Generality is a key value in scientific discourses and practices. Throughout history, it has received a variety of meanings and of uses. This collection of original essays aims to inquire into this diversity. Through case studies taken from the history of mathematics, physics and the life sciences, the book provides evidence of different ways of understanding the general in various contexts. Some legal theorists deny that states can conceivably act extra-legally, in the sense of acting contrary to domestic law. This position finds its most robust articulation in the writings of Hans Kelsen, and has more recently been taken up by David Dyzenhaus in the context of his work on emergencies and legality. This paper seeks to demystify their arguments and, ultimately, contend that we can intelligibly speak of the state as a legal wrongdoer or a legally unauthorized actor.

Scholars such as Renaud Barbara and Bernhard Waldenfels and Regula Giuliani have emphasized time’s central role in Merleau-Ponty’s philosophy, and Michael Kelly has shown how the Phenomenology’s “Temporality” chapter already broaches his later ontological concerns. I deepen our understanding of this temporal–ontological nexus by showing how Merleau-Ponty’s temporal ontology in fact erupts even earlier in the Phenomenology, as an underlying theme that unifies part two, on “The Perceived World,” as leading into the “Temporality” chapter. I do this via a (...) close study of the chapter, “The Thing and the Natural World,” first explicating some profound but easily overlooked points about time implied in Merleau-Ponty’s initial remarks on the constancy of form and size. I then closely analyze his study of color constancy in relation to his central source, David Katz’s The World of Colour, to show how color leads him to conceptualize things as what I call “time-things”—and more generally to conceptualize things, the world, and nature, as being in such a way that temporality is ingredient in their being. This leads to some implications for his temporal ontology. (shrink)

One of the most suggestive points of contact between the thought of the Japanese philosopher and psychiatrist Kimura Bin and the phenomenology of Renaud Barbaras is the parallel between the way the concepts of life as a movement (of becoming) and as an event (of individuation) function in Barbaras’s work, and the way that Kimura employs the terms bios (the individuated life of the organism) and zoē (life as the shared power in all living things). This conceptual frame enables (...) both thinkers to give an account of life as an event that itself is caught up in the ongoing activity of the world. The article shows that bringing Kimura’s work together with Barbaras’s allows us to apprehend something that neither alone could fully grasp: the character of human life as an unfolding event that, as continuous with the life of the world, can be more fully effectuated as a movement of self-realization. Uncut is a book about two kinds of paradoxes: paradoxes involving truth and its relatives, like the liar paradox, and paradoxes involving vagueness. There are lots of ways to look at these paradoxes, and lots of puzzles generated by them, and Uncut ignores most of this variety to focus on a single issue. That issue: do our words mean what they seem to mean, and if so, how can this be? I claim that our words do mean what they seem (...) to, and yet our language is not undermined by paradox. In this article I take up a central question posed by the article jointly authored with Bill Winslade in this issue of JCE: What should be the role of clinical ethics consultants (CECs) in (what we call) an unsettled case: that is, a situation in which the range of allowable choices, among which the parties to a bioethical disagreement must select, cannot be clearly or completely specified? I argue here that CECs should, in such cases, guide the parties by presenting (...) their own reasoned conclusions about what the scope of allowable choices should be taken to include. Since this position challenges the received view that CECs must not express their own moral positions or conclusions in their role as ethicists, I try to defend my view of the CEC’s role in unsettled cases against several objections. If the open society is a society that ‘sets free the critical powers of man’ (Popper, 1945, Introduction), then the subject of critical thinking, now widely taught in universities in North America and at the level of further education in the UK, might seem to be a welcome innovation. Caution is advised. By mistakenly supposing that thinking intelligently is identical with thinking logically, critical thinking textbooks almost invariably regard the purpose of argument to be a combination of justification and persuasion, (...) authoritarian goals that critical rationalists, and other supporters of the open society, must shun. If students do not learn the proper place of reason, and its limitations, they will be disappointed when it fails, and like many irrationalists in the past, may be induced to reason their way out of reason altogether. Waldo (philosophy, Susquehanna U.) proposes that spiritual inquiry is not a matter of formulating and defending a theory of knowledge, but of cultivating a certain kind of character and style of thinking.

Inferential Internalists accept the Principle of Inferential Justification (PIJ), according to which one has justification for believing P on the basis of E only if one has justification for believing that E makes probable P. Richard Fumerton has defended PIJ by appeal to examples, and recently Adam Leite has argued that this principle is supported by considerations regarding the nature of responsible belief. In this paper, I defend a form of externalism against both arguments. This form of externalism recognizes what (...) I call the phenomenon of reflective defeat: if one is justified in not believing that E makes probable P, then this defeats whatever justification one has for believing P upon the basis of E. I argue that this modified version of externalism has the virtue of accommodating the intuitions that motivate internalism, without the cost of the vicious regress that makes internalism so unattractive. Case presentations, esthetics, insurance considerations, communicable diseases, referral questions, dental phobia, and legal concerns all play a role in doctor-patient relationships. These topics, and many others, are the subject of this one-of-a-kind resource, designed to show dental students and practitioners how to approach patient relationships.

Throughout much of the world, universities have driven towards industrial partnerships. This collaboration, which, in the biochemical field at least, has to continue if potential benefits for patients are to be realised, has brought with it a number of problems. These include the neglect of long-term research in favour of short-term projects, the curtailing of free dissemination of research information within university departments and the biasing of results of clinical trials by the financial interests of the investigators. It is very (...) important that governments, universities, and industry itself address these problems. Universities should monitor the amount of basic, curiosity-driven research that is being carried on, compared with that which is more short-term goal orientated. PhD students and post-doctoral fellows should be exposed to the principles of bioethics early on in their careers. Further work is necessary on the terms of research contracts to protect, on the one hand, the rights of individual scientists and, on the other, industry from rogue scientists. Where problems arise, procedures should be in place for independent reviews to be conducted by bodies such as the Medical Research Council in the UK or the National Institutes of Health in the USA. The conflict-of-interest rules recently introduced for publication in medical journals should be extended to all branches of science. (shrink)

This theoretical paper takes an agency-theoretic approach to questions of corporate social responsibility (CSR). A comparison of various extant frameworks focusses on how CSR agency emerges in complex multi-agent and multi-sector stakeholder networks. The discussion considers the respective capabilities and relevance of these frameworks – culminating in an integrative CSR practice model. A short literature review of the evolution of CSR since the 1950’s provides the backdrop for understanding multi-agent cross-sectoral stakeholder coalitions as a strategic determinant of today’s organizational behavior. The paper turns to Werhane’s coupling of moral imagination and systems thinking and forging stakeholder coalitions in problem contexts that were traditionally deemed intractable by for-profit organizations. However, it identifies the problem that the systems approach treats macro-agents (organizations, stakeholders) as given (“black-boxed”) and shies away from more radically re-imagining the possibilities of reassembling agency from the bottom up. Actor Network Theory (ANT) provides such a method, which strictly commits to treating organizational behavior as a product of technological, human and environmental micro-processes. ANT, however, is lacking a genuine moral deliberative stance in designing complex CSR coalitions. In an attempt to capitalize on the respective strengths of these frameworks (Systems thinking and ANT) the paper tends to a recent iterative series of “situational transactive” models that are rooted in the US pragmatist tradition and seek to capture intelligent planning processes in complex problematic contexts. The contribution proposes a new CSR practice model, which assigns specific roles to the theoretical contributions of ANT, system thinking and pragmatism in complex deliberation processes. Most discussions of the relationship between liberty and security focus on the idea that enhancing citizens’ security may require imposing constraints on their civil liberties. This paper explores the question of how measures to enhance security stand vis à vis the idea of political liberty, i.e. the idea of citizens’ collectively directing the power of their state. It distinguishes two models whereby citizens might enact that ideal of self-rule and argues that with respect to issues of national security, the less (...) direct model, which entrusts political agents to make decisions beyond direct democratic input, will often be more appropriate. It argues as well that various practices often seen as fundamentally at odds with the ideal of rule by the people are in fact consistent with a reasonable construal of that ideal. It concludes by outlining various criteria that would have to be met for such practices to be morally permissible in democratic states. (shrink)

Essa mudança na física exigiu que físicos e filósofos repensassem os conceitos pelos quais se podiam representar a realidade, uma vez que as noções clássicas se revelaram limitadas na compreensão dos fenômenos atômicos. O filósofo francês G. Bachelard e o físico alemão W. Heisenberg são autores que discorreram acerca das grandes modificações que ocorreram no seio da física, e, com isso, trataram do problema da linguagem na mecânica quântica. Neste artigo, o (...) objetivo é recorrer aos argumentos de ambos os autores para evidenciar relações entre suas ideias acerca da temática referida. Destaca-se que Bachelard e Heisenberg criticam a aplicação da linguagem usual e dos conceitos filosóficos da modernidade na nova física, mas, mediante sua noção de ruptura, o filósofo francês propõe que a mecânica quântica se restrinja à linguagem matemática. Ideia esta que vai contra ao princípio de complementaridade de Bohr, admitido por Heisenberg na compreensão dos fenômenos quânticos e para uma interpretação da física quântica. (shrink)

Ayn Rand and Friedrich Hayek were notable 20th century advocates of libertarianism, and both of them based their political views, in part, on theories in epistemology. This paper discusses the radical difference in their views on a core epistemological issue, the nature of abstractions. Rand held that we form abstractions from the observation of particular, concrete things. Hayek held the opposite view that abstractions are primary; some are innate, some acquired from our cultural environment, but neither can be independently supported (...) by observation of concretes. Kelley will show why Hayek’s view is both false and inconsistent with a fully individualist moral and political theory. (shrink)

David Brown explores the ways in which the symbolic associations of the body and what we do with it have helped shape religious experience and continue to do so. A Church narrowly focused on Christ's body wracked in pain needs to be reminded that the body as beautiful and sexual has also played a crucial role not only in other religions but also in the history of Christianity itself. Dance was one way in which the connection was expressed. The (...) irony is not that such a connection has gone but that it now exists almost wholly outside the Church. Much the same could be said about music more generally, and Brown writes excitingly about the spiritual potential of not just classical music but also pop, jazz, musicals, and opera. Like Brown's much-praised earlier volumes, God and Enchantment of Place, Tradition and Imagination, and Discipleship and Imagination, the present book will enlarge horizons and challenge the narrowness of much theological thinking. Blair, David Concerning David Tribe's rejoinder to my 'Science works better than that' , it's pleasing to see that there are some points on which we agree. Unfortunately he continues to make a strong and unjustified attack on the scientific community as a whole-essentially on the grounds that, of the conclusions of science that later turned out to be false, virtually all of them were at some time 'believed' by most scientists. In reply, I shall show that it (...) is his underlying framework that needs to be altered-quite radically. He does not understand what the activity of scientists is like-indeed what it has to be like, when faced with the task of extracting knowledge from the real world. (shrink)

Tribe, David Victor Bien's 'Scientific authority: consensually agreed knowledge of nature' (AH, Winter 2012) has stimulated me to reply and dilate on other scientific principles. As a respected PhD in physical chemistry (and an IT authority) he's making a 'contribution to advancing secular ethics'. My credentials are those of a student of physical, biological, psychological and social sciences for over 60 years and author of many pieces on secular ethics, notably Nucleo-ethics: Ethics in Modern Society (1972).

This book collects essays from the 2006 and 2007 International Philosophy Colloquia Evian, centred around a central problem in the philosophy of mind: the relationship between the human faculty of sensory experience and the faculty of conceptual reflection, that is self-consciousness. Containing articles by philosophers of eight nationalities, in three languages (English, French, German), and of "analytical" as well as "continental" provenance, it beautifully represents the spirit of the colloquia. In this dialogue between two interlocutors, the ontology of childhood is considered, first from the point of view of temporality, then power, then language, then from the perspective of philosophy, and inquires whether there is a specific philosophical and/or childlike dialectic of questioning and answering. The claim is made that both the philosopher and the artist carry a childlike way of questioning and acting on the world into adulthood. The discussion then moves to education, and considers the possibility of reconstructing (...) the latter beyond the Platonic notions of “formation,” reproduction, discipline and subjection, and evaluates the role of philosophical dialogue in a school setting as an agent of transformation. Plato’s _Parmenides_ and Aristotle’s _Metaphysics_ initiated the discussion of the “First Philosophy” in the Western canon. Here, David Shwayder continues this debate by considering statements as the fundamental bearers of truth-values. Systematically moving from action to utterance, Shwayder argues that the category of “bodies” is fundamental to the human scheme of conceptualization and that if we had no capacity to refer to bodies then we would be unable to address referents from other categories.
