This paper describes a tool for assisting lawyers and paralegal teams during document review in eDiscovery. The tool combines a machine learning technology (CategoriX) and advanced multi-touch interface capable of not only addressing the usual cost, time and accuracy issues in document review, but also of facilitating the work of the review teams by capitalizing on the intelligence of the reviewers and enabling collaborative work.

Wilfrid Sellars [1962: 1] described philosophy as an attempt to ‘understand how things in the broadest possible sense of the term hang together in the broadest possible sense of the term’. But it is distinctive of philosophy that many of us are interested not only in how the world is but in ways that it could be. That is, philosophy is concerned with facts about modality. Some of the most important arguments in philosophy hinge on modal premises, and philosophers have (...) typically assumed special expertise in evaluating these modal premises. Replicating Goldvarg and Johnson-Laird’s [2000] study of modal illusions, we show that training in mathematics and not philosophy predicts success in overcoming such illusions (n = 395). This study is the first to test the modal expertise of professional philosophers directly. Our findings undermine claims to modal expertise. Philosophical training does not inoculate expert philosophers against basic mistakes in modal judgment. (shrink)

We address how listeners perceive temporal regularity in music performances, which are rich in temporal irregularities. A computational model is described in which a small system of internal self‐sustained oscillations, operating at different periods with specific phase and period relations, entrains to the rhythms of music performances. Based on temporal expectancies embodied by the oscillations, the model predicts the categorization of temporally changing event intervals into discrete metrical categories, as well as the perceptual salience of deviations from these categories. The (...) model's predictions are tested in two experiments using piano performances of the same music with different phrase structure interpretations (Experiment 1) or different melodic interpretations (Experiment 2). The model successfully tracked temporal regularity amidst the temporal fluctuations found in the performances. The model's sensitivity to performed deviations from its temporal expectations compared favorably with the performers' structural (phrasal and melodic) intentions. Furthermore, the model tracked normal performances (with increased temporal variability) better than performances in which temporal fluctuations associated with individual voices were removed (with decreased variability). The small, systematic temporal irregularities characteristic of human performances (chord asynchronies) improved tracking, but randomly generated temporal irregularities did not. These findings suggest that perception of temporal regularity in complex musical sequences is based on temporal expectancies that adapt in response to temporally fluctuating input. (shrink)

A growing body of research reveals that abusive supervision may have negative impacts in organizations. The purpose of the present study is to expand the knowledge regarding the impacts of this dysfunctional leadership behavior by examining its relationship with innovation in work teams. Specifically, we investigate the process through which abusive supervision may undermine team innovation by taking into account the mediating role of team proactive behavior. Moreover, we propose a boundary condition of the negative effect of abusive supervision by (...) considering leader–members interdependence as a moderator. Using a multisource approach, data were gathered from 394 members and 82 immediate supervisors in a public safety organization. Results of path analyses reveal that the relationship between abusive supervision and team innovation is mediated by team proactive behavior. Furthermore, we found that the relationship between abusive supervision and team proactive behavior is moderated by leader–members interdependence, such that this relationship is stronger when the level of interdependence is high. Taken together, the findings of this study improve the understanding of why and under what circumstances abusive supervision may impair team innovation. (shrink)

Some theories of personal identity allow some variation in what it takes for a person to survive from context to context; and sometimes this is determined by the desires of person-stages or the practices of communities.This leads to problems for decision making in contexts where what is chosen will affect personal identity.‘Temporal Phase Pluralism’ solves such problems by allowing that there can be a plurality of persons constituted by a sequence of person stages. As more young people feel safe to outwardly identify as transgender or gender expansive (TGE), meaning that their gender identity does not align with the sex they were assigned at birth, an increasing number of youth who identify as TGE seek gender-affirming medical care (GAMC). GAMC raises a number of ethical questions, such as the capacity of a minor to assent or consent, the role of parents or legal guardians in decisions about treatment, and implications for equitable access to care (...) when differing parental or custodial viewpoints are present. These questions are further complicated by the difficulties in explaining the limits of long-term research in GAMC, with regard to the preservation of fertility, for example. We present two de-identified composite case studies to highlight dilemmas that may arise and offer recommendations to better support patient- and family-centered decision making for GAMC. These include employing a multidisciplinUniverary shared decision-making approach, disentangling informed consent and assent from chronological age, developing a consistent approach to the assessment of decisional capacity, and developing age-appropriate informational materials. Background Discussions on ethical aspects of life-and-death decisions within the hospital are often made in plenary. The prehospital physician, however, may be faced with ethical dilemmas in life-and-death decisions when time-critical decisions to initiate or refrain from resuscitative efforts need to be taken without the possibility to discuss matters with colleagues. Little is known whether these considerations regarding ethical issues in crucial life-and-death decisions are documented prehospitally. This is a review of the ethical considerations documented in the prehospital medical records (...) of patients in a Danish prehospital setting for whom the decision to resuscitate or not was made at the scene. Methods The study is based on discharge summaries of all patients subjected to crucial life-and-death decisions by the Mobile Emergency Care Unit in Odense in the years 2010 to 2014. The medical records with possible documentation of ethical issues were independently reviewed by two philosophers in order to identify explicit ethical or philosophical considerations pertaining to the decision to resuscitate or not. Results In total, 1275 patients were either declared dead at the scene without exhibiting layman’s reliable signs of death or admitted to hospital following resuscitation. In a total of 62 patients, 85 specific ethical issues related to resuscitation were documented. The expressions of the ethical considerations were generally vague or unclear and almost exclusively concerned the interests of the patient and not the relatives. In the vast majority of cases where an ethical content was identified, the ethical considerations led to a decision to terminate treatment. Conclusions A strengthened practice of documenting ethical considerations in prehospital life-and-death decision-making in the patient’s medical records is required. We suggest that a template be implemented in the prehospital medical records describing the basis for any ethical decisions. This template should contain information regarding the persons involved in the deliberations and notes on ethical considerations. The documentation should include considerations concerning the patient’s end-of-life wishes, the estimations of the quality of life before and after the incident, and a summary of other ethical concerns taken into account, such as the integrity of the patient and frame of mind of relatives. This article offers a descriptive and analytic view of the different stages leading to the constitution of a corpus that is representative of the issues of climate and energy justice. Overall, the corpus contains over five million words and gathers reports, newsletters and web-pages dealing with the most equitable ways of moving to a low-carbon future in the aim of limiting climate change. It can be divided into six sub-corpora, according to types of discourse communities, and methods of constitution. We (...) begin by presenting the small Do It Yourself (DIY) corpora which were used as a starting point. Three discourse communities were selected to observe possible variation in their treatment of the issue: Non-Governmental Organisations (NGOs), United-Nation institutions, and the Renewable Energy Sector (RES). The sources are selected according to author, date, keywords in title. Using the concordance Antconc and WMatrix software we test the reliability of the corpora for their thematic content, terminology and lexical unit classification. Our first results enable us to confirm variation between the discourse communities. The discrepancy in sizes and the time-consuming nature of the initial DIY corpus constitution lead us to use BootCat to extend them, using keywords from the corpora as seeds to retrieve and download webpages. We thus contrast a more traditional approach to corpus building to web-as-corpus data gathering methods. We compare the results found in the BootCat corpora to test if they are as specific as those in the DIY corpora. This enables us to draw conclusions on the possible uses and advantages of relatively small corpora for the study of specialised discourse. (shrink)

Caroline Franks Davis provides a clear, sensitive, and carefully argued assessment of the value of religious experiences as evidence for religious beliefs. Much more than an 'argument from religious experience', the inquiry systematically addresses underlying philosophical issues such as the role of interpretation in experience, the function of models and metaphors in religious language, and the way perceptual experiences in general are used as evidence for claims about the world. The author examines several arguments from religious experience and, using (...) contemporary and classic sources from the world religions, gives an account of the different types of experience. To meet sceptical challenges to religious experience, she draws extenisvely on psychological and sociological as well as philosophical and religious literature, probing deeply into the questions whether religious experiences are merely a matter of interpretation, whether there is irreducible conflict among religious experiences, and whether psychological and other reductionist explanations of religious experience are satisfactory. She concludes that religious experiences, like most experiences, are most effective as evidence within a cumulative style of argument which combines evidence from a wide range of sources. (shrink)

En janvier 1783, deux musiciennes, Bianca Sacchetti et Andrianna Ferrarese, s’enfuirent de l’ospedale des Mendicanti, à Venise, pour tenter leur chance sur les scènes de théâtre. Formées dans l’une des quatre institutions vénitiennes destinées à recueillir les orphelins de Venise, elles étaient devenues des musiciennes hors pair, chantaient chaque jour dans la chapelle de l’ospedale et jouaient de plusieurs instruments. Le dossier consacré à leur fugue, qui se trouve toujours à l’Archivio di Stato de Venise, nous donne les circonstances et (...) les raisons de leur fugue, mais fournit également des informations précieuses et uniques sur les aspirations des « filles du choeur » à une vie meilleure. Des documents inédits illustrent les relations d’amitié qui pouvaient exister entre deux jeunes femmes recueillies par charité et suffisamment talentueuses pour avoir réussi à devenir deux des meilleures musiciennes de Venise. Retrouvées par les autorités, elles poursuivirent d’ailleurs une brillante carrière, l’une à l’opéra, l’autre au sein de l’ospedale, la Ferrarese créant même l’un des rôles du Così fan tutte de Mozart. We address the problem of musical variation (identification of different musical sequences as variations) and its implications for mental representations of music. According to reductionist theories, listeners judge the structural importance of musical events while forming mental representations. These judgments may result from the production of reduced memory representations that retain only the musical gist. In a study of improvised music performance, pianists produced variations on melodies. Analyses of the musical events retained across variations provided support for the reductionist account (...) of structural importance. A neural network trained to produce reduced memory representations for the same melodies represented structurally important events more efficiently than others. Agreement among the musicians' improvisations, the network model, and music‐theoretic predictions suggest that perceived constancy across musical variation is a natural result of a reductionist mechanism for producing memory representations. The mechanical properties of vertebrate cells are largely defined by the system of intermediate filaments (IF). As part of a dense network, IF polymers are constantly rearranged and relocalized in the cell to fulfill their duty as cells change shape, migrate, or divide. With the development of new imaging technologies, such as photoconvertible proteins and super‐resolution microscopy, a new appreciation for the complexity of IF dynamics has emerged. This review highlights new findings about the transport of IF, the remodeling of (...) filaments by a process of severing and re‐annealing, and the subunit exchange that occurs between filament precursors and a soluble pool of IF. We will also discuss the unique dynamic features of the keratin IF network. Finally, we will speculate about how the dynamic properties of IF are related to their functions. (shrink)

Humans can follow different social learning strategies, sometimes oriented toward the models’ characteristics. The goal of the present study was to explore which who-strategy is preferentially followed in the technological context based on the models’ psychological characteristics. We identified three potential who-strategies: Copy the pedagogue, copy the engineer, and copy the friend. We developed a closed-group micro-society paradigm in which participants had to build the highest possible towers. Participants began with an individual building phase. Then, they were gathered to discuss (...) the best solutions to increase tower height. After this discussion phase, they had to make a new building attempt, followed by another discussion phase, and so forth for a total of six building phases and five discussion rounds. This methodology allowed us to create an attraction score for each participant. We also assessed participants’ theory-of-mind skills, technical-reasoning skills, and prosocialness to predict participants’ attraction scores based on these measures. Results show that we learn from engineers because they are the most successful. Their attraction power is not immediate, but after they have been identified as attractors, their technique is copied irrespective of their pedagogy or friendliness. These findings open avenues for the study of the cognitive bases of human technological culture. (shrink)

The project scrutinizes the prevalent themes associated with paradisiacal imagery, dissecting the intricate weave of religious doctrines, mythologies, and the intrinsic nature of paradise – be it a tangible realm or a metaphysical state. This inquiry critically assesses the role of AI-generated art, derived from complex algebraic formulations, in mirroring conventional (...) iconography and exposing inherent biases. Such revelations underscore the cultural resonance of diverse traditions and the potential presence of subconscious prejudices. Employing AI algorithms capable of transforming textual prompts into vivid illustrations, this research unveils insights into the nexus of AI and cultural portrayals of utopia, thereby provoking profound philosophical deliberations. Central to these contemplations is the extent of human dominion over conceptualized ideals and the prospect of AI-crafted art inadvertently molding our paradisiacal perceptions, with implications ranging from reinforcement of stereotypes to shaping intrinsic cognitive schemas. Epigenetics reveals the biological mechanisms underlying the reproduction and even the transmission of social inequalities in health. It also emphasizes the complexity of factors involved in the development of some diseases. This complexity raises new difficulties for theories of justice. Is the equal opportunities theory the most appropriate to solve these difficulties? I demonstrate that epigenetics requires a multifactor model of justice—one that is grounded on principles of fairness, impartiality, and environmental and intergenerational justice. In this paper anorexia nervosa is examined through three lenses to determine its possible causes. This paper contains a clinical analysis of the anorexic personality, a psychoanalytic/religious interpretation of the demands of society, and· a feminist reinterpretationof the effects of those demands on the female body. The societal demands to renounce instincts, when examined through a feminist lens, reveals that these demands, in concert with the detrimental effects of feminine socialization and characteristics of the anorexic personality, may lead some women (...) to view their needs as not important, and cause a detachment from and turning against the body in the form of anorexia nervosa. It is concluded that anorexia is not just women taking a diet “too far.” There are other psychological, philosophical, and social factors leading to a prevalence of anorexia nervosa in Western culture. Elle prend pour angle d’approche les relations conflictuelles entre ces grandes déesses pour mieux saisir leurs rapports respectifs au jeu : où et quand jouent-elles? À quoi et avec qui jouent-elles? Quelles sont les informations que l’on peut en tirer pour les femmes et jeunes filles humaines? Diverses problématiques sont abordées à la lumière des études de genre : celles des rapports intergénérationnels et interfamiliaux, de la définition des espaces privé-public, de la séduction et de l’érotisme. Background In this qualitative analysis we aimed to explore addiction physicians’ perspectives on safer injection education for people who inject drugs, especially: (1) on possible means of introducing safer injection education in the medical environment, (2) on the compatibility of safer injection education with each physician’s core values and goals, and (3) on possible reasons for the ethical dilemma in safer injection education. Methods We conducted semi-structured interviews with eleven physicians practicing addiction medicine in France in clinical and harm reduction (...) settings. Results All participants were in favor of educational interventions for people who inject drugs. Nonetheless, these interventions varied from simple advice to injection supervision and they were seen as less acceptable when they concerned the practical and material aspects of injection. Some participants found that physicians practicing in clinical settings, where patients consult mostly to stop their drug use, should not practice safer injection education. On the contrary, other participants claimed that safer injection education was essential in all settings and was not a choice but rather a duty for addiction physicians. The ethical dilemma of such intervention when delivered by medical staff was viewed as a complex phenomenon, related to the representations of intravenous drug use and to societal expectations from physicians. Conclusion Physicians’ views on safer injection education for people who inject drugs reveal an emotionally charged subject related to the structural organization of addiction management in France. Liberals agree that free speech should be protected, where speech is understood broadly to include all forms of intentional communication, including actions and pictures, not merely the spoken or written word. A surprising view about free speech in some liberal and legal circles is that communications should be protected on free-speech grounds only if the communications are mentally mediated. By “mentally mediated communication” we mean speech which communicates its message in such a way that the message can be rationally evaluated (...) by hearers, and causes the hearers to believe it, when it does, through the mechanism of those hearers employing their rational capacity to judge that it is correct. The mental-mediation or persuasion principle, as it is sometimes called, has some important legal and public policy implications. It has been applied to argue that certain forms of expression, despite being forms of speech or expression, lack even a prima facie claim to protection on free speech grounds. -/- Our central aim is to show why the mental mediation principle is mistaken. Liberals should think that some speech which is not mentally mediated deserves protection for the very same reasons that speech which is mentally mediated is often thought to deserve protection. Background: Neonatal nurse practitioners have become the frontline staff exposed to a myriad of ethical issues that arise in the day-to-day environment of the neonatal intensive care unit. However, ethics competency at the time of graduation and after years of practice has not been described. Research aim: To examine the ethics knowledge base of neonatal nurse practitioners as this knowledge relates to decision making in the neonatal intensive care unit and to determine whether this knowledge is reflected in attitudes toward (...) ethical dilemmas in the neonatal intensive care unit. Research design: This was a prospective cohort study that examined decision making at the threshold of viability, life-sustaining therapies for sick neonates, and a ranking of the five most impactful ethical issues. Participants and research context: All 47 neonatal nurse practitioners who had an active license in the State of Mississippi were contacted via e-mail. Surveys were completed online using Survey Monkey software. Ethical considerations: The study was approved by the University of Mississippi Medical Center Institutional Review Board (IRB; #2015-0189). Findings: Of the neonatal nurse practitioners who completed the survey, 87.5% stated that their religious practices affected their ethical decision making and 76% felt that decisions regarding life-sustaining treatment for a neonate should not involve consultation with the hospital’s legal team or risk management. Only 11% indicated that the consent process involved patient understanding of possible procedures. Participating in the continuation or escalation of care for infants at the threshold of viability was the top ethical issue encountered by neonatal nurse practitioners. Discussion: Our findings reflect deficiencies in the neonatal nurse practitioner knowledge base concerning ethical decision making, informed consent/permission, and the continuation/escalation of care. Conclusion: In addition to continuing education highlighting ethics concepts, exploring the influence of religion in making decisions and knowing the most prominent dilemmas faced by neonatal nurse practitioners in the neonatal intensive care unit may lead to insights into potential solutions. This study investigated the beliefs that formed teachers’ intentions to integrate STEM content into their social studies instruction. Participants were 60 elementary, middle, and high school in-service teachers who attended a summer history workshop on Abraham Lincoln. Data were collected by qualitative and quantitative instruments. Beliefs about likely outcomes of integrating STEM, and beliefs about persons who would approve, or disapprove, of STEM integration were elicited from teachers, and content analyzed. The resulting outcome and normative beliefs were used as stems (...) for items in the quantitative instrument. Quantitative data were analyzed primarily by correlation and multiple regression. This study found that attitude toward the behavior, integrating STEM, was formed by 15 outcome beliefs, subjective norm was formed by five normative beliefs, and that attitude and norm predicted behavioral intention. The theory we used enabled us to calculate the numerical contribution of each of the beliefs that were important in forming teachers’ intentions. The results have implications for theory, research, and practice in social studies education. In the realm of practice, these implications are for the initial preparation of, and the subsequent professional development of social studies teachers, both at the elementary and secondary levels.
