C'est une vieille évidence qu'il n'est rien sujet à plus de continuelle agitation que les lois. Et en effet, l'ordre juridique est toujours instable. Il traduit un point d'équilibre momentané, qui n'était pas le seul possible, ni le seul prévisible. Le meilleur des Codes n'a jamais pu le fixer. Son contenu évolue sans cesse. Car, à l'image de la vie, le champ du droit est un espace ouvert, où s'affrontent un chaos de forces en perpétuel mouvement. Ni Providence, ni Progrès (...) n'y apparaissent avec certitude, l'esprit souffle apparemment où il veut et nul ne sait où il va. La preuve en est que la meilleure des règles en un temps donné finit toujours par avoir des effets pervers et qu'il est peu de lois vicieuses qui n'aient parfois d'heureux effets. Dans ces conditions, il ne faut pas attendre de l'enseignement du droit qu'il fournisse un catalogue de recettes pratiques, stables et sûres. Son seul but devrait être d'apprendre à poser les bonnes questions, qui sont presque toujours les mêmes, pour parvenir un jour à trouver de bonnes réponses, toujours provisoires. Or, aucune démarche n'est plus propice à la réalisation d'un tel but que la méthode historique. Elle révèle qu'il n'y a jamais de solution bonne et durable et que chaque civilisation, chaque génération doit trouver elle même ses propres réponses, avec une étroite marge de manœuvre. Pour trouver sa voie, explique l'auteur, ni la science, ni la philosophie ne livrent de clé. Si l'une peut l'éclairer et l'autre le guider, le droit n'est ni assimilable à une science, ni réductible à une philosophie. C'est un art subtil, qui nécessite de se plier à une discipline spécifique, mais dont la parfaite maîtrise dépasse celle des règles techniques qui lui sont indispensables. Elle suppose la sagesse d'admettre les pesanteurs, la complexité et la relativité de la vie, ainsi que la sérénité d'accepter ce qui ne peut être changé, le courage de modifier ce qui peut l'être et le désir de chercher à distinguer l'un de l'autre sans parti-pris. Ceci requiert une tournure d'esprit et une culture à laquelle il ne paraît pas concevable d'accéder sans le secours de l'expérience et le recours à l'histoire. (shrink)

Antoine Arnauld and Pierre Nicole were philosophers and theologians associated with Port-Royal Abbey, a centre of the Catholic Jansenist movement in seventeenth-century France. Their enormously influential Logic or the Art of Thinking, which went through five editions in their lifetimes, treats topics in logic, language, theory of knowledge and metaphysics, and also articulates the response of 'heretical' Jansenist Catholicism to orthodox Catholic and Protestant views on grace, free will and the sacraments. In attempting to combine the categorical theory of (...) the proposition with a Cartesian account of knowledge, their Logic represents the classical view of judgment which inspired the modern transformation in logic and semantic theory by Frege, Russell, Wittgenstein and recent philosophers. Calm is a little-theorized but important link between Roland Barthes and Samuel Beckett. Beginning with Beckett, moving on to Barthes, and then interleaving the two, this paper proposes calm as a ‘scandalous’ category not reducible to kindred states like languor or apatheia. In dialogue with theorists of repose, such as Kant and De Quincey, calmness becomes less a sedated condition than an interactive process, entailing intense sensitivity to the fluctuations of what Barthes calls ‘the affective minimal’. Artistically generative, this ‘emotive (...) lucidity’ encourages inquisitiveness towards the natural world, and enables in both writers specific writing practices — from lists to notation to haiku. Summary New information technology can be an invaluable aid to research in the history of ideas provided it is built on scientific foundations. This article discusses the case of Diderot and D'Alembert's Encyclopédie and analyses its use of earlier dictionaries (the Dictionnaire de Trévoux, Chambers's Cyclopaedia and Moréri's dictionary). It also shows how neglect of existing research in the history of ideas and ignorance of how these eighteenth-century European publications were elaborated, combined with inappropriate use of software for detecting plagiarism, (...) have led to totally mistaken findings. These findings, widely publicised thanks to the Internet, constitute a real danger for future research. The article concludes that the intellectual community urgently needs to invest seriously in the digital humanities in order to safeguard future research. (shrink)

Le nouveau livre de Frédéric Brahami montre comment il faut considérer globalement la réaction des penseurs postrévolutionnaires à la Révolution pour saisir la façon dont s’est élaborée la philosophie politique qui est encore la nôtre, pour autant que nous lisions notre actualité politique à la lumière des sciences sociales. Pour fournir les schèmes de notre pensée politique, il a fallu que les critiques contre-révolutionnaires de la modernité politique soient reprises par les progressistes sensibles à la « question sociale ». La (...) pensée sociale du xixe siècle pouvait alors dégager la raison immanente aux mœurs modernes, en découvrant la double nécessité d’en faire l’objet d’une science et de les comprendre politiquement. Au-delà d’une généalogie alternative et stimulante de la politique moderne, c’est tout une philosophie de l’histoire sociale et intellectuelle qui est là engagée, au terme de laquelle nos sociétés démocratiques apparaissent comme ces sociétés qui ne cessent de se réfléchir elles-mêmes en se pensant politiquement. Developing countries face numerous barriers to conducting effective and efficient ethics reviews of international collaborative research. In addition to potentially overlooking important scientific and ethical considerations, inadequate or insufficiently trained ethics committees may insist on unwarranted changes to protocols that can impair a study's scientific or ethical validity. Moreover, poorly functioning review systems can impose substantial delays on the commencement of research, which needlessly undermine the development of new interventions for urgent medical needs. In response to these concerns, the Drugs (...) for Neglected Diseases Initiative, an independent nonprofit organization founded by a coalition of public sector and international organizations, developed a mechanism to facilitate more effective and efficient host country ethics review for a study of the use of fexinidazole for the treatment of late stage African Trypanosomiasis. The project involved the implementation of a novel ‘pre-review’ process of ethical oversight, conducted by an ad hoc committee of ethics committee representatives from African and European countries, in collaboration with internationally recognized scientific experts. Antoine Pecquet wrote in the eighteenth century during the reign of Louis XV. Although he included Pascal among those he admired, he considered Alexander Pope his true mentor. In Part 1 of "Diverse Thoughts on Man," Pecquet reflects on Man's responsibilities as an individual: in Part 2, on Man's responsibilities as a member of society. Among these responsibilities he includes human and social concerns, such as parental and filial obligations, and the transfer of wealth between generations. In the tradition (...) of Montaigne, Pecquet intended his "Diverse Thoughts on Man" to help his readers learn more about themselves. Although he felt that those who would profit most from his book were readers who had not greatly pondered about themselves, he believed that every reader could find something of value in it. The capacity to stabilize the content of attention over time varies among individuals, and its impairment is a hallmark of several mental illnesses. Impairments in sustained attention in patients with attention disorders have been associated with increased trial-to-trial variability in reaction time and event-related potential deficits during attention tasks. At present, it is unclear whether the ability to sustain attention and its underlying brain circuitry are transformable through training. Here, we show, with dichotic listening task performance and electroencephalography, that training (...) attention, as cultivated by meditation, can improve the ability to sustain atten- tion. Three months of intensive meditation training reduced variability in attentional processing of target tones, as indicated by both enhanced theta-band phase consistency of oscillatory neural responses over anterior brain areas and reduced reaction time variability. Furthermore, those individuals who showed the greatest increase in neural response consistency showed the largest decrease in behav- ioral response variability. Notably, we also observed reduced variability in neural processing, in particular in low-frequency bands, regardless of whether the deviant tone was attended or unattended. Focused attention meditation may thus affect both distracter and target processing, perhaps by enhancing entrainment of neuronal oscillations to sensory input rhythms, a mechanism important for controlling the content of attention. These novel findings highlight the mechanisms underlying focused attention meditation and support the notion that mental training can significantly affect attention and brain function. (shrink)

We argue that ecology in general and biodiversity and ecosystem function research in particular need an understanding of functions which is both ahistorical and evolutionarily grounded. A natural candidate in this context is Bigelow and Pargetter’s evolutionary forward-looking account which, like the causal role account, assigns functions to parts of integrated systems regardless of their past history, but supplements this with an evolutionary dimension that relates functions to their bearers’ ability to thrive and perpetuate themselves. While Bigelow and Pargetter’s account (...) focused on functional organization at the level of organisms, we argue that such an account can be extended to functional organization at the community and ecosystem levels in a way that broadens the scope of the reconciliation between ecosystem ecology and evolutionary biology envisioned by many BEF researchers. By linking an evolutionary forward-looking account of functions to the persistence-based understanding of evolution defended by Bouchard and others, and to the theoretical research on complex adaptive systems, we argue that ecosystems, by forming more or less resilient assemblages, can evolve even while they do not reproduce and form lineages. We thus propose a Persistence Enhancing Propensity account of role functions in ecology to account for this overlap of evolutionary and ecological processes. (shrink)

Understanding the emergence of a tangible 4-dimensional space-time from a quantum theory of gravity promises to be a tremendously difficult task. This article makes the case that this task may not have to be carried. Space-time as we know it may be fundamental to begin with. I recall the common arguments against this possibility and review a class of recently discovered models bypassing the most serious objection. The generic solution of the measurement problem that is tied to semiclassical gravity as (...) well as the difficulty of the alternative make it a reasonable default option in the absence of decisive experimental evidence. Spiritualism designates a philosophy that lays claim to the separation of mind and body and the ontological and epistemological primacy of the former. In France, it is associated with the names of Victor Cousin and René Descartes, or more precisely with what Cousin made of Descartes as the founding father of a brittle rational psychology, closed off from the positive sciences, and as a critic in respect to the empiricist legacy of the idéologues. Moreover, by considering merely the end result, (...) severed from its polemical genesis, we are prevented from understanding how the category of experience constituted a crucial question for spiritualism itself. Through returning to the origin of these discussions in the 1826 preface to Cousin’s Fragments philosophiques, this essay pursues a threefold path: to show that the public birth of Cousinian spiritualism coincides with the affirmation of applying the experimental method, issuing from Bacon, to the study of facts of consciousness; that Cousin’s later evolution follows a process of radicalization—that is, in this context, of ontologization and of reduction; and that by recovering this genesis, we can distinguish many forms of spiritualisms committed to the experimental method, both in alliance with the early Cousin and against the later Cousin. In this way, we can rediscover the interwoven philosophical links, lost in the process of institutionalization, between metaphysical demands and empiricist concerns, or between “French” philosophy and the legacy of Condillac. We discuss models that attempt to provide an explanation for the violation of Bell inequalities at a distance in terms of hidden influences. These models reproduce the quantum correlations in most situations, but are restricted to produce local correlations in some configurations. The argument presented in (Bancal et al. Nat Phys 8:867, 2012) applies to all of these models, which can thus be proved to allow for faster-than-light communication. In other words, the signalling character of these models cannot remain hidden.

To fulfill their crucial duty of relieving suffering in their patients, physicians may have to administer palliative sedation when they implement treatment-limitation decisions such as the withdrawal of life-supporting interventions in patients with poor prognosis chronic severe brain injury. The issue of palliative sedation deserves particular attention in adults with serious brain injuries and in neonates with severe and irreversible brain lesions, who are unable to express pain or to state their wishes. In France, treatment limitation decisions for these patients (...) are left to the physicians. Treatment-limitation decisions are made collegially, based on the presence of irreversible brain lesions responsible for chronic severe disorders of consciousness. Before these decisions are implemented, they are communicated to the relatives. Because the presence and severity of pain cannot be assessed in these patients, palliative analgesia and/or sedation should be administered. However, palliative sedation is a complex strategy that requires safeguards to prevent a drift toward hastening death or performing covert euthanasia. In addition to the law on patients' rights at the end of life passed in France on April 22, 2005, a recent revision of Article 37 of the French code of medical ethics both acknowledges that treatment-limitation decisions and palliative sedation may be required in patients with severe brain injuries and provides legal and ethical safeguards against a shift towards euthanasia. This legislation may hold value as a model for other countries where euthanasia is illegal and for countries such as Belgium and Netherlands where euthanasia is legal but not allowed in patients incapable of asking for euthanasia but in whom a treatment limitation decision has been made. Recent brain imaging studies using functional magnetic resonance imaging (fMRI) have implicated insula and anterior cingulate cortices in the empathic response to another’s pain. However, virtually nothing is known about the impact of the voluntary generation of compassion on this network. To investigate these questions we assessed brain activity using fMRI while novice and expert meditation practitioners generated a loving-kindness-compassion meditation state. To probe affective reactivity, we presented emotional and neutral sounds during the meditation and comparison periods. Our main hypothesis (...) was that the concern for others cultivated during this form of meditation enhances affective processing, in particular in response to sounds of distress, and that this response to emotional sounds is modulated by the degree of meditation training. The presentation of the emotional sounds was associated with increased pupil diameter and activation of limbic regions (insula and cingulate cortices) during meditation (versus rest). During meditation, activation in insula was greater during presentation of negative sounds than positive or neutral sounds in expert than it was in novice meditators. The strength of activation in insula was also associated with self-reported intensity of the meditation for both groups. These results support the role of the limbic circuitry in emotion sharing. The comparison between meditation vs. rest states between experts and novices also showed increased activation in amygdala, right temporo-parietal junction (TPJ), and right posterior superior temporal sulcus (pSTS) in response to all sounds, suggesting, greater detection of the emotional sounds, and enhanced mentation in response to emotional human vocalizations for experts than novices during meditation. Together these data indicate that the mental expertise to cultivate positive emotion alters the activation of circuitries previously linked to empathy and theory of mind in response to emotional stimuli.. The BTB domain is a protein–protein interaction motif that is found throughout eukaryotes. It determines a unique tri‐dimensional fold with a large interaction surface. The exposed residues are highly variable and can permit dimerization and oligomerization, as well as interaction with a number of other proteins. BTB‐containing proteins are numerous and control cellular processes that range from actin dynamics to cell‐cycle regulation. Here, we review findings in the field of transcriptional regulation to illustrate how the high variability of the BTB (...) has allowed related transcription factors to evolve different functional abilities. We then report how recent work has showed that, in spite of their high sequence divergence and apparently unrelated functions, many BTB‐containing proteins have at least one shared role: the recruitment of degradation targets to E3 ubiquitin ligase complexes. In Corneille’s Horace the hero is brought to trial for having defended Rome’s integrity by killing his own sister. The fifth act of the play is devoted to this trial, but should also be read like an allegorical re-enactment of the Querelle du Cid, during which Corneille himself was put to a kind of a ”trial’’ by colleagues and critics scandalized by the moral and ideological audacity of this first play dedicated to a criminal hero. This paper reinforces the current consensus against the applicability of the selected effect theory of function in ecology. It does so by presenting an argument which, in contrast with the usual argument invoked in support of this consensus, is not based on claims about whether ecosystems are customary units of natural selection. Instead, the argument developed here is based on observations about the use of the function concept in functional ecology, and more specifically, research into the relationship between biodiversity and (...) ecosystem functioning. It is argued that a selected effect account of ecological functions is made implausible by the fact that it would conflict with important aspects of the understanding of function and ecosystem functional organization which underpins functional ecology’s research program. Specifically, it would conflict with (1) Functional ecology’s adoption of a context-based understanding of function and its aim to study the functional equivalence between phylogenetically-divergent organisms; (2) Functional ecology’s attribution to ecosystems of a lower degree of part-whole integration than the one found in paradigm individual organisms; and (3) Functional ecology’s adoption of a physiological or metabolic perspective on ecosystems rather than an evolutionary one. This study shows how institutional work contributes to institutional resilience in extreme operating environments. The authors draw from a longitudinal analysis of the operations of Desjardins International Development, a French Canadian nongovernmental organization that, both before and after the major earthquake of 2010, supported the implementation of cooperative banking in Haiti. Building on a unique access to DID’s internal documents as well as on 49 interviews with DID employees, the authors highlight the ways in which political, technical, and cultural forms (...) of institutional work triggered the emergence of social capital, which in turn supported the rise of new forms of institutional work that enabled institutional resilience. The results show how organizational activities focused on shaping institutions may have unintended effects that enable institutional resilience in EOEs, and demonstrate how the accumulation of institutional work by an organization contributes to the enhancement of its social capital. Ethical concerns are motivating the search for alternative methods to obtain pluripotent stem cells without destroying human embryos. The supporters of these methods stress the importance of ensuring that the biological entities used in these alternative methods are not “disabled or sick human embryos.” In this article the authors argue that biological entities bearing anomalies or alterations that directly inhibit the appearance of neural activity (DIANA anomalies) share the moral status of human organisms fulfilling the clinical criteria for brain death. This paper criticizes Jerome Wakefield’s harmful dysfunction analysis of disorder by arguing that the conceptual linkage it establishes between the medical concepts of health and disorder and the prudential notions of well-being and harm makes the account inapplicable to nonsentient organisms, such as plants, fungi, and many invertebrate animals. Drawing on a previous formulation of this criticism by Christopher Boorse, and noting that Wakefield could avoid it if he adopted a partly biofunction-based account of interests like that often advocated in (...) the field of environmental ethics, I argue that integrating such an account of interests into the HDA would generate serious concerns. Specifically, it would make dysfunction sufficient for disorder and so reestablish between dysfunction and disorder precisely the kind of sufficiency relation that harm-requiring accounts of disorder strive to avoid; blur the line between the HDA’s dysfunction and harm components and, in so doing, deprive the HDA of its alleged main advantage over monistic dysfunction-based accounts of disorders like Boorse’s; and tie the HDA to an understanding of harm that is in itself problematic. I argue that these three concerns, and the dilemmas they generate, rob the HDA of much of its prima facie appeal, ultimately indicating that a satisfactory account of disorder should most likely eschew all references to prudential notions of well-being and harm.
