With a novel approach to Aristotle's zoology, this study looks at animals as creatures of nature and reveals a scientific discourse that, in response to his predecessors, exiles logos as reason and pursues the logos intrinsic to animals' bodies empowering them to sense the world and live. The volume explores Aristotle's conception of animals through a discussion of his ad hoc methodology to study them, including the pertinence of the soul to such a study, and the rise of zoology as (...) a branch of natural philosophy. For Aristotle, animal life stems from the body in the space of existence and revolves around sensation, which is entwined with pleasure, pain, and desire. Lack of human reason is irrelevant to an understanding of the richness of animal life and cognition. In sum, the reader will acquire knowledge of the animal as such, which lay at the core of Aristotle's agenda and required a study of its own, separate from plants and the elements. Presenting real life cases from clinical practice, this book claims that children can be conceived of as moral equals without ignoring the fact that they still are children and in need of strong family relationships. Drawing upon recent advances in childhood studies and its key feature, the ‘agentic child’, it uncovers the ideology of adultism which has seeped into much what has been written about childhood ethics. However, this book also critically examines those positions that do accord moral equality to (...) children but on grounds not strong enough to support their claim. It lays the groundwork for a theory of moral equality by assessing the concepts of parenthood, family, best interest, paternalism, and, above all, autonomy and trust which are so important in envisioning what we owe the child. It does not only show how children – like adults – should be considered moral agents from infancy but also how ethical theories addressing adults can significantly profit from recognizing this. "What do grown children owe their parents?" Over two decades ago philosopher Jane English asked this question and came up with the startling answer: nothing (English 1979). English joins many contemporary philosophers in rejecting the once-traditional view that grown children owe their parents some kind of fitting repayment for past services rendered. The problem with the traditional view, as argued by many, is, first, that parents have duties to provide fairly significant services to their growing children, and persons do not (...) owe repayment for others' mere performance of duty; second, even where parents go above and beyond duty in their loving and generous rearing of their children, the benefits are bestowed, at least on young children, without their voluntary acceptance and consent, and so, again, fail to generate any obligation of subsequent repayment on their part (see Blustein 1982: 182-3). Moreover, the entire idiom of obligation and repayment, in English's 1 words, "tends to obscure, or even to undermine, the love that is the correct ground of filial obligation" (352). English's alternative, however -- that children strictly "owe" their parents nothing except what flows naturally from whatever love and affection exist between them -- also strikes many as problematic. Christina Hoff Sommers offers examples of what seem to be clearly delinquent adult children, who simply don't "feel" like sharing their lives with their aging parents, or providing any emotional or financial support to them, and so don't (Sommers 1986: 440-41). Sommers points out that we need some talk of obligations in order to fill in the cracks in human relationships where love and affection fail: "The ideal relationship cannot be 'duty-free,' if only because sentimental ties may come unraveled, often leaving one of the parties at a material disadvantage'" (450-51). Sommers proposes as her alternative to English that legitimate duties arise out of special relationships defined by social roles: being a father or mother, a son or a daughter, "is socially as well as biologically prescriptive; it not only defines what one is; it also defines who one is and what one owes" (447).. The central question of this article is what hope contributes to a good life. The starting point is the assumption that living a good life involves having a good relation to the past, present and future. Hope is a central attitude towards the future that contributes, I argue, to having an own future. I distinguish three ways in which there is reference to an "own future" and thus different ways in which hope contributes to the good life. Finally, I discuss (...) the objection that hope is detrimental to a good life precisely because of its reference to the future, insofar as a good life essentially takes place "in the present". In this article, I respond to Laury Naranch’s and Mary Caputi’s discussion of my book Power and Feminist Agency in Capitalism (2017). In response to Naranch, I clarify how the political subject-in-outline translates into collective political action through the figure of the Chicana working-class woman. I also explain why the proletariat, more so than the precariat, implies a radical political imaginary if we rethink this concept in the context of my idea of the political subject-in-outline. I also clarify that my (...) chapters on Marx expose how Adorno and Marx have problematic imaginations of the working-class woman, which counter their otherwise radical imaginary. In response to Caputi, I clarify the meaning of capitalism in my book and underline that we need a rigorous critique of capitalism to counter the rise of the Far Right. I also explain why the fluid subject does not have agency and why the subject-in-outline is a better way to theorize transformative feminist agency. I also clarify that my conception of feminist political subjectivity does not assume a privileged vantage point outside power structures. (shrink)

In political philosophy, trust, legality and violence are interdependent, with different weights, connecting and excluding. Trust structures suffer most from an anticipation of violence or violence itself. Violence systematically takes place in three stages, according to the german sociologist Jan-Philipp Reemtsma: expulsive, abusive, and homicidal violence, all of which have their distinctive and recurring verbal and nonverbal equivalents. The hyperviolence phenomenon goes beyond this, however, and even mutilates the dead body, whether actually physically, or through massive propaganda that declares the (...) enemy a killable non-human. The goal of hyperviolence is a demonstration of absolute power over victim and bystander by means of a traumatizing violation of trust, reason, and individuality. At the same time, hyperviolence is an atavism in modernity (a historical regression); therefore the practitioner of hyperviolence is the anti-modern type par excellence. The french philosopher Georges Bataille introduces here the concept of "sovereignty" and the "sovereign" as the perpetrator also of hyperviolence. The sovereign's sovereignty is the immediate experience of the moment, free of any responsibility, with a rhetoric of mock justification of each of the three types of violence including hyperviolence. With the ahistorical view of escalating violence and the denial of any rational legitimation by the sovereign as the actor of hyperviolence, the structure of trust and the contract system of democracy itself is also endangered. So the question is, how does one unmask the "sovereign" on his way to undermine legal relations already in his linguistic patterns, in his non-linguistic codes, and how can escalation be prevented by early detection? Considering the high impact strain that the severe acute respiratory syndrome coronavirus 2 pandemic has put on medical personnel worldwide, identifying means to alleviate stress on healthcare professionals and to boost their subjective and psychological wellbeing is more relevant than ever. This study investigates the extent to which the relationships between the status of working in healthcare and the subjective and psychological wellbeing are serially mediated by work recovery experiences and the need for recovery. Data were collected from 217 Romanian (...) employees using a cross-sectional design with self-report instruments, during the first stage of the nationwide lockdown. The results of the serial mediation analyses revealed that working in the medical field is indirectly related to subjective and psychological wellbeing through the following: mastery experiences and mastery experiences as an antecedent of the need for recovery. As such, our findings indicate that working in the medical field is, in fact, linked to healthcare professionals’ subjective and psychological wellbeing, and they provide some input on how recovery experiences and the need for recovery intervene in these relationships. Based on these findings, theoretical, methodological, and practical implications were suggested, and future research directions were proposed to maximize healthcare professionals’ wellbeing. The dynamic organisational processes in businesses dilute the boundaries between the individual, organisational, and societal drivers of corporate philanthropy. This creates a complex framework in which charitable project selection occurs. Using the example of European tour operators, this study investigates the mechanisms through which companies invest in charitable projects in overseas destinations. Inextricably linked to this is the increasing contestation by local communities as to how they are able to engage effectively with tourism in order to realise the benefits tourism (...) development can bring. This research furthers such debates by exploring the processes through which tour operators facilitate community development through charitable giving. Findings show, with no formal frameworks in existence, project selection depends upon emergent strategies that connect the professional with the personal, with trust being positioned as a central driver of these informal processes. Discretionary responsibilities are reworked through business leaders’ commitment to responsible business practises and the ethical subjectivity guiding these processes. (shrink)

In "Demonstratives" Kaplan claims that the occurrence of a demonstrative must be supplemented by an act of demonstration, like a pointing (a feature of the objective context). Conversely in "After-thoughts" Kaplan argues that the occurrence of a demonstrative must be supplemented by a directing intention (a feature of the intentional con-text). I present the two theories in competition and try to identify the constraints an intention must satisfy in order to have semantic rele-vance. My claim is that the analysis of (...) demonstrative reference pro-vides a reliable test for our intuitions on the relation between objective and intentional context. I argue that the speaker's intentions can play a semantic role only if they satisfy an Availability Constraint: an inten-tion must be made available or communicated to the addressee, and for that purpose the speaker can exploit any feature of the objective con-text. This thesis implies the reconciliation between "Demonstratives" and "Afterthoughts". (shrink)

This chapter shows that taboos erected around crimes inhibit individuals and nations' work of mourning for the victims of crimes. The work of mourning is the precondition that individuals and nations take responsibility for past crimes, show solidarity with the victims and their descendants, and make sure that such crimes are not repeated. I bring Theodor W. Adorno and Sigmund Freud in conversation to explain the connection between taboos and the failure to mourn. I further detail this connection with Antigone (...) as an example of taboo and denied mourning. I also explain that the taboos erected around the National Socialist genocide on Roma and Sinti ("gypsies") do not allow Austrians to mourn the loss of this population. As a result, their taking responsibility for this crime remains stifled, and they fail to show solidarity with the Roma and Sinti genocide victims. (shrink)

One of the perennially intriguing questions regarding Kant’s approach to the human sciences is the relation between his ‘transcendental psychology’ and empirical cognitive psychology. In this paper I compare his analysis of the a priori conditions of human cognition in the Critique of pure reason with his empirical account of the human cognitive faculties in his Anthropology from a pragmatic point of view. In comparing his approach to self-consciousness, sensibility, imagination, and understanding in these two works, I argue that Kant (...) distinguishes between the transcendental and empirical aspects of the human cognitive faculties, and regards the transcendental functions as configuring the empirical faculties of human consciousness, or as giving them the structure that they require to become faculties of cognition. I then show that the cognitive faculties of human beings may vary in their empirical operation, even while they are configured by the same transcendental structure. Finally, I characterize Kant’s transcendental psychology in the first Critique as an account of the faculties that are required for a mind to be an agent or subject of cognition, corresponding to his account of the conditions that are required universally and necessarily for something to be an object of cognition.Keywords: Immanuel Kant; Anthropology; Psychology; Cognition; Transcendental; Empirical. It is possible to raise and solve philosophical problems with no very clear idea of what philosophy is, what it is trying to do, and how it can best do it; but no great progress can be made until these questions have been asked and some answer to them given ( Collingwood, 2005 , p. 1).

Adorno to explain some of the psychoanalytic mechanisms that contributed to a scenario where people voted for a leader who undermines their very existence. Trump successfully exploited the feelings of failure of the millions of Americans who have not lived up to the liberal capitalist ideology of success. By replacing their ego ideal with their leader, Trump voters could get rid of the frustration generated by such an ideology. The (...) people “fell in love” with Trump because he gave them the illusion that they “can become great again.” Moreover, by lifting moral restrictions to being openly classist, racist, and sexist, Trump generated a permanent festival where the American people can feel better than classed, raced, and gendered Others and thus satisfied with themselves again. In football it was recently demonstrated, that patterns of motivational constructs in young talented football players are relatively stable in early adolescence, and are associated with specific performance related outcomes (Zuber, Zibung, & Conzelmann, 2015). The aim of the present study was to check whether the motivational patterns found in youth elite football also re-emerge in ice hockey, showing similar relations to performance. 135 young male ice hockey talents (MAge = 17.26, SD = 1.24) playing on the highest and second (...) highest level of their age group were questioned about five motivational constructs. Six months later, their coaches rated their players’ current game performance. The results demonstrated a very high similarity of the patterns in ice hockey with the ones earlier found in football. In terms of the transition to performance levels, the highly intrinsically achievement-oriented players were rated by their coaches as belonging to the top-level players significantly more often (OR = 2.6), whereas the non-achievement-oriented failure-fearing players show a higher chance to be rated as part of the lowest performance group (OR = 3.8). The results indicate the importance of achievement motivation for performance in ice hockey also, and this generalizability thus provides relevant clues which are important for consideration in national programs for talent identification across several sports. In response to Helmut Heid's critique of domesticated philosophical critique, I focus on the metaphor of domestication, which is central to his article. Drawing on the work of Jacques Derrida, I offer a deconstructive critique of the opposition between domesticated and undomesticated critique, arguing that a clear conceptual demarcation between the two is impossible, and that ‘domesticated’ and ‘undomesticated’ critique always carry each other's traces. I explore connections between the undomesticated and das Unheimliche (Freud's ‘Uncanny’), as well as differences between (...) Helmut Heid's and Paulo Freire's interpretation and use of the concepts of ‘domestication’ and ‘liberation’. Lastly, I examine how educators might go about a pedagogy of critique. I argue that critique can and should be understood and taught as a tradition, but one that is heterogeneous rather than monolithic. A careful reception of this translated and metonymic tradition of critique will enable students to see the spaces in which new critique—and critique of critique— is possible. (shrink)

This article contributes to the analysis of refusal to license cases as abuse of a dominant position pursuant Article 82 EC from an economic perspective. In the Microsoft case, the European Commission introduced an "Incentives Balance Test" to assess whether the refusal to give access to interface information can be justified by arguing that this information is protected by Intellectual Property Rights (IPRs): The Commission argued that if the overall innovative effects evoked by a compulsory license are significantly higher than (...) without this access, the IPR owner is obliged to license. This should be assessed through balancing the different incentives to innovate between the dominant firm and its competitors. In the paper we pursue two objectives: Firstly, we analyze to what extent the decision of the Court of First Instance, which confirmed the decision of the Commission, helps to clarify the criteria in refusal to license cases; in fact, it is disappointing in this regard. Secondly, we demonstrate that the basic idea of the Incentives Balance Test can be interpreted as a test whether the specific IPRs of the dominant firm can be defended from the perspective of the economics of IPRs. This implies that Article 82 allows competition law to correct economically not optimal IPRs through a specific economic analysis. This is followed by a broad overview on theoretical and empirical insights from economics of IPRs, innovation economics and competition and network economics that can help to develop a more general and sophisticated Innovation Effects Test that can be applied in Article 82 refusal to license cases. Contextualism in philosophy of language and in epistemology are two distinct but closely entangled projects. The epistemological thesis is grounded in a semantic claim concerning the context-sensitivity of the predicate “know”: we gain insight into epistemological problems by investigating our linguistic intuitions concerning knowledge attribution sentences. Our aim here is to evaluate the plausibility of a project that takes the opposite starting point: the general idea is to establish the semantic contextualist thesis on the epistemological one. According to semantic contextualism, (...) virtually no sentences of a natural language express complete propositions – meaning underdetermines truth conditions. In our paper, instead of assuming the traditional view of meaning in terms of truth conditions, we suggest that a theory of meaning as justification may shed new light on the contextualist approach. We thus show how the notion of justification can be contextualized, arguing that our attempt provides an interesting and quite straightforward way of contextualizing meaning. (shrink)

In recent years the French philosopher Jacques Rancière has addressed the predicament of artists and curators who, in their eagerness to convey a critical message or engage their viewers in an emancipatory process, end up predetermining the outcomes of the experience, hence blocking its critical or emancipatory potential. In this essay I consider Rancière’s writing on this topic and draw out the parallels with the predicament of teachers and curriculum designers who have critical and emancipatory objectives. The risk of education (...) that strives for emancipation is that it can become so directive in steering students to the “right” outcomes that it does not leave these students any intellectual room. Rancière’s work is helpful in reminding us that teachers and curricula with explicitly critical, political, emancipatory objectives can defeat their own purposes and become stultifying if they do not leave the student room to use her or his own intelligence. This article explores various scenes of shame, raising the questions of what shame discloses about the self and how this self-disclosure takes place. Thereby, the common idea that shame discloses the self’s debasement will be challenged. The dramatic dialectics of showing and hiding display a much more ambiguous, dynamic self-image as result of an interactive evaluation of oneself by oneself and others. Seeing oneself seen contributes to the sense of who one becomes. From being absorbed in what one does, one (...) might suddenly become self-aware, shift viewpoints and feel pressed to put on masks. In putting on a mask, one relates to oneself in distancing oneself from oneself. In being at once a moral agent and a performing actor with an audience and norms in mind, one embodies and transcends the social roles one takes. In addition to the feeling of shame, in which the self finds itself passively reflected, the self’s active reflections on its shame are to be taken into account. As examples from Milan Kundera, Shakespeare’s King Lear, a line from Kingsley Amis, a speech by Vaclav Havel and Adam Smith’s Theory of Moral Sentiments indicate, self-presentation in the public and the private sphere is a complex hermeneutical process with surprising twists. By reference to the Aristotelian meditation, this essay undertakes to articulate an understanding of phronesis and sophia, praxis and theoria, in their belonging together. In so doing, it strives to overcome the traditional opposition of these terms, an opposition preserved even by those thinkers, such as Gadamer and Arendt, who have emphasized the practical over against the theoretical simply by inverting the order of the hierarchy.What is at stake, ultimately, is thinking ethics as first philosophy, i.e., seeing the philosophical articulation (...) of scientific knowledge, even of ontology, as resting on (belonging in) living-in-action, as phenomenologically, phenomenally, sensibly grounded. Of course, “ethics as first philosophy” here can mean neither a normative-prescriptive compilation nor a self-founding, autonomous discourse. Rather, the phrase names the comprehensiveness of ethics vis-à-vis all mannerof human endeavor and the openness of ethics vis-à-vis that which exceeds it, that which is irreducible to discourse and in which the ethical discourse belongs. A Priestley duality is developed for the variety j of all modal lattices. This is achieved by restricting to j a known Priestley duality for the variety of all bounded distributive lattices with a meet-homomorphism. The variety j was first studied by R. Beazer in 1986.The dual spaces of free modal lattices are constructed, paralleling P.R. Halmos'' construction of the dual spaces of free monadic Boolean algebras and its generalization, by R. Cignoli, to distributive lattices with a quantifier.

This article investigates difficulties in defining the concept of God by focusing on the question of what it means to understand God as a ‘person.’ This question is explored with respect to the work of Søren Kierkegaard, in dialogue with Franz Rosenzweig, Martin Buber, and Emmanuel Levinas. Thereby, the following three questions regarding divine ‘personhood’ come into view: First, how can God be a partner of dialogue if he at the same time remains unknown and unthinkable, a limit-concept of understanding? (...) Second, if God is love in person and at the same time a spiritual reality ‘between’ human agents, in what ways are his personal and trans-personal traits related to each other? Third, what exactly is revealed through God’s ‘name’? By way of an inconclusive conclusion, divine personhood is discussed in regard to prayer, where the problems of predication that arise in third-personal speech about God are linked with the second-personal encounter with God. This chapter examines Soren Kierkegaard's writings about and related to phenomenology. It evaluates whether Kierkegaard's account of religious life can be considered a phenomenology of religion, and reviews arguments for and against interpreting Kierkegaard as a phenomenologist. The chapter also explores the relation between Kierkegaard and phenomenology by examining the influence of Georg Wilhelm Friedrich Hegel's Phenomenology of Spirit in Kierkegaard, and by comparing Edmund Husserl's and Martin Heidegger's forms of phenomenology to that of Kierkegaard.

This article explores the ethical implications of the dialectics between the human being’s visibility and invisibility by means of a phenomenological approach: In what ways can ›human dignity‹ be experienced, and to what extent does it, as a normative notion, transcend its possible givenness to experience? While there is a consensus that the requirement of respect is implied in this notion, it is controversial how this requirement is realized and fulfilled. Kierkegaard’s ethics of loving vision and Sartre’s description of the (...) objectifying gaze inform a discussion of the feeling of shame: can it protect the dignity of the other person? The following three levels of argumentation will be taken into account: An exchange of glances denoting reciprocal recognition can, on the level of factuality, count as the condition for the subjective constitution of human dignity insofar as it can be experienced in actual contexts of interaction. In a legal context, the constitutional principle of all people’s invisible, inviolable dignity, which is the source of their rights and deserves protection regardless of people’s characteristics and behavior, must be defended against the idea that human dignity is nothing but a contingent, self-posited norm or gradual attribute. The theological dimension of human dignity is considered in regard to its non-empirical ground and destination and to the question of whether human dignity persists post mortem. (shrink)
