What is the wrong behind the widely criticized presentist bias of democracies? In this paper I argue that it is not that future generations are excluded from present-day democratic decision-making quite generally. Rather, I claim that due to the unique risks associated with representing future generations and the limitations on affecting future generations both institutionally and causally, the focus ought to be on including them on a more specific, narrower, set of issues, namely only those that threaten to lead to (...) their domination. I identify such issues as those that may end up being purpose-determining: that may subject future generations to previous generations’ will by forcing them to exert a substantial amount of their energies on dealing with problems caused by their predecessors. I conclude by reflecting on the extent to which political representation together with providing avenues of contestation can minimize the risk of intergenerational domination. (shrink)

Most commentators agree that Leibniz advocates some version of a doctrine of the ideality or reducibility of relations, but there is considerable disagreement about what exactly this doctrine means. I argue that Leibniz’s views on relations are more complex than has been previously appreciated, and that, despite some ‘reductionist’ strands in Leibniz’s position, it is seriously misleading to describe him as a reductionist about relations without adding some important qualifications. The complexity of Leibniz’s views on relations tends to be obscured (...) by the common assumption that they can be captured in one unified thesis, or a small number of closely related theses, and by the widespread neglect to take Leibniz’s division of reality into several ontological levels into consideration. I disentangle ten Leibnizian theses about relations, extrinsic denominations, and their relation to intrinsic denominations. Some of these theses express a kind of dependence of extrinsic denominations on intrinsic ones, and some of them can even be counted as articulations of a form of reductionism. But, overall, the general tenor of Leibniz’s position on extrinsic denominations remains non-reductionist. (shrink)

The influence of background music on cognitive functions is still a matter of debate. In this study, we investigated the influence of background music on executive functions (particularly on inhibitory functions). Participants completed a standardized cued Go/NoGo task during three different conditions while an EEG was recorded (1: with no background music, 2: with relaxing or 3: with exciting background music). In addition, we collected reaction times, omissions, and commissions in response to the Go and NoGo stimuli. From the EEG (...) data, event-related potentials (ERPs) were calculated for the Go and NoGo trials. From these ERPs, the N2 and P3 components were specifically analyzed since previous studies have shown that these components (and particularly the Go-NoGo difference waves) are strongly associated with inhibitory functions. The N2 and P3 components of the difference waves (N2d and P3d) were used for statistical analyses. The statistical analyses revealed no differences between the three conditions in terms of amplitudes and latencies of the N2d and P3d components. In addition, reaction times, omissions, and commissions were comparable across all conditions. Our results suggest that in the context of this paradigm, music as background acoustic stimulation has no detrimental effects on the performance of a Go/NoGo task and neural underpinnings. (shrink)

In highly structured organisational fields individual efforts to deal rationally with uncertainty and constraints tend to lead, in the aggregate, to greater homogeneity in structure, culture and output. Drawing on institutional theory, this paper develops research propositions regarding the nature and scope of corporate social responsibility (CSR) engagement at trade/industry association level. The cases of the water and sewerage and film industries are used in order to test these propositions. The findings suggest that (a) trade associations in more homogeneous industries (...) are more likely to engage with CSR‐related issues; (b) trade associations in industries that face greater external scrutiny and threats to legitimacy are more likely to engage with CSR‐related issues; and (c) trade associations are more likely to engage with those substantive CSR issues that are of greater concern to the industry's most salient stakeholders. The findings also suggest that trade associations may have a greater tendency to engage in symbolic legitimation efforts through CSR if faced with the task of repairing industry legitimacy. (shrink)

Leading contemporary Jewish thinker David Novak has here compiled ten of his essays on a variety of issues in Jewish ethics. Drawing constantly on classical Jewish tradition, Novak also looks at a wide range of modern critical scholarship on the ancient sources. He aims to point out certain common features of Jewish and Christian ethics and the normative implications of this overlapping of traditions; he assumes the reality of a "Judeo-Christian ethic," while refusing to minimize the doctrinal differences (...) between the two traditions. The essays address such major normative issues in social justice as ecology, war and peace, the treatment of minorities, and the approach to AIDS patients. This combination of theoretical reflection and practical application, along with careful and detailed analysis of classical Jewish texts, makes the book a welcome contribution to contemporary ethical theory and normative ethics as well as a work of original Jewish theology. This paper first reviews key Buddhist concepts of time anicca , khanavada and uji and then describes the way in which a particular form of Bhuddist meditation, vipassana, may be thought to actualize them in human experience. The chief aim of the paper is to present a heuristic model of how vipassana meditation, by eroding dispositional tendencies rooted in the body-unconscious alters psychological time, transforming our felt-experience of time from a binding to a liberating force.

The World According to Kant offers an interpretation of Immanuel Kant’s critical idealism, as developed in the Critique of Pure Reason and associated texts. Critical idealism is understood as an ontological position, which comprises transcendental idealism, empirical realism, and a number of other basic ontological theses. According to Kant, the world, understood as the sum total of everything that has reality, comprises several levels of reality, most importantly, the transcendental level and the empirical level. The transcendental level is a mind-independent (...) level at which things in themselves exist. The empirical level is a fully mind-dependent level at which appearances exist, which are intentional objects of experience. Empirical objects and empirical minds are appearances, and empirical space and time are constituted by the spatial and temporal determinations of appearances. On the proposed interpretation, Kant is thus a genuine idealist about empirical objects, empirical minds, and space and time. But in contrast to other intentional objects, appearances genuinely exist, which is due both to the special character of experience compared to other kinds of representations such as illusions or dreams, and to the grounding of appearances in things themselves. This is why, on the proposed interpretation, Kant is also a genuine realist about empirical objects, empirical minds, and empirical space and time. This paper investigates how a performative understanding of a woman’s right to care can become part of a feminist politics which is able to transcend the well-worn dichotomies we find both within and without feminist literature, such as difference versus equality, difference versus repronormativity, and rights as freedom versus rights as domination. Drawing on my own research, I argue that claiming the right to care does not simply push women more deeply into motherhood resulting in even more control and regulation (...) of their lives, but that claiming care rights enables women to speak for themselves. Following the work of Linda Zerilli this paper argues that claiming women’s rights should, above all, be viewed as performative activities which contribute to democratic practices. (shrink)

It was also one of the topics of the lecture series, Urban Governance and Civic Participation in Words and Stone, as part of which Prof. (...) Ferenc Hörcher also gave a talk. Although the following interview is based primarily on Prof. Hörcher’s lecture, the discussion joyfully meandered through a number of other, fascinating topics, like the value of philosophical dialogue vis-a-vis debate, the literary figure of the flaneur, the political ideas of Dante and the philosophical potential of poetry. (...) – si mi s svojim predragim prihodom v družbi imenitnih mož, kakršnih je to drobno mestece rodilo na pretek, odgnal vsak dvom. Kot bi mi z nitjo prijetno pestrega pogovora pričvrstil omahujočega duha, sem kljub misli na odhod ostal in šele ko se je spustila noč, sem zapazil, da je dan spolzel mimo. Kot že mnogokrat poprej sem tudi tistega dne spoznal, da nam nič drugega ne izmika časa tako neopazno kot prav pogovori s prijatelji. In Defense of Religious Liberty contains David Novak’s vigorous—and paradoxical—argument that the primacy of divine law is the best foundation for a secular, multicultural democracy. Novak presents his claim, which will astound both liberal and conservative advocates of democracy, in political, philosophical, and theological terms. He shows how the universal norms of divine law are knowable as natural law, that they are the best formulations of the human rights of life, liberty, and the pursuit of happiness, and that (...) their assertion includes an explicit recognition of God as cosmic lawgiver. Furthermore, Novak maintains that the seemingly disparate ideas of divine command, natural law, and human rights can be integrated into one overall political theory. Novak reveals this integration at work in the classical texts of his own Jewish tradition, as well as in the canonical philosophical tradition of the West, from Plato to the Stoics to Grotius to Kant. He also convincingly makes the case that those who reject any legitimate role for religion in discussions of public morality inevitably substitute arbitrary human power for divine command, arbitrary positive law for natural law, and arbitrary governmental entitlements for human rights that exist prior to the establishment of the state. Novak concludes that religious traditions like Judaism, precisely because they incorporate the doctrines of God the cosmic lawgiver, natural law, and human rights, provide the most coherent ontological foundation for democracy in today’s world. The problem at the center of this essay is how one can reconcile the continuity of space with a monadological theory of matter, according to which matter is ultimately composed of simple elements, a problem that greatly exercised Leibniz, the Wolffians, and Kant. The underlying purpose of this essay is to illustrate my reading of Kant’s philosophical development, and of his relation to the Wolffians and Leibniz, according to which, (a), this development was fueled by ‘home-grown’ problems that arose within (...) the framework of the Wolffian philosophy from which Kant started out, and, (b), on his journey to critical idealism, Kant gradually moved away from Wolffianism, but closer to Leibniz, which, however, he came to realize only some years after the publication of the Critique of Pure Reason. This reading is illustrated by showing that the problem of how to reconcile the continuity of space with a monadological theory of matter is a problem that Kant inherits from Leibniz and the Wolffians, in whose thinking it already plays an important role, that Leibniz’s mature solution to the problem differs markedly from the Wolffian solution, and that Kant’s early, pre-critical solution is largely Wolffian, while his later critical solution is largely Leibnizian, as he himself notes with gleeful satisfaction. The discussion also reveals that this problem is one of the key problems that fueled Kant’s philosophical development and, eventually, led him to the discovery of transcendental idealism. (shrink)

In his recent book, The Empirical Stance, Bas van Fraassen forcefully raises the question of what a philosophical position can or should be. He mainly discusses this question with regard to empiricism but his discussion makes it clear that he takes his proposed answer to be generalizable: not only empiricism but philosophical positions in general should be understood as stances rather than dogmata. The first part of this essay is devoted to an examination of van Fraassen’s critique of ‘naïve’ or (...) dogmatic empiricism, which represents an integral part of his argument for ‘stance’ empiricism. It will be argued that, contrary to van Fraassen’s view, not all versions of naïve empiricism run into the problems identified by him. In the second part of the paper the case will be made that, contrary to van Fraassen’s thesis, the stance empiricist is in at least as bad a position as the naïve empiricist with regard to the task of providing a radical critique of metaphysics, which van Fraassen takes to be an essential task that any empiricist should be able to accomplish. The third part of this essay concerns van Fraassen’s general proposal, and examines the question whether a philosophical position can possibly consist in a stance. It will be suggested that this is not the case. With regard to empiricism this has the implication that if one wants to be a philosopher and an empiricist at the same time one needs to subscribe to a form of naïve empiricism. Furthermore, it will be proposed that as a philosopher-empiricist one should want, or, at least, allow some form of metaphysical theorizing to be part of the philosophical enterprise after all. Contrary to popular belief, I argue that Leibniz is not hopelessly confused about motion: Leibniz is indeed both a relativist and an absolutist about motion, as suggested by the textual evidence, but, appearances to the contrary, this is not a problem; Leibniz’s infamous doctrine of the equivalence of hypotheses is well-supported and well-integrated within Leibniz’s physical theory; Leibniz’s assertion that the simplest hypothesis of several equivalent hypotheses can be held to be true can be explicated in such a way that (...) it makes good sense; the mere Galilean invariance of Leibniz’s conservation law does not compromise Leibniz’s relativism about motion; and Leibniz has a straightforward response to Newton’s challenge that the observable effects of the inertial forces of rotational motions empirically distinguish absolute from relative motions. In the following paper I develop an account of Gilles Deleuze’s ethics through his work on Spinoza, which he contrasts with morality, to argue that an ethical response to the COVID-19 pandemic should resist the moralizing of the New Normal and instead have an immanent focus on what is happening to us. In the first part of the paper I detail the novel approach to ethics as ethology that Deleuze works out most explicitly in Spinoza: Practical Philosophy. In the second (...) part I show exactly how Deleuze contrasts ethics from morality and moral thinking before showing the relation of ethics to morality in relation to the New Normal and contrast the Deleuzian ethical perspective from other ethical philosophical accounts that I claim are indicative a moral approach to the New Normal. I conclude by arguing that the prevalence of the New Normal amidst COVID-19 represents a triumph of what Spinoza calls the sad passions and suggest Deleuze’s ethics might be a way to reject those sad passions. Conrad Gessner was town physician and lecturer at the Zwinglian reformed lectorium in Zurich. His approach towards the world and mankind was centred on his preoccupation with the human soul, an object of study that had challenged classical writers such as Aristotle and Galen, and which remained as important in post-Reformation debate. Writing commentaries on Aristotles De Anima was part of early-modern natural philosophy education at university and formed the preparatory step for studying medicine. This article uses the case study (...) of Gessners commentary on De Anima to explore how Gessners readers prioritised De Animas information. Gessners intention was to provide the students of philosophy and medicine with the most current and comprehensive thinking. His readers responses raise questions about evolving discussions in natural philosophy and medicine that concerned the foundations of preventive healthcare on the one hand, and of anatomically specified pathological medicine on the other, and Gessners part in helping these develop. I then define the modal (logical) properties and relations of propositions, including the modality of conditional propositions and the validity of argument, according to the principles of CTM: that is, in terms of clear and distinct ideas, and without any reference to either possible worlds, or deducibility in an axiomatic (...) system, or linguistic convention. This paper discusses how an understanding of Jung's psychological types is important for the relevance of Gilbert's multi-modal argumentation theory. Moreover, it highlights how the types have been confirmed by contemporary neuroscience and cognitive psychology. Based on Gilbert's approach, I extend multi-modal argumentation to the area of legal argumentation. It seems that when we leave behind the traditional fortress of “logical” legal argumentation, we "discover" alternate modes that have always been present, concealed in the theoretically underestimated rhetorical skills of arguers.

Barth and Niebuhr seemed to be wary of natural law because each of them thought that the “natural” in natural law means that natural law has to be rooted in natural theology. However, natural law today is more cogently formulated without any natural theology at all. “Natural law” means that law can be derived from the twofold character or nature of human personhood: the capacity for a communal relationship with other humans, and the capacity for a covenantal relationship with God, (...) both of which continually overlap in human life. The natural or external world only provides the backdrop for these human capacities; it does not determine them. (shrink)

This paper presents a four layer model for working with legal knowledge in expert systems. It distinguishes five sources of knowledge. Four contain basic legal knowledge found in published and unpublished sources. The fifth consists of legal metaknowledge. In the model the four basic legal knowledge sources are placed at the lowest level. The metaknowledge is placed at levels above the other four knowledge sources. The assumption is that the knowledge is represented only once. The use of metaknowledge at various (...) levels should make it possible to use the appropriate knowledge for the problem presented to the system. The knowledge has to be represented as closely to the original format as possible for this purpose. Suitable representation formalisms for the various types of knowledge in the five knowledge sources are discussed. ABSTRACTWhen learning from text, it is important that learners not only comprehend the information provided but also accurately monitor and judge their comprehension, which is known as metacomprehension accuracy. To investigate the role of a learner’s affective state for text comprehension and metacomprehension accuracy, we conducted an experiment with N = 103 university students in whom we induced positive, negative, or neutral affect. Positive affect resulted in poorer text comprehension than neutral affect. Positive affect also led to overconfident predictions, whereas (...) negative and neutral affect were both associated with quite accurate predictions. Independent of affect, postdictions were rather underconfident. The results suggest that positive affect bears processing disadvantages for achieving deep comprehension and adequate prediction accuracy. Given that postdictions were more accurate, practice tests might represent an effective instructional method to help learners in a positive affective state... (shrink)

Ohne den eigenen Anteil hinzuzunehmen, bleiben dem Leser der Wissenschaftslehre anstelle des Geistes nichts als Buchstaben (...) derselben. Bei Fichte wird die Frage nach dem Ort der Freiheit radikal anders und neuartig gestellt, weil der damalige Zuhorer der Jenaer Vorlesungen und auch der heutige Leser aktiv und systematisch in die Beantwortung der Frage: Was ist Freiheit? einbezogen wird. Dem an der Frage Interessierten selbst wird ein gewichtiger Platz zuerkannt, das System der Freiheit von diesem und seiner Bereitschaft mitzudenken, mitzubilden und mitzuwirken abhangig gemacht. Over the last three decades, the art market has undergone a remarkable transformation. Before the 1990s, artworks were sold with hardly any concern about whether they had been stolen or looted, whereas now any reputable gallery or auction house checks the “provenance” of any substantial work before sale. This transformation reflects interlocking changes in law, norms, and institutions. New York’s and more broadly the United States’ assertion of jurisdiction and application of U.S. substantive law has destabilized title to stolen and (...) looted goods worldwide because American statutes of limitations generally provide weaker protection for those who possess stolen or looted goods even in good faith. Application of American law has had a profound effect, especially for the high end of the market, because European or Asian investors who purchase art outside of the U.S. may eventually want to sell or display their works in the U.S. Defective title under American law thus affects prices worldwide. The tightening and broader application of American law reflects both longstanding legal principles and changes in social norms towards the redress of historical wrongs, most notably prominent campaigns relating to art confiscated or sold under duress in Nazi Germany. New institutions, most importantly searchable databases recording stolen and looted art such as the Art Loss Register, are also changing perceptions about minimum standards for good faith purchase, which in turn affects both social norms and court cases. These new norms, induced by both legal changes and better information, have influenced the market even for less valuable art, for which sale or display in the U.S. is not a relevant consideration and for which the threat of costly legal action is not credible. The fact that social and institutionalized norms play an important role in protecting original owners is probably good, because norms and institutions can be effective even where law is not and often do so at lower cost.
