An adequate account of how inferences and discoveries are made in modern biology is a difficult prospect for a philosopher. Do we really deduce conclusions from Darwin’s principles? Once Darwinian biology is integrated with molecular biology, can we deduce the organism from its DNA? What does induction look like in an era where data sets are often too large to be processed by a human being? What is the role of abductive explanatory claims that try to define the biological individual (...) in relation to the microbiome with which it may be associated, or to revise the notion of evolution when the interaction of organism and environment comes to seem much more complex than earlier generations imagined. How should we evaluate “origins of life” experiments conducted in the laboratory, where chemistry shifts to biology and we try to recreate early conditions on earth to which we have no empirical access? How are the carefully controlled conditions in the lab to be brought into productive relationship with the messy, contingent outdoor work of biologists in the field, studying crabs or eelgrass at the edge of the Pacific Ocean, or prairie plants at the end of woods, on the plains of the Midwest. To answer these questions, I sent my graduate student Tano Posteraro to work with Ted Grosholz, a marine biologist at the University of California / Davis, and my undergraduate student Alex Grigas to work with Ruth Geyer Shaw, a population geneticist at the University of Minnesota. They came back with complex and interesting answers to these questions. (shrink)

Suppose that you must make choices that may influence the well-being and the identities of the people who will exist, though not the number of people who will exist. How ought you to choose? This paper answers this question. It argues that the currency of distributive ethics in such cases is a combination of an individual’s final well-being and her expected well-being conditional on her existence. The 2016 CIOMS International ethical guidelines for health‐related research involving humans states that ‘health‐related research should form an integral part of disaster response’ and that, ‘widespread emergency use [of unproven interventions] with inadequate data collection about patient outcomes must therefore be avoided’ (Guideline 20). This position is defended against two lines of criticism that emerged during the 2014 Ebola outbreak. One holds that desperately ill patients have a moral right to try unvalidated medical interventions (UMIs) and that it is therefore (...) unethical to restrict access to UMIs to the clinical trial context. The second holds that clinical trials in contexts of high‐mortality diseases are morally suspect because equipoise does not exist between a standard of care that offers little prospect of clinical benefit and a UMI that might offer some clinical advantage. This paper examines the role of equipoise in evaluating international research. It distinguishes two possible formulations of the equipoise requirement that license very different evaluations of international research proposals. The interpretation that adopts a narrow criterion of similarity between clinical contexts has played an important role in one recent controversy, but it suffers from a number of problems. An alternative interpretation that adopts a broader criterion of similarity does a better job of avoiding both exploitation of the brute fact of (...) social deprivation and the exploitation of needy populations for the benefit of more well-off populations. It also holds out the promise of reconciling the need to find interventions that can be employed in developing world contexts with the cluster of moral values that must constrain the way such research is carried out. Recent debates over the use of sham surgery as a control for studies of fetal tissue transplantation for Parkinson’s disease have focused primarily on rival interpretations of the US federal regulations governing human-subjects research. Using the core ethical and methodological considerations that underwrite the equipoise requirement, we nd strong prima facie reasons against using sham surgery as a control in studies of cellular-based therapies for Parkinson’s disease and more broadly in clinical research. Additionally, we believe that these reasons can be (...) generalized to apply to the use of other placebo controls that carry signi cant risks of positive harms in and of themselves. As a result, our arguments are centrally relevant to the emerging drive to subject therapies with a surgical component to the same rigorous standards of evaluation as those governing the approval of new pharmaceuticals. There is near universal agreement within the scientific and ethics communities that a necessary condition for the moral permissibility of cross-national, collaborative research is that it be responsive to the health needs of the host community. It has proven difficult, however, to leverage or capitalize on this consensus in order to resolve lingering disputes about the ethics of international medical research. This is largely because different sides in these debates have sometimes provided different interpretations of what this requirement amounts to (...) in actual practice. The goal of the discussion that follows is to clarify the nature of this important moral requirement. The first section explains the requirement for responsiveness to host community health needs in the context of international medical research. The second section examines various formulations of this requirement as they are enunciated in some of the core consensus documents in research ethics. The third section then defends a particular interpretation of this requirement, and the final sections examine more liberal alternatives with the aim of highlighting points of agreement and assessing the significance of areas of disagreement. One of the fundamental challenges in any field of practical ethics is to articulate a framework for deliberation and decision making that is capable of providing warranted guidance about contentious ethical questions.1 Such a framework has to function effectively in the face of empirical uncertainty and what Rawls refers to as the fact of reasonable pluralism—the fact that individuals often differ in their ideals, ambitions, preferences and conceptions of the good life. One of the perennial questions in normative and metaethics (...) concerns the source of the warrant for such judgments, and a major preoccupation of practical ethics has been to find a way to generate such warrant without having to first settle all contentious philosophical questions about the nature and source of normativity. To the extent that scholars use the term ‘common morality’ to refer to a set of moral norms or concerns that are sufficiently common and widespread that they can be used as starting points for moral deliberation and inquiry, I am sympathetic to the term.2 To the extent that appeals to common morality are supposed to do more significant epistemic or justificatory work, they have always struck me as dangerously ad hoc and insufficiently responsive to the legitimate need to explain the ground for common normative claims. Although I am relatively sceptical of appeals to common morality, I am concerned that the version of this view that is critiqued in ‘Why not common morality’ is simply a straw person. Throughout the paper, Rhodes treats common morality as synonymous with everyday ethics and the ethics of everyday life. She says, ‘If common morality and medical ethics were the same, then the ethically justified behaviour for medical professionals and everyone else would be the same’ (Rhodes, p7).3 In effect, the view that Rhodes attacks is …. The wellbeing that can accrue to individuals through their participation in collective endeavours, here called their participatory wellbeing, is a fundamental component of human wellbeing more broadly. It is also difficult to conceptualize, let alone quantify, and has been neglected in philosophy, apparently falling into a gap between the literature on collective agency and the literature on wellbeing. As a contribution towards filling in that gap, this chapter uses the notion of a role within a group—encompassing anything from familial and (...) professional roles to being a friend or a citizen—to solve a puzzle about participatory wellbeing. The puzzle, crudely stated, is that while wellbeing is an essentially individualistic notion, participation is essentially social. By conceiving of participation as a matter of occupying and performing a role, we can recognize and model the complexity (i.e. the multifaceted nature) of participatory wellbeing. (shrink)

Starting with the French Revolution Massacres and Morality studies mass killing as perpetrated by states. In particular it examines the role that civilian immunity has played in shaping the behaviour of perpetrators and how international society has responded.

It is commonly supposed that at least some states possess a moral right against external intervention in their domestic affairs and all human rights violations give members of the international community reasons to undertake preventive or remedial action against offending states. No state, however, currently protects or could reasonably be expected to protect its subjects’ human rights to a perfect degree. In view of this reality, many have found it difficult to explain how any existing or readily foreseeable state could (...) enjoy a moral right of nonintervention without denying the normative force of human rights. This article seeks to reconcile these apparently incompatible commitments by arguing that, in addition to acting in defense of human rights, outsiders must be appropriately responsive to individuals’ distinct and potentially countervailing interests in collective self-determination. I show that, under certain demanding but not unrealistic conditions, individuals’ interests in self-determination are of sufficient weight not simply to ground a judgment against intervention in particular cases but to generate arobust right of nonintervention on the part of some states that nevertheless fail to secure perfect protection of their subjects’ human rights. Contemporary process metaphysics has achieved a number of important results, most significantly in accounting for emergence, a problem on which substance metaphysics has foundered since Plato. It also faces trenchant problems of its own, among them the related problems of boundaries and individuation. Historically, the quest for ontology may thus have been largely responsible for the persistence of substance metaphysics. But as Plato was well aware, an ontology of substantial things raises serious, perhaps insurmountable problems for any account of our (...) epistemic access to such things. Physical things are subject to change, and as such, they are poor objects of knowledge—if knowledge is to be more reliable than mere opinion. There is a reading of Plato’s Theaetetus on which knowledge may be understood as a relation between an epistemic subject and a logos, where logoi are intrinsically dialectical, and where dialectic is a kind of intersubjective activity. Insofar as this epistemology may be attributed to Plato, the project of this paper is Platonic in spirit. It is also, in a sense, Kantian, in that it divorces ontology from the search for things-in-themselves, redirecting our attention from things to objects: epistemic objects. Such objects can be understood, as Maurice Merleau-Ponty proposed, as shared by multiple subjects by virtue of their participation in an intersubjective world, constituted by what Shaun Gallagher calls participatory sense-making. On an epistemology constructed in this way, the fact that both epistemic objects and their subject are mutable is no obstacle to knowledge. Far-from-equilibrium systems are forever mutable; at thermodynamic equilibrium, there would be neither subject, nor object. Epistemic objects, on this picture, are metastable loci of interactive potential. (shrink)

I argue that Scanlon's Value of Choice View does not offer a plausible account of substantive responsibility. I offer a new account, which I call the Potential Value of Opportunities View. On this view, when a person is in a position to freely and capably make an informed choice, we assess her situation not by the outcome she achieves but by the potential value of her opportunities. This value depends on the value of the various things that she can achieve (...) through her choices, as well as on how disposed she is to choose her better options and avoid her worse options. This view explains the priority we give to preventing harm that a person cannot avoid by choosing appropriately over harm that a person can so avoid by the fact that the second person has a valuable opportunity that the first does not have. It explains the importance of protecting people against choosing badly by the value of being placed in circumstances in which one is disposed to choose well, and the disvalue of being exposed to the danger of coming to harm by choosing badly. Este texto pretende apresentar reflexões acerca do pensamento em constelação proposto por Adorno para problematizar as práticas formativas colocadas em movimento nos contextos educativos. Para tanto, nos utilizamos da pesquisa bibliográfica para pensar criticamente sobre a formação dos sujeitos nos contextos educativos. Inspirados no pensamento adorniano nos reportamos ao conceito de constelação e, posteriormente, às categorias de emancipação e autorreflexão. As problematizações construídas nesse trabalho podem contribuir para o desvelamento da multiplicidade de questões que envolvem a complexidade do campo educativo (...) e dos sujeitos que ali se constituem. Indicam a necessidade de compreender que um conceito se entrelaça com outros conceitos, que ultrapassa a linearidade e a busca de um ponto de chegada. Nessa direção, é imprescindível redimensionar os processos de formação docente, ampliando as perspectivas de formação e promovendo experiências de autorreflexão da própria razão. Cultural evolutionary theories define prestige as social rank that is freely conferred on individuals possessing superior knowledge or skill, in order to gain opportunities to learn from such individuals. Consequently, information provided by prestigious individuals should be more memorable, and hence more likely to be culturally transmitted, than information from non-prestigious sources, particularly for novel, controversial arguments about which preexisting opinions are absent or weak. It has also been argued that this effect extends beyond the prestigious individual’s relevant domain of (...) expertise. We tested whether the prestige and relevance of the sources of novel, controversial arguments affected the transmission of those arguments, independently of their content. In a four-generation linear transmission chain experiment, British participants recruited online read two conflicting arguments in favour of or against the replacement of textbooks by computer tablets in schools. Each of the two conflicting arguments was associated with one of three sources with different levels of prestige and relevance. Participants recalled the pro-tablets and anti-tablets arguments associated with each source and their recall was then passed to the next participant within their chain. Contrary to our predictions, we did not find a reliable effect of either the prestige or relevance of the sources of information on transmission fidelity. We discuss whether the lack of a reliable effect of prestige on recall might be a consequence of differences between how prestige operates in this experiment and in everyday life. (shrink)

The United States has dealt with issues on immigration for over a century. The largest wave of immigration before the late 20th century began in the 1870s and peaked in 1910. In the past few decades, the United States has dealt overwhelmingly with the issue of undocumented immigrants. This challenge has led to different approaches to immigration reform and to help regulate the influx of immigrants across its borders. Generally, however, there have been two major sets of voices indicative of (...) the opinion of the American populace. One group has called for tighter immigration rules to prevent the easy entry of undocumented immigrants who have been branded as criminals. The other group has taken a moral and ethical stance to permit the entry of immigrants and to formulate a process for their legal residency. These two opposing views have triggered an ongoing discussion on undocumented immigrants. (shrink)

How should the international community respond when states commit atrocity crimes against sections of their own population? In practice, international responses are rarely timely or decisive. To make matters worse, half-hearted or self-interested interventions can prolong crises and contribute to the growing toll of casualties. Recognizing these brutal realities, it is tempting to adopt the fatalist view that the best that can be done is to minimize harm by letting the state win, allowing the status quo power structure to persist. (...) Indeed, this is how many commentators and states have responded to the tide of human misery in Syria. Could a policy of letting the state perpetrator prevail be a viable alternative to other options, including military intervention? This essay suggests not. It explains the logic behind the fatalist approach and shows that problems of recurrence, precedence, and rights mean that such an approach cannot offer a plausible alternative to measures designed to resist and increase the costs of committing atrocity crimes. O presente estudo (...) científico faz-se necessário ao trazer à arena o debate sobre a possibilidade de se falar ou não de reserva de regulação no âmbito das terapias gênicas, já que a matéria que seriam submetidas a essa reserva técnica não seriam taxativamente delimitadas pela Constituição, devendo ser discutida caso a caso, dentro deste novo ramo do direito chamado direito da regulação. Philippe van Parijs (2003) has argued that an egalitarian ethos cannot be part of a post- Political Liberalism Rawlsian view of justice, because the demands of political justice are confined to principles for institutions of the basic structure alone. This paper argues, by contrast, that certain principles for individual conduct—including a principle requiring relatively advantaged individuals to sometimes make their economic choices with the aim of maximising the prospects of the least advantaged—are an integral part of a Rawlsian political conception (...) of justice. It concludes that incentive payments will have a clearly limited role in a Rawlsian theory of justice. (shrink)

Gender identity is ill-suited as a basis for non-discrimination protections, as proposed in the 2019 Equality Act. Biological sex provides a clearer and better means to the same laudable end.

In this paper, we offer some conceptual building blocks, or rather conceptual flows, towards a radical processual rethinking of the type of agency that allows for the sustainable production and consumption of fashion. Appeals to principled decision making or calculating costs and benefits instrumentally fail to engender the necessary behavioural changes, and more importantly, our current conceptual apparatus cannot account for the relationality that fosters sustainable lifestyles. An empirical study of upcycling practices allows us to interrogate the agency involved in (...) sustainable organising and acknowledge the complex forms of valuation that take place in and through the making process. Our data were analysed through the lens of John Dewey’s pragmatist perspectives on valuation and were brought into conversation with literature on ‘making’, more specifically through the anthropological work of Tim Ingold. We contend that current conceptualisations of sustainable organising are inadequate because they undermine the relational orientation that sustainable organising entails. We argue for a processual, relational approach to valuation, which allows for the accommodation of a plurality of ways of thinking about what sustainable organising may mean. To live sustainably, one has to stay close to materials, engage relationally with one’s histories and contexts, and allow valuation to present itself as part of everyday practice. (shrink)

Unprecedented runaway climate change and ecological degradation is argued to be caused by the dominant capitalist mode of production’s reliance on endless economic growth and capital accumulation. Businesses and organisations are expected to act in an ecologically and socially ethical way to help avert the crisis. Yet, there has arguably been little progress in this direction. The conventional ethical frameworks are generally subsumed under capitalism’s reliance on growth that effectively delegate business ethics to a peripheral and, often, contradictory pursuit, insufficient (...) to influence ecologically and socially sustainable business conduct. We therefore explore an alternative approach by operationalising business ethics through organisational values from a post-growth perspective. By analysing the case of a social cooperative, we highlight how post-growth organisational values emerge through the organisation’s history, the members’ experience, and active contrasting to the dominant capitalist value systems. We contribute to business ethics scholarship by highlighting the potential of post-growth organisational ethics and values in creating contrasts to the dominant capitalist values. Our research further contributes to sustainability scholarship, particularly post-growth perspectives, by highlighting that organising through post-growth values in contrast to the dominant economic system is not only possible, but essential to achieve sustainability. Ultimately, our research illustrates the need for political engagement in upholding organisational ethics, in the face of the ecological crisis. (shrink)

A number of imposing problems now have our best minds in thrall. These include questions regarding the unity or plurality of the races of Man, whether his creation ought to be dated thousands of years or thousands of centuries past, whether species are fixed, or rather undergo a slow, progressive transformation into new species, how supposedly eternal matter relates to the nothingness outside of it, and whether the idea of God is useless. These are just a few of the issues (...) now subject to learned debate. You need, however, have no fear that my address tonight has any pretensions toward resolving any one of these earnest questions. But in the neighborhood of such mysteries lies another question, more or less closely related, to which I may, perhaps, venture to direct your attention; for its complexities, which I have made the object of concerted and conscientious study, are accessible to experiment. This is the question of what we call "spontaneous generations." Mightn't matter, perhaps, organize itself? Or posed differently, mightn't creatures enter the world without parents, without forebears?
