of fact, the teachers have the opinion that this vocalization method, which is adopted, facilitates the learning of the correct sounds, and that teaching the letters in line with the sound learning steps increases the efficiency of the lesson. Although most of the instructors pointed out to the positive aspects of teaching tajwīd sounds in alif ba, one of the instructors did not find it necessary. The opinions of the teachers showed that the sound-based alif ba method can be applied efficiently in online lessons, but the teacher-student relation is affected negatively when compared to the classroom setting. All of the instructors said that the materials used in the lessons and demonstration and educational game methods increased the quality of the course, and that the We Are Children We Are Reading the Qurʾān program is an important resource for them. The Study Group on a European Civil Code has taken upon itself the task of drafting common European principles for the most important aspects of the law of obligations and for certain parts of the law of property in movables which are especially relevant for the functioning of the common market. Like the Commission on European Contract Law's "Principles of European Contract Law", the results of the research conducted by the Study Group on a European Civil Code seek to advance (...) the process of Europeanisation of private law. Among other topics the series tackles sales and service contracts, distribution contracts and security rights, renting contracts and loan agreements, negotiorum gestio, delicts and unjustified enrichment law, transfer of property, and trust law. The principles furnish each of the national jurisdictions a grid reference. They can be agreed upon by the parties within the framework of the rules of private international law. They may provide a stimulus to both the national and European legislator for moulding private law. Beyond this, they aim to further discussion about the creation of a European Civil Code, or a Common Frame of Reference in the area of patrimonial law, by submitting a concrete model. Against the background of the creation of an EU-wide frame of reference for private law relevant to the Common Market, this study, which was requested by the EU Commission, analyses the dovetailing between contract and tort law on the one hand, and between contract and property law on the other. The study examines the legal orders of almost all the Member States of the EU, illustrates the differences between contractual and non-contractual liability and evaluates the different systems of the transfer (...) of property, of movable and immovable securities as well as trust law. The study comes to the conclusion that the intensive considerations on the creation of a model-law in the area of European private law do not allow these thoughts to be limited to contract law. Such a limitation to the scope of the regarding of this area would probably cause more problems than it would solve, or at any rate not do justice to the needs of the Common Market. (shrink)

During the COVID-19 pandemic, the number of patients who require intensive care treatment may outnumber the number of intensive care beds, even in industrialized nations. Consequently, triage may become necessary. In Italy, France, and Spain, age has been used as a leading parameter to decide who is admitted to the intensive care unit, and who receives palliative care. Although age is an objective and easy-to-use parameter, it is ethically not ideal to withdraw ventilator therapy from elderly people who suffer from (...) COVID-19. We have developed a simple and easy-to-use scoring system to allow for triage that is based upon scientific outcome data and, at the same time, fulfills ethical standards. (shrink)

This article demonstrates how Adorno and Horkheimer’s turn to psychoanalytic concepts like sublimation and intra-psychic conflict strengthened critical theory. The piecemeal collective psychology they produced was used to understand fascism and anti-Semitism. But the full significance of these psychoanalytic explanations was concealed by Adorno, who elsewhere denied the possibility of psychology proper after the death of the individual. Adorno and Horkheimer’s underhanded borrowing from psychoanalysis for social analysis had the effect of filtering collective psychology through the lens of regression. To (...) amend this, the article analyzes psychoanalytic explanations from an interpretive perspective, building upon Jessica Benjamin’s psychoanalytic feminism, to contest the tactics of immanent criticism and to revitalize the project of a less dystopic collective psychology. Research suggests that people with psychopathic traits experience fear-inducing stimuli differently from others, seeming to interpret fear as more positive and less negative. We expected that this reaction, termed fear enjoyment, would impact the effect of fear-inducing stimuli on self-report risk-taking behaviour. Risk-taking was measured before and after viewing excitement- and fear-inducing videos (N = 825). As expected from research showing that fear induction tends to reduce risk-taking tendencies, participants showed reduced risk-taking scores following a fear-inducing stimulus. Importantly, this relationship (...) was moderated by psychopathic traits. Participants who did not decrease their risk-taking tendencies following the video scored significantly higher on psychopathic traits. Also, some of the variance in the relationship between psychopathic traits and change in risk-taking was partly accounted for by fear enjoyment, suggesting that future research should examine whether fear enjoyment may play a role in the relationship between psychopathy and risk-taking.
