Based on the understanding of the term rhetoric that transcends the notion of literary genre, this book offers new answers to the questions of the provenance and the role of the main rhetorical strategies in Lucretius' De rerum natura.

The causal Markov condition (CMC) plays an important role in much recent work on the problem of causal inference from statistical data. It is commonly thought that the CMC is a more problematic assumption for genuinely indeterministic systems than for deterministic ones. In this essay, I critically examine this proposition. I show how the usual motivation for the CMC—that it is true of any acyclic, deterministic causal system in which the exogenous variables are independent—can be extended to the indeterministic case. We consider HA*, that is Heyting's Arithmetic extended with transfinite induction over all recursive well orderings, which may be viewed as defining constructive truth, since PA* agrees with classical truth. We prove that Markov's Principle, as a schema, is not provable in HA*, but that HA* is closed under Markov's Rule.

This paper explores the relationship between a manipulability conception of causation and the causal Markov condition (CM). We argue that violations of CM also violate widely shared expectations—implicit in the manipulability conception—having to do with the absence of spontaneous correlations. They also violate expectations concerning the connection between independence or dependence relationships in the presence and absence of interventions.

The authors argue that their target is orthogonal to the realism and instrumentalist debate. I argue that it is born directly from it. While the distinction is helpful in illuminating how some ontological commitments demand a theory of implementation, it's less clear whether different views cleanly map onto the epistemic and metaphysical uses defined in the paper.

Bruineberg et al. provide compelling clarity on the roles Markov blankets could (and perhaps should) play in the study of life and mind. However, here we draw attention to a further role blankets might play: as a hypothesis about cognition itself. People and other animals may use blanket-like representations to model the boundary between themselves and their worlds.

Woodward present an argument for the Causal Markov Condition (CMC) on the basis of a principle they dub ‘modularity’ ([1999, 2004]). I show that the conclusion of their argument is not in fact the CMC but a substantially weaker proposition. In addition, I show that their argument is invalid and trace this invalidity to two features of modularity, namely, that it is stated in terms of pairwise independence and ‘arrow-breaking’ interventions. In their rich and intricate paper ‘Independence, Invariance, and the Causal Markov Condition’, Daniel Hausman and James Woodward ([1999]) put forward two independent theses, which they label ‘level invariance’ and ‘manipulability’, and they claim that, given a specific set of assumptions, manipulability implies the causal Markov condition. These claims are interesting and important, and this paper is devoted to commenting on them. With respect to level invariance, I argue that Hausman and Woodward's discussion is confusing because, as I point (...) out, they use different senses of ‘intervention’ and ‘invariance’ without saying so. I shall remark on these various uses and point out that the thesis is true in at least two versions. The second thesis, however, is not true. I argue that in their formulation, the manipulability thesis is patently false and that a modified version does not fare better. Furthermore, I think their proof that manipulability implies the causal Markov condition is not conclusive. In order to make scientific results relevant to practical decision making, it is often necessary to transfer a result obtained in one set of circumstances—an animal model, a computer simulation, an economic experiment—to another that may differ in relevant respects—for example, to humans, the global climate, or an auction. Such inferences, which we can call extrapolations, are a type of argument by analogy. This essay sketches a new approach to analogical inference that utilizes chain graphs, which resemble directed acyclic graphs (...) (DAGs) except in allowing that nodes may be connected by lines as well as arrows. This chain graph approach generalizes the account of extrapolation I provided in my (2008) book and leads to new insights that integrate the contributions of the other participants of this symposium. More specifically, this approach explicates the role of “fingerprints,” or distinctive markers, as a strategy for avoiding an underdetermination problem having to do with spurious analogies. Moreover, it shows how the extrapolator’s circle, one of the central challenges for extrapolation highlighted in my book, is closely tied to distinctive markers and the Markov condition as it applies to chain graphs. Finally, the approach suggests additional ways in which investigations of a model can provide information about a target that are illustrated by examples concerning nanomaterials in sunscreens and Wendy Parker’s discussion of fingerprints in climate science. We classify every finitely axiomatizable theory in infinite-valued propositional Łukasiewicz logic by an abstract simplicial complex equipped with a weight function . Using the Włodarczyk–Morelli solution of the weak Oda conjecture for toric varieties, we then construct a Turing computable one–one correspondence between equivalence classes of weighted abstract simplicial complexes, and equivalence classes of finitely axiomatizable theories, two theories being equivalent if their Lindenbaum algebras are isomorphic. We discuss the relationship between our classification and Markov’s undecidability theorem for PL-homeomorphism of (...) rational polyhedra. (shrink)

Quantum mechanics posits that the wave function of a one-particle system evolves with time according to the Schrödinger equation, and furthermore has a square modulus that serves as a probability density function for the position of the particle. It is natural to wonder if this stochastic characterization of the particle's position can be framed as a univariate continuous Markov process, sometimes also called a classical diffusion process, whose temporal evolution is governed by the classically transparent equations of Langevin and Fokker-Planck. Daniel Hausman and James Woodward claim to prove that the causal Markov condition, so important to Bayes-nets methods for causal inference, is the ‘flip side’ of an important metaphysical fact about causation—that causes can be used to manipulate their effects. This paper disagrees. First, the premise of their proof does not demand that causes can be used to manipulate their effects but rather that if a relation passes a certain specific kind of test, it is causal. Liver transplantation (LT) activities during the COVID-19 pandemic have been curtailed in many countries. The impact of various policies restricting LT on outcomes of potential LT candidates is unclear. We studied all patients on the nationwide LT waitlists in Hong Kong and Singapore between January 2016 and May 2020. We used continuous time Markov chains to model the effects of different scenarios and varying durations of disruption on LT candidates.

Multivariate pattern analysis can reveal new information from neuroimaging data to illuminate human cognition and its disturbances. Here, we develop a methodological approach, based on multivariate statistical/machine learning and time series analysis, to discern cognitive processing stages from functional magnetic resonance imaging (fMRI) blood oxygenation level dependent (BOLD) time series. We apply this method to data recorded from a group of healthy adults whilst performing a virtual reality version of the delayed win-shift radial arm maze (RAM) task. This task has (...) been frequently used to study working memory and decision making in rodents. Using linear classifiers and multivariate test statistics in conjunction with time series bootstraps, we show that different cognitive stages of the task, as defined by the experimenter, namely, the encoding/retrieval, choice, reward and delay stages, can be statistically discriminated from the BOLD time series in brain areas relevant for decision making and working memory. Discrimination of these task stages was significantly reduced during poor behavioral performance in dorsolateral prefrontal cortex (DLPFC), but not in the primary visual cortex (V1). Experimenter-defined dissection of time series into class labels based on task structure was confirmed by an unsupervised, bottom-up approach based on Hidden Markov Models. Furthermore, we show that different groupings of recorded time points into cognitive event classes can be used to test hypotheses about the specific cognitive role of a given brain region during task execution. We found that whilst the DLPFC strongly differentiated between task stages associated with different memory loads, but not between different visual-spatial aspects, the reverse was true for V1. Our methodology illustrates how different aspects of cognitive information processing during one and the same task can be separated and attributed to specific brain regions based on information contained in multivariate patterns of voxel activity. At the basis of tireless efforts to explain the nature of law lies the question of how judges should decide cases. Therefrom arises a need for a theory that would clarify the role of the courts and, moreover, provide guidance to them on reaching judgments. The history of legal theory abounds with various attempts to offer a generally acceptable answer to the question raised. The fervor of debate and the perpetual dissatisfaction with offered solutions prompted the thought of untamable arbitrariness (...) of judges. In the contemporary debate the significance of argumentation is particularly emphasized as a link of the court procedure which provides reasonableness and therewith justification and persuasiveness of the decision. Before going into the matter, I will indicate in broad strokes which areas of legal theory do argumentation and interpretation belong to. The purpose of setting a conceptual framework is to prevent losing sight of the whole as well as to limit the scope of discourse to a certain section of legal issues. The second part deals with the concept of argumentation in general and some specific features of the argumentation in law. The third part examines the role of legal interpretation and draws a clear distinction between the interpretation as a process and the interpretation as a result. At the end of the discussion I shall put forward a thesis that the interpretation as a process is argumentation, while the interpretation as a result is an argument in the justification of judgment. nema. Unchosen transformative experiences—transformative experiences that are imposed upon an agent by external circumstances—present a fundamental problem for agency: how does one act intentionally in circumstances that transform oneself as an agent, and that disrupt one’s core projects, cares, or goals? Drawing from William James’s analysis of conversion and Matthew Ratcliffe’s account of grief, I give a phenomenological analysis of transformative experiences as involving the restructuring of systems of practical meaning. On this analysis, an agent’s experience of the world is structured (...) by practically significant possibilities that form organized systems on the basis of the agent’s projects and relationships. Transformative experiences involve shifts to systems of possibility, that is, changes to habitual meanings and to how an agent’s projects are situated in relation to one another. I employ the enactivist notion of sense-making to analyze how an agent rebuilds the meaning structures disrupted by a transformative experience. In an unchosen transformative experience, an agent adjusts to a significant disruption through a process of sense-making in precarious conditions. By establishing new patterns of bodily and social interaction with the world, one alters the practical meanings of one’s surroundings, and thereby reconstitutes oneself as an intentional agent. In this paper, we present a method for introducing law students to the writing of legal documents. The method uses a machine-readable representation of the legal knowledge to support document assembly and to help the students to understand how the assembly is performed. The knowledge base consists of enacted legislation, document templates, and assembly instructions. We propose a system called LEDAS (LEgal Document Assembly System) for the interactive assembly of legal documents. It guides users through the assembly process and provides (...) explanations of the interconnection between input data and claims stated in the document. The system acts as a platform for practicing drafting skills and has great potential as an education tool. It allows teachers to configure the system for the assembly of some particular type of legal document and then enables students to draft the documents by investigating which information is relevant for these documents and how the input data shape the final document. The generated legal document is complemented by a graphical representation of legal arguments expressed in the document. The system is based on existing legal standards to facilitate its introduction in the legal domain. Applicability of the system in the education of future lawyers is positively evaluated by the group of law students and their TA. (shrink)

I have conducted a similar investigation on a text by a different author. The results of this investigation, which was performed on a text passage of 100,000 letters, are presented in the following tables from which one can see how and to what extent the limit theorems of the calculus of probability actually become evident.

In the past few decades, a growth in ethical consumerism has led brands to increasingly develop conscientiousness and depict ethical image at a corporate level. However, most of the research studying business ethics in the field of corporate brand management is either conceptual or has been empirically conducted in relation to goods/products contexts. This is surprising because corporate brands are more relevant in services contexts, because of the distinct nature of services and the key role that employees have in the (...) services sector. Accordingly, this article aims at empirically examining the effects of customer perceived ethicality in the context of corporate services brands. Based on data collected for eight service categories using a panel of 2179 customers, the hypothesized structural model is tested using path analysis. The results show that, in addition to a direct effect, customer perceived ethicality has a positive and indirect effect on customer loyalty, through the mediators of customer affective commitment and customer perceived quality. Further, employee empathy positively influences the impact of customer perceived ethicality on customer affective commitment, and customer loyalty positively impacts customer positive word-of-mouth. The first implication of these results is that corporate brand strategy needs to be aligned with human resources policies and practices if brands want to turn ethical strategies into employee behavior. Second, corporate brands should build more authentic communications grounded in their ethical beliefs and supported by evidence from actual employees. (shrink)

Since in Heyting Arithmetic all atomic formulas are decidable, a Kripke model for HA may be regarded classically as a collection of classical structures for the language of arithmetic, partially ordered by the submodel relation. The obvious question is then: are these classical structures models of Peano Arithmetic ? And dually: if a collection of models of PA, partially ordered by the submodel relation, is regarded as a Kripke model, is it a model of HA? Some partial answers to these (...) questions were obtained in [6], [3], [1] and [2]. Here we present some results in the same direction, announced in [7]. In particular, it is proved that the classical structures at the nodes of a Kripke model of HA must be models of IΔ1 and that the relation between these classical structures must be that of a Δ1-elementary submodel.
