Betrachtet man die Forschungslage zum Werk von Karl Marx, sticht sofort ins Auge, dass vor allem dem Recht nur sehr wenig Beachtung geschenkt wird. Dies ist umso bemerkenswerter, da Marx zunächst noch als Student der Jurisprudenz mit den gesellschaftspolitischen Problemlagen seiner Zeit in Berührung trat und erst in der Folgezeit eine enge theoretische Verschränkung mit der Philosophie Hegels vollzog. Entgegen der bislang zumeist systematischen Betrachtungen des Rechts im Werk von Marx wählt diese Arbeit einen anderen Zugriff, indem sein Rechtsdenken ausgehend (...) von seinen Wurzeln, der Hegel‘schen Rechtsphilosophie und ihrer Weiterführung durch Eduard Gans, rekonstruiert und in seiner fortgehenden Entwicklung dargestellt wird. Dabei beschränkt sich die entwicklungsgeschichtliche Methode nicht auf die Hauptschriften des Oeuvres, sondern bezieht gerade auch die peripheren Werkteile mit ein. Zum ersten Mal liegt hier eine umfassende entwicklungsgeschichtliche Rekonstruktion des Rechtsdenkens vor, der es nicht nur gelingt, die beständige Relevanz des Rechts im Denken von Marx zu dokumentieren, sondern zugleich auch sein Festhalten an der Rechtsphilosophie Hegels samt ihres spezifischen Zusammenhangs von Recht und Freiheit. As COVID-19 continues to spread, a variety of COVID-19 tracking apps (CTAs) have been introduced to help contain the pandemic. Deployment of this technology poses serious challenges of effectiveness, technological problems and risks to privacy and equity. The ethical use of CTAs depends heavily on the protection of voluntariness. Voluntary use of CTAs implies not only the absence of a legal obligation to employ the app but also the absence of more subtle forms of coercion such as enforced exclusion from (...) certain social and work activities. The protection of individual rights to voluntary use can be enhanced through an ethics by design approach in the development of CTAs that treat the introduction of CTAs for what it is: a complete novelty that is being tested for the first time in democracies. This study examines how multinational corporations (MNCs) from the retail sector deal with four challenges they face when adopting Corporate Social Responsibility (CSR) policies: the challenge of developing well-performing CSR projects and programs, building competitive advantages based on CSR, responding to local stakeholder issues in the host countries and learning from different CSR experiences on a worldwide basis. Based on in-depth case studies of two globally leading retail MNCs (with strong operations in Latin America), the concept of Transverse CSR Management (...) emerged. Transverse CSR Management is defined as a distinctive form of organizational configuration that crosses different functional areas, country operations, and the boundaries of the firm. In particular, this article makes three main contributions: (1) we identify four central challenges faced by MNC managers when developing their CSR strategies; (2) we propose the concept of Transverse CSR Management to face these central challenges (together, at the same time) and identify its key elements (top management, external stakeholders, functional areas, and country subsidiaries); and (3) we propose four mechanisms (hierarchical, relational, cultural, and collaborative) through which the concept of Transverse CSR Management can be implemented by practicing managers. This study provides valuable insights for MNC managers in headquarters and subsidiaries on the issues they need to address in order to successfully deal with the four CSRrelated challenges. (shrink)

Guilt appeals have been found effective in stimulating ethical consumption behaviors in western cultures. However, studies performed in Confucian cultural contexts have found contradictory results. We aim to investigate the inconclusive results of research on guilt and ethical consumption and to explain the inconsistencies. We aim to better understand the influence of guilt on ethical consumption in a Chinese Confucian context and to explore the culturally relevant individual-level concept of interdependent self-construal as a moderator. We build our argument on the (...) Confucian ethics of ren-yi-li where the virtue of propriety specifies role-based obligations depending on the proximity of one’s relationship to others and may thus limit ethical behaviors that are directed to those who are relationally distant. We hypothesize a positive relationship between guilt and ethical consumption that is, however, negatively moderated by interdependent self-construal. Put another way, consumers who define themselves strongly through their relationships with close others are less likely to compensate for guilt through ethical consumption. We find the hypothesized model supported in a survey of 314 Chinese consumers. The results suggest that guilt appeals can stimulate ethical consumption in Confucian cultures. However, guilt appeals may not be enough, as the moderating effect suggests that they will be most effective when combined with an ethical consumption initiative that conforms to the Confucian li principle. As this principle implies prioritizing close over distant relationships, it follows that consumers may be more likely to respond to guilt appeals which are linked to ethical consumption initiatives whose beneficiaries they feel connected to. The domain of numbers provides a paradigmatic case for investigating interactions of culture, language, and cognition: Numerical competencies are considered a core domain of knowledge, and yet the development of specifically human abilities presupposes cultural and linguistic input by way of counting sequences. These sequences constitute systems with distinct structural properties, the cross-linguistic variability of which has implications for number representation and processing. Such representational effects are scrutinized for two types of verbal numeration systems—general and object-specific ones—that were in parallel (...) use in several Oceanic languages. The analysis indicates that the object-specific systems outperform the general systems with respect to counting and mental arithmetic, largely due to their regular and more compact representation. What these findings reveal on cognitive diversity, how the conjectures involved speak to more general issues in cognitive science, and how the approach taken here might help to bridge the gap between anthropology and other cognitive sciences is discussed in the conclusion. This article focuses on how biblical content and spiritualities can be communicated, probably more effectively, to (late) preschool children by using information technology, which has already been implemented successfully for years in secular and religious environments. Because children enjoy listening to stories, watching cartoons and playing every day, the approach in this research will be to propose a particular construct to communicate biblical content to preschool children. This construct comprises interactive storytelling, cartoon animation and educational gaming, which constitute a trilogy (...) for teaching biblical content and principles to preschool children. This should be done interactively. These three approaches have become fundamental designs and presentations in child education. Churches, Christian nurseries and other Christian educators, in general, are encouraged to develop computer programs according to the construct and strategy proposed in this article for the teaching of the Gospel to late preschool children. The approach in this article will be, firstly, to examine and explore the religious orientation of preschool children and, secondly, to validate and propose how computer technology can be implemented to communicate the biblical content to preschool children via the trilogy of interactive storytelling, cartoon animation and educational gaming in an uninterrupted experience. Contribution: This article argues that the use of interactive storytelling, cartoon animation and educational gaming should be used consecutively and uninterruptedly to communicate the biblical message to preschool children. This is probably the most effective way to keep the attention of these children and to affect their conduct. (shrink)

Studies concerning the relationship between religion and mental health have provided substantial evidence for the existence of a positive relationship. Nevertheless, it remains largely unclear which aspects of both religion and mental health take part in this relationship. The present study uses multiple measures of religion and of mental health to obtain a more refined view of this relationship. The results show the importance of distinguishing between if a person believes and how a person believes. Religious persons who have a (...) symbolic attitude towards religion scored higher on positive aspects of mental health. No significant results were found for negative mental health. (shrink)

When making an assessment of animal welfare, it is important to take environmental (housing) or animal-based parameters into account. An alternative approach is to focus on the behavior and appearance of the animal, without making actual measurements or quantifying this. None of these tell the whole story. In this paper, we suggest that it is possible to find common ground between these (seemingly) diametrically opposed positions and argue that this may be the way to deal with the complexity of animal (...) welfare. The model will have to be acceptable for the different parties that will be affected by it and real benefits for the animal should result from it. This will be the basis of a practical ethical approach. All this can be condensed into a model that essentially is made up out of three basic elements: the classical welfare analysis with an existing welfare assessment tool, an assessment of the stockholder, and an implementation of the Free Choice Profiling technique. This new framework does not pretend to be a different or better animal welfare matrix; it is intended to integrate existing knowledge and to provide a practical tool to improve animal welfare. It identifies whether there are welfare problems on a farm, if present whether these problems are caused by the housing system or the stockholder, and what can be done to improve the situation. In 1 John, the author refers several times explicitly to himself (also once in the plural, 1:4) for writing (γράφειν) certain things with the following purposes in mind, (that, ἵνα): ‘our joy may be complete’ (1:4); ‘you may not sin’ (2:1); and ‘you may know that you have eternal life’ (5:13). In 2:26, he implicitly states that he has also written ‘these things’ (ταῦτα) that (ἵνα) they might be victorious over the deceivers. This is the only book in the New (...) Testament where such a high frequency of an author’s reference to his own writing occurs. In 1 John it is used as part of a fixed phrase (ταῦτα γράφω/ἔγραψα ὑµῖν ἵνα) in the author’s rhetoric. This essay focusses on the primary and secondary objectives for writing 1 John per se, and on conceivable lived experiences fostered by the fixed phrase ‘ταῦτα γράφω ὑµῖν ἵνα’ [I am writing these things to you so that …], as well as the mechanisms the author used to unleash these lived experiences linked with these fixed phrases. The following aspects determine the structure of this essay: the author’s objectives, the expectancy of his writing, the credibility of his writing and the mechanisms the author used through which lived experiences could have been fostered to influence and convince his readers that Jesus is the Son of God. This paper investigates the impact of personal attributes and organizational conditions on attitudes toward corporate misdeeds. On the basis of social cognitive theory, we develop hypotheses that are tested against data collected from 215 German employees using an online survey. Our findings suggest that personal attributes have a much greater impact on ethical attitudes than organizational conditions. Further, a moderating effect of control-oriented culture on the relationship between personality traits and attitudes toward corporate misdeeds is found. In recent years, neuroscience has been a particularly prolific discipline stimulating many innovative treatment approaches in medicine. However, when it comes to the brain, new techniques of intervention do not always meet with a positive public response, in spite of promising therapeutic benefits. The reason for this caution clearly is the brain’s special importance as “organ of the mind”. As such it is widely held to be the origin of mankind’s unique position among living beings. Likewise, on the level of (...) the individual human being, the brain is considered the material substrate of those traits that in combination render each person unique. In view of this preeminent significance of the brain, it is understandable that, in general, interventions into the brain are considered a delicate issue and that new techniques of intervention are scrutinised with particular care. However, in doing so it is important not to go to the opposite extreme and shy away from promising new therapeutic approaches for debilitating disorders of the brain. With respect to the new techniques of brain intervention a broad interdisciplinary perspective is required to discern irrational fear from justified concern. Hence, the Europäische Akademie established a project group consisting, on the one hand, of experts from different fields of medicine who have got first-hand experience of applying the techniques at issue and, on the other hand, of philosophers and a legal expert. The task of this team was to review the state of the art with respect to each single technique of intervening in the brain, to indicate future developments, and to address the ethical and legal issues common to all of them. Such readers should know that Stoicism is a school of _philosophy_. The Stoics themselves would not recommend that you try to Stoic Yourself unless and until you were convinced of the _truth_ of the central claims of the school -- a truth that the ancient Stoics sought to establish by _arguments_. To treat Stoicism simply as self-help, without due regard to whether its central claims can be shown to be true, would be to treat those ancient philosophers with contempt. (shrink)

Using four examples of models and computer simulations from the history of psychology, I discuss some of the methodological aspects involved in their construction and use, and I illustrate how the existence of a model can demonstrate the viability of a hypothesis that had previously been deemed impossible on a priori grounds. This shows a new way in which scientists can learn from models that extends the analysis of Morgan (1999), who has identified the construction and manipulation of models as (...) those phases in which learning from models takes place. People undergo many idiosyncratic experiences throughout their lives that may contribute to individual differences in the size and structure of their knowledge representations. Ultimately, these can have important implications for individuals' cognitive performance. We review evidence that suggests a relationship between individual experiences, the size and structure of semantic representations, as well as individual and age differences in cognitive performance. We conclude that the extent to which experience-dependent changes in semantic representations contribute to individual differences in cognitive aging remains unclear. (...) To help fill this gap, we outline an empirical agenda that utilizes network analysis and involves the concurrent assessment of large-scale semantic networks and cognitive performance in younger and older adults. When the Royal Botanic Gardens at Kew in South London were opened to the general public in the 1840s, they were presented as a ‘world text’: a collection of flora from all over the world, with the spectacular tropical (read: colonial) specimens taking centre stage as indexes of Britain’s imperial supremacy. However, the one exotic plant species that preoccupied the British cultural imagination more than any other remained conspicuously absent from the collection: the banyan tree, whose non-transferability left a significant (...) gap in the ‘text’ of the garden, thereby effectively puncturing the illusion of comprehensive global command that underpins the biopolitical designs of what Richard Grove has aptly dubbed ‘green imperialism’. This article demonstrates how, in the 19th and early 20th centuries, the banyan tree became an object of fascination and admiration for British scientists, painters, writers and photographers precisely because of its obstinate non-availability to colonial control and visual or even conceptual representability. In the context of some criticism about social responsibility education in business schools, the paper reports findings from a survey of CSR education (teaching and research) in Europe. It analyses the extent of CSR education, the different ways in which it is defined and the levels at which it is taught. The paper provides an account of the efforts that are being made to mainstream CSR teaching and of the teaching methods deployed. It considers drivers of CSR courses, particularly the (...) historical role of motivated individuals and the anticipation of future success being dependent on more institutional drivers. Finally it considers main developments in CSR research both by business school faculty and PhD students, tomorrow''s researchers and the resources devoted to CSR research. This article explores managers’ ethical reasoning for behaviors in price negotiations using evidence from 15 in-depth interviews conducted with sales and purchasing representatives in the chemical industry in Germany. Applying transaction cost economics, we find that negotiators in commoditized market-like exchanges either refer to deontological norms such as not to lie, or they neglect a role for ethics, arguing that distributive negotiation is per se opportunistic. In contrast, exchanges of products with higher asset specificity lead to stronger informational integration which (...) is supported with teleological justifications. Some negotiators use teleological justification to build business on trust rather than on economic safeguards as their firm norms would require. For negotiators, our results suggest considering institutional context and adjusting ethical reasoning to the negotiation situation. Firms need to recognize and find ways to address the potential conflicts of their internal norms with their frontline managers’ attempts to act in the firms’ best economic and ethical interests. Through close readings of excavated texts from Guōdiàn, this book provides a comprehensive analysis of the way in which meaning is produced in early Chinese philosophical texts. It is the first book on early China to cast light on the relationship between material conditions and ideas and shows how, in an evolving manuscript culture, texts were used by different social groups.

“Decisions from experience” (DFE) refers to a body of work that emerged in research on behavioral decision making over the last decade. One of the major experimental paradigms employed to study experienced-based choice is the “sampling paradigm”, which serves as a model of decision making under limited knowledge about the statistical structure of the world. In this paradigm respondents are presented with two payoff distributions, which, in contrast to standard approaches in behavioral economics, are specified not in terms of explicit (...) outcome-probability information, but by the opportunity to sample outcomes from each distribution without economic consequences. Participants are encouraged to explore the distributions until they feel confident enough to decide from which they would prefer to draw from in a final trial involving real monetary payoffs. One commonly employed measure to characterize the behavior of participants in the sampling paradigm is the sample size, that is, the number of outcome draws which participants choose to obtain from each distribution prior to terminating sampling. A natural question that arises in this context concerns the “optimal” sample size, which could be used as a normative benchmark to evaluate human sampling behavior in DFE. In this theoretical manuscript, we relate the DFE sampling paradigm to the classical statistical decision theoretic literature and, under a probabilistic inference assumption, evaluate optimal sample sizes for decisions from experience. In our treatment we go beyond analytically established results by showing how the classical statistical decision theoretic framework can be used to derive optimal sample sizes under arbitrary, but numerically evaluable, constraints. Finally, we critically evaluate the value of deriving optimal sample sizes under this framework as testable predictions for the experimental study of sampling behavior in DFE. (shrink)

This article argues that corporate social responsibility may contribute to product differentiation in export markets and thus improve export performance. We test this argument by observing a period of decreasing export competitiveness in a leading emerging economy. Using a large-scale survey design with 252 questionnaires completed by mediumand large-sized Brazilian exporters, we used structural equations modelling to test our hypotheses. The results suggest that CSR product differentiation predicts export performance better than product quality differentiation and almost as well as product (...) innovation differentiation. Multi- group analysis further revealed that the positive and significant effect of CSR product differentiation on export performance is likely to be contingent on the number and type of countries that are targeted. Our study contributes to the literature on CSR and export performance by developing and empirically validating a model that explains under which conditions CSR-based product differentiation may lead to improved export performance. We identify a normative paradox of responsible management education. Business educators aim to promote social values and develop ethical habits and socially responsible mindsets through education, but they attempt to do so with theories that have normative underpinnings and create actual normative effects that counteract their intentions. We identify a limited conceptualization of freedom in economic theorizing as a cause of the paradox. Economic theory emphasizes individual freedom and understands this as the freedom to choose from available options. However, conceptualizing (...) individuals as profit-maximizing actors neglects their freedom to reflect on the purposes and goals of their actions. We build on the work of pragmatist philosopher John Dewey, who distinguishes between habitualized and creative problem-solving behaviors, conceptualizes knowledge construction as a process of interdependent scientific social inquiry, and understands actors as having the freedom to determine what kind of people they wish to be. We apply pragmatist theory to business education and suggest equipping students with a plurality of theories, supplementing neoclassical economics with other economic perspectives and views from other disciplines on economic behavior. Moreover, we suggest putting students into learning situations that require practical problem solution through interdependent social inquiry, encouraging ethical reflection. In doing so, we contribute by linking the problematic conceptions of freedom identified in economic theorizing to the debate on responsible management education. We conceptualize a pragmatist approach to management education that explicitly re-integrates the freedom to discursively reflect on the individual and societal purpose of business activity and thereby makes existing tools and pedagogies useful for bringing potential freedom back into business. We critically assess integrative social contracts theory (ISCT) and show that the concept particularly lacks of moral justification of substantive hypernorms. By drawing on Habermasian philosophy, in particular discourse ethics and its recent application in the theory of deliberative democracy , we further advance ISCT and show that social contracting in business ethics requires a well-justified procedural rather than a substantive focus for managing stakeholder relations. We also replace the monological concept of hypothetical thought experiments in ISCT by a concept (...) of practical discourse to better govern business activities on the macro-level of organizational actors such as firms, governments, and NGOs. It is sometimes claimed that the Kantian Ought Implies Can principle (OIC) rules out the possibility of moral dilemmas. A certain understanding of OIC does rule out the possibility of moral dilemmas in the sense defined. However I doubt that this particular formulation of the OIC principle is one that fits well with the eudaimonist framework common to ancient Greek moral philosophy. In what follows, I explore the reasons why Aristotle would not accept the OIC principle in the form in (...) which it rules out the possibility of moral dilemmas. (shrink)

To discuss moral behavior in organizations, a growing number of authors turn to a ‘virtue ethics’ approach. Central to this approach is the so-called moral character of individuals in organizations: a well-developed moral character enables organizational members to deal with the specific moral issues they encounter during their work. If a virtue ethics perspective is seen as relevant, one may ask how organizations can facilitate that their members can exercise and develop their moral character. In this paper, we argue that (...) the way tasks are defined and interlinked has a profound influence on “exercising and developing moral character”—it can enhance and frustrate it. In order to show how structures may support organizational members to exercise and develop their moral virtues, the paper first describes what it means to exercise and develop virtues in an organizational setting and what is required for it. Next, the paper sets out to explain how specific values on different structural parameters at different structural levels relate to exercising virtues in organizations. (shrink)

In Miletus, about 550 B.C., together with our world-picture cosmology was born. This book tells the story. In Part One the reader is introduced in the archaic world-picture of a flat earth with the cupola of the celestial vault onto which the celestial bodies are attached. One of the subjects treated in that context is the riddle of the tilted celestial axis. This part also contains an extensive chapter on archaic astronomical instruments. Part Two shows how Anaximander (610-547 B.C.) blew (...) up this archaic world-picture and replaced it by a new one that is essentially still ours. He taught that the celestial bodies orbit at different distances and that the earth floats unsupported in space. This makes him the founding father of cosmology. Part Three discusses topics that completed the new picture described by Anaximander. Special attention is paid to the confrontation between Anaxagoras and Aristotle on the question whether the earth is flat or spherical, and on the battle between Aristotle and Heraclides Ponticus on the question whether the universe is finite or infinite. Abstract Relativism about knowledge attributions is the view that a single occurrence of ‘S knows [does not know] that p’ may be true as assessed in one context and false as assessed in another context. It has been argued that relativism is equipped to accommodate all the data from speakers’ use of ‘know’ without recourse to an error theory. This is supposed to be relativism’s main advantage over contextualist and invariantist views. This paper argues that relativism does require the attribution (...) of semantic blindness to speakers, viz. to account for sceptical paradoxes and epistemic closure puzzles. To that end, the notion of semantic blindness is clarified by distinguishing between content-blindness and index-blindness, and it is argued that the attribution of index-blindness required by the relativist account is implausible. Along the way, it is shown that error-theoretic objections from speakers’ inter-contextual judgments fail against relativism. Dessen Heterogenität und die Vielfalt der Rezeptionsweisen seiner Theoreme stand zu dem Bild, welches sich mit dem (...) Namen Carl Schmitt in der offiziellen politischen Kultur verknüpfte, in einer irritierenden Spannung. These der Arbeit ist, daß sich aus dieser Spannung auf wichtige Merkmale der Intellektuellengeschichte der frühen Bundesrepublik insgesamt rückschließen läßt. (shrink)
