Many of the School’s prominent representatives, including Friedrich Wieser, Eugen Böhm-Bawerk, Ludwig Mises, Hans Mayer, Friedrich August Hayek, Fritz Machlup, Oskar Morgenstern, and Gottfried Haberler, as well as Israel Kirzner, Ludwig Lachmann, Murray Rothbard, Don Lavoie, and Peter Boettke, advanced and modified Menger’s research program in sometimes conflicting ways. Yet, some characteristics of the Austrian School remain (nearly) consensual (...) from its foundation through to contemporary neo-Austrian economists. In eight sections, we will briefly discuss some of the philosophical and methodological characteristics of Austrian economics: Austrian action theory and interpretative understanding, a relatively thoroughgoing subjectivism, methodological individualism, ontological individualism, apriorism, essentialism, an often overstated rejection of formal methods, and alertness to economic semantics. A counteridentical is a counterfactual with an identity statement in the antecedent. While counteridenticals generally seem non-trivial, most semantic theories for counterfactuals, when combined with the necessity of identity and distinctness, attribute vacuous truth conditions to such counterfactuals. In light of this, one could try to save the orthodox theories either by appealing to pragmatics or by denying that the antecedents of alleged counteridenticals really contain identity claims. Or one could reject the orthodox theory of counterfactuals in favor of a (...) hyperintensional semantics that accommodates non-trivial counterpossibles. In this paper, I argue that none of these approaches can account for all the peculiar features of counteridenticals. Instead, I propose a modified version of Lewis’s counterpart theory, which rejects the necessity of identity, and show that it can explain all the peculiar features of counteridenticals in a satisfactory way. I conclude by defending the plausibility of contingent identity from objections. (shrink)

Hate speech law can be found throughout the world. But it is also the subject of numerous principled arguments, both for and against. These principles invoke a host of morally relevant features and practical considerations . The book develops and then critically examines these various principled arguments. It also attempts to de-homogenize hate speech law into different clusters of laws/regulations/codes that constrain uses of hate speech, so as to facilitate a more nuanced examination of the principled arguments. Finally, it argues (...) that it is morally fitting for judicial and legislative judgments about the overall warrant of hate speech law to reflect principled compromise. Principled compromise is characterized not merely by compromise over matters of principled concern but also by compromise which is itself governed by ideals of moral duty or civic virtue. (shrink)

Effective altruism (EA) is a movement devoted to the idea of doing good in the most effective way possible. EA has been the target of a number of critiques. In this article, I focus on one prominent critique: that EA fails to acknowledge the importance of institutional change. One version of this critique claims that EA relies on an overly individualistic approach to ethics. Defenders of EA have objected that this charge either fails to identify a problem with EA's core (...) idea that each of us should do the most good we can, or makes unreasonable claims about what we should do. However, I argue that we can understand the critique in a way that is well motivated, and that can avoid these objections. (shrink)

When we think about ethics, we normally focus on a particular sort of agent: the individual person. Some philosophers have argued that we should rethink the limits of what counts as an ethically relevant unit of agency by expanding outward, and claiming that groups of people can have normative reasons for action. In this paper, I explore whether we can go in the other direction. Are there sub‐personal beings who count as agents with their own reasons for action? In particular, (...) might the temporal parts of persons, beings like “me‐in‐my‐twenties,” be thought of as normative agents? This idea, I argue, has deep attractions, and deep, but surmountable, challenges. And if we do accept this idea, I argue, this can indirectly help to support the case for thinking that groups can have reasons for action. (shrink)

Jason Bowers and Meg Wallace have recently argued that those who hold that every individual instantiates a ‘haecceity’ are caught up in a Euthyphro-style dilemma when confronted with familiar cases of fission and fusion. Key to Bowers and Wallace’s dilemma are certain assumptions about the nature of metaphysical explanation and the explanatory commitments of belief in haecceities. However, I argue that the dilemma only arises due to a failure to distinguish between providing a metaphysical explanation of why a fact holds (...) vs. a metaphysical explanation of what it is for a fact to hold. In the process, I also shed light on the explanatory commitments of belief in haecceities. (shrink)

Relativism and contextualism have been suggested as candidate semantics for “knowledge” sentences. I argue that relativism faces a problem concerning the preservation of beliefs in memory. Contextualism has been argued to face a similar problem. I argue that contextualists, unlike relativists, can respond to the concern. The overall upshot is that contextualism is superior to relativism in at least one important respect.

I argue that embodied understanding and conceptual-representational understanding interact through schematic structure. I demonstrate that common conceptions of these two kinds of understanding, such as developed by Wheeler (2005, 2008) and Dreyfus (2007a, b, 2013), entail a separation between them that gives rise to significant problems. Notably, it becomes unclear how they could interact; a problem that has been pointed out by Dreyfus (2007a, b, 2013) and McDowell (2007) in particular. I propose a Kantian strategy to close the gap between (...) them. I argue that embodied and conceptual-representational understanding are governed by schemata. Since they are governed by schemata, they can interact through a structure that they have in common. Finally, I spell out two different ways to conceive of the schematic interaction between them—a close, grounding relationship and a looser relationship that allows for a minimal interaction, but preserves the autonomy of both forms of understanding. A traditional interpretation holds that Kant's political theory simply constitutes an account of the constraints which reason places on the state's authority to regulate external action. Alexander Kaufman argues that this traditional interpretation succeeds neither as a faithful reading of Kant's texts nor as a plausible, philosophically sound reconstruction of a `Kantian' political theory. Rather, he argues that Kant's political theory articulates a positive conception of the state's role.

Do we live in a computer simulation? I will present an argument that the results of a certain experiment constitute empirical evidence that we do not live in, at least, one type of simulation. The type of simulation ruled out is very specific. Perhaps that is the price one must pay to make any kind of Popperian progress.

Previous research has established that goal tracking emerges early in the first year of life and rapidly becomes increasingly sophisticated. However, it has not yet been shown whether young children continue to update their representations of others’ goals over time. The current study investigates this by probing young children’s ability to differentiate between goal directed actions that have been halted because the goal was interrupted, and because the goal was abandoned. To test whether children are sensitive to this distinction, we (...) manipulated the experimenter’s reason for not completing a goal-directed action - his initial goal is either interrupted by an obstacle, or it is abandoned in favour of an alternative. We measure whether children’s helping behaviour is sensitive to the experimenter’s reason for not completing his goal-directed action by recording whether they complete the experimenter’s initial goal or the alternative goal. The results showed that children helped complete the experimenter’s initial goal significantly more often after this goal had been interrupted than after it had been abandoned. These results support the hypothesis that children continue to update their representations of others’ goals over time by the age of two, and specifically that they differentiate between abandoned and interrupted goals. The prospect of European elections has begun to alter the conditions under which national poli tical parties exercise their functions. It has brought parties to negociate common platforms and to strengthen transnational organizations. How these organizations wilt be structured, what functions they wilt assume, will be determined largely by the issue of a conflict-solving process between existing national structures, by the ability of national parties to accomplish new functions in a European system, and by the demands of that system.This study (...) presents a tentative framework of analysis for the examination of European groupings of political parties. It may help to interpret current negotiations and future actions of these organizations with reference to the criteria, structures and functions that are classically those of political parties. It suggests how new situations in the European field may be met by existing organizations or give rise to original political answers. (shrink)

Empirical research has transformed our understanding of autocratic institutions. Yet democratic theorists remain laser-focused on ideal democracies, often contending that political equality is necessary to generate democratic authority. Those analyses neglect most nonideal democracies and autocracies – regimes featuring inequality and practices like gerrymandering. This essay fills that fundamental gap, outlining the difficulties of applying theories of democratic authority to nonideal regimes and challenging long-standing views about democratic authority. Focusing on autocrats that lose elections, I outline the democratic authority of (...) nonideal, flawed procedures. Flawed elections are unjustifiably biased toward incumbents. But under certain conditions, ignoring an incumbent’s loss would require not treating one’s fellow citizens as equals. Under those conditions, therefore, citizens are bound to obey those electoral outcomes – that is, flawed procedures can possess democratic authority. (shrink)

Edouard Machery argues that many traditional philosophical questions are beyond our capacity to answer. Answering them seems to require using the method of cases, a method that involves testing answers to philosophical questions against what we think about real or imagined cases. The problem, according to Machery, is that this method has proved unreliable ; what we think about these kinds of cases is both problematically heterogeneous and volatile. His bold solution: abandon the method of cases altogether and with it (...) many of the questions that we have come to associate with philosophy itself. Many of the critical responses to Machery’s book have focused on whether empirical work on judgements about philosophical cases supports his claim that the method of cases is unreliable. Our problem with these responses is that they accept that reliability is the right way to frame empirically informed concerns about the method of cases, and we think that it is not. The reason is simple: the kind of unreliability thesis that Machery needs proves to be empirically intractable, at least by anything like the current methods used by experimental philosophers, or so we shall argue here. While we have empirical grounds for thinking that unreliability arguments don’t give us reason to abandon the method of cases, we do think that there are empirical grounds for thinking that it needs to be reformed. There are other standards that we expect our methods to meet beyond mere reliability, especially standards of practical rationality, which are too often forgotten in metaphilosophical discussions that tend to focus exclusively on epistemological considerations. Methodological considerations, after all, are not just matters of epistemic normativity, but practical rationality as well. What’s more, considerations of practical rationality become particularly important when we move from the kind of extreme scepticism that Machery endorses to the kind of progressive reformation that we think should be pursued. And so we conclude by arguing that thinking about philosophical inquiry in terms of standards of practical rationality allows us both to better understand what kinds of problems recent empirical work on philosophical cognition raises for the method of cases and also how that work can point the way to reforming it. Jennifer Lackey argues that knowing that p is not sufficient for being epistemically properly positioned to assert that p. Where that knowledge is entirely second-hand and the subject is an expert, the subject is not properly positioned to make such an assertion—since experts are held to higher epistemic standards. We reject Lackey’s argument. In particular, we argue that the division of labour in science makes isolated, second-hand assertions by experts both inevitable and frequent.

ObjectiveCo-morbid insomnia and sleep apnea is a common and debilitating condition that is more difficult to treat compared to insomnia or sleep apnea-alone. Emerging evidence suggests that cognitive behavioral therapy for insomnia is effective in patients with COMISA, however, those with more severe sleep apnea and evidence of greater objective sleep disturbance may be less responsive to CBTi. Polysomnographic sleep study data has been used to predict treatment response to CBTi in patients with insomnia-alone, but not in patients with COMISA. (...) We used randomized controlled trial data to investigate polysomnographic predictors of insomnia improvement following CBTi, versus control in participants with COMISA.MethodsOne hundred and forty five participants with insomnia and sleep apnea [apnea-hypopnea index ≥ 15] were randomized to CBTi or no-treatment control. Mixed models were used to investigate the effect of pre-treatment AHI, sleep duration, and other traditional, and novel [quantitative electroencephalography ] polysomnographic predictors of between-group changes in Insomnia Severity Index scores from pre-treatment to post-treatment.ResultsCompared to control, CBTi was associated with greater ISI improvement among participants with; higher AHI, less wake after sleep onset, and less N3 sleep. No quantitative electroencephalographic, or other traditional polysomnographic variables predicted between-group ISI change.DiscussionAmong participants with COMISA, higher OSA severity predicted a greater treatment-response to CBTi, versus control. People with COMISA should be treated with CBTi, which is effective even in the presence of severe OSA and objective sleep disturbance. (shrink)

In most common-law and civil-law jurisdictions, mistakes of law do not excuse. That is, the fact that one was ignorant of the content or requirements of some law does not excuse violations of that law. Many have argued that this doctrine is mistaken. In particular, many have argued that if an individual’s ignorance or false belief is blameless, if she held the false belief reasonably, then she ought to be able to use that ignorance as an excuse for violating the (...) law. It is much harder to find defenders of the doctrine, despite its prevalence. Pragmatic considerations are occasionally offered on its behalf, but these are generally not impressive. In this paper, I consider a more direct kind of justification for the doctrine, one that attempts to identify something more immediately normatively objectionable about being ignorant of the law. In particular, I consider an argument that suggests that legal ignorance is more like moral ignorance than like nonmoral ignorance and maintains that even nonculpable moral ignorance does not excuse. SUMMARYIn recent years students of politics have begun to recognise Reinhart Koselleck's practice of Begriffsgeschichte, the study of conceptual history, as a useful approach for investigating key concepts in political ideologies and the history of ideas. But his theory of historical time—the temporal dimension to his semantic project and his broader theorising of the historical discipline—is often overlooked and underused as a heuristic device. By placing the thinking of Michael Oakeshott alongside Koselleck's theory of historical time, this article brings his (...) thinking on temporality to the forefront, fashioning a conversation between the two thinkers about the place for history and the formal criteria necessary for ordering the past properly. In doing so, it juxtaposes Koselleck's reflections on historicity and his theory of historical time with Oakeshott's philosophical enquiry on the historical mode of understanding. It identifies important convergences and divergences between the two thinkers' theories, focusing in particular on questions regarding the potential for representing the past as multilayered and plural historical times. The article then suggests that their respective thoughts on the theory of history are in part a reaction to the modern politicisation of historical time and comprise a shared critique of radical political change. In particular, in Giorgio Agamben's theological-patristic reading of the oikos and the double theoretical movement of a politicization of the oikos and an economization of the political. In the background of a totalitarian concept of budgetary thinking. In Agamben's interpretation, the form of intimate household and domesticity itself becomes a threshold phenomenon - which this paper refers to as the oikos of alterity, indicating (...) a necessity of incorporating Oikos' figures in political life and its economization as well in political order. In a second opening coming from fin-de-siècle debates on cinematic distraction the paper shows the critical discourse of socio-cultural techniques of attention and media of modernity while facing the rise of the media of cinema and internet can be described as transitions in attention economy. A third opening introduces in economic metaphors of attention analysed and their move from modern economic theory into biology and Cognitive Sciences. Finally, a recent metaphorologic shift from economic metaphors of attention to acoustic resonance and ecology metaphors of attention, starting with the >echo-logical< attention metaphor of Yves Citton, is hinted on. The present article considers the problematical nature of social philosophy’s interdisciplinary character. The author considers that we can discover its specification as an independent area of the humanities, with exarticulation of adjacent to social philosophy disciplines like political philosophy, historic sociology and social theory. If it will be done, we will be able as the scientists to prove that social philosophy, which if often considering as the synonymous of social theory, has right to exist. The author comes to conclusion that (...) the most part of social theory supporters try to ignore valuative dimension in “theories” of thinkers they research. In fact it is а duty of social philosophy which nature is valuative. In author’s point of view, such a trend in theoretical sociology as “cultural sociology,” which use not only explanatory and descriptive methods but also interpretations, reflects the differences between social theory and social philosophy because it emphasizes the cultural dimension of social processes. For example, cultural sociology deals with issues that are more relevant to philosophy than to sociology, in particular, it concerns the problem of evil. (shrink)

Globalization and cosmopolitanism, on the one hand, and autarchy and nationalism, on the other, are two extremes between which humankind is destined to balance constantly, due to diversity and the natural confrontation of various cultural and civilizational systems by which it is represented. At the same time, globalization and cosmopolitanism are natural phenomena and are the most important characteristics of social development. That is why we should not put obstacles in the way of their dissemination and rooting in social life, (...) but to aim at deeper understanding of their essence and what is hidden behind them in order, preventing ourselves from rash evaluations and one-sided conclusions, to contribute to the formation of a stable and just global world. In lieu of an abstract, here is a brief excerpt of the content:Human Genome Research in an Interdependent WorldAlexander Morgan Capron (bio)This has been the year of agenda-setting conferences for the ambitious ELSI (ethical, legal and social issues) program of the Human Genome Project (HGP). But of the dozen or more major meetings of this sort held across the country, the one held at the National Institutes of Heakh (NIH) in Bethesda, MD, June 2-4, 1991, was distinctive in several respects.1As (...) its name implies, "Human Genome Research in an Interdependent World" was a global look at the issues raised by gene mapping and sequencing. Unlike previous conferences, however, this meeting looked beyond a comparative analysis of clinical and domestic legal issues, and concentrated on topics that may require responses on a truly international level if they are to be successfully resolved.The meeting's organizers gathered an impressive group of more than seventy participants from fifteen countries, including the first significant contingent of Soviet and Japanese scientists, physicians, and philosophers at an ELSI meeting. In addition to talks by the heads of the genome projects in the Soviet Union, Japan, and the United States, the meeting was keynoted by Dr. James Wyngaarden, director general of the Human Genome Organization (HUGO), and I had the honor of serving as its general chairman.The goal of the meeting was to consider an array of issues that scientists, philosophers, and lawyers from around the world suggested might have international significance, with an eye to deciding three things: (1) Does the issue deserve further attention? (2) Is the issue best addressed in an international or domestic context? and (3) Do structures exist to which the issue can be referred for resolution? In the final sessions, the entire group debated proposed resolutions on the various topics and narrowed the list needing further, intensive exploration.To provide an international framework for this process, the conference [End Page 247] established a Global Steering Committee on Ethical and Social Issues in Genome Research, which will coordinate the efforts of several task forces charged with refining the tentative resolutions adopted by the conference participants on June 4. The task forces are expected to be able to complete work on some topics by the time of the steering committee's first meeting, which was described by one participant as a "check point," probably within the coming year; on other topics, the task forces will provide interim reports and arrange to continue their analysis. Several topics—less complex or more embryonic—were referred directly to the steering committee. On all issues, a major objective will be to ascertain what existing or newly created structure or structures are capable of implementing the group's recommendations and then to monitor the issue to ensure that appropriate implementation is occurring.Issues to be Explored by Task ForcesInsurance and EmploymentWhile individuals may derive medically useful information from the expanded range of genetic tests that will flow from the HGP, they could also be harmed if test results become a basis for discrimination. An area of particular concern at the conference in Bethesda was whether genetic information should be used to decide eligibility for employment or the scope and cost of health and life insurance. The complexity of this issue is increased as barriers to worker migration fall (especially in Europe) and as more firms carry on business internationally. Furthermore, questions arise about the limits of required testing and whether individuals may decline to be informed of the results of tests.The task force will not only gather information on practices and legal standards throughout the world—especially in light of the differences among nations with regard to the linkage of employment and various forms of insurance—but will also examine international anti-discrimination laws as a possible means of supplementing domestic statutes and regulations. Local differences in chromatin organisation may profoundly affect the activity of eukaryotic genomes. Regulation at the level of DNA packaging requires the targeting of structural proteins and histone‐modifying enzymes to specific sites and their stable or dynamic interaction with the nucleosomal fiber. The “chromodomain”, a domain shared by many regulators of chromatin structure, has long been suspected to serve as a module mediating chromatin interactions in a variety of different protein contexts. However, recent functional analyses of a number of different (...) chromodomains revealed an unexpected diversity of interaction targets, including histones, DNA and even RNA. The chromodomains of today seem to have evolved from a common ancestral fold to fulfill various functions in different molecular contexts. Combining information gained from recent functional and structural studies of chromodomains with a bioinformatic classification of their structure could lead to the definition of sequence motifs with predictive quality for chromodomain function.
