The act of remaking one's history into a heritage, a conscientiously crafted narrative placed over the past, is a thriving industry in almost every postcolonial culture. This article examines a recent judgment by the European Court of Human Rights that upheld the complaint of a homosexual woman who alleged that her application for authorization to adopt a child had been refused by domestic French authorities on the grounds of her sexual orientation. I argue that the judgment constitutes an innovative and atypical legal consideration of, and challenge to, the heteronormative social relations of contemporary European societies. After exploring the evidence presented by the applicant, and the Court’s (...) interpretation of it, I argue that in order to reach its judgment it was necessary for the Court to make a significant departure from its established jurisprudence in relation to sexual orientation. An essential element of this involved the adoption of a distinctive critical approach, strongly resonant with aspects of ‘queer theory’, which focused attention on the social, cultural and political construction of normative heterosexuality. Whilst a number of commentators have assessed the importance of the judgment in terms of its evolution of ‘gay rights’ in the area of family life, I argue that the Court’s reconceptualized ‘theoretical’ understanding of, and critical approach to, heteronormativity offers the potential to expand the scope of the European Convention on Human Rights across a number of areas of social life—in marriage, public assembly, freedom of expression, as well as family life—where non-heterosexuals continue to face discrimination in contemporary Europe. The founding fathers of neoliberalism are usually imagined as very rational neoclassical economists uninterested in cultural and religious issues. The aim of this paper is to paint a different picture by discussing the ideas of (neo)liberal economists regarding spiritual heritage, with an emphasis on eastern religions. Starting from the existing historiographical debate on the role of Daoist notions in the birth of political economy in 18th-century Europe, as an example of cultural transfer par excellence, argumentation develops into (...) a comparative analysis of philosophical underpinnings of modern laissez-faire liberalism and neoliberalism. The main thesis of the paper is that important epistemological differences between analysed doctrines imply the differences in the attitude of modern economic liberalism towards religion, which is demonstrated via examples of appropriations and translations of eastern heritage. This is a preliminary analysis but with the potential to shed new light on the political theology of contemporary culture and neoliberalism itself. (shrink)

SummaryThis essay aims to study the impact made by Véron de Forbonnais's Elémens du commerce on the development of economic thought in the German Empire. Starting from the 1755 translation of the Elémens, construed here as an aspect of the gemeinnützig-oekonomische Aufklärung, it will examine the reception of the work in cultural and political terms. The analysis will thus focus first on the German universities, where a renewed teaching of Polizei transposed Forbonnais's theoretical ideas into a new ‘science (...) of the state’ centred on economic and commercial mechanisms. Secondly, the political reading of the Elémens during the Seven Years’ War and in the years of Kaunitz's government in Vienna will be taken into consideration. The Journal de commerce published in Brussels will serve as a pathway towards understanding the complex cultural transfer between France and the Empire that Forbonnais's work facilitated: the Elémens were in fact variously used as the manifesto of a new political and economic alliance between the French Crown and the court of Vienna and as theoretical support of Habsburg politics which, in the second half of Maria Theresa's reign, were committed to the principles of free trade and anti-corporatism. Buddhist Insights on Christian MarriageWioleta PolinskaHigh divorce rates and declining marriage rates in Western societies draw the attention of many scholars to the fragility of contemporary marriages.1 Rampant individualism, permissive divorce law, and softening stance on divorce by mainstream Christian denominations are all listed as culprits responsible for the current marriage crisis.2 These conventional accounts, however, overlook important insights gathered by historians (...) of marriage, insights that point to a dramatic shift in the concept of marriage that occurred more than two hundred years ago. According to Stephanie Coontz, “the invention of the historically unprecedented idea that marriage should be based on love and mutual affection” 3 is responsible for greater fragility, but also for creating good, satisfying marriages that bring much happiness to people’s lives.4 Thus, the very source of fragility (the search for love and mutual affection) is also a source of deep connections and lasting relationships. While the fragility accompanying contemporary marriage is here to stay, our efforts to build strong unions need to be carefully evaluated. In what follows, I will address Christian and Buddhist approaches that aim at protecting the stability of marriage. To strengthen marriage, Christianity, from early on, focused on the permanence of marriage whether understood as a sacrament or, later on, as a covenant. Christian wedding vows that promise love, care, and enduring partnership “till death do us part” capture well the prevailing theology of Christian marriage. In contrast, Buddhism employs a concept of impermanence that implies an ever-changing reality that warrants no finality. Recent studies in psychology of mindfulness meditation show that such Buddhist concepts can translate well into effective skills for those in loving relationships. I will suggest that Christian theology might become more successful at preserving the stability of marriage by becoming less focused on the finality of couples’ bonds, and instead attending to the present reality of couples’ relationships.It is well documented that before the seventeenth century marriages were arranged by parents and fulfilled primarily political, economic, and social functions rather than individual needs. Marriage was seen as a means of enlarging one’s economic enterprise, acquiring powerful in-laws, strengthening military alliances, or (for the less [End Page 29] privileged) enlarging the family’s labor force.5 This is not to say that the notion of romantic love was unknown until the seventeenth century, but that it was not closely associated with marriage.6 In aristocratic courts of southern France, for example, romantic love appeared between an unmarried man and a married woman, and it should have been either unconsummated or adulterous.7 As late as the eighteenth century, a “sudden falling head over heels in love, although a familiar enough psychological phenomenon, was thought of as, a mild form of insanity” and an unreasonable basis for marriage.8 Romantic love became widely accepted only in the nineteenth century under the influence of Enlightenment thought, ideals of the French and American Revolutions and of the romantic movement.9Romantic love as an expression of an individual’s desire for fulfillment has its dark side, as it can unleash selfish concerns. Thus, Robert A. Johnson, a Christian theologian, defines romantic love as “airy, fantasy, projections, and an evanescent high. It is fundamentally egotistical—fixated on its own wants and whims. It can never lay the foundation for personal commitments.” 10 The Vietnamese Buddhist monk Thích Nhất Hạnh (b. 1926) states that love can become a kind of sickness when it forms an attachment, similar to drug dependency. When we are under its spell, we are preoccupied with the object of our love and we desire to control and possess the other. To Ven. Hạnh, this is not true love since “it is only the willingness to make use of the other person in order to satisfy our own needs.” 11 Both Johnson and Ven. Hạnh while criticizing romanticized concepts of love are not giving up on possibility of intimate love. The momentum of globalization and universalism, operating through the media, information technology and politics, has steadily diminished the importance of cultural diversity. It has even threatened to erase many of our cultural traditions, or extinguish our diverse experiences of the sacred. Yet the sacred which seems to be lost is often still encased in our cultural objects, stories and religious rituals. This paper will discuss how the memories of the sacred can be both preserved and reawakened. This (...) paper will focus on three scholars who develop alternative approaches to the universal. Franz Rosenzweig saw universal historical progress as oppressive. He believed that the practice of his Jewish religion offered a resistance and a possible correction to the general movement of history. Walter Benjamin saw the forgotten 'ruins' of history encase memories of the sacred and the silenced voices within history. For Benjamin, the role of interpretation is to awaken these hidden memories and voices which are encoded within our objects, images and commodities. This led him to a particular idea of a momentary messianic redemption in relation to greater flow of time. And finally, Jacob Taubes read St. Paul as offering a revolutionary model on how to live one's particular faith within a wider political order. In general, each writer developed an idea of redemption which involves a kind of remembrance of what has been obscured by the more general universal movement of history itself. This is especially relevant for the various religious and cultural communities within Cambodia. The paper will begin and end by discussing the origin story of Cambodia – the marriage between Preah Thong, the Indian prince, and Neag Neak, the Naga princess. I will additionally try to demonstrate that the story and its various reenactments is important because it represents a regenerative process rooted in the eclectic character of South East Asian culture in general. Various forms of memory within the syncretic or eclectic context of Southeast Asia can operate to preserve the sacred in an age of universalization and globalization. It also illustrates how the performance of memory can also offer an antidote to the "trauma" of Cambodia's past. (shrink)

In particular, Augustus seems to have established a hierarchy of military honors, reserving the ovatio and triumph proper for members of his own family, but allowing ex-consuls to earn triumphal honors. Resumen: Mediante la metodología de una reconstrucción inmanente del mejor argumento de quienes se oponen al reconocimiento jurídico del matrimonio entre personas del mismo sexo, este artículo muestra por qué el juez o el legislador no debe aceptar dicho argumento. Con ello se señala solo indirectamente o de modo negativo por qué sí debe ser reconocido dicho matrimonio. En este artículo se reconstruye la estructura y los diferentes contenidos de las justificaciones opositoras, buscando identificar la más robusta de ellas; esto (...) es, aquella con mayor capacidad para -recurriendo a argumentos adecuados a sociedades plurales- traspasar el peso de la prueba al lado de la demanda por dicho reconocimiento. Dicha capacidad se comprueba mostrando concretamente cómo tal justificación logra argumentos de defensa, de crítica a dicha demanda, así como incorporar argumentos del mundo progresista. Pese a su robustez y luego de una evaluación detenida, se concluye que esa justificación no es sostenible bajo medios racionales.: Through a methodology of an immanent reconstruction of the best argument of those who oppose the legal recognition of same-sex marriage, this article shows why the judge, or the legislator should not accept this argument. With this, it is pointed out indirectly and in a negative way why that marriage should be recognized. In this article the structure and the different contents of the conservative justifications are reconstructed, trying to identify the most robust of them; that is, the one with the highest capacity for -using adequate arguments to plural societies- to transfer the burden of proof to the side of the demand for such recognition. This capacity is demonstrated by showing precisely how such a justification achieves arguments of auto-defense, of criticism of said demand, as well as incorporating arguments from the progressive world. Despite its robustness and after a careful evaluation, it is concluded that this justification is nor sustainable under rational means. (shrink)

Global feminism has been criticized as a form of cultural imperialism, whereby a white, western model of feminism is imposed upon women in non-western contexts under the banner of universal sisterhood. In order to provide this theoretical critique with some empirical grounding, this article focuses on the worldwide impact of one of the most influential books ever to be published in the US, Our Bodies, Ourselves. This book not only had a decisive impact on how generations of American women (...) felt about their bodies, their sexuality and their health, but it was translated and adapted in 20 languages, both within and outside Europe. The dissemination of Our Bodies, Ourselves, particularly in the so-called `third world', makes it a perfect site for exploring the possibilities and the pitfalls of the globalization of feminist knowledge. After showing how Our Bodies, Ourselves travelled and was adapted to meet the needs of women in specific contexts, conclusions are drawn about the viability of the `feminism-as-culturalimperialism' critique as well as about the empowering potential of transnational feminist alliances in the field of body/politics. This article deals with political socialization and political participation, in the context of visiting phenomenon, in Turkey. We took the Ali Baba Tomb in central Sivas and Celtek Baba Tomb in Celtek village as the sample of our study. In the study, political socialization and participation was seen as a dialectical process between individual and society. Visiting phenomenon embodying a rich historical, religious and cultural accumulation is important in that it defines the religious tendency of huge (...) masses. As a matter of fact, they have realized their potitical socialization in a pretty much authentic culture with different interests, duties, roles and positions. At the same time, they have shown their political participation with reference to the religious world of meaning. -/- SUMMARY In the contrast to the secular paradigm, religion continues to keep its reciprocal relations with the whole social system without giving an opportunity to any speculation. Religion and politics are two important fields in which this living relationship is stood for institutional structures. This article focuses on political socialization and political participation in Turkey by taking into consideration the phenomenon of visiting. The question of how the visiting phenomenon provided an input to the political system in terms of political socialization and political participation constitutes the problem of the research. Ali Baba Tomb in the center of Sivas province and Celtek Baba Tomb situated in central Celtek Village were selected as samples for the study. The political socialization and participation were talked with 33 visitors who had been selected randomly from different days between September and December 2015 and were tried to understand the data obtained by semi-standardized interview form. It has been examined in terms of its historical development and orientation of relationship between the visiting phenomenon in the research and the political system. For this reason, the basic methodological acceptance of the research has been to understand and interpret political socialization and participation in its specific environment. In this framework, firstly, the socialization of the sample in the context of family, school, mass communication and social environment was evaluated. Later, it has been tried to understand the religiousness in the context of the visiting through the same group. Their political participation has also been resolved according to the classification of Milbrath and Goel’s hierarchical political participation level through the field of political socialization and religiousness. Finally, this research, which is considered as a singular case study, has been subjected to a systematic and phenomenological analysis according to gender, age, education and belief variables on the basis of data obtained through problem-centered interviewing and participatory observation. The visiting in a phenomenological sense involves a trip and travel made with certain requests to the people who are believed to have been buried in places such as tombs, attributed to certain spiritual powers and virtues. The visiting phenomenon in the field of research had brought a rich historical and cultural content, exceeding a simple grave visit. Today, in the religious and traditional meaning world the traumas caused by the modernization and other socio-psychological thrillers have brought a different interest in Turkish society than ever before. The visiting phenomenon has created a continuity with a perception of sanctity and understanding which were shaped by an interaction with many different cultures, pre-Islamic beliefs and eventually mystical and charismatic personalities. However, the visiting phenomenon according to the severity of the individual and social crises experienced in the modern period has also revealed some variations that included popular patterns in both structural and practical contexts. Thus, the visiting phenomenon today is seen in a change by creating new universes appropriate to tradition in different social categories. In the modern era the influence of this change on the political culture is evident. This effect is generally related to the social structure of Turkish society and manifests itself as a closing within the sense of protection of the world of meaning. The visiting phenomenon, which has a special place in the religious life of very large masses in Turkey, has created a peculiar structure of political socialization and political participation around a profound historical accumulation. The participants have realized their political socialization in a unique cultural environment. This culture was formed in the context of family, school, mass communication and social environment. The dramatic situations that have taken place in the process have brought the important socialization problems in this environment. The community associations, the system of obsolete values, the distorted hierarchical relationships and the insecure environments created no longer lead to the searching for meaning by them. These people, who express themselves not like politics (27 people) at last, instead of expressing politics themselves with ideological concepts like ideological rightist, leftist, Islamist, communities people (ʾumma), Kemalist (5 people), but rather Turkish, Muslim, homeland, nation, human and righteousness as the concepts and words to prefer to identify. This should be a socialization that they carry out by transferring the objective world they created outwardly around a set of meanings to their subjective consciousness again. The visitors have carried out a political participation with the accumulation created by this field of political socialization. They saw themselves as often religious and the visiting activity as a sign of religiosity. As a result, the visiting a tomb could have been a simple manifestation of inner happiness and ease in a happy moment or an entertainment as much as it was in distress in this environment. The mystical attitude which is far from the world that many poor people built around the visit has caused them to put reserves in the political institution that represents a secular field. As a matter of fact, the visitors often characterize the world with the terms like empty, lie, trial, and so on. Politics, on the other hand, had been seen as a relationship of interest, cheating and lying. It has been understood that it provides a political input in the framework that Milbrath and Goel conceptualize as audience actions when we look at the political participation of the visiting phenomenon in the Sivas universe. According to this visit, in the sample of the phenomenon 29 people of the participants said that they are not open to the politics while 4 of them said that they are open to the politics. However, given that voting attitudes in the elections, only 2 of the participants did not see this very important; others (31 people) regard voting as a responsibility in the name of country, nation, country or even religion. From time to time, those who say either that they have started to the political discussions or that they have participated in political debates (11 people of them) are less than those who have never attended this kind of debates (22 people). In this sample, the number of people trying to persuade a person to vote for a particular party is 6; the number of people carrying a rosette of a party or hanging the symbols of the party to the house, to the car, was only 4 among those participants. Visiting people usually provide the political socializations in a fatalistic and restrictive environment. Their political participation is also in accord with the symbolic world of this hierarchical structure in which life is defined by certain rules. Therefore, they had produced an unquestionability of the authority as it is in family as well as political institutions. The politics is frightening for them; it is not interested in them and they should be away from it. (shrink)

This article deals with the issue of resignification to advance a hypothesis on the way in which social practices are transformed with recourse to the language of institutions. It first discusses the transition from gay liberation to same-sex marriage equality by exploring the trajectory of homosexuals’ rights claims. The article continues by providing a theoretical interpretation of what brought this shift about, that is, what the author calls a movement ‘from the street to the court’: in both civil law (...) and common law jurisdictions, legal means are increasingly being used by individuals and groups to make their claims audible to political institutions and to society at large. Then, an analysis is offered of the shape that social struggles take when socio-political claims are articulated with recourse to the legal language. The conclusion is that reliance on the law as a device to achieve political goals and construct same-sex group identity risks producing but a feeble resignification of the conventional heterosexual matrix. In light of that, a more effective way to defy this matrix is to create awareness of what is gained and what gets lost in becoming legally visible. (shrink)

The alliance of the Republic of Korea (ROK or South Korea) and the United States of America (or US) was brought as a result of the Korean War. To South Korea, the war was to defend freedom and democracy with democratic countries including US, on the other side, to North Korea, it was to spread the communism revolution by invading South Korea. The original alliance of both South Korea and US was military alliance. It was gradually extended to the fields (...) of politics, economy, society and culture. The ROK-US alliance continues to change as a result of both advanced international status of South Korea and the status of the United States in international society. Especially both countries have shown about differences Japan and China, and North Korea. And the lingering awareness of the difference between the two sides in the alliance still faces the challenges to be solved. This paper suggests ways to promote future peace condition on the Korean peninsula. To do that, this paper tries to show the basic principles for the identity principle, the principle of universality, the principle of reciprocity. (shrink)

As is well known, marriage was frequently employed as an instrument of diplomatic policy in premodern Europe. Dynastic leaders used the marriages of their own family members to create or confirm alliances with other ruling houses. Peace was often the aim and the outcome of such agreements, but the reality of marital politics was far more complicated. Arranging a marriage could be a statement of enmity by two families toward a third party. Attempts to dissolve or prevent marriages (...) already arranged by one's rivals amounted to viable political tactics. During the twelfth century, as rules around the formation and dissolution of Christian marriage were in flux, opportunities for manipulation of accepted practices abounded. This article examines a series of marriages between members of the Anglo-Norman and Angevin ruling families, focusing especially on the reign of Henry I, to demonstrate the complexity of marital practices and their links to peace and war. Literary works of the age, notably Geoffrey of Monmouth's Historia Regum Britanniae, offer further cultural perspectives on the nature of political marriages. Whereas short-term tactical considerations meant that marriages were often tied to episodes of conflict and rivalry, from a longer-term perspective the usefulness of marriage as a means of securing and maintaining peace remained an important element of premodern diplomacy. In this contribution, the author argues that there are in our European tradition two fundamental conceptions of politics since the French Revolution. We can call them the politics as the art of co-existence, and the politics of dénouement. Both conceptions also have a very different stance towards the traditional religions: for the first one mentioned freedom of religion is constitutive, for the second one religion must serve the state or can even be made redundant. Paradigmatic in this respect was the (...) communist treatment of religion as a relic of the past that will disappear when historic reason makes our society transparant . Here politics transforms in a quasi-eschatological political religion. In the twientieth century neo-marxist philosophers say farewell to this kind of politics and begin to rediscover religious inheritances and theological motives. Today two other positions towards religions are noticeable: the utilitaristic reductionist treatment of religion as a need , and ‘Enlightment fundamentalism’ which continues the rationalist communist conception of religion as a relic of the past. The author criticises both tendencies, and defends a ‘politics without dénouement’ which correspondents to a ‘religion without guarantee’. In closing the author argues that the recent populist politics either dream of a new alliance between religion and/or ‘culture’ and the state, or – in a strange inversion of the multicultural ideals of the nineties – promote a purely polemical identity against an ‘alien’ religion, i.c. Islam. Here the author claims that both tendencies fail to recognize the real nature of the new problems. (shrink)

Culture is a demanding word, particularly when it is used in the context of the contemporary academic discipline of international relations . It is often employed in order to distinguish one identity from another, allegedly illuminating idiosyncrasies embedded in a particular society or group of people. The essentialized understanding of culture is also detectable in the case of the current debate on the non-Western international relations theories . Non-Western politicians and scholars often employ the term culture in order to distinguish (...) their values from alleged Western values. However, culture has another important function mainly advanced by a left-wing Kyoto School philosopher Tosaka Jun, that is, culture as a mirror for critical reflection for morality . This article is based on Tosaka's argument that culture has an important function for moral reflection beyond that of a mere means to identify one's distinctiveness from the West, and it criticizes Japan's soft power diplomacy or the total absence of it from that point of view. It also argues that this absence is the result of the soft power discourse's over-simplified interpretation of culture that results in confrontation between the West and the rest, particularly when it is employed in non-Western IRT discourses. Towards the end, I examine Miyazaki Hayao's films, Princes Mononoke in particular, as examples of cultural works facilitating a moment of critical reflection, and I extract embedded messages of relevance to critical reflection on contemporary IR literature, particularly non-Western literature. This paper reviews the studies of Japanese society and culture undertaken by Hong Kong-based sociologists and scholars in related disciplines. It presents information on research projects funded by the Research Grants Council, Social Sciences Citation Index (SSCI), and Arts and Humanities Citation Index (A&HCI) journal articles, authored and edited books, book chapters, non-SSCI and non-A&HCI journal articles, as well as master and doctoral theses written by scholars and graduate students associated with Hong Kong's major universities. It is found that the (...) main topics of research are Japan's capitalist development and corporate growth, meanings and social ramifications of traditional and popular culture, education, gender, and marriage, as well as aspects of work and employment, whereas the major research methods include document analysis, ethnography, and in-depth interviews. The limited amount of research and the preoccupation with economic development and popular culture reflect in part Hong Kong's unique political conditions and the government's indifference to the pursuit of social and political policy analysis. In recent years, the growth of academic exchanges between scholars in Hong Kong, Japan, and other East Asian regions and the heightened emphasis by university administrators on academic research will hopefully bring about advancements in such academic endeavors. Entire libraries can be filled with volumes exploring the cultures, politics and geographies of the largely horizontal mobilities and transportation infrastructures that are intrinsic to urban modernity (highways, railways, subways, public transit and so on). And yet the recent ‘mobilities turn’ has almost completely neglected the cultural geographies and politics of vertical transportation within and between the buildings of vertically-structured cityscapes. Attempting to rectify this neglect, this article seeks, first, to bring elevator travel centrally into discussions about the (...) class='Hi'>cultural politics of urban space and, second, to connect elevator urbanism to the even more neglected worlds of elevator-based descent in ultra-deep mining. The article addresses, in turn: the historical emergence of elevator urbanism; the cultural significance of the elevator as spectacle; the global ‘race’ in elevator speed; shifts towards the ‘splintering’ of elevator experiences; experiments with new mobility systems which blend elevators and automobiles; problems of vertical abandonment; and, finally, the neglected vertical politics of elevator-based ‘ultra-deep’ mining. Since 2014, two legislative actions, the Transgender Persons (Protection of Rights)Act 2019, and the Draft Trafficking in Persons (Prevention, Care and Rehabilitation) Bill 2021, have been pivotal in re-inscribing the Indian state’s colonial policing of queer kinship networks. By criminalising relationalities outside the heteropatriarchal conjugal home, the sexual subaltern is exposed to the state’s mechanisms of rescue and rehabilitation. These developments have occurred alongside the constitutional recognition of privacy in K.S. Puttaswamy v. Union of India (2017) 10 SCC 1 and (...) the decriminalisation of the anti-sodomy law in Navtej Johar v. Union of India 2018 (10) SCALE 386 which have been celebrated as victories of self-determination and dignity for queer kinship. These judicial pronouncements, although symbolically pertinent, fail to materially protect queer kinship, and with the contemporary advocacy around queer marriage, the need for legal and cultural recognition has obfuscated the substantive needs of pre-existing queer alliances. Queer communities continue to organise for their own emancipation and despite their vulnerability, queer visibility offers a public counter-narrative of resistance and survival against the brutalities of society and the state. This article examines the declining prestige and utility of one of the mainstays of pre-Enlightenment peacemaking: treaties uniting once belligerent dynasties through marriage. By the late Middle Ages, interdynastic marriages had become such a common feature of the diplomatic landscape that the practice seemed almost transhistorical, something that was done always and everywhere. By the reign of Louis XIII, however, statesmen began stressing the limits of interdynastic marriage as a diplomatic strategy. This transformation of French affairs of state (...) coincided with the appearance of prose romances that scholars identify retrospectively as the first French novels. This essay focuses on two of the most popular and influential of these novels, César Vichard de Saint-Réal's Dom Carlos and the Countess of La Fayette's La Princesse de Clèves, as responses to the devaluation of the marriage diplomacy that had established dynastic networks between France and the Mediterranean world for centuries. Both works center on the 1559 Peace of Cateau-Cambrésis between France and Spain, which married Henri II's daughter Elisabeth de Valois to King Philip II. While Saint-Réal does not condemn such arrangements wholesale, he suggests that their success is highly subject to fortune. La Princesse de Clèves owes much to Saint-Réal's portrayal of the personal costs of marriages of state, as well as to Madame de La Fayette's own observations of the French and Savoyard courts. Although her focus on the interior life of her heroine limits explicit political commentary, her allusions to miserably unhappy queens-consort cast marriage diplomacy in an overwhelmingly negative light. In this article I consider whether there a right to incestuous marriage. I begin by suggesting that the liberal state get out of the "marriage" business by leveling down to a universal civil union or "registered domestic partnership" status. Removing the symbolism of the term "marriage" from political conflict, privatizing it in the same way as religion, would have the advantage of both consistency and political reconciliation. The question is then whether incestuous unions should be (...) both legal and eligible for this status. I argue that the arguments compatible with public reason for prohibiting them outright, or even for excluding them from the permissible types of legally registered partnerships, are quite weak. The objections to allowing such relations are those from (1) child abuse; (2) unfair burdening of society; and (3) the creation of bad lives. I argue that while rape and other forms of child abuse would be no more legal or tolerated than they are now, the concern about any form of weakening a society's legal and political resources to combat such abuses does indeed register on the justificatory scale, but does not prove that such first-degree incestuous sexual relations are inherently bad enough to warrant intervention in their own right. I then argue that the concern about unfairly burdening society with unhealthy persons is not as dangerously totalitarian as we might initially fear, but nor is it strong enough to justify an outright prohibition. Finally, I argue that a concern to dissuade persons from creating certain kinds of lives (children with extreme birth defects) is also not as dangerously totalitarian as we might initially fear, and in fact goes further towards explaining why we might have a legitimate interest in intervening. Nonetheless, I argue that the criminalization of such acts only make sense when they are indicators of other offenses, namely negligence or abuse, and it thus seems that the act of consanguineous reproduction is itself insufficient. One potentially surprising conclusion of this inquiry is that far from creating strong reasons for tolerating these practices, religious or cultural reasons for valuing incest (as well as polygamy) actually seem to count against tolerating them. The reason is that from a liberal perspective, tolerating polygamy and incest involves the assumption that it is possible to disassociate polygamy and incest simpliciter from abusive practices associated with them, including environments where children are raised to devalue their own sexual (and other) autonomy. However, the presence of comprehensive doctrines which include polygyny or incest as part of a good life actually makes it harder to justify disassociating polygamy and incest themselves from the likely abuse and coercion practiced by those who would value polygyny or incest. A Marriage Made in Hell Where did they come from, these furiously self-righteous “social justice warriors”? The growing radicalism and intolerance on the American left is the result of the strange union of Nietzsche’s “will to power” and a secularized Puritan moralism. In this penetrating study, Mark T. Mitchell explains how this marriage made in hell gave birth to a powerful and destructive political and social movement. Having declared that “God is dead,” Friedrich Nietzsche identified the “will (...) to power” as the fundamental force of human life. There is no good or evil in a Nietzschean world—only the interests of the strong. Reason and the common good have no place there. The Puritan, by contrast, is morally rigorous, zealous to promote virtue and punish vice. America’s Puritan tradition, now thoroughly de-Christianized, has been reduced to a self-righteous moral absolutism that focuses on the faults of others, intent on avenging the sins of society, institutions, and the past in pursuit of the secularized ideals of equality, diversity, and social justice. As Nietzsche’s ideas have permeated our culture, a new generation of radicals has embraced the rhetoric and tactics of the will to power. But the strength of America’s residual Puritanism keeps them only half-baked Nietzscheans. More Christian than they care to admit, they cling to a moralism that Nietzsche would despise. The incoherence of their mixed creed dooms social justice warriors to perpetual frustration. Their identity politics generates ever more radical demands that can never be satisfied, further fracturing a society in desperate need of a unifying myth. Knowledge networking in the cross-cultural setting here focuses on promoting a culture of shared communication, values and knowledge, seeking cooperation through valorisation of diversity. The process is seen here in terms of creating new alliances of creators, users, mediators and facilitators of knowledge. At the global level, knowledge networking is seen as a symbiotic relationship between local and global knowledge resources. This focus is informed by the human-centred vision of the information society, which seeks a symbiotic relationship between technology (...) and society. It explores the nature of the knowledge in transition, raising issues of technology and knowledge transfer in the local–global context. The notions of human–machine symbiosis and of diversity and coherence provide a handle to explore the role of technology for sustainable development. The centrality of knowledge in stimulating knowledge networking for cross-cultural collaboration is illustrated through an exemplar of an EU–India Cross-Cultural Innovation Network project, a collaboration between European and Indian universities and institutes. In this article, I respond to queer critiques of the pursuit of same-sex marriage. I first examine the issue of normalization through a consideration of the everyday lives of same-sex couples with children, a subject about which queer critics are strangely silent. Children force same-sex couples to be out in multiple areas of their lives and recent court cases explicitly challenge the idea that same-sex couples do not make fit parents. Second, I examine whether same-sex marriage will address (...) structural inequalities or will mainly benefit white, middle-class people. Access to marriage has disparate benefits depending on people’s structural locations, but is a movement goal supported by a broad array of LGBT people. Third, I examine the relationship between marriage, regulation, and the state. I argue for a broader understanding of the relationship between the state and different types of relationships, suggesting that it is impossible to escape regulation. If we consider marriage and family forms cross-nationally, we see a variety of possibilities for state recognition of various family forms. I conclude by assessing the impact of same-sex marriage on the future of LGBT politics, arguing that achieving marriage equality may allow the space for new political possibilities to emerge. This article investigates the often cited and dismissed, but rarely examined, relationship between legalizing same-sex marriage and polygamy. Employing a comparative historical analysis of U.S. and South African jurisprudence, ideology, and cultural politics, we examine efforts to expand, restrict, and regulate the gender and number of legally recognized conjugal bonds. South African family jurisprudence grants legal recognition to both same-sex marriage and polygyny, while the United States prohibits and resists both. However, social and material conditions make it (...) easier to practice family diversity in the U.S. than in South Africa. Our analysis of the very different histories of polygamy and same-sex marriage in the two societies suggests the centrality of racial politics to marriage regimes, yielding paradoxical narratives about the implications of legal same-sex marriage for the future of polygamy and sexual democracy. If there is a slippery marital slope, we argue, it does not tilt in a singular or expected direction. (shrink)

The author deals with conservative political philosophy by analysing its foundations and outlining the changes that this doctrine has undergone from its inception to the present day. Paradoxically, for a doctrine whose essence is scepticism about change and a belief in the known, conservatism has changed its foundations, whether we are talking about an organic understanding of society, tradition, property or religion and family values. The author argues that conservatives have lost the so-called cultural war to achieve victories (...) in the political arena, and in doing so have compromised their core beliefs. The author outlines the alliance of a conservative ideology with a neo-liberal or libertarian one, forged in the fight against etatism and communism, which resulted in the retreat of conservatism in favour of the ideas of classical liberalism. The reformation of conservatism by absorbing liberal values often led to the creation of an idea that could no longer be called conservative. The author uses examples of Anglo-American conservatism to try to confirm the thesis presented, but as a reaction to this process he also highlights the incarnation of the values of American conservatism, which had been marginalised for decades, at the beginning of the 21st century. This article draws attention to an understudied phenomenon, transnational political alliances (TPA), which occur when multinational corporations cooperate with local companies to influence public policies of the host government. The article first explores the economic and political sources of TPAs, their structures, and the obstacles to their formation. It then examines TPAs in the context of China, a critical case because of the hostile political environment that discourages TPAs. However, the surprisingly common occurrence of TPAs in China (...) indicates the power of economic incentives for political cooperation yet also suggests the need for further studies of TPAs in a wide variety of economic and political settings. Cosmopolis A Review of Cosmopolitics -/- 2015/3-4 -/- Editorial Dominique de Courcelles & Paul Ghils -/- This issue addresses the general concept of “spirituality” as it appears in various cultural contexts and timeframes, through contrasting ideological views. Without necessarily going back to artistic and religious remains of primitive men, which unquestionably show pursuits beyond the biophysical dimension and illustrate practices seeking to unveil the hidden significance of life and death, the following papers deal with a number of interpretations covering (...) a wide field extending from belief to theory, from emotions to concepts, from the wisdom of personal experience to the most sophisticated doctrines. Spirit and spirituality are indeed many-faceted notions. They may refer to the intricate world of the interacting spirits which inhabit living beings in animistic traditions, without excluding a “grand force” linking human beings within a dynamic whole on which their very existence rely . They also bear upon more atomistic and either/or approaches of Western philosophy, which have become embodied in Cartesian dualism against a monotheist background, to the point of freezing the essence of individuals and culminating in the extreme individualism that characterizes our contemporaries. However, this equally refers to the opposite conception of materialism, across times and cultures, from ancient India and Greece (Cārvāka, originally known as Lokāyata, or some Buddhist doctrines for the former, Democritus or Lucretius for the latter) to more contemporary materialistic schools, whether modern or postmodern. -/- The following papers look at the contrasting forms of the philosophy and spirit of the human factor set into a whole, with no artificial disjoint between the psychical and the physical levels, as Wittgenstein put it: “And how can a body have a soul?”. This approach is not unrelated to the notion of anthropocene examined in a recent issue of Cosmopolis, with provides another comprehensive framework open to a spiritual life emerging from the very environment that generated it. -/- *** The first section of this issue was edited by Dominique de Courcelles, director at the National French Research Centre (CNRS), whom we wish to thank for collecting relevant studies relating to the religious and political questions, with a view to focusing on the war of ideas inevitably waged behind images, concepts and perceptions, taking an asymmetrical approach. To the extent that they are mindful of global/local interactions and include representations, opinions and beliefs, such disciplines as philosophy, philology, history and social sciences can provide useful studies accounting for new practices in geopolitics and a fair diplomacy. -/- In her introduction, Dominique de Courcelles first poses the question of how the religious and political spheres interrelate, with their corresponding religious demands and humanistic values. She then suggests that the right question today may be breaking with the philosophy of human rights concerned with the defense of human beings against the hazards of arbitrary politics or the instrumental use of religion, in favour of a fair philosophy of humankind, a new humanism. This would consist in recognizing a common loyalty of all towards one interhuman, not only interstate community, to protect it from both the autonomy demanded by individuals and the instrumental use of minorities. -/- Considering the fact of diversity, so important today in terms of both politics and religion, Abdelhai Azarkan looks at the conditions under which tolerance could obtain the double status of right and duty. He revisits to two philosophers, John Locke and Voltaire, who thought about it from the historical reality of religious wars. The former made tolerance into a right, basing his analysis on the political-legal level, while the latter saw tolerance as a duty, from an analysis based on ethical-political criteria. -/- Mathieu Guidère examines what he calls semantic denominationalism, a term which implies religious attributes and identities, whichever national loyalties or personal belonging they may have at the same time. Since the early 2000s, thie phenomenon has expanded tremendously, compounded by the “war on terror” and the over media-oriented terrorist actions. Denominational expressions act as formal names for ordinary and high-profile players in domestic and foreign policies of democratic states. These systems reveal a receding secularization, while the powerful comeback of religious identities signals the failure of nation-states and the weakening of the humanist spirit. -/- Barbara De Poli retraces the history of a contemporary jihadism claiming its Islamic essence and asserting the truth of genuine coranic principles via the war on infidels, with a view to restoring the Caliphate. After defining the term jihad, she shows that even if this contemporary jiadism is spreading in the Muslim world, it radically departs from Islamic law and the received use of the term jihad, in so far as it is rooted in the early radical thinking of Islamic ideologues in the 20th century, starting with with Hassan al-Banna, the founder of the Muslim Brotherhood. This current has been fueled by by international conflicts since the outbreak of the war in Afghanistan, in which the so-called Western countries bear a major responsibility. -/- Abderrazak Sayadi starts from the Tunisian experience to ask the question of humanist values and democracy within the relationships between the religious and political spheres. As a historian of religion, he is brought to demystify certain islamic principles and to paying attention to the reform of law, seeing the separation of religion and politics as a precondition to a successful democratic gamble and the establishment of a renewed humanism. -/- Dominique de Courcelles reminds us that getting a better knowledge of narrations and words makes it possible to better understand how logical and rhetorical thinking works for those who wage an asymetriccal war, re-enchanting and mystifying the world to better take control. As soon as 1932, an exchange of letters between Einstein and Freud made it clear that, in order to free man from fatality and war, education understood as culture was fundamental. Such illustrations as the exécution of Oussama ben Laden and the Caliph’s speech in Mossoul show that a premiminary analysis of images and words is essential to a fair diplomacy conducted by people from civil society, whose culture and wisdom allow justice and force to speak together and better resist war. -/- Marcel Boisard thinks that on the day the guns fall silent, exhausted by war, we will not return to the state borders that have prevailed for a century as an outcome of the Sykes-Picot agreement of 1916. It is time to prepare the “day after”, which will be a huge challenge. To this end, a summit of Middle-East nations is urgently needed to globally decide the fate of those peoples. On the condition that we know who the enemy is and accept to name it, to understand the history of the countries, groups and alliances, and to question any false or self-interested sense of certainty. -/- *** In the second section, Paul Schafer provides the author’s experiences to explain how culture, from the artistic to the biological, has the power to to open the doors to spirituality, from the inner self to the global environment. He asks himself whether a relative permanence of spirituality can arise from the specific moments that characterize it. Laurent Ledoux synthesizes the conclusion of a symposium held on 22 January 2015 on the links between philosophy and management, on the basis of the spiritual dimension conceived as “natural” and the answers it may suggest to the issues that face the organizations in a “contemporaniversal” world. Jacques Rifflet makes that question in a secular perspective, based on the wellsprings of personal commitment before it can be caught by any religious creed or scientific theory. In this sense spirituality, in alliance with reason, both inspires human consciousness and illuminates its destiny. Sami Aldeeb asks himself whether Islam can be reconciled with human rights. Caught between the belief in an absolute and final Word descended from the sky, and evidence showing that any religion is the creation of a given culture and a society situated in time and space, the Makkan and … contexts et médinois call for differentiated, if not opposite answers and exegeses. Bernard Carmona provides the outline of a dialogical framework, which is known to be a feature of debates between the various philosophical schools of classical India, exemplified here by the transdisciplinary perspective of debates within a Buddhist context. *** The articles not focused on the previous topic include a study by Landry Signé on China’s strategy, competing with the United States to control African resources. The author deals with the specific case of China’s rapprochement with Southern Sudan since Sudan was broken up. In the last paper, Goran Fejić and Rada Iveković, return to the essential role that women should play, and comments upon the role of some international legal instruments related in particular to the elimination of all forms of discrimination. The perspective is transnational and transethnic and is based on secular criteria, as regards nation-building and more generally society-building. Considering the persistence of widespread violence, whether in times of armed conflict or in times of peace, the question remains whether it is possible to fully implement rights and justice instruments. Increasingly in today’s world we are experiencing intensifying antagonisms around religious and ethno-cultural differences. The confrontation between political Islam and the so-called ‘West’ has replaced the rhetoric of the Cold War against communism. This new constellation has not only challenged the hypothesis that ‘secularization’ inevitably accompanied modernity but has also placed on the agenda political theology as a potent force in many societies. This article analyzes the contemporary revival of political theology by focusing on the headscarf (...) debate in comparative constitutional perspective. It compares the well-known decision of the French Parliament banning the wearing of the headscarf in public schools (2004) with the decision of the German Constitutional Court concerning whether Fereshta Ludin, an Afghani-German teacher wearing the hijab, could teach in German schools (2003) and with the more recent judgment of the Turkish Constitutional Court (summer 2008) upholding the ban on the wearing of the scarf or the turban in institutions of higher learning. At stake in these debates is not only the meaning of fundamental human rights but also why women and their bodies become the object of disciplinary conflicts in culture, law and religion. (shrink)

Building on the cultural transfer theory of Michel Espagne and Michael Werner, the paper examines the history of Marian Zdziechowski’s interactions with Leo Tolstoy. Its starting point is their correspondence of the 1890s, and the endpoint – Zdziechowski’s magnum opus Pessimism, Romanticism and the Bases of Christianity (1915). The main emphasis lies on two microhistories of cultural transfer with opposing vectors, represented in the relations between these two figures. The first, revolving around the publication of Zdziechowski’s essay Religious (...) and Political Ideals of Polish Society, is dedicated to the attempts of Zdziechowski, a young Polish intellectual, to secure a place in the field of Russian intellectual culture with the help of Tolstoy, one of its leading figures. The second concentrates on Tolstoy’s letter to Zdziechowski, which the latter used as a preface to a separate publication of his essay. Aiming to communicate the idea that Tolstoy was no enemy for the Poles to the Polish audience, Zdziechowski thus responded to the critical reaction to Tolstoy in the Polish press of the Austro-Hungarian Empire. In the end, the figure of Zdziechowski as a mediator between cultural fields proves to be of high value for further studies of processes and mechanisms of cultural transfer. (shrink)

Political and social commentators regularly bemoan the decline of morality in the modern world. They claim that the norms and values that held society together in the past are rapidly eroding, to be replaced by permissiveness and empty hedonism. But as Edward Rubin demonstrates in this powerful account of moral transformations, these prophets of doom are missing the point. Morality is not diminishing; instead, a new morality, centered on an ethos of human self-fulfillment, is arising to replace the old (...) one. As Rubin explains, changes in morality have gone hand in hand with changes in the prevailing mode of governance throughout the course of Western history. During the Early Middle Ages, a moral system based on honor gradually developed. In a dangerous world where state power was declining, people relied on bonds of personal loyalty that were secured by generosity to their followers and violence against their enemies. That moral order, exemplified in the early feudal system and in sagas like The Song of Roland, The Song of the Cid, and the Arthurian legends has faded, but its remnants exist today in criminal organizations like the Mafia and in the rap music of the urban ghettos. When state power began to revive in the High Middle Ages through the efforts of the European monarchies, and Christianity became more institutionally effective and more spiritually intense, a new morality emerged. Described by Rubin as the morality of higher purposes, it demanded that people devote their personal efforts to achieving salvation and their social efforts to serving the emerging nation-states. It insisted on social hierarchy, confined women to subordinate roles, restricted sex to procreation, centered child-rearing on moral inculcation, and countenanced slavery and the marriage of pre-teenage girls to older men. Our modern era, which began in the late 18th century, has seen the gradual erosion of this morality of higher purposes and the rise of a new morality of self-fulfillment, one that encourages individuals to pursue the most meaningful and rewarding life-path. Far from being permissive or a moral abdication, it demands that people respect each other's choices, that sex be mutually enjoyable, that public positions be allocated according to merit, and that society provide all its members with their minimum needs so that they have the opportunity to fulfill themselves. Where people once served the state, the state now functions to serve the people. The clash between this ascending morality and the declining morality of higher purposes is the primary driver of contemporary political and cultural conflict. A sweeping, big-idea book in the vein of Francis Fukuyama's The End of History, Charles Taylor's The Secular Age, and Richard Sennett's The Fall of Public Man, Edward Rubin's new volume promises to reshape our understanding of morality, its relationship to government, and its role in shaping the emerging world of High Modernity. Throughout the twentieth century, women's magazines in the United States have socialized their readers to the “proper” expression of love and anger in marriage. Our analysis of a random sample of marital advice articles from 1900 to 1979 examines this cultural convergence of gender, marriage, and emotion. A qualitative analysis identifies techniques for socializing readers to the emotional culture of marriage and shows a historical change toward equating love with self-fulfillment and advocating the expression of anger. A quantitative analysis then specifies the timing of changes in emotion norms and showed an oscillation between modern and traditional norms that is related to waves of political liberation versus oppression. We discuss the relation between emotion norms and behavior and explore the effect of group conflict on the production of emotional culture. Emotion norms have become less rigid and more tolerant of diversity; but gender differences persist, and women are still responsible for maintaining intimate relationships. Historical trends in love and anger norms are nonlinear, not a continuous shift toward individualism, self-development, and free expression, as suggested by recent cultural theories. (shrink)

Public opinion in recent years has soured on multiculturalism, due in large part to fears of radical Islam. In Multiculturalism without Culture, Anne Phillips contends that critics misrepresent culture as the explanation of everything individuals from minority and non-Western groups do. She puts forward a defense of multiculturalism that dispenses with notions of culture, instead placing individuals themselves at its core. Multiculturalism has been blamed for encouraging the oppression of women--forced marriages, female genital cutting, school girls wearing the hijab. Many (...) critics opportunistically deploy gender equality to justify the retreat from multiculturalism, hijacking the equality agenda to perpetuate cultural stereotypes. Phillips informs her argument with the feminist insistence on recognizing women as agents, and defends her position using an unusually broad range of literature, including political theory, philosophy, feminist theory, law, and anthropology. She argues that critics and proponents alike exaggerate the unity, distinctness, and intractability of cultures, thereby encouraging a perception of men and women as dupes constrained by cultural dictates. Opponents of multiculturalism may think the argument against accommodating cultural difference is over and won, but they are wrong. Phillips believes multiculturalism still has an important role to play in achieving greater social equality. In this book, she offers a new way of addressing dilemmas of justice and equality in multiethnic, multicultural societies, intervening at this critical moment when so many Western countries are poised to abandon multiculturalism. Intersectionality is a travelling theory; now enjoying significant contemporary visibility and popularity in the feminist blogosphere, it has moved across disciplines and borders in ways that are quite distinct from the scholarly critique developed by Kimberlé Crenshaw some time ago. In this article, I consider how intersectionality is translated, and retheorised, as an intertwined set of everyday knowledges and associated governmental practices that both echo and diverge from some of the complexities and politics of its wide-ranging scholarly uptake. Drawing on (...) interviews with self-identifying feminists in a pilot project mapping contemporary Australian digital feminisms, this article explores two overarching patterns in intersectionality’s mobilisation. First, the shift to understanding intersectionality as an everyday conceptual grid plotting women’s differences along one axis, and measuring relative privilege and disadvantage on the other, recentring whiteness and liberal multicultural models of diversity and inclusion. Second, the transformation of intersectionality into an abstract, individualistic model of conduct, involving the citation and classification of ‘white feminist’ behaviour elsewhere, in frequent judgments on US celebrity culture. As such, intersectionality, while seemingly popular, often remained curiously ‘theoretical’ and divorced from embodied, everyday practices. I suggest in what follows that such a model of intersectionality raises questions of the commercial, racialised, political and mediated conditions that shape the theory’s visibility and materialisation. This article reconstructs the forgotten friendship between Georges Bataille and the Russian émigré poet and philosopher Boris Poplavsky. Comparing their solar metaphysics, I focus on conceptions of friendship, sacrifice and depersonalisation. First, I retrace Bataille’s relationship to early Surrealis and Russian circles in interwar Paris, with a focus on his friendship with Irina Odoevtseva. I then offer a novel reading of Poplavsky’s poetry through the lens of Bataille’s philosophy, analysing a recurring motif that I call ‘dark solarity’. Uncovering a hidden (...) intertextual dialogue between Poplavsky and Bataille, I argue for Poplavsky’s lasting impact on Bataille’s anti-Icarian sun cult. Finally, my paper demonstrates how Poplavsky’s writings on solar sacrifice, excess and friendship left marks on Bataille’s vision of a solar community, embodied in the secret society Acéphale. The dialogue between Poplavsky and Bataille, I finally suggest, is a missing piece in the entangled history of Russian and French philosophy, as well as an original contribution to discourses on friendship in twentieth-century continental thought. In the ground-breaking 2018 judgment of Navtej Singh Johar v. Union of India, the Hon'ble Supreme Court of India ushered in a new era by decriminalizing homosexuality, marking a pivotal moment in the country's legal history. However, this progressive stride was accompanied by persistent questions concerning homosexual rights that remained unexplored within both cultural and legal frameworks. Despite the legal acknowledgment, members of the homosexual community are often professed merely as 'individuals' and not fully integrated into mainstream society. This (...) perception is aggravated by the absence of a societal 'stamp of marriage,' reinforcing their marginalization. In the realm of Hindu law, the sanctity of marriage is deeply rooted in the scriptures, which explicitly define it as the union of 'two souls.' Remarkably, these very scriptures also assert that a soul is inherently without gender, elucidating that gender is a characteristic exclusive to the human body. It is crucial to recognize that Hindu law, including the relevant Acts, draws extensively from these scriptures, making them a fundamental source of legal principles. The legislation, such as the Hindu Marriage Act, essentially serves to codify and organize the pre-existing Hindu law without seeking to undermine the intrinsic values enshrined within the Holy Scriptures. This article aims to delve into the unaddressed aspects of homosexual rights within the contemporary legal framework, shedding light on the denied rights that persist. While global attitudes are progressing towards recognizing and safeguarding homosexual rights, the Indian government and cultural factors appear hesitant to renounce orthodox and conservative stances. This article seeks to analyse and critique these aspects, exploring the challenges hindering the full acceptance and integration of homosexual individuals into the broader societal fabric despite the transformative legal landscape initiated by the Navtej Singh Johar case. If a state with liberal political and justificatory commitments extends benefits of various kinds to persons forming families, what qualifications may such a state place on the right to access to those benefits? I will make two assumptions for the purposes of this paper. The first is the political and justificatory terrain of some form of political or otherwise non-perfectionist liberalism. The assumption is that we are considering the resources and limitations of a community of persons who (...) accept moral pluralism (if not a specific doctrine like the "burdens of judgment"), some priority for individual freedom, and the obligation to justify public coercion and exclusion in terms accessible and fair to all members of morally and culturally diverse society. The second is that it is justified for a liberal state to recognize some forms of domestic partnerships or families in the first place and extend further benefits to them such as tax credits or laws extending (or facilitating the extension of) medical or social insurance. It is, of course, possible to imagine the argument that the liberal state gets out of the marriage business by getting out of it entirely - by extending no recognition or positive rights to families whatsoever beyond negative non-interference rights. I am interested in the dilemma of a society broadly like existing liberal ones which is committed both to subsidizing families and also to justificatory neutrality (expressed in American constitutional legal terms as the requirement of providing a "rational basis" for unequal treatment). Given these assumptions, I believe that the most justifiable policy on liberal grounds is not the institution of "marriage" increasingly open to new constituent relationships but rather a status of "registered domestic partnership" which fulfills the social and moral aims behind subsidizing the family but is entirely neutral not only to the gender or even to the numbers of the partners, but also to the affective and emotional content of domestic life and the purposes behind contracting domestic partnerships. So is there a right to polygamy and incestuous marriage? There is not a specific right to either and thus there is no a priori reason why some restrictions or even prohibitions on them might not be justified, but the same is true for every specific act where a general right to the freedom exists. I argue in this paper, however, that the arguments compatible with public reason for prohibiting them outright, or even for excluding them from the permissible types of legally registered partnerships, are quite weak. I argue that objections to polygamy from (1) female autonomy, (2) damage to children, (3) fairness in the marital market, and (4) the unfair burdening of society are serious and worth refuting, but do not establish a victorious case against multi-member relationships. As to incest, there are two separate questions. The first is whether the new institution of "registered domestic partnerships" should be open to them. The answer to that, given the state's lack of interest in citizens' reasons for forming partnerships and in what they do whilst being registered in one, is clearly "yes." The second is whether, entirely separate from the issue of legal recognition of domestic partnership, the state has a legitimate rational interest in deterring, preventing or punishing consanguineous sexual relations between close blood relations (first-degree incest). Here, the objections to allowing such relations are those from (1) child abuse; (2) unfair burdening of society; and (3) the creation of bad lives. I argue that while rape and other forms of child abuse would be no more legal or tolerated than they are now, the concern about any form of weakening a society's legal and political resources to combat such abuses does indeed register on the justificatory scale, but does not prove that such first-degree incestuous sexual relations are inherently bad enough to warrant intervention. I then argue that the concern about unfairly burdening society with unhealthy persons is not as dangerously totalitarian as we might initially fear, but nor is it strong enough to justify an outright prohibition. Finally, I argue that a concern to dissuade persons from creating certain kinds of lives (children with extreme birth defects) is also not as dangerously totalitarian as we might initially fear, and in fact goes further towards explaining why we might have a legitimate interest in intervening. Nonetheless, I argue that the criminalization of such acts only make sense when they are indicators of other offenses, namely negligence or abuse, and it thus seems that the act of consanguineous reproduction is itself insufficient. Prior to the pandemic of 2020, global tourism accounted for over ten percent of global GDP, for a total of $9.6 trillion USD; one in every four jobs created that year, across the globe, was in the travel and tourism sector. And yet the figure of the international tourist is often regarded with an attitude ranging from bemusement to outright contempt so much so that a series of books exists to guide tourists on how to avoid looking or acting like (...) tourists. Why, though, is the figure of the tourist —especially the international tourist— so disreputable? Given the sheer number of such tourists (over 1.4 billion, in 2018 alone) it seems odd to think that there is something shameful or problematic about tourism as a practice. What accounts for our seeming disdain for the tourist, even as so many of us engage in tourism ourselves?There are, of course, many obvious answers to this question. The tourist —especially the international tourist— is often a figure of some wealth and privilege; that tourist is likely to be clumsy, at best, in his or her navigating of a foreign society; and he or she is often likely to be less careful in her caretaking of the physical and social spaces into which she travels, given the fact that she is as it were on vacation. These facts may be enough to engender some antipathy towards the tourist especially one who, as Jarvis Cocker noted thirty years ago, regards the local inhabitants as somehow amusing. Tourists are likely to be —as the British aphorism had it about American GIs— oversexed, overpaid, and over here. In this paper, though, I want to suggest a slightly different story for our ethical disquiet with the figure of the tourist. I will argue that the practice of international tourism raises two distinct sorts of ethical worries —both of which reflect the fact that international tourism requires a local industry in which cultural difference is curated and made consumable by the foreign tourist—. This fact may lead to ethical disquiet, I argue, because it can represent a site at which there is a maldistribution of the benefits and burdens of intercultural conversation; the local who works in the tourism industry must become adept at performing his or her culture for the outsider, while that outsider gains the benefits of intercultural conversation without bearing a similar burden of epistemic labor. A second reason for concern, however, stems from the ways in which this demand for epistemic labor can end up deforming and destabilizing local forms of citizenship and political agency. Those who spend their days performing a debased and simplified version of their cultural identity for outsiders may be, I believe, marked by that effort and their own ability to engage in political conversations with fellow local members may be made more difficult as a result. International tourism, in short, may be a site from which both distributive and political injustices might emerge. These concerns, I should note, may exacerbate already objectionable relationships reflecting colonial legacies of oppression; but they may exist even in the absence of any history of colonialism. The mere fact of a market in the curated experience of cultural difference may be enough to raise these worries; and international tourism, I believe, often involves exactly this form of market. This intellectual portrait of Romain Rolland --French novelist, musicologist, dramatist, and Nobel prizewinner in 1915--focuses on his experiments with political commitment against the backdrop of European history between the two world wars. Best known as a biographer of Beethoven and for his novel, Jean-Christophe, Rolland was one of those nonconforming writers who perceived a crisis of bourgeois society in Europe before the Great War, and who consciously worked to discredit and reshape that society in the interwar period. Analyzing Rolland's (...) itinerary of engaged stands, David James Fisher clarifies aspects of European cultural history and helps decipher the ambiguities at the heart of all forms of intellectual engagement. Moving from text to context, Fisher organizes the book around a series of debates--Rolland's public and private collisions over specific committed stands--introducing the reader to the polemical style of French intellectual discourse and offering insight into what it means to be a responsible intellectual. Fisher presents Rolland's private ruminations, extensive research, and reexamination of the function and style of the French man of letters. He observes that Rolland experimented with five styles of commitment: oceanic mysticism linked to progressive, democratic politics; free thinking linked to antiwar dissent; pacifism and, ultimately, Gandhism; antifacism linked to anti-imperialism, antiracism, and all-out political resistance to fascism; and, most controversially, fellow traveling as a form of socialist humanism and the positive side of antifascism. Fisher views Rolland's engagement historically and critically, showing that engaged intellectuals of that time were neither naive propagandists nor dupes of political parties. David James Fisher makes a case for the committed writer and hopes to re-ignite the debate about commitment. For him, Romain Rolland sums up engagement in a striking, dialectical formula: "Pessimism of the Intelligence, Optimism of the Will." His story presents a powerful challenge to modern intellectuals. The ArgumentThe question posed by this paper is why the Russian autocracy failed to pursue successfully Peter the Great's conscious policy of creating a society dominated by technique and competitive with technological levels achieved by Western Europe. The brief answer is that Peter's idea of a cultural revolution that would create new values and institutions hospitable to the introduction of technology clashed with powerful interests within society. The political opposition centered around three groups which were indispensable to the (...) state in fulfilling his vision: the nobility, the clergy, and the scientific establishment. Peter's original intention was to combine theoretical models and technology transfer from the West with educational reforms in Russia to produce new cadres of technical specialists. He attempted to adapt the Leibniz-Wolff cosmology to Russian conditions in order to reconcile ideological conflicts between military service and technical training, science and religion, theory and practice. The embodiment of his ideas in Russian science and religion were Mikhail Lomonosov and Feofan Prokopovich. Under his successors Peter's supporters encountered increased resistance: from the nobility to technical education, from the clergy to the scientific outlook, and from the Academy of Sciences to practical work. All three interest groups were willing to sacrifice real political rights for a recognition by the states of their autonomy to define their social roles. In the end the compromise was effected at the expense of Peter's ideal of the society dominated by technique. (shrink)

This article examines the development of the concept of laicity and its specific application within the French political, social and cultural context. In doing so it contends that, far from being a 'French exception' as is sometimes perceived in the media, laicity in France drew on concepts and practices already in place in other countries at the time of the 1905 legislation separating church and state. The article concludes by asserting a distinction between laicity and secularism, whereby the (...) former emphasises the separation of the roles of state and religion within a nation, whereas the latter refers to the progressive loss of relevance of religion within a culture. The specific definition of laicity has been enshrined in a recent International Declaration of Laicity in the 21st Century. (shrink)
