This article applies the Kantian doctrine of respect for persons to the problem of sweatshops. We argue that multinational enterprises are properly regarded as responsible for the practices of their subcontractors and suppliers. We then argue that multinationalenterprises have the following duties in their off-shore manufacturing facilities: to ensure that local labor laws are followed; to refrain from coercion; to meet minimum safety standards; and to provide a living wage for employees. The Modern Synthesis has dominated biology for 80 years. It was formulated in 1942, a decade before the major achievements of molecular biology, including the Double Helix and the Central Dogma. When first formulated in the 1950s these discoveries and concepts seemed initially to completely justify the central genetic assumptions of the Modern Synthesis. The Double Helix provided the basis for highly accurate DNA replication, while the Central Dogma was viewed as supporting the Weismann Barrier, so excluding the inheritance of (...) acquired characteristics. This article examines the language of the Modern Synthesis and reveals that it is based on four important misinterpretations of what molecular biology had shown, so forming the basis of the four Illusions: 1. Natural Selection; 2. The Weismann Barrier; 3. The Rejection of Darwin’s Gemmules; 4. The Central Dogma. A multi-level organisation view of biology avoids these illusions through the principle of biological relativity. Molecular biology does not therefore confirm the assumptions of the Modern Synthesis. There are two general approaches to characterising biological functions. One originates with Cummins. According to this approach, the function of a part of a system is just its causal contribution to some specified activity of the system. Call this the ‘C-function’ concept. The other approach ties the function of a trait to some aspect of its evolutionary significance. Call this the ‘E-function’ concept. According to the latter view, a trait's function is determined by the forces of natural selection. The C-function (...) and E-function concepts are clearly quite different, but there is an important relation between them which heretofore has gone unnoticed. The purpose of this paper is to outline that relation.This is not the first paper to discuss the relation of C-function and E-function. Previous attempts all follow either one of two strategies. The first proposes that the two concepts are ‘unified.’ The other proposes that they are radically distinct and apply to wholly different fields within biology. (shrink)

We review recent developments in ethical pluralism, ethical particularism, Kantian intuitionism, rights theory, and climate change ethics, and show the relevance of these developments in ethical theory to contemporary business ethics. This paper explains why pluralists think that ethical decisions should be guided by multiple standards and why particularists emphasize the crucial role of context in determining sound moral judgments. We explain why Kantian intuitionism emphasizes the discerning power of intuitive reason and seek to integrate that with the comprehensiveness of (...) Kant’s moral framework. And we show how human rights can be grounded in human agency, and explain the connections between human rights and climate change. (shrink)

In recent years, there has been an increasing interest among philosophers of memory in the questions of how to characterize and to account for the temporal phenomenology of episodic memory. One prominent suggestion has been that episodic memory involves a feeling of pastness, the elaboration of which has given rise to two main approaches. On the intentionalist approach, the feeling of pastness is explained in terms of what episodic memory represents. In particular, Fernández has argued that it can be explained (...) in terms of memory representing itself as being caused by a past perceptual experience. On the metacognitive approach, which we have recently developed in, the feeling of pastness results from the monitoring and interpretation of the processing features of episodic remembering. In this paper, we show that the metacognitive approach should be preferred over the intentionalist approach. We argue that intentionalism, and Fernández’ causal self-referential view in particular, ultimately fail as accounts of the feeling of pastness. The difficulties faced by intentionalism allows us to single out three constraints that any satisfactory account of the temporal phenomenology of episodic remembering needs to meet. We conclude by arguing that the metacognitive view satisfies those constraints in a neat way, and as such, that it should be preferred over intentionalism. (shrink)

In my view, a fundamental part of theology's contribution is an understanding of the Holy Spirit that can encourage the practice of genuine openness to the Spirit. It is already clear that this council will be an event of the Spirit. It will be an event in which the Spirit is invoked and in which (...) the Spirit acts. The question is: will we, who make up the church in this land, be open to the Spirit, and be faithful to the Spirit, in our contributions, responses, and actions? (shrink)

In this study, I will first introduce Husserl’s analysis in Studien zur Struktur des Bewußtseins by emphasizing the reasons that motivate these analyses on descriptive psychology and their status in Husserl’s transcendental phenomenology in the late Freiburg period. I will then focus on the structure of acts, with particular emphasis on three aspects stressed by Husserl in Studien: intentionality, the taxonomy of acts, and Brentano’s principle of the Vorstellungsgrundlage. The last three parts of this study outline the characteristic features of (...) three fundamental aspects of affective life in Husserl’s phenomenology: emotions, sense feelings, and moods. I will conclude with some general remarks on the status of affects and values in Husserl’s phenomenology. (shrink)

Denys Turner is a philosopher who holds a chair in Cambridge's Faculty of Divinity. In this erudite and entertaining lecture he explores the conditions for the belief that God does not exist. According to Turner, the first challenge lies in acknowledging the question 'Does God exist?' to be a valid one. Once the question is established, various things follow, each one making it harder to maintain 'atheism' as a credible or interesting position. Turner boxes atheists into a philosophical corner, showing (...) how the belief that something has come of nothing is itself an acknowledgement of God's existence. Enlisting the help of thinkers as diverse as Aquinas, Kant, Wittgenstein, Nicholas Lash and John Milbank, Turner's witty and provocative piece will be of interest to anyone engaged in religious enquiry who has wondered about the nature and status of atheism as a defendable intellectual position in our age. ABSTRACT:Little theoretical attention has been paid to the question of what obligations corporations and other business enterprises have to the four billion people living at the base of the global economic pyramid. This article makes several theoretical contributions to this topic. First, it is argued that corporations are properly understood as agents of global justice. Second, the legitimacy of global governance institutions and the legitimacy of corporations and other business enterprises are distinguished. Third, it is argued that a deliberative democracy (...) model of corporate legitimacy defended by theorists of political CSR is unsatisfactory. Fourth, it is argued that a Rawlsian theoretical framework fails to provide a satisfactory account of the obligations of corporations regarding global justice. Finally, an ethical conception of CSR grounded in an appropriately modest set of duties tied to corporate relationships is then defended. This position is cosmopolitan in scope and grounded in overlapping arguments for human rights. (shrink)

The problem in question presents several faces: viewed from one angle, it concerns the unity of the concept of “Being in general,” from another, the integrity of the notion (...) of “Dasein,” and from another, the possibility of the perspective from which the philosopher does her work. The purpose of this book is to highlight Carl Stumpf's contributions to philosophy and to assess some of the aspects of his work. This book brings together several specialists of Stumpf and the school of Franz Brentano, and includes fourteen original studies (in English and German) on the various aspects of Stumpf's philosophy, and some of his unpublished writings. This book is divided into four sections, and also includes a general introduction on the reception and actuality of Stumpf's philosophy. The fourth section consists of notes taken by Husserl during Stumpf's lectures on metaphysics in Halle, Stumpf's introduction to the edition of his correspondence with Brentano, which he prepared in 1929, and some important letters pertaining to this correspondence. The purpose of this study is to examine the meaning and value of the criticism that Stumpf address to Husserl's phenomenology in Ideas I. My presentation is divided into four parts: I briefly describe the relationship between Stumpf and the young Husserl during his stay in Halle (1886-1901); then I will comment Stumpf's remarks on the definition of Husserl's phenomenology as descriptive psychology in his Logical Investigations; in the third part, I examine Husserl's notice in section 86 of Ideas I (...) where he compares his own terminology to that of Stumpf; finally I comment on Stumpf's criticism of Husserl's phenomenology in his last book Erkenntnislehre. This paper examines Kant's accounts of friendship and marriage, and argues for what can be called an ideal of “moral marriage” based on Kant's notion of moral friendship. After explaining why Kant values friendship so highly, it gives an account of the ways in which marriage falls far short, according to Kant, of what friendship has to offer. The paper then argues that many of Kant's reasons for finding marriage morally impoverished compared with friendship are wrong‐headed. The paper further argues (...) that a few of Kant's views about friendship are false. The main point is that, when we slightly revise Kant's account of friendship and jettison Kant's misguided notions about marriage, we see that marriages can aspire to much of the same moral richness as friendships. Finally, the paper argues that this friendship model of marriage does not obscure the important ways in which marriages and friendships differ. (shrink)

Providing a principled characterization of the distinction between logical and non-logical expressions is a longstanding issue in the philosophy of logic. In the Logical Syntax of Language, Carnap proposes a syntactic solution to this problem, which aims at grounding the claim that logic and mathematics are analytic. Roughly speaking, his idea is that logic and mathematics correspond to the largest part of science for which it is possible to completely specify by "syntactic" means which sentences are valid and which are (...) not. Despite a renewed interest in the philosophical benefits of analyticity, both inside and outside of Carnap scholarship, Carnap's definition of logical expressions seems to have drawn too little attention. I shall argue that it is worth a second look. More precisely, my aim will be to defend this idea against some technical problems faced by Carnap's way of implementing it and against Quinean attacks on syntax-based conventionalism. Section 1 presents Carnap's definition in the context of Logical Syntax of Language, that is, how exactly the definition works, and why Carnap needs it. In section 2, I review three challenges that have been raised in the literature, and I propose to revise the definition accordingly. I argue that its modified version is immune to the previous challenges, and, to some extent, immune to new challenges as well. In the last section, I suggest that the definition has a philosophical interest of its own, because standard Quinean objections are not as conclusive as one might think when attention is paid to the fact that Carnap requires complete syntactic specification of validities. This paper investigates the nature and foundation of duties to oneself in Kant's moral theory. Duties to oneself embody the requirement of the formula of humanity that agents respect rational nature in them-selves as well as in others. So understood, duties to oneself are not subject to the sorts of conceptual objections often raised against duties to oneself; nor do these duties support objections that Kant's moral theory is overly demanding or produces agents who are preoccupied with their own virtue. Robert Pippin's new book, The Culmination, examines Heidegger's reading and critique of Kant and Hegel. Since Pippin is perhaps best known as one of the most influential contemporary advocates for the importance of engaging with the difficult work of Hegel in particular, it will no doubt surprise quite a few of his readers that, on some fundamental points, the book concludes that “Heidegger is right” (p. xi). In the present piece, I explore some intriguing issues that Pippin's book raises. Although (...) the disagreement between his principal parties is obviously central to his discussion, my main focus is on a possible point of important agreement that that discussion also opens up, in light of which Heidegger might be fruitfully interpreted as pursuing a variant of a Kantian/Hegelian project, though this will also lead me to make a number of critical points about Pippin's reading of Heidegger: although there are grounds for thinking that Pippin's Heidegger does subscribe to such a project, some of the considerations that Pippin advances in arguing that “Heidegger is right” sit uncomfortably—it seems to me—with that project. My working hypothesis is based on the project of a theory of science (Wissenschaftslehre) at the very beginning of the Prolegomena and it consists in conceiving this theory of science as the program which insures their cohesion to the whole of the Investigations in this work. In order to test this hypothesis, I will first examine the different steps which led to the project of a theory of science in the pre-phenomenological period. I will secondly expound the guidelines of the (...) theory of science, insisting in particular on its relation to pure logic. In the third section, I will attempt to define the function of the theory of knowledge and of phenomenology in such a programme. I will conclude with some remarks on the fate of this theory of science after the Logical Investigations. Most of Husserl’s allusions to the theory of science, be it in his lecture notes, the manuscripts that were written after 1901 or other works published during Husserl’s lifetime, seem to suggest that the theory of science kept on assuming the very role it was playing in Husserl’s seminal work: the theory of science provides its basis to Husserl’s philosophical agenda. This paper explores two models using which we might understand Heidegger's notion of ‘Eigentlichkeit’. Although typically translated as ‘authenticity’, a more literal construal of this term would be ‘ownness’ or ‘ownedness’; and in addition to the paper's exegetical value, it also develops two interestingly different understandings of what it is to have a judgment of one's own. The first model understands Heideggerian authenticity as the owning of what I call a ‘standpoint’. Although this model provides an understanding of a number (...) of key features of authenticity, it also invites an important objection—which I call ‘the closure objection’—that can be found in, for example, the work of Steven Galt Crowell and Tony Fisher. Although I argue that this objection can be met, the response for which it calls reveals that the feat of authenticity as understood through the standpoint model rests upon a further feat, and one which may itself have a stronger claim to be identified with Heideggerian authenticity. I develop this thought, introducing what I call the ‘all-things-considered judgment model’ of authenticity, the basis of which lies in, among other sources, Heidegger's appropriation of themes from Aristotle's discussion of phronesis. I explain the exegetical benefits of adopting this model and consider some objections that it invites, before closing with a discussion of how the two models understand the notion of ‘a judgment of one's own’. Over the past centuries the pendulum has constantly swung between an emphasis on the role of either nature or nurture in shaping human destiny, a pendulum often energised by ideological considerations. In recent decades the flourishing of developmental biology, genomics, epigenetics and our increased understanding of neuronal plasticity have all helped to subvert such dichotomous notions. Nevertheless, the media still report the discovery of a gene 'for' this or that behaviour, and the field of behavioural genetics continues to extend its (...) reach into the social sciences, reporting the heritability of such human traits as religiosity and political affiliation. There are many continuing challenges to notions of human freedom and moral responsibility, with consequent implications for social flourishing, the legal system and religious beliefs. In this book, Denis Alexander critically examines these challenges, concluding that genuine free will, often influenced by genetic variation, emerges from an integrated view of human personhood derived from contemporary biology. Some Kantian ethicists, myself included, have been trying to show how, contrary to popular belief, Kant makes an important place in his moral theory for emotions–especially love and sympathy. This paper confronts claims of Kant that seem to endorse an absence of sympathetic emotions. I analyze Kant’s accounts of different sorts of emotions (“affects,” “passions,” and “feelings”), and different sorts of emotional coolness (“apathy,” “self-mastery,” and “cold-bloodedness”). I focus on the particular way that Kant praises apathy, as “sublime,” in order (...) to argue that his praise of extreme emotional self-control is not incompatible with, but rather complementary to, his praise of sympathy. Libertarian theories of the normative core of the corporation hold in common the view that is the responsibility of publicity held corporations to return profits to shareholders within the bounds of certain moral side-constraints. Side-constraints may be either weak (grounded in the rules of the game) or strong (grounded in rights). This essay considers libertarian arguments regarding the normative core of the corporation in the context of global capitalism and in the light of actual corporate behavior. First, it is argued (...) the weak side-constraints view is conceptually incoherent when applied in a global context. Second, it is argued that proponents of the libertarian strong side-constraints view lack an adequate theory of rights. Third, both the weak side-constraints view and the strong side-constraints view are shown to be unsatisfactory insofar as they fail to adequately address the coercive power of corporations. The main conclusion of this essay is that a viable libertarian theory of the corporation has yet to be articulated. (shrink)

This article addresses the recent reception of Franz Brentano's writings on consciousness. I am particularly interested in the connection established between Brentano's theory of consciousness and higher-order theories of consciousness and, more specifically, the theory proposed by David Rosenthal. My working hypothesis is that despite the many similarities that can be established with Rosenthal's philosophy of mind, Brentano's theory of consciousness differs in many respects from higher-order theories of consciousness and avoids most of the criticisms generally directed to them. This (...) article is divided into eight parts. The first two sections expound the basic outline of Rosenthal's theory, and the third summarizes the principal objections that Rosenthal addresses to Brentano, which I, then, examine in sections 4 and 5. In sections 6 and 7, I discuss Brentano's principle of the unity of consciousness, and in section 8, I consider the scope of the changes that Brentano brings to his theory of consciousness in his later writings, which follow the 1874 publication of Psychology. I then draw the conclusion that Brentano's theory rests on a view of intransitive and intrinsic self-consciousness. (shrink)

In Kant’s moral theory, we do not have duties to animals, though we have duties with regard to them. I reconstruct Kant’s arguments for several types of duties with regard to animals and show that Kant’s theory imposes far more robust requirements on our treatment of animals than one would expect. Kant’s duties regarding animals are perfect and imperfect; they are primarily but not exclusively duties to oneself; and they condemn not merely cruelty to animals for its own sake, but (...) also, such things as killing them for food when our health does not require it and ingratitude to service animals. Central to understanding these duties is appreciating Kant’s concern for our morally useful emotions, for it is primarily because of the effect that cruelty to animals has on our sympathetic emotions—which greatly help us treat other rational beings appropriately—that we have duties not to be cruel to animals. Yet cruelty and callousness toward animals are not problematic only because they may weaken some of our morally useful emotions. Cruelty and callousness toward animals are problematic also because they oppose our morally useful emotions; these emotions, as part of the perfection of our nature, should be honored, supported, and furthered, unless there are compelling reasons not to do so in particular cases. Conscious Agency is a major driver of evolution. Artificial Selection (i.e. Conscious Selection by human breeders) was the foil against which Charles Darwin defined Natural Selection. In later work, he extended Artificial Selection to other species. That ability for social (e.g. sexual) selection must have evolved. Jablonka and Ginsburg identify markers of conscious agency, such as Unlimited Associative Learning (UAL), and show that it must have existed at the time of the Cambrian Explosion. To their insights, my commentary argues that (...) the harnessing of stochasticity was also involved in the evolution of the faculty of choice in organisms. (shrink)

In this dissertation I develop a general theory of coercion that allows one to distinguish cases of interpersonal coercion from cases of persuasion or manipulation, and cases of institutional coercion from cases of oppression. The general theory of coercion that I develop includes as one component a theory of second-order coercion. Second-order coercion takes place whenever one person intentionally impairs the formation of the second-order desires of another person, or constrains them after their formation, in a way that frustrates or (...) eliminates the possibility of the victim fulfilling certain of his or her first-order desires. The concept of second-order coercion is important because it suggests that a person's autonomy may be violated in ways that have not been previously recognized. In this dissertation I argue that the unique feature of all cases of coercion is that the alternatives available to the victim, with regard to the formation of his or her will, are intentionally constrained by another person in a way that violates the victim's autonomy. A general theory of coercion should be able to explain how institutions may be understood as coercive. I argue that if institutions are understood as social practices maintained for the purpose of achieving some end, then they may be properly understood as capable of coercion. ;This theory of coercion allows me to make two arguments concerning moral responsibility. First, I argue that current discussions of moral responsibility are inadequate because they fail to take seriously the claim that a person may be responsible, at least in part, for having the beliefs and desires that make a particular action a case of coercion. Second, I argue that discussions of moral responsibility are inadequate because they fail to recognize that an agent may not be responsible for the state of his or her will because he or she may have been coerced in a way that has not been previously recognized. The extensive range and depth of the twenty commentaries on my target article confirms that something has gone deeply wrong in biology. A wide range of biologists has more than met my invitation for “others to pitch in and develop or counter my arguments.” The commentaries greatly develop those arguments. Also remarkably, none raise issues I would seriously disagree with. I will focus first on the more critical comments, summarise the other comments, and then point the way forward on what (...) Wittgenstein is arguably the greatest philosopher of the last hundred years and scepticism is one of the central problems that modern philosophy faces. This collection is the first to be devoted to an examination of how that great philosopher's work bears on this fundamental philosophical problem. Wittgenstein's reaction to scepticism is complex, articulating both a sense that sceptical problems are ultimately unreal and a sense that scepticism teaches us something about the fundamental character of the human predicament. Kant’s ethics conceives of rational beings as autonomous–capable of legislating the moral law, and of motivating themselves to act out of respect for that law. Kant’s ethics also includes a notion of the highest good, the union of virtue with happiness proportional to, and consequent on, virtue. According to Kant, morality sets forth the highest good as an object of the totality of all things good as ends. Much about Kant’s conception of the highest good is controversial. This paper focuses (...) on the apparent conflict between Kant’s claim that we are autonomous, and passages in which he seems to suggest that we require belief in the possibility of the highest good to motivate moral action. I distinguish three distinct versions of these problematic claims that seem to be present in Kant’s texts: that the highest good serves as (1) a motivational supplement to respect for the moral law, (2) a fundamental spring of right action, and (3) a condition of the bindingness of moral requirements. I argue that the texts are better interpreted to yield alternatives to (2) and (3) that do not conflict with our autonomy. I also argue that, properly understood, (1) does not conflict with our autonomy. In arguing for the last claim, I explore Kant’s notion of radical evil and its implications for human agency and virtue. (shrink)

Damit meine ich nicht das Fühlen und Verhalten, das Fortschritt (...) bedingt oder umgekehrt durch ihn hervorgerufen wird; ich meine die Psychologisierung des Fortschritts: die Annahme, er sei eine reine Kopfsache, etwas Ausgedachtes oder Erhofftes, das sich durch seine Projektion auf historische oder soziale Prozesse zu einer gefahrvollen Erzählung verfestigt. "Psychologisierung des Fortschritts" ist also meine Chiffre für die projektivistische Fortschrittskritik, die ich hier ihrerseits kritisiere und der ich ein kulturalistisches Menschenbild entgegensetze.
