Republicans are divided on the question of whether domination is best understood in terms of capacities to act intentionally or of certain structural aspects of society. I offer a model combining each aspect derived from Frederick Douglass’s philosophy. Douglass referred to slavery in both interpersonal terms (to individuals) and structural (to the community), focussing on the unique and pervasive role played by social prejudice which distorts public reason thereby disabling the functioning of republican institutions. While Douglass’s insights constitute a significant (...) contribution to neo-republican theory in their own right, they also offer a slave’s perspective on the central republican concept of domination and shows how historic African American writers made innovative theoretical contributions to republicanism. This paper takes the form of a critical discussion of Crispin Wright’s notion of entitlement of cognitive project. I examine various strategies for defending the claim that entitlement can make acceptance of a proposition epistemically rational, including one which appeals to epistemic consequentialism. Ultimately, I argue, none of these strategies is successful, but the attempt to isolate points of disagreement with Wright issues in some positive proposals as to how an epistemic consequentialist should characterize epistemic rationality.

Human subject research involving brain imaging is likely to reveal signifcant incidental fndings of abnormal brain morphology. Because of this fact and because of the fduciary relationship between researcher and subject, board-certi-fed or board-eligible radiologists should review the scans to look for any abnormality, the scans should be conducted in accordance with standard medical practice for reviewing the clinical status of the whole brain, and the informed consent process should disclose the possibility that incidental fndings may be revealed and what (...) consequences will follow. In the event such fndings are revealed, qualifed physicians should explain to the subject the signifcance of the fndings and the alternatives available. (shrink)

There seems no good reason for doctors to work in secret. Individual users of healthcare and the community in general, which ultimately bears the cost, are perfectly entitled to know how their health services and health providers are performing. The promulgation of surgical report cards has been hailed by some as a liberating step in the right direction. This paper seeks to analyse, from a clinician’s perspective, the evolution and limitations of report cards. Ultimately, the importance of report cards will (...) not be their immediate utility, which is minimal, but as a first step in a much wider and far more important debate about how we meaningfully measure the quality of health services and providers (including managers and bureaucrats), the likely cost of such an enterprise, how much we are willing and able to pay and how we reconcile the competing needs of information versus clinical and preventive care when all are competing for the same and inadequate pool of resources. Much of the discussion on business ethics is philosophical in nature. There is no lack of theories and ideals on moral reasoning. What is missing is translating these moral theories and principles into specific, operational procedures that can indicate a proper course of action. Although most business actions are routine and do not raise serious ethical questions, many people experience difficulty in applying their personal moral principles to specific business decisions in ethically-dilemmatic situations.This study seeks to develop a framework that (...) can be utilized to implement personal moral reasoning based on the teleological theory of Utilitarianism and the deontological theory of Ross''s Prima Facie Duties in the business decision-making process. The central feature in the framework is a point-system that quantities the ethical worth of a proposed business action and determines whether the action would be ethically desirable if taken. It provides an objective element in an otherwise qualitative ethical inquiry process. This study also illustrates practical applications of the system by analyzing the ethical implications of a proposed action where foreign bribery is involved. (shrink)

The rapid development of biobanks internationally reflects the considerable expectations attached to the exploitation of genetics knowledge. However, establishing consent and legitimacy for the new generation of biobanks is not without its challenges because they tend to be prospective in nature, involving the collection of DNA, personal medical and lifestyle data generally held over a very long period of time for unspecified research purposes. Thus far, biobanks have tended to be established ahead of wide-ranging debate about their broad implications. Making (...) specific reference to the 'engagement' processes employed by UK Biobank during its establishment phase, this article focuses on the politics of 'public engagement'. It examines the context of arguments for 'public engagement', drawing attention to how particular approaches to 'engagement' within biobank projects may serve to limit debate on substantive questions arising from their development. Unless biobanks' 'engagements' substantially involve publics in deliberations about their development, it is argued, publics are likely to become distrustful of projects and perhaps resist other similar population-based health initiatives in the future. For humanists the perfect language was a revived Classical Latin. For scholastics it was a practical logic adapted to the needs of education. Though they have long been portrayed as arch rivals, Alan Perreiah here argues that humanists and scholastics were working in complementary ways toward some of the same goals: most significantly, the early modern search for the perfect language. The study advances research on language pedagogy in the Renaissance by clarifying the connections between truth and translation.

The paper offers a critical engagement with Cécile Laborde’s book, Liberalism’s Religion. It elaborates several objections to Laborde’s account of religious accommodations, and sketches an alternative approach.

This study explores the way that belief systems, interactions with social or experimental environments, and skills at the “control” level in decision‐making shape people's behavior as they solve problems. It is argued that problem‐solvers' beliefs (not necessarily consciously held) about what is useful in mathematics may determine the set of “cognitive resources” at their disposal as they do mathematics. Such beliefs may, for example, render inaccessible to them large bodies of information that are stored in long‐term memory and that are (...) easily retrieved in other circumstances. In other cases, individuals' reactions to an experimental setting (fear of failure, or the desire to “look mathematical” while being videotaped) may induce behavior that is almost pathological—and at the same time, so consistent that it can be modeled. In general, such “environmental” factors establish the context within which individuals access and utilize the information potentially at their disposal.Protocols illustrating these points are presented and discussed. A model based on an axiomatization of students' beliefs about plane geometry is outlined, and is shown to correspond closely to their problem‐solving performance. A framework is offered for analyzing problem‐solving performance at three qualitatively different levels: access to cognitive resources stored in LTM, executive or control decision‐making, and belief systems. This paper examines moral problems that arise when assigning liability in causally problematic mass exposure tort cases. It examines the relevance of different conceptions of corrective justice for such assignments of liability. It explores an analogy between the expressive role of punishment and the expressive role of tort, and argues that the imposition of liability in causally problematic mass exposure cases can be justified by appeal to expressive considerations.

"Poststructuralism and Critical Theory's Second Generation" analyses the major themes and developments in a period that brought continental philosophy to the forefront of scholarship in a variety of humanities and social science disciplines and that set the agenda for philosophical thought on the continent and elsewhere from the 1960s to the present.
