Identification of rhetorical roles like facts, arguments, and final judgments is central to understanding a legal case document and can lend power to other downstream tasks like legal case summarization and judgment prediction. However, there are several challenges to this task. Legal documents are often unstructured and contain a specialized vocabulary, making it hard for conventional transformer models to understand them. Additionally, these documents run into several pages, which makes it difficult for neural models to capture the entire context at (...) once. Lastly, there is a dearth of annotated legal documents to train deep learning models. Previous state-of-the-art approaches for this task have focused on using neural models like BiLSTM-CRF or have explored different embedding techniques to achieve decent results. While such techniques have shown that better embedding can result in improved model performance, not many models have focused on utilizing attention for learning better embeddings in sentences of a document. Additionally, it has been recently shown that advanced techniques like multi-task learning can help the models learn better representations, thereby improving performance. In this paper, we combine these two aspects by proposing a novel family of multi-task learning-based models for rhetorical role labeling, named MARRO, that uses transformer-inspired multi-headed attention. Using label shift as an auxiliary task, we show that models from the MARRO family achieve state-of-the-art results on two labeled datasets for rhetorical role labeling, from the Indian and UK Supreme Courts. From an overall perspective of vedantic ethical vision and its application to managerial and corporate ethical morality, the book examines what the Vedantic ethical system, and great thinkers like Tagore, Gandhi, Burobindo and others, can teach us about such questions as individual leadership, transformation of the work ethos, ethics (...) and productivity, and others. Unethical business in India became a recognized phenomenon during the second World War. Academic/journalistic/legal concern with ethics has become visible only during the nineties. Corruption-of-the-poor and corruption-of-the-rich need to be distinguished - especially in the context of globalization. The danger of attributing unethical practices to system failure is recognized. It is also important to bring to bear on intellectual property rights the more fundamental principle of natural property rights. Consciousness ethics will be more crucial than just intellectual ethics.

Amartya Sen’s remarkable endeavour to realize the normative capability of welfare economics goes beyond the impecunious resultants of the neoclassical welfare economy. The neoclassical welfare economy decoratively bracketed values to speculate about factual observations. This was due to the influence of logical positivists and their convictions about experimental scientific statements (primarily mathematical) and their vicinity to empirical truths and analytic statements. Sen adequately inquires “whether morality can be expressed in the form of choice between preference patterns rather than between actions” (...) (Sen, 1997a, 78). “A new phase classical theory” in economics from the hands of Sen and some others put forth two pivotal issues in a unified manner: a. Mathematical models of an economy. b. Ethical reflection on the subject of welfare economy–a value-laden enterprise in Sen’s literature. -/- In general, welfarists and utilitarians affirm that moral values are anchored in individual agency and involve mental metric utilities (pleasure, happiness, pain etc.). This focus, first of all, results in a disadvantage, as it undermines freedom in terms of achievement. Secondly, it pays no heed to achievement reasonably giving more importance to those who are incapable of reflecting on any one of those mental metrics. Besides, Sen argues that equality of opportunity does not accord with the equality of freedom, and its reason is rooted in the scope of the incongruity of human beings and the diversified meanings of efficiency. Developing a general methodological approach to revisit the notion of inequality concerned by exploring a particular substantive stand that Sen aims to underscore involves examining how social arrangements work to define freedom, capabilities, and welfare to ensure comparisons and assessments of quality of life. The book introduces the reader to western ethics as a subject, along with its three standard subdivisions. Although the book is written with university students, policymakers, and professionals in mind, the book is lucid enough to be accessible to most adult readers. The book begins with introductions to the basics of ethics. These chapters are meant to provide the reader with the background knowledge necessary for understanding the more technical chapters on metaethics, normative ethics theories, and applied ethics, the three (...) well-known subdivisions within ethics. The chapters that follow take up core ethical issues from each of these areas. The sections focus on explanation and a critical understanding of the ethical issue. The chapters also have examples, cases, and exercises to encourage critical thinking and to enable the reader to grasp the issue better. The book has tried to bring contemporary issues, such as ethics of human organ transplantation, and contemporary theories, such as Amartya Sen’s concept of Justice and Martha Nussbaum’s Capabilities Approach, to engage the readers with ethics in the real world. The book concludes with applied ethics, but with the example of ethics of artificial intelligence. The aim is to keep ethics as a future-driven activity and to emphasize the need to understand the real-world ethical situations and dilemmas that will affect the stakeholders all around the world in the coming years as artificial intelligence and data-driven technologies change our everyday life. This chapter critiques the notion of identity, a philosophical reaction in the Quinean sense that vindicates another significant hypothesis, which is called the “No entity without identity” theorem. Here, the identification of an entity relies upon its identity. The first segment of this chapter revisits the following question: How do we encounter the concept of a subjective “mind”? Could we “infer” or “experience” the concept of “mind” in our daily lives? Every entity has some characteristics that prompt comparison with similar (...) entities. Although I think that other minds have a subjective periphery and that other minds have an objective periphery lurking behind this (privileged access), we can construe the relationship in a subjective way (individual mind). In the second section of the chapter, I address a different point by considering why the idea of “other minds” causes philosophical dilemmas. Can “other minds” exist as a substance in one’s own mind? The category of human knowledge encompasses the reality of minds and other minds. The other minds remain an accompanying part of the individual mind since the expression, belief, and mental content of the individual mind merge in the linguistic expression in a split manner that we may ascribe as privileged access (subjective incorrigible knowledge) and corrigible knowledge. But I think that the relation between minds and other minds sounds especially idiosyncratic in its own identity. Despite becoming diverse, the individual mind can still be intimate by blending and attunement between the subjective and objective dichotomy. (shrink)

Under the influence of Hilary Putnam’s collapse of the fact/value dichotomy, a resurging approach that challenges the movements of American pragmatism and discourse ethics, I tease out in the first section of my paper the demand for the warranted assertibility hypothesis in Putnam’s sense that may be possible, relying on moral realism to get rid of ‘rampant Platonism’. Tracing back to ‘communicative action’ or the Habermasian way that puts forward the reciprocal understanding of discourse instigates the idea of life-world as (...) composed of ‘culturally transmitted and linguistically organized stock of interpretative patterns’, this section looks for whether Habermas’ psychoanalysis of prolonged discussion can accord with Putnam’s thick ethical terms or not. The last section of the paper pitfalls Putnam’s stance to accepting Habermas’ ‘discourse ethics’ that centers around the context of entangling ‘rational thoughts’ to ‘communication’, but he introduces the idea of fallibilism in a rational query that also attacks the Habermasian metaphysical idea of the validity of ethical statements that goes towards the truth. My next attempt is to see whether Putnam’s objective dictum towards morality that resonates the collapse of fact/value dichotomy from a universalistic stand can successfully evade Rorty’s naive realism and Habermas’ ‘sociologism about values’ respectively. This sort of claim insists on a universalizable pattern of culture-relative value. I consider that the idea of a fact/value dichotomy engages with the inextricable entanglement between the normative and descriptive content, besides the epistemic values having exclusively intertwined with the structure of factual discourse that intends towards collapsing the fact/value dichotomy, a subjective universalizability predilection. The author has attempted to explore historical evidence to seek insights into differences in temperament and ethos between the Eastern and the Western leadership styles. In the process a comparative study of eight personalities (five each from the East and West), comprising nation builders, businessmen, entrepreneurs and politicians, has been done. These leaders have been selected in terms of their social milieu, standing the test of time, having given a sense of direction to their organizations and their leadership qualities, instead (...) of just skills. It has been observed that the Eastern leaders have a spiritual underpinning with varying intensity. On the contrary, leaders from the West in comparable fields do not appear to show any inclination towards reconciliation of spiritual values with material goals. This also vindicates the hypothesis that the Eastern ethos is dominantly 'feminine-intuitive' whereas the Western ethos is primarily 'masculine-rational'. (shrink)

The nominal ground that entwines human beings and animal behaviours is unwilling to admit moral valuing as a non-human act. Just to nail it down explicitly, two clauses ramify the moral conscience of human beings as follows: a) Can non-humans be moral beings?, b) Unconscious animal behaviours go beyond any moral judgments. My approach aims to rebuff these anthropomorphic clauses by justifying animals’ moral beings and animals’ moral behaviours from a meta-ethical stance. A meta-ethical outlook may enable an analysis of (...) ethical and normative views through the limit of moral motives and reasoning. Animals’ sense of moral motives and their apparatus of getting involved in moral acts cannot be compared with human actions. In human moral engagement, we abide by moral paradigmatic theories and their diversified attitudes that could have conceptual and linguistic use in our societal discourses. However, animals’ intentional apparatus may have the propensity to choose an act following the moral consequences (care, utility, responsibility, etc.) in their life-forms. (shrink)

This paper examines the case of a recent H5N1virus (avian influenza) outbreak in West Bengal, an eastern state of India, and argues that poorly executed pandemic management may be viewed as a moral lapse. It further argues that pandemic management initiatives are intimately related to the concept of health as a social 'good' and to the moral responsibility of protection from foreseeable social harm from an infectious disease. The initiatives, therefore, have to be guided by special moral obligations towards biorisk (...) reduction, obligations which remain unfulfilled when a public body entrusted with the responsibility fails to manage satisfactorily the prevention and control of the infection. The overall conclusion is that pandemic management has a moral dimension. The gravity of the threat that fatal infectious diseases pose for public health creates special moral obligations for public bodies in pandemic situations. However, the paper views the West Bengal case as a learning opportunity, and considers the lapses cited as challenges that better, more effectively conducted pandemic management can prepare for. It is hoped that this paper will provoke constructive bioethical deliberations, particularly pertinent to the developing world, on how to ensure that the obligations towards health are fulfilled ethically and more effectively. The paper highlights the alienation and separation produced by science—technology between man and nature, and between man and man. The principal thesis in this paper is that such separative mentality is the root cause of the deterioration in ethics even in unexpected quarters. Warnings about this were foreseen by a number of Indian livers (those who live the thought) and thinkers during the early twentieth century. Their prophecies seem to be unfortunately coming true. The contemporary debate centering round the circumference of feminist discourse has of late been very potent in addressing the issues of certain prejudiced notions in our existing patriarchal structure. This paper is an attempt to show the ongoing paradox existing in the world of feminism which has thoroughly critiqued the patriarchal culture and has naturalized sexual identities, thereby glorifying man’s supremacy and dominion. The patriarchal culture lionized the ideals of brevity, courageousness, and intellect and thought of these as the only (...) special possessions of man in society. The qualities of being submissive, kind and caring in nature is considered to be “ideal” and exclusive qualities of a woman. Even though these qualities are “ideal” to women, they are discarded from being considered as universal in nature and are thought of as insignificant in the mainstream societal structure. These qualities are treated as inferior, and exclusively womanly and hence cannot make their stand in the conventional patriarchal social order. For this reason a dilemmatic situation arises here. My effort is to show that this dilemma cannot be exposed in the sense of gender specific human qualities. (shrink)

This book introduces the theory of graded consequence and its mathematical formulation. It also compares the notion of graded consequence with other notions of consequence in fuzzy logics, and discusses possible applications of the theory in approximate reasoning and decision-support systems. One of the main points where this book emphasizes on is that GCT maintains the distinction between the three different levels of languages of a logic, namely object language, metalanguage and metametalanguage, and thus avoids the problem of violation of (...) the principle of use and mention; it also shows, gathering evidences from existing fuzzy logics, that the problem of category mistake may arise as a result of not maintaining distinction between levels. The paper concentrates on an appreciation of W.V. Quine’s thought on meaning and how it escalates beyond the meaning holism and confirmation holism, thereby paving the way for a ‘meaning nihilism’ and ‘confirmation rejectionism’. My effort would be to see that how could the acceptance of radical naturalism in Quine’s theory of meaning escorts him to the indeterminacy thesis of meaning. There is an interesting shift from epistemology to language as Quine considers that a person who is aware of linguistic (...) trick can be the master of referential language. Another important question is that how could Quine’s radical translation thesis reduce into semantic indeterminacy that is a consequence of his confirmation methord. Even I think that the notion and the analysis of meaning became hopelessly vague in Quine’s later work. I further argue on Quine’s position of meaning that I call, following Hilary Putnam, ‘meaning nihilism’. It seems to me that Quine had no belief like ‘meaning consists in’, or ‘meaning depends on’ something. Through this argument, I would like to challenge the confirmation holism that was foisted by Fodor on Quine’s thesis. My attempt would be to scrutinize Putnam’s point of view that Quine was neither a confirmation holist nor a meaning holist. I think that both Putnam and Quine denied the concept of constitutive connection of meaning as a second grade notion not only from the realm of semantic, but also from the perspective of epistemology. So, linguistic meaning cannot be formed by any sample of its uses. For Quine, the concept of meaning in metaphysics is heuristic and need not be taken seriously in any ‘science worthy’ literature. The paper concentrates on how the acceptance of radical naturalism in Quine’s theory of meaning escorts Quine to ponder the naturalized epistemology. W.V. Quine was fascinated by the evidential acquisition of scientific knowledge, and language as a vehicle of knowledge plays a significant role in his regimented naturalistic theory anchored in the scientific framework. My point is that there is an interesting shift from epistemology to language (semantic externalism). The rejection of the mentalist approach on meaning vindicates external that somehow (...) pave the way for ‘semantic holism’, a thesis where the meaning of a sentence is defined in turns to the totality of nodes and paths of its semantic networks where the meaning of linguistic units depend upon the meaning of the entire language. I would like to relook on Quine’s heart-throbbing claim about the co-extensiveness of the sentential relation and the evidential relation that point towards an affirmation of meaning holism and semantic externalism. Besides, the knowledge of acquaintance that relinquishes the singular thought from the account of psychological consideration and self-knowledge hypothesis copes up with the testimonial and warrant knowledge entangling by the claims of social knowledge as anticipated by Alvin Goldman. My conclusion would be nearer to the stance of semantic externalism inculcated by the social knowledge (in an epistemic sense) and semantic holism. (shrink)

This paper establishes that the contemporary figures of organizational leadership are at best excellent examples of 'dealership' characterized by high skills-competence and low values-commitment. The author points out that managerial and organizational psychology for leadership is yet to grapple with the most fundamental of all the themes: the complete model of man which places the spirit-core of SELF in the centre. The paper upholds the classical Indian concept of wisdom leadership and introduces the rajarshi model of the leader as the (...) very embodiment of satya and rita. The author then dwells on the nature of'rishi-consciousness' and elaborates on the 'rishi' process which leads to the unfoldment of unitive SELF-awareness or ekatmanubhuti. Speaking on behalf of one of the most enduring civilizations of the world, the author asserts that wisdom leadership comes from the ability to perceive the indivisible whole and this ability is not a function of the thinking, reasoning mind but of the intuitive, spiritual mind. The present article concentrates on understanding the limits of language from the realm of meaning theory as portrayed by Wittgenstein. In the Tractatus, Wittgenstein’s picture theory provides a glimpse of reality by indicating that a picture could be true or false from the perspective of reality. He talks about an internal limitation of language rather than an external limitation of language. In Wittgenstein’s later works like Philosophical Investigations, the concept of picture theory has faded away, and he deeply becomes more (...) interested in the ‘use theory of meaning’ and ‘language game.’ My other attempt in this paper is to show Husserl’s theory of meaning and try to find out its compatibility with Wittgenstein’s thoughts. Husserl thinks that as a part of phenomenological experience, ‘meaning’ should be an act character that Wittgenstein rejected as an appeal of inner experience. Like Mohanty, I also attempt to show the Husserlian idea of meaning as an essence that is related to the meaning rather than linguistics. Both the giants are talking about description of language from different levels. My effort would be to illustrate how these two giant thinkers proclaim their meaning theories in such a way that leads to a well-known internalism versus externalism debate in the philosophy of mind and language. In recent years, there has been a huge resurrection of interest in the idea of ‘analysis,’ encompassing on analytic philosophy. As with any major philosophical movement, it is futile to define or classify any precision of what makes someone an analytic thinker. However, drawing on the startling works by Frege, Russell, Wittgenstein, Dummett and Putnam I clear up some strands, portended by the observation that language is the sole medium of analytic philosophy, so the main focus of analytic philosophy is (...) to understand the structure of language, thought, and meaning. Analytic philosophy pursues a critical analysis on the interface between word and world interrelation in terms of natural language guided by analysis, reasons, clarity and reflective thoughts. ABSTRACT Vague concepts are represented by L-fuzzy sets. It is argued that any vague concept carries with it an approximate identity which is a fuzzy equivalence relation. The relation also fulfills the criterion of ? indiscernibility of Identicals ?, which is called ? saturatedness ? in this context. An application in knowledge representation is indicated.

Increasing global competition has intensified the use of informal sector workforce worldwide. This phenomenon is true with regard to India, where 92% of the workers hold precarious jobs. Our study examines the dynamics of workplace dignity in the context of Indian security guards deployed as contract labour by private suppliers, recognising that security guards’ jobs were marked by easy access, low status, disrespect and precariousness. The experiences of guards serving bank ATMs were compared with those working in large reputed organisations. (...) The former reported loss of dignity though their inherent self-worth remained partially intact, whereas the latter reclaimed dignity despite the precarious working conditions and the absence of unions. Guards from large reputed organisations evolved strategies by which they took advantage of the client’s vulnerabilities, developed ‘thick’ relationships at work and immersed themselves in 'doing dignity work' to ensure that they are not disposable. ‘Doing dignity work’ was a visible device which involved actions that met or went beyond the norms laid down by the client and was used by security guards to limit the extent of their precariousness. Since the opportunity to reclaim dignity was facilitated by large reputed clients’ adherence to legal regulations, we see implications of the study for the moral economy. (shrink)

While the causes of human-animal conflict are numerous, many are intertwined with food production systems and the wildlife trade. The emergence and spread of Covid-19 exemplify this. Indeed, the wildlife population in South Asian countries has seen an increase in the risk of both human and nonhuman death in recent months, and as the economy slows, the search for food and extra income will intensify, negatively impacting wildlife. This paper aims to address some of the ethical issues concerning our treatment (...) of nonhuman creatures and the environment in relation to the global food system and wildlife trade following the Covid-19 crisis. Cancer is fast becoming an alarming cause of human death. However, it has been reported that if the disease is detected at an early stage, diagnosed, treated appropriately, the patient has better chances of survival long life. Machine learning technique with feature-selection contributes greatly to the detecting of cancer, because an efficient feature-selection method can remove redundant features. In this paper, a Fuzzy Preference-Based Rough Set (FPRS) blended with Support Vector Machine (SVM) has been applied in order to predict cancer (...) biomarkers for biological and gene expression datasets. Biomarkers are determined by deploying three models of FPRS, namely, Fuzzy Upward Consistency (FUC), Fuzzy Downward Consistency (FLC), and Fuzzy Global Consistency (FGC). The efficiency of the three models with SVM on five datasets is exhibited, and the biomarkers that have been identified from FUC models have been reported. (shrink)
