On December 20, 2002, the Ohio Supreme Court issued an opinion in Dardinger v. Anthem Blue Cross & Blue Shield granting a landmark punitive damages award against the defendant-insurer for breach of contract and bad faith in its coverage of a cancer patient. The court directed that the punitive damages award of $30 million, should it be accepted by the plaintiff, be apportioned between the plaintiff and a cancer research fund to be established in the name of the plaintiff's deceased (...) wife, Esther Dardinger. In so doing, the court broke new ground in the scope and social purpose of punitive damages in health care litigation, as well as the courts’ role in distributing those damages.After being diagnosed with metastatic brain tumors in October 1996, Esther began intra-arterial chemotherapy treatments at the recommendation of her physician, Dr. Newton. Our purpose in this paper is to delineate an ontology for quantum mechanics that results adequate to the formalism of the theory. We will restrict our aim to the search of an ontology that expresses the conceptual content of the recently proposed modal-Hamiltonian interpretation, according to which the domain referred to by non-relativistic quantum mechanics is an ontology of properties. The usual strategy in the literature has been to focus on only one of the interpretive problems of the theory and (...) to design an interpretation to solve it, leaving aside the remaining difficulties. On the contrary, our aim in the present work is to formulate a “global” solution, according to which different problems can be adequately tackled in terms of a single ontology populated of properties, in which systems are bundles of properties. In particular, we will conceive indistinguishability between bundles as a relation derived from indistinguishability between properties, and we will show that states, when operating on combinations of indistinguishable bundles, act as if they were symmetric with no need of a symmetrization postulate. We apply the recently elaborated notions of ‘pragmatic truth’ and ‘pragmatic probability’ to the problem of the construction of a logic of inductive inference. It is argued that the system outlined here is able to overcome many of the objections usually levelled against such attempts. We claim, furthermore, that our view captures the essentially cumulative nature of science and allows us to explain why it is indeed reasonable to accept and believe in the conclusions reached by inductive inference.

This paper argues for Kantian “universalism,” according to which the subject of empirical cognition is not merely individual, but universal. In the first section, I consider the limitations of Hume’s individualist view of the subject of judgment, which is able to explain how another person exerts power over my judgments, but cannot explain how what she says can challenge or support my judgments. In the second section, I argue that Kant’s universalism accounts for the possibility of rational support both among (...) different judgments in me, and among judgments of different subjects. The third section looks at the consequences of universalism for Kant’s account of testimony. I argue that on Kant’s view, it does not matter whether I learn something from my own experience or from your experience. Testimony thus does not emerge in Kant’s philosophy as a significant topic. In the fourth section, I argue that the enlightenment project of overcoming prejudice and acquiring wisdom makes it imperative that knowledge be not only universally shareable, but also actually shared among members of an epistemic community. Accountability is viewed as a civilizing element in society, with professional accountability formalized in most cases as duties dating to the Greeks and Socrates; journalists must find their own way, without formal professional or government regulation or licensing. Three scholars look at the process in a line from the formal professional discipline to suggesting problems the journalism fraternity faces without regulation to suggesting serious internal ethics conferences as 1 solution to the problem.

Schrödinger logics are logical systems in which the principle of identity is not true in general. The intuitive motivation for these logics is both Erwin Schrödinger's thesis (which has been advanced by other authors) that identity lacks sense for elementary particles of modern physics, and the way which physicists deal with this concept; normally, they understandidentity as meaningindistinguishability (agreemment with respect to attributes). Observing that these concepts are equivalent in classical logic and mathematics, which underly the usual physical theories, we (...) present a higher-order logical system in which these concepts are systematically separated. A classical semantics for the system is presented and some philosophical related questions are mentioned. One of the main characteristics of our system is that Leibniz' Principle of the Identity of Indiscernibles cannot be derived. This fact is in accordance with some authors who maintain that quantum mechanics violates this principle. Furthermore, our system may be viewed as a way of making sense some of Schrödinger's logical intuitions about the nature of elementary particles. (shrink)

We formulate Suppes predicates for various kinds of space-time: classical Euclidean, Minkowski's, and that of General Relativity. Starting with topological properties, these continua are mathematically constructed with the help of a basic algebra of events; this algebra constitutes a kind of mereology, in the sense of Lesniewski. There are several alternative, possible constructions, depending, for instance, on the use of the common field of reals or of a non-Archimedian field. Our approach was inspired by the work of Whitehead, though our (...) philosophical stance is completely different from his. The structures obtained are idealized constructs underlying extant, physical space-time. (shrink)

But there is so much precedent for the discovery of fruitful reconceptualizations that in the case of most philosophical and scientific puzzles it is probably irrational ever to give up trying. The notion of qualia, understood as phenomenal properties of sensations that can exist as objects of experience for a conscious (...) subject, is too recent in origin and too specialized in usage to warrant concluding that qualia cannot be understood in terms of physical processes. Humphrey offers an analysis of qualitative mental states that purportedly renders them commensurate with brain states, allowing them to be described in terms of the same dimensions. An improvement on Horwich's so-called pseudo-proof of Russell 's principle of induction is offered, which, we believe, avoids certain objections to the former. Although strictly independent of our other work in this area, a connection can be made and in the final section we comment on this and certain questions regarding rationality, etc.

I discuss some questions of quantum physics, for instance the validity and limitations of the basic language of set theory to deal with problems related to elementary particles. I also present a sketch of a formalization of a “metaphysics of structures”, which might be useful for a kind of “ontic structural realism”, and briefly review the concept of quasi-truth, which underlies my way of understanding scientific theories and the scientific activity.

We present some recent technical results of us on the incompleteness of classical analysis and then discuss our work on the Arnol'd decision problems for the stability of fixed points of dynamical systems.

In reading the Tractatus, one gets the impression that Wittgenstein, having resolved to his satisfaction the problems about language, logic, science, and mathematics, sets these painstakingly articulated findings in a disproportionately skimpy setting. There is a perfunctory ontology at the beginning, which is highly original as well as austere and perplexing; and at the end he hurries even more than usual through ethics, aesthetics and religion—as if the silence was already coming upon him, prematurely. The Notebooks 1914–1916 help a good (...) deal in understanding this skimpy setting. They give little direct indication of the ontological overture, apart from their frequent reiteration that there must be simples of some sort if the sense of expressions is to be determinate, but they give a fuller treatment to the other topics. This is particularly true of the latter half of 1916, when this parcel of topics seems to have become uppermost in Wittgenstein’s mind. Though it is exceedingly difficult to know what to make of what are in effect discarded notes, some of the entries are just too interesting to ignore. I wish to consider what light they throw on his thought at roughly the Tractatus period, and in particular on the ontology that apparently springs up full grown at the beginning of the Tractatus. Does “business ethics,” as we have developed it in the United States, apply without change when business goes abroad? We argue that we cannot assume, in foreign nations (especially in the developing world), that the assumptions of U.S. business practice and business ethics hold without modification. An attempt to find a universally applicable ethic for global business results in the tentative formulation of “ten commandments” to guide the practice of business in the nations of the world.
