I give an analysis of the logical structure of statements describing duties in social roles. Role terms like ‘doctor’ should not be treated as simple predicates, as natural kind terms, like ‘human being’, are. When role terms are treated as simple predicates, fallacies may result. Rather, treat role terms (M) as complex predicates with a simple subject, a person (S), as a base; ‘S qua M’, and then analyze their reduplicative structure. I illustrate and support this analysis by considering sophisms, (...) traditionally known as committing the fallacy of secundum quid et simpliciter, about conflicts of duties in different roles. It was Paul Engelmann who stimulated Wittgenstein to consider art as the avenue of access to what is higher, the "mystical" in the Tractatus. Unlike the course of their personal friendship, it is not easy to reconstruct the nature of their philosophical confrontation with one another. Through earnings announcements, conference calls, and other press releases, corporate executives have an opportunity to frame the narrative of financial disclosures. Numerous studies have shown that textual tone significantly influences stock returns, suggesting that through word choice, upper management may impact market reaction. In this study, we examine the influence of CEO personality traits on corporate disclosures by analyzing the tone of earnings announcements for a sample of Fortune 500 CEOs over nearly two decades. Our hypotheses are twofold: that qualitative (...) disclosures in firms with narcissistic leaders will be biased upward and the bias will moderate as CEOs becomes older. Our empirical results support these hypotheses and suggest that more narcissistic CEOs tend to reinforce their grandiose self-image by issuing more positive earnings announcements but this desire wanes with CEO age. We also find that the stock market response to the tone of the earnings announcement is less pronounced for more narcissistic CEOs, suggesting the market takes into account the bias in narcissistic CEO announcements. Given the residual homonegativity in evidence throughout our diverse communities, and given the large numbers of gay people who remain “in the closet”, it is critical that we seek to understand in greater depth the complexities of the coming-out process with a view to dispelling some of the confusion relating to sexual identity. Internalised homophobia is more widespread than generally acknowledged, and it manifests in a variety of ways, including the sociological phenomenon of gay men remaining closeted until well into (...) middle age. This article applies a hermeneutic phenomenological lens to examine the process of realisation, where an individual gradually becomes aware of his sexual orientation, and eventually acknowledges to himself that he is gay. This process can take decades. For this research project, twelve participants (gay men who have come out after the age of 40) from Aotearoa New Zealand willingly shared intensely personal accounts of their lived experiences. The findings indicate that individuals experience clarity about same-sex attraction in strikingly different ways. This study helps us to understand the difficulties faced by men who have lived the majority of their lives as “straight”, then in middle age find themselves having to negotiate the tortuous terrain between heterosexuality and a new gay identity. The invisibility of nursing work has been discussed in the international literature but not in relation to learning clinical skills. Evans and Guile's (Practice‐based education: Perspectives and strategies, Rotterdam: Sense, 2012) theory of recontextualisation is used to explore the ways in which invisible or unplanned and unrecognised learning takes place as newly qualified nurses learn to delegate to and supervise the work of the healthcare assistant. In the British context, delegation and supervision are thought of as skills which are learnt (...) “on the job.” We suggest that learning “on‐the‐job” is the invisible construction of knowledge in clinical practice and that delegation is a particularly telling area of nursing practice which illustrates invisible learning. Using an ethnographic case study approach in three hospital sites in England from 2011 to 2014, we undertook participant observation, interviews with newly qualified nurses, ward managers and healthcare assistants. We discuss the invisible ways newly qualified nurses learn in the practice environment and present the invisible steps to learning which encompass the embodied, affective and social, as much as the cognitive components to learning. We argue that there is a need for greater understanding of the “invisible learning” which occurs as newly qualified nurses learn to delegate and supervise. (shrink)

This paper sets out to assess the internal coherence of Roy Bhaskar's transcendental realist account of science. Whilst fully supporting his transcendental derivation of a stratified ontology of structures and generative mechanisms from the scientific practice of experimentation, I argue that Bhaskar's adoption of the stance of epistemic relativism results in his inability to defend the generalizability of this ontology. My argument against his epistemic stance turns on the fact that it rests on a false dichotomy between epistemic relativism and (...) epistemic absolutism, and, moreover, that it is quite unnecessary for his efforts to avoid the excesses of epistemological foundationalism. The net result of this stance, in my view, is an inability to sustain the normative force of the concepts of truth and scientific explanation precisely at a time when postmodern authors are denying their privileged status. Ronald Dworkin's theory of law forges a close connection between questions about the truth of propositions of law and the question of political obligation: law as integrity is a theory of legal practice that purports to explain, not only how the content of law is determined, but also why the law—in ordinary cases—imposes an obligation of obedience. The theory (as presented) is ultimately incoherent. If we accept Dworkin's theory of the grounds of law we are obliged to reject his claims (...) about its force; alternatively, if we accept his view of the force of law, we must reject his theory about its grounds: he cannot be correct about both force and grounds. Dworkin supposes that, in extraordinary cases, the force of law is cancelled or overridden; but the relevant considerations of justice are wholly internal to our identification of the content of law. Consistently elaborated, integrity denies the offending requirements legal status: lex injusta non est lex. (shrink)

Nielsen [Nielsen, T. . Felt presence: Paranoid delusion or hallucinatory social imagery? Consciousness and Cognition, 16, 975–983.] raises a number of issues and presents several provocative arguments worthy of discussion regarding the experience of the felt presence during sleep paralysis . We consider these issues beginning with the nature of FP and its relation to affective-motivational systems and provide an alternative to Nielsen’s reduction of FP to a purely spatial hallucination. We then consider implications of the “normal social imagery” model. (...) We can find only one specific empirical hypothesis articulated within this framework and it turns out to be one that we explicitly addressed in our original paper. We also review our position regarding the possible relation of FP during SP to a number of related anomalous experiences and contrast FP to anomalous vestibular-motor phenomena. We review our position that the neuromatrix concept, in the light of available evidence, is more appropriately applied to V-M experiences than FP. Finally, we pursue speculations, raised in Nielsen’s commentary, on the wider implications of FP. (shrink)

A successful lexicographic semantic description characterizes the concepts that occur in establishing the meaning of a listeme by modelling what the competent native-like speaker of the language knows. Because concepts can only be identified to another human through the medium of a natural language, the metalanguage used in the semantic definition of a natural language expression in the object language will always be equivalent to the natural language expression through which that metalanguage is interpreted. The metalanguage of a semantic theory (...) is a demonstrably rational abstract model developed by applying the analyst’s experience and intuitions to inferences drawn from occurrences of actual speech events. Each sense of a listeme is characterized by a description of the salient properties of its typical denotatum. To most effectively implement this project in conceptual engineering is to capture every possible sense of the listeme using metalanguage that is at the same time precise, comprehensive, and succinct. A review of several proposed lexicon/dictionary entries for the listeme cup reveals lacunae that are rectified in a decision procedure whose output characterizes the relevant sense of the input listeme using natural language and the procedural constructs/commands &, XOR, IF, ELSE, ELIF, GOTO, OUTPUT, TENABLE, NEXT ITEM. The resulting lexicographic semantic description satisfies the specified success condition. Establishing the characteristics of metalanguage is crucial to the proper investigation of conceptual engineering. (shrink)

Feminist scholars have long been concerned with privileged women’s activism and engagement with feminist politics and how acts of resistance from privileged subjects might best be understood. In the current moment, we are seeing a reinvigoration of interest in feminist activism particularly from young women, but not necessarily focusing on young women who are positioned as privileged. Simultaneously, there is attention in the sociology of elite schooling to the question of social justice politics in privileged spaces. In this article, we (...) contribute to both of these scholarly conversations by reporting on the feminist activism of three young women attending an elite school in Australia. We argue that these young women’s activism/feminist politics need to be understood as a complex entanglement of resistance and reproduction with regard to gender, race and class, and that drawing on recent theorisations influenced by post-humanism in feminist educational research produces fresh insights into researching gender/race/class reproduction by young women in elite educational settings. This chapter argues that the essential task of a university is not teaching students to be experts in some field of endeavor but educating them, so they might learn how to act in accord with the basic moral constraints governing any endeavor. With the help of ideas from Plato, Aristotle, and Michael Oakeshott, this argument is developed by distinguishing actions from practices and prudential from moral practices. Our moral practices, which comprise our character, cannot be taught, but they can be (...) learned—through conversations and similar educational contexts in which possible actions are imaginatively explored and critiqued in an open-ended manner, with the focus not on what we think or do but how. The difficulty for universities, amid so many practical pressures to do otherwise, to keep this essential educational task as their primary concern is acknowledged. PREFACE. THE Author of this very practical treatise on Scotch Loch - Fishing desires clearly that it may be of use to all who had it. He does not pretend to have written anything new, but to have attempted to put what he has to say in as readable a form as possible. Everything in the way of the history and habits of fish has been studiously avoided, and technicalities have been used as sparingly as possible. The writing of this (...) book has afforded him pleasure in his leisure moments, and that pleasure would be much increased if he knew that the perusal of it would create any bond of sympathy between himself and the angling community in general. This section is interleaved with blank shects for the readers notes. The Author need hardly say that any suggestions addressed to the case of the publishers, will meet with consideration in a future edition. We do not pretend to write or enlarge upon a new subject. Much has been said and written-and well said and written too on the art of fishing but loch-fishing has been rather looked upon as a second-rate performance, and to dispel this idea is one of the objects for which this present treatise has been written. Far be it from us to say anything against fishing, lawfully practised in any form but many pent up in our large towns will bear us out when me say that, on the whole, a days loch-fishing is the most convenient. One great matter is, that the loch-fisher is depend- ent on nothing but enough wind to curl the water, -and on a large loch it is very seldom that a dead calm prevails all day, -and can make his arrangements for a day, weeks beforehand whereas the stream- fisher is dependent for a good take on the state of the water and however pleasant and easy it may be for one living near the banks of a good trout stream or river, it is quite another matter to arrange for a days river-fishing, if one is looking forward to a holiday at a date some weeks ahead. Providence may favour the expectant angler with a good day, and the water in order but experience has taught most of us that the good days are in the minority, and that, as is the case with our rapid running streams, -such as many of our northern streams are, -the water is either too large or too small, unless, as previously remarked, you live near at hand, and can catch it at its best. A common belief in regard to loch-fishing is, that the tyro and the experienced angler have nearly the same chance in fishing, -the one from the stern and the other from the bow of the same boat. Of all the absurd beliefs as to loch-fishing, this is one of the most absurd. Try it. Give the tyro either end of the boat he likes give him a cast of ally flies he may fancy, or even a cast similar to those which a crack may be using and if he catches one for every three the other has, he may consider himself very lucky. Of course there are lochs where the fish are not abundant, and a beginner may come across as many as an older fisher but we speak of lochs where there are fish to be caught, and where each has a fair chance. Again, it is said that the boatman has as much to do with catching trout in a loch as the angler. Well, we dont deny that. In an untried loch it is necessary to have the guidance of a good boatman but the same argument holds good as to stream-fishing... (shrink)

The demonstration that pluripotent stem cells could be generated by somatic cell reprogramming led to wonder if these so-called induced pluripotent stem (iPS) cells would extend our investigation capabilities in the cancer research field. The first iPS cells derived from cancer cells have now revealed the benefits and potential pitfalls of this new model. iPS cells appear to be an innovative approach to decipher the steps of cell transformation as well as to screen the activity and toxicity of anticancer drugs. A better understanding of the impact of reprogramming on cancer cell-specific features as well as improvements in culture conditions to integrate the role of the microenvironment in their behavior may strengthen the epistemic interest of iPS cells as model systems in oncology. Results of a comprehensive simulation study are reported investigating the effects of sample size, test length, number of attributes and base rate of mastery on item parameter recovery and classification accuracy of four DCMs. Effects were evaluated using bias and RMSE computed between true parameters and estimated parameters. Effects of simulated factors on attribute assignment were also evaluated using the percentage of classification accuracy. More precise estimates of item parameters were obtained with larger sample size and longer test length. Recovery (...) of item parameters decreased as the number of attributes increased from three to five but base rate of mastery had a varying effect on the item recovery. Item parameter and classification accuracy were higher for DINA and DINO models. (shrink)

More has been said about the Hart-Fuller debate than can be considered healthy or productive even within the precious world of jurisprudential scholarship – too much philosophising about how law has revelled in its own abstractness and narrowness. But the mission of this book is distinctly and determinedly different – it is not to rework these already-rehashed ideas, but to reject them entirely. Rather than add to the massive jurisprudential literature that has been generated by all and sundry, the book (...) criticises and abandons the project that Hart and Fuller set in motion. It contends that the turn that was taken in 1957 has led down a series of cul-de-sacs, blind alleys, and dead-ends to nowhere useful or illuminating. It is more than past time to leave their debate behind and strike out in an entirely new and more promising direction. The book insists that not only law, but also all theorising about law, is political in all its derivations, dimensions, and directions. (shrink)

Great cases are those judicial decisions around which the common law develops. This book explores eight exemplary cases from the United Kingdom, the United States and Australia that show the law as a living, breathing and down-the-street experience. It explores the social circumstances in which the cases arose and the ordinary people whose stories influenced and shaped the law as well as the characters and institutions that did much of the heavy lifting. By examining the consequences and fallout of these (...) decisions, the book depicts the common law as an experimental, dynamic, messy, productive, tantalizing and bottom-up process, thereby revealing the diverse and uncoordinated attempts by the courts to adapt the law to changing conditions and shifting demands.
