This article has the scope to analyze the influences left by Hans Kelsen and his Teoria Pura do Direito for legal hermeneutic sand the uncertainties still present in his classic book on the interpretive process. Positivism kelseniano, recognized by the separation between law and morality, not omitted as to the reality of legal interpretation, and, without disregarding their theoretical bases, left guidelines for the consolidation of a theory of interpretation. Kelsen developed the concept of legal frame as a limit to (...) the authentic interpreter of the rule whose subjectivity influence the interpretative process,but also saw interpretations outside this frame. The cognitive reserve is widely accepted as the active ability to cope with brain damage, using preexisting cognitive and compensatory processes. The common CR proxies used are the number of formal years of education, intelligence quotient or premorbid functioning, occupation attainment, and participation in leisure activities. More recently, it has employed the level of literacy and engagement in high-level cognitive demand of professional activities. This study aims to identify and summarize published methodologies to assess the CR quantitatively. We searched for (...) published studies on PubMed, ScienceDirect, and Web of Science between September 2018 and September 2021. We only included those studies that characterized the CR assessment methodology. The search strategy identified 1,285 publications, of which 25 were included. Most of the instruments targeted proxies individually. The lack of a gold standard tool that incorporates all proxies and cognitive tests highlights the need to develop a more holistic battery for the quantitative assessment of CR. Further studies should focus on a quantitative methodology that includes all these proxies supported by normative data to improve the use of CR as a valid measure in clinical contexts. (shrink)

Over the last two decades, corporate sustainability has been established as a legitimate research topic among management and organization scholars. This introductory article explores potential avenues for advances in research on corporate sustainability by readdressing some of the fundamental aspects of the sustainability debate and approaching some novel perspectives and insights from outside the corporate sustainability field. This essay also sketches out how each of the six articles of this special issue contribute to the literature by going back to some (...) of the conceptual roots of sustainability and/or by offering novel perspectives for research on corporate sustainability. As these six articles and the outlook on future research opportunities show, broadening the inquiry of corporate sustainability in terms of topics, theories, and methodologies holds considerable potential to improve our understanding of how decision makers and organizations respond to sustainability. This paper examines the influence of internal barriers on the relationship between the organizational capability of stakeholder integration and proactive environmental strategies. We adopt a moderate hierarchical regression model to test the hypotheses using data from a sample of 73 managers in the business education industry. The paper contributes to stakeholder theory by showing that stakeholder integration positively influences the development of proactive environmental strategies when managers perceive internal barriers to the development of such strategies. This thesis describes two classes of Dialectica categories. Chapter one introduces dialectica categories based on Goedel's Dialectica interpretation and shows that they constitute a model of Girard's Intuitionistic Linear Logic. Chapter two shows that, with extra assumptions, we can provide a comonad that interprets Girard's !-course modality. As religiosidades de matriz africana tem um importante papel na condução das práticas de saúde de seus devotos a partir de uma visão integral do corpo da pessoa que considera o ser humano em suas diferentes esferas, a espiritual, a social, a mental e a biológica. No candomblé, a cabeça, denominada de _Orí_, é entendida como a sede da individualidade do sujeito, possui um conteúdo espiritual, tem _status_ de divindade, e guia os filhos e filhas de santo em sua jornada (...) no Ayê. Se enfraquecida, ela pode trazer enfermidades, o que exige uma série de procedimentos rituais para o fortalecimento de _Orí_, como o _bori_, que se traduz no ritual de dar comida e bebida à cabeça, essencial para o restabelecimento da saúde espiritual ou física. A partir desse contexto, a pesquisa buscou compreender a importância de _Orí_ para o processo saúde-doença de pessoas filiadas ao candomblé, entrevistando sujeitos de diferentes terreiros. Os resultados apontam para a capacidade de _Orí_ em fortalecer o caráter das pessoas, seus valores e atitudes positivas diante da vida, como sendo fundamental para se fazer boas escolhas em prol da saúde, e evitar as enfermidades. Ter uma cabeça boa é ter uma saúde boa. (shrink)

Este artigo investiga as posições do liberalismo político de John Rawls e do republicanismo de Hannah Arendt em relação ao humanismo cívico e ao republicanismo clássico. Defende que o republicanismo de Arendt não deve ser considerado um humanismo cívico abrangente e que há uma proximidade entre o liberalismo político e o republicanismo clássico, pois sustenta que um perfeccionismo minimalista baseado em virtudes políticas informa as duas teorias.

Este artigo analisa e compara os modos como Joseph Chan e Jonathan Quong relacionam liberalismo e perfeccionismo, mostrando que nenhum deles consegue formular adequadamente uma das possibilidades dessa relação, o perfeccionismo político. Inicialmente, será mostrado que aquilo que Chan apresenta e defende é um perfeccionismo liberal abrangente e intuicionista, que ele classifica adequadamente como moderado, mas nomeia equivocadamente como político. Em seguida, a análise constata que Quong consegue apontar a possibilidade formal do perfeccionismo político, mas de modo inconsistente, na medida (...) em que recua repetidamente para uma posição em que ele se confunde com um perfeccionismo abrangente. Como conclusão, busca mostrar que o perfeccionismo político ainda precisa ser adequadamente formulado como uma possibilidade concreta e promissora para as democracias liberais. (shrink)

In this article, we will discuss Civil Disobedience as a tool for non-violent protests. We will analyze the ideas from Thoreau to Kant, including the thoughts of Gandhi and Dworkin, verifying the effectiveness, or lack thereof, of their arguments in the political world. With regard to Dworkin and Gandhi, both inspired by Thoreau's thought, civil disobedience to norms provided a change in the political scenario, capable of effecting a mediation of conflicts through non-violence. Kant's perspective, in turn, presents the hypothesis (...) of peaceful resistance when the norms do not correspond to the proposed expectations, the general rule being the idea of respect and obedience to the law. Finally, to conclude this article, we will highlight the writings of Thoreau, Gandhi, Dworkin, and Kant, to postulate that civil disobedience must be linked to the criteria of non-violence, peace, justice, and legitimacy. Desinformação enquanto um fenômeno social criou uma nova desordem global, onde as novas condições de produção, circulação e consumo de informação fizeram das notícias falsas um importante instrumento geoestratégico que, associado às técnicas híbridas, coloca as ações das mídias comunicacionais em sintonia na geração de notícias falsas. Analisamos a maneira como os meios de comunicação disseminam informações tomando como base cinco filtros indicados por Chomsky e Herman (2003): Filtro 1: Importância, propriedade e orientação dos benefícios dos meios de comunicação; Filtro (...) 2: A publicidade como principal fonte de renda; Filtro 3: O fornecimento de notícias para a mídia; Filtro 4: As medidas corretivas como método para disciplinar a mídia; Filtro 5: Anticomunismo como mecanismo de controle. A análise realizada demonstra que, além de notícias falsas, as notícias reais são manipuladas e orientadas para polarizar ideologicamente, requerendo uma adaptação da sociedade na construção de marcos regulatórios, ao passo que as empresas (desenvolvedoras das redes sociais, por exemplo) e seus logaritmos não conseguem contrariar as redes globais da desinformação que atravessam países, continentes e línguas. La investigación realizada consistió en un estudio llevado a cabo en la población de las Regiones de Bío Bío y Valparaíso, con intención de conocer la actitud que tienen frente a la donación de órganos. En Chile la tasa de donaciones en muy baja, y nos gustaría conocer la motivación que lleva ante la negativa a donar los órganos, o tratar de conocer cuáles son las circunstancias que llevan a que Chile se encuentre con esta baja tasa de donantes de (...) órganos. Los resultados obtenidos, mostraron que ambas regiones tienen una actitud positiva ante la donación de órganos, pero ésta baja cuando se pide donar sus propios órganos, y baja aún más, cuando se les pide donar los órganos de sus familiares. En este estudio analizamos variables sociopersonales, variables de interacción social, creencias religiosas, etc. Consideramos que este estudio es de gran relevancia para la sociedad, puesto que es una forma de conocer la opinión de la población, y pueda realizarse una implementación donde sea posible, con la finalidad de incrementar la tasa de donantes y con ello, aumentar la tasa de trasplantes realizados, de tal forma que estaríamos regalando vida a más personas. O conceito de espiritualidade laica pode permitir um espaço na educação escolar para tratar de questões que, por serem públicas e de foro privado, envolvem a vida cotidiana nas mais diversas facetas, incluindo a política, as relações sociais e culturais, por isso precisam ser convenientemente tratadas. Ensaiar, pois, uma abordagem educacional dessa relação é importante em nosso momento histórico no qual a vida social e política são assaltadas por certa religiosidade ou crença. A partir da leitura de um historiador e (...) três filósofos, o texto procura definir uma espiritualidade não apenas laica, mas que possibilite o diálogo entre o laico, o ateísta, o agnóstico, o religioso etc. Para tanto, aposta-se na filosofia e procura encontrar pistas para a ação pedagógica. Conflui o conceito para a existência de determinações históricas, culturais e existenciais e destaca apontamentos para a educação nos quais se admite uma pluralidade de espiritualidades. What is spirituality and how we can approach it in the school environment Abstract: The concept of secular spirituality can allow a space in school education to deal with issues that, being public or private, involve daily life in the most diverse facets, including politics, social and cultural relations, and therefore need to be conveniently dealt with. Rehearsing, therefore, an educational approach to this relationship is important in our historical moment in which social and political life is assaulted by a certain religiosity or belief. Based on the reading of one historian and three philosophers, the text seeks to define a spirituality that is not only secular, but one that enables dialogue between the secular, the atheistic, the agnostic, the religious, etc. To this end, it relies on philosophy and tries to find clues for pedagogical action. It makes the concept converge to the existence of historical, cultural, and existential determinations, and highlights notes for education in which a plurality of spiritualities is admitted. Qué es la espiritualidad y cómo podemos abordarla en el ámbito escolar Resumen: El concepto de espiritualidad laica puede permitir un espacio en la educación escolar para abordar temas que, siendo públicos y privados, involucran la vida cotidiana en las más diversas facetas, incluyendo la política, las relaciones sociales y culturales, por lo que requieren ser tratados convenientemente. Ensayar, por lo tanto, una aproximación educativa a esta relación es importante en nuestro momento histórico en el que la vida social y política se ve asaltada por una determinada religiosidad o creencia. A partir de la lectura de un historiador y tres filósofos, el texto busca definir una espiritualidad que no solo sea laica, sino que posibilite el diálogo entre lo laico, lo ateo, lo agnóstico, lo religioso, etc. Para eso, apuesta por la filosofía y busca encontrar pistas para la acción pedagógica. We are developing the Neurological Disease Ontology (ND) to provide a framework to enable representation of aspects of neurological diseases that are relevant to their treatment and study. ND is a representational tool that addresses the need for unambiguous annotation, storage, and retrieval of data associated with the treatment and study of neurological diseases. ND is being developed in compliance with the Open Biomedical Ontology Foundry principles and builds upon the paradigm established by the Ontology for General Medical Science (OGMS) (...) for the representation of entities in the domain of disease and medical practice. Initial applications of ND will include the annotation and analysis of large data sets and patient records for Alzheimer’s disease, multiple sclerosis, and stroke. (shrink)

Automated classification of legal documents has been the subject of extensive research in recent years. However, this is still a challenging task for long documents, since it is difficult for a model to identify the most relevant information for classification. In this paper, we propose a two-stage supervised learning approach for the classification of petitions, a type of legal document that requests a court order. The proposed approach is based on a word-level encoder–decoder Seq2Seq deep neural network, such as a (...) Bidirectional Long Short-Term Memory (BiLSTM) or a Bidirectional Encoder Representations from Transformers (BERT) model, and a document-level Support Vector Machine classifier. To address the challenges posed by the lengthy legal documents, the approach introduces a human-in-the-loop approach, whose task is to localize and tag relevant segments of text in the word-level training part, which dramatically reduces the dimension of the document classifier input vector. We performed experiments to validate our approach using a real-world dataset comprised of 270 intermediate petitions, which were carefully annotated by specialists from the 15th civil unit of the State of Alagoas, Brazil. Our results revealed that both BiLSTM and BERT-Convolutional Neural Networks variants achieved an accuracy of up to 95.49%, and also outperformed baseline classifiers based on the Term Frequency–Inverse Document Frequency test vectorizer. The proposed approach is currently being utilized to automate the aforementioned justice unit, thereby increasing its efficiency in handling repetitive tasks. (shrink)

Research shows that commitment-based interventions are among the most effective strategies to encourage pro-environmental behaviors, but methods to elicit commitments from a large number of individuals are often costly and unrealistic. Predictions requests—a commitment-type strategy—are an effective mass-communication strategy and have the potential to influence pro-environmental behavior among large audiences. This research is the first to demonstrate that prediction requests in a consumer behavior context influence preference for environmentally friendly products. In addition, this research examines the role of individual and (...) contextual factors in influencing the efficacy of prediction requests. Study 1 shows that exposure to an advertisement with a prediction request leads to increased preferences for environmentally sustainable household cleaning products, compared to a control advertisement, and that this effect is greater when the prediction request is paired with an audience cue . Study 2 indicates that the effect of prediction requests on preference for sustainable products is greater for individuals with interdependent self-construal. Substantive implications and directions for future research are discussed. (shrink)

Although several articles have investigated ethical product attributes, earlier research has not empirically examined different benefits offered by ethical attributes. This study demonstrates that ethical attributes have functional benefits as well as symbolic benefits. More importantly, when the ethical attribute benefit is congruent with the product category benefit, ethical attributes improve product evaluations. In addition, products with a higher degree of physical contact with consumers are affected more positively by benefit congruity of ethical attributes. For products with lower degree of (...) physical contact, benefit congruity of ethical attributes still has a positive impact, but not for consumers who have strong price–quality beliefs. (shrink)

We consider the complex interactions between rape culture and epistemology. A central case study is the consideration of a deferential attitude about the epistemology of sexual assault testimony. According to the deferential attitude, individuals and institutions should decline to act on allegations of sexual assault unless and until they are proven in a formal setting, i.e., a criminal court. We attack this deference from several angles, including the pervasiveness of rape culture in the criminal justice system, the epistemology of testimony (...) and norms connecting knowledge and action, the harms of tacit idealizations away from important contextual factors, and a contextualist semantics for 'knows' ascriptions. Niche construction theory highlights the active role of organisms in modifying their environment. A subset of these modifications is the developmental niche, which concerns ecological, epistemic, social and symbolic legacies inherited by organisms as resources that scaffold their developmental processes. Since in this theory development is a situated process that takes place in a culturally structured environment, we may reasonably ask if implicit cultural biases may, in some cases, be responsible for maladaptive developmental niches. In this paper we wish to (...) argue for an affirmative answer. In order to do so, we first propose to conceptualize implicit bias as embodied perceptual habits, and then proceed to show that these habits are at least partially responsible for maladaptive developmental niches of children with Down syndrome and autism. With this framework we thus hope to bring together two fields of research that haven’t been explicitly connected: implicit bias and niche construction theory. Linking these two theories may bring benefits both to implicit bias researchers, who can extend this concept to characterize other sets of processes as biased, as well as to niche construction theorists, who will have a useful theoretical tool to diagnose maladaptive features of niches brought about by sociocultural biases. The digital revolution has widened the array of curriculum materials available to history teachers. Given the variable quality of these new materials and the deeply contextual nature of teaching, educators need better tools for selecting among the vast options available. This study aimed to validate a device designed for that purpose, called the Curriculum Materials Evaluation Tool (CMET). Using a questionnaire and think-aloud interview, the study examined how four social studies teachers evaluated a novel material set for potential classroom use, (...) and how the CMET mediated their analysis. Findings showed that the teachers preferred when materials are readily accessible and adaptable for their specific teaching context, in contrast to “one-size-fits-all” resources that dominate the Web. The CMET appeared to foster a deeper and broader analysis of the given material set, especially regarding its political and cultural orientation. The study suggests that teachers’ role in vetting and adapting digital materials be recognized and embraced. The CMET can contribute to that end through its use in district adoption committees, teacher professional development, and collaborative curriculum research. (shrink)

Diagnosing Challenging Oppositional Disorder on children and young people is approached by health as a disorder that has a compilation of features that can even make the disorder easily camouflaged or confused with others, such as Attention Deficit Hyperactivity Disorder or Disorder. In addition to the discussions of a TOD’s clinical perception, it’s necessary to deconstruct some norms and look at this difference, through another perception in which it allows us to reflect TOD from a philosophical social perspective.This research sought (...) to reflect on characteristics present in the Disorder and problematize them according to the theory proposed by Michael Foucault about governmentality, this being a concept that basically expresses a manifestation of power in which conducts the conduct of the persons. As a result, the research points out that it is essential to analyze and monitor the behavior of children with suspicion of COD in different contexts, not supporting them only in medical characteristics. Relating to the concepts of the difference’s philosophy, can see children’s attitudes, seen by society as a diversion of behaviors, as manifestations of reverse-behaviors or even, resistance stemming from a normalizing society in the various institutions scattered by social knitting: at school, or family, which are the two most cited in this article. Opportunistic behaviors are considered ethically and strategically troublesome since they disrupt otherwise mutually beneficial relationships. Previous literature has shown that firms attempt to protect their investments from opportunism by generating a large amount of patented marginal innovations in domains central to their industry. However, this approach may generate some ethical dilemmas by preventing firms and societies from more radical, collaborative, and much-needed environmental progress. We extend the environmental innovation literature using strategic and ethical lenses to analyze the potential of an (...) alternative, divergent way to provide financial opportunities for a focal firm without aiming to prevent innovative opportunities for competitors. Our longitudinal analysis of 6768 environmental patents from 59 large companies worldwide in the electrical components and equipment industry shows that high levels of innovation intensity, environmental scope, bargaining power, and environmental expertise increase the incidence of patented environmental innovations related to domains in which industry competitors are less focused (i.e., technological divergence). We also show a positive relationship between this divergence and market-based firm performance. Our results suggest that pursuing innovative divergence to avoid opportunism may make ethical and market sense and we also identify the organizational factors that can support these efforts. This study aimed to synthesize literature data on male judo combat time in international competitions between 2010 and 2019. The search was carried out from May 8th to June 11th, 2021, in electronic databases using the following keywords: AND. After the selection process, 8 articles were included in the systematic review and 7 in the meta-analysis. These studies analyzed 2,562 international male judo combats over the years 2010 to 2019. We observed that the average male judo combat time changed after (...) each rule change. There was a significant difference between combats that ended up to the regular time and those that needed overtime. There were differences between 60kg and +100kg categories and the others in 2011-2012. However, no significant difference was found between the combat time by weight division after the 2017 rule changes, although there are still differences in relation to the end of the combats. There were significant changes in the male judo combat time with each rule change, and the data from the included studies point to a trend of homogeneity in the combat time spent between the weight divisions over the years, and an increase in the occurrence of Golden Score. More studies need to be carried out to identify the new temporal behaviors of athletes. (shrink)

Background In August 2017, Chile lifted its complete ban on abortion by permitting abortion in three limited circumstances: 1) to save a woman’s life, 2) lethal fetal anomaly, and 3) rape. The new law allows regulated use of conscientious objection in abortion care, including allowing institutions to register as objectors. This study assesses medical and midwifery students’ support for CO, following legal reform. Methods From October 2017 to May 2018, we surveyed medical and midwifery students from seven universities located in (...) Santiago, Chile. Universities included 4 secular and 3 private religiously-affiliated universities; all offering medical degrees with a specialization in obstetrics and gynecology and five offering midwifery degrees. We used generalized estimating equations to identify characteristics associated with student support for CO, intentions to use CO to refuse to care for someone seeking abortion, and support for CO at the institutional level. Results 333 of the 413 eligible students who opened the survey, completed the questions on conscientious objection; 26% were seeking medical degrees with an ob-gyn specialty, 25% were seeking midwifery degrees, and 49% were seeking medical degrees and had not yet decided their specialty. While nearly all endorse requirements for conscientious objecting clinicians to inform and refer abortion-seeking patients, a minority would personally use conscientious objection to avoid caring for a patient seeking abortion. About half of religious-university students and one-fifth of secular-university students support objections at the institutional level. Conclusions Most students support the regulated use of CO which preserves patients’ access to abortion care. Religious-university student views on the use of conscientious objection in abortion care are discordant with those of their institutions which currently support institutional-level objections. Isaac de Pinto was an active financier, economist and homme de lettres. Descending from a Jewish family of Portuguese origin, he lived in Amsterdam, Paris and London. Throughout his life, he enjoyed close relationships and made regular contact with important figures of the European Enlightenment.
