Adolescents, in many jurisdictions, have the power to consent to life saving treatment but not necessarily the power to refuse it. A recent defence of this asymmetry is Neil Manson's theory of ‘transitional paternalism’. Transitional paternalism holds that such asymmetries are by-products of sharing normative powers. However, sharing normative powers by itself does not entail an asymmetry because transitional paternalism can be implemented in two ways. Manson defends the asymmetry-generating version of transitional paternalism in the clinical context, arguing that it (...) maximizes respect for adolescent autonomy. This article offers an alternative argument in favour of the asymmetry-generating form of transitional paternalism, one that makes appeal to obligations that individuals have to develop self-governance in others. We should share normative powers asymmetrically in the clinical context for three reasons. First, the asymmetric version of transitional paternalism takes seriously duties to support adolescents’ developing autonomy, alongside other duties that adults have to young people. It does so by enabling young people to be involved in important decisions that they would otherwise be excluded from. This is of value because participation of this sort is central to the cultivation of their self-governance. Second, only the asymmetric version gives young people a voice in respect of all clinical actions, and only the asymmetric version leaves open the possibility that the coarse lines of legislation might be ‘fine-tuned’ in individual cases. Third, the asymmetric sharing of normative powers is consistent with the kind of social arrangements that best support autonomy. (shrink)

The increasing interest in online shopping in recent years has increased the importance of understanding customer engagement valence in a virtual service network. There is yet a comprehensive explanation of the CEV concept, particularly its impact on multi-actor networks such as web stores. Therefore, this study aims to fill this research gap. In this study, past literature in the marketing and consumer psychology field was critically reviewed to understand the concept of CEV in online shopping, and the propositional-based style was (...) employed to conceptualize the CEV within the online shopping context. The outcomes demonstrate that the valence of customer engagement is dependent on the cognitive interpretation of signals that are prompted by multiple actors on a web store service network. If the signals are positively interpreted, positive outcomes such as service co-creation are expected, but if they are negatively interpreted, negative outcomes such as service co-destruction are predicted. Trust is indispensable not only for interpersonal relationships and social life, but for good quality healthcare. As manifested in the increasing violence and tension in patient-physician relationships, China has been experiencing a widespread and profound crisis of patient–physician trust. And globally, the crisis of trust is an issue that every society, either developing or developed, has to face in one way or another. Yet, in spite of some pioneering works, the subject of patient-physician trust and mistrust – a crucial matter (...) in healthcare especially because there are numerous ethical implications – has largely been marginalized in bioethics as a global discourse. Drawing lessons as well as inspirations from China, this paper demonstrates the necessity of a trust-oriented bioethics and presents some key theoretical, methodological and philosophical elements of such a bioethics. A trust-oriented bioethics moves beyond the current dominant bioethical paradigms through putting the subject of trust and mistrust in the central agenda of the field, learning from the social sciences, and reviving indigenous moral resources. In order for global bioethics to claim its relevance to the things that truly matter in social life and healthcare, trust should be as vital as such central norms like autonomy and justice and can serve as a potent theoretical framework. Interpretations of family carer empowerment in much nursing research, and in home‐care practice and policy, rarely attend explicitly to families’ choice or control about the nature, extent or length of their involvement, or control over the impact on their own health. In this article, structural empowerment is used as an analytic lens to examine home‐care nurses’ interactions with families in one Western Canadian region. Data were collected from 75 hrs of fieldwork in 59 interactions (18 nurses visiting 16 families) and (...) interviews with 12 nurses and 11 family carers. Generally, nurses prioritized client empowerment, and their practice with families appeared oriented to supporting their role and needs as carers (i.e. rather than as unique individuals beyond the caring role), and reinforcing the caring role through validation and recognition. Although families generally expressed appreciation for these interactions, a structural empowerment lens illustrates how the broad context of home care shapes the interpretation and practice of empowerment in ways that can, paradoxically, be disempowering for families. Opportunities to effectively support family choice and control when a client is being cared for at home are discussed. (shrink)

This study examines the role of acculturation in shaping consumers’ views of ethics. Specifically, it examines the relationships between the desire to keep one’s original culture, the desire to adopt the host culture, and the four dimensions of the Muncy and Vitell (Journal of Business Research Ethics 24(4), 297, 1992) consumer ethics scale. Using two separate immigrant populations – one of former Middle-Eastern residents now living in the U.S. and the other of Asian immigrants in the U.S. – results indicate (...) that those who want to keep their original culture are less tolerant of unethical consumer activities, while those who are more willing to adopt the host culture are more tolerant of these same consumer activities. Furthermore, the immigrants in both studies who are more tolerant of unethical consumer activities are those who are generally somewhat younger and with less formal education. To investigate the phenomenon of patient–physician mistrust in China, a qualitative study involving 107 physicians, nurses and health officials in Guangdong Province, southern China, was conducted through semi-structured interviews and focus groups. In this paper we report the key findings of the empirical study and argue for the essential role of medical professionalism in rebuilding patient-physician trust. Health professionals are trapped in a vicious circle of mistrust. Mistrust leads to increased levels of fear and self-protection by doctors which exacerbate difficulties (...) in communication; in turn, this increases physician workloads, adding to a strong sense of injustice and victimization. These factors produce poorer healthcare outcomes and increasingly discontented and angry patients, escalate conflicts and disputes, and result in negative media coverage, all these ultimately contributing to even greater levels of mistrust. The vicious circle indicates not only the crisis of patient-physician relationship but the crisis of medicine as a profession and institution. Underlying the circle is the inherent conflict of interest in the healthcare system by which health professionals and hospitals have become profit-driven. This institutional conflict of interest seriously compromises the fundamental principle of medical professionalism—the primacy of patient welfare—as well as the traditional Chinese ideal of “medicine as the art of humanity”. Patient trust can be restored through rectifying this institutional conflict of interest and promoting medical professionalism via a series of recommended practical measures. (shrink)

California has focused on health equity in the state’s COVID-19 reopening plan. The Blueprint for a Safer Economy assigns each of California’s 58 counties into 1 of 4 tiers based on 2 metrics: test positivity rate and adjusted case rate. To advance to the next less-restrictive tier, counties must meet that tier’s test positivity and adjusted case rate thresholds. In addition, counties must have a plan for targeted investments within disadvantaged communities, and counties with more than 106 000 residents must (...) meet an equity metric. California's explicit incorporation of health equity into its reopening plan underscores the interrelated fate of its residents during the COVID-19 pandemic and creates incentives for action. This article evaluates the benefits and challenges of this novel health equity focus, and outlines recommendations for other US states to address disparities in their reopening plans. (shrink)

HIV remission clinical researchers are increasingly seeking study participants who are diagnosed and treated during acute HIV infection—the brief period between infection and the point when the body creates detectable HIV antibodies. This earliest stage of infection is often marked by flu-like illness and may be an especially tumultuous period of confusion, guilt, anger, and uncertainty. Such experiences may present added ethical challenges for HIV research recruitment, participation, and retention. The purpose of this paper is to identify potential ethical challenges (...) associated with involving acutely diagnosed people living with HIV in remission research and considerations for how to mitigate them. We identify three domains of potential ethical concern for clinicians, researchers, and ethics committee members to consider: 1) Recruitment and informed consent; (2) Transmission risks and partner protection; and (3) Ancillary and continuing care. We discuss each of these domains with the aim of inspiring further work to advance the ethical conduct of HIV remission research. For example, experiences of confusion and uncertainty regarding illness and diagnosis during acute HIV infection may complicate informed consent procedures in studies that seek to recruit directly after diagnosis. To address this, it may be appropriate to use staged re-consent procedures or comprehension assessment. Responsible conduct of research requires a broad understanding of acute HIV infection that encompasses its biomedical, psychological, social, and behavioral dimensions. We argue that the lived experience of acute HIV infection may introduce ethical concerns that researchers and reviewers should address during study design and ethical approval. (shrink)

Introduction Future HIV vaccine efficacy trials with adolescents will need to ensure that participants comprehend study concepts in order to confer true informed assent. A Hepatitis B vaccine trial with adolescents offers valuable opportunity to test youth understanding of vaccine trial requirements in general. Methods Youth reviewed a simplified assent form with study investigators and then completed a comprehension questionnaire. Once enrolled, all youth were tested for HIV and confirmed to be HIV-negative. Results 123 youth completed the questionnaire (mean age=15 (...) years; 63% male; 70% Hispanic). Overall, only 69 (56%) youth answered all six questions correctly. Conclusions Youth enrolled in a Hepatitis B vaccine trial demonstrated variable comprehension of the study design and various methodological concepts, such as treatment group masking. (shrink)

How do historians, comparative linguists, biblical and textual critics and evolutionary biologists establish beliefs about the past? How do they know the past? This book presents a philosophical analysis of the disciplines that offer scientific knowledge of the past. Using the analytic tools of contemporary epistemology and philosophy of science the book covers such topics as evidence, theory, methodology, explanation, determination and underdetermination, coincidence, contingency and counterfactuals in historiography. Aviezer Tucker's central claim is that historiography as a scientific discipline (...) should be thought of as an effort to explain the evidence of past events. He also emphasizes the similarity between historiographic methodology to Darwinian evolutionary biology. Andrew Bacon, John Hawthorne, and Gabriel Uzquiano have recently argued that free logics—logics that reject or restrict Universal Instantiation—are ultimately not promising approaches to resolving a family of intensional paradoxes due to Arthur Prior. These logics encompass ramified and contextualist approaches to paradoxes, and broadly speaking, there are two kinds of criticism they face. First, they fail to address every version of the Priorean paradoxes. Second, the theoretical considerations behind the logics make absolutely general statements about all propositions, properties of (...) propositions, etc., but because this sort of intensional quantification is always restricted in the logics, they cannot even express those considerations. I present a novel sort of free logic, which rejects the standard Universal Instantiation but validates a restricted form of the rule, and which addresses both kinds of criticism by allowing some propositions to be unrestricted in their quantification. It may seem that epistemic and practical rationality weigh reasons differently, because ties in practical rationality tend to generate permissions and ties in epistemic rationality tend to generate a requirement to withhold judgment. I argue that epistemic and practical rationality weigh reasons in the same way, but they have different "default biases". Practical rationality is biased toward every option being permissible whereas epistemic rationality is biased toward withholding judgment's being required.

Philosophers have often noted that science displays an uncommon degree of consensus on beliefs among its practitioners. Yet consensus in the sciences is not a goal in itself. I consider cases of consensus on beliefs as concrete events. Consensus on beliefs is neither a sufficient nor a necessary condition for presuming that these beliefs constitute knowledge. A concrete consensus on a set of beliefs by a group of people at a given historical period may be explained by different factors according (...) to various hypotheses. A particularly interesting hypothesis from an epistemic perspective is the knowledge hypothesis: shared knowledge explains a consensus on beliefs. If all the alternative hypotheses to the knowledge hypotheses are false or are not as good in explaining a concrete consensus on beliefs, the knowledge hypothesis is the best explanation of the consensus. If the knowledge hypothesis is best, a consensus becomes a plausible, though fallible, indicator of knowledge. I argue that if a consensus on beliefs is uncoerced, uniquely heterogeneous and large, the gap between the likelihood of the consensus given the knowledge hypothesis and its likelihoods given competing hypotheses tends to increase significantly. Consensus is a better indicator of knowledge than "success" or "human flourishing". (shrink)

We have begun a theory of measurement in which an experimenter and his or her experimental procedure are modeled by algorithms that interact with physical equipment through a simple abstract interface. The theory is based upon using models of physical equipment as oracles to Turing machines. This allows us to investigate the computability and computational complexity of measurement processes. We examine eight different experiments that make measurements and, by introducing the idea of an observable indicator, we identify three distinct forms (...) of measurement process and three types of measurement algorithm. We give axiomatic specifications of three forms of interfaces that enable the three types of experiment to be used as oracles to Turing machines, and lemmas that help certify an experiment satisfies the axiomatic specifications. For experiments that satisfy our axiomatic specifications, we give lower bounds on the computational power of Turing machines in polynomial time using nonuniform complexity classes. These lower bounds break the barrier defined by the Church-Turing Thesis. (shrink)

A critical study of the philosophy and political practice of the Czech dissident movement Charter 77. Aviezer Tucker examines how the political philosophy of Jan Patocka (1907–1977), founder of Charter 77, influenced the thinking and political leadership of Vaclav Havel as dissident and president. Presents the first serious treatment of Havel as philosopher and Patocka as a political thinker. Through the Charter 77 dissident movement in Czechoslovakia, opponents of communism based their civil struggle for human rights on philosophic foundations, (...) and members of the Charter 77 later led the Velvet Revolution. After Patocka's self-sacrifice in 1977, Vaclav Havel emerged a strong philosophical and political force, and he continued to apply Patocka's philosophy in order to understand the human condition under late communism and the meaning of dissidence. However, the political/philosophical orientation of the Charter 77 movement failed to provide President Havel with an adequate basis for comprehending and responding to the extraordinary political and economic problems of the postcommunist period. In his discussion of Havel's presidency and the eventual corruption of the Velvet Revolution, Tucker demonstrates that the weaknesses in Charter 77 member's understanding of modernity, which did not matter while they were dissidents, seriously harmed their ability to function in a modern democratic system. Within this context, Tucker also examines Havel's recent attempt to topple the democratic but corrupt government in 1997–1998. The Philosophy and Politics of Czech Dissidence from Patocka to Havel will be of interest to students of philosophy and politics, scholars and students of Slavic studies, and historians, as well as anyone fascinated by the nature of dissidence. An algebra is effective if its operations are computable under some numbering. When are two numberings of an effective partial algebra equivalent? For example, the computable real numbers form an effective field and two effective numberings of the field of computable reals are equivalent if the limit operator is assumed to be computable in the numberings . To answer the question for effective algebras in general, we give a general method based on an algebraic analysis of approximations by elements of (...) a finitely generated subalgebra. Commonly, the computable elements of a topological partial algebra are derived from such a finitely generated algebra and form a countable effective partial algebra. : Heidegger describes Dasein as subject to a constant pressure to bring its intentional performances into agreement with those of its peers and thence with a generic description of ‘what one [das Man] does’, called Dasein's conformism. I argue that extant accounts of this pressure, which appeal to the essential social embeddedness of intentional performance, fail to account for both the scope and modal force of the demand to act as one does. I propose that we can better understand the (...) role of das Man in Heidegger's account of intentional agency by exploiting a structural similarity between ‘Dasein’ and the familiar notion of epistemic capacity, or a power of knowledge. The result is an account that locates the source of das Man's authority not in our social nature but in our shared aspiration to ontological understanding. (shrink)

Background Community advisory boards have expanded beyond high-income countries and play an increasing role in low- and middle-income country research. Much research has examined CABs in HICs, but less is known about CABs in LMICs. The purposes of this scoping review are to examine the creation and implementation of CABs in LMICs, including identifying frequently reported challenges, and to discuss implications for research ethics. Methods We searched five databases for publications describing or evaluating CABs in LMICs. Two researchers independently reviewed (...) articles for inclusion. Data related to the following aspects of CABs were extracted from included publications: time, country, financial support, research focus, responsibilities, and challenges. Thematic analyses were used to summarize textual data describing challenges. Results Our search yielded 2005 citations, 83 of which were deemed eligible for inclusion. Most studies were published between 2010 and 2017. Upper-middle-income countries were more likely to have studies describing CABs, with South Africa, China, and Thailand having the greatest numbers. The United States National Institutes of Health was the main source of financial support for CABs. Many CABs focused on HIV research. Thirty-four studies reported how CABs influenced the informed consent process for clinical trials or other aspects of research ethics. CAB responsibilities were related to clinical trials, including reviewing study protocols, educating local communities about research activities, and promoting the ethical conduct of research. Challenges faced by CABs included the following: incomplete ethical regulations and guidance; limited knowledge of science among members of communities and CABs; unstable and unbalanced power relationships between researchers and local communities; poor CAB management, including lack of formal participation structures and absence of CAB leadership; competing demands for time that limited participation in CAB activities; and language barriers between research staff and community members. Several challenges reflected shortcomings within the research team. Conclusions Our findings examine the formation and implementation of CABs in LMICs and identify several ethical challenges. These findings suggest the need for further ethics training among CAB members and researchers in LMICs. (shrink)

The metaphor of weighing reasons brings to mind a single (double-pan balance) scale. The reasons for φ go in one pan and the reasons for ~φ go in the other. The relative weights, as indicated by the relative heights of the two pans of the scale, determine the deontic status of φ. This model is simple and intuitive, but it cannot capture what it is to weigh reasons correctly. A reason pushes the φ pan down toward permissibility (has justifying weight) (...) only insofar as it pushes the ~φ pan up toward impermissibility (has requiring weight). Thus, Single Scale is committed to Single Proportion (first pass): all reasons have the same proportion of justifying and requiring weight. Many normative theories reject Single Proportion, and they are not thereby confused about how to weigh reasons. One can be mistaken about the weight of a reason without being confused about how reasons are to be weighed. Single Scale is problematic, not because it appeals to the image of a scale, but because it appeals to the image of a single scale. We need two scales to capture what it is to weigh reasons correctly. (shrink)

This discussion examines the emergence of professional codes of ethics, influences that shape contemporary midwifery ethics, and the adequacy of codes to actualize values embedded in the midwifery ethics discourse. It considers the traditions of professional practice, the impact of institutionalization on health care, the application of a code of practice as a recent addition to those traditions, and the strengths and weaknesses of codes of ethics as models for ethical responses. That is, it sets out to articulate and deconstruct (...) existing frames of ethical response. The ethics of strangers (normative theory and abstract principles) are rejected as inadequate, and the ethics of intimates (feminist-relational ethics) are proposed as a more adequate guide for well-woman centred midwifery practice. Using the terms "cosmology" and "cultivation," the religious nature of Confucianism is explored, beginning with a discussion of the ambiguity surrounding Confucianism and its political uses, which often obscure its religious dimensions. It is also assumed that categories of Western theology such as immanence and transcendence are not adequate to describe Confucianism as religious. In this spirit, it is suggested that beyond political distortions or theoretical interpretations, Confucianism has religious dimensions that need to be explored further. The interaction of the (...) microcosm of the self with the macrocosm of the universe is a central dialectic for establishing inner and outer harmony. Thus, cultivating oneself, responding morally to the social and political order, and resonating with the patterns in nature are at the heart of Confucian religiosity. This is illustrated by two examplars of the Japanese Neo-Confucian tradition: Yamazaki Ansai (1618-1682) and Kaibara Ekken (1630-1714). (shrink)

This chapter examines what role new behaviour-modification policies – commonly known as “nudges” – might play in cultivating virtues. At first sight, they would appear to be ruled out as a candidate means; but, by offering a more nuanced analysis, the chapter argues that some nudges have virtue-cultivating properties. It distinguishes between two kinds of nudges – 'automatic-behavioural' and 'discernment-developing' – and shows that what divides them is the ability of the latter, which the former lacks, to play an ecological-educative (...) role in developing the virtue of practical reason, which is required for the other virtues too. It thus provides an answer to the question of whether virtue-cultivating nudges are possible, while remaining neutral on whether virtue cultivation is, or under what conditions it could be, a legitimate aim of liberal-democratic states.
