Over the last two decades, network-focused approaches have become highly popular in diverse fields of biology, including neuroscience, ecology, molecular biology and genetics. While the network approach continues to grow very rapidly, some of its conceptual and methodological aspects still require a programmatic foundation. This challenge particularly concerns the question of whether a generalized account of explanatory, organisational and descriptive levels of networks can be applied universally across biological sciences. Consequently, the central focus of this theme issue will be on (...) the definition, motivation and application of key concepts in biological network science, such as levels, hierarchies, and explanatory directionality. A unification will be achieved by formulating norms for delimiting the distinctively network-topological class of explanations that connect general as well as very specific biological research questions. The impact of this theme issue is broad and encompassing, as it is highly interdisciplinary and opens a uniquely normative perspective on the foundational aspects of network-based explanations and modelling. This theme issue is intended to become a landmark publication for practical research as well as funding policy decisions, by unifying network approaches in biological sciences in terms of fundamental concepts and informing the public understanding of the network science. An English translation of the Second Disputation.

Concepts such as law, religion or morality may refer both to a practice (or process) and to a doctrine (or product). My thesis is that we should not regard these as separate phenomena, but as two partly incompatible models of the same phenomenon. Law, religion and morality are therefore essentially ambiguous concepts (EAC). An EAC is a concept which refers to a dynamic phenomenon that may only be described and modeled in at least two different ways that are (...) each essentially incomplete and which are partly incompatible with each other. This means that we have to choose between either an incomplete description or an incoherent one. An EAC resembles an essentially contested concept (ECC) as both allow of conflicting conceptions. However, for an ECC the explanation of pluralism lies in the evaluative character of the concept, for an EAC it lies in the dynamic character of the phenomenon. The insight that many of our social concepts are essentially ambiguous may provide a better understanding of social and customary rules and of the debate between legal positivism and its opponents. I reconstruct the positions of three contributors to this debate, Fuller, Hart and Dworkin. An EAC framework offers a better insight into their theories, highlights the deficiencies, and explains why their debates were characterized by serious misunderstandings. (shrink)

In the West, the Estate Rights originated in the eleventh century, whereas in Lithuania they started to evolve only after the Wallachian Land Reform in 1557. The then state conventional rules and manners were gradually transformed into registered Country – seat rights. In the present rather concise paper an attempt has been made to present a picture of the development of Country – seat rights as a relatively independent law system and define its concept. The author has attempted to prove (...) that the rules of behaviour, introduced and observed in estates should be recognised as legal regulations for the following three reasons: (1) the publicly recognised exclusive Land property right and the right of the ownership of the people living on this land; (2) the rights were publicly registered in the Land, Castle (City) Law or Court books or in the books of the Tribunal. Thus they acquired official status; (3) the above-mentioned established estate rules were to be legally and obligatorily executed. Their realisation was guaranteed either with the help of the local power apparatus or, if needed, state compulsory measures could be applied. The Estate Rights in Lithuania in the sixteenth to nineteenth centuries comprised the following legal acts: (1) the act of inventory; (2) urban regulations and directions; (3) privileges granted to the owners by the rulers and special ordinances for the realisation of the given privileges; (4) the so-called “release papers/cards” (horty wolnosci) ; (5) the verdicts of the local Courts of Law; (6) the ownership of different objects on the estate ( the estate lands, mills, pubs, tar boiling pits, etc., including the people who could not act freely, rent treaties, foundations, wills with foundation forms legally included, by applying which the estates realised their constitutive cultural initiatives. The Estate Rights were defined as a system embracing the relations of obligatory conduct designed by the estate owner or his authorised institutions or officials. They were meant to maintain the order within the estate, to guarantee and realise the norms of different cultural initiatives as well. Being mostly ad hoc in their form, the Estate Regulations served both the private and public interest. The Estate Rights in the sixteenth to eighteenth centuries in Lithuania were practiced alongside with other existing legal systems, i.e. the Statute Law, Towns and Canon laws, etc. They all reflected the autonomous state of different law subjects and regulated their relations emerging within. At the same time, the estate rules emphasised their relationship with the Statute Law and importance of legality when formulating their own local regulations. The author presumes that the historical mission of the Estate Rules was more important than the Statute Law for the following two reasons: (1) the estate rules regulated the conduct of the majority of the population (in 1971, 64% of the population lived on estates) and (2) estate rules were carried into effect more consistently and accurately. It was guaranteed by a huge number of estate administration personnel who had the right to immediately apply the local force apparatus measures in respect of the violator. The Statute Law was applied to a rather limited layer of the population (the nobility amounted to only 5 or 6% of the country’s population) . Due to the widespread lawlessness of the nobility and the weak administrative power the State Law was seldom applied. Thanks to its daily labor and obedience, the majority of the population absorbed the destructive effect of the nobility on the state. (shrink)

This paper examines Larry Temkin’s notion of an ‘essentially comparative’ concept and the uses to which he puts it. It is suggested that this notion is a conflation of two distinct notions which need not go together. This leads to a critical examination of Temkin’s arguments that certain central ethical concepts are essentially comparative. These arguments are often found wanting, as is Temkin’s treatment of the Person Affecting View.

Bloom argues that concepts depend on psychological essentialism. He rejects the proposal that concepts are based on perceptual similarity spaces because it cannot account for how we handle new properties and does not fit with our intuitions about essences. I argue that by using a broader notion of similarity space, it is possible to explain these features of concepts.

The paper discusses sortal essentialism': the view that some sortal concepts represent essential properties of the things that fall under them. Although sortal essentialism is widely accepted, there is a dearth of theories purporting to explain why some sortals should have this characteristic. The paper examines two theories that do attempt this explanatory task, theories proposed by Baruch Brody and David Wiggins. It is argued that Brody's theory rests on an untenable principle about "de re" modality, while Wiggins' (...) theory appeals to a thesis about principles of individuation that is either unjustified, or vacuous and incapable of supporting sortal essentialism. In 1956, W.B. Gallie introduced his idea of essentially contested concepts. In my paper, I offer a novel interpretation of his theory and argue that his theory, thus interpreted, is correct. The key to my interpretation lies in a condition Gallie places on essentially contested concepts that other interpreters downplay or dismiss: that the use of an essentially contested concept must be derived “from an original exemplar whose authority is acknowledged by all the contestant users of the concept.” (...) This reveals a similarity between Gallie’s views and the semantic externalist views of Hilary Putnam, and others, about natural kind terms like “water” and “tiger.” I argue that natural kind terms and terms for essentially contested concepts are two species of a single semantic genus. In the case of natural kind terms, a term refers to a natural kind, the exemplars are instances of that kind, and the relation between the exemplars and anything to which the term applies is co-membership of the kind. In the case of terms for essentially contested concepts, a term refers to an historical tradition, the exemplar is a stage or temporal part of that tradition, and the relation between the exemplar and anything to which the term refers is being the heir of. This allows me to understand the contests that alerted Gallie to the phenomenon of essentially contested concepts as contests over the ownership of historical traditions. (shrink)

The text considers points of view of theoreticians of the radical pluralism : Connolly, Mouffe and Tully with regard to the status and the nature of concepts in the political discourse, as well as the consequences of these conceptual presumptions to understanding democracy. The three authors emphasize the essential contestability of political concepts, the paradox of liberal democracy and the need to revise standard rational consensus theories of democracy. Also, the three authors take over the specific interpretation (...) of Vittgenstein to the direction of political theory the centre of which consists of everyday contingent practices of politics as well as dissent about their assessment. The text analyzes the extent to which this reading is compatible to Wittgenstein's position. The author defends the opinion that the essential contestability does not imply agonism and denial of the significance of rules and tries to indicate to the points of illegitimate transition from antiessentialism to unconsensus rules. Also, the text underlines the flaws of dissent conception of democracy and social integration. U tekstu se razmatraju stanovista Konolija, Mufove i Tjulija u pogledu statusa i prirode pojmova u politickom diskursu, kao i posledice ovih konceptualnih pretpostavki na shvatanje demokratije. Sva tri autora isticu esencijalnu spornost politickih pojmova, paradoksalnosti liberalne demokratije i neophodnost revidiranja standardnih racionalno-konsenzusnih teorija demokratije. Takodje, sva tri autora preuzimaju specificno tumacenje Vitgenstajna u pravcu politicke teorije u cijem su sredistu svakodnevne kontingentne prakse politike, kao i disenzus oko njihovog razumevanja i vrednovanja. Autor brani stav da esencijalna spornost pojmova ne podrazumeva agonizam i negiranje znacaja pravila i pokusava da ukaze na tacke nelegitimog prelaza od antiesencijalizma ka nekonsenzusnosti pravila. Takodje, u tekstu se ukazuje na nedostatke radikalne-disenzusne koncepcije demokratije i drustvene integracije. (shrink)

This paper comprises two parts. The first part is an introduction to Auriol’s moderate conceptualism, as it is presented in his Commentary on Book II of the Sentences, distinction 9, question 2, article 1. The second part is an edition of the text. In the introduction, I focus on Auriol’s use of the noetic tool of connotation. My thesis, in particular, is that connotation is a necessary prerequisite to his moderate conceptu- alism. To this purpose, the first part of this (...) introduction will be devoted to a brief presentation of Auriol’s conceptualism. In the second part, Auriol’s theory of essential predication will be presented. In the third part, I will present my claim that Auriol’s theory of essential predication can only be made sense of when read against the background of his theory of connotation as applied to intellectual cognition. The article is devoted to the problems of terminology in the contemporary pop vocal pedagogy field. In the course of the research, which has been conducted from the standpoint of the principle of cultural-conformity, we identified the essence of the concept “contemporary pop vocal-performing thesaurus”, highlighted its structure, and represented the thesaurus in the form of an ontology. The contemporary pop vocal-performing thesaurus as a form of personal activity has a cognitive and creative essence and constitutes an individual professional resource (...) for a performer. As a pedagogical category it is a thematically organized and practically tested outcome of teaching a pop vocalist holistically, and is a renewable interaction of all its components. It consists of cognitive, vocal-technical, artistic-technological, communicative, interpretive, and artistic-figurative components. We note that the artistic-figurative and interpretive components are fully demonstrated in the co-connection of all other components, and reflect the specificity of our concept. We outline some characteristic features of contemporary pop music, the specific components of contemporary non-classical vocal techniques, and modes of presentation of musical information, which are used in the process of forming the contemporary pop vocal-performing thesaurus. We emphasize that the results of our research enable modification of the educational process in the context of contemporary pop vocal, by means of its updating and supplementing with unconventional approaches, principles and methods. Despite the fact that our study primarily concerns the problems of Ukrainian pedagogy we think that its main provisions can apply to the development of methods for teaching pop singing in any country of the world. The eight chapters elucidate the principle branches of Buddhism, the Three Treasures, the elements of existence, the Seals of the Law, dependent origination, the Four Noble Truths, religious practice, and the defilements.

Because “rape” has such a powerful appraisive meaning, how one defines the term has normative significance. Those who define rape rigidly so as to exclude contemporary feminist understandings are therefore seeking to silence some moral perspectives “by definition.” I argue that understanding rape as an essentially contested concept allows the concept sufficient flexibility to permit open moral discourse, while at the same time preserving a core meaning that can frame the discourse.

Zusammenfassung Der vorliegende Beitrag schlägt sechs religionswissenschaftliche Metakonzepte als fachliche Bausteine einer Didaktik für schulische Religionskunde vor. Exemplarisch werden das Metakonzept „Religion als essentially contested concept“ und seine Implikationen für anzustrebende Lernwege im Religionskundeunterricht ausführlich erörtert. Die Metakonzepte bieten nicht nur eine Alternative zu essenzialistischen Kanonentwürfen wie dem Weltreligionenparadigma in der Diskussion um die Inhaltsdimension von Religionskundeunterricht; sie können und sollen auch als Beitrag zum Selbstverständigungsdiskurs der Religionswissenschaft als akademische Disziplin gelesen werden.

In 1956 W. B. Gallie advanced the thesis that certain political concepts, such as that of social justice, are .1 Since then, a considerable literature on the subject has developed, some of it in support of the thesis, some of it in opposition to it.2 W. E. Connolly is a leading supporter of it, and John Gray is a leading opponent of it. However, Connolly's advocacy of it in the second edition of his book is significantly more moderate than (...) that in the first (1974) edition of it. (shrink)

In the Tractatus, Wittgenstein describes the general validity of logical truths as being “essential,” as opposed to merely “accidental” general truths. He does not say much more, and little has been said about it by commentators. How to make sense of the essential general validity by which Wittgenstein characterizes logic? This chapter aims to clarify this crucial concept.

Corporate social responsibility (CSR) has become indispensable in modern business discourse; yet identifying and defining what CSR means is open to contest. Although such contestation is not uncommon with concepts found in the social sciences, for CSR it presents some difficulty for theoretical and empirical analysis, especially with regards to verifying that diverse application of the concept is consistent or concomitant. On the other hand, it seems unfeasible that the diversity of issues addressed under the CSR umbrella would yield (...) to a singular universal definition. Gallie, an eminent philosophical scholar, proposed the essentially contested concepts (ECC) theory in 1956 to address concepts that by their very nature engender perpetual disputes. He pointed out that there are certain concepts which by their very nature are inevitably contested and prescribed seven criteria for evaluating such concepts. This article examines these criteria to discover if CSR is an essentially contested concept and in that case, to construe if such a change in perception will resolve the definitional crisis. The analysis suggests that CSR is an ECC and this explains the potential for several conceptions of CSR, however, it does not totally obviate the need for a definition of its core or common reference point, if only to ensure that the contestants are dealing with an identical subject matter. ABSTRACT When one thinks about the ethics of abortion, one inevitably thinks about rights, since it is in terms of the concept of rights that much of the debate has been conducted. This is true of overtly feminist as well as non‐feminist accounts. Indeed, some early feminist writers – Judith Jarvis Thomson and Mary Ann Warren, for example – employ a model of rights that is indistinguishable, or virtually indistinguishable, from that of their non‐feminist counterparts. However, more recent feminist writers (...) have developed a different understanding of ‘a woman's right to choose.’ In this paper, I will begin by outlining the non‐feminist debate over the moral permissibility of abortion. I will suggest that this debate is irresolvable, since at its heart is an ‘essentially contested concept’, that of personhood. I will then consider the way in which some feminist writers have attempted to reconceive the terms of the abortion debate and suggest an expanded account of women's right to abortion, drawing on the work of Susan Sherwin. Finally, I will argue that there is a further element to a ‘woman's right to choose’ that expands on and provides a conceptual link between the feminist and non‐feminist understanding of abortion. The literature on the metaphysics of gender is partially marked by a tension between conceptions that understand gender categories as importantly at least partly self-determined identities and those that understand them as social or cultural categories imposed upon others as a tool of oppression. I argue that this tension can be mediated by understanding gender categories as essentially contested. I then draw on “radical functionalism” to argue that, while, divorced of context, competing conceptions can simultaneously explicate an essentially contested concept, (...) within context, some conceptions better meet background purposes underlying the use of the concept than others. W B Gallie’s notion of essentially contested concepts remains of philosophical interest. I argue that medicine is one such concept and look at the consequences of this as regards the inappropriateness of looking for definitions and necessary and sufficient conditions to settle debates about what medicine is and is not.

Dicotyledons are polarly organised in several ways. In plant morphology polarity, a principle allowing comparison of different plant structures has until yet not been studied. A division** of the vegetative plant in shoot and root as polar structures leads to the distinction of four instead of three basic organs: leaf, shoot axis, root axis and root cap together with the root hairs. The flower is also polarly organised, its poles are formed by the carpels and the stamens. The foliage leaves (...) are also polarly organised which is reflected by the morphological relationship of foliage leaf, stamen and carpel. The stamen uses the hypophyll*** as base of construction and the carpel uses the epiphyll**** as base of construction. Hypophyll and epiphyll are the two poles of the foliage leaf. Root and shoot, the polar entities of the vegetative plant and stamen and carpel, the polar entities of the generative plant, are morphologically correlated. Stamen and carpel can be understood as a combination of the basic organs of vegetative and generative parts of the plant. The basic organs of the generative plant are pollen grain and embryo sack with their gametophytes. The quantitative comparison of variable proportions is supplemented by a qualitative comparison of polarities. The result is, that the organisation type of the dicotyledons can yet be understood as constituted of morphological related parts.* in german Grundorgane. (shrink)

The issue of Fitting Attitudes inherit the much-discussed ‘wrong kind of reason’ problem (WKR) that afflicts some accounts. The problem remained to attempts to give an account of FA is to specify the right kinds of reasons, to specify the right notion of fittingness. A number of solutions have been proposed to solve WKR. ‘Conceptual thesis’ about attitude formation and the ‘psychological thesis’. The text discusses both of it, raising some questions about them, but also wish to emphasize that the (...) understanding of FA that is supposed to lead to WKR is problematic. An important thing to be brought seems to be that, when applied to essentially contestable concepts, fitting attitude analyses, understood properly (i.e. without unwarranted presuppositions about the very value in dispute) will not result in WKR as conceived in the kinds of examples given earlier. Exploring the issue of Fitting Attitudes and giving to it an alternative account is the main goal of the present paper. Key words: fitting attitudes, contestable, concepts. (shrink)

The long ongoing and partly heated debate on the concept of disease has not led to any consensus on the status of this apparently essential concept for modern health care. The arguments range from claims that the disease concept is vague, slippery, elusive, or complex, and to statements that the concept is indefinable and unnecessary. The unsettled status of the concept of disease is challenging not only to health care where diagnosing, treating, and curing disease are core aims, but (...) also to the branch of philosophy that tries to clarify concepts. This article discusses three claims about the concept of disease: that it is vague, complex, and that it is indefinable. It investigates what is meant by these claims, what their implications are, and whether the claims are sound or not. It is argued that some of the arguments are flawed and miss important points about concept analysis. This does not mean, however, that disease is a clear concept with a crisp definition. It only rules out speculative claims that disease necessarily is vague, complex, and indefinable. It appears at least as hard to show that disease is indefinable as it is to define it. (shrink)
