Ethical concepts are, or purport to be, normative. They make claims on us: they command, oblige, recommend, or guide. Or at least when we invoke them, we make claims on one another; but where does their authority over us - or ours over one another - come from? Christine Korsgaard identifies four accounts of the source of normativity that have been advocated by modern moral philosophers: voluntarism, realism, reflective endorsement, and the appeal to autonomy. She traces their history, showing (...) how each developed in response to the prior one and comparing their early versions with those on the contemporary philosophical scene. Kant's theory that normativity springs from our own autonomy emerges as a synthesis of the other three, and Korsgaard concludes with her own version of the Kantian account. Her discussion is followed by commentary from G. A. Cohen, Raymond Geuss, Thomas Nagel, and Bernard Williams, and a reply by Korsgaard. (shrink)

Different types of consent are used to obtain human biospecimens for future research. This variation has resulted in confusion regarding what research is permitted, inadvertent constraints on future research, and research proceeding without consent. The National Institutes of Health Clinical Center's Department of Bioethics held a workshop to consider the ethical acceptability of addressing these concerns by using broad consent for future research on stored biospecimens. Multiple bioethics scholars, who have written on these issues, discussed the reasons for consent, the (...) range of consent strategies, and gaps in our understanding, and concluded with a proposal for broad initial consent coupled with oversight and, when feasible, ongoing provision of information to donors. This article describes areas of agreement and areas that need more research and dialogue. The explanatory role of natural selection is one of the long-term debates in evolutionary biology. Nevertheless, the consensus has been slippery because conceptual confusions and the absence of a unified, formal causal model that integrates different explanatory scopes of natural selection. In this study we attempt to examine two questions: (i) What can the theory of natural selection explain? and (ii) Is there a causal or explanatory model that integrates all natural selection explananda? For the first question, we argue that (...) five explananda have been assigned to the theory of natural selection and that four of them may be actually considered explananda of natural selection. For the second question, we claim that a probabilistic conception of causality and the statistical relevance concept of explanation are both good models for understanding the explanatory role of natural selection. We review the biological and philosophical disputes about the explanatory role of natural selection and formalize some explananda in probabilistic terms using classical results from population genetics. Most of these explananda have been discussed in philosophical terms but some of them have been mixed up and confused. We analyze and set the limits of these problems. (shrink)

AN ASSUMPTION IN DEBATES ABOUT THE PHILOSOPHICAL SIGNIFICANCE OF MIRACLES IS THAT IF A MIRACLE (A VIOLATION OF NATURAL LAW OR A PERMANENTLY INEXPLICABLE EVENT) WERE TO OCCUR, IT WOULD BE EVIDENCE FOR THE EXISTENCE OF THE CHRISTIAN GOD. THE PAPER EXPLORES RESERVATIONS BY SEVERAL PHILOSOPHERS ABOUT THIS CONNECTION BETWEEN GOD AND MIRACLES, AND PRESENTS ARGUMENTS TO SHOW THAT IF A MIRACLE WERE TO OCCUR THERE WOULD BE GOOD REASON TO DENY THAT GOD EXISTS.

Sports medicine clinicians face conflicts of interest in providing medical care to athletes. Using a survey of college football players, this study evaluates whether athletes are aware of these conflicts of interest, whether these conflicts affect athlete trust in their health care providers, or whether conflicts or athletes' trust in stakeholders are associated with athletes' injury reporting behaviors.

The aim of this paper is twofold: In its first part, we work out the key features of constitutivism as presented by Christine Korsgaard. This reconstruction serves to clarify which goals Korsgaard wants to achieve with her account and which of its central claims she has to defend in particular. In the second part, we discuss whether Korsgaard can vindicate constitutivism's most central claim. To do this, we analyse two important arguments - the argument from unavoidability and the argument (...) from the abstract constitutive principle - that have been made in support of constitutivism. We show how both these arguments go amiss and conclude that at least for now, constitutivism's most central claim has not been successfully argued for. (shrink)

The paper draws its inspiration from the provocation which Merton offered sociology both to engage with empirical data and to perform analyses adequate to guide intervention beyond the particular case. Whilst contemporary STS is very different both in its models of theory and its forms of methodology, this paper suggests Merton's concerns with engagement and adequacy provide a useful way to interrogate current approaches. Specifically, the paper explores some recent anthropological conceptions of ethnographic fieldwork that have provided potent models for (...) the study of scientific and technological cultures. These multi-sited approaches have also provided the opportunity to develop new notions of intervention and explore alternative ways of making contributions to development of theory and practice. In the process of pursuing the goals of engagement and adequacy notions of ethnography have however become stretched. This sense of detachment from methodological canons accentuates the need for methodological debate and skill-sharing in STS. (shrink)

This book evaluates the major debates around which the discipline of international relations has developed in the light of contemporary feminist theories. The three debates (realist versus idealist, scientific versus traditional, modernist versus postmodernist) have been subject to feminist theorising since the earliest days of known feminist activities, with the current emphasis on feminist, empiricist standpoint and postmodernist ways of knowing. Christine Sylvester shows how feminist theorising could have affected our understanding of international relations had it been included in (...) the three debates. She elaborates a feminist method of empathetically cooperative conversation which challenges the identity politics of IR, and illustrates that method with reference to the Greenham Common Women's Peace Camp and the efforts of Zimbabwean women to negotiate international funding for their local producer cooperatives. : On the Aristotelian picture of virtue, moral virtue has at its core intellectual virtue. An interesting challenge for this orthodoxy is provided by the case of universal love and its associated virtues, such as the dispositions to exhibit grace, or to forgive, where appropriate. It is difficult to find a property in the object of such love, in virtue of which grace, for example, ought to be bestowed. Perhaps, then, love in general, including universal love, is not necessarily exhibited (...) for reasons. This is the view that, with the help of Heidegger's notion of a fundamental emotional attunement, I defend. The problem is to show how universal love, and its manifestation in the virtues of universal love, can then be seen as rational. Showing this is the task of the essay. (shrink)

This article explores the emergence of leadership during implementation of a water saving initiative in the rural community surrounding Barren Box Swamp in the Murray Darling Basin, Australia. Qualitative data analysis indicated that the system elements affecting the type of leadership to emerge included the extent to which the groups were engaged in the process, the level of access to resources, and the level of investment in the outcomes of the project. Although these results reinforced key aspects of complex problem-solving (...) through collaboration, they demonstrated varying degrees and types of both engagement and leadership within the case community. Given the current finding that these varying elements can coincide within one system, this case suggests that each community’s characteristics, resources and context will determine the optimal combination of leadership style and level of collaboration needed to facilitate sustainable community development. abstractBackground: Evidence shows both a tendency for research participants to conflate research and clinical care and a limited public understanding of research. Conflation of research and care by participants is often referred to as the therapeutic misconception. Despite this evidence, few studies have explicitly asked participants, and especially minors, to explain what they think research is and how they think it differs from regular medical care. Methods: As part of a longer semistructured interview evaluating assent and parental permission for research, (...) adolescent research participants (n = 177), including adolescents with illnesses and healthy volunteers, and their parents (n = 177) were asked to describe medical research in their own words and say whether and how they thought being in medical research was different from seeing a regular doctor. Qualitative responses were coded and themes were identified through an iterative process. Results: When asked to describe medical research, the majority described research in terms of its goals of helping to advance science, develop treatments and medicines, and help others; fewer described research as having the goal of helping particular research participants, and fewer still in terms of the methods used in research. The majority of teen and parent respondents said being in research is different than seeing a regular doctor and explained this by describing different goals, different or more procedures, differences in the engagement of the doctors/researchers, and differences in logistics. Conclusions: Adolescents participating in clinical research and their parents generally describe medical research in terms of its goals of advancing science and finding new medicines and treatments, sometimes in combination with helping the enrolled individuals. The majority perceive a difference between research and regular medical care and described these differences in various ways. Further exploration is warranted about how such perceived differences matter to participants and how this understanding could be used to enhance informed consent and the overall research experience. Vulnerability in research is often understood as a diminished ability to protect one's own interests, manifested by a compromised capacity to give informed or voluntary consent. Certain groups of people are thought to be more vulnerable than others and therefore are at risk of being exploited or mistreated in research. Accordingly, the federal regulations call for additional safeguards to protect vulnerable groups.There remains some ambiguity and contradiction, however, regarding what groups are vulnerable in research and why,3 since the available codes (...) of research ethics and regulations describe many groups as vulnerable. When so many groups are considered vulnerable, but no specification is offered as to how they are vulnerable or what particular protections are appropriate, the possibility of meaningful safeguards is diminished. In addition, current concepts of vulnerability are usually applied to whole groups of people, without distinguishing between individuals in a group who might truly have a compromised capacity to protect their own interests from those who do not. I begin by discussing forms of cosmopolitanism that motivate challenges to distributive accounts of global justice. I then use Sen's version of the capabilities approach to show how distributive accounts fall short, why an overarching theory of justice is not needed, and that democracy understood as the exercise of public reasoning can do the work of identifying and addressing injustices. That said in favor of Sen, I argue that his account fails to attend to the kinds of injustices emerging from (...) relationships of power and the institutions and structures in which these relationships are embedded. To show this, I outline features of a feminist relational approach, which I then apply to Canada's attempt to address historic harms through the Indian Residential Schools Truth and Reconciliation Commission. While I agree with Sen that we do not need a theory of global justice that is universal, ideal, impartial, or abstracted from context, I aim to broaden the scope of justice beyond both distributive accounts and Sen's version of the capabilities approach. This Article examines the ways in which market vendors in Kampala, Uganda, responded to plans to redevelop their markets through the concession of long-term leases to private investors. These plans met with massive resistance from the marketers, with significant outcomes. The Article uncovers how the marketers actively negotiated a “gray space” between legality and illegality and creatively used the law, with a view to asserting themselves as the legitimate rulers of their markets. It shows how the marketers engaged in highly (...) diverse modalities of struggle, stretching across the legal/illegal boundary. They organized in multiple configurations which were flexible, hybrid and mutant in character, rather than being fixed in particular organizational categories. In their struggles, the marketers engaged in shifting alliances and with a disparate range of political allies. Their politics were fluid, untamed and pragmatic, but also contradictory and fractured. This flexibility and pragmatism enabled them to navigate a complex political landscape and to make instrumental use of a generally unfavorable legal environment. (shrink)

Le propos de l’article est l’analyse de la cérémonie de la prise d’habit au sein de l’Ordre Notre-Dame du Mont-Carmel aux xviie et xviiie siècles. À partir des sources normatives, picturales et hagiographiques, cette cérémonie est détaillée, notamment la scénographie de l’avant/après, gommant toute marque féminine (présence de cheveux, soins pour un teint pâle, vêtement ajusté, usage de soieries, de bijoux, etc.). Certaines pratiques témoignent de la mise en impatience de ce passage de la soie au drap, qui se traduit (...) par des prises d’habit clandestines, prématurées ou des portraits de mondaines usurpatrices en habit de carmélites. Il est vrai que le modèle absolu de La Madeleine, compte tenu des origines le plus souvent princières des postulantes, n’est pas étranger au prestige de la métamorphose. Réalité et construction représentative permettent de montrer comment le Carmel s’est approprié une cérémonie, qui, dans le contexte compétitif entre les ordres de la liturgie tridentine, valorise la femme, par le biais de la moniale, affranchie des attributs de son sexe. Mais surtout, la vêture a su rendre spectaculaire et désirable ce qui a priori ne l’est pas, la pauvreté et la pénitence du corps et de ses attributs, dans le but avoué du recrutement de nouvelles postulantes. De la rivalité entre drap et soie, le vainqueur n’est pas forcément celui que l’on croit. (shrink)

Danielle Wenner has crafted novel arguments in defense of republican accounts of freedom. I learned a lot from her discussion of how Philip Pettit's neorepublican account of freedom as nondomination does a better job than standard accounts of freedom as noninterference of explaining how power over an agent can restrict their freedom to act autonomously. The real crux of Wenner's argument, however, is that freedom as nondomination can do this work in a way that those who defend an account of (...) relational autonomy cannot. I will start with Wenner's defense of freedom as nondomination and of what it can do as the background for assessing her critique of relational autonomy. Controversy persists over the ethics of compensating research participants and providing posttrial benefits to communities in developing countries. Little is known about residents' views on these subjects. In this study, interviews about compensation and posttrial benefits from a hypothetical HIV vaccine trial were conducted in Uganda’s Rakai District. Most respondents said researchers owed the community posttrial benefits and research compensation, but opinions differed as to what these should be. Debates about posttrial benefits and compensation rarely include residents' views like these, (...) but future ones should. (shrink)

We present empirical evidence from dialogue that challenges some of the key assumptions in the Pickering & Garrod (P&G) model of speaker-hearer coordination in dialogue. The P&G model also invokes an unnecessarily complex set of mechanisms. We show that a computational implementation, currently in development and based on a simpler model, can account for more of this type of dialogue data.

At a time when neoliberalism and financial austerity are together encouraging academic scientists to seek market alternatives to state funding, this essay investigates why, a century ago, their predecessors explicitly rejected private enterprise and the private ownership of ideas and inventions available to them through the patent system. The early twentieth century witnessed the success of a long campaign by British scientists to persuade the state to assume responsibility for the funding of basic research : their findings would enter the (...) intellectual commons; their rewards would be primarily reputational . The essay summarizes recent research in three separate fields of British technoscience—electricity, aviation, and agricultural botany—all of which were laying claim, at this time, to a heightened commercial or military importance that raised new questions about the ownership of scientific ideas. It suggests that each of the three established an idiosyncratic relationship with the patent system or with other forms of “intellectual property,” which would both influence their emergent disciplines and affect the extent to which commercial enterprise could remain a viable funding strategy. This article describes developments in the use of information technology in the biological discipline of taxonomy, using both a historical overview and a detailed case study of a particular information systems project. Taxonomy has experienced problems with both its scientific legitimacy and its utility to other biologists. IT has been introduced into the discipline m response to these perceived problems. The information systems project described here served as a means of managing the tensions between scientific legitimacy and utility. It is (...) argued that this project represents an example of the use of a technological development m an attempt to re-engineer a discipline. The development of the information system is analyzed as an attempt to develop a scientific instrument that will embody a particular model of the discipline. The concerns of taxonomy with status and legitimacy make it appropriate that this new technology should be introduced at the interface between the discipline and the rest of biology as a means of disseminating results, and thus come to represent the discipline and the plants described to outsiders, just as the system represents outsiders to taxonomists. Conscience is the psychological faculty by which we aware of and respond to the moral character of our own actions. It is most commonly thought of as the source of pains we suffer as a result of doing what we believe is wrong --- the pains of guilt, or “pangs of conscience.” It may also be seen, more controversially, as the source of our knowledge of what is right and wrong, or as a motive for moral conduct. Thus a person (...) who is motivated to act on principle is said to act “conscientiously.” These terms come from the Latin “conscientia,” a direct translation of the Greek “syneidesis.” This ranges in meaning from being aware of something to “knowing something in common with” someone. Knowing something in common with someone can mean sharing his secret, and this puts you in a position to serve as a witness against him. Thus the term came to have a judicial use, to describe one who could bear witness. In certain contexts, “syneidesis” came to mean a state of knowing in common with oneself, and so of bearing witness against oneself. Although these terms appear in Stoic and Epicurean works, conscience did not receive extensive philosophical treatment until the Medieval period, when treatises on conscience became standard. Medieval philosophers distinguished two aspects of conscience, “conscientia” and “synderesis.” Roughly, “synderesis” refers to the ineradicable and infallible basis of conscience in human nature, while “conscientia” refers to the more particular judgments we make about our actions. There are various ways of specifying the two ideas further. In Thomas Aquinas’s account, which became standard, synderesis grasps the basic moral principles which are the first premises of practical reasoning, while conscientia is the conclusion, the act of judging that one ought to perform a particular action. In this paper I explore the possibility of explaining why there is such a thing as the good in naturalistic terms. More specifically, I seek an explanation of the fact that some things are good-for human beings and the other animals in the final sense of good: worth aiming at. I trace the existence of the final good to the existence of conscious agents. I propose that the final good for an animal is her own well-functioning as the kind of (...) creature she is, taken as an end of action, and that having this as her final good makes her better at the activity she is necessarily engaged in, namely, living.
