Logical positivism is often characterized as a set of naive doctrines on meaning, method, and metaphysics. In recent decades, however, historians have dismissed this view as a gross misinterpretation. This new scholarship raises a number of questions. When did the standard reading emerge? Why did it become so popular? And how could commentators have been so wrong? This essay reconstructs the history of a “caricature” and rejects the hypothesis that it was developed by ill-informed Anglophone scholars who failed to (...) appreciate the subtleties of European scientific philosophy. It argues that the received view has a more complicated history and was frequently promoted by the European positivists themselves. The essay shows that the view has roots in both American and European scientific philosophy and emerged as a result of the complex interplay between the two communities in the years before the intellectual migration. This paper studies the conflict between critical rationalism and critical theory in Karl Popper and Theodor Adorno’s 1961 debate by analyzing their shared rejection of Karl Mannheim’s sociology of knowledge. Despite the divergences in their respective projects of critical social research, Popper and Adorno agree that Mannheim’s sociology of knowledge is uncritical. By investigating their respective assessments of this research program I reveal a deeper similarity between critical rationalism and critical theory. Though both agree on the importance of critique, they (...) are less concerned with the development of critical consciousness as a focus of this project. In this way, Mannheim’s sociology of knowledge, particularly in its formative stages, revolves around a set of problems relatively inaccessible to critical rationalism and critical theory, since it is centrally concerned with identifying and cultivating the possibility of critique in society. In closing, I gesture to the importance of political education in Mannheim’s early work, suggesting that a return to these experimental texts will yield resources for political thought today. Absolute Positivism The paper argues that we miss the point and strength of Kelsen’s Pure Theory of Law if we take it to drive a middle way between reductionism and moralism. Rather conversely, the Pure Theory is a radical theory. It tries to overcome the opposition between reductionism and moralism by making clear that both opponents rest on the same ill-conceived convictions about legal validity. Both take it that the law cannot be normative by itself. In contrast, the Pure (...) Theory tries to find a new approach to the understanding of law that takes seriously the constitutive functions of law. It tries to understand the validity of law as resting in law itself. Au tournant du xxe siècle, Abel Rey reprend cette question. Or, son livre, La Théorie de la physique chez les physiciens contemporains, exercera une influence forte sur le (...) Cercle de Vienne. Le positivisme absolu que propose Rey présente à la fois des analogies frappantes et des différences notables avec le positivisme logique. Si on y trouve le même souci de clarté et de précision, la logique n’est pas au centre de la démarche philosophique. Les diverses sciences, des mathématiques à la psychologie, sont mises à contribution. Social constructionists take a different approach to postpositivism and endorse a relativist rejection of truth and hold that the task of research is to foster a scepticism that undermines any positive truth claim made. In Beyond Positivism, Behaviorism, and Neoinstitutionalism in Economics, Deirdre Nansen McCloskey zeroes in on the authoritarian cast of recent economics, arguing for a re-focusing on the liberated human. The behaviorist positivism fashionable in the field since the 1930s treats people from the outside. It yielded in Williamson and North a manipulative neoinstitutionalism. McCloskey argues that institutions as causes are mainly temporary and intermediate, not ultimate. They are human-made, depending on words, myth, ethics, ideology, history, identity, professionalism, gossip, movies, (...) what your mother taught you. Humans create conversations as they go, in the economy as in the rest of life. In engaging and erudite prose, McCloskey exhibits in detail the scientific failures of neoinstitutionalism. She proposes a "humanomics," an economics with the humans left in. Humanomics keeps theory, quantification, experiment, mathematics, econometrics, though insisting on more true rigor than is usual. It adds what can be learned about the economy from history, philosophy, literature, and all the sciences of humans. McCloskey reaffirms the durability of "market-tested innovation" against the imagined imperfections to be corrected by a perfect government. With her trademark zeal and incisive wit, she rebuilds the foundations of economics. (shrink)

Legal positivists maintain that the legality of a rule is fundamentally determined by social facts. Yet for much of legal history, ordinary officials used legal terminology in ways that seem inconsistent with positivism. Judges regularly cited, analyzed, and predicated their decisions on the ‘laws of justice’ which they claimed had universal legal import. This practice, though well-documented by historians, has received surprisingly little philosophical attention; I argue that it invites explanation from positivists. After taxonomizing the positivist’s explanatory options, I (...) suggest that the most viable option appeals to conceptual change: classical Romans, early modern Europeans, founding-era Americans were not using ‘law’ (or ‘lex’ or ‘jus’) to refer to the subject matter of contemporary legal philosophy. But the strategy is costly. It renders positivism’s truth surprisingly parochial. And it supplies new reasons for doubting positivist accounts of contemporary practices, including the treatment of moral principles in modern adjudication. (shrink)

In this paper I shall briefly analyze Husserl’s and Wittgenstein’s divergent reactions against the positivist stance on natural science and on the new cultural role that philosophy should play in relation to science. To a great extent, their philosophies can be considered as a departure from positivism, although for quite different reasons. I shall argue that Wittgenstein, in the Tractatus, took positivism as a starting point that he tried to overcome from within. This endeavor led him to defend (...) some theses of a pragmatist flavour as well as a peculiar type of radical agnosticism on ontological and epistemological issues. Husserl, however, considered that positivism was a dead-end for philosophy. Positivism has beheaded philosophy as a consequence of advancing a reductive view of science. Phenomenology is the attempt to understand the genetic and subjective processes that have ended up in an objective and scientific image of the world. (shrink)

Pierre Duhem gilt ais einer der wichtigsten Reprüsentanten der franzosischen Wissenschaftsphilosophie um 1900. Seine Konzeption physikalischer Theorien wird üblicherweise ais moderne Umsetzung des antiken – proto-positivistischen – Programms der „Rettung der Phänomene‟ angesehen. Diese Sicht ist richtig, bedarf aber der Ergänzung, indem der diskursive Kontext der Duhemschen Position berücksichtigt wird. Im vorliegenden Beitrag wird dargelegt, dass Duhems philosophischer Zeitgenosse Abel Rey eine zentrale Rolle in diesem Zusammenhang spielte.

By targeting and critiquing these assumptions, he lays the groundwork for a post-positivist philosophy of science that does not provide aid and comfort to the enemies of reason. This book consists of thirteen essays.

In this paper, we investigate how the life and work of Louis Rougier relate to the broader political dimension of logical empiricist philosophy. We focus on three practical projects of Rougier in the 1930s and 1940s: first, his attempts to integrate French-speaking philosophers into an international network of scientific philosophers by organizing two Unity of Science conferences in Paris; second, his role in the renewal of liberalism through the organization of the Walter Lippmann Colloquium; and third, his attempts at political (...) negotiations between Great Britain and the Vichy regime during the Second World War. These activities of Rougier in the 1930s and 1940s have so far never been discussed as part of a unified project on his part. Based on our investigations of these practical projects of Rougier, we argue that his relation to logical empiricist philosophers should primarily be understood on the level of action. His projects aimed to proliferate the concrete improvement of society and the lives of its citizens by expunging all metaphysical questions and speculations from the sphere of social discourse. Rougier conceived logical empiricist philosophers as allies to achieve such practical effects in society. (shrink)

In her 1921 book, The Space-Time Problem in Kant and Einstein, Ilse Schneider examines the foundations and consequences of the theory of relativity from an epistemological perspective. Beyond addressing detailed questions of early 1920s physics, it is a programmatic attempt to reconcile Kant’s transcendental idealism with Albert Einstein’s physics. The Kantian background puts the book in direct competition with Ernst Cassirer’s book Einstein’s Theory of Relativity, published in the same year. Schneider’s approach was largely ignored in the research compared with (...) Cassirer’s. What has not been considered so far is that Schneider and Cassirer represent two different interpretations of Kant, which they apply to Einstein’s physics. Recent Kant scholarship has differentiated these interpretations into the “metaphysical” and “epistemological dual-aspect” views. The former view can be found in the work of Schneider’s academic supervisor, Alois Riehl, and clearly distinguishes Schneider’s realist-inspired approach from Cassirer’s idealism. Given these differing views, it is necessary to be more precise when speaking of “immunization strategies” in the context of neo-Kantianism in order to make the differences between Schneider and Cassirer clear. Cassirer immunizes philosophy from the results of physics. In contrast, Schneider exposes philosophy much more strongly to physics. (shrink)

In Unifying Biology, Smocovitis offers a series of claimsregarding the relationship between key actors in the synthesisperiod of evolutionary studies and positivism, especially claimsentailing Joseph Henry Woodger and the Unity of Science Movement.This commentary examines Woodger''s possible relevance to key synthesis actors and challenges Smocovitis'' arguments for theexplanatory relevance of logical positivism, and positivism moregenerally, to synthesis history. Under scrutiny, these arguments areshort on evidence and subject to substantial conceptual confusion.Though plausible, Smocovitis'' minimal interpretation – that somegeneralised (...) form of Comtean positivism had a role in synthesishistory – requires more of an evidential basis and must engageexisting scholarship on epistemic reforms in the biological sciencesprior to the synthesis period. Smocovitis is right to investigateepistemology in the synthesis period of evolutionary studies and tolook for links to wider changes in science and philosophy. Nearly thirty years ago, Robert Alexy in his book The Concept and Validity of Law as well as in other early articles raised non-positivistic arguments in the Continental European tradition against legal positivism in general, which was assumed to be held by, among others, John Austin, Hans Kelsen and H.L.A. Hart. The core thesis of legal positivism that was being discussed among contemporary German jurists, just as with their Anglo- American counterparts, is the claim that there is no (...) necessary connection between law and morality. Robert Alexy has argued, however, that the law, besides consisting conceptually of elements of authoritative issuance and social efficacy, necessarily lays a claim to substantial correctness, which is derived from analytical arguments. Furthermore, if this claim to substantial correctness necessarily requires the incorporation of moral elements into law, then the ‘necessary connection thesis’, as defended by non-positivism, can be justified. Some of the most significant objections to this sort of claim, stemming from the Anglo-American world, are those introduced by Joseph Raz. In his ‘Reply’ to Robert Alexy, Raz raises at least three interesting criticisms, including, first, the ambiguity of ‘legal theory in the positivistic tradition’, second, the indeterminate formulations of the ‘separation thesis’, and, third, the necessary claim of law to legitimate authority as a moral claim. As a point of departure, I will argue that Raz’s three criticisms are misleading. For they do not enhance our understanding of the genuine compatibility or incompatibility between legal positivism and non-positivism. Despite the frequently reformulated theses of legal positivism and the various kinds of opponents responding thereto, the essential divergence between legal positivism and non-positivism was and remains the answer to the question of the relation between law and morality. Furthermore, I will clarify that in the strictest sense there can be three and only three logically possible positions concerning the relation between law and morality: the connection between them is either necessary, or impossible (i. e. they are necessarily separate), or contingent (i. e. they are neither necessarily connected nor necessarily separate). The first position is non-positivistic, while the latter two positions are, indeed, both positivistic, but in different forms: one may be called ‘exclusive’ legal positivism, the other ‘inclusive’ legal positivism. I will continue by showing that these three positions stand to one another in the relation of contraries, not contradictories, and that, taken together, they exhaust the logically possible positions concerning the relation between law and morality, never mind the tradition or authority from which these positions are derived. Raz mentions, however, many changeable formulations of the separation thesis, which even leads him to acknowledge ‘necessary connections between law and morality’. One who is trying to understand legal positivism would no doubt be puzzled by this claim. Nevertheless, I will argue that this is an alternative strategy of legal positivism, and it points to naturalistically oriented view. Although this necessary separation between law and morality, understood naturalistically, strikes one as strengthening the separation, in the end it leads to a weakened notion of necessity. This weakened necessary separation thesis, however, cannot be justified through the so-called claim of the law to legitimate authority, defended by Raz, for it is difficult to answer the question of whether a normally justified but factual authority can gain legitimate authority. Finally, the necessary connection between law and morality in a strong sense can still be justified by the claim of law to correctness, as per Alexy’s argument. (shrink)

By “Logical Positivism” I mean the doctrine originated by Dr. Wittgenstein and expounded more at length by Professors Carnap, Schlick, and other members of the Viennese Circle in the periodical calledErkenntnis. The clearest account of it in English is that given by Mr. R. B. Braithwaite in the volume calledCambridge University Studies.

In this collection of essays one of the preeminent philosophers of science writing offers a reinterpretation of the enduring significance of logical positivism, the revolutionary philosophical movement centered around the Vienna Circle in the 1920s and 30s. Michael Friedman argues that the logical positivists were radicals not by presenting a new version of empiricism but rather by offering a new conception of a priori knowledge and its role in empirical knowledge. This collection will be mandatory reading for any philosopher (...) or historian of science interested in the history of logical positivism in particular or the evolution of modern philosophy in general. Due to their acceptance of the verifiability principle, the only way left for logical positivists to argue for the meaningfulness of religious language was to accept some sort of emotivistic conception of it or to reduce it to the description of religious attitude. The verifiability principle, however, suffers from some severe limitations that make it inadequate as a criterion for cognitive meaning. To resolve these problems, logical positivists gave up the requirement of conclusive verifiability and defended a sort of ‘liberalization’ (...) of the verifiability principle. Carnap’s confirmability criterion for cognitive meaning, which is a liberalized form of the verifiability principle, is compatible with an orthodox conception of religious language since, from a theistic perspective, the existence of God can be confirmed through our observational statements. Many studies of the labour market spatial mismatch rely on the deductivenomological model of causation to test the theory that low-skilled, inner-city residents have been isolated from the knowledge of job opportunities by the suburbanization of jobs. The logic of this approach follows the deductivenomological model of explanation which establishes causation by measuring the constant conjunctions between ‘causes’ and ‘effects’. As an alternative, I have used a realist approach to the study of the labour market spatial mismatch that uses a (...) ‘causal-explanatory’ method. This approach entails the qualitative description of the causal mechanism in order to discover and conceptualize its causal properties. The results suggest that the spatial mismatch theory could be refined in order to accommodate the finding that workers in excluded ghettos do not necessarily rely solely on local social networks to find out about job vacancies. Instead, workers with employment experience have strong workplace-based social networks. Since employers recruit workers by relying on referrals from trusted workers, these workplacebased social networks can put job seekers at the front of the hiring queue, regardless of where they live. Judging Positivism is a critical exploration of the method and substance of legal positivism. Margaret Martin is primarily concerned with the manner in which theorists who adopt the dominant positivist paradigm ask a limited set of questions and offer an equally limited set of answers, artificially circumscribing the field of legal philosophy in the process. The book focuses primarily but not exclusively on the writings of prominent legal positivist, Joseph Raz. Martin argues that Raz's theory has changed over (...) time and that these changes have led to deep inconsistencies and incoherencies in his account. One re-occurring theme in the book is that Razian positivism collapses from within. In the process of defending his own position, Raz is led to support the views of many of his main rivals, namely, Ronald Dworkin, the legal realists and the normative positivists. Some philosophers argue that many contemporary debates in metaphysics are “illegitimate,” “shallow,” or “trivial,” and that “contemporary analytic metaphysics, a professional activity engaged in by some extremely intelligent and morally serious people, fails to qualify as part of the enlightened pursuit of objective truth, and should be discontinued” (Ladyman and Ross, Every thing must go: Metaphysics naturalized , 2007 ). Many of these critics are explicit about their sympathies with Rudolf Carnap and his circle, calling themselves ‘neo-positivists’ or ‘neo-Carnapians.’ Yet (...) despite the fact that one of the main conclusions of logical positivism was that metaphysical statements are meaningless, many of these neo-positivists are themselves engaged in metaphysical projects. This paper aims to clarify how we may see a neo-positivist metaphysics as proceeding in good faith, one that starts with serious engagement with the findings of science, particularly fundamental physics, but also has room for traditional, armchair methods. 아이리스 영은 개인의 책임을 넘어선 정치적 책임을 주장하면서 법적인 책임 모델과 사회적 연결 모델을 주장하였다. 그런데 이러한 구분은 실증주의 법개념에 근거한 것으로 보인다. 내용의 정당성까지를 고려하는 비실증주의 법개념론은 사회적 연결 모델과 유사하다. 비실증주의 관점의 확장된 법개념은 여성문제에 대한 법적인 책임을 묻고 법판단에서의 젠더정의를 실현하는 데 적합하다. 이 글은 위안부와 같은 여성문제를 해결하기 위하여 아이리스 영이 전제하고 있는 법의 개념을 비판적으로 다루면서 비실증주의 법개념론의 입장에서 사회적 연결 모델을 바탕으로 법적 책임까지 물을 수 있는 방안을 모색하였다.
