Physics has been thought to truly represent reality since at least Galileo, and the foundations of physics are always established using philosophical ideas. In particular, the elegant naming of physical entities is usually very influential in the acceptance of physical theories. We here demonstrate (using current developments in thermodynamics as an example) that both the epistemology and the ontology of physics ultimately rest on poetic language. What we understand depends essentially on the language we use. We wish to establish our (...) knowledge securely, but strictly speaking this is impossible using only analytic language. Knowledge of the meanings of things must use a natural language designed to express meaning, that is, poetic language. Although the world is really there, and although we can indeed know it truly, this knowledge is never either complete or certain but ultimately must rest on intuition. Reading a recently discovered artefact with a palaeo-Hebrew inscription as from the first century, we demonstrate from it that this ontological understanding long predates the Hellenic period. A number of hugely valuable natural resources fall outside of the borders of any nation state. We can legitimately expect political theory to make a contribution to thinking through questions about the future of these extraterritorial resources. However, the debate on the proper allocation of rights over these resources remains relatively embryonic. This paper will bring together what have often been rather scattered discussions of rights over extraterritorial resources. It will first sketch some early modern contributions to thinking through rights (...) over the ocean. It then discusses the guidance available within more contemporary contributions to debates on resources beyond the state. Finally, it concludes by emphasising the key questions with which future work on this topic must engage. (shrink)

The consensus is that musical works and other ‘multiple’ artworks are abstract objects of some sort. According to the standard objections to musical materialism, multiple artworks cannot be identified with any concrete manifestation since concrete manifestations are many, and one thing cannot be identical to many. Multiple artworks are particularly good, while particular concrete manifestations are particularly bad, at surviving the destruction of particular concrete manifestations. Finally, multiple artworks cannot be identified with a particular sum of concrete manifestations since sums (...) and works differ modally. This paper aims to show that by appealing to recent work on the metaphysics of material objects, musical materialists avoid the standard objections. (shrink)

The Surfactant, Positive Pressure, and Oxygenation Randomized Trial (SUPPORT) has been the focal point of many different criticisms regarding the ethics of the study ever since publication of the trial's findings in 2010 and 2012. In this article, we focus on a concern that the technical design and implementation details of the study were ethically flawed. While the federal Office Human Research Protections focused on the consent form, rather than on the study design and implementation, OHRP's critiques of the consent (...) form reveal views about the study design and implementation that we believe are fundamentally flawed. These criticisms about the design and implementation of SUPPORT, if generalized, become relevant concerns about these aspects of many comparative effectiveness research studies.Our analytical approach will be to use SUPPORT as a prime example of comparative effectiveness research and show why it challenges some prevailing assumptions about the riskiness of research. We will address five aspects of the study design and implementation: 1) randomization, 2) treatment by protocol, 3) choice of endpoints, 4) lack of a “standard care” control group, and 5) the use of altered oximeters. Examining these aspects will allow us to answer two specific central questions. The first is a methodological question with ethical implications: was the study designed in such a way as to answer the primary study question? The second question is whether the study design added or decreased risk to the babies enrolled in the study compared to babies who were not in the study. (shrink)

Alienation theory has acted as the stimulus for a great deal of research and writing in the history of sociology. It has formed the basis of many sociological ‘classics’ focused on the workplace and the experiences of workers, and has also been mobilized to chart wider social malaise and individual troubles. Alienation theory usage has, however, declined significantly since its heyday of the 1960s and 1970s. Here, the reasons why alienation theory was ‘forgotten’ and what can be gained by ‘remembering’ (...) alienation theory are explored. To realize this ambition this article proceeds by (1) briefly visiting differing definitions of alienation theory, before charting its high point, and the various debates and tensions of the time, during the 1960s and 1970s; (2) analysing the reasons why alienation theory fell from grace from the 1980s onwards; (3) elaborating how and why alienation theory is still relevant for sociology and the wider social sciences today. The ocean is central to our lives, but many of our impacts on the ocean are highly unsustainable, and patterns of resource exploitation at sea are deeply inequitable. This article assesses whether the objectives encapsulated in the UN's Sustainable Development Goal for the ocean are well equipped to respond to these challenges. It will argue that the approach underpinned by the SDG 14 is largely compatible, unfortunately, with ‘business as usual’. SDG 14 is undoubtedly intended as a starting point rather (...) than a final destination; but it is nevertheless important to be clear about how far we still need to travel on the road to oceanic justice. Most significantly, SDG 14 leaves several key challenges inadequately addressed or simply unaddressed. It fails to specify adequate principles for the fair sharing of benefits and burdens flowing from the ocean, including the burdens of tackling pressing environmental problems. Neither does it address the underlying causes of inequality in the ocean economy. It neglects to properly address, furthermore, the fragmented institutional context which significantly impedes effective action to advance the goals of justice and sustainability at sea. Finally, whereas SDG 14 correctly identifies a series of necessary reforms to the ocean economy, it fails to engage with important issues of transitional justice which will arise if these policies are implemented. Vital first step though it is, promoting a just and sustainable ocean will require us to set our sights considerably higher than the targets endorsed as part of SDG 14. (shrink)

The public/private dichotomy has long been the object of considerable attention for feminists. We argue that, by focusing their attention on a divide which has declined in importance, feminists may fail to keep up with the current means by which sexual inequalities are perpetuated. Furthermore, by concentrating on this divide feminists risk reproducing such dichotomous thinking in their own work, discursively perpetuating that which they had initially hoped to displace. We begin by surveying feminist critiques of the public/private dichotomy, consider (...) recent moves to go beyond critique, yet suggest that the dichotomy continues to be a framing concern within feminist work. We then survey the way in which space has been understood within geography, and consider the implications of adopting a relational conception of space for analysis of public and private in political theory. We offer a broader framework for examining the ways in which sexual inequalities are reproduced in contemporary society. We therefore open up the possibility that over time inequalities may be mediated to a greater or lesser degree by spatial divisions. This places a further pressure on the assumption that the public/private divide, or some variation thereof, must be at the heart of feminist theorizing. (shrink)

Over the past decade, Nancy Fraser has developed a sophisticated theory of social justice. At its heart lies the principle of parity of participation, according to which all adult members of society must be in a position to interact with one another as peers. This article examines some obstacles to the implementation of that principle. Concentrating on the contemporary status order, it asks two specific questions. Is it possible to produce a precise account of how the status order might need (...) to be ordered for parity of participation to be realized? And is it possible to derive a detailed and coherent political strategy capable of achieving such parity within the status order? The argument of this article is that, while Fraser has recognized the difficulties that the complexity of the contemporary status order poses for achieving parity of participation, she has nevertheless underestimated those difficulties. If parity of participation requires status equality, important and difficult work remains to be done in delineating the nature, and demands, of equality in the contemporary status order. (shrink)

Both Jaspers and his friend and intellectual mentor, Max Weber, took phenomenology to be a part of a tradition of "empathy" (Einfühlung) and "understanding" (Verstehen). Both concepts were important within the Methodenstreit, or methodological controversy, which was raging over the nature and the scientific status of the human sciences at the turn of the century. Empathy was an important concept for Jaspers and for Weber but not for other figures within the Methodenstreit, such as Wilhelm Dilthey and Georg Simmel, both (...) of whom were also highly influential on Jaspers and Weber. Understanding was a crucial concept for all these men. To them, it was the defining feature of the human sciences. All of these authors and the Methodenstreit in general were dominated by themes that were fundamentally Kantian. -/- Also present within the Methodenstreit were socalled neo-Kantian figures such as Wilhelm Windelband and Heinrich Rickert, who were successively Jaspers's professors after he left the practice of psychiatry in 1913 to take up a lectureship in psychology within the Heidelberg department of philosophy. An interest in the differing logic of the natural, and the human or cultural, sciences was the neo-Kantian influence on the Methodenstreit. Empathy played no part whatsoever, and understanding played a late, different, and minor part in Rickert's thinking. Jaspers's phenomenology begins from the same neo-Kantian themes as Rickert's theory of science, but Jaspers does not follow Rickert into his detailed distinctions between the two kinds of science. -/- For Jaspers, phenomenology was an "understanding, empathic representation" (verstehende, einfühlende Vergegenwärtigung) of the other person's psychic life. For Weber, it was an "empathic understanding" (einfühlende Verstandnis). Both Jaspers and Weber believed that this definition of phenomenology was exactly in line with Husserl's own thinking. This paper shows that their belief was a serious misunderstanding of Husserl's view. (shrink)

Abstract:In this essay I respond to four commentators who participated in a symposium on my book, Reconstructing Pragmatism. Issues that emerge include: Addams’s and Rorty’s mutual commitment to cultivating affective rationality; how Royce and Rorty share an ethical imperative in their philosophy and where both can learn from Alain Locke; what a post-Rortyan pragmatism might look like and the best path toward realizing it; the significance of recovering the serious, unironic Rorty and the limits of weak misreadings; Rorty’s pragmatic maxim; (...) and reflections on how best to sustain the habits and practices of a robust pragmatic tradition and community. In places, for understandable reasons the commentaries stray from the book’s argument about Rorty’s relation to classical pragmatism and address larger issues surrounding Rorty’s work and its broader reception. I don’t respond to all such matters but try to here and there, which hopefully gives what follows a relevance for contemporary pragmatism beyond the book itself. (shrink)

In two studies, we explored the frequency and phenomenology of musical imagery. Study 1 used retrospective reports of musical imagery to assess the contribution of individual differences to imagery characteristics. Study 2 used an experience sampling design to assess the phenomenology of musical imagery over the course of one week in a sample of musicians and non-musicians. Both studies found episodes of musical imagery to be common and positive: people rarely wanted such experiences to end and often heard music that (...) was personally meaningful. Several variables predicted musical imagery, including personality, musical preferences, and positive mood. Musicians tended to hear musical imagery more often, but they reported less frequent episodes of deliberately-generated imagery. Taken together, the present research provides new insights into individual differences in musical imagery, and it supports the emerging view that such experiences are common, positive, and more voluntary than previously recognized. This paper seeks to apply some of the tools of analytic philosophy to a text written by a 'continental' philosopher, in order to evaluate the quality of its arguments. In 'On Forgiveness', Jacques Derrida seems to be making two different claims about forgiveness. First, he claims that an act of forgiveness is only truly meaningful as forgiveness when one is forgiving the unforgivable. Second, he is also recommending that we change our understanding of the concept of forgiveness for ethical reasons. (...) I examine three lines of argument used in the essay to support the first claim. I find each of these lines of argument problematic. Since these arguments are unconvincing, I argue that this leaves only the second claim for Derrida to defend. (shrink)

While earlier work has emphasized Kant’s philosophy of religion as thinly disguised morality, this timely and original reappraisal of Kant’s philosophy of religion incorporates recent scholarship. In this volume, Chris L. Firestone, Stephen R. Palmquist, and the other contributors make a strong case for more specific focus on religious topics in the Kantian corpus. Main themes include the relationship between Kant’s philosophy of religion and his philosophy as a whole, the contemporary relevance of specific issues arising out of Kant’s (...) philosophical theology, and the relationship of Kant’s philosophy to Christian theology. The Trompenaars database (1993) updated with Hampden-Turner (1998) has been assembled to help managers structure their cross cultural experiences in order to develop their competence for doing business and managing across the world. The database comprises more than 50,000 cases from over 100 countries and is one of the world's richest sources of social constructs. Woolliams and Trompenaars (1998) review the analysis undertaken by the authors in the last five years to develop the methodological approach underpinning the work. Recently Trompenaars (...) with Hampden-Turner (Trompenaars and Woolliams, 1999) have extended the concepts into a new model on dilemma reconciliation of cultural differences. This paper reviews these latest updates in relation to dilemmas of cross-cultural business ethics. The paper asserts that knowledge in relation to business ethics is culturally specific; and that ethnocentrism is not easy to avoid. Too great an emphasis on rational-analytic conceptions of reality may mean that syntheses, emotion, and intuition, are not adequately developed. This presents implications for doing business and managing across cultures and for resolving ethical dilemmas. (shrink)

The cortical visual mechanisms involved in processing spatial relationships remain subject to debate. According to one current view, the ''dorsal stream'' of visual areas, emanating from primary visual cortex and culminating in the posterior parietal cortex, mediates this aspect of visual processing. More recently, others have argued that while the dorsal stream provides egocentric coding of visual location for motor control, the separate ''ventral'' stream is needed for allocentric spatial coding. We have assessed the visual form agnosic patient DF, whose (...) lesion mainly affects the ventral stream, on a prehension task requiring allocentric spatial coding. She was presented with transparent circular disks. Each disk had circular holes cut in it. DF was asked to reach out and grasp the disk by placing her fingers through the holes. The disks either had three holes (for forefinger, middle finger, and thumb) or two holes (for forefinger and thumb). The distance between the forefinger and thumb holes, and the orientation of the line formed by them, were independently varied. DF was quite unable to adjust her grip aperture or her hand orientation in the three-hole task. Although she was able to orient her hand appropriately for the two-hole disks, she still remained unable to adjust her grip aperture to the distance between the holes. These findings are consistent with the idea that allocentric processing of spatial information requires a functioning ventral stream, even when the information is being used to guide a motor response. ‘Organisational failure’ is central to medical ethics. In the National Health Service (NHS), we usually examine failures at hospital level. We have had around 100 hospital inquiries since the first in 1969, into Ely Hospital, Cardiff. This year, we had the Ockenden Report into Shrewsbury and Telford Hospital. Last year, we had the Outram Inquiry into West Suffolk Hospital. In 2020, the James Inquiry into Ian Paterson. And, before that, Morecombe Bay, Gosport War Memorial, Mid Staffordshire, Liverpool Community Health, Winterbourne (...) View, Anthony Ledward, Stoke Mandeville, Bristol Royal Infirmary and so on. As Taylor says, these reports teach us clinical failure usually has an institutional setting and that blaming individuals overlooks working ‘culture’. They have also led to: (a) new regulatory bodies to manage, investigate and improve NHS standards, (b) new codes of conduct to mandate reporting of serious accidents—backed up by the Whistle-blower’s Act and explicit statutory duties of disclosure, (c) root cause analysis to encourage consistent investigations so we can learn from reliable data and (d) new ‘Speaking Up Guardians’ and a Patient Safety Commissioner to encourage informal discussion about patient safety. What is so surprising is how little these inquiries and reforms have achieved on the larger scale. Of course, we must …. (shrink)

This groundbreaking work challenges modernist military science and explores how a more open design epistemology is becoming an attractive alternative to a military staff culture rooted in a monistic scientific paradigm. The author offers fresh sociological avenues to become more institutionally reflexive -- to offer a variety of design frames of reference, beyond those typified by modern military doctrine. Modernist military knowledge has been institutionalized to the point that blinds militaries to alternative designs organizationally and in their interventions. This book (...) seeks to reconstruct strategy and operations in "designing ways" and develops theories of action through multifaceted contextualizations and recontextualizations of situations, showing that military design does not have to rely on set rational-analytic decision-making schemes, but on seeking alternative meanings in- and on-action. The fact that humans are responsible for climate change is certain. But the meaning of the fact of human responsibility is not disclosed by stating the fact: there is a distinction between the two principles, de facto and de jure, the right to state a fact and the right to assert the meaning of the fact. This distinction must be preserved in order that humans may interpret the nature of our responsibility, as a form of justice. In fact, the nature (...) of human responsibility can never be exhaustively determined. To recognise the fact of human responsibility for climate change may only lead us to acknowledge that climate change coincides with the plundering and exploitation of the earth as a natural resource, together with the industrial pollution which fouls our atmosphere. It is something else again to know precisely what must be done, how to think and write and interpret the science, or even what can be achieved before it is too late to prevent the worst effects of global warming. In this essay I analyse the central claims of proponents of the idea of the Anthropocene, arguing that they are arrogant and perhaps even naïve: in particular, the suggestion that humanity and nature have now fused to become a geological force is shown to be theological in its orientation. The essay also exposes Anthropocenology as a form of pedagogy, meaning that rather than opposing the neoliberalism that it attacks, Anthropocenology joins itself to the biopolitical institutions of education, seizing power in order to govern a totalized human population all the more effectively. Herman Dooyeweerd approached time in terms of order. By contrast, Dirk Vollenhoven saw time as continuous change and becoming. Hendrik Hart, in his article “Problems of Time: An Essay,” attempts to steer a middle course between Dooyeweerd and Vollenhoven. However, Hart did not sufficiently take into account that temporality is primarily continuous succession in duration and continuous duration in succession. Nor has he been able to come to terms with the root of cosmic time.

Researchers have suggested that ethical judgments about “right” and “wrong” are the result of deep and thoughtful principles and should therefore be consistent and not influenced by factors, such as language :e94842, 2014b, p. 1). As long as an ethical scenario is understood, individuals’ resolution should not depend on whether the ethical scenario is presented in their native language or in a foreign language. Given the forces of globalization and international convergence, an increasing number of accountants and accounting students are (...) becoming proficient in more than one language, and they are required to interpret and apply complex ethical pronouncements issued by various global standard setters both in their native language and in English. There have been calls in the literature to examine whether subjects make systematically different ethical judgments in a foreign language than in their native language. We contribute to the literature by drawing on culture, linguistics, and psychology research to provide empirical evidence that Chinese subjects are more aggressive in interpreting the concept of control when providing their consolidation reporting recommendations in English than in Simplified Chinese. We applied a 2 × 2 within-subject and between-subject randomized experimental design using a sample of Chinese final year undergraduate accounting students at a leading Chinese university, where accounting courses are taught in both Simplified Chinese and English. Students in our study are proxy for entry-level accounting practitioners. Our findings have implications for the globalized business world and cross-cultural research by challenging the commonly held assumption that an individual’s ethical judgment is consistent in different languages. We suggest that systematically different ethical judgments in native and foreign languages needs to be recognized. (shrink)
