If the bindingness of morality was to rest on something as ‘subjective’ as the non-cognitivist says it does, the grouse goes, and morality itself would come down crashing. Nothing less than an ‘objective’ source of normativity, it is supposed, could hold morality in orbit. Some of these worries automatically morph into worries about the projectivist model of normativity of law as well: one which understands the authority or normativity of law in terms of subjective attitudes taken towards the law. Music is universal at least partly because it expresses emotion and regulates affect. Associations between music and emotion have been examined regularly by music psychologists. Here, we review recent findings in three areas: (a) the communication and perception of emotion in music, (b) the emotional consequences of music listening, and (c) predictors of music preferences.

This article outlines two models of constructing contract theory: The impinging model (based on metaethical cognitivism), which gives central place to truth and justification; and the projectivist model (based on metaethical non-cognitivism), which gives central place to attitudes and motivation. It is argued that modern contract theories which typically seek to present the whole body of contract doctrine as deducible from, and morally justifiable by, one or a small number of apex principles, presuppose the impinging model. By contrast, a projectivist (...) approach to theory creation does not purport to offer justificatory apex principles, but rather argues for propositions that are likely to have maximum motivational purchase in the practical reasoning of contract law’s subjects. The article then goes on to point out the theoretical cost of the impinging model and argues that projectivist accounts do a better job of accommodating the internal point of view of contract law’s subjects. Journal of Human Values, Volume 28, Issue 3, Page 209-220, September 2022. It is paradoxical to make a moral statement and, in the same breath, disavow commitment to it. Following G. E. Moore, who first identified an analogous paradox—albeit, in the case of factual statements and disavowal of belief in them—these are called Moore paradoxical statements. Richard Hare argues that in order to determine whether an ‘ought’ is a moral one, one only needs to examine if this attitudinal adherence necessarily (...) accompanies the judgement in question. If not, Moore paradoxicality hits and the ‘ought’ in question is not a moral ‘ought’. Hare’s test poses a problem for Joseph Raz who argues that normative terms such as ‘ought’ have the same meaning in legal and moral statements. Raz, however, acknowledges a dilemma this brings in its wake: It is possible to make legal statements without necessarily endorsing them, which creates a presumption against these being equivalent to moral statements. To tackle the dilemma, Raz challenges the very idea of commitment to normative statements by arguing that it is also possible to make detached moral judgements. This paper argues that Raz’s idea of ‘detached normative statements’ falters in that the purported examples of detached normative statements Raz uses turn out upon closer examination to be non-normative statements using either norm-relative or non-normative ‘oughts’. A successful account of the ‘normativity of law’ is meant to inter alia establish how legal requirements come to be morally binding. This question presupposes taking a stance on the metaethical debate about the nature of morality and moral bindingness between the cognitivist and non-cognitivist camps. An overwhelming majority of contemporary legal philosophers have an unspoken adherence to a cognitivist metaethic and the model of normativity of law emerging from it: the impinging model. Consequently, the problematic of the normativity of (...) law is so calibrated as to in limine rule out any putative account of the normativity of law that presupposes a non-cognitivist metaethic: the projectivist model. This paper calls for a recalibration of the problematic of the normativity of law to a metaethically aseptic viewpoint from which the projectivist model is seen as a plausible theoretical contender to the impinging model. _The Contradictions of Modern Moral Philosophy_ is a highly original and radical critique of contemporary moral theory. Paul Johnston demonstrates that much recent moral philosophy is confused about the fundamental issue of whether there are correct moral judgements. He shows that the standard modern approaches to ethics cannot justify - or even make much sense of - traditional moral beliefs. Applied rigorously, these approaches suggest that we should reject ethics as a set of outdated and misguided claims. Rather than facing (...) up to this conclusion, most recent moral philosophy consists of attempts to find some ways of preserving moral beliefs. This places a contradiction at the heart of moral philosophy. As a resilt it is often impossible to tell whether a contemporary philosopher ultimately rejects or endorses the idea of objective right and wrong. On the basis of a Wittgenstein approach Paul Johnston puts forward an alternative account of ethics that avoids this contradiction and recognises that the central issues of ethics cannot be resolved by conceptual analysis. Capturing, transferring, managing, and reusing data, information, and knowledge in the context it is generated can lead to higher productivity, effective communication, reduced number of requests for clarification, and a shorter time-to-market cycle. We formalized the concept of reflection in interaction during communicative events among multiple project stakeholders. This concept extends Donald (...) Schon’s theory of reflection in action of a single practitioner. We model the observed reflection in interaction with a prototype system called TalkingPaperTM. It is a ubiquitous client-server collaborative environment that facilitates knowledge capture, sharing, and reuse during synchronous and asynchronous communicative events. TalkingPaperTM bridges the paper and digital worlds. It transforms the analog verbal discours, annotated paper corporate documents, and the paper and pencil sketches into indexed and synchronized digital content that is published on and streamed on-demand from a TalkingPaperTM web server. The similarity of documents in a large database of published Fractals articles was examined for redundancy. Three different text matching techniques were used on publisheds to identify redundancy candidates, and predictions were verified by reading full text versions of the redundancy candidate articles. A small fraction of the total articles in the database was judged to be redundant. This was viewed as a lower limit, because it excluded cases where the concepts remained the same, but the text was altered substantially.Far (...) more pervasive than redundant publications were publications that did not violate the letter of redundancy but rather violated the spirit of redundancy. There appeared to be widespread publication maximization strategies. Studies that resulted in one comprehensive paper decades ago now result in multiple papers that focus on one major problem, but are differentiated by parameter ranges, or other stratifying variables. This ‘paper inflation’ is due in large part to the increasing use of metrics (publications, patents, citations, etc) to evaluate research performance, and the researchers’ motivation to maximize the metrics. ABSTRACT Many people now believe that human reproductive cloning – once sufficiently safe and effective – should be permitted on the grounds that it will allow the otherwise infertile to have children that are biologically closely related to them. However, though it is widely believed that the possession of a close genetic link to our children is morally significant and valuable, we argue that such a view is erroneous. Moreover, the claim that the genetic link is valuable is pernicious; it (...) tends to give rise to highly undesirable consequences, and therefore should be combated rather than pandered to. The emphasis on the genetic is unwarranted and unfortunate; rather than giving us moral reason to support reproductive cloning in the case of infertility, the fact that cloning requests are likely to be motivated by the genetic argument gives us reason to oppose its availability. Providing information to consumers in the form of food labels about modern systems of animal farming is believed to be crucial for increasing their awareness of animal suffering and for promoting technological change towards more welfare-friendly forms of husbandry (CIWF, 2007). In this paper we want to explore whether and how food labels carrying information about the lives of animals are used by consumers while shopping for meat and other animal foods. In order to achieve this, we draw upon a (...) series of focus group discussions that were held in Italy as part of a large EU funded project (Welfare Quality®). In the focus group discussions we addressed how, when or if, claims made about the lives of animals on food labels intervened in what the participants bought and ate. We contend that such labels bring the lives of animals to the forefront and act as new ‘subjectifiers’ (Latour, Citation2005: 212) that offer a new tool for becoming an ‘ethically competent consumer’, who cares about the lives of animals while shopping for food. However, this offer is not always easily accommodated within existing competences and previous commitments, as it requires a reassessment of existing, and often intimate, practices of shopping, cooking and eating. We argue that new labels carrying welfare claims, with their intention of increasing market transparency, produce two contrasting outcomes: they open new spaces of action, which offer an opportunity for investing in new competences and for engaging with animal welfare issues, in short, they allow an ‘ethically competent consumer’ to emerge, but they also produce another outcome, or a collateral casualty (Bauman, Citation2007), namely the ethically non-competent consumer. ‘In daily matters, be competent’ (From How to live ethically, the Tao Te Ching). Sie betrifft die objektive Eingrenzung der Zulässigkeit einer Behandlungsbegrenzung und die Subsumtion des Wachkomas als irreversibel tödliches Grundleiden, das ärztliche Ermessen bei der Indikationsstellung, die normative Einordnung einer Ernährungstherapie am Lebensende und die Verbindlichkeit von Patientenverfügungen. Die medizinethische Kritik offenbart eine unzureichende Wahrnehmung medizinischer und medizinethischer professioneller Dokumente (...) und den Rückgriff auf medizinethisch veraltete Konzeptionen der Sterbehilfe durch das Gericht. Die Folge ist eine fehlerhafte Subsumtion der Wachkomapatienten in die Kategorie irreversibel tödlicher Erkrankungen und eine inhaltliche Schwächung der Verbindlichkeit von Patientenverfügungen. Background: Recruitment, training and performance management are central processes in Human Resource Management (HRM) for organizational performance. Organizational Culture (OC) also determines these practices based on the nature of hiring, career development, and employee retention. It is essential to have a clear understanding of the relationship to gain the biggest benefits for HRM strategies and organizational results. Aim: Thus, the current research examines how OC affects HRM practices such as RP, TD, PM, EE, RR, and CR. It is desired to (...) identify how OC influences HRM practices and offer recommendations that can help to improve the HRM practices. Method: A questionnaire survey was conducted among 250 respondents using a structured 5-point Likert scale. The survey was based on demographic characteristics and evaluated the OC influence on RP, TD, PM, EE, RR, and CR. The study employed the PLS-SEM technique and T-test with the CFA and psychometric tests to check for reliability. Results: A strong correlation between OC and human resource management practices was established. OC impacted the approach to attracting employees, selecting and developing training programs, assessing performer appraisals, motivating employees, deciding on retention strategies, and handling conflict. These observations show that OC has a strong impact on the range of HRM practices. Conclusion: It is important to understand that organizational culture is an influential component that affects HRM practices. Positive OC affects the ability to attract, develop, manage, engage, retain, and resolve conflicts with employees. The PLS-SEM approach was useful in analysing these relationships and enhancing the HRM strategies with regards to organizational culture. (shrink)

Film production is the process of creating a film, involving stages such as progress, pre-production, invention, post-production, and sharing. It encompasses planning, scripting, shooting, editing, and finalizing the film for public viewing. The process of imagination drives innovation in scripting, directing, and cinematography, resulting in unique, engaging experiences that captivate audiences with their emotive stories. The principle of this investigation is to assess how psychological factors add to enhancing imagination in film production, focusing on their impact on creative processes and (...) outcomes. A study surveyed 680 students from college film program students to analyze their creative personality and imaginative capabilities using structured questionnaires. Key psychological constructs included Creative Self-Efficacy, Emotional Resilience, Cognitive Flexibility, and Intrinsic Motivation. The study investigated the impact of psychological factors on college cinema students' creative imagination in filmmaking, demonstrating high validity and reliability with Factor Loadings exceeding 0.76, Composite Reliability higher than 0.88, and Average Variance Extracted (AVE) range as of 0.59 to 0.67. Discriminant validity was confirmed as every construct AVE was better than its square correlations by other constructs. Psychological factors significantly influence film production imagination, fostering creative thinking and emotional depth. Understanding and harnessing these factors enhances storytelling, character development, and audience engagement, ultimately enriching the cinematic experience. (shrink)

The article discusses the Kenyan post-2007 elections political crisis within the framework of ‘libertarian communitarianism’ that integrates individualistic self-interest with traditional collectivist solidarity in the era of globalization in Africa. The author argues that behind the Kenyan post-election anarchy can be analyzed as a type of ‘prisoner's dilemma’ framework in which self-interested rationality is placed in a collectivist social contract setting. In Kenya, this has allowed political manipulation of ethnicity as well as bad governance, both of which have prevented the (...) building of a strong, impartial state. In Kenya, socio-economic disparities and historical injustices due to corruption, nepotism, cronyism and other forms of favoritism have maintained ethnic and other internal tensions, which exploded into open conflict after the disputed December 2007 elections.The author shows how the ‘libertarian communitarist’ politico-economic context lacks shared values and precludes forward-looking solutions for social justice that promote public good and national unity. Instead, a nation remains divided with its people set up in competitive positions, because there is public trust neither in partisan and self-interested governments nor in inefficient state structures with often (ethnically and/or regionally) biased (re)distribution of resources and unequal service delivery. The greed of the political elites and grievances of the ordinary citizenry maintain distrust across the nation and focus on past injustices rather than finding a shared agenda for future unity.The author suggests that in order to build up public trust, to strengthen the state structures and to gain national unity, it is necessary to focus on shared values and a forward-looking concept of justice, acceptable to all. Purpose: The main purpose of the study is to generate an idea about the validity of data-driven predictive analytics related to sustainable banking investment portfolio development. Methodology: Depending on the positivism philosophy, the researcher has focused on generating a hypothesis that can be evaluative and generate an outcome related to the topic under discussion. The descriptive design of the study has helped the researcher develop an idea about the different perspectives related to sustainable investment and ESG goals. The primary quantitative (...) data analysis is conducted by purposefully generating a sample of 101 participants, coming from the managerial level dignitaries from 10 leading banking sectors of the European continental financial market. Results: Analysing the opinions given by the respondents by IBM SPSS software, the results of the study. The results show that most of the male participants have shown their interest in participating in the survey which indicates the career growth of male bankers to be higher than the female ones. The most participating age group is found to be the people belonging to the age group of 21 to 35. The mean value of the correlation coefficient is found to be 0.921 and the mean value of the coefficient of determination is found to be 0.848. On the other hand, the regressive degree of freedom is found to be 11 which indicates the linear relationship present within different variables that are considered generally by the respondents. Conclusion: The interdependence of the variables clearly shows that the market trend regarding the future of the sustainable investment sector present within the banking field can be developed based on predictive analytics inclusion within the level of investment that is focused on meeting the ESG goals for improving sustainability. These factors act as the main motivators for the cross-departmental teams that act simultaneously for performing other tasks along with maintenance of predictive modelling of real-time data to evaluate the future of the banking investment sector. This study examines the relationship between social and emotional abilities and standardized test results among elementary school students in Saudi Arabia. The data was collected using a purposive sampling strategy, with the Social and Emotional Learning Assessment Scale (SELAS) used to assess skills and actual educational material utilized to provide standardized test results. Data analysis involves the utilization of descriptive statistics, Pearson correlation coefficients, regression assessment, ANCOVA, and subgroup analyses. The results indicate a robust and positive correlation between social and (...) emotional abilities and standardized test scores. The regression evaluation demonstrates the ability of these skills to accurately predict academic achievement. The ANCOVA method finds socio-economic variables as the primary moderators. The evident existence of disparities, principally influenced by gender and grade level, highlights the necessity for interventions that are specifically tailored to address these variances. Proposed approaches include integrating comprehensive social and emotional learning activities into educational curricula, implementing targeted interventions to address socio-economic disparities, and implementing strategies customized to individual genders. Maintaining continuous surveillance and assessment is crucial for fostering a comprehensive academic environment. (shrink)

This study investigated the role of school administrations in Saudi Arabia in raising awareness of students using social media from the perspectives of teachers at the secondary level. The study followed the descriptive survey, for which a questionnaire of 41 paragraphs was developed and administered to 500 teachers. The findings revealed the degree of responses of male and female secondary school teachers regarding the role of school administrations in Saudi Arabia in confronting the dangers of social media, which had a (...) medium level. The findings demonstrated that the academic qualification variable for this dimension was associated with statistically significant differences, with the disparities favoring holders of bachelor's degrees. Finally, the results showed differences between the participants' opinions on the role of school administrations in Saudi Arabian schools in confronting the risks of social media because of years of experience variable. In wertpluralen Gesellschaften begegnen uns in der medizinischen Versorgung zahlreiche Konflikte, bei denen die kulturellen und religiösen Wertvorstellungen und Einstellungen des Patienten eine wichtige Rolle spielen. Besonders komplex wird es, wenn die betroffene Person nicht mehr in der Lage ist, selbst über die medizinischen Maßnahmen zu entscheiden. Ob eine Patientenverfügung in solchen Konfliktsituationen einen entscheidenden Beitrag zu einer ethisch angemessenen Lösung leisten kann, bleibt eine berechtigte Frage. Im Folgenden werden die ethischen Aspekte im Umgang mit muslimischen Patienten und die Nutzung (...) einer kultursensiblen und kultursensitiven Patientenverfügung bei diesen Patienten differenziert behandelt.Die Vielfalt an Haltungen zu Entscheidungen am Lebensende innerhalb der islamischen Welt, der Einfluss der Familie und traditioneller sittlicher Einstellungen, heterogene Formen der Religiosität und das Gesundheitssystem des jeweiligen Landes erweisen sich als wichtige normative Anhaltspunkte für die Anwendung einer Patientenverfügung bei muslimischen Patienten. Trotz zahlreicher Schwierigkeiten kann eine kultursensible und kultursensitive Patientenverfügung einen wichtigen Beitrag zur Berücksichtigung und Umsetzung der Entscheidungen eines entscheidungsunfähig gewordenen muslimischen Patienten leisten. abstract: In Kephalaia Gnostika, the third part of his great trilogy on the ascetic and contemplative life, the early Christian desert monk Evagrios of Pontus made a statement that resonates with the story told by the Buddha in the Aggañña Sutta. Evagrios declared that there had been a time when evil did not exist, and from this premise, he extrapolated that there will come a time when evil will not exist anymore. Both Evagrios and the Buddha, it seems, were essentially (...) optimistic in their teaching, convinced that despite being subject to a "fall," human beings have agency and can work toward establishing virtue in their lives and experiencing the fruits of this labor. In order to do this, a sophisticated understanding of how the mind works is key, and the two teachers, within the lineaments of the thought worlds of their respective backgrounds, explore what contemplation and meditation offer to this end. They also discuss other qualities that contribute to the development of a "gentle warrior," a character recognizable in both traditions and notable for the level to which they have erased subjectivity and their dedication to the achievement of good outcomes. Der Beitrag plädiert für eine stetige Dokumentation von Ethikberatungen (interne Dokumentation). Auf diesen Grundlagen können unterschiedliche Berichte über Ethikberatungen mit unterschiedlichen Inhalten und unterschiedlichen Adressaten entstehen. Es wird zwischen einem Ergebnis- und einem Verlaufsbericht unterschieden. Diese werden von summarischen Zeitraumberichten oder einem Berichtssystem Ethikberatung abgegrenzt. Ergebnisberichte mit einer Darlegung des Beratungsergebnisses und den wichtigsten ethischen Argumenten werden häufig in Krankenunterlagen eingeordnet. Verlaufsberichte dienen in der Regel eher (...) Ausbildungs- und Qualitätssicherungszwecken.Dokumentationen in diesem weiten Sinn können zu einer Professionalisierung der Ethikberatung beitragen. Dabei ist es aber von zentraler Bedeutung, sich die Zielsetzung der jeweiligen Form von Dokumentation zu vergegenwärtigen und ehrlich und aufrichtig nach Schwächen und Entwicklungspotenzialen der Beratung zu ethischen Fragen im klinischen Alltag zu suchen. It is difficult to translate the title “Wissen und Glauben” (Knowledge and Faith, see Romans 11:33 and I Corinthians 13:13) into English, because there ist a debate between Kant, Jacobi, Fichte and Hegel behind it. Through Fichtes “Wissenschaftslehre” knowledge has been accepted as the basic element of all scholarship, whereas faith belongs to religion.

_ This scholarly article examines the intricate relationship between social policy and its effects on vulnerable populations. Through a comprehensive analysis of various social policies, the article elucidates the challenges, opportunities, and unintended consequences that arise in the realm of policy-making. The focal point remains the exploration of how policies, when effectively crafted and implemented, can either ameliorate or exacerbate vulnerabilities within specific population groups._.

In this research, I tried to collect and study Qur’anic verses related to the topic of tolerance temper in the prophets’ calling to their people, through the calling of the Prophet Muhammad, may God bless him and grant him peace, to his people. At the end of the research, it concluded with results, the most prominent of which were: that the Holy Qur’an is the constitution of morals and etiquettes, and it includes sublime etiquettes and refined morals, and that the (...) Prophet, may God bless him, was the most prominent worker of divine directives, especially with regard to tolerance temper with his people when calling them to Islam. The research also ended with a recommendation to conduct specialized studies on tolerance temper among the prophets in the rest of the Qur’anic surahs. (shrink)

Feminist philosophers of religion have drawn attention to desire as a neglected category for approaching the sources and concerns of religion. This paper extends this discussion by engaging with one particularly disturbing aspect of the writings of the Marquis de Sade. In a world where ultimate sexual pleasure is derived from destruction of the Other, Sade glories in describing the suffering of mothers, often at the hands of their own children. This paper offers one possible reading of these dark desires (...) through employing aspects of psychoanalytic theory to suggest that, rather than isolate him from the majority of humanity, we might consider possible connections between the desires he details and our own. This involves considering the ambivalence of the mother, and thus challenging the idealization of the all-caring, all-nurturing mother. (shrink)
