Legal experts—lawyers, judges, and academics—typically resist changing their beliefs about what the law is or requires when they encounter disagreement from those committed to different jurisprudential or interpretive theories. William Baude and Ryan Doerfler are among the most prominent proponents of this view, holding it because fundamental differences in methodological commitments severs epistemic peerhood. This dominant approach to disagreement, and Baude and Doerfler’s rationale, are both wrong. The latter is committed to an overly stringent account of epistemic peerhood that dogmatically (...) excludes opponents. The former violates the conjunction of three plausible epistemic principles: Complete Evidence, considering all epistemically permissible evidence; Independence, in which only dispute-independent evidence is epistemically permissible; and Peer Support, which involves epistemically permissible evidence. Instead, I argue for jurisprudential humility—we ought to be more willing to admit we do not know what the law is or requires, and take seriously conflicting views. (shrink)

In February 2020, the British Society for the History of Science hosted its first entirely digital conference via Twitter, with the dual goals of improving outreach and engagement with international historians of science, and exploring methods of reducing the carbon footprint of academic activities. In this article we discuss how we planned and organized this conference, and provide a summary of our experience of the conference itself. We also describe in greater detail the motivations behind its organization, and explore the (...) good and bad dimensions of this relatively new kind of conferencing. As the climate crisis becomes more acute and, in turn, the pressure to reduce the carbon footprint of academic activities increases, we argue that digital conferences of this style will necessarily become more central to how academia operates. By sharing our own experiences of running such a conference, we seek to contribute to a rapidly growing body of knowledge on the subject that might be drawn on to improve our practices going forward. We also share some of our own ideas about how best to approach digital conference organization which helped us to make the most of this particular event. (shrink)

Rae Langton and Jennifer Hornsby have argued that pornography might create a climate whereby a woman’s ability to refuse sex is literally silenced or removed. Their central argument is that a failure of ‘uptake’ of the woman’s intention means that the illocutionary speech act of refusal has not taken place. In this paper, I challenge the claims from the Austinian philosophy of language which feature in this argument. I argue that uptake is not in general required for illocution, nor is (...) it required for refusal in particular. I conclude with remarks on the relationship between illocutionary and perlocutionary speech-acts. (shrink)

While organizations today make extensive use of complex algorithms, the notion of algorithmic accountability remains an elusive ideal due to the opacity and fluidity of algorithms. In this article, we develop a framework for managing algorithmic accountability that highlights three interrelated dimensions: reputational concerns, engagement strategies, and discourse principles. The framework clarifies that accountability processes for algorithms are driven by reputational concerns about the epistemic setup, opacity, and outcomes of algorithms; that the way in which organizations practically engage with emergent (...) expectations about algorithms may be manipulative, adaptive, or moral; and that when accountability relationships are heavily burdened by the opacity and fluidity of complex algorithmic systems, the emphasis of engagement should shift to a rational communication process through which a continuous and tentative assessment of the development, workings, and consequences of algorithms can be achieved over time. The degree to which such engagement is, in fact, rational can be assessed based on four discourse-ethical principles of participation, comprehension, multivocality, and responsiveness. We conclude that the framework may help organizations and their environments to jointly work toward greater accountability for complex algorithms. It may further help organizations in reputational positioning surrounding accountability issues. The discourse-ethical principles introduced in this article are meant to elevate these positioning contests to extend beyond mere adaption or compliance and help guide organizations to find moral and forward-looking solutions to accountability issues. Salience-sensitivity is a form of anti-intellectualism that says the following: whether a true belief amounts to knowledge depends on which error-possibilities are salient to the believer. I will investigate whether salience-sensitivity can be motivated by appeal to bank case intuitions. I will suggest that so-called third-person bank cases threaten to sever the connection between bank case intuitions and salience-sensitivity. I will go on to argue that salience-sensitivists can overcome this worry if they appeal to egocentric bias, a general tendency to (...) project our own mental states onto others. I will then suggest that a similar strategy is unavailable to stakes-sensitivists, who hold that whether a true belief amounts to knowledge depends on what is at stake for the believer. Bank case intuitions motivate salience- but not stakes-sensitivity. (shrink)

This dissertation is about prejudice. In particular, it examines the theoretical and ethical questions raised by research on implicit social biases. Social biases are termed "implicit" when they are not reported, though they lie just beneath the surface of consciousness. Such biases are easy to adopt but very difficult to introspect and control. Despite this difficulty, I argue that we are personally responsible for our biases and obligated to overcome them if they can bring harm to ourselves or to others. (...) My dissertation addresses the terms of their removal. It is grounded in a comprehensive examination of empirical research and, as such, is a contribution to social psychology. Although implicit social biases significantly influence our judgment and action, they are not reducible to beliefs or desires. Rather, they constitute a class of their own. Understanding their particular character is vital to determining how to replace them with more preferable habits of mind. I argue for a model of interpersonal fluency, a kind of ethical expertise that requires transforming our underlying dispositions of thought, feeling, and action. (shrink)

One of the problems that Bayesian regularity, the thesis that all contingent propositions should be given probabilities strictly between zero and one, faces is the possibility of random processes that randomly and uniformly choose a number between zero and one. According to classical probability theory, the probability that such a process picks a particular number in the range is zero, but of course any number in the range can indeed be picked. There is a solution to this particular problem on (...) the books: a measure that assigns the same infinitesimal probability to each number between zero and one. I will show that such a measure, while mathematically interesting, is pathological for use in confirmation theory, for the same reason that a measure that assigns an infinitesimal probability to each possible outcome in a countably infinite lottery is pathological. The pathology is that one can force someone to assign a probability within an infinitesimal of one to an unlikely event. (shrink)

In the following I show that Hubert Dreyfus’ account of skill rests on a misguided interpretation of Martin Heidegger’s work on understanding in Being and Time. Dreyfus separates understanding according to the analytic philosophical concept pair, so called ‘know-how’ and ‘knowledge-that’, that corresponds for him to the pragmatist differentiation between skillful acting and theoretical conceptual thinking. Contrary to that, Heidegger argues that only one form of understanding exists that is neither captured by ‘know-how’, ‘knowledge-that’ or a combination of both. Instead (...) of presupposing two radically different ways to engage with the world, one practical-agential, the other theoretical-conceptual, Heidegger shows that all genuine forms of comportments rest on the same form of understanding that exhibits the highest degree of intelligibility when we deal with the world ordinarily. The Heideggerian account therefore comes without the many dichotomies so often criticized in the literature on skill and understanding, and offers a radically different view of world disclosure and of what we do when we ‘theorize’. Austrian economist Ludwig Mises’s central role in the socialist calculation debates has been consensually acknowledged since the early 1920s. Yet, only recently Nemeth, O’Neill, Uebel, and others have drawn particular attention to Mises’s encounter with logical empiricist Otto Neurath. Despite several surprising agreements, Neurath and Mises certainly provide different answers to the questions “what is meant by rational economic theory” (Neurath) and whether “socialism is the abolition of rational economy” (Mises). Previous accounts and evaluations of the exchange between Neurath and (...) Mises suffer from attaching little regard to their idiosyncratic uses of the term “rational.” The paper at hand reconstructs and critically compares the different conceptions of rationality defended by Neurath and Mises. The author presents two different resolutions to a detected tension in Mises’s deliberations on rationality: the first is implicit in Neurath’s, O’Neill’s, and Salerno’s reading of Mises and faces several interpretational problems; the author proposes a divergent interpretation. Based on the reconstructions of Neurath’s and Mises’s conceptions of rationality, the author suggests some implications with respect to Viennese Late Enlightenment and the socialist calculation debates. Something dramatic, revolutionary, is required. You have ideas. You might have a plan. But although you are certain of the wrong around you, you are not certain of the path forward. You have some doubt about the plan, whether it will work, its moral costs, and whether there are problems you cannot yet see. (...) You have revolutionary doubt. That is good. We need revolutions. But revolutions should not be only conducted by the certain. This article will help you to nourish that doubt, to see why it is almost always epistemically appropriate if also almost always difficult to maintain, to learn how to live and act with it, and to give it its due without it leading to paralysis and inaction. This essay examines the provenance of a single, curious term that William James often used in connection with his own pragmatism. The term is Denkmittel, an uncommon German contraction of Denk and Mittel. James’s Central European sources for this now forgotten bit of philosophical jargon provide a small illustration of a bigger historical point that too often gets obscured. Pragmatism—James’s pragmatism, at least—was both allied with and inspired by a broader sweep of scientific instrumentalism that was already flourishing in fin (...) de siècle European philosophy. Brain states, which correlate with specific motor, cognitive, and emotional states, may be monitored with noninvasive techniques such as electroencephalography and magnetoencephalography that measure macroscopic cortical activity manifested as oscillatory network dynamics. These rhythmic cortical signatures provide insight into the neuronal activity used to identify pathological cortical function in numerous neurological and psychiatric conditions. Sensory and transcranial stimulation, entraining the brain with specific brain rhythms, can effectively induce desired brain states correlated with such cortical rhythms. Because brain states have distinct (...) neural correlates, it may be possible to induce a desired brain state by replicating these neural correlates through stimulation. To do so, we propose recording brain waves from a “donor” in a particular brain state using EEG/MEG to extract cortical signatures of the brain state. These cortical signatures would then be inverted and used to entrain the brain of a “recipient” via sensory or transcranial stimulation. We propose that brain states may thus be transferred between people by acquiring an associated cortical signature from a donor, which, following processing, may be applied to a recipient through sensory or transcranial stimulation. This technique may provide a novel and effective neuromodulation approach to the noninvasive, non-pharmacological treatment of a variety of psychiatric and neurological disorders for which current treatments are mostly limited to pharmacotherapeutic interventions. Evolutionary game theoretic accounts of justice attempt to explain our willingness to follow certain principles of justice by appealing to robustness properties possessed by those principles. Skyrms (1996) offers one sketch of how such an account might go for divide-the-dollar, the simplest version of the Nash bargaining game, using the replicator dynamics of Taylor and Jonker (1978). In a recent article, D'Arms et al. (1998) criticize his account and describe a model which, they allege, undermines his theory. I sketch a (...) theory of evolutionary explanations of justice which avoids their methodological criticisms, and develop a spatial model of divide-the-dollar with more robust convergence properties than the models of Skyrms (1996) and D'Arms et al. Consequential historical decisions that shaped transportation systems and their influence on society have many valuable lessons. The decisions we learn from and choose to make going forward will play a key role in shaping the mobility landscape of the future. This is especially pertinent as artificial intelligence (AI) becomes more prevalent in the form of autonomous vehicles (AVs). Throughout urban history, there have been cyclical transport oppressions of previous-generation transportation methods to make way for novel transport methods. These cyclical oppressions (...) can be identified in the baroque and modernist periods, and a third oppression may occur in the contemporary period. To explore the idea of a third oppression, we focus on the bicycle and outline the history of cycling to understand how historical mode oppression unfolded. We then present several social and political factors that contributed to the oppression of cycling and share recommendations for how to avoid future oppressions including political, social, and design actions for researchers and policymakers to take. This paper argues that priorities for AI-enabled mobility and cyclist needs be advanced in proportion to the extent that they contribute to societal goals of urban containment, public realm, and proximal cities. Additionally, future mobility evolutions should prioritise mobility justice and mode choice over inducing a singular transportation method. (shrink)

One reason for this is that versions with restricted or even no reliance on the principle of sufficient reason (PSR) have been formulated. By not relying on PSR – what many consider to be a necessary falsehood – philosophers have been able to escape many of the old criticisms of cosmological arguments. Casini, Illari, Russo, and Williamson (2011) suggest to model mechanisms by means of recursive Bayesian networks (RBNs) and Clarke, Leuridan, and Williamson (2014) extend their modelling approach to mechanisms featuring causal feedback. One of the main selling points of the RBN approach should be that it provides answers to questions concerning manipulation and control. In this paper I demonstrate that the method to compute the effects of interventions the authors mentioned endorse leads to absurd results under the additional assumption of (...) faithfulness, which can be expected to hold for many RBN models of mechanisms. Gerard of Abbeville's inception speech, which he delivered during the 1250s as a graduating master in theology at the University of Paris, stands out among the extant principia. While many thirteenth-century inception speeches drew clear distinctions between philosophy and theology, and metaphysics and revealed theology in particular, Gerard - who was the foremost secular master of his day - adopted a different strategy in order to establish the preeminence of theology with regard to all other sciences. Consciously avoiding to pit (...) theology against philosophy, he proposed to redefine the relations between both within the conceptual frame of sapiential knowledge. The article analyses how Gerard argues in favor of a supreme wisdom, capable of accommodating Aristotle's first philosophy and Christian theology. Showing that Gerard's approach did not remain uncontested, it traces the remarkable influence of his principium. (shrink)

It is commonly assumed that classical logic is the embodiment of a realist ontology. In “Sets and Semantics”, however, Jonathan Lear challenged this assumption in the particular case of set theory, arguing that even if one is a set-theoretic Platonist, due attention to a special feature of set theory leads to the conclusion that the correct logic for it is intuitionistic. The feature of set theory Lear appeals to is the open-endedness of the concept of set. Kant's explicit account of the state's responsibility for welfare, in the Rechtslehre, is cryptic and incomplete. Kant does suggest, however, that: provision for those unable to provide for themselves is implicit in the idea of a social contract; and the sovereign, as ‘proprietor of the land’, possesses authority to intervene in civil society to guarantee the necessary conditions for the exercise of their purposive faculties. These elements of Kant's argument seem most plausibly justified by the teleological judgement that the sovereign (...) must strive to realize a ‘rightful condition’ in which members of society are ensured equal opportunity to realize their purposive faculties. In order to secure such a condition, the Kantian sovereign must intervene to guarantee conditions assuring that agents are equal in their ability to pursue their individual ends. Such a Kantian egalitarian policy, Chapter 6 argues, should focus on the equalization of capabilities rather than of: welfare, or resources. (shrink)

History of philosophy is embedded into the theory of history. Two different philosophies, but we still have similar basic connections between different parts of each philosophy and a closer similarity of these two relativist thinkers. Gadamer, as a disciple of Heidegger, worked out the philosophical hermeneutics (Truth and Method, 1960) established by Heidegger in the early 20s. He embedded his approach of the history of philosophy in his hermeneutics, particularly in his description of history grasped as a chain of historically (...) effected events. Rorty, as a neopragmatist thinker, classified first the philosophers as systematic and edifying in his Philosophy and the Mirror of Nature (1979), but later, in his Contingency, Irony and Solidarity (1989), he already speeks about history of philosophy as the history of metaphors. Despite their differences, it may be proved, on the one hand, that some part of their philosophies is primus inter pares; on the other hand, they both are relativists in some sense, and claim that we can have only narratives about the history of philosophy. Maybe you only have 1000 units of some resource, but 10,000 people need the resource or would benefit from it. One question: why do you control the resource? Leave that aside for now. A second question: how should you allocate the resource? If you are a decision-maker in a health system, and if the resource has to do with medicine or public health, we are in the world of the ethics of scarce resource allocation decisions in healthcare. Munthe et al (...) 1 note that the ‘operational norms that guide actual decision making in this area tend to be similar across health systems’ and include principles concerning need, prognosis, equal treatment and cost-effectiveness. Even with just these principles, there are hard questions of how they ought to be specified, operationalised and balanced against each other when they conflict. They do not focus on this. Instead, they identify a concern: paying attention only to these principles in making allocation decisions may lead decision-makers to miss ‘negative dynamics’ that result from their decisions. They aim to rectify this by suggesting a ‘sustainability’ principle that would sit alongside these other ethical principles, serving as a side-constraint that rules out certain allocation choices or as a distinct reason to be weighed in the decision-making calculus (or a reason to save or insure against negative dynamics). Commercialisation and consumerism have had lasting and profound effects upon the nature of oral health and how dental services are provided. The stigma of a spoiled dental appearance, along with the attraction of the smile as a symbol of status and prestige, places the mouth and teeth as an object and product to be bought and sold. How the dental profession interacts with this acquired status of the mouth has direct implications for the professional status of dentistry and the relationship (...) between the profession and society. This essay examines the mouth’s developing position as a symbol of status and prestige and how the dental profession’s interaction and response to this may have important effects on the nature of dentistry’s social contract with society. As rates of dental disease reduce in higher socioeconomic groups, dentistry is experiencing a reorientation from being positioned within a therapeutic context, to be increasingly viewed as body work. This is not in of itself problematic; as a discipline dentistry places a very high value upon the provision of enhanced or improved aesthetics. This position changes when the symbolic exchange value of an aesthetic smile becomes the main motivation for treatment, encouraging a shift towards a commercialised model of practice that attenuates professional altruism. The dental profession should not welcome the association of the mouth as a status and prestige symbol lightly; this article examines how this paradigm shift might impact upon the social contract and dentistry’s professional status. Given the scholarly attention the work has attracted, one might, therefore, be tempted to consider that there remains little to add to its interpretation. Yet, as Joshua C. Benson has shown in a series of articles, this is clearly a fallacy.
