The ArgumentThe thesis of this paper is that there are three basic processes by which a technological innovation is fitted into an existing culture: Rejection, in situations where all interested groups are satisfied with a traditional technology and reject apparently superior innovations because they would force unwanted changes in technology and ideology; Acceptance, in situations where a new technology is embraced by all because it appears to serve the same social and ideological functions as an inferior, or inoperative, traditional technology; (...) and — most commonly in complex societies — conflict over acceptance or rejection, in situations where a new technology introduced or proposed by one group, who perceive it as advancing their interests, is resisted by another group, who perceive it as threatening their welfare. A traditional tripartite concept of culture is employed, distinguishing technology, social organization, and ideology. Four case studies are introduced to illuminate the issue: the Thonga tribesmen of Mozambique, whose occupation as gold and diamond miners at first suited perfectly the requirements of the Thonga lineage and marriage system; the Yir Yoront of Australia, an aboriginal group who found that the steel axe introduced by whites disrupted the patriarchal status system and confounded their mythology; the Senecas, an American Indian tribe that for generations rejected male plow agriculture because their way of life was organized around female horticulture, but who took up male agriculture at the urging of a prophet when traditional male roles disintegrated on the reservation; and the anthracite miners and mine operators of nineteenth-century Pennsylvania, who discovered that fundamental changes in both social organization and ideology were needed in order to cope with catastrophically high rates of industrial accidents attendant on the new system of deep-shaft mining. Scholars in philosophy, law, economics and other fields have widely debated how science, environmental precaution, and economic interests should be balanced in urgent contemporary problems, such as climate change. One controversial focus of these discussions is the precautionary principle, according to which scientific uncertainty should not be a reason for delay in the face of serious threats to the environment or health. While the precautionary principle has been very influential, no generally accepted definition of it exists and critics charge that (...) it is incoherent or hopelessly vague. This book presents and defends an interpretation of the precautionary principle from the perspective of philosophy of science, looking particularly at how it connects to decisions, scientific procedures, and evidence. Through careful analysis of numerous case studies, it shows how this interpretation leads to important insights on scientific uncertainty, intergenerational justice, and the relationship between values and policy-relevant science. This paper examines the concepts of desert and luck, familiar in political theory but neglected by sociologists. I argue that the idea of desert is composed of both personal performance and the degree of responsibility a person has over that performance. Distribution ought to be in accordance with the indebtedness created by the person's performance. This can be compromised by luck; that is, personal desert is undermined where lack of performance scuttles the applicability of the contributory model. The Sustainable Development Goals are an opportunity to address major social and environmental challenges. As a widely agreed framework they offer a potential way to mobilise stakeholders on a global scale. The manner in which the goals, with time-based targets and specific metrics, are set out within a voluntary reporting process adopted by both governments and business, provides a fascinating and important case for organisational studies. It is both about advancing performance measurement and evidence-based policy-making for sustainable development, and also (...) participation and consultation at a wider, more global scale, than has ever been possible before. This paper contributes to the notion of SDGs as a wicked problem, answering calls for deeper theorisation, via synthesis with core ideas in the management field of decision theory. A case study on the wicked problem of deforestation and its links to supply chains, multi-stakeholder initiatives and SDG reporting, provides an illustration of the relevance of the application of decision theory to wicked problems, presented using a novel conceptual framework. This helps to illustrate new avenues for research and practical application regarding the balance of technocratic and participative approaches for sustainable development. (shrink)

A corrective justice account of a private law remedy attempts to the explain the remedy as giving back to the plaintiff something to which the plaintiff had a prior right that was breached by the defendant's receipt of that thing. It has proven challenging to explain how disgorgement for breach of contract is consistent with corrective justice. This remedy gives to the plaintiff any profit that a defendant received from a third party by breaching a contract with the plaintiff. In (...) this paper, I critique two leading attempts to show how disgorgement for breach of contract is consistent with corrective justice. I argue that these attempts fail, and I suggest that a plausible corrective justice account of disgorgement should be based on something other than the nature of the contractual rights borne by a plaintiff. I then develop an alternative account based on an analogy between disgorgement for breach of contract and disgorgement for breach of fiduciary duty. To do so, I draw on recent scholarship on the consistency of disgorgement for breach of fiduciary with corrective justice and analyze the leading judicial decision on disgorgement for breach of contract by the UK House of Lords inAttorney General v. Blake. I argue that the fiduciary-based account can provide a plausible explanation for how disgorgement effectuates corrective justice by giving back to a plaintiff something to which he had an antecedent right that the defendant violated by profiting from a breach of contract. Disputes between advocates of Bayesians and more orthodox approaches to statistical inference presuppose that Bayesians must regard must regard stopping rules, which play an important role in orthodox statistical methods, as evidentially irrelevant.In this essay, I show that this is not the case and that the stopping rule is evidentially relevant given some Bayesian confirmation measures that have been seriously proposed. Supervised injectable opioid assisted treament prescribes injectable opioids to individuals for whom other forms of addiction treatment have been ineffective. In this article, we examine arguments that opioid-dependent people should be assumed incompetent to voluntarily consent to clinical research on siOAT unless proven otherwise. We agree that concerns about competence and voluntary consent deserve careful attention in this context. But we oppose framing the issue solely as a matter of the competence of opioid-dependent people and emphasize that it should be (...) considered in the context of inequities in access to siOAT as a medical treatment. Consequently, we suggest that bioethics literature on nonexploitation, which focuses on clinical research in low-income countries, is helpful due to locating ethical issues within systemic social conditions. The causal Markov condition (CMC) plays an important role in much recent work on the problem of causal inference from statistical data. It is commonly thought that the CMC is a more problematic assumption for genuinely indeterministic systems than for deterministic ones. In this essay, I critically examine this proposition. I show how the usual motivation for the CMC—that it is true of any acyclic, deterministic causal system in which the exogenous variables are independent—can be extended to the indeterministic case. (...) In light of this result, I consider several arguments for supposing indeterminism a particularly hostile environment for the CMC, but conclude that none are persuasive. This article examines methodological individualism in terms of the theory that invariance under intervention is the signal feature of generalizations that serve as a basis for causal explanation. This theory supports the holist contention that macro-level generalizations can explain, but it also suggests a defense of methodological individualism on the grounds that greater range of invariance under intervention entails deeper explanation. Although this individualist position is not threatened by multiple-realizability, an argument for it based on rational choice theory is called (...) into question by experimental results concerning preference reversals. A concept of diversity is an understanding of what makes a group diverse that may be applicable in a variety of contexts. We distinguish three diversity concepts, show that each can be found in discussions of diversity in science, and explain how they tend to be associated with distinct epistemic and ethical rationales. Yet philosophical literature on diversity among scientists has given little attention to distinct concepts of diversity. This is significant because the unappreciated existence of multiple diversity concepts can (...) generate unclarity about the meaning of “diversity,” lead to problematic inferences from empirical research, and obscure complex ethical-epistemic questions about how to define diversity in specific cases. We illustrate some ethical-epistemic implications of our proposal by reference to an example of deliberative mini-publics on human tissue biobanking. (shrink)

Illuminating innovatively the dialectic by which “sign” is induced “to signify” requires an analysis of the inferrer-entailed symbolics constituting “signified,” a process particularly observable during relative, purposeful re-signification, particularly at high-visibility sites. Because Nathaniel Hawthorne focused intently his romantic-dramatic oeuvre on cynosural women, because of his affinity for allegorical signification, and especially for his tangibility to feminist themes and axiologies of virtue transcending even the highly reformist nineteenth century, he is here chosen an interpretation-open “carrier wave” for that research. Climactically (...) and consonant thematically, also instructive is Umberto Eco’s unnamed, eponymous “Rose” for being an antiphrastic sign with a truth of its own signifying at least (like Hawthorne’s Puritan-oblique Hester Prynne) divergence from male/hieratic hermeneutics; at most (like Apuleius’s metaphysical Psyche, Hawthorne’s lodestar) ineffable, philosophical Good. As if to the generating premise, Eco wrote in The Name of the Rose, “Without an eye to read them[,] signs produce no concepts”; socially consequential signification-conditioned transformation, in that eye and toward those signifieds, symptomatic both historical and rhetorical, is here assayed. Tilley argues that since religions are not summaries of bloodless beliefs but embodied communal practices, the heuristic for the justification of beliefs must shift. Although some of the lines of this shift to practical wisdom remain vague, Tilley has taken philosophy of religion in an excellent direction. Attention to these questions would sharpen his sketch: Why abandon linguistic philosophy with no attention to the help one might receive from the embodied linguistic practice of the later Wittgenstein? What grounds the wisdom (...) we seek to practice? Can community outsiders argue with insiders? Do these embodied philosophical arguments differ from theological arguments? (shrink)

IN THE DISCUSSION on education in the Republic, Socrates lays down the principles which those who speak about the gods must follow if they want to avoid the errors of traditional mythology. The first typos of this rational theology is this: "God is the cause, not of all things, but only of the good." For "God, being good, cannot be responsible for everything happening in our life, as is commonly believed, but only for a small part. For we have a (...) far smaller share of good than of evil, and while God must be held to be the sole cause of good, we must look for some other factors than God as cause of the evil." Rightly celebrated, this passage has set the agenda for ages of reflection in Western thought on the cause of evil. In contrast to traditional mythology where the gods are seen as the origin of both good and evil--as Homer says, "Zeus has two jars standing on the floor of his palace, full of fates, good in one and evil in the other"--the divinity is now freed of all responsibility for evil. God, who is entirely good, can only be the cause of well-being. If this answer sets God free of all responsibility for evil, it seems to be at the cost of limiting God's power: for God is no longer responsible for "most things in human life," since most of them are evil. What, then, may be the cause or causes of evil? Do bad things have a cause? Or do they just happen? Plato's formulation seems to suggest that he favours a dualistic solution to the problem of evil: God is the cause of all good, but for evil we have to find other causes. What could those causes be: matter, cosmic necessity, an evil soul? Various answers of this type were developed in later Platonism and in later mythological philosophies. Without denying that Plato often uses a dualistic discourse and uses elements of it in his cosmology, I do think that Plato had something different in mind. After all, he was not primarily interested in the problem of theodicy. For in this passage of the Republic, he is not concerned with the problem of evil in the universe as a whole, which is really the theodicy question, but with evil in "human life," that is, evil insofar as human beings experience it and suffer from it: the fact that we are not at all living well but are instead miserable and unhappy. Merleau-Ponty’s writings on the philosophy of painting, though widely influential and much discussed, remain enigmatic. In this paper I compare his views on painting with those of his older contemporary, Jacques Maritain, who also holds that painting can give us a non-conceptual insight into deep truths about things that are inaccessible to discursive thought. I argue that some ideas that are obscure and undeveloped in Merleau-Ponty are developed more clearly and fully in Maritain. Even where there are significant differences between (...) them, these are not as great as it might at first seem. This comparison can help us to see the ways in which both philosophers’ theories of art are important for understanding their philosophies as a whole. Furthermore, the views they hold in common can continue to suggest a plausible and fruitful way to think about art today. (shrink)
