In this paper, we respond to Andrew Avins's recent review of methods whose use he advocates in clinical trials, to make them more ethical. He recommends in particular, “unbalanced randomisation”. However, we argue that, before such a recommendation can be made, it is important to establish why unequal randomisation might offer ethical advantages over equal randomisation, other things being equal. It is important to make a pragmatic distinction between trials of treatments that are already routinely available and trials of restricted (...) treatments. We conclude that unequal randomisation could, indeed, be an ethical compromise between protecting the interests of participants and those of society. (shrink)

Prominent models of attentional control assert a dichotomy between top-down and bottom-up control, with the former determined by current selection goals and the latter determined by physical salience. This theoretical dichotomy, however, fails to explain a growing number of cases in which neither current goals nor physical salience can account for strong selection biases. For example, equally salient stimuli associated with reward can capture attention, even when this contradicts current selection goals. Thus, although 'top-down' sources of bias are sometimes defined (...) as those that are not due to physical salience, this conception conflates distinct - and sometimes contradictory - sources of selection bias. We describe an alternative framework, in which past selection history is integrated with current goals and physical salience to shape an integrated priority map. (shrink)

The modal object calculus is the system of logic which houses the (proper) axiomatic theory of abstract objects. The calculus has some rather interesting features in and of itself, independent of the proper theory. The most sophisticated, type-theoretic incarnation of the calculus can be used to analyze the intensional contexts of natural language and so constitutes an intensional logic. However, the simpler second-order version of the calculus couches a theory of fine-grained properties, relations and propositions and serves as a framework (...) for defining situations, possible worlds, stories, and fictional characters, among other things. In the present paper, we focus on the second-order calculus. The second-order modal object calculus is so-called to distinguish it from the second-order modal predicate calculus. Though the differences are slight, the extra expressive power of the object calculus significantly enhances its ability to resolve logical and philosophical concepts and problems. (shrink)

The author examines the differences between the general intensional logic defined in his recent book and Montague's intensional logic. Whereas Montague assigned extensions and intensions to expressions (and employed set theory to construct these values as certain sets), the author assigns denotations to terms and relies upon an axiomatic theory of intensional entities that covers properties, relations, propositions, worlds, and other abstract objects. It is then shown that the puzzles for Montague's analyses of modality and descriptions, propositional attitudes, and directedness (...) towards nonexistents can be solved using the author's logic. Liberation theology is in retreat. Once orthodox Catholics, starting with Pope John Paul II, recognized liberation theology's cultural challenge, they effectively countered it. They insisted on a traditional Catholic hierarchy of values. They undercut liberation theology's appeal by taking back key words and precepts that liberationists tried to appropriate. The Magisterium's sensus fidei included practical steps to demonstrate the weakness of liberation theology's hold, especially on poor people. Orthodox Catholics thus used the theological and practical weapons that the Church always (...) had at her disposal. The response of many liberation theologians has been to change some of liberation theology's precepts. (shrink)

Yet such a contrast fails to provide an adequate account of the full scope of either philosophy or psychoanalysis. On the one hand, philosophical inquiry is not wholly pre-empted by the question of reality; it may also extend into the realm of phantasy, as can be seen in Plato's effort to determine the epistemological value of eikasia or in Husserl's consideration of Phantasie as a basis of insight into essences. On the other hand, psychoanalysts are as concerned about reality as (...) they are about phantasy. Indeed, one of the key phrases of psychoanalytic therapy is "adaptation to reality." The reason for this concern with reality is clear: if phantasies are modifications or distortions of the real, it is imperative to discern what the character of reality is, especially since it is held out as the standard of a sound state of mental health. :In this essay, I critically engage with a methodological approach in contemporary political theory — unconstrained utopianism — which holds that we can only determine how we should live by first giving an account of the principles that would govern society if people were perfectly morally motivated. I provide reasons for being skeptical of this claim. To begin with I query the robustness of the principles unconstrained utopianism purportedly delivers. While the method can be understood as offering existence proofs, because (...) we can devise other situations in which morally flawless decision making would unearth alternative sets of principles, I argue that such proofs tell us surprisingly little about how we should live in general. Drawing on this point, I contend that normative models that wish away certain phenomena that are uncontroversially central to any account of politics cannot plausibly claim to tell us how we should live in political society. I conclude by offering a more positive sketch of why avoiding this brand of utopianism might not represent a problematic capitulation to the morally nonideal and suggest that theorizing in light of certain constraints may be a precondition of good normative theorizing itself. This essay explores the controversy over peer-to-peer (p2p) software, examining the legal and ethical dimensions of allowing software companies to develop p2p technologies. It argues that, under the Supreme Court’s ruling in the Sony betamax case, technology developers must be accorded the freedom to innovate and develop technologies that are capable of substantial noninfringing uses. This doctrine, known as the Sony doctrine, provides an important safe harbor for technological development, including p2p. The safe harbor, however, does not immunize conduct beyond (...) the design, sale, or supply of the product. For other conduct that falls outside the Sony safe harbor, the traditional standards of secondary liability apply. (shrink)

A brief analysis of the processes of measurement common to any science reveal a paradox. This paradox is encountered when one tries to make clear how formal statements are related to experience in such a way that factual statements, such as statements about measurements, result. I believe that this paradox bears an analogy to the “fallacy of the third man” which disturbed Plato. Be that as it may, this paradox has not been satisfactorily solved in modern times, although a full (...) comprehension of the processes of measurement would require its solution. THERE IS MUCH TALK THESE DAYS OF RIGHTS: Civil rights, legal rights, natural rights, human rights, women's rights, reproductive rights, children's rights. A great deal of it--if not all of it--is confused and confusing. Indeed, it is safe to say that no politically relevant concept more needs clarification than this one. Furthermore, because we are lavishly spending our political capital, it will soon happen that neither the incantation of familiar phrases nor the public expression of sentimental pieties will keep us (...) from destroying our community. The conflict between property rights and civil rights, so prominent in the 1960s, is only one example of the sort of tensions which we will undergo in the future. Unless adequate categories through which these conflicts may be resolved are accepted, any one solution can only prefigure larger conflicts whose features are ominous indeed. (shrink)
