Ethical concepts are, or purport to be, normative. They make claims on us: they command, oblige, recommend, or guide. Or at least when we invoke them, we make claims on one another; but where does their authority over us - or ours over one another - come from? Christine Korsgaard identifies four accounts of the source of normativity that have been advocated by modern moral philosophers: voluntarism, realism, reflective endorsement, and the appeal to autonomy. She traces their history, showing (...) how each developed in response to the prior one and comparing their early versions with those on the contemporary philosophical scene. Kant's theory that normativity springs from our own autonomy emerges as a synthesis of the other three, and Korsgaard concludes with her own version of the Kantian account. Her discussion is followed by commentary from G. A. Cohen, Raymond Geuss, Thomas Nagel, and Bernard Williams, and a reply by Korsgaard. (shrink)

Objective Some researchers claim that the quality of informed consent of clinical research participants in developing countries is worse than in developed countries. To evaluate this assumption, we reviewed the available data on the quality of consent in both settings. Methods We conducted a comprehensive PubMed search, examined bibliographies and literature reviews, and consulted with international experts on informed consent in order to identify studies published from 1966 to 2010 that used quantitative methods, surveyed participants or parents of paediatric participants (...) in actual trials, assessed comprehension and/or voluntariness, and did not involve testing particular consent interventions. Forty-seven studies met these criteria. We compared data about participant comprehension and voluntariness. The paucity of data and variation in study methodology limit comparison and preclude statistical aggregation of the data. Results and Discussion This review shows that the assertion that informed consent is worse in developing countries than in developed countries is a simplification of a complex picture. Despite the limitations of comparison, the data suggest that: (1) comprehension of study information varies among participants in both developed and developing countries, and comprehension of randomisation and placebo controlled designs is poorer than comprehension of other aspects of trials in both settings; and (2) participants in developing countries appear to be less likely than those in developed countries to say they can refuse participation in or withdraw from a trial, and are more likely to worry about the consequences of refusal or withdrawal. In this article I begin by discussing the persistent problem of relations between educational inequality and the attainment gap in schools. Because benefits accruing from an education are substantial, the ‘gap’ leads to large disparities in the quality of life many young people can expect to experience in the future. Curriculum knowledge has been a focus for debate in England in relation to educational equality for over 40 years. Given the contestation surrounding views about curriculum knowledge and equality I consider (...) the thinking of two philosophers, Jacques Derrida and Emmanuel Levinas, and their work on justice, to trouble the curriculum framework and discourse of knowledge promoted through the policy text of The Importance of Teaching: The Schools White Paper (2010) and later associated policy reforms to the General Certificate of Secondary Education (GCSE) curriculum in England. The Schools White Paper aims to make the curriculum more challenging to students by introducing tight controls in terms of the assessment framework and curriculum knowledge. I argue that, when considered through Derrida's perspective on language and meaning and Levinas' view on the ethical responsibility for the other, the reforms present obstacles to the search for a just curriculum. I look to the work of Sharon Todd and Paul Standish for a re-imagination of curriculum as or through relations in the light of Derrida's and Levinas' philosophies. (shrink)

Phenomenology provides a method for disability theorists to describe embodied subjectivity lacking within the social model of disability. Within the literature on body integrity identity disorder (BIID), dominant narratives of disability are influential, individual bodies are considered in isolation, and experiences of disabled people are omitted. Research on BIID tends to incorporate an individualist ontology. In this article, I argue that Merleau-Ponty's conceptualization of “being in the world,” which recognizes subjectivity as embodied and intersubjective, provides a better starting point for (...) research describing the experiences of those with BIID and amputees. Sometimes beliefs that are shared are treated as if they are knowledge in spite of a lack of evidence or even in the face of evidence to the contrary. Beliefs informed by prejudices and ignorance about people with disabilities are often treated as certain and reinforced by social practices. In this paper, I distinguish between knowledge claims and beliefs that are treated as if they are true. I use Wittgenstein’s account of the connection between epistemic and other social practices in (...) On Certainty to consider how it is possible to change beliefs about disability. I draw on Naomi Scheman’s “Forms of life: Mapping the Rough Ground” to consider political applications of Wittgenstein’s thought. I use a Wittgensteinian framework to critique Peter Singer’s claims regarding the lives of disabilities in Practical Ethics. I draw attention to the ways in which unjustified beliefs about disability can inform and be reified through social practices. Likewise, changes in social practices can dislodge common ableist beliefs about disability. (shrink)

In contrast to the conventional fund management industry with a profit-oriented logic based on risk and return, ethical and faith-based funds should follow the religious principles of their investment-style philosophy. Islamic funds should obey the theological teachings of the primary sources of Islam, the Quran and Sunnah, as stakeholders expect these religious teachings to influence the investment decisions of fund managers. In practice, Islamic fund managers use Accounting and Auditing Organization for Islamic Financial Institutions ’s screening criteria, based on secondary (...) sources of Islam, which allow investments that are only partially halal to be included in their portfolios. This study finds that a more religious logic in screening practices, although impairing diversification, does not necessarily harm performance. Thus, Islamic investment funds, and the wider ethical fund management industry, should, and could, adopt stricter screening criteria that match their investment mandates and bring more ethical business practices to the industry. This book evaluates the major debates around which the discipline of international relations has developed in the light of contemporary feminist theories. The three debates (realist versus idealist, scientific versus traditional, modernist versus postmodernist) have been subject to feminist theorising since the earliest days of known feminist activities, with the current emphasis on feminist, empiricist standpoint and postmodernist ways of knowing. Christine Sylvester shows how feminist theorising could have affected our understanding of international relations had it been included in (...) the three debates. She elaborates a feminist method of empathetically cooperative conversation which challenges the identity politics of IR, and illustrates that method with reference to the Greenham Common Women's Peace Camp and the efforts of Zimbabwean women to negotiate international funding for their local producer cooperatives. Research examining consumer responses to the provision of nutritional information as part of restaurant menus has produced mixed results. In light of pending legislation requiring the provision of nutritional information, the authors examine the how corporate social responsibility impacts consumer service evaluation of restaurants. Findings from three studies demonstrate that the relationship between consumer attitudes toward the disclosure of nutrition information and their subsequent evaluation of the food provider is impacted by CSR-related initiatives. Studies one and two find that consumer (...) evaluations are enhanced when the firm has an existing reputation for CSR and when the firm includes healthy product options as part of the introduction of the nutritional information. Study 3 finds these effects are particularly strong with fast-food restaurants. Overall, the findings suggest that, for some firms, the introduction of the legislation provides an opportunity to strengthen relationships with customers and gain advantage over some competitors. In this paper, I explore the claim that phenomenological accounts grounded in the lived experiences of those most tangibly impacted by social norms related to ability can provide crucial correctives and supplements to the existing philosophical literature on disability. After situating discussions of the body within disability theory and debates over the impairment/disability distinction in philosophy of disability more specifically, I argue that extant models are inadequate for theorizing subjective experiences of living as a disabled person. I then develop an (...) account of the relationship between impairment/disability by drawing upon critical phenomenological approaches to embodiment. In conclusion, I turn to the methodological and metaphilosophical issue of how to conduct ethical inquiry concerning disability. I examine some of the ways that ableist assumptions can inform curiosity, provide examples of disabled people’s accounts of experiencing derivatizing curiosity, and offer suggestions for practices of curiosity that not only avoid epistemic harms, but are actively anti-ableist. Although many women experience harmful behaviors that fit the legal definition of sexual harassment, very few ever label their experiences as such. I explore how psychological ambivalence expressed as sadomasochism may account for some of this gap. Following Lynn Chancer, I argue that certain structural circumstances characteristic of highly stratified bureaucratic organizations may promote these psychological responses. After discussing two illustrations of this dynamic, I draw out the implications for sexual harassment theory and policy.

The relation between conscious recollection and source memory for perceptual details was investigated in three experiments that combined the remember–know paradigm with a multidimensional source monitoring test. Experiment 1 replicated that source memory for perceptual details is better in the case of “remember” than “know” judgments. Experiment 2 showed that the relation between “remember” judgments and source memory for perceptual details is diminished by a semantic orienting task during encoding. Experiment 3 demonstrated that “remember” judgments are related to enhanced source (...) memory for specific and unique kinds of perceptual source information, whereas memory for incomplete and global perceptual source information does not differentiate between “remember” and “know” judgments. The results show that the attentional focus during encoding and the specificity of retrieved source information form boundary conditions for the use of source memory for perceptual details as a basis of “remember” judgments. This article explores the reasons some pregnant women enter maternity homes with the plan to place their babies for adoption. The authors discuss changes in maternity homes over the twentieth century and report on findings from a survey of currently licensed homes in Texas. Next, the authors discuss the findings from fieldwork and in-depth interviews with residents of two maternity homes. They identify three major reasons why birth mothers enter maternity homes: the desire to escape abusive or stressful family lives, (...) the desire to avoid the stigma of placing a child for adoption, and the desire to provide their children, and in some cases themselves, with a stable and loving family life. The authors contend that entering a maternity home with the intention of placing their babies for adoption represents an effort on the part of birth mothers to reconfigure their own, often impoverished family lives. Part-time work schedules are a popular option for many women struggling to reconcile the competing demands of employment and motherhood. They are controversial among feminists because they are associated with job penalties that promote gender inequality. Previous research on this topic has focused on issues confronting women workers in professional and managerial jobs. In this article, we compare and contrast the experiences of women in professional and secondary part-time jobs, drawing on 60 in-depth interviews with mothers working in such “good” (...) and “bad” jobs. We find that mothers at the top and at the bottom of the employment hierarchy face unique disadvantages from their part-time employment to which they respond in different ways. Yet in both instances, mothers assume responsibility for their “choices,” which absolves organizations of blame for exploitation and discrimination against part-time workers. We suggest alternative possibilities for the organization of work in the conclusion. (shrink)

Since 1977, when the _Harvard Educational Review_ published Carol Gilligan's now-classic article "In a Different Voice," in which she argued so persuasively (...) that women and girls must be understood on their own terms, researchers have been discovering, uncovering, and recovering women's ways of knowing, being, thinking, teaching, and learning. _Minding Women_ charts the wealth of thought and writing related to women and girls and education that this process of discovery has produced. _Minding Women_ begins with a "Classics" section—articles that call attention to the lack of research on girls and women and describe the effect this has had on knowledge and society. The contributors then discuss feminist pedagogy, and how it has changed and been refined over time. Girls and young women are the focus of the next section. Too often their voices and viewpoints are excluded from these discussions, so some of their own writings are included here. The book then explores women's educational history, showcasing some of the rich work in this area over the past twenty years. Identity issues are addressed in the final section, acknowledging that substantial differences exist among groups of women and girls on how they experience the world and their roles, prospects, and lives. This paper takes a novel approach to studying the existence and stability of Nash equilibria in N-firm Cournot–Bertrand oligopolies. First, we show that such games can be monotonically embedded into a game of strategic heterogeneity, so that each firm best responds to the choices of all other firms in a monotonic way. We then show that this monotonicity can be exploited to derive conditions which guarantee the existence of a unique, dominance solvable Nash equilibrium which is stable under all adaptive (...) dynamics. These conditions constitute a strict improvement over existing results in the literature. Finally, we examine the effect on these conditions resulting from additional firms entering the market. This article is aimed at introducing a French discourse analysis model, e.g. the ‘star model’, initiated by the LAA team led by Robert Vion in Aix-en-Provence, to English-speaking researchers. It will be argued that language activity is multi-dimensional and can be traced at various heterogeneous levels of speech productions belonging to macro as well as micro orders. Speakers achieve different varieties of positioning which result in negotiating an interactional space within a pre-given situation. The model is precisely designed to offer (...) a unified and comprehensive view of such heterogeneous phenomena in constant interconnection. In this study, we also intend to illustrate our approach through the analysis of two different corpora. Speakers’ strategies under extreme conditions will be analysed; the various sequences used were taken from a special corpus which we were asked to study as part of a national research programme. In order to illustrate interactional space shifts, we will also use the transcript of a meeting which took place between a patient and a medical investigator in a hospital in Marseilles. (shrink)

Disturbances of perception of subjective time have been described in schizophrenia but have not been experimentally studied until now. We investigated how patients with schizophrenia estimate the subjective temporal distance of past personal events, i.e. how these events are perceived as subjectively close or distant in time. Twenty-five patients with schizophrenia and 25 control participants recalled 24 autobiographical memories from four different life periods. They estimated the subjective TD and rated the amount of detail of each memory. Results showed that (...) patients with schizophrenia had a distorted perception of subjective TD. Their memories were significantly less detailed than those of controls and, unlike control participants, the amount of memory detail was not significantly correlated with subjective TD. Poor access to memory detail may account for distortions of perception of subjective time in patients with schizophrenia. (shrink)

This paper examines the ethical conundrum between a hospital's ethos of relieving distress, investigation and treatment, and its concurrent duties under English law to administer tests of decision-making capacity and safeguarding protection where it believes the patient may lack this capacity. Delirium, characterised by a precipitous decline in mental functioning exhibiting the shared symptomology of recoverable depressive disorders and terminal dementia, is not uncommon after emergency admission of elderly patients into acute medical hospital wards. The use of functional capacity testing (...) as a benchmark for decision-making capacity for post-discharge residence has been criticised as outdated, conceptually floored, subjective, lacking central guidance, transparent process, and accountability. A study of patient experience demonstrates the potential for hospital misuse of capacity testing, the failure of functional testing to differentiate decision making capacity from the disability of partial cognitive impairment, and how hospital capacity processes can interact and amplify patient pathology thereby decreasing recovery prospects. Prioritisation of mental capacity obligations above thorough investigation of emergent mental pathology and relief of patient anguish, results in extended detention in medical wards lacking bespoke facilities. Further understanding of patient experience is needed to inform policy with interventions tailored to avoid harm and increase wellbeing. (shrink)

ABSTRACT This exploratory study assessed links among children’s moral concern and their ideas about the rights and protection of companion, farm, wild animals and ecosystems. Sixty-one children responded to three interview questions that were coded as either anthropocentric or biocentric in orientation. Results revealed unique links among children’s moral concern and their ideas about the rights and protection of different types of animals and ecosystems. Biocentric moral concern was associated with two protection strategies: 1) advocacy to protect companion animals and (...) ecosystems, and 2) the need for peer support to help protect wild animals. Overall, results revealed the nuanced diversity of children’s moral concern and ideas about the rights and protection of all types of animals and ecosystems. Implications for moral education programs include a balanced approach to foster compassion, environmental awareness, and social justice among youth. (shrink)

Comme beaucoup d’autres femmes, elle connaît les difficultés d’accès à la contraception et souffre de l’avortement clandestin. Son mode de vie en couple vivant avec un autre couple et le partage de ses nuits entre son mari et son compagnon – sans exclure (...) d’autres relations – dessinent une alternative au modèle traditionnel originale et plutôt heureuse. The question of education for democratic ‘empowerment and liberation’, and how this might guide pedagogic practice is seldom raised and extremely challenging for social work education today. This chapter takes up the proposition that social work, through its educational practices, ‘can’ deliver on its promise of ‘democratic practice’ if democracy is understood as a process and not a predefined product. We argue that such a process and its embodiment in institutions cannot exist without the formation of radically democratic subjects, people (...) (including social workers) capable of questioning dominant social forms and of creating new forms and practices. Accordingly, this chapter explores the educational implications for social work of the work of the revolutionary theorist, Cornelius Castoriadis (1921–1997). Castoriadis’ philosophy accords a crucial role to democratic pedagogy (paideía) as an essential form of praxis in the creation of a radically democratic, egalitarian and sustainable society. In particular, we examine his idea (against (neo)liberal individualisation) that ‘autonomy’ is simultaneously an individual and social project that begins in, and is always dependent upon, individual and collective self-reflection. This argument is illustrated by examples from the authors’ classroom experiences of teaching both critical reflection and critical social theory to social work students in Australian universities, on the premise that both are indispensable in social work education as a democratic practice for ‘empowerment and liberation’. The chapter outlines a brief discussion of Castoriadis, his main ideas and the pedagogic dimensions of his philosophy before bringing the latter to bear on the authors’ teaching experiences.
