An increasingly long line of high-profile scientific misconduct cases raises the question of whether regulatory policy ought to incorporate more rigorous sanctions for investigators and their institutions. Broad and Wade graphically describe these cases through the early 1980s. They continue to recent times with the cases of Evan Dreyer, Kimon Angelides and Robert Liburdy, Justin Radolf, and others. In addition, recent Congressional investigation into conflict of interest concerns surrounding consulting by National Institutes of Health scientists has raised further questions (...) about ethical standards. The record of continuing scandal suggests that current policy may not be optimal for controlling scientific misconduct. Would an alternative policy better minimize its incidence and associated costs?What should we expect of public policy governing misconduct by American scientists? U.S. regulations do not afford consistent protections to human research subjects. One complaint is that they focus on federally sponsored research, with private research covered only if it falls under the jurisdiction of the Food and Drug Administration. This paper examines a deeper problem: Even when the regulations do apply, they still do not afford consistent standards of protection. The U.S. Common Rule and related FDA regulations lack a workable regulatory control mechanism.

The literature on mathematical explanation contains numerous examples of explanatory, and not so explanatory proofs. In this paper we report results of an empirical study aimed at investigating mathematicians’ notion of explanatoriness, and its relationship to accounts of mathematical explanation. Using a Comparative Judgement approach, we asked 38 mathematicians to assess the explanatory value of several proofs of the same proposition. We found an extremely high level of agreement among mathematicians, and some inconsistencies between their assessments and claims in the (...) literature regarding the explanatoriness of certain types of proofs. A well-established narrative in the history of science has it that the years around 1800 saw the end of a purely descriptive, classificatory and static natural history. The emergence of a temporal understanding of nature and the new developmental-history approach, it is thought, permitted the formation of modern biology. This paper questions that historical narrative by closely analysing the concepts of development, history and time set out in Karl Ernst von Baer’s study of the mammalian egg (1827). I show that (...) Baer’s research on embryogenesis aimed not simply to explain temporal changes, but to inscribe the formation of new individual organisms into a continuous, unending organic process. I confront Baer’s views with other explanations of embryogenesis arising in the 1820s and 1830s, especially those of Jean-Baptiste Dumas and Jean-Louis Prévost and of Theodor Schwann. By highlighting divergences between these scientists, especially as to their view of the role of gender differences in reproduction, I argue that biology evolved not from a homogeneous concept of developmental history but out of various, even opposing, views and research programmes. Thus, the birth of biology did not imply the end of all natural history’s thought models. (shrink)

This paper supports the literature which argues that derivational robustness can have epistemic import in highly idealized economic models. The defense is based on a particular example from mathematical economic theory, the dynamic Walrasian general equilibrium model. It is argued that derivational robustness first increased and later decreased the credibility of the Walrasian model. The example demonstrates that derivational robustness correctly describes the practices of a particular group of influential economic theorists and provides support for the arguments of philosophers who (...) have offered a general epistemic justification of such practices. In this volume, Charles Taliaferro and Jil Evans promote aesthetic personalism by examining three domains of aesthetics - the philosophy of beauty, aesthetic experience, and philosophy of art - through the lens of Judaism, Christianity, Islam, theistic Hinduism, and the all-seeing Compassionate Buddha. These religious traditions assume an inclusive, overarching God's eye, or ideal point of view, that can create an emancipatory appreciation of beauty and goodness. This appreciation also recognizes the reality and value of the aesthetic experience of (...) persons and deepens the experience of art works. The authors also explore and contrast the invisibility of persons and God. The belief that God or the sacred is invisible does not mean God or the sacred cannot be experienced through visual and other sensory or unique modes. Conversely, the assumption that human persons are thoroughly visible, or observable in all respects, ignores how racism and other forms of bias render persons invisible to others. (shrink)

The notion of patients’ duties has received periodic scholarly attention but remains overwhelmed by attention to the duties of healthcare professionals. In a previous paper the author argued that patients in publicly funded healthcare systems have a duty to participate in clinical research, arising from their debt to previous patients. Here the author proposes a greatly extended range of patients’ duties grounding their moral force distinctively in the interests of contemporary and future patients, since medical treatment offered to one patient (...) is always liable to be an opportunity cost in terms of medical treatment needed by other patients. This generates both negative and positive duties. Ten duties—enjoining obligations ranging from participation in healthcare schemes to promoting one’s own earliest recovery from illness—are proposed. The characteristics of these duties, including their basis, moral force, extent and enforceability, are considered. They are tested against a range of objections—principled, societal, epistemological and practical—and found to survive. Finally, the paper suggests that these duties could be thought to reinforce a regrettably adversarial characteristic, shared with rights-based approaches, and that a preferable alternative might be sought through the notion of a “virtuous patient” contributing to a problem-solving partnership with the clinician. However, in defining and giving content to that partnership, there is a clear role for most, if not all, of the proposed duties; their value thus extends beyond the adversarial context in which they might first be thought to arise. Abstract Occupational stress in nursing has attracted considerable attention as a focus for research and as a consequence multiple objects of nurses' stress, or 'stressors', have been identified. This paper puts into question the dominant conceptual and methodological approach to occupational stress in nursing research by both foregrounding the notion of anxiety and juxtaposing it with the notion of 'stress'. It is argued that the notion of 'stress' and the domination of the questionnaire have produced a narrow reading of the (...) topic. Some of the literature on occupational stress/anxiety in nursing is reviewed and our analysis illustrates how the identified objects of stress have a tendency to multiply contingent on the number of studies undertaken. Thus definitive objects of nurses' stress remain elusive. We argue that a return to the notion of 'anxiety' and methodological approaches other than empirical ones can bring both depth and breadth to the consideration of occupational distress in nursing. Further, we argue that the object of 'anxiety' is unconscious, thus unknown, and given this, a more informative approach is to map nurses' response to anxiety, the discursive formations arising out of anxiety, rather than attempt to define those objects of anxiety. This paper forms an introduction to this issue, the contents of which arose directly or indirectly from a conference in May 2001 on Corruption of scientific integrity? — The commercialisation of academic science. The introduction, in recent decades, of business culture and values into universities and research institutions is incompatible with the openness which scientific and all academic pursuit traditionally require. It has given rise to a web of problems over intellectual property and conflict of interest which has even led (...) to corporate sponsors’ suppressing unfavourable results of clinical trials, to the detriment of patients’ health. Although there are those who see the norms of science developing to recognise the importance of instrumental science aiming at specific goals and of knowledge judged by its value in a context of application, none justifies the covert manipulation of results by vested interest. Public awareness of these problems is growing and creating a climate of opinion where they may be addressed. We suggest a way forward by the introduction of nationally and internationally-accepted guidelines for industrial collaboration which contain proper protections of the core purposes of universities and of the independence of their research. Some codes suggested for this purpose are discussed. We note that some universities are moving to adopt such codes of conduct, but argue the need for strong support from the government through its funding bodies. (shrink)

Background The opioid epidemic has enabled rapid and unsurpassed use of big data on people with opioid use disorder to design initiatives to battle the public health crisis, generally without adequate input from impacted communities. Efforts informed by big data are saving lives, yielding significant benefits. Uses of big data may also undermine public trust in government and cause other unintended harms. Objectives We aimed to identify concerns and recommendations regarding how to use big data on opioid use in ethical (...) ways. Methods We conducted focus groups and interviews in 2019 with 39 big data stakeholders who had interest in or knowledge of the Public Health Data Warehouse maintained by the Massachusetts Department of Public Health. Results Concerns regarding big data on opioid use are rooted in potential privacy infringements due to linkage of previously distinct data systems, increased profiling and surveillance capabilities, limitless lifespan, and lack of explicit informed consent. Also problematic is the inability of affected groups to control how big data are used, the potential of big data to increase stigmatization and discrimination of those affected despite data anonymization, and uses that ignore or perpetuate biases. Participants support big data processes that protect and respect patients and society, ensure justice, and foster patient and public trust in public institutions. Recommendations for ethical big data governance offer ways to narrow the big data divide, enact shared data governance, cultivate public trust and earn social license for big data uses, and refocus ethical approaches. Conclusions Using big data to address the opioid epidemic poses ethical concerns which, if unaddressed, may undermine its benefits. Findings can inform guidelines on how to conduct ethical big data governance and in ways that protect and respect patients and society, ensure justice, and foster patient and public trust in public institutions. This paper argues that Kierkegaard is not an irrationalist, but a "responsible fideist." Responsible fideism attempts to answer two important philosophical questions: "Are there limits to reason?" and "How can the limits of reason be recognized?" Kierkegaard's account of the incarnation as "the absolute paradox" does not see the incarnation as a logical contradiction, but rather functions in a way similar to a Kantian antimony. Before we take up the arguments directly, there is one general point about Socrates' position that he considered essential to everything he said in the Crito. Also, he thought that this point was easily missed. He calls it his "starting point." It is that "we ought neither to requite wrong with wrong nor to do evil to anyone, no matter what he may have done to us." And Socrates warns Crito not to accept this position too quickly or without full (...) consideration, "for I know that there are few who believe or ever will believe this". Yet this moral principle is so essential to his arguments that "those who believe this, and those who do not, have no common ground of discussion, but they must necessarily, in view of their opinions, despise one another". Face à des enjeux planétaires qui se multiplient et à leurs pronostics de plus en plus inquiétants, les injonctions à agir vite s’imposent avec une certaine évidence. Si la proposition semble tenir du bon sens et ne pas nécessiter qu’on s’y arrête, il convient de prendre un peu de recul, au contraire. S’autoriser à prendre le temps : le temps de la déconstruction des évidences, à commencer par celle de la définition de l’urgence qui invite à de nouveaux engagements, suivi (...) d’un temps nécessaire à l’élaboration d’une réponse appropriée, et ainsi de suite… Sans parler du temps du partage nécessaire, dès lors que la cause se doit d’être collective et non simplement individuelle et personnelle. Sans remettre en cause la légitimité des alertes écologiques, il convient de réfléchir à des modalités d’action permettant tout à la fois des engagements fermes en matière de transformation sociale et la prise en compte d’imprévus. L’article conclut par la présentation de quelques innovations dans le domaine des projets urbains qui tentent de combiner ces deux enjeux. Given what we know about the nature of knowledge and scientific work it no longer makes sense to think of scientific knowledge as demarcated from “ordinary” knowledge through its methods or the characteristics of the scientific community. As the social studies of science have shown, boundaries become ambiguous when viewed close up so that science merges with ordinary knowledge. But does this mean that distinctions between knowledge claims rest on nothing more than social conventions, powerful as these might be? The (...) articles in this special issue address this question from a variety of perspectives, while this introduction sets out this broader framework and highlights the themes that unite the individual articles. Our central argument is that although boundary work is difficult, complex, and contingent, it is too important to be left to chance or tradition. The Carolingian empire in western Europe has long been defined by its military expansion and Christian renewal. Carolingian historical narratives portrayed their victories as divine gifts and so encouraged soldiers and commanders to interpret their actions within a theological hermeneutic. Previous scholars have seen this hermeneutic as justifying war. This paper shall argue instead that these narratives reflected and reinforced the hermeneutic with which soldiers interpreted their campaigns and the military spirituality practised as a result. This article proposes that Horace's Epodes and Ovid's Metamorphoses open with significant acrostics that comprise the first two letters, in some cases forming syllables, of successive lines: IB-AM/IAMB (Epod. 1.1–2) and IN-CO-(H)AS (Met. 1.1–3). Each acrostic, it will be argued, tees up programmatic concerns vital to the work it opens: generic identity and the interrelation of form and content (Epodes), etymology and monumentality (Metamorphoses). Moreover, as befits their placement at the head of collections, both acrostics negotiate the challenge of literary (...) commencement. The introduction reviews recent developments in acrostic studies and discusses important predecessors and parallels for Horace's and Ovid's ‘two-letter’ and syllabic acrostics. Two subsequent sections examine the acrostics singly, and a conclusion compares the dialogues that these acrostics open between author and reader, underscoring the welcome challenge which Ovid's acrostic offers to the prevailing scholarly view that this form of wordplay is a strictly visual affair. Feminist scholars have long critiqued the fashion industry’s ultra-thin beauty standards as harmful to women. Combining data from three qualitative studies of women’s clothing retailers—of bras, plus-size clothing, and bridal wear—we shift the analytical focus away from glamorized media images toward the seemingly mundane realm of clothing size standards, examining how women encounter, understand, and navigate these standards in their daily lives. We conceptualize clothing size standards as “floating signifiers,” given their lack of consistency within and across brands and the (...) extent to which women engage in identity work and body work in relation to them. Our findings indicate that the instability of these unregulated standards allows some women—particularly those with bodies located closest to the boundaries between size categories—to claim conformity to body ideals and to access some of the associated psychological, social, and material privileges. However, even as individual women may benefit by distancing themselves from stigmatized size categories, this pattern renders women’s body acceptance tenuous while simultaneously reinforcing hierarchies among women based on body size and shape. This article is a sequel to an earlier exploration of the possibility of a shift in the Book of Tobit from the Deuteronomistic theological perspective in the beginning to a more nuanced concept of theodicy in the end. The Semitic versions of Tobit found at Qumran are regarded as the earliest witnesses to the story of Tobit, dating from ca. 100 BCE to the early part of the 1st century CE. They are very fragmentary, but the theme of almsgiving recurs (...) at regular intervals in the narrative. In the beginning the Deuteronomistic theological perspective is expressed in terms of Tobit’s belief that God will reward with prosperity those who give alms to their own kinsmen, but towards the end the ideology appears to shift from the rather self-centred ‘prosperity cult’ orientation to a different motivation for almsgiving. The aim of this article is to test the possibility that the almsgiving references are rhetorical hinges that mark the movement of the narrative into a different ideological viewpoint. The complexity of the manuscript transmission of the story of Tobit in the larger matrix of diachronic cultural and religious trends in the ancient Near East is kept in mind when text-critical problems are encountered.
